Chairman Erickson said these items were continued because we requested
some additional information which we have received in a separate packet. We
also asked for the total plan to be presented.
Mr. Boardman showed the Planning Commission a drawing which included
' all five phases as they are laid out now.
. Mr. Erickson said it was primarily a topography problem that made the
changes necessary in Phase IV and V.
Chairman Erickson said that as he read through the minutes, it repeatedly
states that any parking problems for the recreation building should be solved
in Phase III. Mr. Boardman said Phase III was the quadraminium portion of
the development. He said he wondered when it was stipulated, that the parking
problems be solved in Phase III; zf the Council and Planning Commission didn't
think that what is now Phase IV would be Phase III.
Mr. Clark said the recreation building was considered by itself and 14
stalls were provided on that plan. We did find where 6 stalls could be
provided in Phase II on Meister Road by widening this road. When Mr. Qureshi
mentioned at the Council meeting in November, that more parking should be
provided, there was additional room in Phase IV and V before the plan was
changed. Mr. Erickson said it looked like they could provide 20 or 30 stalls
on the original plan.
^ Mr. Minish said he was not clear on what the proposal was for parking
�� spaces for the recreation building. Mr. London said the original proposal
� showed 14 parking stalls and with the six they were picking up along Meister
Road, it would be a total of 20 stalls.

Mr. Minish asked how many persons would be eligible to use the recreation
building. Mr. London said there were 276 townhouses. He said there would be
an average of 3 people to a townhouse. Mr. Minish said that would be about
800 people. He asked what the farthest distance would be from the recreation
building and what the average distance would be. Mr. London thought the
average distance would be about two blocks, and the farthest distance would
be about 1,000 feet.
Mr. Clark said this is just a preliminary plan. Mr. Qureshi would be
back before final plan approval was made and they would know by then how
much parking he was looking for.
Mr. Harris wondered how much this recreation building would be used in
the winter time. Mr. Clark said there could be outside people coming in to
use the party rooms.
Mr. Harris asked how many people could use the recreation room at one
time. Mr, London said he thought about 50. Mr. Harris said if you figured
two people to a car, it would sound like they were looking for about 25
parking spaces, or five more than could be provided for now. Mr. London
said we could pick up about 200 feet along Meister Road. Mr. Zeglen thought
25 stalls would be enough. Mr. Fitzpatrick said he didn't think the problem
would be so much with the owners of the townhouses as there would be with

outside people coming in to use the party rooms.
Chairman Erickson said his major concern is that after this plan is
approved, and there proves to be a need for additional parking, there is no
place to put it.
Mr. London said that in his original conversation with Mr. Qureshi, it
was thought that additionaL parking could be provided across the street from
the recreation building. Mr. Clark said he didn�t think Mr. Qureshi was
aware of the contour of the land at that time. Mr. London said parking could
be pravided there but it would be costly, and they would have to take out some
large Oak trees. We can provide parallel parking along Meister Road �ithout
taking out trees, just North of the recreation building.

Mr. Clark said that if after a couple of years, there isn't enough
parking, the Association could make room for more, however it then would
be their cost. Chairman Erickson said that because this is private property,
the City couldn't make them do it. Mr. Clark said the City has the authority
to put up "no parking" signs for fire protection, and this could force them
to provide additional parking.
Mr. Harris asked if the Fire Marshall deteru�ines how many people can use
the recreation building. Mr. Clark said the code is in reference to the
amount of exits. There can be so may people in the building per exit. He
thought the occupant load would exceed 50.
^ Mr. Minish said he would like to clarify something else that had been
/�, discussed two weeks ago. Mr. London said they were developing the area for
single family homes and selling the lots. They are not building the homes.
He thought this was a change from the original proposal. He said that in
the information they had received, there were several references made that
the single family sites not be left, and only the �ultiple part of the
develogment be constructed. Mr. Clark said there have been several single
family homes started. The single family home sites were divided into two
plats. In Phase I there are 77 lots. There are 15 homes completed here.
Phase II has been platted, and the water and sewer contract will be let in
May. Mr. London said 50 lots have been sold.

Mr. Erickson said there was an agreement he thought we had, that the
City would designate some of the lots as unbuildable. Mr. Clark said the
final assessment role has not been adopted. The City has the option of
designating 15 lots on which no special assessments would be placed. We
are not sure whether we will follow this plan or assess the lots on a sliding
scale. They would start out with zero on the first lot and gradually add
assessments as the lots improved. Mr. Erickson said he did not agree with th?s.
He was in favor of the 15 lots not having assessments. Mr. Clark said
there were pros and cons for both plans. Mr. London said it would be fall of
1974 before these lots go on special assessments. Mr. Clark said the water
and sewer assessments could go on this fall on the first plat. Mr. Fitzpatrick
asked if it had been determined at the present time if any of the lots were
unbuildabie. Mr. Clark said there were definitely S or 6 lots that couldn't be
built an. The cost of the assessments on any of these 15 lots that were built
on, would be absorbed by the other lots.

