Bozy, who is the Human Resources director of the Metropolitan Council. He said
he would appreciate it if other members of the Planning Cammission could come
to this meeting so they could see what the Human Resources Commissions were doing
in other comnunities. Ne said there would be seven comnunities represented.

IVE MINUTES OF THE SPECIAL PARKS & RECREATION COMMTSSIDN MEETING OF
Mr. Peterson said it might be of interest to the Planning Comnission that
there seems to be a movement in the Parks & Recreation Cortmission toward. the
philosophy of providing facilities rather than park programs. There were a
couple of reasons for this. One was to save the Eity's resources, and the other
reason was that it allowed the people to have the type of program that they
particularly liked. He said he thought it would also be correct to say that this
was not a unanimous consensus of the Parks and Recreation, but it was the majority
at this time. He said that as the Planning Comnission studied their goals and
objectives, they would note that they were more facility oriented than program
oriented.
MOTION by Peterson, seconded by Scott, that the Planning Commission receive
the minutes of the Parks 6 Recreation Commission special meeting of October 19,
1975. Upon a voice vote, a12 voting aye, the motion carried unanimously.

Mr. Fred Anderson was present.
��l✓ Mr. Harris said this special use permit had been issued to an individual,
,� and now this business was under different ownership.
��tw�G Mr. Anderson said he wasn't aware that he needed a special use permit for
his business until a couple of months ago when he had an occasion to come into
�•1 �� City Hall. He was informed of this at that time, and was told that this would
�%�� � be placed on the Planning Comnission agenda.

Mrs. Wahlberg asked what effect this would have on the original stipulation
on the special use permit that this be issued to Clifford Anderson only. She said
she would interpret that to mean that Fred Anderson should have made a new appli-
cation for a Special use permit. She asked if administration had addressed
themselves to the problem that it appears that t4r. Fred Anderson has been operating
this business for over 9 months without a valid special use permit?
Mr. Boardman said it was thought that the name could be changed on the
special use permit because it was exactly the same operation that had been
approved on the original special use permit. He said the City had received no
complaints on this operation, and the present operator of the business was living
up to all the stipulations of the original special use permit.
Mrs. Wahlberg said she thought the siipulation was very clear that the special
use permit had only been granted to Clifford Anderson as long as he was the
operator of the business. so she didn't see how administration could make that
kind of decision.

Mr. Peterson asked if wfien a special use permit was issued to an operator
if there was anything put on a deed or a license, so a new operator would be
aware that a special use permit was needed? Mr. Boardman said there wasn't
any license required, and this property was leased, not purchased. He said there
was no record on the deed anyway. .
Mr. Peterson asked if there was any way a prospective buyer could be made-aware
that a special use permit was needed? Mr. Boardman said that he felt that anyone
contemplating operating a business in Fridley should stop at City Hall to see if
there were any special things needed to operate that business. He said the only
way that staff could stay on top of these things would be to �o to an occupancy
permit. He said they would need three or more inspectors if the City was going
to require an occupancy permit every time a business changed hands. �
Mr. Harris said he made the original motion back on May 22, 1974, and it was
the feeling of the Planning Commission at that time that there was concern about ,

on this ,property and they didn't want unrepaired cars standing around, or parts

Mr. Peterson said he agreed with the previous recommendation, but it then
seemed to him that the City should set up some type of system so they would be
aware of when a business changed hands.
' Mr. Boardman said he didn't see how this could be handled under the present
conditions, but if the City did deny the new owner a special use permit, he thou9ht
the new owner would have legal recourse from the past owner because he hadn't
made him aware of this special requirement.
Mr. Langenfeld-said we could probably add another stipulation that in the
event this business was sold, the present operator notify the ne�.a o�aner that this
business required a special use permit. Mr. Narris said that if this was going
to be handled as a transfer, they couldn't add stipulations to the original special
use permit. They would have to have a new request to change stipulations.
Mr. Langenfeld said it was mentioned in the original minutes that this operation
had to be checked by the Fire Marshall and the Electrical Inspector to make sure
everythin9 was up to Code. He asked if this business was still up to Code? Mr.
Boardman said he was sure that it was. He said there would be periodical inspec-
tions made by the fire Marshall because of the paint booth.
Mr. Scott said that he agreed that there probably should have been a new
special use permit requested by the new owner, but from the discussion it would
seem that the new owner was fulfilling the stipulations of the ori9inal special
use permit. Mr. Harris said he felt he didn't want to cause a hardship for the
present owner as long as he was operating under thestipulations of the special
use permit.
MOTZON bg Scott, seconded by Peterson, that the Planning Commission recoma+end

