l. CONSIDERATION OF A VACATION REQUEST, SAV #96-04, BY KELLER
STRUCTURES:
To vacate the drainage and utility easement that lies within
the most northerly 10.00 feet of Lot 1, Block l, Longview lst
Addition, according to the plat thereof on file and of record
in the Office of the County Recorder, Anoka County, Minnesota,
except the most easterly 10.00 feet thereof, generally located
south of 61st Way, east of East River Road, and west of the
Burlington Northern railroad tracks.
Ms. McPherson stated the vacation request is by Keller Structures
who is representing Lakeiand Properties, Inc. of Wisconsin.
Lakeland owns Tri-Star Insulation which is located in Minneapolis.
They have purchased property located at the intersection of East
River Road and 61st Way in the southwest portion of the City. This
property is vacant and is located north of Longview Fiber. They
are currently negotiating for a small office building located
directly at the corner of 61st Way and East River Road. The
company that currently occupies this building is Doradus
Corporation. Lakeland Properties hopes to construct a 22,945
square foot warehouse on the vacant property and connect it through
an on-grade pedestrian connection to the existing office building.
^ Ms. McPherson stated the vacation request is for a 10-foot drainage
and utility easement�located adjacent to the north lot line of the
vacant parcel. The petitioner is proposing to construct the

proposed warehouse 1.5 feet from the north lot line which
encroaches into the easement. The Engineering Department has
reviewed the request. There are no utilities or drainage needs for
this easement. The topography is such that the property slopes
slightly from east to west. There are drainage and utility
easements located along the south and east lot lines of the subject
property. The Engineering Department has requested, in exchange for
vacation of the subject easement, that if the petitioner gains
control of the office property, a 10-foot easement be granted to
the City along the east property line which would continue the 10-
foot utility easement that exists along the east property line of
the vacant parcel.
Ms. McPherson stated, as a side issue, the office building property
is currently zoned CR-1, General Office. Staff has requested that
the petitioner submit a rezoning request for this parcel to M-1,
Light Industrial, which is what the vacant parcel is currently
zoned. This will allow a continuity of zoning between the two
parcels since they are proposed to be physically connected by a
walkway. This will eliminate any potential conflict with the
Uniform Building Code and eliminate the need for a variance to the
setback requirements.
Ms. McPherson stated staff recommends approval of the vacation
request, SAV #96-04, with the following stipulation:
1. The petitioner shall grant a ten foot drainage and utility
easement along the east property line of the office property
(as shown on Exhibit A).
Mr. Kondrick asked the current zoning of the office building.
Ms. McPherson stated the current zoning is CR-1, General Office.
Mr. Kondrick stated staff is suggesting that it would be of benefit
to the petitioner to have that zoning changed. However, that is
not a part of the reguest this evening.
Ms. McPherson stated this was correct. That request would come
before the Planning Commission once staff received that application
from the petitioner.
Mr. Clark stated he works for Tri-Star Insulation Company, which is
currently located in north Minneapolis, and he is representing Mr.
�rnold Schmidt, owner of Lakeland Properties. It is to his benefit
if the company builds a new building. The company is now located
in north Minneapolis and he is not thrilled with the current
location. They are excited about making this change.

Ms. Savage asked if there were any problems with the stipulation.
Mr. Clark stated no. Mr. Schmidt stated there was not problem with
the stipulation. There is a low area behind the Doradus property
right now. They would like to.be able to join the current office
building with the new warehouse rather than build a separate
office. The warehouse will be storage. The company sells pipe
insulation to commercial and industrial contractors. The building
itself will be primarily for storage of the insulation product.
Mr. Kondrick asked if there would be any site preparation necessary
for this construction.
Ms. McPherson stated the site would require the typical grading
necessary to put in the building footings. The site is on good
soil so there is no soil correction needed. They would be required
to meet the grading and drainage requirements of the zoning code.
Mr. Sielaff asked if the rezoning would go up to where the current
building is.
Ms. McPherson stated yes. The rezoning would affect the portion of
^ the property where the existing office building is located.
Mr. Clark stated, if the purchase goes through and they attach the
warehouse, they will redo the outside of the office building to
match the warehouse.
Mr. Sielaff asked what the zoning is on the north side of 61st Way.
Ms. McPherson stated the property is zoned R-3, General Multiple
Family Dwelling, and is currently vacant.
Ms. Modig stated the petitioner is now negotiating for the office
building. If they do that, the petitioner wouid grant the City a
10-foot easement. What happens if they do not acquire the office
building?
Ms. McPherson stated, in that instance, the City would not be able
to acquire that easement because the property would be under
separate ownership.
Ms. Modig asked if the City would have a drainage easement on that
property.
Ms. McPherson stated there are easements for the right-of-way along
the north portion of the site. Doradus does have a stormwater pond
in this area. As far as the site in general, there are easements
� along the east and the south sides of the subject parcel which