� Mr. Harris asked if Phase IV and V were all townhouses. Mr. Boardman
said they were. He said the original plan stated there could be a maximum
density of 850 units. The plan presented now shows 787 units. Mr. Harris
/', said they are under density in the whole development then. Mr. London said
they had taken out 2 units in Phases I and II, dropped 4 in Phase III, and
2 in Phases IV and V.
Mr. Clark said he had read over the agreement in the original rezoning
request and all the stipulations have been met.
Mr. William Drigans asked if the plan could be approved subject to a
study being made periodically of the parking needs, and if additional parking
was needed later, the parking could be added, Mr. Erickson said the problem
is that if the plan is approved as presented, there would be no room for
additional parking. This is a private developm�nt, and the problems are their
owci, except if the City has a problem getting fire equipment into the area,
then it's the City's problem. Mr. Harris thought the Fire Marshall could
designate fire lanes if people park on streets rhat aren't wide enough for
on-street parking.
Chairman Erickson asked for a statement from Mr. London on why the
original plan wasn't followed. Mr. London said the original plan was based
on aerial photographs which weren't too accurate. When they had a new
topography of the area they came up with a plan that better suited the terrain.
^ MOTION by Zeglen, seconded by Fitzpatrick, that the Planning Commission
�� close the Public Hearing on the proposed Plat, P.S, ��73-02, by Darrel A. Farr
Development Corporation. Upon a voice vote, all voting aye, the motion carried
unanimously.
Mr. Darrel Clark said that at the Building Standards meeting of March
22, 1973, the Subcommittee made the stipulations that a�ot lot be provided
in Phaae IV and V and that evergreens be planted as a noise screen along
I. 694. Mr, Boardman said the planting of evergreens was to be worked out
with the Highway Department and the developer.
Mr. Zeglen asked Mr. London if anything had been worked out with the
Highway Department yet. Mr. London said it had not. Mr. Zeglen said they
should bring the planting proposal to the City Council.
Mr. Fitzpatrick said if we couldn't find a place to park a car, how wi11
we find space for a tot lot. Mr. Boardman said ther-e was a flat, open area
connected to a walkway where the tot lot could be located.
Mr. Clark said that in reviewing the recreational facil�ties, we are
trying to get a tennis court grovided in Phase IV and V. There is space for �
a court in the Southeast corner. Mr, Fitzpatrick said if another tennis court
could be provided, it would help in that there would be less pressure put on
- the City to provide additional courts, Mr. Boardman said the Townhouse Associatior
�, can control the time limit on the use of the tennis courts, Mr. �lzrk said this
is something we have to•work out with th� developer �s the area develops. Mr.
Erickson asked if the developer has agreed to this. Mr. Clark said we have a

f"'� letter from Darrel Farr in which he agrees to work with the Planning Department
to provide additional recreational areas. This tennis court would not interfere
with the townhouse dwellings as it would be across the street, behind the garages.
� MOTION by Minish, seconded by Zeglen, that the Planning Commission recommend
� to Council approval of proposed plat, P.S, �k73-02, Innsbruck North Townhouses
Phase IV and V, and preliminary plan approval for Phase IV and V, for the
townhouse area generally located one quarter mile East of Mat.terhorn Drive and
North of Interstate No. 694, being a replat of Outlot H, Innsbruck North, with
the provision that as much parking space as can be provided on Meister Road
for parallel parking for 200 feet; the recommendation of the Building Standards-
Design Control Subcommittee for a tot lot to be located as shown on the plan,
and a planting screen for noise be_provided along I. 694, the evergreens being
at least 5 feet high. Upon a voice vote, all voting aye, the motion carried
unanimously. -
3. CONTINUED: EXTENSION OF SPECIAL USE PERMIT, SP �k71-04, GREEN GIANT
HOME AND GARDEN CENTER POOL CENTER: Located at 7622 University Avenue N.E.
Mr. Jack Jones, Construction Superintendent of the Engineering Department
of Green Giant, and Dave Rick, Manager of the Green Giant Garden Center, were
present.
Chairman Erickson said we have asked for additional information on this
/1 item also. Building Standards-Design Control Subcommittee has recommended
approval with the stipulations that a wood fence be constructed between the
�� main driveway and the service drive, that there will be a chain link fence
along the North and West boundaries with a green covering of some type, planted,
Green Giant get a letter of approval and agre�ment from the St. Paul Water
Works Department, and the old business shed be discar�ed and not be•onoved to
the ne�a site.
Mr. Fitzpatrick asked why there was a property line between the Garden
Center and the Pool Center. Mr. Rick said because they were leasing the land
for the pool center.
Mr. Zeglen said Green Giant wanted to slat the chain link fence but
the Subcou�nittee felt they wanted this to be a screening fence with something
growing on it for a scfeen, such as ivy.
Mr. Minish asked the petitioner if he expected this to be an on-going
operation from year to year. Mr. Jones said they did as they have quite an
investment. Mr. Minish said that in going through the previous minutes and
the action taken, this had been approved on a temporary interim basis. He
said he thought this was what we were talking about.
Mr, Clark said we are talking about two things; the pool center, and
also a new land use plan for the entire Garden Center.

