Mr. Lindblad said he had one comment to mak�. He said that he
noted that Council had concurred with the Building Standards-Design
Control Subcommittee recommendation on the Salt Storage building except
that they deleted stipulation 5 which stated that Council work up an
agreement with the Minnesota Highway Department stating either they
provide an area for multi-recreational use a.r provide an access to an
area for such use. Mr. Lindblad said they thought a boat or canoe
launching area could be provided as this would be an ideal site for
such a facility. Mr. Clark said there was a real need for this. Mr.
Harris said he had been at the Council meeting and as he remembered it,
it seemed that they felt they might have problems of security in proviain
this facility. �

/'1 � Chairman Fitzpatrick read the Public Hearing i�otice on the
proposed amendment to Chapter 205, Section 205.051, Paragraph 2, A,
Accessory Uses, of the City Code of the City of Fridley.
Nir. Fitzpatrick said the purpose of this proposed change was
to set a riia�imum size on second accessory buildings that would not
require a special use permit.
Mr. Lindblad said he thought only one accessory building and
one additional accessory building is ail that should be allowed on
a lot. He said he wouldn't like to see two or three little sheds
on a property.
Mr. Fitzpatrick asked how many accessory buildings under the
minimum square footage requirement for a special use permit would be
allowed on a lot.� � .
Mr. Clark said the intent is to allow a garage and one other
accessory building. Mr. Harris said he thought this should be
discussed so the intent was clear in the ordinance.
Mr. Fi:tzpatrick said we have to decide at what point we want
a second accessory building ta require a special use permit so that
the requests be�ow this requirement can be handled at the staff level.
^ Mr. Clark said the intent of the original ordinance was so that
� a second accessory building couldn't be built that would be used for
additional income. He thought any building up to a 12 f oot x 20 foot
� size would be too small to allow any use but for the purpose intended,
which would be for some type of storage. You would need a building this
large to store a boat, for instance.

Mr. Harris said we co�uld specify that any accessory building not
be used for home occupation. Mr. Clark said this is already in the
Code. Mr. Harris said he thought it would be a good idea to restate
it in this section of the code also.
Mr. Fitzpatrick said he thought that anyone who was going to
try and use a second accessory building for additional income would
want a building larger than 240 square feet, and this would still
require a special use permit so this could sti11 be controlled.
Mr. Harris asked Mr. Clark if they should specify that these
second accessory buildings have to meet the State Building Code. Mr.
Clark said he was sure that the metal storage sheds did not meet the
State Code. They didn't have 40 pound roof loads for one thing. He
said these aren't habitable buildings, and the metal storage sheds were
so popular, he didn't fe�l they should concern themselves with this. He
said people don't enter storage sheds that much in the winter time and
it would really be a coincidence if one collaped when someone was in it.
Mr. Harris asked Mr. Clark how having this building affixed to
a permanent foundatian would be interpreted.. Would this mean a concret�
slab? Nir. Clark said he didn!t think a concrete slab could be required.
He said h� has seen a post and beam used also and there may be other

methods to keep these buildings permanently located. This is to
prohibit people from buying a floor for these buildings and not
attraching these buildings to any foundation. He said he thought
the statement could remain as it was as the City wasn't having any
problems with i� now.
MOTION by Lindblad; seconded by Harris, that the Planning
Commission close the Public Hearing on the consideration of amending
Chapter 205, 5ection 205.051, Paragraph 2, A, Accessory Uses, of the
City Code of the Ci.ty of Fridley. Upon a voice vote, all voting aye,
the'motion carried unanimously. �
MOTION by Narris, seconded by Lindblad, that the Planning
Commission recommend to Cbuncil that Chapter 205, 5ection 205.05I,
Paragraph 2, A, .Accesscrz� Uses, of the City Code of the City of
Fridley be amended to read as follows:
2. Accessory Uses
A. Private garages or other accessory buildings. On1y one
a�cessory building �n excess of 240 square feet is allowed
per site. One additional accessory building is allowed
provided it does not exceed 240 square feet.
^ Any accessory building in excess of the above requirements
(square footage or number of buildings) requires a special
use permit.

