Chairman Fitzpatrick said he wanted the contents of this letter included in the minutes and he read, as follows: /1 "The letter is address to Edward Fitzpatrick, Chairman of the Planning Commission: At the regular meeting of the Board of Education, District 14, held on February 19, 1974, the following resolution caas introduced by Gordon Sangster: "Whereas the Fridley Planning Commission has received a request to rezone Lots 13, 14, 15, 16, Block 2, Riverwood Manor, from R-1 (single family dwelling areas) to R-3 (general multiple family dwelling areas), Whereas the described property is located across 71st Way Northeast from the entrance to the Riverwood Elementary School, And whereas the increased housing density and attendant traffic could create a safety hazard at the school entrance, Therefor�, be it resolved that the Board of Education of Fridley Independent School District No. 14 requests that the described property be retained with the current R-1 zoning classification." Mr. Clark said the Plats & Subdivisions-Streets & Utilities Subcommittee had been given a petit.ion by the neighbors stating that they were in opposition to this preliminary plat, but most of the opposition seemed to be against the extension of 61st Avenue N.E. rather than the entire plat. Mrs. Gloria Arel, 1521 Ferndale Avenue N.E.,�said a different plat was presented at the Plats & Subdivisions meeting this evening, and their opposition was to the extension of 61st Avenue N.E. � Mr. Clark said the first plan presented by the petitioner is the plan that you have in your agenda. According to the comg���:�l��nsive park plan, there is a need for a park in this area, so the Cit�,= =:.�taff dr�w up a modification of this plan, where the City would try t� get some where between two to three acres for a neighborhood park c?�1 this plat. Planning Commission Meeting - February 20, 1974 Page 4 � •One of the big objections to this first plat was that it did not render the Theilmann property to their satisfaction. The Plats & Subdivisions-Streets & Utilities Subcommittee told the petitioner to work with the City staff and the Theilmann's to develop a plat that was satisfactory to both. The petitioner brought in a new plan tonight that does not include the Theilmann property. Chairman Fitzpatrick said all the Theilmann property wasn`t included in the first plat. Mr. Clark said it did not include the Theilmann homestead property on which their home is located. Mr. Clark said the p'reliminary plat presented to the Plats & Subdivisions-Streets & Utilities Subcommittee before this meeting still had some opposition also. The people living on Ferndale did not want 61st Avenue N.E. extended any further West than the existing right of way and the . petitioner is to negotiate with the property owners for the rig.ht . of way or work with the Parks & Recreation Commission if this cul-de-sac has to be entirely on this plat. This would make lots 20 and 21 unbuildable and the balance of these lots could possibly be added on to the proposed park land. The petitioner was asked to dedicate 1.8 acres for park land and the City will have to negotiate � for the additional acre or so that will be needed for a neighborhood park. The petitioner was asked for a 10 foot sidewalk easement along Lot 15 for a walkway to the park. Any three to one slope on the plat would be sodded within one year of development to prevent erosion. Another stipulation was to have all the utilities undergrour�d. Mr. Clark continued, th.at there was a triangle needed for Briardale Road and the petitioner should negotiate with the Theilmann's or ask the City to negotia�e for it or else start condemnation proceed- ings for it. The road, Woodside Court would be temporarily dead- ended at the West and East sides where it meets the Theilmann property. O.ther stipulations were that the petitioner should plant one tree on each lot and the drainage plan be presented to the City Engineer for approval. � Mr. Clark said the street on the West side of the plat will line up with the road when Mr.O'Bannon develops his property. Mr. Drigans asked if Mr. O'Bannon has platted his property next to this plat yet. Mr. Clark said only a portion of it has been platted. � Mr. Clark said this plat was going to the Par�s& Recreation Commission at a later date. Paul Brown has said he would like room for a ball diamond, a multi-pu.rpose court to be used for basket ball and volley ball, a skating rink and possibly t1QCkey,and an a�paratus section. If the petitibner runs the cul-de-sac on parts of Lots 21 and Planning Commission Meeting - February 20, 1974 Page 5 1'1 22, the Parks Commission might pick up the balance of these two lots and leave them in their natural state. This area could be used for a hi11 for sliding in