MOTION by Harris, seconded by Drigans, that the P.Zanning Commission
approve the minutes of the September 25, 1974 meeting as written. Upon

receive the minutes of the Parks & Recreation Commission Subcommittee
meeting of September 23, 1974. Upon a voice vote, a11 voting aye, the

RECEIVF BUILDING STANDARDS-DESIGN CONTROL SUBCOMMITTEE MINUTES:
OCTOBER 10, 1974
MOTION by Harris, seconded by B1air, that the P.Zanning Commission
receive the minutes of the Building Standards-Design Contro.Z Subcommittee
meeting of October 10, 1974.
Mr. Harris asked Mr. Clark if stipulation 9 for the Medical
Clinic which reads " The medical building wi11 be limit,ed-to occupation
and uses as stated in a letter from the Unity Medical Center of
September 6, 1973 which states that this building shall be limited to
health professionals which will include, but not limited to, physicians,
dentists, oral surgeons, clinical psychologists, psychiatric social
workers and allied mental health personnel. Ancillary uses other than
office space shall be limited to those commercial enterprises designed
to serve the doctors and dentists and their personnel and patients.
Such ancillary uses would include things such as professional pharmacy,
an optical company, possibly a card and flower shop, and possibly at
a later date, a coffee shop, could be enforced. Mr. Clark said the
reason the petitioner wanted this worded this way was because there
might be new health fields in subsequent years, and they might want
to be in this building. Mr. Harris said that if they had trouble
renting this building, they might be able to use this stipulation to

rent out to some type of business that wasn't compatible with the
,� primary use of this building.
Mr. Drigans said this was one of th� stipulations the Planning
Commission had on the Special Use Permit.
Chairman Fitzpatrick said the statement says that it is limited
to health professionals, but they didn't want to limit what type of
health professions they could rent the building to.
Mr. Drigans said he thinks their out is that the ancillary
uses other than office space shall be limited to those commercial
enterprises designed to serve the doctors and dentista and their
personnel and patients. He said this could include lawyers, insurance�.
offices, auditor's etc.
Chairman Fitzpatrick said the petitioner's themselves are deter-
mined to limit this building to health professionals so he didn't
think this would be a problem. Mr. Clark sai� as he understands
it,.the building is already 80o rented-

RECEIVE BOARD OF APPEALS SUBCOMMITTEE MINUTES: OCTOBER 15, 1974
MOTION by Drigans, seconded by Blair, that the Planning Commissian
�"1 receive the Board of Appeals Subcommittee minutes of their October 15,
1974 rneeting.
Mr. Drigans said the Council tabled the v�riances for building
on 50 foot lots< Mr. Clark said that these could come before the
Planning Commission if the petitioner decides to build these homes
because they are in the flood plain and will require Special Use Permits.
Mr. Harris said he was interested in the decision an�i the comments
made on the approval for Graham Testers. Mr. Drigans said he said the
Board felt this was a combination of the petitioner and administration
in that this was allowed in the first place. Mr. Clark said the
petitioner was told that if he did this, he was doing it at his own
risk of it being approved. Mr. Drigans said that as this was different
from the plan originally approved, he thought this project'should have
been red tagged, and no one seemed to know where the approval came from
to let them cut the green.area to such a small amount by putting a
driveway through this area.

sion waive the reading of the Public Hearing notice for the consider-
ation of a preliminar� p1at, P.S. #74�-06, Zander's .Zst Addition, by

