Mr. Robinson stated there were two developers in the audience, tJorman Brody
of Brody Associates, Inc., the project constructors of the commercial center,
and Northwest Racquet & Swim Clubs, represented by Allen Kimball and
Kelvin Retterath.
Mr. Robinson stated there were three official re4uested actions: (1) the
platting of approximately 21 acres of property; (2) a special use permit
for the construction of a parking lot in what is now an obsolete flood
plain; and (3) the vacation of 1.7 acres of city proper�y now held for drainage
purposes.
Mr. Robinson stated the purpose was to construct a multi-use commercial
building which will be 55,625 sq. ft, and a racquet & swim club which will be
1II0,000 sq, ft.
hir. Robinson stated the plat consisted of three lots--approximately 6.4 acres
for the commercial center, 13.7 acres for the racquet and swim club, and
2.75 acres forthe existing Sears property wt�ich was being platted as a separate
parcel (also owned by Brody Associates).
Mr, Robinson stated the existing land use and zoning showed the property
as predominately C-3 (generall shopping center, the highest commercial zoning}
and a small area which was zoned as a PUD zone in 1966 by the City Council.
The fourth iten on the agenda dealt with Planning Commission consideration of
this plan as a master plan development under the PUD for that portion of the
development.
Mr. Robinson stated Staff has researched the Comprehensive Plan related to
this proposal and has found that the 1990 Land Use tlap shows that this location
is designated as 5-2 or redevelopment district. This was consistent with the
HRA's activity in tViis area whereby they established a redevelooment district
under Section 462 of the Minnesota State Statutes. The 5-2 zoning cal7ed for
a Mixed use development, and Staff feels this proposed property usage would be
consistent with that 1990 designation.
t+lr. Robinson stated as far as utilities, there was a 24-inch storm sewer
existing on the west end of the site which connects to a city swail which drains
under Nighviay 65 to an existing ditch and then runs north to Rice Creek where
it discharges. That storm sewer line will be used in conjunction with the new
planning scheme devised by the developer.
Mr. Robinson stated there was an 8-inch sanitary sewer line which transects
the site and runs north to a lift station on Centrai Avenue. Currently, the
Engineering Department is investigating whether or not the 8-inch line and
lift station are adequate to meet the needs of the development.
Mr. Robinson stated there was a 12-inch water line in Central Avenue and an
8-inch water main in Rice Creek Road which should be sufficient to meet the
needs of the project.

Mr. Robinson stated a traffic analysis for the site shows that in 1984,
traffic counts were done on Rice Creek Road. There taere 3,600 cars per day
just west of Central Avenue and 5,400 cars per day close to Highway 65.
Projections by the developer are 500 cars per day for the commercial center
and 1,000 cars per day for the racquet and swim club. Utilizing 1.2 persons
per vehicle, this would result in an increase of 2,500 cars per day on
Rice Creek Road.
Mr. Robinson stated that in conjunction with the develonment, the City has
devised a new roadwav system for Rice Creek Road. Starting on Central, there
will be a new thru rinht hand turn ]ane off Central for southbound traffic.
The idea was to divert traffic off Central Ave. north of Rice Creek Road.
There will also be installed two through lanes, goi�na east and west on, Rice Creek
Road ' to facilitate additional traffic. A central median will also be
installed with landscaping. There will be protected left turn lanes at all
major driveway openings. At the corner of Highway 65/Rice Creek Road, there
will be three lanes, one right turn lane, one through or left turn lane, and
one strictly left turn lane. Also, part of the proposal was to close off the
service road which presently dumps very close to the intersection at Highway 65,
which was considered a dangerous situation hy the Public t•lorks 6epartment.
That service road will be closed, vacated, and the developer of the new shop-
ping center wf�o also owns the existing shopping center will utilize that
street for additional parking. There will also be no curb cuts on Central
Avenue for the development.
Mr. Robinson stated the developer has put together a drainage plan and it was
on the Rice Creek Watershed District agenda that evening so by the following
day they should have an indication of whetlier or not this �vould be approved.
As far as otlier environmental reviews, there has been considerationcf the
project by both the DNR and the Army Corps of Enganeers. The Army Corps of
Engineers has determined that although there are 7imited value wetlands
on the site, they could come under a national permit by the Army Corps of
Engineers. The DiJR reviewed the site and they have no problem with the
proposed plans.
Mr. Robinson stated that upon completion of the project, there will be
extensive landscaping to screen the development from the residential area,
both to the south and to some extent to the north, and heavy screening of
the parking.
Mr. Robinson stated in terms of zoning compliance, the proposal was consistent
with the C-3 zonin9. The racquet and swim club was proposing 414 stalls.
In.conjunction with that, 5taff has done a significant amount of research
with other cities and their codes related to health and racquet club facilities
and have found a wide degree of variance on how they treat these types of
facilities. In reviewing the various clubs owned by the proposed developer,
it was sliown that the Fridley proposal would actually be at the top of the
scale regarding the parking provided at other facilities. They have used the
ratio of 2.3 cars of pa�king per 1,000 sq. ft. of gross floor area, which
was adequate.

