shortcomings in the water delivery system, and identifies
procedures for conservation of water resources during declared
emergencies.

55.0 feet thereof, Auditor's Subdivision No. 22, generally
located at 6291 Central Avenue N.E.

Mr. Hickok stated that the request is for the property located at
6291 Central Avenue N.E. A special use permit is being requested
in conjunction with a variance to allow construction of an
addition to an existing home. The variance was reviewed and
approved by the Appeals Commission on September 12. The varianae
allowed the petitioner to construct the addition 7 feet from the
southern property line rather than the 10 feet as required by
code. The special use permit is for a second accessory structure
over 240 square feet.
Mr. Hickok stated there is an existing home and garage on the
site. The addition is out toward Central Avenue. The property

is at the corner of Central Avenue and Rice Creek Road. The
proposed addition is 22 feet x 24 feet. It is a two-car garage
with a master bedroom on the second floor of the addition. A
breezeway connects the new garage/master bedroom to the existing
house. The code requirement for a special use permit is to
protect the open space and to consider elements such as home
occupations, etc., that a second large accessory building might
encourage.
Mr. Hickok stated staff has determined through their review that
this is living space and additional garage space. The current
garage is detached. Staff recommends approval of the special use
permit with the following stipulations:
1. The petitioner shall construct a hard surface drive of
asphalt or concrete within 12 months of the City Council's
approval of SP #95-09.
2. All grading, drainage and downspout locations shall be
designed in a manner which will prevent detrimental run-off
impacts to adjacent properties.
3. All necessary permits shall be obtained from the City prior
to construction. �
Mr. Oquist asked if the driveway is on Rice Creek Road or onto
old Central.
Mr. Hickok stated the driveway is onto Rice Creek Road and the
curb cut for the driveway has already been created.
Mr. Newman asked if the structure the petitioner is expandinq is
considered an accessory space even if it is connected by a
breezeway.
Mr. Hickok stated yes. The trigger is the garage. Even an
attached garage is considered an accessory structure.
Mr. Newman asked if there had been any comments from the
neighbors.
Mr. Hickok stated the neighbor had provided positive support at
the Appeals Commission meeting.
Mr. Saba asked the petitianer if he had any problem with the
stipulations.
Mr. Litwinczuk stated no.
Mr. Oquist asked if the petitioner would lose any trees. �

SIIBJECT: Water Conservation and Emergency Plan
INTRODIICTION
As you may recall, the Minnesota Department of Natural Resources
(DNR) has required that all communities with municipal water
supplies submit water conservation and emergency water plans (as an
amendment to their local comprehensive plans) by January 1, 1996.
A staff committee was formed consisting of inembers of the Police,
Fire, Finance, Engineering/Public Works, and Community Development
Departments. To assist with preparing the document, the City
Council approved hiring Short_�Elliott Hendrickson (SEH). The draft
plan is nearing completion and will� be considered by the City
Council at its November 13, 1995 meeting. � �
PLAN IMPACTB
This plan will serve as an amendment to the City's Comprehensive
Plan including the amendment to the sewer and water chapter that
was recently approved by the City and the Metropolitan Council.
Fridley's current water supply system is sufficient to accommodate
the future growth and redevelopment activities that will occur in
Fridley, beyond the year 2010. This projection assumes that there
will be no additional contamina�ion problems without suitable
supply treatment or replacement.
According to state plan mandates, an operational work plan with
completion dates should be implemented by.the City which include
the followinq:
-- Collection of water use data by expanded customer
categories. The commercial/industrial category could be
collected separately, residential categories separ�ted
into dwelling unit type, and unaccounted and nonprofit
uses could be defined and separated accordingly. �

It is our hope that this memorandum will provide you with an
insight into the process and provide you with an opportunity to
respond to impacts, plan completion scheduling or other related
issues. It is important that we address any unresolved issues and
move this Comprehensive Plan Amendment through the process. A
January 1, 1996 plan completion is required by law.

On May 3, 1995, the Fridley Planninq Commission and Environmental
Quality and Energy Commission held a joint meeting to discuss the
City's.Water Conservation and Emergency Plan. A draft plan was
circulated and comments were made by the Commission Members.
I have included the minutes from our EQE/Planning Commission
discussion. The (paraphrased) comments included:
Comment - What about wellhead protection and the City�s
implementation of interim strategies prior to
the finalized version of the State�s wellhead
protection rules?
Response - The City has prepared a preliminary inventory
of well information and is committed to
dovetailing the State•s Wellhead Protection
Plan into this plan as soon as the final
document becomes available.
In the interim, the City will continue to
protect our wellheads through the zoning and
building code standards established to protect
the environment.
�
The City will also investigate and likely �
pursue a grant to further the cause of
wellhead protection.
ComYnent - Is pemergency" defined anywhere?
Response - The language on Page 40 has been enhanced to
include natural hazards, human caused
disasters and contamination. Contamination
hazards are now and would continue to be
monitored by City staff. The Water Emergency
Conditions Ordinance that will be required as
an implementation element of this plan can be
drafted with very specific language to address
the contamination response procedures.
Comment - In the Emergency Ordinance Provisions on page
42 the restriction of restaurants serving
water on a voluntary or mandatory basis is a
concern. Drinking water is essential and
restaurants should not be restricted from
serving it.
Response - The Water Emergency Conditions Ordinance that
will be required as an implementation element
of this plan can be drafted with very specific
language to address the restaurant water �
service restriction. The plan language still
^ needs a minor revision so that

Comment - Is it necessary to test the City's___drinking
water daily?
Response - Yes, the water is tested for fluoride daily.
Every Wednesday the State requires tests for
drinking water quality. These tests would
identify certain characteristics of the water
and assure that the standards of the safe
drinking water act are met.
Comment -
Rigorous testinq for traces of TCE is done on
a monthly schedule when well or wells are in
use. Well #9 is tested semi-anrivally. The
implementation plan includes a date certain
requirement for a resolution of preferred
mediation method for well water contamination.
Have we considered having large water users do
water conservation plans to be submitted to
the City? �
Response - Yes, if the City elects to do so, our Water
Emergency Conditions Ordinance can be drafted
with very specific language to address large
user, conservation plan implementation.

l. REVIEW OF THE CITY OF FRIDLEY•S WATER COIdSERVATION AND
EMERGENCY PLAN
Mr. Hickok stated the state legislat}�'e.in 1993 mandated a
modification to Chapter 186 in which�"'Chey. r���'ed communiti�es
with municipal water supplies to prepare a water conservation and
emergency plan prior to January 1, 1996. In an effort to get a
better understandi:ng of what it is the state wanted, staff�
invited Jim Japs from the Department of Natural��Resources and
Gary Oberts from the Metropolitan.Council to come out i.n
November. At that time, only 3 of 113 co��r�ties had completed
this plan. Staff was concerned that this is quite a task and it
is. important that there be a chapter amendment to the
Comprehensive Plan. Staff prepared an internal working team with
Ms. Dacy, Mr. Hickok, Ms. McPherson, finance representatives, and
Public Works representatives who worked in the areas of
inventory, emergency planning, and water conservation planninq.
Mr. Hickok stated, from those early discussions, thay put
together an inventory for what the plan should include. There
are guidelines from the s'tate that are very specific. Much of
the information in the agenda packet is inventory information.
At this meeting, Hickok stated he would like.to focus on the
policy aspects of the plan. The imrentory is somewhat in place.
The City did consult with:MSA, an engineering consulting firm, to
analyze the City's water'supply.,system.:' That MSA plan in draft
form has come back to Mr.�Flora for his''review. This could be on