Mr. Scott said he thought the Planning Cortmission was going to have to
address itself to this kind of problem on special use permits. He said he was
sure that the staff did not let this happen on purpose, and there should be some
way the problem could be handled.
Mr. Harris said he could foresee a problem in transferringthe name to An Kop
Auto Body, because this business could change ownership and still keep the same
nama. He thought the special use permit should be transferredfrom individual to
individual rather than by business name. otherwise we would lose control.
Mr, Scott said he would WITNDRAW his motion. Mr. Peterson said he would
WIR'HDR7W his second.
Mr. Anderson said he ran his business on a car in and car out basis. He
had to repair or paint one car a day in order to stay in business. He said he
would like to find a larger area for his operations, but this wouldn't be for
one or two years. He said his lease ran from month to month. He said this was
his first business venture, and he had learned a lot in the past year. He said
he was young, but that regardless of his age, he still should have been made
aware that he needed a special use permit by the previous owner. Mr. Boardman
said he could have been faced with buying a business that could not have continued
if a special use permit had been denied. Mrs. Wahlberg explained to Mr. Anderson
that the questions the Planning Commission had were not directed against him. It
was just a problem they were trying to resolve amongst themselves. She asked
that a copy of the stipulations on this special use permit be given to Mr. Anderson
Mr. Anderson read them, and said he would agree to all the stipulations.
Mr. Boardman said that sending out a renotification of an existing Special
Use Permit would not accomplish much. He thought the main concern should be that
tfie present operator had kept this a clean operation.
Mr. Scott said he would like to see Fred Anderson be allowed to continue his
business, but how it could be handled, he didn't know.
Mrs. Wahlberg said that when any Caronission deliberates on any request, and
to the 6est of their ability comes up with a stipulation, then it disturbed her
to think that this stipulation could be ignored. She felt that the new owner
should petition separately. Mr. Harris said if they were going to ask for a
new request for a special use permit, he thought the petitioner should be allowed
to operate white this`process was going on. He said that if they were going to
change any of the stipulations then this would have to be done. If we only
recorrnnend a change of name, then he thought that could be done without a new
request.
Mr. Peterson said if the name was transferredfrom Clifford Anderson to
Fred Anderson, and all the stipulations stayed the same, he could see no problem
with this. They could address the problem of how this could have been handled
better as a separate issue. He said he felt they had- an obligation to protect
the buyer in a case like this. He said he thought the property owner should be
told that a business couldn't be operated on this property without a special use
permit, and he should give this information to anyone win was going to rent this
property.
Mr. Scott asked if this Special Use Permit could be issued on the property?

Mr. Harris said he wouldn't be in favor of any special use on the property.
They would lose all control of this operation then.
Mr. Langenfeld said that as long as none of the stipulations were changed
on the special use permit, he couldn't see any problem of transferring the name.
He said that if they wanted the property ow�er to make any future tenant aware
that a special use permit was necessary for this operation, that could be a
separate motion. Mr. Scott said this motion could notify the property owner that
when the present operator's lease expires, any future lessee should be made aware
that a special use permit was necessary before he could operate this business, and
if it was going to be used for some other purpose, the City should be notified.
MOTIDN by Langenfeld, seconded by Peterson, that the Planning Coimnission
recommend to Counci2 approval of the transfer of Special Use Permit, SP p79-07,
from Clifford Anderson to Fred Anderson, and that a11 the stipu2ations stay the
sarm as � � e Pla Commission of May 22, 1979.
Mr. Harris said the reason this was tied to the operator of the busin
was because we were trying to eliminate multiple sales of the business and
ending up with an operator who was not as careful to maintain a clean operation
as the present-operator was. .
Mr. Scott said that if another operator let this business deteriorate, the
City would get complaints, and if he hadn't applied for a special use perinit,
this would be a way of closing down a poor operator, so maybe this was a good
stipulation.
Mr. Pe.terson said he wanted to speak in favor of the motion because he
didn't think we should place any hardship on the present operator because from
all reports he was running a clean operation, but he also shared Mrs. Wahlberg's
concern on how we could keep control of special use permits that were granted
to individuals. He said that maybe the Chairman of the Planning Commission cou
request that we get a legal opinion from the City Attorney on hoa� this could b
controlled, and how we could give protection to any subsequent owner so he wo d
ware of this requirement. '

