John Wuchko, has requested consideration of a special use permit
in accordance with Code Section 205.18.O1.C.12 to allow exterior
storage of materials, and equipment.
The special use permit provision in the M-2, General Industrial
zoning district allow exterior storage of materials and equipment
with certain considerations.
On May 15, 1990, Phillip Leffel, Leffel Incorporated, dba MAACO
Painting and Bodyworks applied for a special use permit for this
site. The City Council officially approved the request with 4
stipulations. These stipulations wer.e:
1. Vinyl slats shall be installed for screening purposes.
2. The fence shall be no higher than 8 feet tall as
outlined by the Zoning Code.
3. The sod shall be removed and replaced with class 5
gravel and a liner or barrier to protect the ground
from leakage.
4. This speaial use permit applies solely to Maaco Auto
Paintinq and Bodyworks. This special use permit cannot
be transferred to a future tenant without the approval
of the Planninq Commission and City Council
You wiil note that stipulation number 4 refers to a future tenant
other than Maaco Auto Painting and Bodyworks. Though Mr. Leffel
is no longer doing business as MAACO Painting and Bodyworks, Mr.
Wuchko is retaining the MAACO Painting and Bodyworlcs name.

Ms. Dacy stated staff, along with Darrel Clark, the Chief Building
Official, can discuss the storage addition with the petitioner.
Mr. Kramer stated he would be willing to table the special use
permit request as long as he can ciean u� the area, but not
eliminate everything until they arrive at a more permanent
solution.
Ms. Sherek stated her biggest con rn is that the petitioner can
have the best intentions of res ing the issue by cleaning up the
storage area and putting eve ing in back. By having a fence
w2�ich might encourage more ndalism, she can see everything coming
back out front again, a that is not a solution to this storage
problem. She would 1' e to see the petitioner explore the option
of a storage addit' with staff.

Ms. McPherson stated this property is zoned M-2, Heavy Industrial,
with adj acent M-2 zoning on the north, east, and south sides of the
p�operty. There is commercial and residential zoning to the west
o� the property across the railroad tracks.
Pis. McPherson stated the petitioner is requesting a special use
permit in order to construct a fenced storage area directiy outside
t�ae tenant stall of this multi-tenant building. The petitioner has
a contract with Shorty's Towing, which has a contract with the City
of Fridley, to tow accident vehicles from accident sites to various

� storage areas. The Maaco site would act as a sa�ellite storagE
area for Shorty's Towing.
Ms. McPherson stated the storage area needs tc be a:acure3 a�ea;
therefore, the petitioner is propesing a chain link fence �o fenc�
a 48 ft. x 80 ft. area adjacent to the sou�heast wall of th�
building, which is adjacent to Maaco's tenant stall. Currently,
the area proposed to be fenced is a green area. The petitioner
would not construct a curbcut, but would use a wood r�ap to access
the storage area.
Ms. McPherson stated that while this area is not highly visible
fr�ora any public right-of-way, staff is stili recos.�ending that
appropriate screening be required if the Planning Co�mission
recommends approval of the special use permit.
Ms. McPherson stated that since the proposed storage area is
relatively small and is not highly visible from the public right-
of-way, staff recommends the Planning Commission recomLaend approval
of the special use permit to allow the exterior storage of vehicles
and equipment with the following two stipulations:
1. Vinyl slats shall be installed for screening purposes.
2. The fence shall be no higher than 8 f�et tali as out�.inec
� by the Zoning Code.
Mr. Saba stated he would be concerned about accid�nt `rehicles
stored on a grassy area where there is the potential for oil anc
antifreeze to leak into the ground.
Mr. Dahlberg agreed.
Mr. Phillip Leffel stated the vehicles that will be stored in thi�
area are iess severely damaged and less likel�r to be totalled b}�
insurance companies. The reason Maaco is contracting with Shorty's
is because Maaco will have a better opportunity to acqu�re th�
repair work on these vehicles. If a vehicle is not repairable, it
will not be brought to this site. Generally, the only leakage fro:J.
a damaged vehicle is radiator leakage; and the vehicles are prett�
dry by the time they reach the storage location.
Mr. Saba stated he would feel better if at least par:. of t%e area
was a hard surface area for those vehicles th�t mig^�. be le�:�inc
or appear to be leaking contaminants.
Mr. Leffel stated he could look iato t:z pc��ibilyt�' o°
blacktopping the area with the ok=ner of the p�operty. H� sLate�
that based on the experience of ot�er Maaco cer�ers �:�t ha-.�e con=
this, they average about 4 vehicles a month, so there ::oulc nc� b�
very many vehicles on the site at one ti;ae.