garages whether attached to, tucked under, or detached

Mr. Harris asked Mr. Clark to contact Herb Meyer of the State
Building Code Division and ask about these metal storage buildings
having standards set by th� State.
2. CONTINU�D: PUBLIC HEARING: P.EQUEST FOR A SPECIAL USE PERMI`1',
SP #74-10, BY W. RED STANG: Per Fridley City Code, Section
205.051, 3, N, to allow trailers, campers, mobile homes, boats,
machinery, s.parting equipment and like enterprises having its
merchandise in the open and not under cover of display salesroom,
to be located on Lats 1 and 2, Block 1, C. D. Hutchinson Addition,
. located at 6451 East River Road N.E.
Public Hearing open.
^ Mr. Clark said the petitioner has asked that this request be
continued until he can meet with the Oil. Company to see if he will
be able to have a fenced in area for any outside storage he might
need. If he can obtain this, he wili withdrau� his request. If he
can't obtain this, he will still need a special use permit.

MOTION by Harris, seconded by B1air, that the PZanning Commission
continue the request for a SpeciaZ Use Permit, by W. Red Stang, SP
#74-Z0, until the petitioner decides to wiihdraw his request or to
continue to seek this special use permit. Upon a uoice vote, a11
voting aye, the motion carried unanimously.
3. RENEWAL OF SPECIAL USE PERMIT, SP �73-03, BY KEITH S. SWENSON
AND DENNIS D. SARKILAHTI: To continue a service station and
permit the addition of rentaZ of local and one-way truck and
trailers, as per Fridley City Code, Section 205.101, Paragraph
B, 3, E, l, to be located on the East 119.01 feet of Lots 28, 29,
and 30, Block 4, Hyde Park Addition, the same being a Texaco
Station at 6071 University Avenue N.E.
Mr. Dennis D. Sarkilahti was present.
Mr. Sarkilahti said Mr. Swenson was no longer connected with
this request. He now has U-Haul trucks and trailers instead of
E-Z-Haul.
Mr. Clark said that as far as he was concerned this was one
of the cleanest rental stations that he had seen in a long time.
The petitioner has kept the rental units in an orderly mannex. Only
once or.twice has there been more units on the property than there
shou)d be and the petitioner said this would happen at times when
a lot of units came in on the week-end and they couldn't be moved
until Monday.
Mr. Clark said they have changed off on where they parl�ed the
trailers and the trucks. Mr. Sarkilahti said the reason this was chang-
ed was because where the trucks has been located, this had almost
caused an accident happening an:coming over the curb. Mr. Blair
said he liked the location of the units better where theY were
�ocated now, than where they were located before.
Mr. Clark said the Ci�y�has received no complaints on this
operation. He said that the present operatar of this station was
doing a good job in keeping a neat operation.
Mr. Lindblad asked about the one year renewal. Mr. Clark said
he thought this was a good policy because it helped keep the oper�tor.

Mr. Fitzpatrick asked the petitioner if he had any objection�
to a yearly review of the special use permit. Mr. Sarkilal��i said
he had no objection. .