Mr. Fitzpatrick asked the petitioner if he was aware Lhat this Special
Use Permit was subject to annual renewal. Mr. Jones said that he was.

� Mr. Clark said the reason this was an annual permit was because of its
location. We wanted to see how the business was conducted. Last year, I
don�t recall that we ever had any reason to discuss the way the business
� was conducted for the pools and we didn't receive any complaint calls.
Mr. Minish said they are asking for an extension of the Special Use
Permit. Mr. Clark said that technically they were, but at this time, they
were asking that the extension not have a time limit, at least not an annual
time limit.
Mr. Fitzpatrick said the first year there was a stipulation that everything
�e removed at the end of the season. Mr. Clark said it was not removed. Mr.
Fitzpatrick said we are just trying to clarify how the permits have been made
the last two years.
Mr. Clark said the first year it was not a Green Giant operation, but it
was the second year.
Mr. Clark said that another thing that should be discussed is that they
not be allowed to add pennants or banners or any new signs. Mr. Fitzpatrick
said the sign ordinance would keep them from putting up additional signs. Mr.
Clark said he just wanted to draw it to the petitioner's attention what the
ordinance was.
Mr. Rick said they would like to put up a temporary sign
�� center has been moved. Mr. Fitzpatrick said that what we're

Chairman Erickson asked Mr. Glark if the Planning Commission was being
asked to approve the plot plan. Mr. Clark said this wouldn't be necessary
as this was a Building Standards item. The Planning Commission was only being
asked to approve the Special Use Permit, although they are tied closely together.
It wouldn't be out of order to act on both of them.
MOTION by Zeglen, seconded by Fitzpatrick, that the Planning Commission
recommend approval to Council of the extension of the Special Use Permit,
SP ��71-04, �reen Giant Home and Garden Center Poo1 Center, and approval of
relocating the pool center with.the stipulations of the Building Standards-
Design Control Subcommittee which are:
1. A wood fence be constructed between the main driveway and
and the service drive along Osborne Road.
2. That there will be a screening fence albng the North and
West boundaries with a green covering of some type planted.
3. Green Giant get a le�tter of approval and agreement from the
St. Paul Water Works Department.

^ Mr. Jones said it was just an additional parking lot. Mr. Harris asked what

Jones said they will blacktop the area and landscape around the sign. Chairman

Mr. Zeglen AMENDED THE MOTION stating the Planning Commission does not

MOTION by Fitzpatrick, seconded by Minish, that the Planning Commission

by Russell Schlemmer. Upon a voice vote, all voting aye, the motion carried

Chairman Erickson asked Mr. Schlemmer if he has a garage now. Mr.
Schlemmer said he has an attached single car garage. Mr. Erickson asked
� him what type of driveway he has. Mr. Schlemmer said he has a concrete
drive and would have a concrete driveway for the second garage.
� Mr. Erickson asked Mr. Clark if the City has any objection to this
request. Mr. Clark said there might be a drainage problem, and we have had
a call from a neighbor who was concerned a.bout the driveway having to be so
close to the property line. There is only 11 feet between the house and
the property line. There could be a problem concerning snow removal.
Mr. Erickson asked Mr. Schlemmer how he intended to handle the snow
problem. Mr. Schlemmer said he had a snow blower and could direct the
snow to some other area.
Mr. Erickson asked Mr. Schlemmer what the elevation was where he planned
to build the garage. Mr. Schlemmer said it was pretty level, maybe a little,
higher.
Mr. Harris asked Mr. Schlemmer the size of his single garage. Mr. Schlemmex•
said it was 11 feet x 21 feet.
Mr. Mykola Moroz, 289 Ely, said his driveway was 5 feet from his property
line. This new driveway would only be about six feet from that driveway,
and then about 20 feet further was the drivewa.y for Mr. Schlemmer�s existing
garage. He said it would make the whole area look like a driverray. He said
' he had only bought his home a year ago, and wouldn't have bought it if he
� had know another driveway was going in or another garage would be built. He
said he thought this would hurt the resale value of his horae.
Mr. Robert Freeman, 273 Ely, said this garage would block his view of. the
park because his living area is facing North.

