MOTION by B1air, seconded by Harris, that the Planning Commission
receive the Parks & Recreation Commission minutes of December 31, 1973.
Upon a voice vote, a11 voting aye, the motion carried unanimously.
� Mr. Harris asked if they have settled on a location for the
A-frame building. Mr. Blair said they had. Mr. Harris asked if
it was going to be moved in one piece. Mr. Clark said it would be.
The bid to dismantle it and store it was $2500 and to move it in one
piece,including the foundation, was $3300.

^ Mr. Harris asked if this building was going to be used as a
warming house only, or would they be using it for storage. Mr.
Clark said�it wauld be used for recreation in the summer time, for
class rooms. This area will be part of the trail system. It could
be used for storage, but there is an old barn on the fringe of this
same park property, and I have mentioned to Paul Brown that rather
than ask to have this barn removed, that this would make a good storage
building.

SP #73-13, BY A. DAVIDSON: To permit the sale of used cars at
7395 Highway #65 N.E., being a block North of 73z Avenue N.E.
and East of Highway #65, per Fridley City Code, Section 205.101,

Public Hearing open.
Mr. Earl Peterson, Mr. A. Davidson, and Mr. Gus Doty were
present.
Mr. Doty preserited a picture of American Auto Listing's locatiori
at 5245 Lyndale Avenue South and copies of the warranty given by
this company on their used car sales. �
Chairman Fitzpatrick said this item had been continued because
there were only three members present at the previous meeting and
those present wanted to look at the other location where American
Auto Listing was already doing business. -
Mr. Blair said he had looked at the picture of the facilities
at 5245 Lyndale and asked Mr. Davidson what kind of facility they
intended to have in Fridley.
Mr. Davidson said that in addition to the used car lot, they
intended to have full service facilities, if this location was
successful.
Mr. Davidson said they have been in business for 8 months and
this was a.new type of concept in the sale of used cars. They haven't
had one complaint to the Better Business Bureau du�ing this time. We-
feel we have the best.warranty offered in the State. At the Lyndale
location we only sell used cars, but at the Hopkins location, we
have full service facilities. We have just renewed our licen�e at c�u�r-
three present locations, with no problem. �
Mr. Lindblad said you charge a 15o.commission for selling these .
cars. Mr. Davidson said we take care of the trade-ins and the financ-
ing also. '
� Mr. Clark asked how long they intended to use a temporary
structure at this site. Mr. Davidson said they didn't know if they
would have a garage at this site with a full service area and body
shop, or Whether it would just be a used car office. He said they
would need six months of operations to make the decision on what
" type of permanent structure they would want; and within a year of

the start of operations, they would have a permanent structure.
Mr. Harris said he had visited their location in St. Faul. He
asked Mr. Davidson how long they h�ad been in business there. Mr.
Davidson said that lot had been open for 6��months, and he had to
admit this was a bad decision. They had many problems with this
lot because of vandalism and the bad area it was located in. Mr.
Harris said if he was to look favorably on this request, the facilities
would have to be much better than what he had seen in St. Paul.
Mr. Davidson said it does measure up to the neighborhood it's in.
This lot does fit in with the neighborhood and the clientele, but -
they were ashamed of this location in St. Paul. �
MOTION by Blair, seconded by Lindblad, that the Planning
Commission close the Public Hearing for the re.quest for a Special
Use Permit, SP �73-13, by A. Davidson.• Upon a voice vote, all voting
aye, the mofion carried unanimously.
Mr. Harris said if we do recommend approval of this request,
I think we should specify a time limit, so we would be able to
review this after they are in operation.
Mr. Fitzpatrick said that we could stipulate that before this
is renewed, that a permanent structure replace the temporary structure.
� Mr. Harris asked Mr. Clark if there should be mention of the
signs, lighting, landscaping, curbing or a plot plan showing their
layout for Council. Mr.. Clark said most of this could probably be
� handled by administration, because a temporary building wouldn't go
to Building Standards, but they�should have a plot plan showing all
these things, before they go to Council.

Mr. Harris wondered if they should have some fencing. Mr. Lindblad
said it would be hard to sell�:�sed cars with a fence around the
property.
Mr. Harris asked what plans the petitioner had for the property
zoned M-1.' Mr. Davidson said it cauld be used for a service area
related to the used car lot.
Mr. Lindblad asked Mr. Davidson what licenses were required
to opertate a used car lot. Mr. Davidson said they were licensed
both by the State and locally. They have to have�a license for
each lot.
Mr. Clark said Mr. Peterson had mentioned at the meeting of
December 19th that they intended to bring sewer and water in for
their temporary building. Mr. Peterson said this.was available to
the site, and they wanted it brought in before they put in a permanent
parking lot. Mr. Clark said there would have to be plumbing facilities
available on the site.

MOTION.by Lindblad, seconded by Blair, that the Planning
Commission recommend to Council approval of the request for a
special use permit, SP #73-I3, by A. Davidson, to permit the sale
of used cars at 7395 Highway #65, being a block North of 73� Avenue
N.E. and East of Highway #65, per Fridley City Code, Section 205.101,
3, G., for a period of one year, at which time it mnst be reviewed
for renewal, with the stipulations that sewer and water be provided
for the temporary structure and a plot plan be prepared for present-
ation to the Council. TJpon a voice vote, a11 voting aye, the motion
carried unanimously. .
2. REQUEST FOR A LOT.SPLIT, L.S. #74-01, BY AMERICAN AUTO LISTINGS:
To split off that portion of Parcel #4780 presently zoned C-2S,
in Section 12, T-30, R-24, lying West of the East line of Lot 10,
Block 1, Central View Manor, extended North, the same being
7395 Highway #65 N.E.
Mr. Cl.ark asked if the petitioner owned all of parcel #4780
and if it was abstract or torrens property. ,
Mr. Doty said it was abstract property and Sheldon Mort�nson
was the Fee owner of the property, but the petitioner has a purchase
agreement.

Mr. Clark asked if they intended to split this lot immediately
and if they were going to record it right away. Mr. Peterson said
he thought they would do it as soon as possible. Mr. Clark said
the reason he was asking was because, while he thought it was a
good idea to split the property at the zoninq line, the legal descrip-
tion was quite complicated, and as this property did extend from
Central Avenue to Highway #65, it might be better to plat it than
handle it as a lot split. . .
Mr. Harris said that at the time the Planning Commissionoaerty
the petitioner to apply for a lot split to divide the C-2S p p
and the M-1 property, the petitioner only had a purchase agreement
on the commercial property.
� Mr. Clark said he thought the City Attorney should check the .
legal description to .see if this meets the legal requirements for a
lot split, or if it should be platted.
Mr: Harris said he felt this should be divided at the zoning
line also, because maybe the petitioner might want to sell the M-1

MOTION by Harris, seconded by Blair, that the Planning Commission
recommend to Council approual of the request for a Iot split L.5.

^ Mr. Clark said that if the City Attorney decided this property
should be platted, it would have to come back to the Planning Commission
for a Public Hearing, but this would not hold up the special use
request. Mr. Peterson said this was agreeable to the petitioner.
3. ARMORY RE�UEST
Mr. Fitzpat�ick asked if we had had any more response on
the armory request.
Mr. Clark said we haven't, but he didn't expect any, because
he thought most organizations didn't meet in �ecember and would
probably respon d after their January meetings. He said he though t
the Planning Commission could probably put this on their agenda for
the second meeting in February. � •
4. TAX FORFEIT LOTS
Mr. Fitzpatrick said he wondered what had been done about
tax forfeit lots being sold that could have been used by the City.
Mr. Clark said the County doesn't sell tax forfeit lots now
without the app.r.c��Tal of the City Council.