4. VACATION REQUEST, SAV #74-01, BY'FLORENCE E. SWANSON: Vacate
that part of Hugo Street dedicated in the plat of Swanson's
Terrace, lying Easterly of the Southerly extension of the West
line of Lots 1 an� 3, Block 1, Swanson's Terrace.
5. REQUEST FOR A LOT SPLIT, L.S. #74-1I, BY FLORENCE E. SWANSON:
Relocate the division line between Lots 3 and 4, Block l, 5wanson's
Terrace, to be located parallel to and 80 feet South of the
South line of Lots 1 and 2, Block l, Swanson's Terrace.
Mr. Clark said that what prompted this request was the sale
of Lots 4 and 5 to the City for park property. Lot 3 will remain.
a residential lot. The reason for the dedication for the bubble
for the cul-de-sac was to give access to Hugo �treet for these lots
which isn't needed now.
Mr. Harris said he had talked to P�irs. Swanson's representative
on the telephone before the meeting. He.wondered.if he had to come
to the meeting, and he told him he didn't think he had to be there.
Mr. Harris said Mr. Sporre told him this is torrens property.
�, Mr. Clark said they may have a problem at the County. He said
that if this had to be platted, the City would probably have to share
in the cost because of the park land. Mr. Harris said it was worth
a try to handle this as a lot spTit. Mr. Clark said the legal descrip-
tion was quite simple so this might help.
Mr. Harris asked if it was going to be hard to describe the
vacation? A7r. Clark said no. It could be described as all of Hugo
Street lying East of the Westerly line of Lot 1 extended South.
MOTION by Harris, seconded by B1air, that the PZanning Commission
recommend to Council approval of a vacaiion request, SAV #74-01, by
F1or�nce E. Swanson, to vacate that part of Hugo 5treet dedicated in
the plat of Swanson's Terrace lying Easterly of the Southerly extension
of the West Line of Lots 1 and 3, B1ock 1, Swanson's Terrace. Upon a
voice vote, a11 voting aye, the motion carried unanimously.
Mr. Fitzpatrick said he thought the request for a lot split was
a rea�onable request to stra.ighten out the lot line of Lot 3.
Mr. Harris asked if there would be a fence between the park
property and Lot 3. rir. Clark said he was not familiar enough with
the development of the park property to know if tnis would be fenced.
They ususally do put up a fence. Mr. iiarris said it would loak bett��r
to have the fence go on a straight line�than at an angle.
^�� Mr. Harris said what this lot split request amounts to is
a land trade off between Lots 3 and 4.
MOTION by Lindblad, seconded by Harris, that the P.Zanning
Commission recommend to CounciZ apprvval of the request for a lot split,

Mr. Harris asked Mr. Clark if it was necessary to state that
if this dian't get accepted by the torrer�s examiner it will have
to come back as a plat? Mr. Clark said no, it will just have to

Upon a voice vote, a11 voting aye, the motion carried unanimously.
Mr. Clark said the petitioner had stated orally that they thought
the fee should be waived on these requests because the City is benefit-
ing from these requests also.
MOTIDN by Harris, seconded by Lindblad, that the Council consider
waiving the fees for the requests for a vacation, SA V#74-01, end
a 1ot split, L.S. #74-1.Z, bv F.Zorence E. Swanson, because the City
wi11 benefit as much as the petitioner from these requests. Upon a
voice vote, a.Zl voting aye, the motion carried unanimously.
6. I�IEMO FP.OA'! JERROLD BOARDMAN ON ZONING CHANGE FOR CHASES ISLAND
Mr. Clar)c said the City had received a letter from the State
saying that they will approve our fload plain ordinance with the
� change that Chases Island be changed from CRP-2, flood plain, to
CRP-1, floodway. This doesn't affect the use of this property as
far as the use the City can make of this property. Boat docics and
� shelters or anything else that would not float away during a flood
can be built on this property. The reason for this change was because
CRP-2 would allow the filling of land, and they want to make sure
the channel coulcl not be narrowed with land fill. He said the City
had no objection to this change.
MOTION by Harris, seconded by Lindblad, that the Planning
Commission receive the memo from Jerrold Boardman on the zoning
change for Chases Island. Upon a voice vote, a11 voting ay,e, the
motion carried unanimously.
7. INFORMATI'ON FOR HYDE PARK �TUDY
Mr. Fitzpatrick said this is still under discussion by the Council
and as the Planning Commission had received all this information on
Monday, he didn't think anyone had been able to read it all yet.
Mr. Harris said he was at the Council meeting on June 3, 1974. He
thaught the Couricil was thinking about having the Planning Commission
hold a Public Hearing.
Mr. Clark sa�d the Planning Commissior. should probably wait on
^ this until they get the minutes of that Council meeting so this could
be cla�ified.
MOTION by Harris, seconded by Blair, that the Planning Commission
receive the information for the Hyde Park Study and continue this item