Mr. Dahlberg asked if Maaco stores vehicles to use for parts for
repairing vehicles. �,
Mr. Leffel stated they do not do that. They are primarily a
production and painting facility and deal with other people �•�o
supply the needed parts.
Mr. Dahlberg stated that if it is acceptable by the owner of the
property to blacktop the storage area, the owner may not feel the
need for the petitioner to return the storage area to grass,
because another tenant might have a need for a blacktopped storage
area.
Mr: Kuechle stated he did not think a blacktopped area would do
what they want it to, and that is to contain any leaking
contaminants, such as oil and gasoline. Most of those are solvents
and they would either soak into the blacktop, or insufficient
quantities go through the blacktop. So, he was not sure this is
a valid reason to ask the petitioner to blacktop the area.
Mr. Dahlberg stated that a blacktopped surface might be an
advantage to Maaco. With tow trucks coming in and out, the sod
area will get worn down rather quickly and it will be dirt and nud
when it rains.
Ms. Sherek stated the City of Fridiey has a standard that they
require parked vehicles to be stored on hard surface areas.

Ms. Dacy stated Ms. Sherek is correct; however, an alternative
wouid be to excavate the sod now, put down a plastic covering, and
put in class 5 or crushed rock. That would make it easier for the
property owner to re-establish the sod.
Ms. Sherek asked if classified rock is an acceptable surface for
storing vehicles.
Ms. Sherek stated that, as Mr. Dahiberg had stated, the grassy area
saill soon be worn down, and it is going to be a mess in a very
short time. The City requires homeowners to store vehicles on hard
surface areas, and she did not think the City should allow a
business to create a parking_lot that is not a hard surface area.
It is creating a substandard space that could be a contamination
problem in the future.
Mr. Leffel stated he had no idea of the cost of blacktopping the
area. If it is very costly, it might not be feasible for hir_ to
proceed.
Mr. Saba stated he could accept the alternative of class 5 or
crushed rock with a plastic covering under the rock. T�^.e c�st
would be significantly less. If the Commission is agreea�le, he

would recommend another stipulation that the sod surface be
excavated, lined with plastic and coated with class 5 gravel.
Mr. Dahlberg stated that if this is done, he would recommend the
petitioner remove a portion of the curb so the petitioner does not
have to use a wooden ramp.

hearing.

Attached is the staff report for the above-referenced special use
permit. The special use permit, if approved, would allow outside
storage of materials and equipment at 100 Osborne Road N.E. The
Planning Commission voted unanimously to recommend approval of the
request to the City Council with the following stipulations: �

Ms. Dacy, Planning Coordinator, stated that this is a request for
a special use permit to allow the petitioner to construct a fenced
storage area for the outside storage of cars related to the auto
painting and bodyworks facility. She stated that staff recommended
that the outdoor storage area be fenced with vinyl slats and the
fence be no higher �han eight fee� tall.
Mr. Dacy stated th�t the Planninc Com�ission added a stipulation
that the storage area be excavated, lined with plastic, and six
inches of Class S material be ins�alled.

