PU�LIC HEARING: REZONING REQUEST, ZOA #74-03, CITY OF FRIDLEY: Rezone Chases.Island located on Government Lot 5, from CRP-2 (flood plain) to CRP-1 (floodway). . MOTION b� Blair, seconded by.,Lindblad, that the PZanning Cammission waive the reading of the Public Hearing notice on the request for rezoning by the City of Fridley, ZOA #74-03: Upon a voice vote, a11 voting aye, the motion carried unanimously. - Mr. Clark said this zoning change was recommended by the Depart- ment of Natural Resources. It is actually a condition of their approval of our flood plain ordinance. He said that as this is all City owned property an.d this change wouldn't affect what would be built on this property, the City administration recommends approval of this request. Mr. Lindblad asked if this zoning change would prevent any building on this property? Mr:( Clark said it would permit structures that have a low flood damaae potential. Mr. Harris said this will be changing the progerty from the 100 year flood level to the 50 year flood level. Mr. Clark said that what the Department of Natural Resources is saying is that they want tYiis property to be in a more restrictive district. Mr. Lindblad asked what was the purpose of this zoning change? Mr. Clark said he thought the Department of Natural Resources was right in requesting this change. In a CRP-2 district, houses and garages can be be built with a special use permit being granted. He said that he didn't think they knew when they requested this cYiange that this was City owned land and that there is no intention to build anything on this island except shelters. Mr. Clark then read the uses allowed in a CRP-1 district. (1) Any use having a low flood damage potential including recreational use, parking lots, residential yar.ds, loading areas, storage yards, water control structures and other open space use. (2) Structures accessory to the above uses may be permitted if: a) Structures are not for human habitation. b) Structures have a low flood damage potential. c) S�ruct�res are firmly anchored to prevent floatation. d) Accessory buildings are not more than 150 sc�t�are feet. (3) Al1 structures are permitted in this section with the exception of public uses require a Special Use Permit. (4) Any removal of existing trees over 3 inches in diameter sha1Z require City approval. (c) Public Facilities Public utility facilities, railroad tracks and bridges within the preservation District shall be designed to minimize increases in flaod elevation and must be reviewed by all governmental bodies having jurisdiction, but in all cases the City of Fridley will make the final determination. Mr. Clark said this doesn't affect the use of the property as far�:as the City is concerned. Mr. Bert Slater, 128 River Edge Way N.E., said the reason he was at the meeting was because he would like to know what was being prop�sed � Planning Commission Meeting - Juiy 17, 1974 • Page 3 ^ for Chases Island. Mr. Clark said the purpose of this meeting was to change the zoning of this island from flood plain to f lood way. About a year ago, the State of Minnesota passed legislation to force municipalities to have flood plain zones. In order to do this, the City had to set up these zones and Fridley decided to call these CRP-1 and CRP-2. The City sent their Ordinance and map of these districts to the Department of Natural Resourc�s. They, in turn, sent it to the Army Corp. of Engineers and they studied it and recommended that we change the zoning of Chase Island. This is not a proposal to build any particular structure on this island. Mr. Slater asked if the Planning Commission was aware of what was being proposed for the Islands of Peace. Mr. Clark said he wasn't directly involved with this project but he had heard they were intending to have a shelter just so people could get out of the weather, and some more pathways. He thought they were working on a dock. Mr. Clark said there is an Island of Peace Foundation which Jerrold Boardman of the City staff was working with, and he told Mr. Slater he could call him if he had any questions on this project. Mr. Slater asked if the Planning Commission was aware of the bicycle route proposal and the questionnaires on this proposal. Mr. Clark said that about 1,000 residences were getting these questionnaires on a random basis. He said he thought it would be some time in August before the information had been gathered fram these questionnaires. He said that one of the members of the Planning Commission would be /� asked to sit on the Committee for this bicycle route so they could bring information back to the