Bob Schroer, Bob's Produce APPROVAL OF JULY 8 1992 PLANNING COMMISSION MINUTES: � MOTION by Mr. Kondrick, seconded by Mr. Sielaff, to approve the July 8, 1992, Planning Commission minutes as written. IIPON A VOICE VOTE, ALL VOTING AYE, CHAIRPER30N BETZOLD DECLARED THE MOTION CARRIED UNANIMOU3LY. 1. CONSIDERATION OF A LOT SPLIT RE4UEST L.S. #92-03, BY DOUG AND BETH NYBERG- To split the West 1/3 of the East 249 feet, front and rear, of Lots 6 and 14, Revised Auditor's Subdivision No. 10, into two lots, generally located at 1376 - 66th Avenue N.E. Ms. Dacy stated this property is located between Creek Park Lane and 66th Avenue. The petitioners are proposing to split the property into two residential lots. The existing house is located on the north side, and the vacant lot is to the south. Each lot meets the minimum 9,000 sq. ft. lot area and the 75 ft. lot width requirement. Staff is recommending that the Planning Commission recommend approval of this lot split with one stipulation: , � 1. A park dedication fee of $750.00 shall be paid at the time of issuance of a building permit for the vacant lot. � � PLANNING COMMI33ION MEETING, JIILY 22, 1992 PAGE 2 Mr. Nyberg stated he had nothing to add to the staff's presentation. Mr. Kondrick stated the request seems very straightforward, and both lots will meet all code requirements. He would be in favor of recommending approval of the lot split request. The Commissioners agreed. MOTION by Mr. Kondrick, seconded by Mr. Sielaff, to recommend to City Council approval of lot split request, L.S. #92-03, by Doug and Beth Nyberg, to split the West 1/3 of the East 249 feet, front and rear, of Lots 6 and 14, Revised Auditor's Subdivision No. 10, into two lots, generally located at 1376 - 66th Avenue N.E., with the following stipulation: 1. CONSIDERATION OF A LOT SPLIT RE4UEST L S. #92-04, BY ROBERT SCHROER OF EAST RANCH ESTATES: To split off the south 33 feet of Lot 5, Block 2, East Ranch Estates 2nd Addition, generally located at 7787 Ranchers Road N.E. Ms. Dacy stated the property that is being subdivided is located just to the north of Bob's Produce Ranch and is located at the curve of Ranchers Road and 77th Way. The Ajax Company occupies the building on the property. The site is zoned M-2, Heavy Industrial, and the property to the east and south are zoned C-3, General Shopping Center. Ms. Dacy stated the petitioner is proposing that the southerly 33 feet of the Ajax property be subdivided and then added to the Bob's Produce Ranch property. This area happens to coincide with the Metropolitan Waste Control Commission's sanitary sewer easement. By the petitioner purchasing this property, his new lot line will then be on the northern side of that 33 foot strip. That will enable him to have the appropriate setbacks. Another advantage of the lot split is he has been working with the owner of Ajax Company to configure a new shared driveway to the street. Ajax will be reconfiguring their parking lot and putting in a new gate, and they will also free up additional area for the � petitioner's trucks to access the new building as well as for the trucks to the Lyndale Garden Center. PLANNING COMMISSION MEETING, JIILY 22, 1992 PAGE 3 ;� Ms. Dacy stated staff is recommending approval of the lot split, subject to four stipulations: 1. The petitioner shall receive permission from and comply with any conditions of the Metropolitan Waste Control Commission for construction of the proposed access road within the sanitary sewer easement. 2. The curb/driveway opening on Ranchers Road shall not exceed 32 feet in width. 3. The parcel shall be combined with the Bob's Produce parcel prior to issuance of a building permit. 4. The fence along the west property line of Bob's Produce shall be extended as far north as possible to screen the loading dock area from Ranchers Road. Mr. Betzold stated the staff report states: "Once the vacation request was approved by the City Council, the petitioner discovered that he did not have direct access to Ranchers Road from the rear of Bob's Produce Ranch." How did that happen? Is that something staff or the Commission should have spotted when n it came before them? Mr. Schroer stated he did not think either staff or the property owners knew where the lot line was. Staff did a lot of work in helping them find out where the lot line is supposed to be. Mr. Schroer stated the lot split will help for their loading and unloading and also for Lyndale Garden Center. It will help create a better traffic pattern for the trucks. He stated this has been a very complicated piece of land to develop. His son has worked extensively with City staff, and staff has done a fine job in helping them with this project. He stated they are very happy with this plan if it is approved by the City Council. Mr. Kondrick stated that, again, this is a very straightforward request, and it will help to redevelop this area. He would recommend approval. The Commissioners agreed.