the winter time. Mr. Driagans asked to have the cul-de-sac problem explained again. Mr. Clark said th�t on the original proposal, 61st Avenue was extended the width of the plat. The:terrain is such that this really wasn't feasible. On the second plat, the petitioner is only extending 61st Avenue as far. as the right of way has already been dedicated, ending with a cul-de-sac at this point. This cul-de-sac would extend into � lots on the South side of this plat where right of way has not been granted. The Plats & Subdivisions-Streets & Utilities Subcommittee asked the petitioner to n•egotiate for this right of way. Two of the thre� people who would be involved in granting this right of way were at the earlier meeting and stated that they did not want to give this right of way. The other party was not present, but according to those present, he would be willing to give the right of way. If the right of way cannot be obtained in line with 61st Avenue, the petitioner might have to put the cul-de-sac all on his property which would make Lots 21 a�d 22 unbuildable, so it was suggested that the portion of � these lots that are remaining, be added to the park land to be purchased by the City. Mr. Lindblad said that Lots 22 and.23 were quite long lots. Mr. � Clark said this was because there was quite a grade change on these lots and they had to be that long so they would have about 60 feet to build on. Mr. Blair asked the status of the triangle of Theilmann property that comes down into Briardale Road. Mr. Clark said the Theilmann's were asked to dedicate the right of way for this road because this plat will help them develop their land when they are in a position to plat. Mr. Clark said it would be better for the grading and utility work if Theilmann's were to plat at the same time as the balance of this property is being platted. Mr. Goodroad said they have made every effort to work with every one concerned with the proposed plat. This is the best plan they could come up with that pleased the most people. Mr. Drigans asked Mr. Clark if all these lots will be buildable. Mr. Clark said there hasn't been enough time to check the lots against the elevations on the plat, but he would think about five lots would be prablem lots, where there will have to be a lot of grading, retain- ing walls and some terraci.ng. These would be Lots 26, 27, 28, and 29 for sure, where there is a 30 foot fall from the back lot line to the front 1ot line. They plan to use tuck under garages on these lots and will use about 4 feet for the driveway for the garage and about 6 feet on the grade of the house, leaving a difference in grade of ,r� 20 feet. This would be about a three to one slope. The two long lots in the Southwest corner of the plat have an area of about 70 feet they could k�uild on, and with a 35 foot setback and a 25 foot house, they could build on these lots. 1� �`'� � Planning Commission Meeting - February 20, 1974 Page 6 Chairman Fitzpatrick asked about the lots facing South on 61st Avenue. Mr. Clark said these lots are higher in front than in back, and will be walkouts. The petitioner has already stated that he intends to ask for a 10 foot variance on the front setback so these houses could be closer to the street. The houses on the same street in the Briardale Plat are set back 30 feet, so it wouldn't be too bad to have this variance as long as all the houses have the same setback. ' Mr. Harris said the right of way for the cul-de-sac on 61st Avenue is one of the hold-ups on.the plat. Mr. Clark said the petitioner will have to negotiate for the right of way for this cul-de-sac or move the cul-de-�sac. Chairman Fitzpatrick said it would be hard to make a decision on this;plat untiZ we know what the Parks& Recreation Commission decide on the par_k. Mr. Blair said there is already money budget�d for a park in this area. Chairman Fitzpatrick asked Mr. Harris if there was general agreement on this plat at the earlier Plats & Subdivisions meeting. Mr. Harris said this plat really didn't please anyone completely, but may be the best plat for this area. There were problems with the different grades but one of the stipulations made at this earlier meeting was that the grades be worked out with the City Engineering Department. Mr. Clark said it was difficult for the City or the petitioner to set grades until they have an approved preliminary plat to work with. Just looking at the topography map, it does look like it can work. Chairman Fitzpatrick said there were problems with the cul-de- sac, the park plan, the triangle and other problems on this plat that couldn't be resolved at this time and he wondered if the plat should be given preliminary a_pproval. Mr. Harris said the'se problems will have to be solved before final approval, so