should handle any utility needs that are required. The Engineering
Department felt that, because there is a 10-foot easement that does
stop on the north property line of the subject parcel, it would be
appropriate to extend that given the opportunity. She believes
that Lakeland Properties feels very positive they will be able to
acquire that property.
Mr. Kuechle stated, if the petitioner cannot acquire that property,
they will not meet the setback requirements.
Ms. McPherson stated, if they do not acquire the Doradus property,
they would have to go back and re-look at the design of the
proposed warehouse in order to include the required office space
and to meet the setbacks. If Lakeland Properties did not feel
positive about their potential to acquire the parcel, they would
not have gone this far.
Mr. Clark stated there is a lease condition with the company
operating the business in that building. The owner has retired and
has moved. If Lakeland could buy the property, it would help
release them from a lease commitment. It is just a matter of
negotiating this with the owner. Lakeland would like to purchase
the building and have it all be one part. That would be the best
for them. The rezoning is just to be able to attach the existing
building to the warehouse. They currently have a separate office
and warehouse which makes it more difficult to operate a business.
Mr. Kuechle asked if the Commission could add a stipulation that
this recommendation is valid only if the property is acquired.
Ms. McPherson stated the Commission could do that.
MOTION by Mr. Kuechle, seconded by Mr. Kondrick, to recommend
approval of Vacation Request, SAV #96-04, by Keller Structures, to

DESCRIPTION OF REQUEST:
The petitioner requests that a special use permit be issued to allow veterinary clinics which
condu�t vaccinations. The request is for a 783 square foot space within the Pet Food
Warehouse store at 753 - 53'� Avenue N. E. If approved, the petitioner would conduct
wellness clinics which provide affordable preventative medicine for pets. The petitioner
conducted similar clinics ftom 1993 to 1996 at its previous location at 250 Osborne Road N.E.
SUMMARY OF ISSUES
Section 205.15.01.C.(9) o# the Fridley City Code allows with a special use permit animal clinic,
veterinary clinics, animal hospitals, public kennels, obedience schools, and training services
provided the following conditions are met:
A. All windows in the area of the building housing animals shall be double glazed with a fixed
sash. _ �
B. Any ventilation systems shalt be designed so that no odors or organisms will spread
between wards or to the outside air.
I C. There shall be no outside pens or holding areas.
IThe proposed clinic wil! occur eight to twelve hours per week, including one evening and one
weekend day; however, during the Winter, less hours are required.
The clinics will not provide invasive surgery or long-range care for animals. The area
proposed to be used is located in the northwest part of the Pet Food Warehouse facility and
has no exterior windows and one exterior exit door. The petitioner needs to submit
information regarding disposai of inedical waste.
RECOMMENDATION
The request meets all of the zoning code standards set forth in Section 205.15.01.C.(9) of the
Fridley City Code. Staff recommends tha# the Planning Commission recommend approval of
the request to the Ci#y Council with the following stipulations:
� � 1. No vaccination supplies or medical waste shall be stored on the site.
2. Any alterations to the building will require issuance of a building permi#.
3. The veterinarians shall be currently licensed by the State of Minnesota.

