Mr. Harris said he had some questions on the sign varianc�
on the P�lenard Lumber sign. Mr. Clark said the recommendation of
the Board of Appeals was in these minutes and this was changed
somewhat at the City Council meeting. Mr. Harris was shown a
lett�r that was writt�n by Mr. Clark to the company constructing
the sign and to Menard's which explained the stipulations on the
sign.
MOTION by Harris, seconded by LindbZad, that the P.Zanning
Cornmission receive the minutes of the Board of Appeals Subcommittee
meeting of August 27, Z974. Upon a voice vote, aZl voting aye, the

RECEIVE PARKS & RECREATION COMMISSION SUBCOMMITTEE MINUTES: AUGUST
26, 1974 .
Mr. Fitzpatrick said that included with these minutes is a
lease agreement with the Target Store for some park area. Mr. Harris
questioned Mr. Clark as to what type of park equipment woulc3 be going
i.nto this area. He said it looked like this lease ran frorn year to
year and could be terminated on short notice. Mr. Clark said he was
nat too familiar with this proposal, but he would check with the Park
� Director, I�aul Brown, and get some answers before the next meetinc�.
Mr. Fitzpatrick said he knew the City had been anxious to provide some
parkland for this area of the City.

Commission waive the reading of the Pub.Iic Hearing notice on the
request for a preliminary p1at, P.S. #74-05, by Edwin Dropps. Upon
a voice vote, all voting aye, the motiQn carried unani:mousl�.
Mr. Clark said that when the Planning Commission reviewea the
preliminary plat for Rice Creek Estates, this portion known as�Rice
Creek Estates Second Addition, was all one plat. He said he believed
Mr. Dropps had some probl�ms closing on the portion that was Chi�s
property, so he decided to just develop Phase I of the plat at that
time, and would come back with the second Phase at a later date, and
that is what he is presenting tonight. '
� Mr. Clark continued, that there are just a couple of differences
on this plat from the first time it was presented. On the first plat,
the cul-de-sac on 61st extended further to the West, and the lots
that sould have been served by this are no,w served by a cul-de-sac
' at the end of Rice Creek Drive. The balance of the plat looks pretty
much the same.
Mr. Dropps said that at the Plats & Subdivisions-Streets & Utilities
Subcommittee meeting they requested a detailed topog of the grades on
the lots that are served by the cul-de-sac at the end of Rice Creek
Driv�, and with that cul-de-sac also. They were concerned that we
could build houses on these lots because of the elevations and grade
changes. Mr. Clark said the grade on the cul-de-sac is still a little
high and we wauld want to stipulate that the maximum slope would have
to be three to one. This would mean that there would be 13 vertical
feet where there would have to be some time of retaining wall.
Mr. Harris asked if the top soil could be held on a three to one
pitch. Mr. Clark said there was another house in this area with the
same soil conditions that has held at that slope. This house is about
five years oZd, and there haven't been any problems.
Mr. Fitzpatrick said that just North of Lot 1, Block 4, there is
an apparent continuatiGn of a street. Dir. Clark said this street will
continue onto what will become Heath�r Hills 3rd Addition. Mr. Clark
� said that rlike O`Bannon has seen this plat before, and has approved
that location of the street for access to his property.

/1 Mr. 0`Bannon, who was in the audience, said he was not satisfied
with the location of this road. It seems to have been moved North.
He said he would lose a 1ot from his plat with the road in this
location. It would leave him with a 1ot of about:18,000_square feet,
which would have to be one lot, because he could not get the minimum
width of 75 feet for the two lots even though they would meet the
square footage requirements for two lots.