Mr. Robinson stated tlie setbacks for the racquet and swim club wouid be
80 ft. fror� Old Central which meets code and 50 ft. from abutting residentiai
property which also meets code. That will aiso be heavily landscaped.
14r. Robinson stated the commercial center north of the racquet and swim club
will also be set back 80 ft. from Old Central and approximate7y ]00 ft.
from Rice Creek Road. Tfiey are prroposing 296 parking stalls �•lith 278 stalls
required by code. Tliis was based on the requirement of 1 stall per 200 sq, ft.
of floor area for a speculative mixed use conmiertial building.
Mr. Robinson stated Staff was recommending the following stipulations. He
believed tlie developers were in agreement with all or most of the stipulations.

l. Developer agrees to provide an additional 15 feet of right-of-way along
the south of Moore Lake �rive {incarporated on preliminary plat).
2. Developer agrees to provide a 10 foot bikeway/walkway easement in
addition to and south of the additional 15 feet of ri9ht-of-way (see
stipulation #1 - incorporated on preliminary plat},
3. Developer agrees to provide additional bikeway/walkway easerrrent, 15 feet
in widtVi, all along west and south of Lot 2, Block 2, to provide access
from Moore Lake Drive to Moore Lake.
4. �eveloper agrees to provide a separate street easement on the north side
of �400re Lake Urive - on the south of the existing Shorewood Shoppinq
Center parcel. Easement to be 15 feet in width alonc� the western 2/3
of ttie site and tapering to � at the east end, Provide prior to recording
plat.
5. Developer agrees to pay for any utility relocations or improvements
necessitated by development.
6. All necessary utility easements to be incorporated on plat.
7. A park fee, estimated at �23,451, to be paid prior to recordina piat.

Mr. Barna stated that on the parking lot islands and entry and exit ways,
he wou7d be concerned about a traffic hazard by too dense a landscaping or
too high a berming.
Mr. Robinson stated there would be a visual safety zone on each of the
drfveways which was basically a 25 ft. triangle specified by code, and
there would be no berming or plant material on those areas which woiald
block visibility.
Ms. Sherek asked if someone did a parking ratio on the U.S. Swim & Fitness
facility because of the problems with parking at that facility, and how did
that canpare with this racquet and swim facility?

Mr. Rbbinson stated it was not exactly fair to compare the two facilities,
because inside the.racquet and swim club there were eight tennis courts
and numerous racquet ball courts.wfiich take up a lot of floor area. The
tennis courts alone were 55,000 sq. ft. so there was an enormous amount of
playing area that only a few people at a time will be utilizing. They did
look at the U.S. Swim G fitness facility, and there is approximately
30,000 sq. ft. of floor area and just about 100 cars.
Mr. Saba stated he would be concerned about additional run-off because of
tlie taking away of green space, and the adequacy of the storm see�ers and
sanitary sewers.
��1r. Robinson stated Staff was concerned about this also, and a studyvas under
way by the Engineering Dept. As far as additional run-off, there was an
existing holding pond the City maintains on the center of the site. The
developer will have to replace that capacity plus provide capacity for all of
their run-off. The Rice Creek Watershed District was reviewinq those drainage
plans to see if the developer has been successful in doing that.
t4r. Saba stated there was r�ention in the stipulations of a 10 ft. bikeway/
walkway easement along Rice Creek Road. Then, there was also mention of a
6 ft. aialkway path. If there was a 10 ft. easement, why not make a 10 ft.
path? There was a lot of foot traffic generated by the schools for jogging
and running during the school season.
Mr. Robinson stated the standard was an 8 ft. path--G ft. of green space with
street li9htin9, thenthe 8 ft. path, and 14 ft. of landscaped screening.
He stated that could be looked at a9ain and they would have room to expand to
10 ft. if necessary.
Ms. Sherek asked how far the eastern-most driveway by the existing shopping
center was from the intersection at Old Central/Rice Creek Road.
P1r. Robinson stated it was approximately 190 ft.
Ms. Sherek stated she has always felt that spot was very bad as far as
visibility. She was very concerned with the landscaping providinq limited
visibility to the left for people exiting. She thought some kind of condi-
tion needed to be created there so there was either a separate lane for
people to turn right into, that was not part of the ordinary traffic lane,
or that the landscaping near that curve be eliminated so there is a clear
view to the left.
Mr. Robinson stated Ms. Sherek's point and Mr. Barna's point about visioility
were well taken, and would be taken into consideration when they are doinq
the revision.
Ms. Sherek stated in the stipulations it stated tliere would be no overhead
doors. ldas that no overhead doors on the exposed side or none on the service