REQUEST

SITE DESCRIPTION/HISTORY
The subject property is a single story rnulti-tenant building located on 53'� Avenue. The
building houses Target and Pet Food Warehouse. The previous Pet Food Warehouse
location at 250 Osbome Road was damaged in August of 9 996 by stcong winds.
The subject building was constructed in 1967. Tenants within this space have included
a grocery store (1967 -1982) and a fabric store ('I982). The property also included a
gas station (1967), a model home sales office (1971), and cash facility (1982).
ANALYSIS
In 1993, the City issued special use permit, SP #93-07, to the petitioner to conduct
similar clinics at the Osborne Road Pet Food Warehouse location. At that time, the
petitioner proposed to conduct wellness clinics every weekend for approximately three
to four hours. The petitioner's current reques# increases the amount of tirne for the
wellness clinics to eight to tweJve hours per week, inGuding one week night and one
weekend day per week with less hours provided during the Winter.

The petitioner proposes to use an area 783 square feet in size located at the northwest
comer of the tenan# space which has been designated as a care and training area
This amounts to 4.6°� of the 16,910 square foot tenant space. The wellness clinics do
not provide for invasive surgery or long-term care of animals. The intent of the
standards established in the code is to regulate full service clinics such as to maintain
animals in their facilities on a round-the-clock basis. The peti#ioner does not intend to
provide these types of services.
In the original special use permit request, the petitioner indica#ed that they did not need
an infe�tious waste generators license. The petitioner, however, should submit a
detailed plan indicating fiow medical waste will be handled and stored while at the
clinic site to prevent access by the general public.
The City received no complaints regarding the petitioner's previous operation a# 250
Osborne Road while in operation.
STAFF RECOMMENDATION TO THE PLANNING COMMISSIONI

CITY OF FRIDLEY PROJECT SUMMARY
� DESCRIPTION OF REQUEST:
The petitioner, Geratd Kantor, requests that Lot 16, Revised Auditor's Subdivision No. 103 be
annexed from the City of Coon Rapids into the City of Fridley. If approved, �e property woutd
be combined with property in Fridley also owned by the petitioner. The petitioner has a
potential buyer for the property who wishes to construet a new home.
�SUMMARY OF ISSUES
The proposed annexation will affect a total of five lots. Two properties located in Coon Rapids
(8310 and 8330 Broad Avenue) are currently serviced by the City of Fridley. The remaining
property, also located in Coon Rapids and comprised of two lots, is currently serviced by
septic, well, and fieating oil (8320 Broad Avenue). Those property owners would like to be
connected to utilities. The petitioner will need to extend utilities from Kimball Street. An
easement will need to be dedicated across #he subject property to provide services to the ..:

RECOMMf NDATION
Staff recommends that the Planning Commission recommend approvat of the annexation

1. The annexation request shall include Lots 14, 15, and '16, Revised Auditor's Subdivision
No. 103 and Lots 22 and 23, Blodc 4, Mississippi Oaks.
2. The petitioner shall dedicate a 25 foot utility easement over the westerly portion of Lot 16.
3. The annexation request is contingent upon approval of the Coon Rapids City Council and

REQUEST
Mr. Gerry Kantor owns Lots 15 and 16, Block;0,� Riverview Heights (Fridley) and Lot
16, Revised�Auditor's Subdivision 103 (Coon Rapids)(see�attachment A): � Mr. Kantor
� has requested annexation of Lot 16 to the City of Fridley (see `attachment B�. The City
of Coon Rapids is unable to provide sewer. and water utilities to Lot 16, services would
need to be extended from the intersection of Kimball Street and Riverview Terrace. Mr.
Kantor has a purchaser for these lots. The purchaser would like all lots to be in one
municipality in order to have the most flexibility for construction of a dwelling on the
! lots.
ANNEXATION PROCESS
The Minnesota Municipal Board is established by State Statute to review annexation
requests. Annexations may be initiated by the municipality, the Board, or a property
owner. If both cities are in agreement, each Counci! passes a resolution and a
simultaneous "detachment and annexation" occurs. The resolutions are submitted to
the Board for final action. The City Attorney has indicated that the Board should find
this type of request a routine case for approval (see memo dated November 11).
Annexation may occur without 100°� agreemeni of the affected property owners: '
Based on preliminary conversations with Coon Rapids staff, it is anticipated that Coon
Rapids will agree to a"detachmeni". A number of options have been reviewed with
Coon Rapids staff, and the City is agreeable to a detachment of up to five lots to the

