Stacy Stromberg, City Planner, the petitioner is seeking a special use permit to allow for
a repair garage within the existing building (service use) for the motorcycles and
recreational vehicles that aze sold as part of the Hitching Post Motorsports business
which is located at 7651 Hwy 65 NE.
Ms. Stromberg, stated the subject property is zoned C-3, General Business, and is
located on the Highway 65 Service Drive, south of Osborne Road. The existing building
was constructed in 1998 as a restaura.nt with indoor volleyball courts. The property
remained as a resta.urant with volleyball courts until 2005 when the Hitching Post
purchased the property. Recently City staff discovered there were several recreational
vehicles being stored in a fenced in area north of the existing building. After discussions
with the petitioner, it was determined this azea is primarily used for customers to drop off
their recreational vehicles while they were waiting to be serviced. Once the vehicles are
serviced, then the customers typically picks them up. The petitioner has also articulated
that this area is used to store seasonal Jet Ski's that the Hitching Post has winterized for
their customers.
Ms. Stromberg stated the City Code allow repair gazages as a permitted special use in
the C-3, General Shopping zoning district. Repair garages are defined as a place where
major repair of motor vehicles is conducted, including engine rebuilding or
reconditioning. Though this business does not repair motor vehicles, it repairs
recreational vehicles which aze similar enough to a11ow the use through a special use
permit.
Ms. Stromberg stated as a result of this special use permit request, staff took a field trip
to analyze what other communities require for similar type uses. Though Fridley has a
few small businesses that sell recreational vehicles, there is not one that is that close of a
comparison. Tousley Motorsports in Gem Lake would be considered a close comparison
as it is a similaz type business in that it has a service/repair/storage business that is
associated with their retail sales of recreational vehicles. In order to mitigate any
negative impacts that may occur as a result of the storage azea on the particulaz site, staff
is recommending that the petitioner screen the azea in a similar fashion as Tousley
Motorsports has at their location in Gem Lake. Ms. Stromberg showed a picture of the
screened-in azea at Tousley Motorsports. There is a screened fence that already exists on
the subject property with a gate which will be required to be screened so the vehicles
cannot be seen from the public right-of-way.
Ms. Stromberg stated the Hitching Post does have enough parking to meets its required
pazking located to the west of the subject building. Due to the fact that this pazking is not
going to be used for storage, it is not hindering the ability for customers to park outside of
the building..
Ms. Stromberg stated the commercial zoning code requires that all materials and
commercial equipment stored outside is screened so as to not be viewed from the public
right-of-way or neighboring properties of different zonings. By requiring the Hitching
Post to screen their outdoor service area, they will be meeting City Code requirements.
Similar examples of Fridley properties that received special use permit approvals for a
use that allowed them to have an outdoor use or storage area are Chopper City Sports
located just south of this property, Wal-Mart, and Menazds. In the cases of Wa1-Mart and
Menazds, those businesses were required to build screening walls that were
architecturally compatible with their existing buildings to ensure proper screening.
Ms. Stromberg stated staff recommends approval of the special use permit request with
stipulations as repair garages are a permitted special use in the C-3 zoning district. Staff
recommends that if the special use permit is granted, the following stipulations be
attached:

1. Fenced-in area shall be screened in order to comply with code
requirements by December 31, 2008. Gate shall also be screened and
remain closed, except when being used for access to the yazd, to ensure
proper screening.
2. Site shall remain free of debris, vehicle parts, and junk (inoperable) motor
vehicles, motorcycles and recreational vehicles.
3. Items in the outdoor storage area shall not exceed the height of the fence.
4. Refuse container shall be screened and located in the side or reaz yard.
5. Fence material sha11 be reviewed and approved by City staff prior to
installation.
Chairperson Savage asked the petitioner if he had any problem with the stipulations
including the screening which has to be obviously more than a chain link fence and not
visible to the outside?
Joe Papa, General Manager of Hitching Post, stated he know he needs to do it. His only
question is what sides of the storage area would need to be screened? They have owned
the property for two yeazs.
Ms. Stromberg replied tlle west side and the north side of the storage area would be
required to be screened.
Mr. Papa stated but it was not like that in the past.
Ms. Stromberg replied, correct, however it was not used as a storage azea by the
previous owner.
Chairperson Savage asked Mr. Papa whether he understands that the screening
requirement is part of the Fridley Code7 She asked whether he had any idea what kind of
material will be compatible with the building?
Mr. Papa replied he assumes it would be a vinyl.
Commissioner Kondrick asked regazding the petitioner was planning to refabricating
the chain link fence to shield the view from the public right-of-way or would they be
constructing a solid wa11 that would be similaz to the existing building?
Ms. Stromberg replied, the City is telling the petitioner that they have to build a
mansory wa11 that is compatible with the existing building like they did in the cases of
Menazds and Wal-Mart. However, the , petitioner will have to decide if they' d like to
install slats within the existing fence or slats with some type of landscaping around the
front. In the example from Tousely Motor Sports, they have a chain link fence and it has
vinyl fencing over that. It is up to the petitioner as to what he would like to see and what
he would like to do. The last stipulation, however; is that staff would approve it before
installation.
Commissioner Oquist stated he read about a repair gazage. Are they going to build a
gazage?
Mr. Papa replied, no, they do the repairs inside the building itself. It holds a service bay.
Ms. Stromberg stated the Code specifically states that repair garages aze allowed in this
district with a special use permit. This category best describes the use proposed. So
basically it is just a service use within the existing building, which is categorized as a
repair garage due to the language in the City code.
Chairperson Savage asked whether there have been any complaints from the public?
Ms. Stromberg replied, no.

REQUEST
The petitioner, Michael Jackson, of Franklin Builders Inc., is seeking a special use permit to
allow limited outdoor storage of construction materials and equipment and vehicles within a
fenced in area in the rear yard of the property at 7865-69 Beech Street. The enclosed storage
area is approximately 24 ft. by 61 ft.
HISTORY AND ANALYSIS
The subject property is zoned S-3, Heavy Industrial,
Onaway Addition as are all surrounding properties. It is
located on Beech Street, south of 79th Avenue. The
existing building was constructed in 1969 and an entry was
added in 1989. In 1998, the City created a new zoning
district for industrial lots below one and one half acres in
size, with special attention to the Onaway Addition. The
creation of this zoning district allowed lots in the Onaway
Addition to become in-compliance with the code as it
recognized the small lot sizes. In 2004, the property was
granted three variances. Two of them were to recognize
existing non-conforming setbacks on the north and west
sides. The third variance was granted to allow an addition
to the south side of the building. That addition was never
constructed and as a r.esult that portion of the variance is
null and void.

In June 2006, staff notified the owners of the subject ,
property that there were code violations on their property, which is used for the Franklin
Builders business on the south end of the building and leased to an auto body business on the
north end of the building. The outside storage violations came to staff s attention when the auto
body business failed to apply for their annual license and the City Clerk asked that Planning
staff investigate. An auto body business of a different name then later applied for an annual
auto body repair license. Because of outside storage violations, Planning staff was reluctant to
approve the annual permit. Under advisement from our City Attorney, staff did eventually
approve the license and we continued to send letters to the property owner and the auto body
business owner that code violations at the property needed to be resolved. Staff had called and
written several letters trying to get the violations resolved. About one year ago, the property
owners were asked one more time to meet with staff to discuss the violations at the site. Staff
was able to meet with Michael Jackson, one of the owners, to explain that the property owner
needed to apply for a special use permit if they were going to continue to have outside storage
at this facility. When no special use permit was received several months later, staff issued
citations to all of the owners of the property.
The owners of the property and the owner of the auto body business have not had a clear
understanding throughout this process about how the auto body business can be compliant with
City codes. The auto body business only has room to store two vehicles inside the building at
night. Staff has tried to communicate the code requirements that state the business cannot use
on-street parking for the storage and delivery of customer vehicles. Staff has also tried to
communicate that the business cannot store any vehicles outside the front of the building
overnight, yet unlicensed and inoperable vehicles are often stored outside overnight.