electrical connections to new development would be underground, What about
the telephone lines? lJould they be underground also?
Mr. Robinson stated that if one utility goes underground, they all go under-
ground. 7hat included cable TV lines.
f4r. Bil7ings suggested that C-7 be changed to read: "All utility connections
to new developments to be underground."
Mr. Norman Brody stated he was President of Brody Associates, one of the
developers of the Moore Lake Commons project. Ne stated that last October
they purchased the existing Shorewood Plaza. At that time, it was their
intention to upgrade the shopping center, and they had an additional 21 acres
on which they are proposing this new development. At a brainstorming meetinq,
they decided on various uses and the one they settled on was to approach a
health and racquet club facility to see if this would be an appropriate site
for such a facility. They went to what they felt was the premier health clu6
in the Twin Cities area and were very pleased when these people responded
favorably to the proposal. Since then, they have been working with Staff to
develop a comprehensive plan which they feel will benefit the City and be in
keeping with the development which is also going in on the southwest corner
of �9oore Lake (tlie old di•ive-in site).
f4r. Brody stated the entire development, upon coMpletion, is going to be
renamed 11oore Lake Commons and will be composed of four buildings-- the
existing Stiorewood Plaza of 65,000 sq. ft., the Sears building of 25,D00 sq, ft.,
the racquet and swim club building of 180,000 sq. ft., and the cor�mercial
building of approximately 55,000 sq. ft. As to the existing Shorewood Plaza,
tfiey intend to renovate it by putting on a new canopy to rrodernize the appear-
ance of the building and a new sign band to present uniform signage. As the
leases come up for renewal, they will be inserting new sign criteria which,
over tlie course of years, will result in uniform signage. This will be in keep-
ing with what they intend for the new building which will have similar si9n
criteria. In addition, they intend to resurface the parking lot of the
existing Shorewood Plaza and put in new plantings. Tliis phase did not require
City approval, but they were telling the Commission for informational purposes.
Mr. Brody showed drawings of the Shorewood Plaza renovation phase, and he
showed tlie elevations of the new mixed-use buildin9 which was proposed adja-
cent to tlie racquet and swim club.
i4r. Brody stated fie would like to address some of the issues of concern to the
Planning Commission and tlie neighbors. He stated the service areas for their
portion of the project will be between their building and the racquet and
s��im club and also behind the building. This entire area will be screened by
the racquet and swim club itself or by plantin9s located along Central Ave.
The various stores will be serviced by 3 ft. doors for their service entrance.

doors togetlier which will swing open for a 6 ft, entrance. They feel
because of tlie depth of the stores (55 ft. and 75 ft.), they will be cater-
ing to smaller tenants that will not have larQe trucks servicing them.
Mr. Brody stated the trash enclosures will be screened from view as reflected
in the stipulations. They will have parkinq spaces adjacent to the buildinq
and along the landscaped areas. The back area will be used for employee
parking to the office on tlie second flo�r. This will be accomplislied by having
a�+alk�iay which runs from front to back through the first floor of the office
section so employees can park in back and utilize the entrance and take the
elevator to the second floor. Patrons will be parking in front of the facility.
t4r. Brody stated they have worked with Staff to establish a uniform method of
ingress and egress to tfie facility through a joint driveway and then safety
valves for additional exits to the north and to the southwest.
Mr. Brody stated that as mentioned by Mr. Robinson, the storm drainage plan
had been submitted to tiie Rice Creek lJatershed District and ti•ias subject to
the Rice Creek Watershed District approval. If there are any changes or any
suggestions for improvement, they will comply with those conditions.
t�r. Brody stated they have attempted to have a uniform landscaping plan.

the area. They will certainly address the Commission's concerns about

Mr. Brody stated that because of any concerns from the neighborhood of what
they would be seeing, they have prepared a drawing shoo-�ing the cross section
view of ��hat the profile of the building would look like from different areas.
Mr. Brody stated they have tried to do their best in making a uniform, first-
class project that will benefit Fridley and be a showplace for Fridley. He
stated they are very happy to be in Fridley and would welcome any questions
from the Planning Commission and the audience.
Mr. Brody introduced Allen Kimball wiio was representing the Northwest Racquet
and Swim Club.
Mr. Kimhall stated he was with 1��1R Architects, the architects for IJorthwest
Racquet and Swir� Club. He stated they own ten clubs throughout the metro-
politan area. Presently, they are constructing a similar size to the Fridley
one at Eden Prairie at I-494 and Baker Road. One of the other clubs they own
is located in Brooklyn Center on Highway 100 at France Ave. The qual�ties
and finishes of the new clubs will be similar to the one in Brooklyn Center,
although the Fridley and Eden Prairie clubs will have two stories only. The
Brooklyn Center club has three stories. The two floors seems to make the
club flow a little bit better, and it seems to lay out as a better plan.

Mr. Kimball stated the club entra�ce itself was on the west elevation. They
control the main entrance to the club, specifically because it is a private
club by membership only. All the clubs are reciprocal where a member can use
any of the clubs.
Mr. Kimball described the facility from the different elevations.
Mr. Kimball stated that tdorthwest Racquet and Swim Club owners were sticklers
for landscaping and groomfng, both on the exterior and on the interior.
t4r. Kimball described the layout of the inside of the facility. He stated
that in addition they have five exterior tennis courts that will not be
lighted and wi]1 be for day use only. They also show an exterior swimming
pool. Tliey have one under construction at Eden Prairie, and if it is accepted
well, they will be building one at the fridley site.
Mr. Billings stated 414 parking stalls were proposed for the racquet and
swim club. Did they believe that v�as adequate parking based on the 381 stalls
at the Brooklyn Center club whicli r�as similar in size to the Fridley club?
t4r. Y.ir�ball stated tliey believed it was adequate parking, and they woul,d have
no problem with the stipulation for more park9na if it was found necessary.
Ms. Sherek asked if there was any signage planned for tenants who want
signage on the outside to identify themselves on the Rice Creek Road and
Central Avenue sides.
Mr. Brody stated there vrouid be no signage on Centrai Avenue, All the
signage would be on the front of the buildings.
Ms. Sherek asked if that was realistic in tettns of the types of tenants
he was expecting to attract. Retail tenants are going to want to be identified
on the traffic side.
Mr. Brody stated Central Avenue was a traffic side, but Rice Creek Road was
also a traffic side, and they can control that with their sign criteria.
tJhat the City was requiring limited their signage to only the front of the
building.
Mr. Robinson stated because this was a multi-tenant building, there must be
a comprehensive si9n plan approved by the City before they can get
a sign permit.
Mr. Brody stated they feel with a common name for the whole project, �400re
La4:e Commons, that the people they are trying to attract will know where
Moore Lake Commons is. They are trying to have a name that people can identify
as the racquet and swim club and the various tenants they will have in the
building.
Mr. Saba asked if there were any plans to upgrade the Sears building.
Mr. Brody stated they have preliminary plans which will add a blue canopy
to the entrance. However, most of the work was being directed to the larger
Shorewood Plaza area.