OPTIONS FOR ANNEXATION
The owner has petitioned the City to annex Lot 16, Revised Auditor's Subdiv�sion 103
into the City. There are other lots to consider for annexation since the City of Fridley
provides sewer and water service to adjacent lots. Also included as possible
candidates for annexation are Lots 14, and '15, Revised Auditor's Subdivision 103, and
Lots 22 & 23, Block 4, Mississippi Oaks (see attachment C). There is a spectrum of
options for the Council to consider:
Option A, No Annexation
This option requires the property owner to construet a dwelting on the properties
as currently legally defined and located in their respective municipalities. If a
dwetling was constructed on Lo#s 15 and 16 in Fridley, lot area and setback
variances would be required. Lot 16 in Coon Rapids is buildable without
variances. Sewer and water services and access would be extended in the
Riverview Terrace right of way to the municipal border. An agreement between
the finro cities would need to be executed.as has been done in the past with
adjacent lots (Lots 22 and 23,� Block:4,, Mississippi �aks are. cu�rently� senred by ._
the City of Fridley in this manner): No tax base increase would be received by
the City. :
Option 6, Annexation of Lot 16
This option would annex only Lot 1 fi, as requested by the petitioner (see
attachment D). This would allow the purchaser to have the maximum flexibility
for dwelling construction on the property. The property would be serviced in the
manner described in Option A, minus the agreement. A utility easement would
be retained across Lot 16 in order to provide services to Lots 14 and 15 which
are currently serviced by a private weN and septic system.The City would gain
$220 - 336 in taxes each year (full taxes are $1433-2188).
Option C, Annexation of Five Lots
This option would annex five lots in#o tMe City o# Fridley (see attachment E).
There are several advantages #o this option:
� 1. The City gains additional tax base for lots which it currently services
($916, see attachment F). Taxes to the affected property owners

would be lower in Fridley.
2. The north border of the City will be "straightened", thereby providing a
logical boundary between the two cities.
3. Sewer and water easements will be in place to provide services to the
dwelling on Lots 14 and 95, should the septic system fail.
4. The school district will remain the same.
There is one disadvantage to this option;
1. The dwelling on Lots 14 and 1 S has access to Broad Avenue via a 10
foot private lane between Lots 22 and 23. This access is nonconforming
as the Zoning Code requires a minimum of 25 fieet of access. If this
dwelling were damaged to more than 50°10 of its value, the Council would
have to approve a variance to allow reconstruction of the dwelling, or a
public stree# must be constructed.to provide legal access.
This disadvantage, however, also holds true for the City of Coon Rapids.

Two out of the four property owners have .been informally contacted .about this
option. The ownerof Lots 14 and 95 (septicsystem) is favorable to the
: annexation.
COST OF ANNEXATION
What is the cost of annexation to the City? The cost is minimal, as the City is already
billing the lots serviced in Coon Rapids: The'property owner would be required to pay
for the extension of the street and'services to Lot 16; The owner of Lots 14 and 15
would also participate in the cost of.the utility extensions, as they'benefit from#heir
installation: The City gains $916 in increased tax fiase ($5755 total taxes).
CITY COUNCIL DIRECTION

The City Council discussed the annexation request at ifs November 18, 1996
Conference meeting. The Council directed staff to pursue the annexation of up to five
lots, pending concurrence by the Coon°Rapids City Council and discussions with the
adjacent property owners who may be included in the annexation request.

DISCUSSIONS WITH ADJACENT PROPERTY OWNERS °�'
Staff spoke with the owners of 8340 ar� 8320 Broad Avenue a# length reg�rding the'
annexation request. Mr. Anderson, owner o# 8310 Broad Avenue did not have
concems with becoming a Fridley property owner, but did express concem with the
nonconforming access to 8320 Broad Avenue which has a 10 foot private lane. He did
not want to have any of his property acquired for additional access width to 8320 Broad
Avenue.
Mr. Seidel, owner of 8320 Broad Avenue, indicated that he also did not have any
concerns with becoming a Fridley property owner. He would like to be connected to
sewer, water, and gas services in conjunction with Mr. Kanto�s installation.
Staff was unable to meet wi#h the owner of 8330 Broad Avenue prior to the Planning
Commission meeting. �
