to order by�Mayor Greig at 7:35 P.M.

APPROVAL OF MINUTES:
Motion by Johanson to approve the Ninutes of the July J,9� 1�60
meeting. Seconded by Wolke. Upon a voice vote� there being
no nays� the motion carried unanin,ously.
Motion by Wolke to approve the Ninutes of the July 25, 1�60
meeting. Seconded by Johanson. Upon a voice vote� there bein@
no nays� the motion carried unanimously.

RESOLUTION.,�89-1960 CONFIRMING ASSESSMENT FOR PROJECT W-23:
The above Resolution was read. Motion by Wolke to �dopt the
above Resolution. Seconded by Johanson. Upon a voice vote�
there being no nays� the motion carried unanimously.

The above Resolution was tabled.
NEW BUSINESS•
RUBLIC HEARING ON WAZER AND SEWER - SHE�RIDAN PLAT:
Mayor Grei� opened the hearing on the abovewater and sewer
project. No one appeared for or a�ainst the proposed improve-
ment. Motion by Johanson to close the hearing. Seconded by
Wolke. Upon a voice vote� there being no nays, the motion
carried unaniu�ously.
PUI3LIC HEARING - 1�60 STRELT 5URFACING:
The Manager announced that the hearing could not be held as
the Fridley News had not published the second notice of the
hearing as'they were supposed to do. Motion by Johanson to
instruct the City Mana�er to write a.letter to the Fridley News
rebuking them for leaving out several of the City's legal notices
and causing a delay and causing undue exFense on the part of the
City. Seconded by Wolke. Upon a voice vote� there being no
nays� the motion carried unanimously.
OPENING OF BIDS ON SCHOOL CROSSING SIGNAES:�
Tabled until later in the meeting.

The above Hesolution was read. Motion by Johanson to adopt

kESOLUTION ��2-1960 TRANSFERRING FUNDS:
The above Resolutihn was read. Motion by Wolke to adopt the
above Resolution. Seconded by Nagel. Upon a vpice vote, there
being no nays� the motion carried unanimously.
There was a discussion as i.o whether or not the water lines should
be lowered� and if the street was at the proper grade. Motion
by Wolke to instruct the City Manager to proceed with having the
water line lowered on 5th Street between 53rd and 54th. Seconded
by Nagel. Upon a voice vote� there being no nays� the motion
carried unanimously. �
CONS�DERATION OF kEQUEST FOR CHANGE ORDER - PROJECT 21-B:
Mr. Comstock stated that he did not have his recommendation�
relative to th39 request� in writing yet, but would answer any
—� questions� now� if desired. Motion by Johanson',to table the
chan�e order until the En�ineer is prepared. Seconded by Wolke.

1'here was a discussion. as to whether or not ']6th Avenue was
vacated. It was verified that it had been. Motion by Wolke
to accept the 5econd Revised Preliminary plat of Lawrence Garten
A�ldition. Seconded by Nage1. Upona voice vote, there being no
ns,ys, the motion carried unanim�usly.
VACAZION OF 20 FOOT WALRWAY - BOYER PALMER REQUEBTs
Mr. Comstock stated that there is a possibility a storm sewer may
have to be put through the walkwa,y, which Boyer Palmer had re-
quested be vacated. Motion by Wolke to set a Pub11c Hearing on
the vacation for the earliest possible date. Seconded by'Johanson.
Upon a voice vote� there being no nays� the motion carried unani-
mously.
REPLAT Or TIMMERMAN'5 ADDITION:
The City Manager explained the �roposed replat of,Timmerman's
t�ddition. Motion by Nagel to accept this ss the preliminary plat
of Tinmerman's Addition. Seconded by 7ohanson:';� IIpon a voice
vote� there being no nays, the motion carried unanimously.