t4r. Billings asked Mr. Brody if it was his intent that when the lease with
Sears is up that he would be negotiating with Sears or any future tenant
to try to upgrade the building and tie it in with the other project.
�4r. Brody stated that at the time the Sears lease is up, tl�ey will be
amenable to doing some major renovation. As such with the nature of the
Sears rent, it was not economically feasible at this time to do much
improvement.
t4r. Saba asked if there was any plan Co provide a bicycle parking area
at the racquet and swim club.
Mr. Brro dy stated he believed the clubs do provide for bicycle narking.
Mr. Barna asked if there was going to be a pylon sign.
Mr. Brody stated there would be a pylon si9n and a monument or ground sign
identifying the project and directing traffic to the entrance.
Mr. Barna stated that regarding Central Avenue, Mr. Brody had indicated there
was a retaining wall because of the high grade. How high was that retaining
wall?
hlr. Brody stated he believed at the high point, the retaining wall ��as 3-4 ft.
and then it gradually tapered off.
Mr. Barna stated he would be very concerned about a person being dropped off
on Central Avenue and running through the green area and then the danger
of falling over the 3 ft, drop. People are 9oing to go through this way,
whether the residents like it or not.
Mr. Robinson stated the code would require some type of railing if there
is more than a 36-inch drop.
'�r. Brody stated they might be able to address that concern by possibly
providing some kind of pedestrian path along there to direct people through
that area.
Mr. Billings stated the comment by Mr. Barna that people are going to go
through there anyway was probably a valid comment, but he questioned whether
they want to encourage any pedestrian traffic through there from Central Ave.
Ms. Sherek stated an alternative would be to put extremely dense shrubbery
along there.
Mr. Barna stated people are being dropped off on University Avenue, both
north and south-bound to cross University to get to the U.S. Swim & Fitness
facility. That was what triggered his concern for a similar situation here.
Mr. Brody stated it would be better to have a walkway than to have a structure
that people are going to go over anyway.

Mr. Barna stated the City might want to consider having a passenger drop-off
area on Central Avenue to prevent the stopping of traffic on Central Avenue.
Mr. Robinson stated they are trying to discourage any use of Central Avenue
in relation to this project.
Mr. Barna stated the City should either take precautions so the area is
completely blocked with no access or provide some safe access.
Mr. Jim McCulloch, 6185 Heather Place, asked about the hours of the racquet
and swim club, and what kind of security would there be during the evening
hours?
Mr. Kimball stated the hours would be 7 a.m, to 12 p.m. He stated there
was a third-shift maintenance crew who did all the cleaning and also v�atched
the grounds. He stated they have not had any problems with vandalism at
any of their other clubs. The tennis courts will be enclosed with 12 ft.
high tennis fence, and the swimming pool wiTl be enclosed.
Mr. McCulloch stated that regarding the dropping off of people on Central
Avenue, he would be very much opposed to that type of situation. Traffic
was bad enough coming out of Heather Place and because of the grade, they
had to be very careful in making a left hand turn. If people are pulling
off, �r if there is a special drop-off lane, that would just be anoYher
car to look for. He would encourage the developers and the City to do what-
ever they could to discourage any access to the facility from Central Avenue.
P4r. Scott Kohanek, G116 Central Ave.,asked if there Viould be generators on
the roof.
Mr. Kimball stated they will have all rooftop mechanical units. Any noise
from tliese units would be minor. This buildin9 was different from an office
building. In this buitding they are dealing with atmospheres that are com-
pletely different--locker rooms, running track, fitness rooms, pool, etc.,
so the oniy way to make it work was to have a small unit for each atmosphere.
With an office building, there is one atmosphere throughout the whole building.
He stated he thought the largest tonnage unit they have at the Eden Prairie
club was 10 tons of air conditioning.
Mr. Kofianek stated he did not see a time when the traffic on Central Avenue
was 9o�ng to be minimized in any way, and he would also discourage any kind
of walkway, pathway, or any access from Central Avenue, He stated the
traffic vias hazardous enough along Central Avenue.
CounciTperson Schneider asked if any projections had been made on traffic
on Rice Creek Road and Mississippi St, east of Old Central.
Mr. Robinson stated there were no projections for those areas--just the
3,G00 cars per day west of Central Avenue in a 1984 traffic count. He wauld
guess those projections would be less than that east of Central; however,
they cou7d run some projections. 7he primary concern was the distribution
of traffic after the developme�t.

Mr. Robinson stated this special use permit was for the construction of a
parking lot facility in what was designated on the zoning map as a flood
plain. In researching the designation, it was discovered that the original
application of this flood plain was based on some obsolete topography. In
1931 tVie State had issued a Surface Water ;1anagement Rct which required the
municipalities to institute a regulation protecting flood plain areas. At
that time, Staff used a 1955 topo9raphical survey to determine that an
extensive area of the proposed project site was in the flood plain. Based
upon a current survey by the developer, it was apparent the City was
erroneous at that time and that, in fact, a very sr�all area close to the

lake was still in the flood plain. The rest of the area had been filled
prior to the enactrient of the Surface lJater Management Act.
Mr. Robinson stated he has talked to John Stein at the �NR who said this

fridley, and tliat it could simply be amended administratively. The Rice
Creek �latershed District was aware of this contradiction and will be review-
ing that along with the storm drainage plan. Based on the Rice Creek Water-
shed District's concurrence, they can simply remove the flood plain designa-
tion. In tiie meantime, there was a little bit of uncertainty as to how to
handle this, so they were processing a special use permit with a stipulation
that the special use permit be subject to Rice Creek ldatershed District
and City approval of the storm drainage plan.