Mr. Ed Hanson, representing The Ground Round, was. present to present the request.
Mr. Hanson said that basically the existing sign is 100 square feet which is the
maximum allowed by the City Code. He said the reader board is usually a part of
their signs. He said it is plastic and uses various letters to advertise specials
�"`� in the restaurant and they would like to use it on this sign, He added it would
be nice to have but they need a variance to put it up.
Chairman Crowder asked why the panel wasn't put up with the original sign? Mr.
Hanson said they could not put it up because of the total sign area allowed by
the City, and that they didn't find this out until after the sign was ordered.
Mr. Plemel asked about the ma.terial of the pane.l. He said the drawing says it is
rough sawn cedar wood. Mr. Hanson.said the edging is probably cedar but the part
where the letters are is probably metal. "
Chairman Crowder asked if the message would be used to advertise programs coming
up? Mr. Hanson said that it would. .
Chairman Crowder asked about the elevation of the land in regard to Central
Avenue. Mr. Hanson said the restaurant does sit on a hill and the sign will be
on the side of the hi11. Mr. Crowder stated the Code specifies a sign minimum
height of l0 feet above the centerline of the street and the drawing shows the
panel approximately 7 feet above the grade. He said since the property is
landscaped quite high, the sign should meet this requirement.
Chairman Crowder stated in all cases, the Board asks what the hardship is in
asking'for a variance an@ in this case it soun�ts like the panei has already
been bought. Mr. Hanson said the panel was part'of the sign package. He added
he thought the panel will be a benefit to the restaurant as a changing sign
� draws attention to it.

.Chairman Crowder noted the existing sign is 96 square feet and the proposed panel
/`� is 24 square feet making a total of 120 square feet.

Mr. Plemel stated he has nothing against this sign as long as there is no
visibility problem created by it.
Chairman Crowder said that if the traffic signal was not there, he might be moxe
hesitant.
Mrs. Gabel stated she has no objections to the addition of the panel.

request.
Mr. Peugh stated that basically the variance is needed to compete with the rest
of the signs on the shopping center. He said the 150 square £eet they are asking
for would fit in with the rest of the signs.
Mr. P2.eme1 asked how many of the existing signs at this location are over the
required area? Mr. Peugh answered just about all of them.
Chairman Crowder asked if there was any kind of a sign existing now for Fridley
Office Supply. Mr. Peugh answered that there are only two old frames above the
store that will be replaced with the proposed sign.
Pictures of the shopping center, showing the existing signs, were shown to the
Board. .
Chairman Crowder asked how the sign will be lit? Mr. Peugh said that they will
possibly use spot lights or fluorscent lights on the bottom.
Chairma.n Crowder asked if Fridley Office Supply intends on coming back to the
Board to pue a sign on the shogping center pylon? Mr. Peugh said he did not
know of any such plan.
Chairman Crowder asked if the sign would be angled toward Highway ��65? Mr. Peugh
said it would not be.

Chairman Crowder asked how the size for the sign was decided upon and if the sign
was already made?- Mr. Peugh said the customer picks the size he wants. He added

� �he supposed the.customer had looked at the existing signs and decided to have the
same size. Mr. Peugh said the sign has not been made up yet.
Mr. Beugh stat�ed the sign will be metal and have a green background with white
lettering. He added that a sign seems large when you talk about square footage
buC when a sign is erected, it seems to shrink as you get away from it. Mr. Peugh
said the customer just wants the sign to be seem from about the Sears Store and
the highway.
MOTION by Gabel, seconded by Plemel, to close the public hearing. Upon a voice
vote, there being no nays, the motion carried.
Mrs. Gabel said she can't see that jus't because the other signs are there, that
it would justify this variance, but she supposed the applicant feels he has a
right to this size sign as th e priority has been already set.
Mr. Plemel said this sign is l0 square feet sma.11er than the Payless Sh�e sign.
He said it would be nice if all of the signs could be uniform. He said on a
new shopping center, he would not be inclined to grant a variance for sign area
but this was a different case.
Chairman Crawder said his.feelings on signs were.difficult to explain. He said he
is not in�the sign business so he doesn't know what size sign would be adequate
for a particular business or for reading from a distance of so many feet. He said
on this shopping center we have signs that are just about all oversized and this
is the last shop in the center to be �ccupied. He said the only reason he can
� appxove of this sign is because the others are existing and there is no reason
to deny this sign to set.an example.