ELN,ER JOHNSON'S RIVEHLAND FLAT:
There'was considerable discussion on the 50 foot size. Attorney
Knutson�'who,'is representing Mr. Johnson� asked if the nre-
liminary,pTat could be accepted subject to changing the lot
size on certain lots. Nr. Segner pointed out that the proposed
cul-d'e=sac,on the plat took in part of his property� and he
had not given permission for anyone to use his property for a
street. The City Manager explained that there were only two
members of.ihe Planning Commission present when this was brought
to their att'ention� and that l�t�ey had taken no action� or made
no recommendation on it� and it was brought to the Council with
no specific recommendation. Mr, Segner stated the plat had
cone into the Planning Conmission Meeting after the Planning
Commission',was in session� and had not been checked out by
them. He stated there should be a connecting north-south street
parallel with the river� and this plat did not provide such a
street. Mr. Breyley� who lives in the area stated he cou)d see
no purpose of the proposed cul-de-sac. Motion by Johanson that
this preliminsry plat not be accepted� and that it go back to thF
Planning Commission for study and recommendation on their part�
before it is brought back to the Council. Mr. Wolke stated he
thought that the cul-de-sac had been taken care of� and it was
a17 on Johnson's property� and he was unaware it inc]uded some-
one else's property, Notion seconded by Wolke. Upon a voice
vote� there being no nays� the uotion carried unanimously.
OPE;NING OF BID5 ON SCHOOL CR055ING,,SIGNAL:
The City Manager announced that only one bid had been received.
It was from,�Lehn Electric in the amount of $1�398.00. Motion
by Johanspn'�o receive the bid and award the contr�ct for the
school cro5sing signal to Lehn Electric, Seconded by Na�el.
Upon a voi'ce vo�e� there being no nays� the naotion carried
unanimously.
E UEST BY MR5 SEVERSON 20 BUILD A GAHAGE ON ZHP� REAR OF HFR
LOT� _AHZ'HUR SZREET s
Mrs. Severson had requested pernission to build a gara�e on her
lot� and s�e was not certa�n whether it conforned to i.he City
Code as she proposed to build it. Mr. Nagel stated thai, a
street may have to be put throu�h where the garape is to be
built. The matter was tabled until later in the meeiing, so
that the City Attorney could deternine whether or not st came
within the code of the City.

Seconded bp Nagel. Upon a voice vote� there being no nays� the
motion carried unaniff ously.
Motion by''Nagel to approve Liquor Claims 2035 throu�h 2053.
Seconded by Johanson, Upon a voice vote� there being no nays,
the ffotion carried unanimnusly.
Motion by Johanson to approve Public Utility Claims 981 through
985. Seconded by Nagel. Upon a voice vote� there being no
nays� the motion carried unanimously.

The above Resolution was tabled� since final plans were not ready.
There were several people who were apposed to the construction of
the four-plex at this address. It was pointed out��however� th�t
the area was zoned for multiple dwelling and the City had no reason
for ti�ithholding the permit� inasmuch as the plans rr,et the City
5pecifications� and it ti•as in an area zoned for multiple dwelling,
Zhere k�as considerable more discussion as to hoW this four-plex
woulcl affect the area� and the peoPle in the area,wished to know
if there any wzy they could stop it. Motion by Wolke to a�prove
the �ermit� inasmuch �s it meets all the City requirements.

The City Attorney determined that the garage that Mrs. Severson
wished to build was in the rear of her yard�' and therefc+re would
come within the �ode of the City� and there would be no need
for a variance request.
PETITION OPPOSII�IG COtv'SZRUCTION OF WATIIR TOWER AND WELL5:
Mr. Sanders� who lives in the vicinity of 61st and �th Street
presented a�etition to the Council� with arproxinately 2�0
names on it� requrstin� the u�ell anrl tower be kept out of the
park. Motion by Johanson to receive the peitition� an�? place
it on file. Seconded b,y Wolke. Upon a voice vote� there
being no nays� the moti_on carried unanimously.
VISITORS:
Mr. Madsen stated that he will construct a 30 foot industrial
road on the west side of the lots north of N�ississippi along
the railroad tracks� if this 16 foot portion of Main Street
is vacated, Motion by Johanson to authorize the City N,ana�er
to set a d&`te for'"a public hearing on the above two vacations.
Seconded by Nagel. Upon a voice vote� there being no nays� the
motion carried unaniu��usly.
Mr. Coustock presented plans for the water main north of Rice
Creek. The City Attorney read the above Resolution, Motion
by Johanson to adopt the above Resolution. 5econr9ed by Wolke.

Mr. Comstock asked if' the Council would like to have this
portion deleted from the contract. Cafter sone discussion on
the subject no action was taken deleting this lateral from
project 5W-�6,