Mr. Fitzpatrick asked if both these neighbors also had 60 foot lots.
^ They both said they did. Mr. Fitzpatrick asked if there was any reason this
garage was being set back 45 feet from the house. Mr. Schlemmer said he would
be able to bring it forward a little. Mr. Clark said because the driveway
/, was so long, from a safety standpoint, there would have to be room to hava a
turn-around.
Mr. Fitzpatrick said the real problem aeems to be that he needs a driveway
to the back of his house which has to be placed on an eleven foot strip. Mr.
Fitzpatrick said he could sympathize with the neighbors not wanting a garage
Iocated in a large open area. He said there must be a problem with vehicles
sitting out in the open. Mr. Moroz said there was no problem because Mr.
Schlemmer keeps things very neat. Mr. Schleu�er said he has a boat and trailer
stored away from the property and other recreational vehicles which he has
stored other places, and he would like to keep this equipment on his own
property. That is why he wants the second garage.
Chairman Erickson said he thought administration should look at this
property before any decision was made. '
Mr. Zeglen said it might be possible to move the garage close to the
back of the house and have the garage doors opening to the West. Mr. Schlemmer
could still have room for a turn-around but the garage wouldn't be so far back
on the lot. Mr. Schlemmer said he had thought of this but didn't like the
location because it would be too close to his present house,
� Mr. Harris asked Mr. Schlemmer if he was using the 11 feet for access
�� to his back yard now. Mr. Schlemmer said he had to because there was only
5 feet on the other side.
Mr. Fitzpatrick asked if the Planning Commission had the power to make
the stipulation that this garage be brought in closer to the house, and if we
do, then maybe this should be continued to see what arrangements the petitioner
can make.

it would depend upon the snow loads on the roof. Mr. French said the gauge
seems to be heavier on this shed than others he had looked at. He thought
it was because of the span. He said he didn't need this large of a building
but to get it long enough for his boat, he had to take the width.
Mr, French said the reason for the placement of the shed on the lot
was because he wanted it inaccessible from the street.

Mr. Willey said he was represeating Mr. Menkveld and himself, as buyer
of this property. Mr. Menkveld has requested the vacation of 67th Avenue
so that I can build a residential dwelling upon this lot for myself as my
personal residence. I have been before the Parks & Recreation Commission
and they have suggested that I dedicate the part of the easement from the
top of slope back to the City for park purposes. They said they had no
objection to the vacation. The lot as it stands right now is not buildable.

Mr. Fitzpatrick asked if anyone from the City had been out to look at
the embankment. Mr. Clark said he had seen the site and also Ralph Volkman
from the Park Department. He said the drawing.presented appeared to be
quite accurate.
Mr. Willey said he did not have a survey at the time he was before the
Parks & Recreation Commission but he has had one made which the Planning
Commission has.
Mr. Fitzpatrick asked how wide the property would be with the vacation.
Mr. Willey said it would be 70 feet at the Westerly most point. On the
Easterly point is where it meets the cul-de-sac so it is appreciably narrower.
Mr. Zeglen asked if there was a dwelling on Lot 30. Mr. Willey said
Mr, Sodahl has a home built on Lots 29 and 30. Mr. Willey said he had
talked to Mr. Sodahl earlier in the evening and he supports the request
for the vacation as this would add open space to his yara.
Mr. Erickson asked why this came before the Parks & Recreation Commission.
Mr. Fitzpatrick said because of the general concern in not vacating City
property along the Creek.

�� Chairman Erickson said this is in a nature of a trade. The petitioner
gets the vacation and dedicates to the City the area beyond the slope as
park property. Mr. Fitzpatrick said we are concerned about keeping the
creek bank in public ownership.
Mr. Erickson asked Mr. Willey if he had drawings of the house he
proposed to build. Mr. Willey said he did. He said this would be a two-story
house with an attached garage. He would be using a mansard type roof to lower
the profile of the house so it would blend in better with the existing homes
on the block. He will use horizontal siding, the same as the other houses
in the area. The house will have a redwood deck which will serve as a large
play pen for his small children. Mr. Clark said the deck will be shortened
by 5 feet to the North to meet the sideyard setback requirement of 10 feet
on the South.
Mr. Fitzpatrick asked if this item was before the Plats & Subdivisions
Subcommittee. Mr. Harris said it was but ox� the vote for denial there were
two aye and two nay votes so it comes to the Planning Commission without a
recommendation.
Mr, Clark said he didn't know if the City can vacate a st�eet right of
way and simply'retain it for park purposes.
/"\ Mr. Fitzpatrick said the Parks & Recreation Commission did not recommend
� approval of the vacation, they just said they had no objections if the park
gets the rededication.