8. ARTICLE FROM PUBLIC MANAGEMENT MAGAZINE 1970 FROM JERROLD BOARDMAN:
AESTHETIC POLLUTION
MOTION by Lindblad, seconded by B1air, that tfie Planning Commission
receive the article from Public �anagement 1970 from JerroZd Boardman
entitled Aesthetic Pollution. Upon a voice vote, alI voting aye, the
motion carried unanimously.
�r. Clark said this was an article t�at had been called to
Mr. Boardman's attention and he thought it was something the Planning
Commission would be interested in.
Mr. Fitzpatrick said this is something we have talked about from
time�to time in relation to billboards. He said he had been to the
Fridley D.F.L. convention and there seemed to be support�for the
enforcement of the sign ordinance. He said they weren't as specific
as he woula have liked them to be.
Mr. Harris said there was discussion at the Council meeting on
having the Environmental Quality Commission study and make recommenda-
tions on the applications for variances and special use permits on
the billboards. These would come back to the Planning Commission and
^ Board of Appeals.

Mr. Langenfeld said that someone on the Council has said that
the Environmental Quality Commission could make recommendations on
whether the variance sho�ald be allowed an� this had been questioned �
by the City Attorney. Mr. Harris said this was because only the
Board of Appeals were authorized to make recommendations on variances.
What the Board of Appeals and the Planning Commission want from the
Environmental Quality Commission is a recommendation on the �nvironmental
impact of each billboard which would help these two bodies in their
recommendations.
9. INFdRMATION FROM JAMES LANGENFELD FOR THE PLANNING COMMI5ION
MOTION by Lindblad, seconded b� Harris, that the Planning Commission
receive the i.nformation from James Langenfeld. Upon a voice vote, a11
voting aye, the motion carried unanimously.
Mr. Langenfeld said that most of this information was self-explana-
tory. He had given them a copy of the Environmental Quality Commission
by-laws and information he had received at an environmental symposium
at the University of Minnzsota. '

�tembers of the Planning Commission got a copy.
Mr. Langenfeld said he often got material that he thought the
Planning Commission should have. Mr. Fitzpatrick said the Planning
Commission would like ta have copies of the Environmenal Quality
Commission nlinutes. Mr. Langenfeld said he would ask the secretary
to see that they got them and then he could include any other informa-
tion along with this.
10. GENERAL DISCUSSION
Mr. Lindblad asked when Burlington Northern was going to clean
up their junk yard between 47th and 49th Avenue. He said this should
either be cleaned up or fenced. Mr. Clark said this should be taken
care of by late summer or in the fall.

Mr. Harris said that up in East Ranch Estates by the 78th Street
exit between Rancher's Road and University there was a break in
the sanitary sewer line and surface water �aas running into the
sanitary sewer. He said the Metropolitan Sewer Board should be
notified of this to see if some credit could be given. This should
be repaired.
NOTE: This has been fixed temporarily until there is storm
sewer construction.
Mr. Harris asked when they were going to work on the drainage
ditch for 78th Street and get the storm sewer for this area completed.
NOTE: August 15th is the completion date.
Mr. Langenfeld asked who would be doing th� testing for
Moore Lake. Mr. Clark said he knew there had been bids taken, but
he didn't know who had gotten the bid.
Mr. Langenfeld said that he wondered if anyone on the Planning
Commission had seen all the trees that had been cut down in the
County park west of East River �Road. He said that when you see this,
anyone would vote for a tree ordinance. He said you can see all the
way to the river now.
NOTE: The County went in to clear some brush and found di_seased
trees. They had no choice but to cut them down. -
Mr. Harris asked Mr. Clark to check on a sign by the Town Crier
that was in City right of way. .

