Ms. Stromberg stated that the petitioners are seeking a special use permit to allow the
construction of an 864 square foot accessory structure in the rear yard of their residence at 506
Rice Creek Terrace. The building will be used for storage and a workshop. Section 205 of the
City Code requires a special use permit to allow accessory buiidings other than the first
accessory building over 240 square feet. It also requires that the total square footage of
accessory structures not exceed 1,400 square feet. The total square footage of the existing
garage and the proposed accessory structure is 1,304 square feet. There is also a 71.5 square
foot enclosed storage area Iocated directly next to the existing garage that must be removed
upon completion of the proposed accessory structure as it does not meet bui(ding code
requirements. The petitioners have asked to keep the enclosed storage area intact until the
proposed structure is constructed to eliminate any outdoor storage issues.

Ms. Stromberg stated that the proposed accessory structure would be accessed off 68`n �
Avenue. The accessory structure meets ali setback requirements. Staff has received
comments from two neighbors expressing concern that the covenant requirements do not allow
detached garages. The covenants expired in 1985. If the covenant had not expired, it would
have been up to the neighbors to bring a lawsuit against the petitioner because the City does
not enforce covenants.
Ms. Stromberg stated staff recommends approval with the following stipulations as second
accessory buildings over 240 square feet are a permitted special use in the R-1 zoning district:
1. The petitioner shall install a Code-required hard surface driveway within 12 months of
issuance of the building permit.
2. The petitioner shall obtain all necessary building permits prior to construction.
3. The structure shall not be used for a home occupation or living area.
4. All vehicles shall be stored on a hard surface as approved by the City.
5. Total square footage of afl accessory structures must not exceed 1,400 square feet.
6. The garage shall be architectura!!y compatible with the existing home and finished with
complementary siding and color scheme.
7. The petitioner shall remove the enclosed storage area along the southwest side of the
garage prior to April 3, 2003, or prior to the final inspection of the proposed accessory
structure, whichever comes first.
Ms. Savage asked if there were any other comments from the ne+ghbors.
Ms. Stromberg stated they heard one comment from a neighbor who wrote to say the proposed •
garage was okay with her.
Mr. Oquist asked if this specia{ use permit was not approved, would the enclosed storage area
along the southwest side of the garage have to be removed?
Ms. Stromberg stated that, yes, it would have to be removed.
Ms. Savage asked if staff had explained to the neighbors that the covenant had expired.
Ms. Stromberg stated that when she first spoke to the neighbor who had the question, she was
not clear whether the covenant had expired. The City Attorney advised her it had expired, so
she left a message for the neighbor to give her a call back. She never received a call back from
the neighbor.
Mr. Saba asked why the garage would be at an odd angle.
Ms. Shannon Wright, petitioner, stated that it was a mistake. It had been approved to go right
along parallel to the easement. They are planning to do a renovation in the yard, and this would
be a good time to put this accessory structure out there because they are going to be doing
major dirt hauling. They are planning to spend around $50,000 outside of the house to update
the property. They talked with six of the nearest neighbors who do not have a problem with the
garage. The neighbor across the street on 68�' Avenue has a detached garage located across
the street from their proposed garage focation. No neighbor has a front door looking out on 68tn
Avenue. The people in back on both sides do not have a problem with the new garage. She
stated they want to make this look property as nice as they can, and they do not have any •
problems with the stipulations. The enclosed storage area along the side of the garage was

� built by her husband and is not attached to the garage. It does not bother her to take it down.
They will remove everything out from the storage area into the new garage and have the
storage structure dismantled then. Siteworks Design will be building the foundation. It should
take about three weeks to build the accessory structure.
Ms. Marlene Knight, 513 Rice Creek Terrace, stated that she has safery concerns and did return
the phone call about the covenant to Ms. Stromberg twice. She then talked to Mr. Bolin. This is
a very short street at about 1/2 block. People race around these corners a!I the time. The
neighbors are looking at a 3+ car garage here and the potential for abuse by future owners is a
concern with extended family having more cars producing more traffic. The neighborhood has
all attached garages and this would not fit in.
Ms. Savage stated that the special use permit request meets the requirements that accessory
buildings cannot exceed 1,400 square feet.
Ms. Knight stated that she understands that and is only bringing up various safety issues and
other things that come along with having such a fairly short street.
Ms. Savage stated she is very familiar with this street as she drives there twice a day. She has
never experienced cars zipping around fast. She F�as lived near there for 15 years.
Ms. Knight stated cars go too fast all the time, go up on people's yards, and everything else.
She has lived there for over 30 years.
� Mr. Lloyd Nietling, 506 Rice Creek Terrace, stated that he jogs the area. Many people's
garages are filled with treasures. He is a pat rack and has lots of treasures. They have no plan
to use this as a garage. The first thing that will go into this structure will probably be the ping
pong table, saw, and other treasures. He does not think that three car garages attached to the
house look very good. There are many houses with two car garages with finro vehic(es sitting
out in the driveway, and he does not think that looks very good. They want to increase the
value of the property and keep the location looking nice.