we could ask to see the final plat before it is submitted to the City Council. Mr. �Cl.a�xk said there is a sewer �and water project in this area and thepetiti�anerwould like to have this plat added to that project. He is also anxious to get some model homes built. Mr. Drigans said this was a sketch that was just drawn up today, and there were problems with this plat. We don't know if these will all be buildable sites, how many variances they will need, and if the problems can be worked out. Mr. Goodroad said this plat has been on the drawing board for some time, and it was only because of the requested changes that all the information wasn't ready at this time. Mr. Clark said they have prepared a topography:map,but at least three different plats have been drawn up in two weeks and it wasn't feasible to have this topography overlayed on each different proposal. Mr�. Harris said he felt it was necessary to approve this preliminary plat to give the petitioner some direction.. We will never know what � �"1 � Planning Commission Meeting - February 20, 1974 Page 7 the grades are or what the drainage problems will be, or what variances may be needed until we approve something. Mr. Lindblad said the Parks & Recreation Commission are going to have to have something to look at if they are to make a determination on the park land. Mr. Utter said he agreed with Mr. Harris in that the petitioner has to have somewhere to start and he has to have acceptance of this plat before he can start working on the problems. Mr. Drigans said he realized that the Plats & Subdivisions- Streets & Utilities Subcommittee had recom�ended approval of this preliminary plat but as far as he was concerned there were too many unanswered questions. He said he could see giving concept approval. He said we do not have any correspondence from Mr. O'Bannon on how he feels this plat will fit in with his property. Chairman Fitzpatrick said the petitioner was not asking for concept approval. He said that although this was the mast preliminary plat they had looked at in a long time, this was a request for prelim.= inary plat approval. Mr. Harris said the petitioner will be able to establish the street grades and lot grades after he has approval of this preliminary plat. ; Mr. Lindblad said he didn't think anything could be accomplished by delaying the approval of this plat. He said we should either approve or deny tYie preliminary plat at this meeting. MOTION by Harris, seconded by B.Zair, that the Planning Commission close the Public Hearing on the request for consideration of a pre- Iiminary plat, P.S. #74-01, Rice Creek Estates, by Goodco, Inc., and Pine Tree BuiZders. MOTION by Harris, seconded by Lindblad, that the Planning Commission recommend to Council approve of P.S. #74-01, a preliminary plat, Rice Creek Est���s, by Goodco, Inc., and Pine Tree Builders, a replat of part of Lots 9 and I0, Auditor's Subdivision No. 22, .Zocated between Rice Creek Road and 61st Avenue Northeast and West of Benjamin Street, with the following stipulations: (1) Subject to obtaining street dedication from the Theilmann's for the extension of Briardale Road. (2) Subject to obtaining right of way for cul-de-sac on 61st Avenue or realignment of the cul-de-sac on petitioner's property. DESIGNATION OF l.11 MILES OF STATE AID STREETS Mr. Harris�said this was reviewed by the Plats & Subdivisions- Streets & Utilities Subcommittee at their meeting of February 13, 1974. They changed the priority list as given in the February 7th memo from Richard Sobiech. The priorities stayed th� same except that Main Street from 83rd Avenue N.E. to 85th Avenue N.E. was inserted as number three instead of number one. The Subcommittee felt that they would rather wait a year on this street until the North Park area was settled. Mr. Clark said that with the mileage , that'.would be allowed the following year, they would be able to designate this street at that time. Mr. Lindblad asked the advantages and disadvantages to having State Aid streets. Mr. Clark said a city is allowed to designate 200 of its street as State Aid streets. We collect construction money and maintenance money based. on the mileage designated for State Aid. This year, the City rec�ived �185,000 in construction money. The disadvantages mirht be that they dictate how the road should be constructed. They must be 9 ton roads. The minimum width is 40 fcet and they like to see � them 44 feet or wider. Having a State Aid road does disrupt some �. neighborhoods because people tend to drive faster on these wider streets, and it has been said that we are building speedways. Mr. Clark said that on'the Iist of priorities recommended by the Plats & Subdivisions-Streets & Utilities Subcommittee that number 1 Planning Commzssion