Chairman Langenfeld opened tk�e meeting at 7:40 p.m.
BY-LAWS
Mro Langenfeld asked the Commission members if theq had any comments on the
By-laws in their final draft formo Mrs. Sporre directed a question to the
Planning Commission members as to whe�.her or not they had absentee voting
or proxy voting in their ?iy-Laws. Mr. Fitzpatrick stated that they did
not. Mrs. Sporre expla�:ned they had proxy an3 absentee voting so as to
be ahle to get full input from the Commission members when a member is
absent, as long as neiiher vote is being used to constitute a quorum.
/"1 Mr. Fitzpatrick said when 2 out of 5 of the Planning Commission members
are absent, they continue their actual bi�siness until a meeting where there
is better attendance.
POSITION OF EQC MEMBER 0'� THE PI,ANNING _COMMISSION
Mr. Langen�eld read out loud the discussion made at the Planning Commission's
meeting on Apri1 3, concerning the position of a EQC member on the Planning
Commission. The motion was made for the Planning Commission to take under
advisement having a member of th� EQC becom.�ng a permanent member of the .
Planning Commission.
It was said that if a member of.the Environmental Quality Commission became
a member of the Planning Commission, the EQC would become a subcommittee of
the Planning Commission. Mr. Erickson asked if the subcommitt�e came up
with something, would that go directly to the Council; Mr. Fitzpa�rick
said it deger�ded on what type of action it.was. All recommendations would
go directly to the Council. Mr. Harris said they would have direct access
to the EQC minutes if they became a subcommittee. They would have the
opportu�l��+.y of either accepta.rL� �r commenting on the minuies.
Mrs. Sporre said she felt it was the EQC's idea ta become a member of the
Planning Commission so as to give more balance to the Planning Commission
and to expand their own criteria for decision making. She asked if they
took the structural area of the land into consideration when they were
� making plans? Mr. Harris said they required that a complete set of
,� engineering drawings be made at the time of the glat. They go into depth
on their research and take into consideration the location and surrounding
areas.
ENVIRQNMENTAL SYMPOSIUM
Mrs. Sporre reported on the Environmental Symposium she had attended,
It began with a general discussion an the new Legislation. Several

Enviranmental.leaders spoke on the Legislation. She att-ended the seminar ���
on �nvironmental Impact StaL-ements. She also attended the workshop on fihe
� �Metro Parics Bill, and aslced some questions pertaining to North Park.
Mr. Langenfeld added that the Symposium began as a general discussion and
was broken down into �-�orkshops afterwards. One of t.he taors:�op's Mr. Lan�enfeld

person or citizens must have a desire and taillingness to accomplish a certain

(b) PURPOSE.
(1) The purpose af these �egu1ations is to provide public agencies and
private persons �,�ith pol7cy, definitions, proccdures, criteria,
siandards and guidelines of stateavid� application ta be used in

(2) Because deve�lopment in areas of the State that possess important
historic, cultuial, or esthetic values or natural sys�ems �hat
perform fur�ctians of greaf:er than local significance may resuit
in irreversible damag� to these resources,.decrease their value
and utility for public purposes, or unr�dsonably endanger life
and proper�y, th� Sta�e shall id�ntify these critical are�s and
assist and cooperate with local units of a�ver�nment in the preparation.

(4) The critical areas plannign process is intended to be applied to
a limited nurr��er of �reas in the Sta��.� Criiical area designation
based or� crit�ria that may cha�acterize large or common areas of the
� . State or reyian shall be avoided.