Mr. Clark said t1�at at the Plats & Subs meeting of October 16,
1974 Mr. Korin, who owns the property that is the exception to this
plat, said there was a two to four foot discrepancy in the East-West
3.ine of his South property line. Mr. Dailey's surveyor made a call
to me and explained that the lot irans in tlze field were not in the
location where Mre Korin thought they were. Mr. Cla�k said he had not
been out in the field to check these irons, so we still have this
su�vey discrepancy.
Mr. Clark said that other items which were discussed at this
meeting was the problem of drainage along the East line of Mr. Korin's
property, which was going to be taken care of by a swale along Lot 6
of this plat. Mr. Korin stated that he would agree to the encroachment
on his property for this swale, so that in case the storm sewer along
his South property line plugged up, the excess water could drain towards
61st AvPnue. Except for the survey discrepancy, all the stipulations
,p�t on.by the Plats & Subdivisions-Streets & Utilities Subcommittee
have been agreed to by the developer. These stipulations are to provide
an easement for the storm sewer as shown on the plat, provide an ease-
ment along the rear lot lines for other utilities, solve the drainage
problems w'ith Mr. Korin, provide one tree per lot, 2" in di.�meter,
reduce the street dedication for 61st Avenue from 25 feet to 20 feet,
so Lot 6 will have the required 80' front footage and provide under-
ground utilities. There is an existing house on this plat which wi11
be moved to Lot l. The entire plat will have to be regraded and there
will be a lot af excess fill.
Mr. Drigans asked how the elevations were shown on the plat. Mr.
Clark said the dash lines are the existing elevations and the solid
lines are the proposed elevations.
� Mr. Elmars Prieditis, 6031 Benjamin Street N.E., said his property
was South of this plat. He said thatin looking at the proposed plat,
there would be an 8 foot drop in five feet and he wondered if this met
the code raquirements. Mr. Clark said the grade would have to be three
to one, that was code.

� Mr. Nystrom said he thought there was quite a drop at that location
at the present time. Mr. Prieditis said it was about a four foot drop
in 10 feet now. Mr. Clark said this will have to be changed to a three
to one slope. Mr. Nystrom said he knew this was code, and he didn`t
know why the engineer hadn't drawn the elevations according to the code.
Mr. Korin, 6051 Benjamin Street N.E., asked Mr. Clark if he had
checked out the elevations for'the storm sewer along the South lin�
of his property. He said he was told at the time this was installed
that it wouldn't be low enough to drain his yard and he wondered if
this was true or not. Mr. Clark said this would be checked out, but
according to the drawing on the plat, it should be low enough to handle
the drainage. Mr. Clark said it was at the time that this was stubbed
into the street that Mr. Korin was told it would not be low enough.
Mr. Fitzpatrick asked Mr. Korin if he had enough room on his lot
to split off half of it for a building site. Mr. Korin said this was
debatable. He feels that he has and everyone else has told him he
doesn't,',so for the time being, we're not discussing that. Mr. Fitz-
patrick said that Mr. Korin didn't have any current plans for his
property then.
Mr. Korin said that the discrepancy in the survey was that the
curb should be thr�e feet from his property line, and with the new
survey, the curb is on my property now. He said that when the City
,� surveyed for the street, their survey agr�ed with his.
Mr. Prieditis asked if this plat could be approved without the
three t.o one slope not being shown. Mr. Harris said this was onl.y
the preliminary plat, and this would be one of the stipulations �or
the final plat.
Mr. Harris asked who would be responsible for maintaining the
20 feet of street dedication adjacent to Lot 6. Mr. Clark said the
property owner of Lot 6. Mr. Harris said he thought this should be
spelled out as a stipulation. Mr. Clark said this was covered in the
zoning code. '
Mr. Korin said that at the Plats & Subs meeting, Mr. Thorson had
stated that there were no plans for adding a garage to the house that
was being moved to Lot 1. He said he had talked to the Zanders, and
they said they did plan to have a garage and it was in their contract.
Mr. Harris said the reason he had brought this up at that meeting was
because of the grade on this lot. It seemed that it would almost have
to be a tuck under garage. Mr. Korin said he thought that was what it
would be. Mr. Fitzpatrick asked if this home belonged to the sellers
of the property. Mr. Korin jaid yes, it belonged to the Zander's.

Mr. Fitzpatrick said the survey discrepancy should be worked
out before this plat goes to Council. Mr. Clark said it would
/1 certainly have to be resolved before the hard shellswere made. Mr.
Fitzpatrick asked who would have to resolve the conflict in the
survey. Mr. Clark said he thought the petitioner should revise
his preliminary plat to show how the drainage problem would be worked
out along Lot 6, the grade change along the South property line, and
the street dedication changed from 25 feet to 20 feet. The Planning
Commission will have another meeting before this goes to Council, and
he thought they should get another look at this plat, with the revised
grade, before this goes to Council. He told Mr, Nystrom to show the
recommend�d changes and get the preliminary plat as close to the final
plat without drawing up hard shells. Mr. Clark said he thought the
Council could set the Public Hearing date for the final plat as long
as the Planning Commission would be able to see the preliminary plat
again.