Meeting - February 20, 1974 Page 9 �'h needs another mat and curb,(Main Street - Osborne Road to 79th Avenue), number 2,(Commnacnumber 3,7(MainVStreet•E•83�doAbenue NOEa)toe85th another mat, a Avenue N.E.) needs everything. . Mr. Harris said that the City administration didn't feel we would get State Aid approval on priorities 4 and 5. Mr. Clark said that Benjamin Street from Rice Creek Road to Gardena Avenue, is a brand new street�and we probably won't be spending any money on this street for 20 years. On the fifth priority, Jackson Street -- 73rd Avenue N.E. to Osborne Road, one of the conditions the State put on this route was that it be continued South from 73rd across Rice Creek to Rice Creek Terrace. Mr. Drigans asked why we are designating f'ive priorities when � cnly t�ao can be approved. Mr. Clark said that if the State doesn't accept the first two priorities, they would alternate priorities to choose from. Mr. Drigans asked if there were other places in the Cit� other than those on thispriority list that would be better to designate. Mr. Clark said many routes are suggested to the State, and they then tell the City where they would accept State Aid designation. MEMO FROM DARREL CLARK TO CITY ATTORNEY: FEBRUARY 8, 1974 Mr. Clark said this memo covered two items. The first was on the sign ordinance on billboards. He said he had talked to Mr. Herrick and he said he would answer this part of the memo after he has met with the Planning Commission and the Board of Appeals. The sscond item on the memo was just to ask for clar�fication on recommending a Special Use instead of rezoning, and he said this was something v�re have done before on the�North Suburban Hospital �• District rezoning request. Mr. Clark said you couldn't change the rezoning request to different zoning, but as a Special Use Permit is more restrictive, this is allowed. � Planning Commission Meeting - February 20, 1974 Page 10 � Mr. Clark asked when the Planning Commission and Board of Appeals � would like to have their meeting with Mr. Herrick. Mr. Drigans said the Board of Appeals was meeting on March 12th and_the special meeting could be held after this meeting as long as the Board members would already be present. He said they usually met at 7:30 but they could meet at 7:00 this evening so the special meeting could be sure to start around 8:00 P.M. This was satisfactory to the other members of the Planning Commission. Mr. Lindblad asked if there was any advantage to the City in . allowing billboards. Mr. Clark said he thought it might have been the intention of the Planning Commission and the Council when they adopted this sign ordinance that possibly they could eliminate some of these billboards in five years since the ordinance required Council action on billboards . within five y�ars of the original adoption, at least the ones that have serious problems. These would be the billboards that are too close to an intersection or in residential areas. Mr. Drigans asked Mr. Clark if he cbuld prepare a map showing the location of the existing billboards and have photographs taken of each one. They wi11 have to get additional right of way from peaple South of the plat for this cul-de-sac. ' Mrs. Gloria Arel, 1521 Ferndale Avenue N.E.,,asked if this road was going to be cut to the elevation of the gravel pit. Mr. Clark said the cul-de-sac would be about 300 feet West of Benjamin Street and would be about 10 feet to 15 feet above the grade at Benjamin. You can't go steeper than 6% or the cars would have difficulty going up and down this.street in the winter time. Mr. Ctiarles Rice, 1521 Ferndale Avenue N.E., sa�i•d part of the circle for the cul-de-sac would be on his property and he didn't want to give up any of his property for the cul-de-sac: M�. Thomas Eggen, 1344 Hillcrest Drive N.E. said there were some � .�high cliffs in this plat and how did they expect to build homes on _�tixthem. Mr. Goodroad said they would have tuck under garages. Mr. Harris asked if all the lots next to Heather Hills would have to have tuck under garages. Mr. Harris said Mr. O'Bannon had come to the last Plats & Sub- divisions-Streets & Utilities Subcommittee meeting after the petitioner had 1eft, and it didn't seem that he would be agreeable to having any� grade change started on his property, so any grade change would have to start at the property line. Mr. Harris asked about drainage for this plat. Mr. Clark said it would depend upon when the Theilmann parcel was platted as to where the drainage would go, but there wasn't a drainage plan for this plat yet. Mr. Harris asked about public utilities. Mr. Clark said they �would come in from Benjamin. He said there was an 8" pipe and this was larg� enough to take care of this area and there would be enough of a drop, for