Mr. Robinson stated that besides the C-3 zoning, there was also 3.8 acres
adjacent to Central Avenue that was zoned PUD. This was rezoned'in 1966 U�ith
the idea of building a shopping center. A plan was never really submitted
for the development, and the ordinance that �ias in place at that time has
changed. The ordinance which was originally enacted was that the development
would have to be started w3thin one year or the Planning Commission could make
some determination to recommend to City Council to revert the zoninq to what
it was before. That was never accomplished. Today's ordinance would say that
the property would revert to the prior zoning if nothing happened within
3 years. However, it was the City Attorney's opinion that this a�nuld be
a retroactive aoplication of today's code, so he did not feel that would be
appropriate. So, Staff t�as recommending that the master plan that was being
recommended at this meeting be recommended to City Council for approval as
part of the PUD zoning.
Mr. Saba stated he would almost rather clean up the zoning in another way
ratiier tlian leave this small portion as a PUD zone. A PUD zone normally o+as
a�+hole development complex, not just one small portion of a development.
Mr. Robinson stated by recommending this master plan be established as part
of the PUD, ttiey were, in effect, saying that the whole developnent �+as part
of the PUD and that it locked the plan into place. So, if the developers
wanted to change their minds and build something else, they a+ould have to
come back to the Planning Commission and Citv Council because of the PUD
status.
Mr. Billings stated his understanding of what I1r. Saba was saying was that
this was sort of a"back-door" approach and what they should really be doing
is coming in for a zoning change and doing it tt:e right way.
Mr. Robinson stated the problem with zoning changes was that zoning changes
were kind of controversial in nature, and they also take a great deal of
time. Basically, if the Commission liked the development and felt the City
had enough safeguards in place, the PUD was just an abstract overlay over
the map and really did not mean anything.
Mr. Saba stated he understood that. He liked the development, but he just
did not want to see them making some of the same mistakes they have made in
the past with zoning.

they could go ahead and approve this, but she did agree with Mr. Saba that
it was kind of a"back-door" approach. She would like to direct City Staff
to inform the Commission of the existence of any and all undeveloped PUD's
in the City so the Planning Commission can review them and revoke them if
necessary.
Mr. Robinson stated that in conjunction with changing the flood plain ciass-
ification, they could process a zoning change. They would not have to rush
into that but could do it as a housekeeping type of thinq.

Mr. Robinson stated about 1', years ago, the Fridley HP.A acquired some land
for roadway purposes and then removed a house. At this time, the roadway
improvement will create a problem for an individual whose driveway opens
right at the new corner. The City will purchase a small portion of property
from the lot to the south to place the drive on Hackman Avenue. In addition, the
lot split also splits off some unneeded roadway improvement property.
Ms. Sherek stated she did not think the Flanning Comr�ission should approve

make any sense at this point in time. Wfrat happened if in the future, the
City needed five more feet of property and then they have to pay this
individuat for it after giving him tfie property now?
Mr. Robinson stated tfie road design really could not be done until these
things are cleaned up. He recommended the Planning Commission approve it
with the stipulation that the final details of the road design be fully
understood before tlie lot split is recorded.
Mr. Billings stated he had the sa��e concern as 11s. Sherek. from the stand-
point that the City Council has not approved the roadway design. If the
Planning Commission does recommend approval of this lot split, they should
add a stipulation that the final design of the roadway be anproved by the
City Council prior to this lot split going to City Council for aoproval.

everyone along Central Avenue is going to have nroblems with their drive�aays
with the roadway improvement. This lot split was solving one person's
drivea�ay problem, but nov+ was everyone else going to ask the City to buy
property to solve their driveway problems?

6. COtlSIDERATIOtJ aF AN A�4Ef�DMEWT TO THE M-1 AND M-2 I�IDUSTRIAL SECTIONS OF THE
Mr. Robinson stated the City was having a lot of problems with mixed use
development. They have recently had requests for a restaurant in the Fast
River ftoad Business Center and a softball hitting operation at Winfield and
Harris developments (both office/warehouse projects). Both of the requests
are commercial-type businesses. From a pia�tiical standpoint, there was no
reason why a restaurant couldn't be allowed in the East River Road Business
Center; however, the M-2 Industrial code doesn't allow it.
i+lr. Robinson stated also included in the agenda was a mer�o from Linda fisher
of the Larken, Hoffman, Daly & Lundgren Law Frim, the law firm representing
the East River Road Business Center. It was their idea to look at hrn� other
cities handled th�se types of situations. It did seem to be allowed for in the
various zoning codes, either with a special use permit or outright suchas
a restaurant in an industrial center.
11r. Robinson stated he would like some direction from the Planning Cor�mission
as to whether the City should be pursuing this. If so, Staff would bring
back a proposed ordinance change to the second meeting in July.
t1r. Barna stated he would have no objection to that.
t1s. Sherek stated she liked the idea of allowing services that support the
business/office/industrial park only. She stated Edina does it that ti�ay.
Mr. Robinson stated it would then become a matter of defining those sunport
services in the code.
Mr, Billings stated Mr. flick Harris has been before the Plannina Commission,
Appeals Gommission, and City Council expressing the same concern and that
was: Was the City being overly generous with special use permits to the
point 4ihere they have gone beyond the zoning of a particular area? 1laybe the
City should 'ue taking a more serious look at the uses in industrial/commercial
zoning and see if any major changes are in order, rather than just several
small changes.
Mr. Saba stated what he heard Mr. Billings saying was that if they say some
support services are permitted with a special use perinit, were they then
creating loopholes in special cases? t4aybe they should change the zoning
code to eliminate the need for a special use permit for certain types of services.