(c) pEFINITIONS { ��
n The following terms as used in these Regulations, shall have the �ollowing
meanings, unless otherwise defined:
(1) "Council" means t�e Minnesota Environm�ntal Quality Council created
pursuant to Minn. Stat. �116C.01 et. seq. (Supp. 1973).
(2) "Developer" means any perso� or governmental agency undertaking any
development as defined in these Regulatiors.
(3) "Development" means the making of any material change in the use or
appearance of any structure o� land including but not limited to: �
(aa) Reconstruc�ion, alieraiion of the size, or material change
in the ex�ernal appearance of a s�ructure on the land;
(bb) Change in the intensity of use of t�e land;
(cc) Alteration of a shore or bank of a river, stream, lake or
pand;
(dd) Cemmencement of drilling (except to.obtain soil samples),
mining or excavation;
(ee) Qemolition af a structure;
^ (ff) Clearing of land as an �djunct to construction;
�
(gg) D�posit of refuse, solid or liquid waste, ar fi11 on a
parcel af 1and;
(hh) Divisian of land into three or more parcels.
(4) "Development permit" means a buildi�g permit; zoning permit; water
use permit; disr�arge permit; permit �or dredging, �illing or
altering any portion or a watercourse; plat approva1; re-zonins;
certific�tion; variance or ather actian having the effect of permitting
any development as defined in the Act or ihese Regulatians. .
(5) "Government develo�ment" means any devela�ment financed in whole or
in substantial part, directly or indirec�ly, by the U�ited Stat�s,
the S�ate of M7nnesota, ar any�agency or poiitical subdivision thereof.
(aa) "Development �inanced in substantia'1 part" m�ans developm�nt
. with more than 50 percent of its financing or.reimbursement
from monies of the gavernments, or any agency, or politTCal sub-
division thereof. . .

(bbj "DevPlopment financed indirectly" means development
. under°µrritt�n or insured by m�nies of the governments,
� or any agency ar poli�ical subdivision thereof.
(6) "Land" me�ns the earth, water, and air, above, below or on the
surface a►�d includes any improvcments or struciures customarily �
' regard�d �s land.
(7} "Local u��� of governmpnt" mea��s any political subdivision of the
State, including bu�.��ot limit�d �o counties, municipali�les, towrt-
ships, anci all agenc��s and baards Lhereof.
(8� "Order" n�ans the G.o`��r•�or's Er,ecutive Order that formally
desigrai.e:� a part�cular area as a critical area upon t�e
recorrmcnda�ian of th� Council.
(9) "Parcel" of land means any quantity of land Gapable of being
d�scrib�d �,�itn such defini 4e�ess t�at 9ts loc��t�on and bo�ndaries
may be �stab�liJhed, which is desi�nated by its owner.ar developer
as l�n� ta ae us�d or� c9evelop�d as a unit, r,r which has been used
or develap�d as a unit.
(10) "Powers" me�ns the statutcry or othe� legal authority of federal,
state, o�° regional ager�cies and iocal units of gavernment.
(11) "Recor�nerda�tion" means a written documer�t praposing a particular
� area as a cri�ical ar�a that is efficially submitted for review
and aci;ion by the appropriate bodies.

(12�} "Region�l Developm�r�t CommissiQn" m�ans any Regional D�ve�opment
Comn�ission creaied pursuant to i�i�nn. S•tat. S�Vtions 462.381 to
462.395 (i97�) and tt�e M��tropolitan Council created pursuant
to Nlinr�. Stat. Chap�er 47�B (l�il}.
(13) "Regula�ians'" means tf�e instrurn�nts by which state ag�ncies and
1oca1 ui7its of governm?nt contro1 the physical develo�ment of
th� critir.al area or any part or d�ta�l th�reof. Reg�l�tians
includ�, but are na� limit;�d to, ordinar�ces establisi��ing zoning,
subdivisian cor�t�c�7, platting and the adop�:ion of detailed maps.
(14) "State agencv" means a Stat� t�o�rd� cammission, instiiution, or
any other uni t of ��ate goverr�m`r��..
(15} "Structure" means anyt���ng cons�r�t�cted or installed or portable,
the �s� o� Evhich requ�res a locai�en on a parce� of land. It
incl«de� a�rnova�ie svru�.tc�re �v�hich can, wi��le i�t is lo��ted on
land, bA used for f�ausing, business, comm�►~cial, agricul�ural,
or office �3urpose� ei�ther tempararily or pe�manently. Structure
also includ�s fen�.es, billboards, swimmir,g pools, poles, pipelines,
iransmission lines, tracks and a�dvertising signs.�

A critical area sha11 have ane of the following four characteristics:
(1} An area signific�n�ly affected by an existing or propos�d major
govet��m�nt developrn�nt that is intend�d to serve subs�antial
nunbers of p�rsans �eyond the vicinity ir��vhich the d�v�iopment
is lacated and ihaL tends to genev�ate subs�antial development
ar urbanization.
(2) An ar�a having a s�gnificar�� effect �a,pan an existing or� proposed
� majar c�av�pnment a�velopm�r�� that is intended to serve substan�ial
numbers a�' persorr beyond ��e v�ci�ity ir� which the de�elopment
is Toca��d and �ha�� �tends to g�nerate ssabstantial dev�lopment
or ur�banization.
(3) An area containir�g historical, natural, scientific, or cultural
resources of reg�onal or statewide impor�ance.
(4) An arca having a significant #mpac�'upon historical, natural
scie��iric, or cultural resources of regional or s�atewide
� import�nc�. ,

(b) G�ITERIA.
In accord�n�;e with tt�e characteristics of h4EQG 52 (a) and the
purpose o�= th�se Regulations, a critical area shall mzei all af the
fallowing criteria:
(1) The area si�all bP of significan� regional or statewide
public interes�;
(2) Other pati�rers are uriavailable, inapplicable, or are not .
being used �ffec;t�6vely to �nsure ad�qua.t� and coord�nated
local¢ regional, or s�ate pianning an� rregulation to protect
the. public int�res� T��the area�
(3) The ar�a shall be one of a limited nu�i�er of such areas in
ihe region or sta��; and
(4) The a�°ea shall be described s�p�cifically enough to permit
delineatian by legal description. �

no p�ians or regulations for the critical ar�a exis� a� �he time
of the ord�r of designai�on, the plans and regulations shall be

unjt of government, it may seek-reimbursem¢nt from �he local unit of
governmen�t far the actual cnsts of pr�para�ian.

explained that the State said this area will be a restricted area and no one
will be allotived to entir it at all. Mr. Boardman said the .Polluti_on Contra;
Agency has set up certain specifications for salt storage sheds and the Highway
Department has met these specifications.

asked Mr. Pascke if he could reduce the size of his building to 45 feet X 75
ieet from 55 feet X 75 f.eet, giving l0 extra feet for the seiback. Mr. Pascke
will be asking for a 25 foot setback instead of the normal 35 feet. r1r. Boardman
wanted to warn Mr. Pascke that the Board of Apgeals were usually very strict
on the 35 foot setback. I��1r. Pascke said that �aould give him too small of a
building to build and he ��ould have to decide if it would be ��iorth it to build

Mr. Roy Taylor, general contractor and brother of the applicant, wa� present to

MOTION by Crowder, seconded by Gabel, to waive reading the public hearing n@tice.
Upon a voice vote, there being no nays, the motion carried.
Mr. .Taylor.explained the buildings to either side of the proposed dwelling have
less than the required 35 foot setback. He said they would like to line this
house up with the existing garage that is set back 22.7 feet from the Fairmont
Street property line. He said this location will be more convenient in getting
from the�house to the garage. He said they would also like to line up with the
dwelling that is set back 19.9 feet from the property line along Broad Street.
Chairman Drigans asked why they are tilting the house. Mr. Taylor answered for
appearance-wise mainly, He added this will prevent cutting down several trees
and wi11 give more privacy ta the back yard.
Chairman Drigans asked why the house can't face Fairmont Street. Mr. Taylor said
it could, but this positioning will make a much nicer corner. He said this location
will also prevent the possibility of selling off part of these lots for another
building site.
Mrs. Wahlberg asked if there are any other houses in this area that are tilted
on the lot. Mr. Taylor said he did not know of any.
Mr. Crowder asked if the garage had an existing hard surface driveway. Mr.
Taylor said the garage is a block garage and has just a gravel driveway. Mr.
Crowder asked if there was a house on this lot at one time. Mr. Taylor said the
garage was built some years back and was part of the adjacent property to the
south. He said when they sold the land, the garage went with it. Mr. Crowder
asked if there were plans to enlarge the garage and Mr, Taylor answered it would
be used just as it is now. •
Mr. Crowder asked how the house would be located if the variance was denied.
Mr. Taylor said he really di..un't know.
Mr. Mattson stated another thing is that Broad Stree�t takes a jog at this
location, so if the house would�be turned to the narth properly (parallel to
Fairmont St.) it would look down Brcad Street.

