SUMMARY OF PROJECT Friendly Chevrolet is requesting a special use permit to allow the property to be used as storage for new vehicles and employee pazking. SUMMARY OF ANALYSIS Ciry Staff Yecorramends denial of this special use peYmit. The proposed use is not compatible with the residential properties located to the east & west. • This site presents a security risk to vehicles because screening efforts to mitigate this use from adjacent properties run contrary to crime prevention recommendations. Friendly Chevrolet intends to use the property as storage for new vehicles and employee parking. The property, located at 1160 Fireside Drive, is currently vacant and was formerly Tam's Rice Bowl. Location of property HlStO Located mid-way between Highway 65 and Old Central, the building was originally a"road house" constructed in the 1930's. In the 1950's the building's use changed to a restaurant and it has been utilized as such until summer 2000. The neighboring mobile home development was platted in 1959. October 24, 2000, demolition contractors for Friendly Chevrolet were issued a permit for the demolition of the structures on the site. Friendly asked for pernussion to pazk employee cars on the existing asphalt until while the Special Use Permit determination is being made. A grace period until January 15, 2000 was granted to allow Friendly a short-term solution to a pazking problem on their existing site. At that time the asphalt is to be removed and all parking on the site must cease until an official determination has been made regarding the special use permit and �� all associated improvements have been made. View of property from Fireside Drive � � Friendly's Proposal Site Plan The petitioner's proposal seeks approval of a 146 stall parking lot to be setback at least 30' from the existing south curb line on Fireside Drive. On the east and west property boundary the proposed parking lot will be constructed 15'-6" from the property line. The southern 121 feet of the site will be utilized as pond/infiltration area. Two Fireside Drive curb cuts will be utilized to access the site. Lighting Plan Six, 20' High, 400 Watt, Metal Halide light fixtures have been proposed to light the east and west parking area (3 each side). Four, 20' High, 250 Watt, Metal Halide light fixtures will light the interior aisles of the parking lot. A photometric illustration has been provided and shows that the light fixtures have been designed to cut-off the light to less than the Code Maximum 3 foot- candles at the property line. Landscape Plan A landscape plan has been submitted. The plan meets the minimum Code requirement. The petitioner has indicated that they are evaluating the type of privacy that they will install. Part of that evaluation will depend on feedback from the mobile home park owners. They have asked for the neighbor's input and will likely install the fence design favored by those neighbors (included in your packet for your convenience). '�' / �. Analvsis Zoning The property is zoned C-3, General Shopping Center. As such, automobile agencies selling or displaying new and/or used motor vehicles are listed as allowed by special use permit. Friendly Chevrolet has a Special Use Permit for their auto sales operation, north of Fireside Drive. Special Use permits are parcel specific, rather than owner specific. Therefore, a new Special Use Permit is required for this parcel, even though a special use permit has been granted across the street at the petitioner's main facility. It is also important to note that typically, an agency selling and/or displaying automobiles would have a building on the site. In this case the use is being described as ancillary to the larger complex across Fireside Drive and no building is planned. The site's primary use is intended to be for vehicle storage. Further, it is important to note that granting a Special Use Pernut would not only allow Friendly the opportunity to expand their existing use, but it would also allow Friendly or a future land owner to operate a separate auto sales operation from this location. /"'�, City Code defines the purpose of the Special Use Permit provisions in Chapter 205.05.04.A. The - purpose is to provide the Ciry of Fridley with a reasonable degi-ee of discretion in deteYmining the suitability of certain designuted uses upon the general welfare, public health, and safety. In making this determination the City may consider the nature of the land upon which the use is to be located, the nature of the adjoining land or buildings, the effect upon tf-aff c into and f�-om the premises or on any adjoining roads, and all such other factors as the City shall reasonably dee�n a requisite of consideration in determining the effect of such use. For the purpose of recording, the terms Special Use Permit and Conditional Use Pe�mit shall be said to mean one and the same pursuant to M.S.A. Section 462.3595, Subdivision 4. 