Mr. Leffel, the petitioner, stated that this stora�� a�e,� would be
used by Shorty�s Towing to tow vehicles to a secure� �rea. He �
stated that where Shorty's now tows vehicles to their facility
there are no repair facilities at the site. He state� tt�.�t, most
of the timA, the insurance companies a1'_�» �_._ t� -�:�i,.,,r the
vehicle in order to avoid anothEr tow.
Councilman Billings stated that he is not concerned wit� the dollar
value of the rental agreement Mr. Leffel has with Sh�rty�s, only
if Shorty's receives any payment from Mr. Leffel if h� would work
on the vehicles Shorty's brings to his establishment.
Mr. Leffel stated that if he repairs the vehicle, Sh�rty�s would
receive a 10 percent commission.
Councilman Billings stated that he is concerned froa th� standpoint
that this outside storage may not be incidental to ti�e operation
of Mr. Leffel's body shop. He stated that, typicaily, outside
storage is associated or is an incidental aspect of a particular
business. He stated that he believes this goes beyond that scope.
Councilman Billings stated that there is also the philosophical
question that when a person's vehicle is towed to a-� auto body
repair shop that, in fact, there may have been coercian by their
insurance company to do business with a particular bo�y shop. He
felt possibly the City's contract with Shorty's shoulc be reviewed
and put in a clause to specifically prohibit that ty�� of thing.
Ms. Dacy stated that the Zoning Ordinance does not address the
issue that exterior storage of materials has to be an accessory
use to the principal use. She stated that staff's interpretation
is that it is outdoor storage of materials, and they ha�e to obtain
a special use permit and whether or not it is relateu to the use
is not a criteria that is specifically stated.
Mr. Herrick, City Attorney, stated that the cod� does not
specifically state that the storage has to be an incide�tal use and
whether or not this should be changed, he fezt kas a:�Iicy issue.
Mr. Leffel felt that to refer to coercion was not ap�ropriate as
the owners of these towed vehicles can have their cars fixed
anywhere they wish. �
Councilman Billings stated that Mr. Leffel was the one who brought
up this issue and stated that the insurance adjuster s��etimes may
not want to pay far another tow.
Mayor Nee stated that there are tires s�or�� _� t�a �=ck area of

� Councilman Schneider stated that if this buiiding is not in
compliance, he is not comfortable with proceeding_
Councilwomar. Jorgenson stated that she �«�as c^-�'==�ned that matt �-ials
could drain from these vehicies into the groLnd and contaminate the
soil.
Mr. Leffel stated that by the time the vehicles reach the storage
area, most of them have already been drained of any fluids.
Mr. Leffel stated Council can state that he cannot offer Shorty's
a commission, and he would be happy to go along with this
stipulation.
Mayor Nee stated that he shared some of the same concerns as
Councilman Billings.
MOTION by Councilman Billings to table this item until July 23,
1990. Seconded by Councilwoman Jorgenson. IIpon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanimously.
Mayor Nee stated that he would like to know what Shorty's is doing
on the vehicles he tows for the City. He was also concerned about
the signage for this building.
� B. RESOLUTION NO. 48-1990 AUTHORIZING AGREEMENTS BETWEEN THE CITY
OF FRIDLEY AND RECIPIENTS OF 1990 FEDERAL COMMLiNITY
DEZ7ELOPMENT BLOCK GRANT FUNDS FOR HUMAN SERVICE ORGANIZATIONS:
Mr. Steve Barg, Planning Assistant/Code Enforcement Officer,Jstated
that $33,291 has been designated for community service`s under the
Community Development Block Grant program_ He stated that the
Human Resources Commission heard oral presentations from the
agencies requesting funding. He stated that more reguests for
funding were received this year than last� year even though there
was about $1,000 less in funding.

Mr. Barg stated tha� it is recommended Council approve the Human
Resources Commission's recommendation for allocation of these CDBG
funds to the various agencies.�'and authorize the City to enter into
contracts with the individual recipients of these funds.

Mr. Barg stated that a"corrected resolution has been submitted as
the Banfill-LockE Center for the Arts was inadvertently omitted
from the resolution submitted in the Council's agenda packet.
MOTION by Councilman Fitzpatrick to adopt R�so'ution No. 48-�990,
which includes $2,500 to the Banfill-Locke Ceater for.the hrts.

Site
This request is located on Lot 2, Block 4, Commerce Park, generally
located at 100 Osborne Road N.E. Located on the lot is a multi-
tenant building with Maaco occupying the southeastern two tenant
spaces. The parcel is zoned M-2, Heavy Industrial, as are parcels
to the east, south, and north. The Burlington Northern railroad
tracks are located to the west of the parcel with R-1, Single
Family Dwelling, and C-2, General Business, zoning to the west of
the railroad tracks.
Analysis
The petitioner is requesting that the special use permit be issued
in order for him to fulfill contractual obligations with Shorty's
� Towing. Section 205.18.O1.C.(12) of the zoning code allows outside
storage of �aterials and equipment with a special use permit.
Shorty's To.�ing has a contract with the City of Fridley to tow
accident vehicles to a secured area. Maaco's contract with
Shorty's allows them to act as a"satellite lot" for Shorty's.
The petitioner is proposing to fence a space 48 feet by 80 feet
adjacent to the southeast wall of the building, which is adjacent
to Maaco's tenant sta31. The fence is proposed to be constructed
of chain link. Currently, this area is grassed and curbed. While
not highly visible from the public right-of-way, staff recommends
that appropriate screening be required with approval of the special
use permit.
Recommendation and Stipulations
As the proposed storage area is relatively small and is not highly
visible fro� the public right-of-way, staff recommends that the
Planning Cor.unission recommend approval of the special use permit
request, SP 190-09, to allow the exterior storage of vehicles and
equipment with the following stipulations:
l. Vinyl slats shall be installed for screening purposes.

At the July 9, 1990, meeting, the City Council tabled action on the
above referenced request. A nu�ber of issues were raised regarding
the City's contract with Shag-ty's Toaaing and its relationship with
Maaco'Auto Painting and Bodyaorks. Please see the attacYzd
memorandum from Jim Hill, the Public Safety Director, regarding �he
City's current contract with Sr.orty's Towing.
Shorty's Towing has indicated to us that they do not receive any
"referral fee" at this time, nor do they intend to in the future.
However, should the Counci3 want to impose this condition on
Shorty's Towing, it is recc�mmended the contract be amended and
approved by the Council at a future meeting.
In order to resolve the othe� concera� regarding outdoor storage on
the property in general, we have con�acted �he new tenant (Discount
Tires) regarding the illec�al outc�oor st�rage of tires and a
trailer, as well as an illeg�l sign_ k'e also recommend that as a
stipulation to this request, the special use permit pertain to
Maaco Auto Painting and Bod�works specifically.

permit cannot be transferred to a future tenant without the
approval of the Planning Commission and City Councii. Seconded by
Councilman Fitzpatrick.

Site
Blomberg Estates was platted in December of 1980. At that time,
a 10° drainage and utility was recorded to allow an 8" sanitary
and 18" storm sewer to cross Lot 7, Block 2.
During October 1983, a building permit was issued for a home on
Lot 7, Block 2, Blomberg Estates. That permit was for a 48'x
26' home with a 24'x 26' attached garage. Attached to the permit
application was a survey, modified by adding a simple-inked-in
sketch of how the home would sit on the property. The 10'
easement was clearly illustrated on the diagram and a front yard
setback dimension was indicated, but a dimension from garage to
the south property line was not included. It is the contractor's
responsibility to insure the home is to be properly constru�cted.
An as-built survey was prepared by Suburban Engineering, once the
home was completed. That survey indicated that the attached
garage had been constructed in a manner that encroached on the
City's drainage and utility easement along the entire length of
the garage.
The encroachment was identified as part of a title search when
the petitioner was preparing to sell the property.

Staff suggested that the property owners submit a hold harmless
agreement as a solution to the encroachment. This hold harmless
agreement would indemnify the City of responsibility if the
garage were damaged by utilization of the easement for purposes
in which it was intended. The Title Company declined to pursue
this option, opting for the vacation process as the ��cleanest��
option to rectify the title problem.
Prior to application, the petitioner was advised about the
necessity to have a survey identifying the precise description of
the area to be vacated.