Ms. Johns asked if Fridley has an ordinance that limits the amount of cars parked in the

Ms. Stromberg stated it does not.
Mr. Saba stated that many people need more storage space for vehicles and other things. He
does not have any problem with this at aIL
Ms. Johns stated that there does not seem to be any problem with this request. If the home
was ever sold, there might be a problem with many cars in the driveway and garage.

Ms. Stromberg stated that the petitioner is requesting a special use permit to allow the
construction of an 840 square foot garage. Section 205 requires a special use permit to aflow
accessory buildings other than the first accessory building over 240 square feet and requires the
total square footage of accessory structures not to exceed 1,400 square feet. The total square
footage of the existing garage and the proposed accessory structure is 1,374 square feet. The
proposed structure would be located 58 feet back from the property line. Staff recommends
approval with the following stipulations as this is a permitted special use in the zoning district:
1. The petitioner shall obtain all necessary building permits prior to construction.
2. The structure shall not be used for a home occupation or living area.
3. All vehicles shafl be stored on a hard surface as approved by the City.
4. Total square footage of all accessory structures must not exceed 1,400 square feet.
5. The garage shall be architecturally compatible with existing home and finished with
complementary siding and color scheme.
Ms. Savage asked if there were any calls from the neighbors.
Ms. Stromberg stated she did not receive any calls. •
Mr. Saba asked if there was a drainage problem with the landscape in back.

� Ms. Stromberg stated this was shown to the City Engineering staff, and they did not have any
drainage concerns.
Mr. Timothy Miller, petitioner, stated tha� he does not have any objections to the stipulations.
Ms. Savage asked if there were any reactions from the neighbors.
Mr. Miller stated that he has not had any reactions from the neighbors.
Mr. Saba asked if there were any problems with drainage or flooding.
Mr. Miller stated he is on the end of a dead end street, and it is all downhill from there. The
water flows away from the property.
Ms. Sue Paenter, 541 Dover Street, stated she is Mr. Miller's neighbor. She wanted to show
support for Mr. Miller's project. She believed it is a good idea.

REQUEST
The petitioner, Barry Seaberg is seeking a special use permit to allow the construction
of a 988 square foot second accessory building at his residence at 6716 Jefferson
Street. The proposed building will be used for recreational vehicle storage and vehicle
parking.
ANALYSIS
The property is zoned R-1, Single Family and is located and f�onts on Jefferson Street.
The dimensions of the lot are 75 ft. by 140 ft. and iYs a rectangular shape. The existing
home was built in 1956 and a single stall garage was constructed in 1961. An addition
was constructed off the rear of the home in 1978.

Accessory structures over 240 square feet are a permitted special use in the R-1 zoning
district. The existing garage is 384 square feet and the proposed accessory structure is
988 square feet. The existing garage, plus the proposed accessory structure are a total
of 1,372 square feet.

The petitioner is asking to construct a 26 ft. by 38 ft. detached garage in the rear yard of
his property. The proposed garage will be setback approximately 25 feet behind the
existing single stall garage and meets all side and rear yard setback requirements. The .
existing garage will stay intact and will act as a carport, which will allow the petitioner to
drive through it, to get to the proposed structure. The petitioner plans to add a garage °
door to the back of the existing garage, which will allow him to drive through it to utilize
the proposed structure.
� The petitioner is also seeking a variance to increase the lot coverage requirement from
25% to 25.8% to allow the construction of the 988 square foot accessory structure in
the rear yard. This request went to the Appeals Commission on April 10, 2002 and
after much discussion the variance was unanimously approved. With the approval of
the variance, the Commission asked to have the Engineering Department take another
look at the possible drainage issues on this lot with the addition of the proposed
structure. Please see the attached letter from Jon Haukaas, Public Works Director.
City staff hasn't received any comments from neighboring property owners.