Mr. Anderson asked how long this special use would be in effect? Mr. Harris
said it would be in effect as long as he operated the business and did not violate
any of the stipulations.
Mr. Boardman said he would like to see people encoura9ed to come into City
Hall when they wanted to start a business in Fridley to find out if there were
any special requirements for that business. He said that perhaps there would be
some ��ray that the Chamber of Commerce and the City could work together on this.
Mr. Boardman said if a new business required some type of license or a new sign,
this would be one way to catch these things.

Chairman Harris directed that a letter be sent to Mr. Ryan, the owner of
this building requesting him to inform any subsequent purchasers of this business
that they have to get approval of a 5pecial Use Permit before their business goes
into operation.

On October 22, 1975, Mr. Fred Anderson from An Kop Auto Body,
appeared before the Planning Cormiission and requested that a Special
Use Permit which had becn approved for Clifford Anderson to operate
the same type of business on May 22, 1974, be transferred to his name.
At that time, Mr. Fred Anderson said he had been operating this business
at 6385 University Avenue for several months.
The Plannning Comnission was concerned that this matter hadn't
come to the attzntion of the City at the time that Mr. Fred Anderson
purchased the business from Mr. Clifford Anderson. Mr. Fred Anderson
stated at the Plannning Comnission meeting that he didn't know he needed
to have the name on the Special Use Perniit transferred until he had
come to City Hall on another matter.
Generally, a Special Use Permit is granted on the property, not to a
specific operator. Oue to the nature of this business and the fact that
the operator is a renter, the Planning Cortanission felt they would tie the
Special Use Permit to the operator of the business.
One of their recommendations was that the property owner should be
made aware of this stipulation so that any subsequent lessee of this property
could be notified that it would be necessary for them to appear before the
Planning Comnission for a name transfer on the Special Use Permit before
they start operating the business. Otherwise they would be operating in
violation of our ordinance and could be closed down until they comply with
the ordinance. /

CALL TO ORDER:
4ice-Chairperson Nielson called the March 21, 1984, Environmental Quality
Commission meeting to order at 7:30 p.m.
ROLL CALL:
Members Present: Maynard Nielson, Bruce Peterson, Tom Gronlund
Members Absent: Richard Svanda, Wayne Wellan
Others Present: Jim Robinson, Planning Specialist

CARRIED UNANIMOUSLY.
i. CONTINUED: COMPOSTING DISCUSSION
Mr. Robinson stated that at the January meeting, it was su9gested that
Staff contact some other municipalities in the metro area to see if there
were any sample questionnaires or surveys that have been done regarding
support or lack of support for composting. He stated he had contacted
Mark Huddleston of the MPCA to see if Mr. Huddleston knew of any surveys
related to citizen interest in leaf composting. Mr. Huddleson stated he
did have one survey that was done in the City of Seattle. Mr. Huddleston
stated he would send a copy of this survey to Mr. Robinson.
Mr. Nielson stated he felt the Canmission would really have to take a
survey in the community to really see if there was any support for a compost-
ing project. At tf�is point, tfiings are at kind of a standstill.
Mr. Peterson stated he has kind of gotten the impresslon that until manda�
tory composting and source separation are required, there doesn't seem to
be very much interest on tfie part of the City.
Mr. Gronlund asked if anyone from City Staff had attended the "Evaluating
Waste Management Options" seminar on Feb. 23-24. The Canmission had made
a motion recommending one or more planning staff, John Flora, and a City
Council member(s) attend this seminar.