Mr. Dennis Drevniak, 6684 Fridley Street, said he objected to any
structure being built on this lot and thought it was an infringement upon
� - the wild area.
Mr. Gary Sodahl, 6689 Anoka Street, said his only objection was to a
two-s.tory house.
'' Mr. Willey said the reason he went to a two-story house was so he would have
- a large enough house for his needs and still maintain some open space on his
� lot.
Mr. Harris said that if we don't grant the vacation, this lot will be
dead. It would be very difficult to build on as it is and meet the setback
. requirements. It seemed to him that we either have to go along with the
vacation or the City may have to acquire the land. We would have to iron
out the park dedication.
Mr. Drevniak said that if this lot could not be built on, he would
�like to buy it for an agreed upon price. Mr. Willey said there is no
agreed upon price because he wants to build his house on this lot.
Mr. Fitzpatrick said we had a�.wo to two vote h� the Plats & Subdivisions-
Streets & Utilities Subcommittee and a cautious statement from the Parks &
� Recreation Commission, and I think we should continue this item until we know
�, the legal ramifications.
�� Chairman Erickson said he didn't tliink there could be an intel.ligent
vote on the vacation request until evervone had seen the property.
Mr. Harris said one of the things he was concerned about, and they
didn't get to this at the Subcommittee level, was that he knew you could
keep motor cycles, mini-bikes, snowmobiles and the like, off of park property.
Can you keep them off of public right of ways when there is no street there.
If this dedicated right of way was left as is, could they stop recreational
vehicles from using it. He said if they were licensed vehicl.es, he didn't
think there was a thing the City could do about it.
Mr. Fitzpatrick said he would like to see this vacation request continued
until it is determined if all of 67th Avenue should be vacated along the
embankment and how it could be handled.
Mr. Minish asked the petitioner if he would consider building any other
kind of house, Mr. Willey said a one-story home would be too small and he
thought the house he proposed would blend into the neighborhood. A sma.1.1
house wouldn't blend in with the neighborhood either. There are a variety
of grade changes in the area. ,
Mr. Fitzpatrick said I don't think we have the right to deny this request
^ just because of the park consideration. There are otner things to cnnsider.

Mr. Clark said there have been several questions brought up here that I
would like to check with the City Attorney. One of the questions was if we
could keep licensed recreational vehicles off a dedicated right of way.

Mr. Clark said the house has been moved but he thought the vacation
should still be Frocessed just in case there was even an inch error; to protect
the future buyers of the house. If a survey should show a small part of the
house was built on an easement it might be difficult to get a mortgage commitment.
Mr. Minish said at the time the variance was granted for this house, they
did have letters from the three utility companies saying they had no objection
� to the vacation being granted.

Mr. Harris said the Plats & Subdivisions-Streets & Utilities Subcommittee
recommended that the vacation be granted.
Chairman Erickson asked if this was a drainage easement also. Mr. Clark
said it was but they would still have nine feet.

8. REPORT ON RUSTY WATER
Mr. Minish said when we first started our discussion on the Comprehensive
Plan, I raised the question about what I believed to be a problem we had with
our water. I was told by Mr. Qureshi that we had all these iron removal plants
and that doesn�t see to be the case. I�m sure we are not the only household
in Fridley to have problems with rusty water. It just seems to me that this
was a problem that should have a soluti.on and as far as I�m concerned the
problem has not been solved. I cannot tell from the memo we have in our
�, agenda if we will ever be rid of the problem.
Mr. Fitzpatrick said it sounded like they were building something out
of parts they receive bit by bit. Mr. Mini.sh said it sounded like we were
a second-rate municipality.

Mr. Harris said they have a problem with murky water. There is a grey
granular material in the water that looks like fine rock.
� Chairman Erickson said they have had rusty water, on occasion for years.
� He wondered if anyone has ever came up with a solution.
Mr. Minish said the problem in their neighborhood has worsened in the
past couple of years.
Mr. Clark said the memo that is in the agenda spells out pretty well what
they are doing about the problem right now.
Mr. Minish said I would like to see the City moving agressively to solve
the problem.
Mr, Clark said the City has hired a consultant, a water specialist, and
he is analyzing the system, and taking water samples throughout the whole City.
I think the flushing program should help to get the iron bacteria_out of the
system. The water comes out of the filtration system practically iron free.
Mr. Minish said he wanted to raise the question to see if something was
being done on a formalized basis.
^ STATEMENT BY MR. FITZPATRICK
� Mr. Fitzpatrick said he wanted to take some cognizance of the fact that
there was going to be an almost complete turn-over of the Planning Commission.
To take nothing away from the people who are going to be on the Planning
Commission, I would like to say in all seriousness . that we are certainly
going to miss the kind of expertise that Mr. Erickson has had on these matters,
and the fac�t of having a lawyer, Mr. Minish, is certainly an advantage that
we aren't going to have, and Mr. Zeglen's acquaintanceship of the whole area
and his usually having checked out and looked at the items first ha�d, these
are all qualifications that are going to be hard to replace.
I also want to say that it is 011ie's choice not to continue as Chairman,
and it was not my choice to be Chairman, my first choice was to continue as
Park Chairman.
Mr. Erickson said he has �njoyed being Chairman, but he has been Chairman
for a number of years and felt he would like a little rest. He said it had
been a pleasure working with all the men on the Planning Commission,
Mr. Harris said the Plats & Subdivisions-Streets & Utilities Subcommittee
wanted me to have it mentioned in the minutes, a note of appreciation to their
former Chairman, Eldon Schmedeke, for his long hours of hard work and dedicati�n
to the Gity of Fridley.