Planning Commission at that time. Mrs. Irene Maertens, 144 River Edge Way N.E., said that alI sY:e knew about the development of the Islands of Peace is what she had learned at the State Fair. She wonde-red if this rezoning would affec� her property because it was so close to Chase Island. Mr. Clark said this request was just rezoning Chases Ialand. � Mr. Slater asked if in time, there would be walkways on the North end of Chase Island. He said there was a walkway to the school on his property. At the time this was put in, it was said that this would never be a bicycle path, but it is. He said this was put in for the safety of children and he would question how safe this walkway was at this time. His concern was that the traffic on this walkway would be increased due to future development of Chase Island. Mr. Clark said there was just a narrow strip for the City to get their vehicles to Chase Island for maintenance, but there would be no public vehicl� access to the Island. Mr. Harris said there was no way they could get from the North end of Chases Island to public right of way. Mr. Clark said the North end of Chases Island was a lot lower than the South end. Mrs. Maertens asked if they could add f�ll and make it higher. Mr. Harris said that before that could be ^ done, permission would have to be gotten from the Department of Natur.al Resouces, and he didri't think they would permit that. Mre. Maertens said it has also been mentioned that this zoning wouldn't allow trees to be cut down. Mr. Harris said he would like the Islands of Peace Foundation to either present their plans to the Parks & Recreation Commission or the Planning Commission so the members would have some idea of what was planned for this area. Mr. Blair said they had been'.to the Parks and Recreation Commission about a year ago but he believed they went directly to Council at the present time. PUBLIC HEARING: F�EQUEST FOR A SPECIAL USE PERMIT, SP #74-12, BY GORCO CONSTRUCTION COMPANY: Per Fridley City Code, Section 205.157, 5, D, to allow tl�e construction of a garage in CRP-2 � zoning (flood plain) on Lots 21 and 22, Block T, Riverview Heights, the same being 675 Fairmont Street N.E. MOTION by Lindblad, seconded by B1air, that the Flanning Comrr►ission waive the reading of the Public Hearinq notice on the request for a Special Use Permit, SP #74-12, by Gorco Construction Company. Upon a voice vote, a11 voting aye, the motion carried unanimously. Mr. Clark said the Gorco Construetion Company was building a detached garage for Robert Wo•lmutt at 675 Fairmont Street N.E. He said that this garage was under construction before the inspeetion department knew it was being built. We �ed tagged the construction and told them they had to go through this process before they could get a building permit. The garage actually meets all the building codes. This will be lacated on the edge of the CRP-2 zone. The administration has no objection to this garage being built. As long as it is not for human habitation, the restrictions on this construction are not that great. We have sent the required notice to the Department of Natur�l Resources and they haven't responded, so it could be assumed that they have no objection. Mr. Harris asked if they have met the other requests that were in the letter in the agenda. Mr. Clark said there was no letter from N.S.P. ^ Mr. Ed Girard, 680 Glencoe Street N.E., said he had two questio�ns. Who was supposed to get the building permit, the builder o� the home owner, and if the City didn't have to take some responsibility for this garage being started without a building permit or the required special use permit. Mr. Clark said that as soon as they found out a garage was under construction, the City stopped the construction until n � Planning Commission Meeting - July 17, i974 • Page 5 a special use permit and a building permit could be obtained. As far as who gets the building permit, this is an agreement between the builder and the home owner. Sometimes, the awner agrees to get the permit, and doesn't get around to it, and all of a sudden the masonry man is there to put in the slab. We can double fee anyone who starts construction without a building permit. It is sometimes difficult to determine if this was something deliberate or not. Mrs. Girard said she didn't think this garage was located 3 feet from the side property line. Nit. Clark said we have a new survey of this property after the slab was in for the garage and this survey shows the garage is three feet from the Iine. He said that 3. feet was not very much. Mr. Girard asked why the petitLOner needed a special use permit if this garage meets all the codes? Mr. Clark said it was because it was in the flood plain (CRP-2). Mr. Girard said t�eir house and garage was just built a year ago and they were closer to the river than this garage was and they didn`t have to get a special use permit. Mr. Clark said they would if that house was being built now, but that this o�dinance wasn't in effect a year ago. Upon a voice vote, a11 voting aye, the motion carried unanimously 3: B�LLBOARDS DISCUSSION: BILL WEISS SIGN Mr. Clark said the reason this was put on the agenda was because a couple of ineetings ago you requested a joint meeting with the City Council and stated you would like to talk about the Hyde Park Study, the armory and billboards. The armary is still pending, Bill Nee is looking into the Hyde Park issue and will report back to the Council, and they will decide if they want the Planning Commission involved in this or not. The City Manager asked Peter Herlofsky ta find out what the Planning Commission wanted to discuss as far as bzllboards are concerned. , Mr. Clark said the reason Bill Weiss's name is included in this � part of the agenda was because he wanted to tell the Planning Commissior. '' that this sign blew down., He said he told Mr. Weiss that in order to put this sign up again, he would have ta have the property�rezoned, apply for three variances, and obtain a Special Use Permit. Mr. Clark said he told Mr. Weiss he didn't think he cauld jump all those hurtles to get his sign put up again. He said he asked him to wait and see ��. Then if it was creating a problem, he could consider this again. Mr. Lindblad asked if the State would have to approve this sign. Mr. Clark said it was not in highway right-of-way. Mr. Harris said they would lik'e to discuss the policy the City ' Council would like to have the Planning Commission follow in considering Special Use Permits for billboards. Mr. Lindblad said we should know if the City Council is going to support us or not. He said there was no use in the Planning Commission hassling over these billboards if Council is going to approve all the requests. Mr. Clark said you could find out what they think is the most important criteria to use; the intersection, the zoning, or the R-1. The Planning Commission should know if they are in favor of extending the time for these billboards or if they are in favor of eliminating them. Mr. Lindblad said he thought the Planning Commission should have some input from Council before we have to handZe these requests. Mr. Haxris said we should find out if Council is concerned about billboards at all. /'� Mr. Clark asked if the Planning Commission had a preference on when this joint meeting should be held. Mr. Harris said he_thought an off Wednesday would be a good night for the Planning Commissian. Mr. Clark said he would find out the Council'.s feelings, and the Planning Commission members could be called. 4. BICYCLE PATHS COMMITTEE Mr. Clark asked Mr. Blair if he would serve as an ex-officio member of the Bicycle Path Committee. Mr. Blair said he would. Mr. Clark saic� if there were any minutes of these meetings, he should make sure the Planning Commission sees them. They wouldn't have to receive them at their meeting. but they would know what was going on. Mr. Smith said he had been Uefore this Board last winter (December 6, 1973) and this Board approved his building plans, different from those pre- sented tonight, but the City would not grant him a permit. The Board asked why and Mr. Smith said he did not I:now. Mr. Boardman presented copies of the December meeting. They stated that before a building permit could be given, various agreements between Ron Smith and the affected property owners must Ue presented to the Ci.ty in regards to joint parking and also Ron Smith was to bring in agreemeiit plans for improvement of his properties in this area. Mr. Boardman said Mr. Smith was aware of these agreements, but had not brought them in. b4r. Tonco asked Mr. Smith if this building was the plan he �vanted since his previous building was a.lready approved. Mr. Smith and Mr. Boardman said this was a better plan, as the old plan had one main entrance wi.th a side yard loading doar and the back yard was undeveloped. Mr. Boardman said the same agreements (except parking and vacation of Gumwood Street which has been completed) woul.d be required for this building p2an also. He said that since Gumwood Street was vacated, one-half of the right-of-way went to Ron 5mith and this will. b e used to handle the truck traffic to the rear of the b uilding. Mr. Lindblad pointed out that a 25 foot driveway with 10 foot radius would be required and tltat poured concrete curb will be used around all parking areas. Building setbacks ��rere according to code. Mr. Smith said the Uuilding laill be painted split face concrete block with a brick on the front. Mr. Boardman said he would prefer to see a break-off biock in front as opp�sed ta the split face. 