SUBJECT: Small Lot Runoff From Garage Additions

There has been a lot oF questions recently about stormwater issues as they relate to small
residential lots and the increased impervious area due to house and garage additions. Current
federal, state, watershed and local regulations do not address areas of this size other than through �
maximum lot coverage percentages. In fact, the threshold for even looking at stormwater
concerns for development only recently dropped from 5 acres to 1 acre. Anything less is still not
addressed. Below is an example of what happens on a typical small lot as impervious area is
added.
Typical soils in Fridley are mostly sand with some silty clays or gravel mixed in. These are
considered moderately well draining soils. With the exception of frozen or heavily saturated
conditions, these soils can absorb and infiltrate approximately 0.15 in. to 0.30 in. of rain per hour.
We will use 0.15 in./hr to be conservative.
The majority of rain events each year are less than 0.5 in. of rain in a 24 hour period. We have
several rains of at least 1.0 in. of rain each year and generally only one storm per year that will
exceed 2.0 in. of rain in a 24 hour period. The 2.0 in. 24 hour storm will be used as the typical
worse case scenario. The 2.0 in. �4 hour storm has an average intensiry of 2.0 in. = 24 hours =
0.088 in./hr. This is what would need to be absorbed by an undeveloped lot.
For this example, we will say a typical small lot is 80 feet wide by 100 feet deep for a total oF 8,000
square feet. An older house with single car attached garaae could be 25 feet by 50 feet for 1,250
square feet of building area.

• Assumina we are only concerned with the rear half of the house because the front drains to the
street, we have 4,000 ft= total area with 625 ft= of impervious surface. The rainfall load to the rear
yard is increased by a ratio of the Total Area = Pervious Area or 4,000 fr =(4,000 fr - 62� fr)
= 1.18�, an 18.5% increase over the natural condition. The net rainfall to the rear yard is then
1.1$3 x 0.088 in.lY�r = 0.104 in./hr: well below the 0.1 � in./hr the ground can handle.
A �arage or house addition of ?�0 square feet would put this lot at the 25% maximum lot
coverage (1,2�0 ft= +��0 ft coverage = 8,000 ft2 total = 25%). If this addition is completely in
the rear half of the property, the amount of impervious surface is increased to 1,375 ft4. The
rainfaZl load is increased by the ratio of Total Area = Pervious Area or 4,000 ftY =(4,000 ft4 -
1,37� fr) = 1.5�4, a 59.4% increase over the naturai condition and a 33.9% increase over the
original construction condition. The net rainfall to the rear yard is 1.524 x 0.088 in./hr = 0.134
in./hr; still below the 0.15 in./hr that the ground can handle.
Higher amount storms and higher intensity-short duration storms do occur but it is impractical
to account for all these possibilities. Steep slopes and highly compacted soils also affect the
absorbency of the soil.
In conclusion, for the majority of situations and typicat storm events, staying at (or very near) the
lot coverage requirements in the existing code is sufficient to minimize the impact of stormwater
� runoff for small residential lot siniations.

To Whom it may concern,
The garage will be used for storage of three vehicles, a 18 foot
snowmobile trailer in winter and a boat in place of the trailer in summer.
The single driveway can't be widened for a double garage because it's
only 15 f�et wide with a 5 foot setback. I can't leave any vehicles in
driveway since it would be in the way of next vehicle leaving, so each
needs a parking place in garage. The front yard has a telephone pole on
opposite property line so there is no possibility of parking a boat on the
other side of the house - plus there is only 5 feet of property not
counting easement. A garage connected either to the front or back of
existing garage wouldn't solve any problems of parking since one
vehicle would have to be moved into to street every time some one
wanted to use another vehicle.
The width and length of garage are critical to my parking requirements.
One trailer of either type will fit across back of garage with access from
front of garage for vehicles. I'm either going to remove back wall of
existing garage for a drive through area or take it down if possible to
allow for more driveway space.

Parcel Description and History
The parcel proposed to be replatted is located at the northeast comer of the
intersection of 7�' Street and 615t Avenue. The property contains Commons Park, the
Fridley Middle School, and City water facilities.
The School District originally acquired the property through tax forfeiture and dedication
by resident Carl Sorenson. The School District has owned the parcel since 1955.

In 1957, the first of several agreements outlining joint use and exchange of property •
between the City of Fridley and ISD #14 was drafted. Subsequent to the 1957
agreement, additional agreements were drafted in 1960 and 1972.
The property is predominantly Torrens; however, a few lots within the property are
abstract. As the parcel is predominantly Torrens, a plat is required in order to subdivide
parcels for separate ownership. A number of City and School District facilities are
located on the subject parceL
Analysis
The subject parcel is zoned R-1, Single Family Dwelling (Middle School) and P, Public
(Commons Park). The zoning code is unique in that it does not require minimum lot
area or outline specific setback criteria for school buildings. The subdivision ordinance
does not require minimum lot area for public facilities. The lots on the proposed plat are
defined by the uses located on the property. The following table shows the breakdown
of lot areas and the specific use within the lot. Those lots, which indicate portions (1A,
1 B, etc.), are defined as such in order to accommodate the abstract lots within the
Torrens properties. This will facilitate recording of the plat at Anoka County.
