RES 1959-47 - 00013027RESOLUTION NO. 47 - 1959 A RESOLUTION ORDERING IMPROVEMENTS, APPROVAL OF PLANS, AND ORDERING ADVERTISING FOR BIDS. WHEREAS, the resolution of the City Council adopted the 28th day of May, 1959, set the date for hearing on the ' proposed improvements, as specifically noted in the notice of hearing attached hereto for reference as Exhibit "A ", and WHEREAS, all the property owners whose property is liable to be assessed with the making of these improvements (as noted in said notice) were given ten (10) days published notice of the council hearing through two (2) weekly publica- tions of the required notice, and the hearing was held and the property owners heard thereon at the hearing, as noted in said notice. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley, Anoka County, Minnesota, as follows: 1. That the following improvements proposed by council resolution are hereby ordered to be effected and completed as soon as reasonably possible, to wit: a. All of the improvements as noted in the notice of hearing on the same as are noted (in Exhibit "B ") in said notice, except items 3,4,10,11, 120 16, 170 180 19, 20, 210 22, 23, 24, 26, 28, 29; except the north one/half (N;I) of item 2; except 5th Street from 58th Avenue to 59th Avenue under item 5; except 58th Avenue from 6th Street to 7th Street under item 7. That the work involved in said improvements as listed above shall be consolidated as one improve- ment and shall hereafter be designated as Street Improvement Project 1959 - 1. 2. The plans and specifications prepared by the Director of Public Works for such improvements and each of them, pursuant to the Council resolu- tions heretofore adopted, a copy of which plans and specifications are hereto attached and made a part hereof, are hereby approved and shall be filed with the City Clerk. 3. The work to be performed under Project 1959 - 1 ` shall be performed under one contract. The City Manager shall accordingly prepare and cause to be inserted in the official newspaper advertisements for bids upon the making of such improvements under such approved plans and specifications. The advertisement shall be published for ten (IQ days, and shall specify the work to be done and will state that bids will be opened and considered at 7:30 o'clock P.M., on the 23rd day of July, 1959, in the council chambers of the City Hall, and that RESOLUTION 47 - 1959 - Continued. no bids will be considered unless sealed and filed with the City Clerk, and accompanied by a cash deposit, bid bond, or certified check payable to the City for five per cent (5 %) of the amount of such bid. That the advertisement for bids for Street Improvement Project 1959 - 1 shall be in substance , as that in Exhibit "B" attached hereto for reference and made a part hereof. NOW, THEREFORE, NOTICE IS HERM GIVEN THAT on the 18th day of June, 1959, at 7:30 o'clock P.M., the City Council will meet at the City Hall in said City, and will at said time and place hear all parties interested in said improvements in whole or in part. All of said lands to be assessed proportionately according to tie benefits received by such improvements. That the Council proposes to proceed with each of said improvements as separate improvements, except as hereafter otherwise provided by the Council, all under the following authority, to -wit: Minnesota Laws 1953, Chapter 398 and laws amendatory thereof and in conformity with the City Charter. LAGRANGE MAYOR REMMTON NO. 47 EXHIBIT "B" CITY OF MIDI.EY NOTICE TO BIDDERS MUNICIPAL STREET IMPROVEMENTS - -- BIDS CLOSE JULY 23, 1959 NOTICE TO CONTRACTORS — Sealed bids will be received by the Council of the City of Fridley, Anoka County, Minnesota at the office of the City Manager in said City until 7:30 o'clock P.M., on the 23rd day of July, 1959, and will be publicly opened and considered by the City Council at 7:30 o'clock P.M., on the same date for the furnishing of work and materials for the installation of the following improvement: STREET IMPROVEMENT PROJECT 1959 -1 , The project will consist of the following approximate quantities: as more specifically determined by the requirements of the Plans and Specifi- cations to -wit: 4" Stabilized Aggregate Base — 4,131 Cubic Yards 1f" Hot Plant Mix Asphalt Mat including Seal Coat - 39,841 8q. Yda. Asphaltic Concrete Curbs -- 22,105 Lineal Feet - All in accordance with plans and specifications prepared for.the City of Fridley, Anoka County, Minnesota by the Director of Public Works. Plans and specifications may be examined at the office of the City Direc- tor of Public Works and copies may be obtained for the contractors individual use by applying to the City Clerk and depositing with the City Clerk $10.00 for each set, 95.00 of which will be refunded to each bidder submitting a bona fide bid upon return of the documents in good condition within ten days of opening bids. Bids shall be directed to the City Manager, securely sealed and endorsed upon the outside wrapper with a brief statement that the bid is for Street Improvement Project 1959 -1. Bids must be made on the basis of cash payment for the work and accom- panied by a cash deposit, certified check "on a responsible bank in the State ' of Minnesota" or a bidder's bond and made payable without condition to the City of Fridley in an amount not less than five per cent (5%) of the total amount of the bid. The City Council reserves the right to reject any and all bids and to waive any informalities in any bids received without expla- nation. - No bid may be withdrawn for a period of thirty (30) days.