'I7iis gives a larger ^ webbing design for more contrast. MOTION by Tonco, seconded by Simoneau to recommend to Council approval of the plans (dated June 6, 1974) for the building with the following stipula- tions: l, llriveway be 25 feet wide. 2. 10 foot radius at entrance. 3. Concrete Curb (6" x 18") around blacktop area. 4. Use landscaping plan as shown on 6-10-74 plans. 5. All storage of material and equipment must be inside. 6. D'rainage plan be worked out with the Engineering Department. ^ 7. Any outside storage of waste material must be screened, properly. 8. Any outside roof equipment must be properly screened. 9. Loading area on the north side of the existing building will not be used any longer, and all loading and unloading will b e inside of the new b uilding. 10. Provide easements for the westerly 10 feet of Lots 16 and 17, Block 7, Onaway addition. The Board strangly recommends that the City Council not issue a building permit for 7740-80 Beech Street until the City receives a signed written agreement stating that an agreement was reached for providing joint parking between Assurance Mfg. and S�erco Tool, the City Attorney to act'as mediator. Mr. Boardman presented a sketch for the front which he felt would create a more balanced looking front. He changed the windows fron Z on each side of the door to 2 on the north side and none on the south side. tiowever a glass pane2 would be next to the door for enterior lighting and balance. Mr. Erickson and Mr. DeVriendt liked the ehange but said mortgage money is set up already and if this new plan would cost more they would not be able to do it. The glass panel next to the door, Mr. Erickson noted, would be quite expensive not only for the cost of the glass but by new building codes it would have to safety glass and wired for vandalism reasons. The Board stipulated that they would leave the decision of which design they would use after investigating the cost for the new design, but this should be decided before going to Council. All parties agreed to this. The Board asked if they would be painting the front. They felt a natural biock would look better, especialiy on the new design. Pir. DeVriendt said if they use Mr. Erickson's plan it definitely would be painted. The Board left this as an option, again dependin� on what design would be used. Mr. Lindblad said the shrubbery plan as presented was okay. ^ Mr. Tonco asked about drainage. Mr. Erickson said he did not think there would be a prablem. The Board suggested they work with the Engineering Depart- ment if there is a problem. It was pointed out that aIl outside dumpsters must be screened; alI roof equipment, if any, be screened; enough parking stalls provided; and poured concrete curbing (6" x 18") must be used around the parking lot (except on the east side as future expansion will be on this side and precast curbing can be used here) . The Board noted there was no security lights. They suggested lights on the corners to flood the east, south and west sides and possible decorative lights over the doors and windows. Mr. Brangstrom said they will be constructing 2 complexes, 2 stories with 18 units each. The exterior will be constructed of brick and cedar. The cedar will be used around the windows and for the balconys. At present they clo not plan any garages. The Board asked what would be located in the storage building in the parking lot. Mr. Bran�strom said lawn equipment, dumpsters, etc. They plan on having a central garbage pickup inside the building and then transfer it to this area for pickup by a garbage service. Mr. Tonco asked what type of shin�s would be used. Mr. Brangstrom said ^ perhaps a slate-type, depending on the dollars available. Mr. Weber explained they do not know how many investors will be going in on this building so they da not have final plans or dollars available at the present time. Mr. Tonco asked about the construction of the party walls and was partic- ularly interested in the wall where the joint plumbing would be located. He felt noise wou�d be carried back and forth between apartments. Dir. Brangstrom said this canstruction was not fina2ed yet. Mr. Boardman said this Board had no jurisdiction over the inner construction, but that City staff would make sure it met code. Mr. Lindblad asked if there would be parking facilities for recreations equipment. Mr. Weber said no, as this created an area of added e�ense and vandalism. � Mr. Lindblad asked Mr. Boardman about the changes in red in regards to the parking lot. P•1r. Boardman said they had 9' x 20' parking stalls and in order to get the 36 stalls per complex needed at 10' x 20' he relocated the one entxance and parking stalls as needed. BIBLE CLUB� Mr. Zane Kaiser was present to ask the Catrnnission's permission to conduct Bible Study classes for yauth, at one of Fridley's Parks. They're planning to hold the classes frc�n 3:30 to 5 each day with 2 or 3 people in charge. ^ Mr. Kaiser reports that their a�tendance i.s increasing quite rapidly in St. Paul. With this response in rnind, they are expanding their program and hope to include Fridley. Mr. Brown felt that the City would be receptive to the pragram on a one year, rotating basis. The Mv�i.an ca�vu.ed. GUITAR LESSONS, Mr. Jon Parker was in attendance at the mceting to propose scgne Gtiitar Lessons for the resid�nts of Fridley. He apened the discussion with scgne of his personal backround. He stated that ha was a college graduate and has taught within Fridley's Ele�nentary School systc�n. ^ Mr. Parker explain�l that his personal experience indicates that it's not hard to find guii_ar players, but it is hard to find gu.itar teachers and especially those who also have an education backround. The pres�nt status of his organization includes lessons in Shoreview, I-�rden Hills, Blocenington, Fdina, Ros�nount, West St. Paul, South St. Paul, Burnsville, and Osseo. His instructors teach the basic fund�nentals of guitar, and knaa haw to adapt it to the classrcxxn. Page 2 �� (�`�TAR LESSONS CCON`T): Mr. Parker stated that their group lesson program is for 10 weeks, and they feel that after a year, the student should be eligible for private lessons. The minimum age is 4th grade, and his oldest student is about 75. They limit the classes to 10 people. It is their experience that after the 10 weeks, about 7 of the students are interested in furthering their abilities. Within the first 10 weeks, tYie students learn the basic cords and fundamentals. The second 10 week session teaches them the finer points of the guitar and how to smoc.>th out the basic cords and make them a little nicer. The third 10 week session teaches the students s�ne music theory and how to read notes. So after a on� year proqram, they have a very sowzd backraund on the guitar. At that time, they should have determined �ahether or not this is the type of thing they would lik� to continue with. Fram this point, they are �eady for private lessons. Many of the instructors are available for private lessons. Private lessons enable the student to specialize in classical, jazz, rack-�n-roll., finger-pickin', or the various other styles of guitar. I t is surprising, though, that the trend is not taward rock-n-roll. Mr. Parker stated that most of his time now is spent with the hiring and training of teachers. A lot of the teachers ccgne fr�n a teaching backround or musical b�.cicround already. Mrs. Caldwell asked for the manner of payment� Mr. Parker stated that the Recreatian ^ Departmer�t would collect the fees and he would su}xni.t a i.nvoice to the Department at the end of the session. T� �k�rge would be $1.50 for 1 wee}c� In c�nparison to the amount charged by music studios or private inclividuals, this is very nominal. Ten lessons wauld cost an individuaZ $15.00. Mrs. Caldwell asked how many students would be in each class? Mr. Parker stated. that they try to Ywld the classes at 10, but if n�re cam�, they either allaw one or two additional students into the class, or if more t�Yian th.at are interested, they will divide the class so t11at individual attention is still given. Jim 5naw, President, apened the presentation by explaining that he had invited Maynard Nielsen and Keith Cturmens to be present with him in the eveni: that a project suggestion would involve more than his one year in offic�. Mr. Snaa stated that they were partial to Moore Lake Beach and Park, but that they had -t�c�n care of the picnic area and lighting the flag pole, so were ncra open to suggestions. Mr. Dahlberg stated that since they were partial to Nioare Lake Beach, perhaps they wauld be in�erested in l�comi..ng involved in an aeration system for the lake. This type of system ha.s been used in ott�er municipalities, and appears to be doing a great deal of good. Mr. Brawn stated that there was a need for so� domed picnic shelters in some of the parks, as we11 as a"crow's nest" for the contr_ol panel at the Commons Football field. He stated that there had been same talk. about building a storage building for the football, hockey, and baseball eauipment. It was thought that perhaps the two could be done at the same tiune, locating the "craw's nest" on top of the storage building. The idea h.as been tabled due"to thE excessive costs involved. Mr. Braan also reco�nnended the West Moore Lake Park area as a good area to consider for a project. The area xesidents would prefer to have th.e area remain in its natural state, but Mr. Bro�an feels that it could be cleaned up and perhaps � some park benches added, without disturbing plant life and wild life. Mr. Brown suggested that perhaps a new sign system, similar to the one located at Moore Lake, which was designed and_constructc-�d by a couple of boy scouts, could be _ adopted for t,he entire Fridley Park syst�n. Another suggestion might be the poz-table band shell which had been requested by the Fridley City Band. , Mrs. Caldwell asked if the Lions were interested in funding a Youth Center for the youth of the co�nunity? Mr. Sno�a stated that they were, but thought that this would be taken care of with the construction of a�.M.C.A. in Fridley. The Lions Club has set $10,000.00 aside for the Y.M.C.A., but he has heard that their land is xiow for sale and the chances are that they will not be locating in Fridley. I n f.Y�t event, the money will b� used for some other civic function. Mr. Snow went on to say that they try not to have any money remaining at the end of the year, because they are t�ed on this amount. They do give money to groups involved with seeing and hearing problems, as well many other civic organizations. Mr. Snow said that he would take these suggestions back to the Lions Club and that they would decide on a project. He'll be reporting back to the Ccx�nission as soon as the decision is made. RUTH CIRCLE PARK� Mr. Steve N�ser was present at the meeting to ask t.he Ca�ni:ssioners if they had n made any plans for the lots which were purchased adjacent to Ruth Circle Park and hi.s prop�rty? He stated that at the time he purchased his hcxne, the adjacent lots were zoned as msidential and he thought hcanes would be bu�lt on thexn. Now, he finds he lives next door to city park, and he is wondering just what type of facilities are planned for this imnediate area. This is all to be built on the North end of Ruth Circle Park.' Mr. Moser asked if there was a time table which might tell him when this would be inStalled? Mr. Blair said that to his knowledge, no time table had been set. Mr. Brc�m agreed . Mr. Moser stated that he'd rather not see the area developed, and asked if he could be kept infornned of the status of development. Mr. Blair said that this could be done, but Mr. Brown reccmnnended that he keep in contact with the Department, since it becomes very difficult to keep track of each individual and their particular situations. Mr. Brawn went on to suggest that Mr. Moser call the City Hall in th� Sprinq to inquire about possible development for the comi.ng SuiYUner, and also to see just what is bc�ing incorp�rated into the coming yeax''s budget. Both Mr. Blair and Mr. Wagar agreed that they doubt if there will be any develogrnent on the new property for at least five years, but could not make that a firm carun.ittinent. Mrs. Caldwell stated that she was opposed to the stickers since the people are parking on the streets and the parking lot stands vacant. She said that the people park on the side stxeets as well as on Centxal Avenue, and then cut through the yards to get down to the Beach. After s�le general discussion on.the passil�ilities of a better solution tA the situation, Mr. Blais reccxranended that the stickers be eliminated. Mr. Dahlberg said that in a case where more than one party is in•,rolved., perhaps each party could pay for half of cost for '-�he portion of the fence he would utilize. If twc� residents and the City were;i.nvolved with the same fence, a percentage would have to be wc�rked out. Mr. Blair said that the Ccxr�ii.ssion should check into the law to see just what would be permissible. NAMING OF HAMILTON�S ADDITION TO MECHANICSVILLE� As a result of a contest held on the Playgrounds, the Ccgrmtissioners were given a list of the suggested names f.or the property located within Hamilton's Ac3dition to Mechanicsville. After careful consideration, Mrs. Caldwell said that she felt °Jubilee Park" was appropriate for the Silver Anniversary of Fridley. Mr. Wagar agreed, and said that he also liked. the name "Hartman Park."
