08/13/1962 - 00023571[�� � � �'� � SPECIAL COUNC2L MEETING ° AUGTJST 13, 1962 A special meeting of Che City Council was called to order by Mayor Greig ae 7;05 P.M, Members Present Member� Absent: Johanson, Grezg, Nee, Sheridan, Wolke None PUBLIC HEARING ON REQUEST TO BUILD EOUR-PLEXES IN NAGELS WOODLANAS ADDITION (CONTINUED): Mr. Peterson, the developer, was present and presented pictures of the proposed four- plexes. A grnup of people from the area stepged forward to view the pictures, t� question was asked about Che pictures of double bungalows, and Mr, Peterson was asked if he wasn't supposed to bring a picture of a douhle bungalow, which could be built also. Mr. Peterson presented a letter to the Mayor with reference to the four-plexes that he proposed to build and the t�me limit on them. The Mayor read the letter to the audience. Max�orie Glass, 7422 Able Street N,E „ asked what these groposed four-plexes would rent for. Mr. Peterson stated that they would rent for $135,00 a unit, A question was asked about the double buxtgalows, how many double bungalows or four-plexes could be built. It was stated that there are.22 lots, and a four-plex building could be built on each of Che lots, One of the residents stated that the pxoperty originally was single family� and a couple of years ago Mr. Nagel tried to zone it light industrial, but it was kept at multiple dwelling, and now they are trying to add four-plexes. Mrs, Klingl� 7364 Ab1e Street, asked Mr. Peterson if he did not know what it was zoned for, oz appxoved for only double Uungalows when he bought it, Mr. PeCerson stated that he did not rea3ly know for sure. Mr. Lubeck, 7524 Able Street, stated that it was designated as double bungalows, and said that he could not see how Mr. Peterson could help but know it was approved for only double bungalows. Mr. Lubeck stated that he would do any- thing he could do to prevenC anything other than double bungalows going into this area. A queseion was asked about who was advertising lats for sale for double bungalows across the street. Mr, Peterson stated that he did not know, and that he was not advertising. Mr. Nee stated that the question is whether the people would be better off with this type of four-plex construction, and this type of unit, or double Uungalowsa At Che present time, no,one knows anything about the double bungalows, Mr, Nee staLed that he does feel obligated to uphold any agreeufent the City may have had with the people in the area, but the people should donsider the different alternatives. A question was asked whether there was an answer to the placement of double bungalows on the lots� could they face each other, or could they face either street. Mr. Peterson stated that he could face two of them together, or he could face them to the industrial side, The question was asked of Mr. Peterson why he would want to face them to the industrial side. One of the residents sYated that it seemed that Mr. Peterson was threaten�.ng tbem with the prospect of facing double bungalows to the industrial side, One of the residents seated that Mr. Peterson was supposed eo bring in the plans for duplexes. Mr. Peterson stated that he does not have plans for duplexes, as he does not know what type oE duplexes they would be. One of the residents stated that if the four-plexes, as proposed, did not meet with success, that Mr. Peterson would then be able to put in any type of four- plexes, Mr. Lubeck stated that he does not like the looks of the four^plexes. One of tfie residents stated that a lot o£ the cars would be parking on Able Street even though Mr. Peterson would have the garages and driveways on the Baker Street side of [he lots. Sohn COlbert� 7343 Able Street N.E., asked about paying for the street surfacing on Ab1e Street, and asked if Mr. Peterson would not have to help pay for the surfacing on Able Street. Mr. Kohlan stated that he could find no oU�ection to facing the buildings one way or the other, but they would have to have a 35 foot setback. Mr. Lubeck asked if the Council did not have the power to direct them to face the buildings one way or the other. Mr, Kohlan stated not at the present time, hut they could have this power. One of the residents stated that at the time this property was replatted, a special stipulation was put on the property so that only double bungalows could be put in. Mrs, Glass stated that she is_afraid that the four-plexes wi11 fa11 into disrepair, and become a slum area. Mr. Peterson stated that it was his intention to se11 to owner occupants. Mro Nee pointed out Yhat there are stringent regulations on multiple dwellings in Fridley, but these regulations do not apply to double bungalows. One of the residents asked why the City of Fridley solicits multiple dwelling units. Mr. Nee stated that Fxidley has one of the strongest multiple dwelling regulatory ordinances in the area. Mr. LuUeck stated that he was concerned about Che number of school children which would be going to the schools in his district i�f all of these four-plexes were built. Mr. Peterson stated that in Golden Va11ey, there is a higher percentage oi school children in one family homes than in the apartment buildings. A question was asked what the commitment of the hank was for each of these buildings. Mr. Peterson stated that the bank had valued the buildings at $52,000,00 each. The question was asked about taxes, and whether more taxes would be derived from single family