When this code enforcement case began, the rear yard of the property along the alley was
fenced in with a chain link fence without screening. Sometime between May and November
2007, the owner has added slats to the chain link fence, but no special use permit allowing
outside storage was obtained.
The arraignment for this court case occuRed Nov. 26, 2007. A pre-trial date occurred on
December 11, 2007. The pre-trial date was postponed to February 29, 2008 to allow Mr.
Jackson time to eviat the auto body repair tenant. At pre-trial, Mr. Jackson indicated that he
instead planned to apply for a special use pemait for outside storage. A trial date is set for May
5, but staff will likely advise our attorney to request a postponement of the trial until later to
allow time for the special use permit application process to unfold.
As a result of the court action, the petitioner
has applied for a special use permit to allow
limited outdoor storage on the site. City
Code allows limited outdoor storage in the S-
3, Heavy Industrial Onaway zoning district
that is up to 50% of the building footprint
with a special use permit. The buildings
square footage is 4,503 square feet, so City
code would allovir up to 2,251 sq. ft. of
outdoor storage on this site. A 24 ft. by 61
ft. (1,464 sq. ft.) fenced in area already
exists in the rear of the lot that is screened
from the public right-of-way. This area is
where the petitioner currently has the
outdoor storage of construction materials
and equipment. There is also vehicle
storage in this area for the business the
petitioner leases space to.
Before the special use permit can be issued
there are additional requirements that need
to be met. Those specific requirements
relate to height, screening, parking, and the
types of materials allowed to be stored �
outside. City code requires the existing
businesses to have 9 parking stalls based on the breakdown of uses within the building. City
code also states that each parcel shall provide enough off-street parking for the businesses
located on site. The petitioner has submitted a survey of the property; however the location of
parking stalls and the amount of parking stalls on the site hasn't been identified. As a result,
City staff will stipulate that a site plan identifying code complaint parking stalls be submitted and
approved within 30 days of issuance of this special use permit. While the businesses located in
the building may not need a lot of parking stalls for employees, it is apparent to staff that
several stalls need to be designated as customer parking for the auto body business. If code
compliant stalls can't be acquired along the west and south sides of the property, the petitioner
will have to reduce the size of the outdoor storage area in the rear of the lot to make room for
additional parking stalls.
The proposed site plan will be in compliance with all other code requirements for outdoor
storage.
City staff hasn't heard from any neighboring property owners.
RECOMMENDATIONS
City Staff recommends approval of this special use permit, with stipulafions.
Limited outdoor storage is a permitted special use in the S-3, Heavy Industrial Onaway Addition
zoning district, provided specific code requirements are met, subject to stipulations.
STIPULATIONS
Staff recommends that if the special use permit is granted, the following stipulations be
attached.
1. The petitioner shall submit a site plan to City staff within 30 days of issuance of this
special use permit identifying the location of 9 code complaint parking stalls.
2. Nine code complaint parking stalls shall be striped within 60 days of issuance oft this
special use permit.
3. No outdoor storage other than the existing enclosed area in the rear yard shall exist on
the site without an additional special use permit being approved.
4. The petitioner shall receive approval from the Fire Marshal for the types of materials
stored outside within 30 days of issuance of this special use permit.
S. No junk (inoperable or unlicensed) vehicles shall be stored on site.
6. All vehicles shall be parked in designated parking stalls.

We purchase the building at 7865-69 Beech Street in 1983 and ha.ve
been in operation since then at the site.
We had a storage trailer on site and it served the purpose well, until the
City changed their code and asked us to remove it. We complied. We
installed a fence in the rear for storage, as we have ha.d burglary problems
without the fence. This was done with the city's approval.
The code evidently was changed agai.n, so we had. to add slats to the
fence. We again complied We rent 7869 Beech St. to SA Enterprise and