Mr, Robinson stated Mr. Flora attended this seminar.
Mr. 6ronlund stated the Commission would like to know if Mr. Flora had
picked up any new or fielpful information at this seminar. Maybe there
were some pampfilets or materials Mr, Flora picked up that might be heipful
to the Comnission.
Mr, peterson stated that New Brighton had a leaf composting project, He
suggested Staff call New Brighton to see how this program was progressing.
Mr. Robinson stated he would contact the Garden Club to see if they would
6e tnterested in a city composting project and if they would want to get
involved in helping with a survey.
Discussion continued until the next meeting when they should have a copy
of the Seattle survey.
2. REVIEW OF HAZARDOUS WASTE ORDINANCE:
Mr. Peterson stated that at the last meeting, he had expressed the concern
that in Section 218.05, S�ecial Use Permit Application Procedure, Item #2,
it stated that "upon staff review of the application for hazardous waste
facilities, the application will be scheduled for review by the Fridley
Environmental Quality Commission". If the Corranission is going to review
and recommend to the Planning Commission, they need more information than
just the application. What other materials would be supplied to the
Commission? This needs to be addressed in the rewriting of this ordinance.
Mr, Robinson stated that in 218.05, Special Use Permit Application Procedure,
Item #6, it states that "the Planning Commission shall hold a public hearing
on the proposed special use permit". He stated the City Counci7 had asked
if the Environmental Quality Comnission would concur with the City Council
that the City Council should also hold a public hearing on the proposed
special use permit.
Mr, Nielson and Mr. Gronlund concurred that it would be beneficial for the
City Council to also hold a public hearing on the proposed special use permit.
Mr. Robinson stated another thing brought up by Che City Council was related
to Section 218.15, Monitoring Analysis and Testing. The City Counci7 felt
there should be a requirement for bonding to cover the expenses of any
necessary testing that migfit have to be done. They felt this requirement
should be added in under Item #3.
Mr. Gronlund and Mr. Peterson agreed this requirement shou7d be added.
Mr. Robinson stated he would have the ordinance rewritten and mailed to
the Comnission members prior to the next meeting,

3. 50LID WASTE DISPOSAL FACILITY - BILL DISCUSSION 5ENATE BILL N0. 1312:
Mr. Ro6inson stated that at tfie last meeting, the Commission had made a
motion reconenending that the City Council support the concept of S.F. No.
1312, "A bill for an act relating to solid waste disposal facilities,
establis�ing funds for abatement cleanup, closure and postc7�sure care
of solid waste disposal facilities; providing duties and authority to
the pollution control agency, requiring adoption of rules for closure,
postclosure care, and financial responsibility for landfill operators;
providing penalties; appropriating rtroney; proposing new law coded in
Minnesota Statutes Chapter 116".

would like the Commission members to start thinking of sane
objectives for incorporation into the 1984 work plan.

CALL TO ORDER:
Chairwoman Schnabel called the April 4, 1984, Planning Commission meeting to
order at 7:30 p.m.

Mr. Robinson stated the property was located south of 81st and along
University Avenue. The special use permit request was to use the property
for a refinishing, painting, 6ody work-type shop.
Mr. Robinson stated Staff would recommend the following stipulations:
1. T6e special use permit be issued to the individual and not the
property. (He stated he had included past minutes on a similar
special use permit request in Oct, 19?5 where it was suggested
the special use permit be issued to the individual rather than the
property because if the business were to change hands, the new
owner would also fiave to come before the Planning Commission to
receive a special use permit and would become acquainted with
e�hatever stipulations were necessary to operate the business.)
2. The body shop should provide a 1-hr. fire wall between the rest
of the building. (Apparently, this is already in place.)

3. The City would like to have a plan on how paint and/or other
hazardous waste wil7 be disposed of.
4. No outside storage of materials will be allowed without a
fenced dumpster area.
5. No junk cars will be left on site at any time.
Ms. Schnabel asked the petitioner, Mr. Benjamin, if he had any comnents.
Mr. Benjamin stated he was in agreement with what P4r. Robinson had said
and would have nb problem with abiding by those stipulations.
Mr. Benjamin stated he was presently in the automobile business at Datsun
North in Fridley, in the service and parts business, not body work. Nowever,
he was familiar with the body work business. He stated this was his first
venture into this type of business. He stated his partner was Randy McPherson,
wfio currently manages MAACO Auto Painting in Fridley. Mr. McPherson was also
at the meeting and wou7d be glad to answer any questions.
Ms. Schnabel stated the Planning Commission would be interested in what
method they plan to use for the disposal of wastes and how they can assure
that paint and other pollutants will not go into tfie storm sewer, for instance.
Mr, McPherson stated all the waste material will be hauled away. He stated
Auto Refinishers Warehouse, Inc., off 35W, handles the disposal of waste for
them. There will be no storage or accumulation of waste materials. They
keep everything clean and organized and t�ere wi71 not be any problems.
He stated there are some very strict regulations, and all flarrmab7e materials
will be handled according to tfiose regulations.
Mr. Kondrick stated that when cars are being painted, there is always left-
over paint, thinners, etc. What is done with these left-over liquids?
Mr. McPherson stated that any left-over paint is given to the customer for
touch-up painting, The solvents or thinners for cleaning equipment are put
into a 55 gallon drum and then hauled away.
Ms. Gabel asked how many cars could be accommodated at one time.

