1. PUBLIC HEARING:
Consideration of a Zoning Text Amendment, ZTA #04-01, by the City of Fridley, for
an ordinance to remove the requirement for a special use permit for single family
property owners, who choose to have a second accessory building (garage, shed,
etc.), over 240 square feet. Currently, a special use permit must be obtained prior to
construction. This amendment would allow these structures as a single family
structure's accessory use, subject to conditions imbedded within the proposed
amended ordinance language. The attached conditions would relate to size, location,
and architectural compatibility with the principal structure.

SUBJECT: Zoning Text Amendment Request, ZTA #04-01, Removal of Special
Use Provision for 2"d Accessory Structures

INTRODUCTION
As you are aware, City Code currently requires a resident to obtain a special use permit
(SUP) prior to constructing a second garage on their property. The Planning
�, Commission and Council have approved all 26 SUP's submitted over the past 5 years.
These SUP's were all approved with a fairly standard set of stipulations to ensure
compatibility with the existing home and surrounding environment.
The City's recently completed fee study indicates that the City's cost to bring an
application through the SUP process is approximately $1,400. Setting SUP fees high
enough to cover the City's cost, for what has become a routine approval, would deter
residents from building the structures needed to store vehicles and other homeowner
goods indoors.
STAFF RECOMMENDATION
Staff recommends that the City modify the Code requirements in the R-1 district thereby
allowing second accessory buildings without a special use permit. Instead of a SUP,
staff believes the same objectives could be accomplished by building the standard
stipulations of a second accessory building SUP into the performance standards of the
R-1 Chapter of the Zoning Code. These same standards will apply to single-family
properties located in R-2 and R-3 zoning districts.
This change will accomplish several things including taking the cost of administering
these SUP's off the backs of the general public, and it will simplify the process for
homeowners who may be trying to accomplish one of our other objectives, which is
eliminating inappropriate outdoor storage.

SECTION 205.07. R 1 ONE-FANIILY DWELLING DISTRICT REGULATIONS
1. USES PERNIITTED
A. Principal Uses.
The following aze principal uses in R-1 Districts:
(1) One-family dwellings.
(2) Single family attached development as per conditions under Section 205.11 of this
Code.
B. Accessory Uses.

(1) (-a� A private gazage is the first accessory building. It shall not exceed 100% of the
first floor area of the dwelling unit or a maximum of 1,000 square feet.
(2) An additional garage or accessory building over 120 square feet provided the
following criteria are met:
a. The combined total floor area of all accessory buildings shall not exceed 1,400
square feet.
b. The maximum height for a11 accessory buildings shall not exceed. fourteen
(14) feet above grade at the rnidspan of roof.
c. Accessory building shall not be used for a home occupation or as living area.
d. Accessory stYUCture shall be architecturally compatible with ezisting home by
matching siding, coloY schemes, roofing �nnaterials, roof type and roof pitch.
e. All drive and parking areas to be hard suff'aced.

(3) (�} Privately owned recreational facilities which are for the enjoyment and
convenience of the residents of the principal use and their guests. ^
(4) �} Home occupations.
(S) � The rental of guest rooms to not more than two (2) persons per dwelling unit.
� (6) f e} Solar energy devices as an integral part of the principal structure.
C. Uses Permitted With a Special Use Permit
The following are uses permitted with a Special Use Permit in R-1 Districts:

(1) �} Churches.
(a) Building and site requirements and performance standards sha.11 be equal to or
greater than those outlined in the following, CR-1 sections of the Code; 205.16.3,
205.16.4, 205.16.6 and 205.16.7.
(b) A parking requirement of at least one (1) off-street pazking space shall be
provided for every three (3) fixed seats or for every five (5) feet of pew length in
the main assembly hall. Additional pazking may be required for ad.ditional church
activities, such as day caze, classroom and recreational activities. (Ref. 888)
(2) {�} Private Schools.
(3) (4} Day Care Centers provided they are to be located in places of worslup, schools or
�"'\ in other buildings located on an arterial or collector street. (Ref. 1121)
(a) At least one (1) off-street parking space shall be provided for each 100 square feet
of useable day caze floor area.
(b) Reduction of parking spaces may be allowed when provision of space required for
parking stalls, due to the particular nature of the proposed use or other
considerations, would be an unnecessary hardship. Adequa.te open space shall be
provided to satisfy the total number of required parking spa.ces.
(c) When the provisions for required parking space is inadequa.te, the City may
require additional off-street parking be provided. (Ref. 864)
(d) The minimum lot size is 12,000 square feet. (Ref. 1121)
(4) f3} Private nonprofit golf courses, country clubs, yacht clubs, tennis courts,
swimming pools and additional recreational uses, not an accessory use to the
principal uses.
(S) �} Utility companies having transformers, pumping sta.tions and sub-stations subject
to the following m;nimum requirements:
(a) There must be conformity with the surrounding neighborhood with respect to
setbacks, open spaces and architectural design.
(b) It must be screened.