Chairman Drigans asked what is on the lots to the east; Lots 30, 31, 32 and 33.
^ Mr. Taylor said these lots are part of a hill that is about 15 feet above the
road level. He said he believed the lots are buildable but there would, in his
opinion, be problems building a house on them.
Mr. Mattson mentioned the variation in the setbacks would n4t be as apparent here
as where the land is flat.
Chairman Drigans said another fact to consider is traffic visibility. He said on
a corner lot this is a big consideration.
Mr. Crawder said he didn't think he would like to see the house not tilted and have
a 22.7 foot setback. He said the visibility is better as the house is proposed than
if it met Code.
Chair•man Drigans said the hardship seems to be keeping the house in line with the .
garage.and the adjacent dwelling and saving the existing trees. •
MOTION by Wahlberg, seconded by Gabel, to close the public hearing. Upon a voice
vote, there being no nays, the motion carried.
Chairman Drigans informed�the Board that tliis item was before the Council on
June 10, 1974 and the Council will concur with whatever the Board decides.
Mrs. Wahlberg said she doesn't find any strong objections to the variance other
�� than the fact that the request for the 22.7 foot setback should be predicated on
the fact�that the house be tilted as proposed on the survey dated May 30, 1974.
She said she did iiot want the house to be changed to be parallel to Fairmont
Street and she felt �hat if it was changed, that it would need another variance
and come back for review. �
MOTION by Wahlberg, seconded by Gabel, to approve the variance request with the
stipulation that the house be located as proposed on the survey dated May 30, 1974
and if the location is changed to be parallel to Fairmont, that the request come
back to the Board .f�r review. Upon a voice vote, there being no nays, the motion

Chairman Drigans statea this request was before the Council on June 10, 1974 and
the Council tentatively approved three of the variances but did have strong
^ reservations about the variance to reduee the side yard setback abutting a side
street of a corner lot from 35 feet to 25 fect. He'said the alternative for. this
variance would be to reduce the building size by 10 feet to meet the setback.

� A discussion on the variances brought out that the rear yard variance and t�e ���
zero side yard would allow this bua:ld�ng to line up with_ths bui.lding to the
� north which also had these variances granted on it. The parking variance has
' also been granted on the building to the north and on other buildings in the
area. �
Mr. Crowder stated the reason for the zero side yard was to have more green
area on the ends of the buildings and to reduce the side yard variance from
35 feet to 25 feet would defeat the reasoning for zero side yards.
Mrs. Wahlberg stated she felt the Board should concur with the Council and
deny the side yard variance.
MOTION by Crowder, seconded by Wahlberg, to close the public hearing. Upon a
voice vote, there being no nays, the motion carried.
MOTION by Crowder, seconded by Plemel, to approve the variances to reduce the
rear yard setback from 25 feet to 24.5 feet, and to reduce the side�yard
setback from 15 feet to zero feet on the north side of the building and to
reduce the setback between off street parking and the building from 5 feet
to zero feet with bumpers installed on the building, and to deny the variance
to reduce the side yard setback variance abutting a side street of a corner
lot from 35 feet to 25 feet for the following reasons; 1. The building to the
west; acro5s Elm 5treet, meets the 35 foot setback. 2. The property to the
east, across the alley, if developed as industrial, will probably have to