Fir. Robinson stated he thought the zoning code was working well except in
the case of a mixed use development.
Mr. Saba stated maybe the City needed a separate zoning for business
development centers or mixed use development centers.
Ms. Sherek stated she Vras sure the City of Roseville had a separate zoning
class for mixed use business development centers. She asked Staff to check
with the City of Roseville to see if, in fact, they do have ordinances and
zoning that covers that, If they do, then the Planning Commission should
look at them.

present 2:uilding b,� 1252 si. ft. for a total of approximately 4552 �. ft.
7he extra sFace is inten3ed far uses ancillaiy to the car wash tusiness, such
as Foli�hing and tuffing. The present zoning iC-1> does not allow for auto
related businesses. The proposed C-2 zaning allows foc auto related
oFerations with a s�cial use pecmit. we are processin9 a special usc pecmit
wncurrently with the rezoning for cazwash and fuel dispensing in C-1. This
will allow the petitioner to oommence oonstruction prior to finalizino the
moce lengthy r�oning application. A prc�ision oE the S.U.P wi11 be that the
petitioner agree to firalize the rezoning k� Octobet 30, 1987. It will be a
matter of rernrd that the S.U.P. is intended to be valid for the C-2 zoning.
This grooedure has been reoommerxled t� t.he City Attorney's office.
The adjacent vacant building lot and vacant lot (parcels C and B
respectively7 to the north af the canaash are also propose& for z�oning fran
C-1 anp C-2. The Fetitionez is Rlaus Freyinger (contract purchaser) and
owrec of the adjaoent River Road East Apartments. Mr, Freyinger wants to
lease the building as a pizza shop and therefore also needs C-2 status.

Staffs biggest ooncern is the lack of psrking for the carwash. At present,
typically few custaners park at the site, haaever, the expanded business
would ap�eac to involve moze auto drop-off business. ML. Frey inger has
agreed to prw ide for the use of up to ten stalls on Tract C for the car wash
use. Mr. Olenefeske should 8emonstrate and agree as a stipulation of his
S.U.P. that his operation will not ca3uire additional g�rking.
A second major concern is future use of the properties under the C-2
classification. Staff recommends that, no automotive related businesses
(service or sales) be allowed on Tract B and C. Zriese provisions should be
incorporated on a r�oning agreenent and filed against t1�e properties.
A master plan and comglete list of stipulations will be available at the
meeting on July 8th.

Chairperson Kondrick called the June 1, 1987, Parks & Recreation Commission
meeting to order at 7:30 p.m.

t4r. Young stated that on the first page, last paragraph, second sentence, "f4EA"
sliould be changed to "MEA/MET".
Upon a voice vote, alt voting aye, Chairperson Kondrick deciared the minutes
approved as amended.
1. STAFF REPORT:
a. Region 5AA Softball Tournament
Mr. Kirk stated that at the last meeting, he had told the Commission
he was looking at trying something new with two tournaments--one with
the 14RPA and one with Region 5AA. In lieu of the City charging a
5600 rental fee, the City would handle concessions and charge admissions.
Mr. Kirk stated the MRPA did not get enough teams and had to cancel the
tournament. It was opening fishing weekend, which might have been the
reason they didn't get better participation. They had been looking for
16 teams in three different divisions and only got about 4-5 teams.
Mr. Kirk stated the Region SAA tournament �•+as held. The City did not
charge the $600 rental fee, but netted about $480 in admissions and
about $100 in concessions. So, the City made about �580 instead of the
$600 from the rental. He stated it was the only way that Region 5 would
have held the tournament, as they did not feel they could pay the rental
fee.