: ANALYSIS
On at least one other occasion a garage encroachment has caused a
situation were the owners were required to provide an
indemnification document to the City. In that instance a garage
was straddling a 6� utility easement. Discovery of the easement
came after that garage was in place. �
In the current situation the importance of the easement, combined
with the request to vacate, has caused the Engineering staff some
concern. Typically, when the combination of storm sewer and
sanitary sewer lie within a 10' utility easement, all of the 10'
would be required to provide the necessary space to make repairs
on the utility lines. Therefore, their reconimendation was to
vacate only the portion of the easement beneath the garage
encroachment. This vacation, though not ideal, will leave about
nine feet six inches of easement.
Other utilities, including the power and gas companies have been
notified. As of yet, there has not been a response regarding
this matter from those utilities.

STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve the request

Consider Resolution to Determine Consistency
Between the Comprehensive Plan and the Proposed
Expanded Redevelopment Plan for the Southwest
Quadrant
State law requires that the Planning Commission review any
modification to a redevelopment plan to determine its consistency
with the City's Comprehensive Plan.
The Commission is well aware of the effort to develop a
redevelopment plan for the Sauthwest Quadrant of the University
Avenue/Mississippi Street intersection. On December 5, 1994, the
City Council and HRA completed a Request for Proposal process
with three developers and also evaluated options regarding
expanding the project area to include the existing four apartment
buildings along Satellite Lane. The City Council and HRA decided
to select Rottl.und Homes, Inc. as the developer for the Southwest
Quadrant. At the same time, the City Council and HRA decided to
expand the project area to include the four additional acres
containing the apartment buildings.
The purpose of the expansion is to maximize the value of the new
project, to create a residential character as part of the "Center

existing single family neighborhood to the south, and finally, to
provide a wide variety of housing styles and choices to meet
existing market demands.
The 1982 Comprehensive Plan identifies the area now occupied by
the apartments as medium density residential. The Center City
Tax Increment District is shown on the plan as a redevelopment
district. Rottlund submitted a concept plan proposing 48 senior
condominium units (two 24-unit, four story buildings), 96
attached townhome units for young professionals, and 26 detached
townhome units for empty nesters. Approximately 17 detached
townhomes are proposed to be included into the redevelopment
project area. The density of this portion of the development is

are currently 76 units on the four acre site. Therefore, the
reduced density is consistent with the existing Comprehensive
Plan.
The Rottlund proposal is a concept plan at this point, and does
not represent any type of approval from the City Council or HRA.
Rottlund nust submit a plat, rezoning, and single family attached
townhome applications to the Planning Commission and City Council
`for final approval. Rottlund is also aware that they need to
meet the design guidelines as developed by the Planning
Comrsission, City Council, and HRA.
Although `he Comprehensive Plan does not specifically address the
Southwest Quadrant or the Center City redevelopment, the Housing
chapter of the Plan states that one of the purposes of the plan
is to "stimulate private activities to produce additional housing
that will provide a broader range of housing choices." The
mixture o= proposed housing units is supported by the recent
housing �arket analysis completed by Maxfield Research Group in
1991. Fu=ther, during the review process, staff spoke with two
local rea=tors who also reinforced the need for townhomes for
empty nes�ers and seniors. The architectural design guidelines
and emphasis on quality interior products wiil also help to
generate a housing quality which will add to the value of the
development.
Recommendation
Staff recommends that the Planning Commission approve the
attached resolution determining that the proposed expansion of
the redevelopment project area to include the four acres along
Satellite Lane for inclusion into the Southwest Quadrant
redevelopaent is consistent with the Comprehensive Plan.

Community Development Block Grant 1995 Allocation
Because the Human Resources Commission was unable to�hold a
, meeting in January, a recommendation about the 1995 allocation
has not yet been prepared from the Commission. The next Human
Resources Commission is February 2, 1995. Because of the
application deadlines for Anoka County, we will be unable to
inform the Planning Commission of the Human Resources Commission
action until after City Council approval. We will update the
Planning Commission, however, after City Council action on
February 13, 1995.
Although we have not discussed it specifically with the Human
Resources Commission, we are not anticipating a significant
change from the 1994 proposal which included $25,000 for the
routine disbursement to eligible agencies, $2,500 for the ACCAP
Senior Outreach Worker and $2,500 for the Fridley Senior Home
'Companion Program.