units, or from multiple dwelling units. The method of arriving at taxes was explained to the people. Mr. Wolke stated that some of Che first apartmeut buildings built in the Summit Manor area are not Coo desirable, but the later ones are much better. One of the residents stated that they had �ust Uui1t a$20,000, ��z home in the area, but they did so because they thought there would be dou6le bungalows across the street. Mr. Lubeck asked if the bnilder could not build one famxly houses. Mr. Greig pointed out that trailer parks have a lower ratio oE children per unit than do single family houses. Mr. Lubeck stated that Mr, Peterson knew how the land was zoned when he bought it. Mr. Johanson,stated that some sort of action should be taken on this matter tonight. Mr. Sheridan asked Mr. Peterson if he were not to build the four-plexes, if he could put double bungalows on this land. Mr. Peterson stated that he doubted if they could finance double hungalows. The Mayor asked what price class houses would go in if the four-plexes were not built. The answer was that they wDU1d be the type that could be sold to a G.I, with no down payment, The Mayor asked for a final cemment from the Councilmen. Mr. Wo1ke and Mr. Nee had no £inal coa��nt� Mr. Greig stated that he personally does not care for double bungalows, and they are not a good risk as iar as the bank is concerned, and he would not like to see ' double bungalows go in the area. Mr. Sheridan stated that the Council is not voting on the question of double bungalows, and the City had to come to an agreement previouslq on this, and the double bungalows were part of the agreement for the buffer strip, The Mayor asked for a show of hands of the people in the audience. 14 were opposed to the four-plexes, and no one in favor of them. Motion by Nee to deny the waiver to permit building of four-plexes, in'Nagels Woodlands Addir_x�n. Secon�ed by Johanson. Thase voting aye, Johanson, Nee, Sheridan, Wo1ke. Opposed, Greig. Motion carried. ,_ _ REQUEST TO DEEER SPECIAL ASSESSMENTS BY MTt, RAICHLE.AND MR. EOOK ON LOTS 20 AND 21, �tARIAN HILLS ADDITION AND RESOLUTION N0. 93-1962 RE-CERTIFYING ASSESS- MENTS; Mr. Sheridan stated that he was somewhat disappointed Ln the letter which had been addressed to the Gouncil, as Mr� Raichle had told him in his conversation that he wonld be willing to pay in the neighborhood of $100,00 this year, and the balance could be paid in one lump sum next year. MY. Cook stated that he would like mote than 2 years to pay it off. Mr. Raichle stated that he would be willing to pay it off in 2 years. There was a discussion on whether or not the assessment should be spread over a number of years, and the rnum6er of times that these assessments had been deferred previously. Mr. Sheridan asked Mr. Raichle and Mr, Cook if they would be willing to pay a regular payment this year, and the balance next year. Mr. Raichle stated that he would be willing to do this. Motion by Johanson to adopt the resolution correcting the error in the assessment ro11 and re-certifying the assessments on Lots 20 and 21, Marian ' Hills Addition. Seconded by Nee, Upon a voice vote, there beittg no nays, the motion caxried unanimously. He stated that the owner *aas supposed to be at the meeting tonight, but apparently is not here. . REQUEST BY J.E, LEWIS TO MOVE HOUSE AND GARAGE FROM 3530 - 3RD STREET NORTH TO 5851 MAIN STREET NORTHEAST; The Council discussed the type of construction involved in this building. Motion by Wolke to deny this request. Seconded by Nee. Upon a voice vote; there being no nays, the motion carried unanimously. MOVING OF HOUSE BY D.L, ANDERSON FROM MISSISSIPPI STREET NORTHEAST TO 7550 ASLE STREHT AND KETURN OF THE $200.00 CASH BOND: The City Manager stated that this move had been completed. Motion by Wo1ke to return the $2D0.00 to Mr, Anderson. Seconded by Nee. Upon a voice vote, _ � there being no nays, the motion carried unanimously. Motion by Nee to receive the Building Board minutes and place them on file. Seconded by Wolke. Upon a voice vote, there being no nays, the motion carried unanimously. Mr. Sher�.dan left the meeting. BOARD OF APPEALS MINIJTES - AUGUST 8, 1962: REQUEST FOR VARIANCE OF SIDE YARD REQUIREMENT ON LOT 14, BLOCK 2, SYLVAN AILLS ADDITION - REQUEST BY MIKE SOKOL - 6131 RAINBOW DRIVE N.E.: 243 The Board of Appeals had recommended granting this variance requesk as most of the other residents in the area had received similar variances. Motion hy Nee eo concur in the recou¢nendation of the Board of Appeals and grant this variance. Seconded by Wo1ke. Gavel to Nee, Mayor Greig left the meeting temporarily. � CONTRACT FOR FURNISHING OF GAS TO PUMPHOUSE: The Citq Manager brought up the letter from the Minfleapolis Gas Company with reference to agreement for furnishing gas to the City Waterworks pumphouses. The CZty Manager explained the contents of the letter. Motion by Wolke to authorize the City Manager and Mayor to sign the agreements. Seconded by Johanson, IIpon a voice vote, there being no nays, the motion carried unanimously. Gave1 to Greig. RESOLUTION N0, 95-1962 AUTHORIZiNG CONDEMNATION FOR STREET AND UTILTTY EASEMENT FROM GARDENA AVENUE SOUTH TO HIGHWAY �k100: The City Engineer explained the proposed re-alignment of the water feeder line and M.S.A, street from Gardena Avenue south to Matterhorn Drive Bri�lge at Highway 96100. He stated that the church has proposed to se11 the land involved for what it cost