We have court on � friday nights and on every other monday. We also have court on one tuesday night a � month. We have all jury cases on each saturday that is necessary. We will average about 12-15 jnry cases this year in 1964. I would anticipate about � 200Q cases this year, because the highwaq patrol will ba running about 2 times a month � at our main inter�etions in Fridley what they call saturation patrols� which usally � average about 150 tickets in each case. Also the Fridley police have hired 4 new �� police officers and that will increase that activity. Receipts will increase about � $5000.OQ. I also find that there are a whole lot more citizens complaint�. My clerk tel? �� me that over a 40 hour a week, he would also average about 260 hours over that in a ,� years time. This includes all jury cases, and other court dates. The clerk of conrt is � also called out serveral times in the middle of night by the police dept. �•� Here are some comparable salaries of other suburban courts. � :• :. , •'� Hopkins Clerkof court $488.00 partime. Bloomington has 3 or 4 clerks that handle about �� 6000 cases a�d their salaries are total about $18000.00 or $19000.00. My clerk would be responsible to be at all `� court ca�es including all jury cases. He would also handle all probation cases in the � office. ,By doing away with serneral things in the court budget we can have a fulltime .� ;� clerk of court without increasing our budget. I am proposing that the e�erk of aourt ' be paid'$7200.00. B, Working Plans and Specifications: The working plans and specifications to accomplish the work shall include a11 detailed drawings, maps, plans, specifications, bid forms and assi.stance in awarding of contracts. All as applies to and concex'ns construction pl.anning of the work. At all times tne Engineers shall prepare sufficient sets of plans and specifications to fu1fi11 the needs of the C ity offices, the bidders and the contractors. C. General Supervision; The general supervision of the construction of the work to be accomplished shall include the making , of a11 partial and final esCimates, and certificates of work performed, tne checking of the contractor's work schedules, visits to the construc�ion locations during the period of construction (as often as conditions require or at the special request of the City) and the checking af the contractor's operations in all ways; all for the determination of compliance with the plans and specifications and to safeguard interests of the City. General supervision does not include "fu11 time on tize site supervision." Upon completion of any constx'uction work supervised by the Engineers, the Engineers will furnish two copies of as-built plans and speci.fications as noted. General supervision includes the supervision and direction of staking and inspection, but the cost of all staking and of (non-pro- fessional engineer) inspection is to be performed as are extras. -2- � • • , � ._ � . l g; _ _. - � D. Maintenance: For a11 jobs designed and supervised by the Engineers, the Engineers shall be responsible for any unusual maintenance problems and will supply investigation reports and judgment as deemed necessary by the C ity. The C ity shall determine tiie question of whether there is an unusual maintenance problem. For jobs designed but not supervised by the Engineers, the Engineers shall be available for con- sultation and cotmnents . E. Time Limit: A1X work done by the Engineers except supervision wi11 be completed within the time limit recommended by t'ne Engineers and accepted by the City. F. Desi�n Data; The Engineers shall furnish to the City, upon request, any doctunents, the bases and data used to design the project and other related information. G. Progress Report; The Engineers will supply the progress reports about the project undertaken by them when asked by the City. ARTTCLE 3 WORK ORDERS All work orders are to be executed by the City Manager and all services are to be performed pursuant to work orders. A. Residential Supervision: Residential supervision is a part of and in addition to general supervision. It may include the furnishing of competent personnel to stake out the woxk and competent personnel to inspecC the construction of the work as a whole during its progress. I . ... . . � .. . . . . . � . � ARTICLE 4 CITY MANAGER APPROVAL A11 services performed by the consulting engineers requiring Council approval such as the preliminary report, construction plans and specifications, general and residential supex'vision, bid analyses, change orders and estimates must be approved and accepted by the C ity Manager prior to submitting said items to the City Council for approval. The consulCing engineers will work directly with the City Bepartment designated by the C ity Manager for that purpose during all phases of design and con- struction of any project, including general supervision, and residential supervision when ordered. The City Manager will have the final say about what the working ot the Engineers with the City Department means and involves. ARTICLE 5 COMPENSATION Compensation for the engineering work set out in this Agreement shall be as follows: A. The compensation for the services performed under Article 2 shall be a sLUn of money computed by multiplying the construction cost of the improvement by Che basic rate. In the event there is difficulty in ascertaining the basic rate applicable to any particular project, the � • Engineers may elect to set the basic fee at 5% and then have the rate ad� justed to the appropriate percentage at a 7,ater date. Errors and omissions constituting negligence of the Engineers , , shall be corrected by the Engineers at their expense. In the event a dispute arises between the parties in interpretin� � � this Agreement the dispute shall be resolved by arbitration. Each party shall select a representative and the two persons se�ected shall promptly agree upon a third person, and these three persons shall constituze the arbitration commission who shall study, hear and consider the matter in conformance with the Uniform Standard Arbitration Act as enacted in Che Statutes of Minnesota. ARTICLE 6 PROPERTY OF THE CITY Upon payment of the fees provided for in this Agreement for either preliminary plans or the working plans and specifications as the case may be,,: said original plans or corrected original plans (as-builts) � znd copies of specifications shall become the absolute property of the City � and shall be furnished to the City upon demand as its property and as evidence of the engineering work and services performed. if the work be constructed in wliole or in part, in accordance with such pl�ns and specifi- cations under the supervision of the Engineers, then not less than two copies of the plans and specifications of such work "as-built" shall be furnished wiChout further costs to the City for the purposes of record to the City, and shall become the absolute property of the City for any and zll purposes.
