REQUEST
The petitioner, Van O Lite, is seeking a special use permit to allow the outdoor storage of
containers in the rear yard. The containers will be for housing inventory and staging
product for delivery.

There are alternatives to outdoor storage on this site. The Petitioner applied for a pemut
for a mezzanine, which would be used for storage of materials. However, the Petitioner
chose not to pursue the construcdon of the mezzanine due to the sprinkler requirements
of City Code, Chapter 1306. Though the Petitioner does not favor the altemative of
building a mezzanine, it is the best alternative for storage on the site according to staff s
analysis.
The C-2, General Business zoning along University Avenue, comes from a time when
commercial use along the main corridors had direct access to University. Once direct
access was terminated, a frontage road system was required. This left shallow lots for
conunercial development. Developers of these shallow lots must consider the site �
dimensions and build accordingly. If this consideration is not taken into account, the City _
may be left with undesirable image issues. Outdoor storage of containers would be one
such issue. The containers are highly visible from 60`� Avenue and the residential
neighborhood to the east. The storage of the containers will potentially diminish the .
normal enjoyment of the properties surrounding the site.
Finally, fire roadway standazds require access with a minimum of a 20-foot width of
unobstructed clearance (Article 10, Section 10.204a). Because this site is already
maximized, further reduction of the aisle space would potentially harm firefighters'
ability to maneuver on the site. _
City staffhas received comments from neighboring property owners. Donna Ruch,
whom resides directly behind Van O Lite, does not want to see any outside storage.

I personally understand that the city planners receive many challenges and are often
under verbal attack while attempting to maintain proper land use. Verbal attacks and
demands are not our approach. We recognize your authority in this City.
Our goal at Van O Lite is to work with you in achieving property that reflects the
professional standard that y�u are st*iving far.
Please understand that �ve are making contintial steps to comply with code in all areas.
�Ve now have on staff a part time maintenance employee who has been assigned the task
of becoming familiar �vith all city cc�de. He will be responsible in maintaining both of
our facilities and insuring compliance in all areas.
To date, we have repainted over the rivo way traffic arrows, scheduled a replacement of
the pine that has died, repaired all damaged and aged fencing at,6041 and enclosed empty
�allets rhat �vere "outside stored" at 6041. We also paid for the redone sidewalk without
qttestion even though our contractor should have covered this in the original building
pro�•am. . .
In :cgards te a�:r containers behind the 5945 beilding, we ind:,ed did call and were told
that it was not forbidden to have them. What we were not told was that a special use
permit would be required. In no way, did we kno�vingly act.in a.way that was against
city policy or code. In addition, we had the containers treated and painted to hide their
presence and to minimize their "intrusion" in the neighborhood. Our attorney, Bob
Fulgency, �vill be representing us in our appeal process and expla.ining our unique
(special) circumstances that led up to the eventual necessity af the containers. This is not
a hostile approach on our part. �Ve aze simply appealing the issue and will comply with
any results from the process. .

Per Minnesota Statute 15.99, local govemment units are required to notify land use
applicants within 10 days if their applications are complete. We received an application
for a Special Use Permit on August 16, 2002. This letter serves to inform you that your
application is complete.
Per your written request, the 60 Day Rule is being extended to accommodate your
^ schedule. As a result, the Council must now take final action on your request by
December 12, 2002.
A public hearing on this item will take place at the City of Fridley Planning Commission
meeting on October 2, 2002 at 7:30 PM in the City Council Chambers.
Your item is also scheduled for hearings at the City Council Meeting on October 28,
2002 at 7:30 PM in the City Council Chambers at 6431 University Avenue.

I am responding to two notices that I received:
1. Van-O-Lite - I live right behind this business and I do not want to see
any outside storage. It is bad enough I have to look at that ugly building.
I am trying to sell my home and I do not need anything more to be a
deterrent.

2. Brandes Place - Absolutely not...........this is going to lower the
value of homes in our neighborhood and again I am trying to sell my place.
I would certainly hope that Fridley is not going to end up like the Brooklyn
Park area.