Mr. RoEinson stated the City notified the owners of the property. It is not ou�
responsibility to notify the renters of adjacent 6ua�nesses. The manag�r.
of the building is in favor of this operation and feels it will be a

first-class operation. As far as adjacent businesses, he assumed
Mr. Jim Benson had notified them.

Mr. Jim Benson stated he was the agent manager for the building. The owner
of the building is Prudential Life Insurance Co. Prudential is probably
more critical than the City might be. Prudential is a very cautious land-
lord and the last thing they need is anything tfiat would tarnish the image
of Prudential Life Insurance. They would not have entered into negotiations
with this project if it had not been with people they felt would run a first-
class operation. They have some very strict covenants in the lease which
prevents the business from any excess noise or outside storage problem. This
is an industrial building, and there are other industrial tenants. The
building is built sound. All the walls are fully insulated. Their main
concern was simp7y the nature of tfie business, and they are convinced that
this is an excellent company run by two people writ� good reputations who
are both Fridley people. He stated tfie lease is a 402 month lease.
Mr. Svanda stated that in the third stipulation out7ined by Mr. Robinson,
he would like to see tfie words "disposed of" deleted and the word "manage-
ment" inserted. He stated disposal is only one part of the hazardous waste
situation to be dealt with and management talks in terms of what they are
going to be doing with ihe waste while it is on site. Also, instead of that
plan just being submitted to the City, he would recommend the petitioner
be in contact with Anoka County with regard to getting the appropriate licenses
from Anoka County for the generation of hazardous waste which is required by
state law.
Mr. Benjamin stated he had no problem with that.

Mr. Saba stated this sounded like a good clean operation. He liked the idea
that the cars would all be stored inside. He stated he has done business
with MAACO and that was a fairly well managed operation. This operation
sounded like it vras a betteP plan than^the MAACO facility. He stated he saw
a lot of 6enefits to the community with this operation.
Ms. Schnabel stated the only thing she would like the Planning Commission
to consider was the subject of whether the special use permit should be
issued to the individual and not to t6e property. Since there was a 40z-
month lease, perhaps tE�ey should issue the special use permit for a 40 month
period of time or the special use permit would cease to exist if the business
changed hands or was sold, At the end of the lease period, Staff could
review it to see if the conditions of the permit were being met and if it
was necessary to extend the special use permit.

Ms. Schnabel stated SP #84-02 would go to the City Council on April 16.
She stated Staff would verify this date with the petitioner,
2. LOT SPLIT REqUEST: L.S. #84-02 BY G. W. PASCHKE: Split off the Souther7y
30 feet of Lot 7, Block 4, University Industrial Park, and add it to
Lot 8, Block 4, University Industrial Park, to provide additional parking
for an existing building at 7922 Ranchers Road N.E.
Mr. Robinson stated this property was located just north of 79th and west
of Ranchers Road. The owner of Lot 8 is proposin9 that 30 feet of the
northerly Lot 7 be added to Lot 8 to provide for future parking.
Mr. Robinson stated Staff had a couple of concerns regarding tf�is item.
One was that 30 ft. was not really adequate for parking by city code. The
total footage needed from the building to the lot ]ine was 53 ft. With
the 30 ft., they will only have 50 ft., so they are 3 ft, short of the
footage required for parking by code. Staff felt this was a problem, and
the petitioner should be requesting 33 ft.
Mr. Robinson stated the other concern was that these 7ots are substandard
by today's code (3/4 acre - old code; 72 acres - new code). Staff felt
that by taking 30 ft, from Lot 7 would be making Lot 7 additionally sub-
standard and would be creating a poor situation for development. Staff felt
Lot 7 should be combined wiih Lot 4 for future development. The new Lot 4
would then be slightly over 2 acres.

