SUBdECT: ZTA #OS-01 Temporary Outside Storage M-OS-91
Background
Some commercial businesses over the years have reported a need for temporary storage of seasonal
merchandise. In these cases, it has not been financially prudent for the business owner to make a.n
addition to their building for space that they need for only a few months during the year. Their solurion is
to rent a portable storage container and place it on their property for the time they need it. Current zoning
code regulations do not permit such containers in a commercial district — even by special use permit.
�"� The majority of respondents to the last CounciUCommission survey indicated that they would be
interested in approving a code amendment that would permit temporary stora.ge containers in commercial
districts. Therefore, staff has developed the atta.ched code language for the C-2, General Business, and C-
3, General Shopping, sections of the Zoning Code. The C-1, Local Business District, ha.s purposely been
omitted from consideration for this amendment due to the district's minimum lot size. C-1 sites aze
generally too small to accommodate and allow for screeni.ng of storage containers.
The proposed language would allow a system of applying for a temporary permit for a maximum duration
of 90 days. The permit fee would be the same as what we charge now for a temporary outdoor sales
permit -$75 with a$300 refundable deposi� Several parameters would need to be met by the applicant to
protect public safety and provide adequate screening. In order for staff to determine if the business could
meet these requirements, the applicant would need to submit a drawing showing how they could meet all
of the code requirements with their completed pernut application.
Recommendation
Staff recommends approval of the attached zoning text amendment following a pubic hearing to be held
by the Planning Commission on September 7, 2005. This item is then tentatively scheduled to be heard by
the City Council on September 26, 2005.

Fridley City Code Chapter 205 (Zoning)
Section 205.14.7.G.(2)
(a) The property owner shall obta.in a Temporary Outdoor Display License from the
City at least one week prior to starting the event. The properiy owner shall submit �
the information required on the license application. The city shall approve the
license prior to commencement of the event.
(b) A Temporary Outdoor Display License is required whether mercha.ndise is sold
for profit or given away as part of a promotion.
(c) Only items associated with the principal use may be displayed.
(d) Three events per year are permitted, and shall occur no closer than 20 days apart.
(e) Six events per year are permitted for multi-tenant developments, and shall occur
no closer than 20 days apart.
(� The duration of each event shall be no longer than 10 consecutive days.
(g) The merchandise shall be displayed in a manner that does not 'vnpede vehicular
traffic or otherwise cause unsafe traffic conditions.
(h) The merchandise sha.11 not be displayed in the boulevard or on any landscaped
area.
(i) If a tent is to be used, the property owner shall obtain a building pernut and �
comply with the requirements of the Uniform Building Code related to tents.
Fees for tents shall be as established by the Uniform Building Code.
(j) , The property owner shall pay the fee as established n Chapter 11 of the City
Code.
(k) Signage for temporary promotions must meet the temporary sign definition with
the exceprion that they may e displayed only during the ten-day event (214).

SUBJECT• ZTA #OS-02 Parking Stall Requirements in Commercial Districts M-OS-92 _
Background
The City has recently received two parking requirement variance applications in C-3, General Shopping,
redevelopment cases. The vaziances were granted and have triggered an interest in revisiting Fridley's
commercial parking requirements.
Atta.ched is an analysis of what other cities in the Twin Cities area require for commercial pazking spaces.
The comparison is not perfect as different cities have different zoning category definitions, but staff did
�"``, their best to make a fair comparison.
Currently, Fridley's zoning code requires one parking sta11 for every 150 square feet of building floor area
in our C-1, C-2, and C-3 commercial districts. The atta.ched spreadsheet shows that the norm is more like
one stall for every 250 squaze feet of building floor area. This equates to five stalls per 1,000 square feet.
Target representatives had indicated that their most recent parking studies have shown that they need
about 3.8 parking sta.11s per 1,000 on their busiest day. Therefore, staff is proposing changing the
language in Fridley's Zoning Code to require one stall for every 250 square feet, which equals four stalls
per 1,000 — still slightly over what Target says they need on their busiest day.
Changing the base parking requirement results in the base parking sta11 ratio being the same or less in the
Zoning Code other than exceptions - like office use or speculative parking. Therefore, staff is
recommending eliminating those exceptions from the code.
As noted in recent staff reports on parking variance requests, reducing the amount of unnecessary
impervious surface area in the City would not only be more visually appealing, but it would also help
reduce surface water runoff and the heat island effect of large paved areas.
Recommendation
Staff recommends approval of the attached zoning text amendment for revised commercial parking ratios,
following a pubic hearing to be held by the Planning Commission on September 7, 2005. We feel making
tlus code change will reduce the number of commercial parking variance requests in the future and
provide environmental benefits to the community. This item is then tentatively scheduled to be heard by
� the City Council on September 26, 2005.