� COMPREHENSIVE PLAN REVIEW
Chairman Erickson said it would seem that we are not through yet. We

^ have some possible recommendations for amendments to the Comprehensive Plan
that were made by the staff of the Metropolitan Council. They have postponed
the hearing of the Plan until next month. Jerry Boardman and myself have
� spent some time with a couple of gentlemen from there and they told us what
,they thought should be in the Plan before they put in their report.
Jerry Boardman and i felt we should have a meeting with both the old
and new members of the Planning Commission and probably incorporate some
of these ideas into the Plan before it goes in for review. The City Council
has set up a Public Hearing for May 14, and the Metropolitan Council will
have their review after that, so I suppose Council can have their Public
Hearing, and continue it.
Mr. Erickson said he would like Jerry Boardman to make the presentation
of the Comprehensive Plan for the new members. He said the new members should
be given a copy of the Comprehensive Plan and have all the mem�ers receive
a copy of the amendments suggested by the Metropolitan Council. Mr. Erickson
said he would like to have the meeting on May 2, 1973, and it would be a
completely closed meeting.
Mr. Clark said you could pass your reco�endations on to the City
Council on the amendments suggested by the Metropolitan Council. Mr.
Erickson said we will also have to pass them on to the Metropolitan Council
because right now the plan the Metropolitan Council is looking at is our
� plan. Even after the Metropolitan Council approves the plan, our City
Council may want to change it.
� The Metropolitan Council doesn't seem to understand that this is just
a beginning plan. Metropolitan Council will never approve a plan without
a statement on housing. They don�t have to approve our plan unless we want
to get preference for Federal monies.
Chairman Erickson said we will plan on meeting the second of May. Mr.
Fitzpatrick asked Mr. Erickson to chair this special meeting.

uaing the easemeat as part of his yard as he owns both Lots 29 and 30, he will
need the easement to be able to build as he only has the one 40 foot lot. Mr.
Willey said Mr. Sodhhl was also willing to convey the right af way from the

Mr. Drevniak asked what plans the City had for the park area. Mr. Clark
sai.d there was na adopted plan for the development of this park. There has been
so�ne talk of the County taking it over. On our part, it would probably stay
a nature area, with walking paths and nature trails.
Mr. Meiasner asked why the cul-de-sac on Fridley Street didn't go through
to 67th Avenue. Mr. Clark said because of the grade on 67th Avenue, the City
has never planned Co open this street.
Chairman Harris asked what the law was when a dedicated street was vacated.
Mr. Clark said it goes back to the property it was taken from originally. Mr.
Harris said that legally we couldn't dedicate the street for park purposes. Mr.
Clark eaid he thought the street would have to go back to the original property,
and if the prop�rty owners were agreeable, then they could dedicate it for
park purposes. We could retain part of the street right of way, but I don't
thinl� that's the way we should go.
^ Mr. French said he felt that when the City has dedicated right of ways

;Mar. Paschke explained �hey want the zero side yard as he �elt the side yard
apace �hat is xequired ia useless space. The other buildings in the area
that have the side yard space look bad because this space is used for storage
of junk, Orie building in the area (A1 Zeis building) has two common walls
m$king three business areas inside and it looks beautiful. He said the owner,
Mr. Dqn Harstad, of the adjacent lots, Lota 5- 7� has agreed in writing that
when he builds on his 7.ots, he will connect his building to the proposed
buildi.ng and leave space on Lot 7 for the green area that is required for
aides yaxd.
Mr, Paschka said as far as the back yard variance of 6 inches, the lot is
. ' just 6 inches to narrow. They meet the 35 foot front yard setback but are.
6 3.nches to narrow to meet the rear yard setback also. They would need the
variance on either the �ront yard or the back yard and they chose to have it
� on �t�e back yard,
^ Mx. Paschke stated the off street parking variance from 20 feet to 13 feet
could be eli.minated if need be by removing 2 parking stalls as they propose
to h�ve 11 but are only required to have 9. The other vari•ance on off street
parking from 5 feet to zero feet could also be eliminated by removing the
5 foot sidewalk area by the building and moving the stalls up 5 feet.
Mx. Crowder stated the building in simply to long and to wide for the lot.
Mr. Paschke said the i.ot coverage maximum requirement is 40% and they do
not go oyer that req,uirement. He added that on a corner lot, which this is,
the setbacks are laxger than on an inside lot.
Mx. Crowder asked if there are any utility easements on this property?
Mr. �'aschke said he thought there was an easement in the back.
Mrs. Wahlberg asked what the feelings of the City were on these variances?
Mr. 1Vordah]. answered the only consideration of the City is that the agreement
with Mr, Harstad be in writing and he added the City is also working with
Paco Masanry on the loading dock located in the back of the building.