the City Council agenda for their review on May 15. This study
is the result of the Council's interest in water quality and
functionality of the system. The Council was interested in
knowinq about the water quality and about the water system in
general.
Mr. Hickok stated he would like feedback on wellhead protection.
Running simultaneously is the wellhead protection pragram which
involves the rewrite of the health rules. In 1989, the State was
lookinq at the overall water supply for the region and determined
that staff should have some protective devices in place for the
wells and, at that time, they determined a wellhead protection
program was necessary. Very recently, they passed a wellhead
protection program and the rules are being rewritten. Staff is
not at a point where.they can bring those rules i.n. The rules.
will be reviewed when they are final.
Mr. Sielaff stated the rules are in draft form and.he thought
they were close to bei.ng final.
^ Mr. Hickok stated this was correct. There have been a series of
public information meetings and.staff have been i.nvolved in these
review discussions.
Mr. Sielaff stated there are cities that have already begun thei,�r
wellhead protection plan.

Mr. Hickok stated, as cities are gro g� anc��l�ri.ng for wells,
they will need to be up-to-date with their wellhead protection
plans. � �
Mr. Sielaff stated, while it is fi.�e to wait uritil the rules.are
final, he thought there are some thi.ngs staff can do now. The
EQE has discussed this and that Commi.ssion has supported•the -
Program-

Mr. Hickok stated he thought the EQE has supported the draft
also. He asked if they were.comfortable with the direction it is
heading.
Mr. Sielaff stated he would prefer to get started on the wellhead
protection plan. The wellhead protection Yules autline that the
cities have to do a wellhead protection plan which must be
approved by the state. He did not think the rules would chanqe
that much. There is much data already generated so that they
could start a plan. He has been in contact with some people.

Mr.�Hickok stated it is the�City's intent to move alonq and get

quarter as their target date to have the plan finalized. Staff
is confident with the recommendations and modifications that they
will be able to this. It may be that the wellhead proteation
plan will be far enough along to incorporate and take it all to
the Council at one time.
Ms. McPherson stated she understo�l the water conservation�plan
would be adopted as soon as the EQE provided comments and the
Council approved it. Then staff would wait until the rules are
final to begin wellhead protection. Based on these comments,
there is no reason staff cannot start the data collection and
preliminary inventory. The City probably has the data in this
plan or sewer and water data in the C�mprehensive Plan.
Mr. Sielaff stated_the State of Minnesota also has a consultant
who is doing a study an the well field.
Ms. McPherson stated she was sure they could go back, start
taking a look at it and see how it fits into the workplan.
Mr. Sielaff stated the EQE felt it important to do this but also
address the issues of the well field.
Mr. Hickok stated the MSA study bei.ng done will be very helpful
i.nformation to build into this. Staff will go forward on the
wellhead protection.
Mr. Hickok referred to paqe 39, Emer�`ency �o�ure Update.for
Water Supply. The first paragraph states there are hazards that
could affect the water supply system and, in response to that,.
staff wants to have a plan i.n place. There are recommendations
in the eme�gency response plan. This:section talks about the
groundwater, it makes suggestions about alternative water _
sources, and the possibility for an interconnection such�as staff
have with New Brighton. The City Council has in the past been
interested in doing things that are a joint service cooperative
effort with other communities. This plan states there are �
alternative sources of water available in the event of some
emergency and staff need to tap another resource.
Mr. Sielaff asked if "emergency" is defined anywhere. Also, does
nnatural hazardn include hazards such as hazardous waste entering
the water supply?
Ms. McPherson stated the second sentence of that paragraph
includes human-caused disasters including the release of
� hazardous materials in to the supply or system, structural fires,
major construction or transportation accidents, or vandalism.