these utilities. Mr. Harris asked about the electric and telephone lines. Mr. J"� Goodroad said they intended to have underground uti�lities. Mr. Robert Ledin, 6243 Kerry Lane N.E. asked what would be assessed against the abutting property owners for the development of utilities for this plat. Mr. Harris said he thought the only assessment would be for storm sewer and this Subcommit�ee couldn't say if Mr. Ledin would be assessed or not. This would be determined by the City Council, and they would hold a Public Hearing for any assessments. Mr. Goodroad said he didn't know if there would be storm sewers in this area. It might be handled by catch basins. Mr. Rice, 1541 Ferndale Avenue N.E., said he didn't want to lose property for the cul-de-sac and then get assessed for the street also. Councilm�n-at�larg�,Utter said that the lots on Ferndale were large eno.ugh so they could be split into two lots when Glst Avenue with the cul-de-sac is constructed. Mr. Rice said they didn't want to split their lot. , Mr. Utter said he thought there was a problem being created with the area being set aside for a neighborliood park. There should be another access to this park or it would be almost landlocked from � the children South of this plat. They would be cutting through private property to get to the park. He thought there could be some shifting of Lots 10 through 15, and 10 feet could be taken off Lot 9, to allow a walkway along Lot 15. Mr. Harris said he wouldn't think so, but couldn't say with certainty because the storm sewer design has not been made for this plat. Mr. Clark said the petitioner is not dedicating the land for the entire park. He is dedicating l.8 acres and the additional acre or more would have to be purchased by the City. This premininary plat is also going to the Parks and Recreation Commission for consideration of the park area. � Mr. Harris asked about the lots along Heather Hills. He wondered ! if it would help to make deeper lots. Mr. Clark said the front elevation of these lots was 920 feet and the bank elevation was 950 feet. He . said they can make up 4 feet with the driveway and anather 6 feet with the tuck under garage, so that would be 10 feet altogether. This would make a three to one�lope or 20 vertical feet in about 70 feet horizontal in the rear yard. Mr. Harris asked if all these lots would be buildable. Mr.. Clark said he thought there would have to be some terraeing and retaining walls, if they were going to be buildable. Mr. Harris asked Mr. Goodroad if they planned any vegetation in the area. Mr. Goodroad said they didn't have any plans as yet. Mr. /'� French said they have been asking that new plats provide one tree per lot. This shoul,d be a tree that is disease resistant with a minimum of 2" diameter. Mr. Goodroad said they have put it in the purchase agreement or in a covenant that the property must be sodded one year from completion of a home site in other areas, and this could be done here. i`� Mrs. Gloria Are7� said she had a petition signed by 25 people who were against this plat that she would like to present. Mr. Harris sai.d it was poor planning and poor engineering to have a dead end street without a turn around. It makes it difficult for plowing snow, inconvenient for emergency vehicles, and trucks have to pull into a private driveway to turn around. Mr. Lembke said trucks use his driveway and he doesn't mind. Mr. Clark said it is a dangerous practice if there are children playing in the area. � Mr. Harris asked Mr. Theilmann how he liked the revis�d pre- liminary plat presented at this meeting. Mr. Goodroad said they have set aside a 20 foot strig for this purpose. Mr. Harris said we still have the problem of the cul-de-sac on 61st Avenue. We wi11 have to ask the petitioner to obtain the right of way for the cul-de-sac or have the City negotiate for it or siart condemnation proceedings for this right of way. Mr. Harris wondered if some of the property shown as park property could be inoved so there would be room for the cul-de-sac on this plat. Mr. Clark said the terrain was such that they would need at least 300 feet by 300 feet for park property to provide the facilities the Park & Recreation Director would like to see in this park. A ball diamond needs 250 square feet. If the petitioner has to shorten the cul-de-sac, he will lose Lots 20 and 21 for building sites and the balance of these lots could probably be added to the park property.. Mr. Clark said the petitioner can work with the neighbors and the Parks & Recreation Commission on this cul-de-sac but he didn't think this should hold up the plat. Mr. Theilmann said they didn't want to dedicate the road for � Woodside Court at this time because if they did, they might as well plat because they would get all