The Board then had a discussion on the turni�g area and parking area in the back
yard.
Mr. Crowdex stated the parking was really not the Boards concern, but this should
be conaidered by the Building Standards Cousnittee or the Engineering Department.
Mrs. Wahlberg asked if they had considered cutting down the size of the building?
Mr. Pasc'hka said they originally drew up Qlans to meet the side yard requirements
but all they would end up with is wasted space between buildings which would co7,lect
junk and by cutting down the floor axea you would be cutting down the usefulness
of the waxehouse.
Mx. Edson stated the buildings like they propose to build look so much bettex
^ as they have the solid green area in front and what storage there is is a�.l st4xed
in the acreened back area and not in the side yards whexe it can detract from �h�e

Chairman I�igans pointed out that it seemed strange that this building can
meet the 40% lat coverage requirement and yet they need so many variances to

Mr, Paschke stated that if their land was in the m�iddle of the block they could
ge� the building on the lot but they need variances because it is a corner•lot.

the other requiremente. He said he did not think the Board should set a precedent
by approving a11 the variances. He said he felt it was an ill-prepared building

Mr. Crowder said he would state his opinions of each variance separately.

Mx. Crowdex said except for the fact that the owner of the next lot has not said

was also concerned with the loading zone area. She added the problem here is the

be on Lot 30. �e said that if Mr. Meggitt has to build according to the Code, he
wauld not be able to build,� but with the zero setback he could put up a 4,000
square foot building. He said Mr. Meggitt does not object to the variances at all.
Mr, Paschke explained they need the same variances on this request as the last one

no dack area on this building as the trucks will go into the building.

yards �nd pulled his cre�w off the job and came up to City Ha11 to talk to the
Building Inspector. Mr. Johnaon added the only Ching they could do is to build
^ the house to the north of this lot farther away from the adjoining lot line to
acquire the required footage between structures. He said he plans to start
�the house on the adjoining lot within a week or two.
^ Mr. Dick H,arris, 62Q0 Riverview Terrace, stated he had no objections to the
variance as long as the stipulations for the previous variances on this property
would sti11 be in eff�ct.
Chairman Drigans stated this variance would not alter the stipulations for the
previous vaxiances, He then read tha Code concerning verifying surveys wh ich
stated the verifying survey showing the location of�the foundation shall be
required before the framing pf the structure is begun.
Mr. Johnson atated he was in exror by not having the survey in his possession
before they started fzaming but City Hall usually gets �heir copy of the survey
in three days which in this case they did not.
�Ir. Crowder aslced if on the dwelling to the north, would the garage side be

Mx. Johnson said they would rather put the living area on the south side because
the two structures would then be farther apart, but they could do it that way
if �he Board requested it. .

make as much noiae as they do outside. He said his double driveway goes almost

Chairman Lindblad wanted to express his thanks along with the other
membexsto former memb�rs, Mr, Geroge Zeglen and Mr. Robert White, for
th�ir time and eifort they had put into the Building Standards Committee.
At this time he alsa intxoduced the new membels of the committee, Mrs. Pat

pecaple, such as lawyers, doctors, contractors, etc. This building is a

The exteriar o� the building will be a face brick with painted concrete

and costly to replace these trees. He prefers a low lying (12-18") shrub

Mrs. Treuenfels felt the parking stalls for the handicapped should be
closer ta the buildin,�. Mr. Bernu explained the parking ].ocated close$t to
th� buildi�g was generally aregarded as employee parking, and the visitor
paarkin� and d�signated parking stalls for the handicapped were approximately
th� same distanGe from the building.