Mr. Drigans said he didn't know how the Council cauld set a
public hearing date when there was a survey discrepancy. How many
surveys were there? Mr_. Clark said that on this particular piece
of pro�erty, there were two surveys, Mr. Korin's survey and Dailey
Home's sur`vey. He said there were other surveys in the area. Briardale,
Pine Tree Builders, Andy Gowel`s Plat and the exception to the Zander
property. These should all meet on the corner of 61st and Benjamin.
Mr. Drigans said thi5 should be resolved by our next meeting then. Mr.
Clark said it isn't only a City matter to resolve. Mr. Drigans asked wh:
was responsible f.or resolving this then. Mr. Clark said that both
surveyors have certified that their survey is correct, so he would
assume this would be a legal matter. He said he would have to check
with the City Attorney on this. T'his was why he felt the City Council
could set a hearing date and this problem would have to be resolved
at the Council level� Mr. Drigans said he thought it was up to the
Planning Commission to resolve any problems before it went to Council.
Mr. Clark said there was na way the Planning Commission could resolve
a survey error.

Mr. Clark aslced Mr. Nystrom when he wanted to start grading. Mr.
Nystrom said they wanted to grade this property this fall.

�,,,� Mr. Korin said that before any grading is done and the hole
South of his property is filled up, they better put the storm sewer
and catch basin in, or he would have water problems in the spring.
Mr. Prieditis said if this was graded before the plat was
approved, he would want them to be sure of the slope on the South
property line also.
Mr. Fitzpatrick said the plat would not be approved if the grading
was done differently from what was stipulated.
2. CONSIDERA`I'ION OF A VACATION REQUEST, SAV #74-04, BY JERRY GUIMONT:
Vacate that portion of a 15 foot utility easement needed for
a 30' x 24' addition to am existing garage, located on Lot 12,
Block 5, Rice Creek Plaza South Addition, the same being 6551
2nd Street N.E.
Mr. Harris said there were Tetters from the four utility companies
stating that they had no objection to that portion of the 15 foot
easement being vacation where the petitioner wants to have his g.�rage
addition encroach on this easement. Mr. Harris said the entire ease-
ment is 25 feet, so this is a wide easement.
Mr. Clark said they had received the 1ega1 description of that
partion that needs to be vacated from the surveyor today, and it is
quite long. He said tY�.e petitioner cauld have encroached on this
^ easement with the approval of the utility companies, but he had advised
the petitioner to have it vacated so that 10 years down the line, there
wouldn't be any problems, such as getting a.��mortgage commitment.
Mr. Clark said the petitioner has a 2 car garage now for a seven
unit apartment building. This 30 foot addition will give him three
more spaces to make this a 5 car garage. To do this, the front corner
of the garage will encroach about seven feet on the easement and the
back corner will eneroach about 3z feet. The normal way we vacate an
easement.is-usually the entire strip, but there is a telephone pole
just one foot from the new garage wall. This happens to be a corner
post, which is used by the telephone company, the power company, and
General Television. It wauld cost in excess of $2,000 to move this
pole. The u�ility companies do not want to move this pole, and have
given permission for this garage to be one foot from the pole.
Mr. Drigans asked if this could be a safety hazard. Could
someone climb on ttie garage and then climb the pole? Mr. Clark
said the pole has no p�gs on it, so this shouldn't be a problem.

recommend to Council approval of the vacation request, SA V#74-04, by
Jerry Guimont, to vacate an irregular strip of land lying �,rithin a Z5