Ms. Schnabel asked if there was a lack of parking stalls at this time.
Mr. Ro6inson stated he 6elieved the potential buyer of the property feels
he may need more parking stalls in the future.
Mr. Steve Spraungel stated he was representing Mr. Paschke. The peop7e who
occupy the building on Lot 8 are purchasing this property from Mr. Paschke,
and Mr. Paschke is providing them with the extra 30 ft. Mr. Paschke is
taking the position that they have to decide what they are going to do with
the additional 30 ft. Mr. Paschke did not know what the new owners' plans
were for this p�operty, and al] Mr. Paschke wanted was the lot split. The
property is in Mr. Paschke's name, but the 30 ft. will be purchased from
Dave Harris who owns Lot 7.
Ms. Schnabel stated the fact that they would be creating a really substandard
lot by recommending approval of this lot split made the decision difficult
for the Planning Commission.
Mr. Jim Benson stated he would like to address the issue of substandard lots.
He stated he was the agent for Rice Creek Associates. He stated these lots
were platted under tfie old code, and he was involved in all the meetings
when the City was changing the lois from 3/4 acre to 12 acres. He stated
there was nothing magic about 12 acres, nor 3/4 acre, for that matter. No
one really had any objection to the 3/4 acre lots. It was Mr. Paschke's
suggestion to change it from 3/4 acre to 12 acres 6ecause of the new parking
standards in the city code and because in their evaluations everyone felt it
would be better to have 12 acres lots. He stated a 3/4 acre lot was still
a very buildable lot. They could still put a fair-sized building on it
and provide parking and meet the code. He did not see where they were pro-
viding for a substandard lot. He stated he was sure Dave Harris would want
to say something about combining Lots 4 and 7. There may be some other
alternatives. There are three oiher lots, Lots 3, 4, 7. Each one is a
little over an acre, so there are over 3 acres right now. By dividing off
the 30 ft. for Lot 8, there would sti71 6e close to 3 acres in the remaining
3 lots. It might make more sense to divide t�e three lots evenly into two
lots.
Mr, Benson stated that parking might have been a bad word to use with this
lot split. This is a 5-year lease agreement with Boring Machine and Tool.
Boring Machine and Tool have an option to purchase the b�ilding during the
term of the lease. There is also a clause in the lease agreement that
requires Mr. Paschke to provide them with 30 more feet:alongside their
building. It was not necessarily for parking. In fact, he was not convinced
the 30 ft. was for parking. The 30 additional feet would creaie a better
truck maneuvering area and loading dock area.
Ms. Schnabel stated the lot split request for 30 ft, was fine, but she wanted
to make sure that everyone understood that at a future date, if Mr. Paschke
or whoever buys the building want to put parking in that area, they will
have to come in for a variance. That variance may or may not be granted.
Ms. Gabe7 stated she had a problem with creating a substandard lot.

Mr. Goodspeed agread with Ms. G6be1.
Mr. Robinson stated Staff would recommend the following three stipulations:
1. Lot 7 should be combined wit� Lot 4 for future development.
2. 33 ft. should be added to Lot 8(instead of 30 ft.) to
provide parking as per code.
3. Landscaping and curbing will be continued at time of deve7opment.
Mr, Svanda stated he did not see the size of Lot 7 being a little smaller
as being an issue of concern,
Mr. Benson stated they still ha�e a very viab7e lot at .92 acre. Under
today's code, they can even put a 15,000 sq. ft. bui7ding on that lot and
meet all code requirements. That is a fair-sized bui7ding and not substandard
by any means.
Mr. Oquist stated he did not see anything wrong with granting this request.
He would be in favor of approving the request, but the Commission should
point out that if this property is to be used for parking in the future,
either 33 ft. or a variance will be required.

Ms. Gabel stated she understood there was room enough to put a substantial-
sized building on Lot 7, but she had a problem with approving something
that, in effect, created a substandard lot by today's code. She would like
to have some clarification from the City Council on how they felt about
these types of situations.
Mr, Oquist stated they are not developing new lots with a new plat. The
lots are already there at the old standard and, therefore, are not substandard
lots.