Mr. Kirk stated the tournament went well, and they do plan to do it again
next year.
f4r. Kirk stated that as far as admissions, they charged $i.50 for adults
and �1.00 for students. They migl�t charge a litt]e more next year. He
stated Ralph Volkman's people did an excellent job on the maint�nance of
the fields. They had received many good comments about the fields.
Mr. Kondrick stated he had also received a telephone ca�l from a man who
did not reveal his name but who said it was a pleasure to play in a park
so well maintained with such a nice atmosphere. He stated this person
said he looked forward to playing ball at the fridley Community Park.
P4r. Young asked about the new parking lot at the Community Park.
Mr. Kirk stated it was planned to De put in soon._ It would edd 121 parking
spaces.
b. Summer Recreation/tJaturalist Program
Mr. Kirk stated they feel they have a good line-up of summer programs,
and the registration has been very positive.
Mr. St. Clair stated they have a lot of regular programming at the flature
Center--friday night programs, Sat. afternoon programs, and the Sat. tJight
Live co-sponsored with �4idwest Mountaineering. He stated the Teen Club
met on Sunday nights; however, they wili not be meeting for the summer.
They hope to start up again in the fall and continue through the summer
next year.
Mr. St. Clair stated the surtmer programming was kicked off on P�emorial
Day with the second annual Picnic-in-the-Park. They had games and events,
a parade, the Teddy Bear Band, and naturalist events. People could bring
picnic lunches or eat at the concession stand. One of the goals of the
day is to inform the community about the sumner progrartaning. They had a
craft tabTe for the chiTdren and information on the neighborhood parks
and activities at Springbrook. He stated the attendance was over 600
people, doubled from the previous year. Mr. St. Clair stated it was a lot
of fun, and they hope to continue the Picnic-in-the-Park.
Mr. Kondrick stated he felt the names and telephone numbers of the
Corranission members should be listed in the program brochure. It would
be helpful for people who want to contact the Commissioner in their
neighborhood.
Mr. Kirk stated Mr. St. Clair, Mr. De6ardner, and he had gotten together
to change the format and size of the brochure. He stated they would like
to have a table of contents inside the cover. They would list all the
groups and organizations that the City works with on proqramming. They

would also like to highlight the different groups or organizations each
season and have a picture a�d some information about each one. The
Commission members would also be included.
c. 49'er Days Events
Mr. Kirk passed out information on the 49'er Days schedule of events
which began on Wed., June 17, and c�ntinued through Sun., June 21,
Ne stated that as the Commission members knew, the Jaycees had taken
over the leadership of the 49'er Days. They were very enthusiastic and had
some very good ideas. Ne stated Mr. DeGardner, Ms. Connie ThomQson, and
he were involved with the 49'er Days Committee in helping with the 49'er
Ddys.
2. OLD BUSINESS:
a. Tennis Court at Logan Park
Mr. Kirk stated that at the last meeting, Staff was asked to research the
cost of lighting the Logan Park tennis court, either through relocation
or new lighting, and bring this information to the Commission,
Mr. Kirk stated at first Mr. flora thought there were some existing poles
or wiring that would help bring the cost of the lighting down, but he
found there was no wiring in place. The cost for new lighting was approx.
$12,000.
Mr. Kondrick stated he felt the next step was to communicate this informa-
tion to the neighbors and invite Jim Bromenschenkel to the next meeting
to discuss this and to see if the neighbors would be interested in helping
with the funding, which was something Mr. Bromensthenkel had mentioned
earlier. A concern raised by Mr. Young at the last meeting was that there
would be no off-street parking and the possibility of drawing peonle from
outside the neighborhood to the park.
Mr. Kirk stated he would contact t4r. Bromenschendel and convey to him
the estimated cost and invite him to the next meeting to discuss this.
Mr. Kondrick stated he would also be concerned if there were even enough
people using the tennis court to justify this kind of expenditure.
The Commissioners agreed.

proposing to add a deck with a gazebo onto the rear of the dwelling�nit.
Since the gazebo is connected to tlie house by the deck, the deck and
gazebo are considered to be part of the house. The deck will extend to
within 16 feet of the rear lot line which requires a variance. The
deck could be built without a variance if it was built without the gazebo.
Staff has no stipulations to recommend if this petition is approved.
�9r. Clark showed pictures of the property--one looking from inside the house
toward.the rear yard, and one taken from the north end of ihe house standina
on the existing deck looking south.
Mr. Clark stated the gazebo was really a second accessory buildinq because it
was an accessory use to the house, It could be detached from the house and
be as close as 5 ft. from the back lot iine.
Mr. Clark stated that at the meeting was a cony of a letter signed by a

Mr. Clark stated the house behind the E7we11's was at a higher elevation.
In the sumnertime because of the foliage, it s+as barely visible. In the
wintertime, it wou]d be a little bit more visible.
Mr. Clark stated Tom Brickner had built most of these homes and all of ihese
lots because of the distance of the plat froM south to north are rather
short. A71 the homes are within code, but they are all really tight to the
back yards, leaving no rear yard space as far as a�ditions to the houses.

t1r. Clark explained that if the gazebo was on the deck but not attached
physically to the house, he believed there would be no need for a variance.
Tfie deck itself would meet code. But, since Mrs. Elwell is severely allergic
to bees, if the gazebo was not attached physically to the house, she �aould
still have to go outside before entering the r�azebo.
t1r. Elwell stated lie did know know �ahat the gazebo would look like if it was
separated from the house as they had no plans for it that way. Ne stated
the existing deck will be replaced with a new red��ood deck. The new deck
will extend 2 ft. beyond the exist?ng deck o-ihere their bushes are now. He
did not know what imQact this would have on the neighbors because of the
heavy foliage. Of course, the deck and gazebo would be a little more visible
in the wintertir�e,
Mr. Sherek asked P4r. Elwell if they had snoken to their neighbors about the
gazebo.
Mrs. Elwell stated they have not had a chance to speak to the neighbors
behind them as they moved in only about six weeks ago. She stated the
neighbors on the north and on the south have no problem a�ith the deck or
the gazebo.
Mr. Elwell stated they have had a lot of trouble with bees in their backyard.
Mrs. Elwell stated she felt the project was going to be done very nicely and
would add beauty to their home and to tf�e neighborhood. As far as her
medical situation, she has been allergic to bee stings for about 10 years,
and she must carry injection-type medication with her at all times when she
is outdoors.
Mrs. Elwell stated that as far as having the gazebo detached from the house,
she, too, did not know what it would look like because she did not kna� what
kind of plan the contractor could come up with. She did not think it would
look as nice if they want something that will add value to their home and
future resale value.
��rs. Elwell stated they just recently took down two bee nests. Sprina a�d
fall are very bad for bees. She stated they have lived in this home for
five years, and there have been only about ten times �rhen she has been able
to sit outside for any length of time without having to go in because of bees.
She stated it is a beautiful area, and she would like to enjoy it more.