3. OPEN MEETING LAW
MOTION by Harris, seconded by B1air, that the Planning
Commiss.ion rec�ive the Ietter sent to the Anoka County Attorney by
four citizens of Fridley, and the letter from Weaver, Ta1.Ze & Herrick,
sent to the City Council, dated October 2.Z, 1974. Upon a voice vote,
alltfotinq aye, the motion carried unanimously.
Mr. Drigans said he hoped that these four citizens were genuinely
interested in the eninrcemen� of the open meeting law and not pursuing
this matter for political reasons. He said he was opposed to the
Planning Commission being used for political purposes.
^ Chairman Fitzpatrick said this is. in the hands of the Coun.ty
Attorney now.
4. SETTING DATE FOR WORKSHOP MEETING
Mr. Drigans said the Planning Commission had set aside one night
a month, the same night as the Public Hearing meeting of the City
Cauncil, for having their workshop meetings. They hadn't had one
in October, and he thought they should request one for November.
Mr. Clark said he thought November 18th would be the Public Hearing
night for the Council, because November llth was a legal holiday.
Mr. Clark said he thought he should check with Virgil Herrick,
the City Attorney, to see if these meetings were in violation of the
open meeting 1aw. There may have to be some notice given for these
meetingsr
5. RESPONSE 'I'O MR. HUFF'S MEMO
Mr. Harris said he thought Mr. Huft should be invited to make
his presentation at the next Planning Commission meeting.

6. RIVERVTEW HEIGHTS
Mr. Harris said he had an occasion for visiting in the Riverview
Heights area recently. He said that durinc� the flooding in 1965, he
had felt that this was a disadvantaged area, and was pleasently su.r-

pris�d to find what a nice area this has become. He said it had
a small town atmosphere with very light traffic. He said he caas
/"'1 impressed with the neighborliness shown, and a lot of people were
just out walking.
Mr. Clark said �his area had come a long way in the last few
years. Mr. Harris said the .lighting in the area was very wel� done.
7. N.S.P. UNDERGROUND UTILITY R�TES
Mr. Clark said there was so much ccnfusion on how N.S.P, charged
for underground utilities, and as the Planning Commission usually
requested unaerground utilities on ne� plats, he thought a represent-
ative of N.S.P. should be asked to a Planriing Co:nmission meeting tc
explain their policy.
Mr. Fitzpatrick said Mr. Clark should make these arrangements
and if the representative could come to their next meeting on November
6, 1974, this could be added to the agenda.

Mr. David Corcoran and Mr. James Antell were present for the petitioner.
AZr. Corcoran presented a picture and site plans of the building to be
acted upon.
Mr. Corcoran sai.d the building is to be constructed using precast
materials. The Building will be used as an office and warehouse.
D4r. Corcoran stated the building wzll be built on a 6.97 acre lot. The
building warehouse is 25 feet high and the office and truck strip are 10 to
12 feet below the warehouse.
Mr. Boardman showed plans of the building. hir. Corcoran said the
building would be flat panel or double T panel on the walls. He s�ated the
concrete could be plain or ribbed and either brushed or painted white. Mr.
Corcoran said, also, the outside of the building presents a sawtooth effect
with the laying of the concrete blocks.
Mr. Cor.coran showed on the plans the trucking dock where the txucks
will�drive right in the building to load and unload merchandise.
Mr. Nelson asked about the effects on air pollution. P•4r. Corcoran
stated the building would be used strictly as a warehouse.
b�ir. Boardman said the building is close to the lot line to be near
the railroad for ea.sier use when loading and unloading merchandise.
Mr. Corcoran said the landscaping would be done by Franz Lipp-Marvin
Vehler Partnership. Shade trees will extend to the end of the property line.
Flowering trees will also be used. The landscaping will continue near the
railroad side also.

Chairman.Lindblad discussed the amount of parking stalls. Mr. Corcoran
stated there were 55, which is four more than the required amount.
� Chairman Lindblad asked about equipment on the roof which will be
viewed from the street. r1r. Corcoran said there �aould be the tops of the
exhaust fans and air conditioning units showing, but they would be low.
enough not to harm the appearance of the building. T.Zr. Lindblad then stated
that the new design on the roof units look better than any material used to
screen them. �
Mr. Simoneau asked the question concerning refuse materials and �he
disposing of them.
Nir. Corcoran stated there caould be very little. The warehouse is to

Mr. Corcoran stated there would be 46 employees in all.