the assessments, and they ��r�n't in a position to plat at this time. Mr, Goodroad said he has already lost 15 lots from this plat, and the plan presented tonight �as the best he could do to please the most people. If this plat wasn't acceptable, he was ready to let the property go�back to the City. Mr. Harris said there is going to have to be some street dedication from the Theilmann's for Briardale Road that will be going through at the present time on this plat. There is a smalltriangle of the Theilmann property in this road. He thought this dedication would be of mutual benefit to both parties. Mr. Goodroad said he didn't think it would hinder any property even if they didn't want to split their lots, to have a small part of the cul-de-sac on the property South of this plat for 61st Avenue. Mr. Clark said it wouldn't take much property, but the peaple didn't want the assessments that would come with having this cul-de-sac on their property. Mr. Harris said that if the petitioner didn't want to negotiate for the 61st Avenue right of way he needs for the cul-de-sac, or couldn't negotiate, then it would have to be negotiated by the City or condem- /1 nation proceeding would have to take place. He said this would add 25% in administrative costs to the cost of acquiring this right of way and this would be assessed back to the property owners in the project. For this reason, it is better and cheaper for the petitioner to do his own neg�tiating.. Mr. Harris said he thought the Subcommittee would be negligent if theyapproved this plat without the street dedications. � �� Plats & Subs.-Str. & Util. Sub. Mr. Harris said that it was one of the hard facts of life, that a developer has to give to get. � Mr. Harris said he didn't warit to get into any real estate d.ealings, but perhaps Mr. Goodroad could do some trading with the Theilmann's for the righi of way on the small corner of their parcel needed for right of way on Briardale Road, and the Theilmann's needed a 17 foot strip to make their lots meet the minimum front footage requirements, when they want to develop their plat. Mr. Harris said that Woodside Court could be temporarily dead- ended until the Theilmann's were in a position to plat. � Mr. French said that one solution would be for the Theilmann's to dedicate the street right of way to the City on Briardale Road in consideration of the petitioner platting his parcel in such a way as to allow Mr. Theilmann to get 8 lots when he is able to plat. Mrs. Theilmann said they would like to check with their attorney on this. Mr. Harris said we wouldn't have to have the street dedication �, until Council was ready to consider the final plat. Mr. Theilmann said as long as they didn't have to give an answer on this right now, they didn't want to hold up approval of the plat. He said he did noi know i_f there could be any leeway in dealing with his loan company. Mr. Tonco said that he felt the sidewalk was definitely needed and that all possibilities to convince the loan company that tlie move is desirable should be carried out. If they still have any problems then possibly some� thing could be worked out with the Planning Department in order to get the required side�aalk. � Mr. Tonco asked how the wood canopy at the front entrance would be constructed. Mr. Babinski said that the wood panel would be flush with the wall abhve the doors. Mr. Boardman sa.id that this was not what was dis cussed and set up originally. The wood was supposed to be at the front face of the four foot wings forming a canopy out of the entire section. This canopy would house any entrance lighting for the doorway. Mr. Babinski said that he was not aware of this and had always been under the impression that the wood �ould be just attached directly to the wall between the fins. Both Mr. Lindblad and Mr. Tonco agxeed that the framing of the canopy as originally concurred would cause undue hardship to the builder and tlzey would suggest that they accept the wood panel directly attached to the building wall but that a flat canopy about 1? to 18 inches in depth be located betcaeen the fins right above the door for weather protection and entrance lighting and that the canopy be constructed to match the wood panel on the back wall. Mr..Lindblad asked if there will Ue any rooftop equipment. Mr. Babinski said that there would be, but that they �vould be quite small, no more than 24 inches high. rfr. Lindblad said that our code requires .these to be screeried i.f they can be seen from public thoroughfare. �9r. Babinski said that it would be almost impossible to see them on this size of a building. The existing building has the same type of equipment and it cannot be seen from the street. He said he would be willing to screen them if requested to do so.