205.05.04.E(3), states, Special Use Permits nzay be denied by motion of the Council and such nzotion shall constitute that conditions required fo� approval do not ezist. No application for a Special Use Permit which has been denied wholly or in part, shall be resubmitted for a period of six (6) months from the date of said order of denial, except on new g�-ound or new evidence or proof of changes of conditions found to be valid by the Planning Commission. Comprehensive Plan The City's draft Comprehensive Plan awaits final approval at the Metropolitan Council. In the plan, the City indicates: "The mobile home park p�ovides a source for affordable housing and � should be maintained and enhanced where possible. " The Comprehensive Plan is a planning tool intended to help guide future growth and development of the community. It is comprehensive in that it ties together the various elements that make up "the city" including land use, housing, transportation, environment, public facilities, parks and recreation. The Plan is important in that � it identifies a vision, goals and guiding principles for future land use decisions. In the Comprehensive Plan, a statement exists that probably best describes the challenges the city will face as it considers redeveloping sites like the former Tam's Rice Bowl site. The sta.tement says, "Meeting the challenges that lie ahead will require the cooperation of all segments of the community. Neighborhoods, businesspeople and the local government will need to focus on the good of the entire community, rather than the parochial interests of any one geogf-aphic area or segment of the population ". Plain and simple, staff believes that the though the site is in close proximity to Friendly's site, its proximity is its only redeeming value as a car storage site. Caz storage that separates two affordable housing neighborhoods can only be viewed as planning for the pazochial interests of one segment of the population, without a view of the greater good to the community. Friendly Chevrolet is a very strong business, a business that the City can be proud of. It is a business whose growth is undoubtedly a sign of its success. The City is interested in seeing its businesses flourish, but not to the detriment of existing neighborhoods. Planning Review Issues A dichotomy of planning interests became evident (early on) as staff analyzed this proposal. The ^ issue boils down to aesthetics vs. security. Planning would prefer to have the petitioner beautify the site perimeter (beyond the minimum requirements proposed), keep lighting low, and to � minimize the impact of the use. Conversely, crime prevention and security people would prefer to expose cars by opening up view sheds for observation and to have bright lighting for security. The interests collide. If the site were to be improved with the standard screening elements Code requires when a commercial site borders residential properties, the number of crimes to property would undoubtedly rise. Vehicles could be damaged, stripped, or stolen. Though, heavy landscape, the use of berms and plantings, and the use of privacy fence typically help to mitigate impacts to surrounding uses, they would not. The goal would be to minimize the view of the mass of asphalt and cars, minimize glare of light off cazs, minimize direct light impacts, etc. In 1998 Fridley's Crime Prevention Specialist, Rosie Griep mapped that years crimes related to damage to or theft of automobiles. The statistics were clear on the map that the highest occurrences of these incidences were in locations on or near the major thoroughfares and in locations where numbers of vehicles aze left outside and left unattended. From a pure planning perspective, having Friendly's parcels contiguous, rather than sepazated by � Fireside would be preferred. Roads historically have provided land use buffers and allowed for a _ � transition to other uses. Additional affordable residential is one possibility for the re-use of the Tam's site. Another option is a low intensity commercial use, which compliments the nearby residential use and provides a convenience or service to that neighborhood. A third option may be a combination of the low intensity commercial and residential uses. RECOMMENDATIONS Ciry Staff recommends denial of this special use permit. Staff recommends denial of Special Use Permit #00-11, due to the incompatibility of the use with adjacent residential and the inability to adequately screen the use due to crime/safety concerns. Stipulations Staff recommends that if the Planning Commission chooses to recommend approval of the special use pernut, said approval should be subject to the following stipulations: 1. Fencing around site shall resemble the board on board fence submitted with the petitioner's application. 2. The petitioner shall be responsible for litter control on the premises, and litter control is to occur on a daily basis. 3. Parking lot must be lined with a concrete curb. 4. All parking stalls must meet code requirements for size. �` 5. No employee parking allowed along Fireside Drive or the service road. 6. Final drainage, landscaping, and irrigation plans shall be submitted with building permi�- application and shall be approved by staff prior to issuance of any future permits. 7. Petitioner shall execute a storm pond maintenance agreement, requiring petitioner to maintain the storm pond. 8. All lighting shall be "bollard" type to minimize impact to neighboring properties. 9. The petitioner shall comply with all outdoor sales and storage provisions of Chapter 205 of the City Code. 10. The petitioner shall comply with all outdoor storage requirements. 11. The petitioner sha11 install underground irrigation for the landscape areas surrounding the parking area. 12. Petitioner shall prepare and submit to the City a security plan to assure additional oversight of the storage lot and to deter crime to property. 13. All existing asphalt shall be removed by January 15, 2001. 14.