Mr. Dropps said this road was supposed to fit into an all-mver
plan for this area. Mr. Harris said that was his understanding of
the placement of this road also.
Mr. O'Bannon said that if this road could be swung South a little
bit,�he could get his two lots. He showed the Commission a copy of
his proposed Heather Hi11s Third Addition so they could see the problem
he would have if this road stayed as its present Zocation. Mr. Harr_is.
said the road and Mr. O'Bannon's plat were off abaut 20 feet. Mr.
O'Bannon said he would end up with a lot 130` x 14Q` which would be
too narrow to make into two lots. .
Mr. Clark said that if Mr. Dropps would bend the street seven feet
towar.ds the back of Lot l, Block 4, and Mr. O'Bannon would bend the
street about seven feet on his plat, this would give then both their
lots, that would still meet the front footage requireme�ts. Both
parties agreed. Mr. Harris said that could be made one of the stipu-
lations af the approval of this plat.
Chairman Fitzpatrick said that most of the people in the audience
for this plat seemed to be the people from Ferndale who were concerned
about 61st Avenue. Those people were shown a copy of the plat, and
were satisfied that 61st Avenue was not going to be extended.
Mr. Harris asked Mr. Dropps if there had been any negotiations
between the Theilmanns and himself since the last meeting? Mr. Dropps
said he hadn't talked ta the Theilmanns at all since the Iast meeting.
He said his thoughts were that he get all the other problems worked out
on this plat first. At the last meeting there was discussion by himseZf
about coming to an agreement on the Square footage valuation of ttie
property and that he would work with the Theilmann's on that basis.
He thought that what the City had used for a square footage valuaiion
an the property they purchased for the additional park land would be
a good figure to start negotiations with. He said they left a 15 foot
strip the Theilmann's need to plat their property, and he needs the
corner of Briardale Road, and once the square footage valuation had
been worked out,`he didn`t think this should be too difficult to nego-
tiate.
Mr. Harris asked what kind of retaining caalls they would be using
to maintain this three to one slope. Mr. Dropps said he couldn't say
because tYie topography map with the elevations was de�:ivered to the
City Hall and this was the first time he had seen it. Mr. Clark said
there werel3 vertical feet to make up, and this could be worked out
with a combination of terraces and retaining walls. Mr. Dropps said
the engineer had pLCked the worst spot� on the plat to work on. Mr. Clarl
said this was correct. Mr. Dropps said the maximum would be 13 feet

^ and this would taper down to 6 feet. Mr. Dropps said that what ever
was necessary to do on these lots, he would do, as far as the retaining
�a1Zs w�re concerned. He thought the problem was mostly on Lots 3 and
4, Block 4, and he thought that both aesthetically and for safety it
would probably be better to have some terracing on these lots instead
of all retai_ning walls.
Mr. Clark said there are some trees on this plat, on both the
West and South boundary, that will have to come out to dev�lop this
plat. There won't be any trees left. He said he thought the members
of the Commission and the people in the audience should be aware of
this.
•Mr. Harris asked Mr. Dropps if he was still planning on having
underqround utilities with this $2 a month charge for life. Mr.
Dropps said he did, and he thought he had received a letter from the
power company saying they were no longer making this charge. It would
be a one time charge to the developer, but he would check on this again.
MOTION by Lindblad, seconded by Harris, that the Planning'Commission

Mr. Harris asked about the utilities down that street that goes
to Iieather Hills. Mr. Clark said this had been checked by our Engineer-
^ ing Department and Comstock & Davis, and these grades will work. The
sewer and water wi11 be stubbed in at the end of this street. All the
streets in this plat will drain toward Benjamin and that`s the same
direction the sewer will flow. Mr. Harris asked who was going to do
� the construction on the utilities. Mr. Dropps said the City will put
them in.
MOTION by Harris, seconded by LindbZad, that the Planning Commissior
recammend to Council approval of the preliminary plat, P.S. #74-05,
Rice Creek Estates 5econd Addition, by Edwin C. Dropps, d/b/a Pinetree
Builders, a replat af Lot 10, except the North 260 feet thereof; Audi-
tar's Subdivisian No. 22, general.Zy located North of 61st Avenue N.E.
and West of. Benjamin Street, with the following stipulations:
I. Petitioner should endeavor to negotiate for street right-of-way
from the Theilmann's for the extension of Briardale Road.
2. Subject to negotietion with thc City for additional park Zand.
3. Pr.ovidc underground utilities. .
4. One tree planted per lot, 2" minimum diameter.
5. Grades to be worked out with the City Engineering Departrr�ent.
6. Lots that have qrade difficulties with a thre� to one slope

if he so desired. Mr. Fitzpatrick said there was a question in
^ his mind whether this would be automatic or if he may have to
seek some type of approval. Mr. Clark said he would have to check
on this further, but he could prabably have a cabinet shop in'his
garage under the present zoning, but not under R-1 zoning. Mr.
Benson said the reason he bought this property was because of the
M-1 zoning and that was why he was opposed to any zoning change.
Mr. Clark said that if the rest of the Block was zoned R-1,
it could have an effect on the resale value of yaur house, and
also if your house was damaged by fire or wind or by other means,
more than 500, you would not be allowed to rebuild, when this property
was zoned M-1. There are pros and cons to this zoning also.
,Chairman Fitzpatrick said he wasn`t sure this was in the present
zoning code, but the Planning Commissian was presently going through
the Code, clarifying some things that needed clarification, and
putting in the Code some things that were City policy at the present
� i:ime .
Mr. Benson asked that if all the property on this block was
developed as R-1, wou�- d there have to be some type of barrier because
of the railroad t a,,,�s. He said he �aorried about his children and

some type of stipulation on the rezoning request, i f t hey so de s i r e d,
^ but they shouldn't expect the railroad to do this because they were--
there first.l Mr. Muhich said that it seemed"that in practice, the
industrial screens from the homeowner, not the homeowner screening
from industrial, unless they choose to do so. You couldn't expect
� the owners of the property next to the railroad tracks to provide
a barrier that would benefit the rest of the homeowners in this
area, uMless they want to c�o it. Mr. Fitzpatrick said the Planning
Commission ean put any stipulation we feel would be needed in
. considereing this rezoning. -
Mr."Harris said that if there was some noise abatement on this
� property, it would enhance the value of the property.
Mr. Harris asked Mr. Clark•hQw long this property had been zoned
M-1. Mr. Clark said the original zoning map, 1956. Mr. Harris asked
it there were residential homes on some of this property then. Mr.
Clark said that there was. They allowed R-1 to be built in any zoninq
until 1969. 5ince that time, it has not been City policy to allow
single family homes to be built on commerical or industrial zoned
property.

Mr. Benson said Mr. Muhich should just rezone his own property,
and leave the rest of the block alone. Mr. Muhieh said the other
property owners who have R-1 dwellings on this block, with the exc�ption
of Mr. Benson, wanted the property rezoned also, because they didn t
want any industrial next door to them.

Mr. Harris said he would just as soon keep the Public Hearing
� open and continue this request until Mr. Muhich decides what he
wants to do, get �.�p a petition or just ask for rezoning of his own
property.

Mr. Polaski came forward to present his request. The plot plan was shown to the
Board. Mr, Mattson explained to the Board that the plat of Ouimette Terrace, with
its slightly undersized lots was more or less sanctioned by the City because they
would have had wasted space otherwise. Mrs. Gabel asked to see the'house plans.
r,,, Mr. Polaski showed the Board the plans for a Capp home style "The Clairmont", a
two story 26 fnot square house with attached double car garage. Mrs. Wahlberg
asked if the plans had been cut down in size. Mr. Polaski said they had not.
Mrs. Wahlbcrg asked if he had thought of enlarging the house. Mr. Polaski said
, he had asked the Capp Home people about that and they told him it wouia cost a
thousand dollars to add a couple of feet.
Mr. Mattson explained that it would take an extra 4 feet of length to the house
to bring it above the required minimum code requirement of 768 square feet for the
first floor of a two story house, Mr. Drigans asked what the commercial. value of
the house would be. Mr. Polaski said 35 to 4U thousand and that they would be
paying abaut 24 thousand unfinished. Mr. Polaski said they had an opta.on Qn a
15 year mortgage from Capp Homes. Mr. Drigans asked what the maxim�m lot coverage
is in an R-1 District. Mr. Mattson said 25o and that even with the r�duced lot
size in this case, lot coverage is not a problem, nor would it be exceedec�.were
the house up to code size.
Mr. Drigans said that with the reduced l�t size he thought the house size could
be reduced also.
Mrs. Wahlberg asked about a smaller garage ta offset the cost of a larger house.
Mr. Drigans said that he thought adding on one end and taking off the other end
of this house would adversely alter the appearance and balance of the design.
MOTION by Wahlberg, s.�conded by Gabel, to close the public hearing. Upon a voice
vote, there being no nays, the motion carried.
^ Mr. Driqans said that he would be inclined to go along with this Plan,
Mrs. Wahlberg said that she felt the 768 square feet required in the Code is
small alr�ady and that it does not seem unreasonable to ask for compliance, in
�.his case par�icularly since there was no prablem with the lot size. Mrs. Wahlberg

also said that the setting of a precedent in an area with several undeveloped lots
was asking for more requests to build undersized houses.
Mr. Drigans wished to have a drawing of the "Clairmont" model entered as ExYiibit "A".

of the variances with the stipulation that the "Clairmont" plan as presented by
Mr. Polaski and specified as Exhibit "A° by in fact the one to be built without

Mr. Jack T�awrence of Signcrafters,.Inc., came forward to present the request.
Mr. Lawrence explained that the sign they wanted to erect for Frank's Nursery
was not oversized or otherwise against Code. He said that the Council stipulation
that wall signs be removed from this building (Council minutes of April 3, 1972)
had referred to the building under different ownership and occupancy status and
that requests by Frank's i�ursery should be considered as separate items.
This brought about a discussion of the history of the requests for signs by
Bob's Produce Ranch. Mr. Drigans reminded Mr. Lawrence that the signs on the
pylon identifying Bob's Produce and Frank's Nursery were to have come down long
/� aga as per a previous stipulation but they are still there. Mr. Lawrence admitted
he had been slaw in removing these signs but he had wanted to do all the work at
once and they had been delaye3 by a wait for plastic to be used in the Frank's
Nursery pylon sign. Mr. Lawrence stated that he would have the signs in question,
` removed within a day or two. '
MOTION by Wahlberg, seconded by Gabel, to close the public hearing. Upon a voice
vote, Lhere being no nays, the motion carried.
Mr. Urigans said that he would go al.ong with the request but that all signs
scheduled to come down must come dawn before any new signs go up.
MOTION by Wahlberg, seconded by Gabel, to recommend to the City Council, approval
of the request with the stipulation that the two identity signs on the large
pylon be removed within 24 hours. Upon a voice vote, there being no nays, the
motion carried.

Mr. b�uhich and Mr. Boardman presented pictures of the house to be moved in
and also pictures of the surrounding homes. Dhr. �iulzich said he is asking for a
rezoning request from M-1 to R-1. It was pointed out that this area has always
been zoned M-1 and when the homes that are there now were built it was legal to
build R-1 on �ndustri�l land.' Mr. rluhich said he has talked with the affected
homeowners and all are in f.avor of the rezoning except one homeowner. This
homeowner has 2/3 of his property on M-1 and l/3 on R-1; th e home rests 1/2 on
M-1 and 1/2 on R-1. This owner would like to keep his M�1 zoning in order that
he may place a wood working, home occupation shop in his garage. Mr. Muhich
said }ie tried to point out various reasons to this h�meowner as to why two
zonings would be a hardship to him. i�1r. Boardman said if 50% of his home was
ever destroye�, he would not be able to rebuild his home due to the double
zoning. Mr. Aluhich said-this was the only opposition he received.

said if the Board request one he �aould put one up, but it would be a bit of a
hardsha�p to do it immediately. Mr. 'Tonco suggested by the end of 1975 that the

b4r. Tonco asked what the Planning Commission's feelings on his request
were. Mr. Muhich said they wanted a petition brought in signed by the home-
owners that they are in favor of the rezoning. Other that that, they se�med
in general agreement for the rezoning. Mr. Muhich said he did have the
signa.tures of all the homeowners explaining what he was going to do and what
he wanted, but it was not worded as a petition..
Mr. Boardman asked about posting a bond to ensure proper landscaping is
done. He said the City has requested this of other homes mo;�ed in and felt
it was a good safeguard policy. The Board and Mr. Niullich agreed to this bond
and set it at $500.00.
MOTION by Tanco, seconded by Nelson to recommend approval of the home
relocation subject to a petition brought in by Mr, I�4uhich stating approval of
the rezoning by the affected property homeowners and with the following
stipulations:

Mr. Dave Torkelson was present for the request.
Mr. Torkelson said this axena will b e added onto the rear of the present
structure. The rink will be full sized and able to seat 1,000 people. There
will be a service door on tlie north side with 2 fire exit doors on the north
and south elevatinns. llarrel Clark a.nd Bob Aldrich h ad suggested placing the
doors here for easier fire equipment access. The main entrance will be on the
west wall. Mr. Torkelson said he would like to put a sidewalk on the south
side and some type afconcrete curb stop on the_north side to keep cars away
from the building.
Mr. Torkelson said the present structure has an ice floor designed for 6
months use and they are using it year around which has caused the floor to
raise. The new rink would have a 12 month floor design thus enabling the pre-
sent arena 6 montl�sice use and 6 m�nths use as an auditorium.
Mr. Lindblad asked if there would b e adequate parking. P.4r. Torkelson said
there will Ue more than enough.
^ Mr. Boardman asked Mr. Torkelson to fill in wha.t the Board of Appeals had
decided at the Tuesday evening meeting. Mr. Torkelson said they are suppose to

have a 25 foot setback from the rear property 2ine but with the new addition, they
will have only 13 feet to 15 feet (the building sits at an angle). A variance
was given with the stipulation that if the Armory should go in on the adjacent
land, there will be joint parking. This is something the City and County will
have to work out at that time, however, Mr. Torkelson could see no problem
with the joint parking agreement.

Mr. Tonco asked where the dumpsters will be located. Mr. Torkelson replied
at present they sit on a cement slab on the northeast side, however they will
have to be relocated. It was suggested to place them on the north side with
proper screening. Mr. Torkelson agreed ta this.
Mr. Boardman asked if the landscaping plan would be similar to the present
landscaping. He replied that he thought it would be very similar as he did the
previous landscaping work. Mr. Boardman said a plan would not have to be brought
in for Council approval but only for staff approval.
Mr. Torkelson said the exterior material will match the present structure
as much as possible. The bottom will be brick, then broken block, rough block
and broken block again. r1r. Boardman suggested a scored block in place of the
regular stacked block to give more design and break up to the building.
Mr. Torkelson said he will look into the passibility of using scored block vs.
regular block, but could not say for sure because of the money involued.
Mr. Lindblad asked if there would be any roof equipment. Mr. Torkelson
said they will have 2 towers located on the west side roof to service the Freon
System for the ice rink. He said, however, that since the fire exits have been
relocated from the east side to the north and south sides the tdwers could be
placed on the east side at ground level. This would place them to the rear of
the new addition instead of on the front. The Board and Mr. Boardman felt it
would be b etter to have these towers on the ground instead of on the roof.
MOTION by Simoneau, seconded by Treuenfels, to recommend to Council approval
of the request with the following stipulations:
1. Sidewalk be placed along the south elevation.
2. Poured concrete curbing (6" x 18") be placed along the north elevation.
3. Dumpsters be relocated on the north side �aith proper screening.
4. Landscaping plan be similar to the existin� plan and subject to staff
' approval. .
5. The 2 Fre on towers be placed at ground level on the east elevation if
possible. Otherwise if placed on the roof they must be properly screened.

Mr. Peter VanHauer and Mr. Albert Eilers were present for the request.
Mr. Ei2ers said basically what they are here for now is to get approval to
start soil stabilization. D9r. VanHauer said they would like to start now as
they expect costs to go up 25% to 30% within the next 4 to 6 weeks and a�.so
they would like to get this done before winter. He explained that they would be
removing approximately 3,000 y3rds of bad soil, debris and blacktopping and
replacing with a good foundation soil.
It was explained that the clinic will be attached to the east side of the
hospital by a skywalk. The clinic will have the same desigr. and red brick as
the hospital. The main difference in the building material will be that pre-
cast concrete will be used instead of poured concrete for the bands on the"
exterior walls. �
Mr. Boardman pointed out that at a meeting held bet�een these gentlemen and
the City staff Thursday afternoon, it was decided that the clinic should be
moved 1-1/2 to 2 feet further west. This will allow for iroper zoning and setbacks
if the building is ever sold. Another item changed was the amount of parking.
The City staff felt there was too much parking even though the amount shown was
what was needed according to code. The staff felt it could be stipulated on
the building permit that parking be provided for what is needed and if more is
ever required it will be provided. At present the parking is adequate for
both the clinic and hospital. The clinic and parking area will cover 3 of the
11 acres owned by the North Suburban Hospital District. The remaining 8 acreas,
for the present, will remain a Green area.
Mr. Boardman said various parking lot setbacks from the property lines had
to be followed. He suggested a plot plan be brought in to show the parking lot
as it should be.
NSr. Nelson questioned if the exits onto Osborne Road would be adequate to
handle the added traffic flow. Mr. Eiler said when the NSHD went through for
. its special use permit'(approved 10-15-73) one stipulation was that no additional
traffic Ue directed towards the residential area. h1r. Boardman said the exits
off onto Osobnre Road would suffice as Osborne Road has b een constructed to
handle a large traffic volume, the visibility along Osborne Road is excellent,
and there wi11 be no traffic stacking as all major intersections are a good
distance away from these exits.
Mr. Eilezssaid a possibility to make sure all traffic is directed towards
Osborne Road would be to liave an inner road in the clinic's parking lot, exiting
^ to the Osborne Road exits only.

Mr. Boardman said there are 2 ways the Board can handle this request: 1)
apprave the site location enabling them to go ahead only with the soil stabiliza-
tion; and 2) approve the actual site layout and this would mean that the NSttD
would not come before this Board again. Mr. Boardman said he felt there were
to many questions on the parking and setbacks and landscaping and felt the request
should return to this Board.

building location in order only to start soil stabilization with the following
stipulations:
1. The building be moved 1-1/2 to 2 feet west to allow for proper zoning

said this Baard could see no objection, but they would have to get staff approval.

5. GENERAL BISCUSSION
Mr. Tonco asked why we request roof equipment screening if there is no
follow up on it to make sur.e ii is maintained. A1r. Lindblad also questioned
signs that were illegal, why something is not done to eliminate them. R9r. Boardman
said the City realizes there are many code ofienders, Uut they do not h ave the
City personnel to follow up on everything as soon as it should be. He said
Steve O1son, Environmental Officer, has been working very hard on problems such
as these, and in particular in Ona.way Addition, Determan's VVelding, Central t�uto
and more. He said Mr. Olson sets up inspections and makes reinspections to make
sure compliance has been met, if not he is not afraid to write out tickets to
the offender.
6. ADUITIONAL EDUCATIONAL M�ETINGS
^ Mr. Boardman said these meetings could be set up 2 to 4 months in advance.
They would include vistors to tell the Board about new concepts in building

It'was decided a meeting would be set up for the first Thursday in each
month that there is no scheduled regular meeting, starting in October.

RE: Rezoning of Lots 11 through 21 and Lots 28 through 37,
Block 4, Spring Brook Park Addition, from Light Industrial
(M-1) to Single Family Residential (R-1) (ZOA #74-04)
Before making this request for your consideration of rezoning
this parcel of land as shown on the enclosed portions of the secti.on
maps from light industrial (M-1) to residential (R-1), I made quite
a thorough survey of the areas. I found that a great majority of
the occupants and land owners in the vicinity seem to be greatly in
favor of the proposal.
I've obtained signatures and addresses of all the property
owners of the land in question, except for Mr. Richard Kush of
Chicago, Illinois, owner of Lots 11 and 12, Block 4, af the Spring
Brook Park Addition. I have, however, written to him explaining
the situation, with a request for his opinion on the matter.
I have also obtained favorable reaction from most all of the
other owners in the neighborhood. This includes parties from both
^ Block 4 and Block 5. I was able to explain the proposal to all those
who signed the rezoning form. .

In reviewing the proposal, you will find that the four home
owners located toward the East end of Block 4, which is zoned
industrial, have maintained and improved their property, probably
with the intention of staying there for some time.
I would also like to pQint out that it would appear improlaable
for the City of Fridley to ever realize much additional revenue from
the area. Industrial zoning ordinances such as area and setback
requirements make it virtually impossible for any inc�.ustrial develop-
ment.