(3) Convenience stores, grocery stores and services, including laundry, dry cleaning,

shops related to retail service and catering to neighborhood patronage.
(4) Reta.il services, including jewelry, hardware, sporti.ng goods, records and music,
variety and notions, drug, appliance and clothing shops and flower shvps.
(5) Professional office facilities including real esta.te, lawyer, architectural, engineering,

Section 205.14.S.D.(3)(d)((1))
(-�} ,� For nursing homes and homes for the elderly, parking shall be provided at the �
%llowing rates:
((1)) Nursing Homes: One space for every four (4) beds and three (3) spaces for
every four (4) employees on the largest shift.
((2)) Independent Living Facilities: One space per dwelling unit, with 50% of the
stalls enclosed. If the building is convertible to market rate, the number of
stalls provided shall be as in Section 205.09.OS.C.(1).
((3)) Assisted Living Facilities: One-half (1/2) space per unit.

feet of building floor area. for furniture sales use.
(2) Accessible parking spaces will be provided in accordance with Minnesota Rules,

D. Design Requirements.
(1) Drainage:
All driveways and parking areas, except those for less than four (4) vehicles, shall be
graded according to a dra.inage plan which has been approved by the City.
(2) Lighting:
Any lighting used to illuminate an off-street parking area shall be shaded or diffused
to reflect the light away from the adjoining property and tra�c.
(3) Curbing:
The entire perimeter of all parking areas in excess of four (4) stalls, access driveways,
truck loading spaces or other hard surface areas that handle motor vehicle traffic shall
be curbed with a poured six (6) inch high concrete curb and gutter.
(a) Curbing shall be required around safety islands.
(b) Curb cuts and ramps for the handicapped shall be installed as required by State
law.
(c) Construction shall be in accordance with curbing specifications on file at the City.
(d) The City may exempt curbing:
((1)) Where the parking lot directly abuts a sidewalk which is sufficiently
higher than the grade of the parking lot and satisfies the curbing
requirements.

� SECTION 205.15. C-3 GENERAL SHOPPING CENTER DISTRICT REGULATIONS
1. USES PERNIITTED
A. Principal Uses.
The following aze pri.ncipal uses in C-3 Districts:
(1) Commercial laundry and dry cleaning esta.blishments.
(2) All uses allowed under C-1 Principal Uses and C-2 Principal Uses of this Chapter,
provided they meet the following conditions:
(a) All uses are located within a shopping center building or a cluster of three (3) or
more uses using common or shared pazkin.g facilities, or
(b) The use facilities require a minimum of 100 parking spaces.
(c) Sexually oriented businesses as defined and regulated in Cha.pter 127 of the
Fridley City Code. (Ref. 966).
(3) Pawn shops, pawn brokers as regulated by Chapter 31 of the Fridley City Code, and
^ secondhand goods dealers as defined in Minnesota. State Statute 471.925. (Ord.
1104)
B. Accessory Uses.
The following aze accessory uses in C-3 Districts:
(1) Signs.
(2) Off-street parking facilities.
(3) Off-street loading facilities.
(4) Storage of inerchandise, solely intended to be retailed by the principal uses.
(5) Solar energy devices as an integral part of the principal structure.
(6) Weekly sea.sonal outdoor food sales occurring less than three consecutive weeks
subject to the following standards: (Ref. 1032)
(a) Sale area shall not exceed 200 square feet of area.
^ (b) Sale area shall be located within 20 feet of the major entrance of the principal
building.

A. Height.
Building height shall be a maximum of six (6) stories not exceeding sixty-five (65) feet
provided that no building shall be erected to a height exceeding for-ty-five (45) feet that is
within fifty (50) feet of any R-1 or R-2 residential district unless one (1) additional foot
of setback can be provided for each one (1) foot of building height or portion thereof
exceeding forty-five (45) feet.
B. Exterior Materials.
The type of building ma.terials used on exterior walls shall be face brick, natural stone,
specifically designed precast concrete, factory fabricated a.nd finished metal frame
paneling, glass or other ma.terials approved by the City.

agrees to enter into a written agreement, in recordable form, with the City, in

will be. Upon this happening, the parking ratio for the buildi.ng will be determined
on a promote basis by the parking ratio per the number of square feet for each
type of use which the owner represents will be located in the building. After
execution of this -agreement, any changes to the specified uses will require a
special use permit from the City.
( fl At last one (1) off-street parking space shall be provided for each 400 square feet
of building floor axea for furniture sales use.
(2) Accessible pazking spaces will be provided in accordance with Minnesota. Rules,

Any lighting used to illuminate an off-street parking area shall be shaded or diffused
to reflect the light away from the adjoining property and traffic.
(3) Curbing:
The entire perimeter of all parki.ng areas in excess of four (4) stalls, access driveways,
truck loading spaces or other hard surface azeas that handle motor vehicle traffic shall
be curbed with a poured six (6) inch high concrete curb and gutter.
(a) Curbing shall be required around safety islands.
(b) Curb cuts and ramps for the handicapped shall be installed as required by Sta.te
law.
(c) Construction shall be in accordance with curbing specifications on file at the City.