blr. Boardman said there will be a new storm sewer put in this fall.
Chairman Lindblad said he would like a color scheme planned for the
outside of the building. He did not want tfie building left unpainted.
Mr. Boardman said they could �vork out a color scheme with the planning
department if the board so chooses.
Mr. Simoneau asked if they would provide handicapped facilities.
Mr. Corcoran stated there would be facilities provided for the handi-
capped.
I�ir. Simoneau made the motion the request for the new building b e sent
to Council for approval with the following stipulations:
1.. That an exterior b uilding color sch eme be worked out for the
building with city staff.
2, That the landscaping be continued along the street right of
way tocaards the N.E. so the project will look mo.re complet� (as shown in red
on plan) .

time, in the cons�.deration of the preliminary plat. .
Mr. Korin, 6051 Benjamin Street N.E., said he wanted the surv�y
line resolved before tlzis plat was f-_inaliz�d. He continued that tlze
survey line lze has used has been register_ed with the City for 18 years.
He said that the stak� in his yard has been used by others in determi_ninq
their prop�rty lines, so if this stalce is off, other property lines �ti�ould
be of� also. Mr. Rorin said he didn't think it was up to him to prove
wher_e his proper�ty was located and thougYlt the new survey would have t�
be rechecked. �Zr. Clarlc said that surveys aren't registered with the
County, but I��r. Y.or_in did have the property surveyed 18 years ago and
has be�n occupying the lan� according to this survey. Mr. Clark
cantinu�d that sometimcs t�he survey will indicate three points in his
survcying, the pro-rated line, the platted distance and the occupation
line.
i�lr. Y.orin said he just want�ed the Subcommittee to be aware that
th�re was a discrepanc 'in the line, because after every-L-hing was
finalized, it would be too late to have tlZis problem resolved; and
also he wanted to check on the drainage plane
Mr. French said this ��ras just the first of many steps in the
process af g�tting a plat approved.
Mr. Clark said the drainage is sho�an on the plat. The dash
lines are exisi.ing elevations a.nd the solid lines are th�_proposed
� elevations. Mr. Thor_ son said I��r. Korin' s property �aould still drai.l �
the same way as -it is noEa. I�r. Clark said they are extending an inlet
for drainage.
Mr. I�orin said that at the time Benja;nin Street was put �n, Alr.
Qureshi saic� he could drop this street one foot for drainage or us�
the money to put in a dra.in soutll of his property. Mr. Korin said
he wanted both, but he couldn't have both, so he didri't think the d�a?n
taas low enough to drain his property. _

Mr. IIarr.is asked how old this house was and what impr.ovements
� would have to be made to brinc� it up t� code. Mr. Tl�orson sai3
it F�as about 30 to 35 years ald, ancl would have to be updated as
far ��s heating, plumbinr and electricity were conc�rned. He said
that struci�urally, thc l�ouse was in pretty good condition. Mr. Harris
askec� if this house had a garage. Mr_. Clark said no, and if this
house was goil�ig to have a garage, it would probably have to be a tuck

Mr. Christensei� asked if the conilict on the surveying should
hold up the Subcommittee's r.ecommenda�.ion on this plat, or could ii�
be made a stipu:tation. ;:ir. Meissner said this �aou'ld have to be resolved
before any £inalapproval could be givcn on the plat.
Mr. Clark said he thought it should be stipulated that the
confl.ict bet�ween the t��o surveys tiTould have to be resolved, that th�re
should Ue utility eas�ment along the back property lines of the plat,
and a si�orm se�aer easeraent for tYie pipe ad��acent to the south property
line to the exception in this pl.at.

care of hi_s drainag� p?-oblems so he didn' t get �-aater in his basement?
A1r� C1zrk said this pipe is at least 4 feet below your basement and
it's a minimum of a J_2" pi�`�e, so it should take care af all the drainage.
A4r. Meissner asl:ed if Pdr. Korin had a�aroblem after this plat was
developeci, ��aho would he seek redress f.rom? Iie said he supposed it
would be a lega_1 problem that would l�.ave to be resolved in court.

disttzrbed, tl�iere cou.ld be a swale put in on his property on the