them on acreage basis, and also stated that the property owners to the south have verbally agreed to give the land to the City, but neither of these dedications have been signed as yet, Motion by Johanson to authorize the City to negotiate with the property owners in question, and also to authorize condemnation of Che property if necessary, as shown in Che proposed alignment on Drawing �F62-42R, Seconded 6y Nee. Upon a voice vote, there being no nays, the motion carried unanimously. CHANGE QRDSR FQR STREET PROJECTS - SYLVAN HILLS ADAITION: � The City Engineer explained that a problem exists on street grades, drainage in relation to Sylvan Hills Park and drainage pond, and SS�kS outlet, The grades proposed for the street to provide surface drainage result xn too flat a gzade across the drainage pond, therefore� the o1d grades used to design the drainage pond should be restored and a surface drainage ditch with gratings will have to be constructed across Sylvan Lane and along Jupiter Drive. He stated that tha�s would involve raising this ineersection about 1'� feet and constructing about 370 feet of reinforced concrete ditch. Motion by Wolke to authoriae preparation of a change order on this matter, Seconded by Nee, Upon a voice vote, there being no nays, the motion carried unanimously. CROSSOVER ON HIGHWAY �'665: Mr. Ray Carlson, represeizting Lampert Lumber Company, Mr, Sheldon Mortenson, and a representative from the Harstad Company were present with reference Co the crossovers cahich were being taken out on Highway �k6$ at the railroad tracks (Minnesota Transfer Railroad CrosSing) and also at 73z Avenue. There was considerable discussion on the taking ouC of these crossovers and putting in�of the new ones. Mi. Nee stated that the crossing eventually would have to be pnt in at 73rd Avenue. Mr. Ray Carlson stated that Fridley Lumber Company originally started up �n 1954 and they were un- loading their lumber at New Br�ghton at that time, but in 1957 they negotiated a lease with the Minnesota Transfer Railway, and have been unloading since that time on the east side of Highway �k65 and the Minnesota Transfer Railway tracks. They have spent about $2,000.00 Co improve the site at the lumber unloadLng poLnt, He � stated that Minnesota Transfer Railway says that they will be provided with a spot on the west side of the tracks when the tracks are extended further. He stated that the Council should leave in the crossovar at the railroad tracks until such time as the area is developed and the proper service roads are provided� so that a11 of the present propertq owners have access to a crossover. Mr, Johanson suggested that a Letter be directed ta the State saying that the City does not want the crossings taken out until service is provided Co crossovers to a11 of the propexty owners. The Mayor read excerpts from the meeting of February 5, 1962, and some of the other meetings concexning this suh�ect. The representative from the Harstad Company stated that he had been approached for the purpose of signing an easement over pare of his property but that he had refused to sign this agreement, He asked under what con- ditions are sexvice roads accepted by the City for use, The question �aas asked if a service road is put in, who would pay for it. Mr. Wo1ke stated ehae the normal procedure is that the property fronting on the service road would have to pay £or any servicing or improvements put in. Mr. Nee asked who will put in the service `��� road on the west side of Highway ��fi5. Mr, Peterson stated that he wi11 put in this service road, Mr. Johanson stated that the crossovers should remain in place untiZ the service roads are built and put into operation. The crossover on 73i Avenue could be discontinued when 73rd Avenue goes through. The Mayor suggested that the City Manager contact the Highway Department and inform them that it was the City's understanding that none of these crossovers wexe to be deleted until service was provided to all property owners, and until a txaffic count was taken. The question was asked why existing crossovers were being taken out, merely to push them up a block, Mr, Nee explained that the present crossovers wexe not in the proper place for the total development of the area. He also stated that a11 - of the property owners would 6e provided access when the proper service roads were built, and he stated that he felt the solution of the problem was far�everyone to get together so that this sexvice road could be built, Mr. Ray Carlson stated that the lumber company had to pay For a service road in the front of their pro@erty, but the trailer park had not put one in front of their property. Mr. Nee stated that the agreem2nt with the Highway Department was to leave in the present cross- ings until a serious hazard develops, Mr. Wolke suggested that a let�er be written to the Highway Department. Mr. Johanson stated that the City Manager should_also telephone the Hlghway Department and inform them of the fact that a letter is be�ng sent. Motion by Johanson to instruct the City Managex to bfriie a letter to the Highway Department informing them that the City Council's position is that none of the crossovers should be taken out until all of the property owners provided with service to cr-ossovers and the proper service roads are obtained and_put ia, and 73rd Avenue is put in, and the City Manager 1s also to telephone the Highway Department informing them of this.