Mr. Sielaff asked about the Twin Cities Army Ammunition Plant
(TCAAPj water and if there is a failure i.n their system. What
if, for some reason, some contaminated water got by the filtering
system? The monitoring device could malfunction. Someone could
fail to switch the filters at the proper time. There could be
some.incident t�at•could prevent proper treatment f�om occurring
and staff could end up drinki.ng contaminated water.
Ms. McPherson.stated they could include that as part.�of this.
Another�part of this is to write administrative procedures and
write an ordinance to activate emergency procedures. They can
bri.ng up that very specific point.
Mr. Sielaff stated the alternate sources of water includes TCAAP.
Does this also include rTIRCOP? While these can be considered as
a solution to an emerqency, this can also be a source.
Mr. Hickok stated they can address this. Mr. Flora has been
working with this�and can be contacted about this concern.
� Mr. Sielaff stated the document.says TCAAP water was 2 million
gallons/day. He had heard thexe was anywhere between 3 million
and 4 mi.11ion gallons/day. Is this saying the maximum.is 2 ��",
million qallons/day that staff will take from them? There is a
big difference between 2 million gallons/day and 4 million
gallons/day. He would like to have that clarified.

Mr. Hickok referred to page 40,the Water Supply Shortage Plan.
Mr. Hickok provided copies of a handout listing the
prioritization of what they would do in the event of an --
emergency. The Water Supply Shortage Plan talks about public
education, sprinkiing restriction-ordinances,�and energy -
efficient retrofitting programs that wonld help to reduce the
water demands and help reduce some of the peak demands.

Mr. Hickok stated the next area, Water Emergency Conditions,'
talks about what the City would do to head off some of the
demands.
Ms. Savage disagreed with the item to restrict restaurants frrnn'
serving water to customers. �rinking water is an essential and
restaurants should not be restricted from serving water.

related. He thought contamination also could contribute to a
water shortage.
Mr. Bondow.stated the City may have to shut down a portion of the
system because of contaminants and have a shortage. -
Mr. Hickok stated this would mean that it is not just when the
reservoir is too�low to fight fires. It is also when the quality
of the water is not at safe drinking water standards. So, there
are water quality issues and water emergency conditions that are
very specific.
Mr. Hickok reviewed page 41, Administrative Actions, Emergency
1 Ordinance Provisions, and Utility Operation Program. 'Under
Administrative Actions, the education program should be
structured so it 3.ncludes the water quality and water quantity
issues and how to respond to those in an emergency: The-IItility
Operation Program speaks to the short term performance thinqs�
that would allow the City to conserve water and modify ^
�- operations.
Mr. Kondrick stated the IItility Operation Program lists one
option as purchasinq water from the surroundinq cities. When
this is done, how is the quality monitored to be sure it meets
standards?

Mr. Hickok stated the City has a staff person who deals with
water quality and monitoring. The City regularly monitors the
water system. --
Mr. Rondrick asked if was necessary to test the water daily.
Mr. Hickok stated he was not sure.
Mr. Sielaff stated this would depend on what parameters youeare
looking for. Mr. Rondrick makes a good point. How can staff be
sure staff is getting qood quality water from another source? -
How does staff insure the quality of the water staff is takinq?
Mr. Kondrick stated the average layperson will ask questions
about how often staff tests the water. Are there State
requirements that dictate the frequency?
Mr. Hickok stated there are State requirements. There are
periodic testings as well as annual testing. The City does �
ongoing testing through the course of the month and probably

Ms. McPherson stated they can add an paragraph that speaks to
water quality testi.ng and contamination. They can also add
somethinq on pur system and how TCAAP works. They should also
find out when the Navy site is comi.ng on line and add that.
Otherwise, there will be an addendum later. .
Mr. Saba stated he found it scary that the City is taking water
that has been cleaned. He hoped that everything hazardous had
been removed, but what happens in there is an error or
malfunction of some kind.
Mr. Hickok stated the water quality issue is somethinq that the
City Council has spent much ti.me on.
Mr. Saba stated it appeared that their discussion was more
� concerned about color contaminants rather than the non-visible
contaminants. The Council is respondi.ng to the calls they-get.