Mx, I,indblad asked about �he rubbish cor�trol. Mr, Bernu said each
pexson renting spaee has their own rubbish c,ontract for inside, there is
a cen�xal xubbish area outside. The board sa'id this area would have to be
screened. Also �he outside ground heating and air conditioning unit wi11
havs to have a sereen. Mr. Bernu said this had been provided. There is no
autside stora�e af �quipment o,r material other than thsse two iteras.
Mr. Tonca recommended a 1#�ndscape plan be developed and brought in
�or approval by the CQUncil.
� The board asked about lighting on the building, decorative and security.
kr. ��xnu said there will be 6 each, 10 feet high with 14" globes along the

said once a week there wou�d be an auction. Items, he said, move faster

Mr, Dowds sai.d there will be no addition to the buildings except for a
sign that says xhe campany's name. .
There was no problem with the building site or landscaping as this is
a11 pre-existing.
The baard asked where the junk items would be stared. Mr. Dowds said
ot����de of the buildings, but inside a screened parking area. The board
p���ted out tha� this area wi11 have to be screened definitely, cars wi11
�c�t be piled an top of each other, and no item shall exceedthe neight of

the SQUth fence, and along East River Road. Mr. Dowds said he has a
contract with the landscaping firm 4hat did the original landscaping p1an,

Mx. Stanley Petexson and Mr. Dick Erickson were present for the request.
Mr. Erickson speaking for the architectual firm, said the purpose of
the building wi11 be to house a new electronic system, the function of the
building will help explain the architectual design. He went on to say, that
th�y use a very straightforward effect with a natural colored brick and
d�rker brick around the recessed doors and windows. Few windoks are used
�ecause of secruitY,and wa11 space on the inside of the building is a
px�mium. The design is such that they do not wish to attract attention to
the building since it strictly has a functional use and no direct public
contact.
Mxs, Treuenfels felt the building was a very unattractive building and
i'`�haped we could see�some �ype of break up in the bxick for a different design.
f�She felt tha� since this area in Fridley would be all commercial, and
Noxthwestern Bell was the first commercial in the area, they will be setting
the style and atmasphere for this area. Therefore a more pleasing bui,lding
she f�1� wpuld be better £or Fridley.
The rest o£ t}i��board felt the design was adequate.

Mr. Boardman pointed out they need poured concrete curbing
top area. Thexe were enough stalls for parking provided.

around these additians. Security lights, drainage, site plan, parking area
w�re all px�;existing. A 7 foot fence (6 feet fence and 1;foot barbed
�wira pn top) will surround the tank. This is the same type of fence
arQUnd the buildings. An eight foot berm strip will be maintain�d araund
the tank, Mr. Boardman suggested a staggered planting scheme, as this
will not create a fringe effect but a more n�atural effect. The berm strip

Burlingtcan Northern explained that the purpose of the light towers
is to ge� �igh� in between the railroad cars and tracks for safety measuxes
and prAp�x �runn�.ng of the railroad yard. Eleven towers o� approximately
10Q feet i.� h�ight wi�l be constructed. �The light will be a metal arc,
high intensity, dir��tional flood light. A directional flood light is
di,x'ect�c� a.n or�� spo� and has a shield over the light. Therefore, light
wi�l no� go laeyond a 45° angle from the source. With the shield, no
direct li�ht�ng wi11 be put on traffic using the nearby freeway, East
RiYer Road or residential strests. Residents in the nearby area will not
have a d�.re�.t �.ight c�n th�m e�.ther, The direction of the lights will be
�ala�ed so th�y beam in the direction of the railroad yard.

plainXs ab�u� the �ligh�, but the light the residents see will be indixect
and hav� the stren�th of a low beam car light, therefore not harsh or

Dear Mr. Herrick:
The Planning Commission has two questions with reference to a
vacation request tliat is presently being deliberated upon.
(1} Can the City of Fridley vacate a street right of way and
retain all, or a portion of it, for park purposes. The
reason being that if it is vacated, it would revert to
the private owizer on one side, rather than to the City
Park land located on the other side.
If it is not possible to do this then I would think it
could be vacated and a separate document would be necessary
dedicating it as a park.
(2} Since it is a dedicated street right of way, coui.d the City
of Fridley prohibit its use to licensed motor vehicles everi
though it is noz open to traffic. I am thinking of motor
cycles and tZ�e like .
The Planning Commission �aill be reconsidering this item at their
meeting of May 9. Therefore, your comments on this matter wouid be
appreciated on or before May 4, 1973 so we could for��rard the in�orin�tion
to the rnembers �aith their a�enda.

^ This letter is in regard to the questions that you raised in
� your letter of April 23, 1973, regarding the above matter.
I am of the opinion that if the street right of way is to be
vacated, that a separate deed should be obtained from the private
owners dedicating a portion of the easement for park purposes.
If the street right of way is not being used for street pur-
poses, it is under the co�itrol of the fee owners, probably the ad-
jacent property owners, and they may use the property as their own
until such time as the City decides to dedicate the street. This
being the case, they could fence the right of way to prevent it
from being used by motorcycles.