Mr. Bob DeGardner was present to present his request.
Mr. DeGardner explained at the ti.me the building permit was issued, the house
was positioned on the lot to meet all of the setbacks. He said they discovered
they had put the foundation in wrong when the verifying survey was made. He said
the dwelling has a jogged garage that is setback 33.20 feet, while the house i�s
setback only 31.20 feet. He said the east side lot line adjoins a 12 foot alley
easement so there shouldn't be any problem with the variance.

� Chairman Crowder asked if there was any talk about eliminating.this alley? Mr. Mattson
said it hasn't been a pressing issue.
Chairman Crowder asked what portiori of the living area was on the east side of the
house? Mr. DeGardner answered that the bedrooms are on that side.
Mrs. Gabel asked if the adjacent land is vacant? Mr. DeGardner said it was vacant
but that he doesn't own it. He added that the owner of that land has two lots and
will probably face th e house, if he builds, toward Hickory Stxeet.
Chairman Crowdex stated his only concern is with the lots to the east but it seems
the variances wouldn't affect them that much. He asked if there was a large '
boulevard in front of this lot? Mr. Mattson answered approximately 10 feet.
MOTION by Gabel, seconded by Plemel, to close the public hearing. Upon a voice
vote, there being no nays, the motion carried.
Mr. Plemel said there is a hardship due to the fact that the foundation is in.
He said there seems to be no special problems involved.
Mrs. Gabe1 stated the intent to do it right is there.
Chairman Crowder said the adjacent dwelling could have a problem but it would be
nothing majox. He said he couldn't see any grecedent being set with the front
yard variance and there are no objecCions from the surrounding property owners.

Mr. Bettcher stated the two houses to the south of his lot are older homes that
have their own sewer systems and are built towards the river. He said the two
housss to the north are newer homes and built closer to the road. He said if his
house has to be built with the average setback, he would have sewer problems as
the land slopes toward the river. He said he would also have to instalT a longer
driveway than he wants .
Mr. BEttcher presented a letter signed by his adjoining progerty owners that
stated they had no objections to the variance.
MOTION by Gabel, seconded by Plemel, to accept the letter of no objections. Upon
a voice vote, thexe being no nays, the motion carried.

Mr. Bettcher presented a set of his house plans to the Board. He said the dwelling
� is an L-shaped design and the garage would be 50 feet from the property line but
the house would extend back another 37 feet..

Chairman Crowder asked if the neighbor directly to the south had any qualms about
the setback? Mr. Bettcher said the neighbor liked the setback as the house would
not block his view of the river.
Chairman Crowder asked if the back of the house was to be finished as he said the
Board had one recent case whexe the neighbor had an objection to the variance as
he did not want to look ati a block wall. Mr. Bettcher said that he was not going
to have a walk-out type house, so the back would be finished. �
Chairman Crowder asked if it was the applicants i.mpression that he would have to
install his own septic tank if the house was moved back? Mr. Bettcher said no,
but he would probably have to install a pumping stati�n or build a very high house
to avoid the plumbing problems.
MOTION by Gabel, seconded by Plemel, to close the public hearing. Upon a voice
vote, there being no nays, the motion carried.
Mrs. Gabel stated the hardship seems to be the plumbing problems that would be
created by moving the house farther back, and since no one objects, she can see
no reason for not approving the variance.
MOTION by Plemel, seconded by Gabel, to recom�nexid to the City Council, approval

Chairman Crawder explained to the Board that tfiis item had been tabled at the
December 11, 1973 meeting as no one was present to present the request. The
item then went to Council on December 17, 1973, where the applicant presented
it, and the Council approved the variance.
Mr. Mattson stated this house is on the corner of Matterhorn a�d Hillwind Road
and the boulevard on the variance side {HilTwind) is 50 feet�so there should be
no problem. He added there are no plans to widen Hillwind Road.
Chairman Crowder stated that since the design of�the house and the boulevard
l,,, all.ows for good visibility for the cross traffic, and since the Council has
approved this request already, he could see no reason why the Board shouldn't
aPProve it.

I was out of totan and did not attendour Dec. board meeting when this
letter was discussed; however the board discussed the pros and cons and
voted in favor of such an armory. We do not knovr of anynesds of Rotary
that would be served by such a iacility.