Mr. Hickok stated the IItility Operation Program talks about steps
to be taken on a short term basis to reduce the water demand.
Mr. Hickok referred to page 42, Water Supply and Conservation
Plan Implementation. This part of the plan is the�detail of the ��.
implementation. The plan will serve as an amendment to the
Comprehensive Plan including an amendment to the sewer and water
chapter. Mr. Hickok reviewed the operational recommendations

Mr. Hickok referred to paqe 43, and reviewed the minor physical
changes recommended to the City�s water system. --
Mr. Sielaff stated the fourth point, „Development of an'
increasing block method of water charges and/or a summer_water
metering program" should be included as part of the operational
recommendations listed on the previous page.
Mr. Kondrick asked what the Marion Hills booster was.
�Ms. McPherson stated the Marion Hi.11s area is the area behind
Menards and is the highest area in the community. Because the
City has a gravity flow system, the higher elevations have lower
water pressure. By installing a booster station in that area,
the fire trucks don�t have to work as hard to pressurize the
water for fire fightinq purposes.
Mr. Hickok stated this is the policy and implementation aspect of
�"1 the conservation plan. It is an a.mportant plan and contains a �-

Mr. Bondow suggested, to conserve paper, that he send out only
those pages having changes.
Mr. Sielaff asked if staff had considered having large users do
water conservation plans and submit them to the City.
Mr. Hickok stated there was some discussion about conservation
programs for large users. This has worked for energy
conservation. He thought this issue was worth bringing forward.
` Ms. McPherson stated the City has the cheapest water rates in the
seven county metro area. IIntil the Council moves to reverse the
current pricing system and increase the rates to a pai.nt where
the system pays for itself, there is no incentive fo� large users
to conserve water. At that point in time, it will be easier to
convince large users that by implementing these procedures they
can save money.
� Mr. Sielaff stated this makes sense to this economically, but
what about emerqency situations. He can see the need for large
users to do something on an emergency basis. If staff is having
the citizens take steps to conserve, then the large users should
also do something.

The 26' x 44' single fam�y dwelling and 20' x 22' attached garage were constructed in 1960. In 1990, a
20' x 26S' addition was conshucted to the rear of the original garage.
Reguest Analysis
The request is to vacate a 10 foot ut�7ity easement The easement is located wittiin the westerly 10 feet
of the dwelling unit, The easement was originally dedi� in 1957 adjacent to the easterly lot line of
Lot 9, Block 4 of Ostman's 3rd Addition. The easterly 20 feet of Lot 9 was added to adjacent lots in
order to create a bu�dable lot � °� _
In reviewing the suivvey (not a verifying suivey), it is easy to see why the error was made when the
bu�ding permit for the dwelling vvas issued. The words "uli7ity easemen�' are located in the westerly 10
�et of the new lot, however, azrows marking the actual easement azea indicate the easterly 10 feet of
�t 9.
The Engineering Deparlment has no objections to tlie vacation request, however, to maintain the City's
future options, have requested that an easement be dedic�ated wer the westerly 10 feet of the subject
parcel. No public ut�7ities are loc�ated in the easement area. In order to avoid a new encroachment
situation, a verifying survey should be submitted to determine the setback of t}ie dwelling unit from the
westerly lot line.

DESCRIPT'ION OF REQUEST:
The Fridley �iRA requ� that a lot split be approved to allow the sale of property to adjacent
properties. The sale of the properly w�71 "straighten" the alignment of lot lines.
SUMMARY OF ISSUES:
The Fridley �IItA acquired 533 Janesv�le in 1995 through its scattered site acquisition program.
The dwelling on the properly was oonstructed prior to the platting of Riven►iew Heights in 1922.
As a result, the lots were created around the dwelling unit T`wo parcels w�l be created; one
20' x SO', the other LS' x 25'. These two parcels w�71 be sold to the properties to the north of
the subject parcel.
Once split, the subject parcel w�l not meet the minimum 9,OQ0 square feet required for lot area.
The resulting lot area w�l be 8,250 square feet The Planning Commission will need to
acknowledge tbis deficiency as permitted in Section 211.05 of the Fridley City Code if it approves
the lot split request.
RECONIlVIENDED ACTIONS:
Staff m,commends that the Planning Commission recommend approval of the request to the CSty
CouncIl with the following stipulations:
1. The adjacent properiy awners shall oombine the new parcels with their e�sting parcels into
one tax pazcel. �
2. The I3RA shall conduct a public hearing as required by law prior to the sale of the property.
3. The Planning Commission recognizes that the lot area of 533 Janesv�le Street NE is less than

The Fridley HRA acquired the properly in 1995. The dwelling, constructed prior to 1922, and the
detached garage, constructed in 1977, were demolished in August 1995.