Mr. Sherek stated this is a beautiful house and area.. He thought the plan
for the gazebo would definitely fit in with the style of the house. The

of trees in the back yard and there is as much green area as is possible.
This deck and gazebo would certainly not encroach on any of the neighbors'
sites, so he would be in favor of approving the variance, especiatiy
because of the hardship as stated.
Ms. Savage stated she would agree. This was not a situation where there is
a back yard with a lawn adjacent to another back yard with a lawn, It was
a unique back yard +��ith all the bushes and trees that are completely hiding,
at least in the surmer, the gazebo and deck from the other properties.
Because of the uniqueness of the property and the hardship, she felt the
hardship was met and tVie spirit of the code was met, and she would be in
favor of the variance as stated.
Mr. Barna stated the hardship was rtet. The spirit of the code was defiriitely
being met. This was a very unique nei9hborhood v+ith large wiid spaces v+here
there are high incidences of all different species of bees. Ne would have no
objection to approving the variance.

This property is located north of 76th Way and west of East River Road
in the new Oak River Estates subdivision. The lot is currently vacant
but the petitioner plans to construct a 64 foot long dwellin� unit
(44 foot long house, 2� foot long garage).
The lot is 75 feet o-�ide. This allows for a five foot setback on the
garage side and a six foot setback on the living area side, which requires
the variance.
The houses on the east and west sides of the petitioner's lot are set

the petitioner.
Staff has no stipulations to recommend if this petition is approved.
Mr. Clark stated this was rather a new plat. Mr. Clark stated the house to
the west of the petitioner's lot was a new house and the house to the east
iaas an olcler house, about 40-50 years old, with new siding. The reason the
proposed house has to be set back 51 ft. was because of the setback of the
older house.
Mr. Clark stated there were two easements on the lot--one on each side of
the lot of 5 ft. The petitioner would like to place the garage on the East
River Road side which would place the house 6 ft. off the west lot line and
19 ft. from the new house to the west.
�1r. Clark stated an alternative would be to flip the house �ahich then put
the garage 5 ft. off the west lot line and then the house would be 36 ft. or
better from the house to the east.

Mr. Clark stated 20 ft. was the minimum size for a garage so the garage
could not be reduced any more. If the petitioner does not get the variance,
he could reduce the width of the house to 40 ft., but that was not very large
for a rambler.
Mr. Barna asked Mr. Silseth if he had looked at other rambler-style house
plans such as an L-shaped rambler.
tdr. Silseth stated they have looked at other plans, but they have not seen
any other acceptable plans at this time. He stated noo�adays most lots are
too smali for rar�blers. They live in a split level now, but a split level
is not designed for older people. He stated this would be a two bedroom
house, and he would prefer an attached garage.
t1r. Sherek stated this was quite a deep lot and would alloai for other styles
of houses.
t4r. IJick DeGroot, 149 - 76th Way N.E., stated he owned the new house to the
west. He stated that on the side of his house facing the petitioner's lot,
he had tvro bay windows, one of which was his master bedroom. He stated he
would not mind iooking at a garage from his windows, but he wou]d object to
living space on that side. If the house was flipped, then he would have no
problem ��ith it. He stated the three houses to the west, even the older one,
a7] have garages on the west side of the house, and it would be more uniform
if the petitioner's garage was on that side also.
�4r, John Stifle, 119 - 75th lday N.E., stated he lived across the street from
Mr. DeGroot. He stated he had no real objection to the variance; hovrever, his
biggest concern was that the house would be positioned in relation to the
setbac4: of the older house on Lot 4. Ne stated he has heard rumours that the
a�mer of tlie older house has abandoned the house because of code violations.
lJhat will happen to that house if the bank forecloses on it? tJill it eventually
be torn down? lie objected to building this house in accordance with the older
house on Lot 4 v�hich miglit eventually be torn down.

��tr. Sherek stated he had difficulty in being able to be in favor of this
variance request. One reason was because it was new construction, and there
has to be other house plans that could be used on this lot that wouid not
require a variance. lJith a long 64 ft. structure stretched from one side
of the lot to the other, he felt it would break up the visual look of the
neighborhood. For that reason and because there was no valid hardshio, he
would have to vote against the variance.
Ms. Savage stated she agreed with Mr. Sherek. Unfortunately, these were
rather small lots, and the proposed rambler gave the appearance of crowding
the lot. As pointed out, the house has not been built. t4r. Silseth knew
what he was getting into when he purchased the lot. Hopefully, he will be
a61e to come up with a different plan that will not require a variance.

Mr. Barna stated that on 75th Way, there quite a number of ramblers, but on
76th lday, tliere were different styles of houses and none were really close to
the lot lines. There were no trees or shrubs to break up the continuity
either. 4Jith the house not being built yet, the fact that there were a
nurr�er of other house plans that could be built on the lot that would satisfy
the petitioner'S living requirements and the code requirements, and the fact
that there was no real viable hardship, he would have to vote to deny the
variance.
Ms. Savage stated tfiere was also opposition from one neighbor.