This parcel is located northwest of the subject parcel and w�l purchase the 20' x 50' parceL Located on
the parcel is a 24' x 36' dweDing constructed in 1968 and a 20' x 22' detached garage constructed in 1969.
528 Kimball Street
This parcel is located northeast of the subject parcel and w�71 purchase the 15' x ZS' parcel. Located on
the parcel is a 1A' x 44' dwelling construct�ed in 1967. A 20' g 22' detached garage was oonstiucted in
1971 on that same lot A variance was granted in 1971 to reduce the distanc� l�tween the garage and
�'�e living space on 533 Janesv�le from 15 feet to 11 feet
Request Analysts
The intent of the lot split is to realign the northerly lot line of 533 7anesv�le with the remainder of the
platted lots to the east and west The proposed lot w�l meet the 75 foot lot width minimum required
by cvde. The lot is currently 9,625 square feet in area, If approved, the lot split would reduce the lot
area to 8,250 square feet, 750 square feet less than required by code. Section 205.07.03.A.(2) of the
Zoning Code does permit lot areas of 7,5� square feet on subdivisions or plats recorded prior to
December 29, 1955. This lot would exceed that requ'vement In this neighborhood, reduced lot areas
are not uncommon. The City has permitt�ed �nstruction of dwellings on lots as small as 5,500 square
feet (537 Fairmont Street). Sec�ion 211.05 of the Fridley City Code permits the Planning Commission
and City Councl to approve subdivisions with variations from the requirements of the ordinance. The
reasons why they aze necessary shall be noted in the minutes.
The parcels to be created by the lot split w�l need to be combine with the existing parcels of 538 and
528 Kimball Street in order to ensure that they beoome one tax parcel. The HHRA is required by law
to conduct a public hearing prior to the sale of the parcels. This is scheduled for the November HRA
meeting.

Backctround Information
The subject property consists of three (3) platted 25� x 110'
lots, plus a portion of two adjoining lots (the southerly 20� of
Lots 52 and 53 and the southerly 15' of Lot 54) in the Riverview
Heights Addition. The lot currently is 9,625 square feet in
size.
The odd lot configuration is the result of a home which was
located on the site and constructed prior to the original plat in
1922. In recent years the home fell into disrepair, was
foreclosed upon by a bank, became vacant and had deteriorated to
the point where rehabilitation was no longer economically
feasible. In May 1995 the HRA acquired the site from HUD and the
house was demolished in early September 1995.
The plan for the site is to sell the vacant lot to a private
party for construction of a new single family home under the
HRA's Housing Replacement Program. At the request of two
adjoining property owners, the HI2A would like to sell the 20' x
50' piece on Lots 52 and 53 and the 15' x 25' piece of Lot 54.
The HI2A would like to complete the transaction prior to reselling
the subject property this fall.
� Hardship Statement
The Fridley HRA is requesting a lot area variance which would
reduce the current lot size from 9,625 s.f. to 8,250 s.f. The
lot area variance would be necessary for the HRA to sell the site
as a buildable lot.
The proposed conveyance, would return all of.the lot boundaries
(528 and 538 Kimball St. and 533 Janesville St.j to the original
plat lines. Although, it reduces the Janesville St. site
somewhat, it increases the Kimball St. sites and enlarges the
rear yard areas. In addition, it would correct a boundary line
problem, clarify the leqal descriptions, and enhance the
appearance of the area.
If approved, the revised Janesville St. lot would still be
attractive to the private market. In fact, the HRA sold a 75' x
110' vacant lot at 677 Hugo St. in Aug�•st of this year to a
builder who will start construction this fall.
