Mayor Nee explained the Council action of February 10, 1965 in suspending
the licenses of the Frontier Club and that a request by the licensee for a
hearing had resulted in his calling this meeting and that by answering to
the roll call the Councilman would waive the written notice of hearing.
Mayor Nee also stated that Councilman Thom:pson,who could not be present,
had assured him that he waived the notice of hearing.-., Mayor Nee then
declared the meeting open at 7,50 P.M. and asked for roll calls
ROLL CALL;
Members Present: Sheridan, Wright, Kirkham, Nee
Member Absent: Thompson
Mayor Nee explained that the Special Meeting on Wednesday, February 10, 1965
had been convened on the basis of Police Reports, one by Sergeant Cook, and
one by Sergeant Cook and Patrolman Erickson, and that the Council invited
Chief McCarthy and Sergeant Cook to the meeting to explain their reports in
full. The Council had heard testimony from the Police Department. and examined
the Police Contact Pile on the Frontier Club dating from 1963, and that it
was believed that charges would be brought and upon conviction could result in
mandatory revocation, so a motion was made to suspend the licenses under
Section 81,12 of the code of the City of Fridley, 1963, until such time as the
• expected ,charges were made and resolved. The City Attorney had advised the
:'mayor° that the 'licensee would like to have a hearing so this meeting had been
convened.
ATTORNEY FOR THS LICENSEE - MR MARTELLo
Mrs Martell advised that he was the attorney for the licensee and asked that
he be allowed to speak, He stated that the licensee's position is that under
State Law and decisions of the Supreme Court, a license cannot be suspended
without a notice of hearing and a listing of reasons for the proposed suspension.
r"ne licensee's have had no chance to rebut the reasons for a suspension. It
seems to be that the basis for the suspension is a presumption of guilt. The
Licensee. is losing business while the licenses are suspended. Mr. Martell
suggested that the City Attorney be asked if the Council action were indeed
Iawfful..
City Attorney Smith stated that he was not at the meeting on Wednesday, February
10. 1965 Mr. Smith Stated that there are two actions provided for in the
Ordinance, one of which is suspension in which there is no notice required. and
the other is revocation which requires notice. He suggested that the matter
be reviewed if the power to revoke would have to be used, so he felt that
reasons for the suspension should be presented to the licensee so that he could
review and rebut. The license was granted originally under the Ordinance
providing for Suspension without notice. The City Attorney suggested the
Council proceed to have the Police testify again, and if the presentations
Seem to warrant it the Council rescind action, or if testimony indicates suspension

Mr. Martell stated that lotrking at one side of as incomplete question he could
see why the Council would act as the Council had acted on February 10, 1965.
He pointed out that some of the 9 complaints in the contact file were not the
fault of the Club, that a motorcycle had hit a ,anal in the front of the Club
which had resulted in a Police call,; and that ,,Iso a party wanting admittance
after hours had also resulted In a Poli.rx call. Ii: stated that the statements
by Sergeant Crook and Sergeant Voigt about the ag- of the girls would not be
admissible as evidence- in court. Mayor Nee stated perhaps Mr. Martell
misunderstood, that, he believes action in tha first instance would be against

to cost $1.2 million. Councilman Kirkh:in stated that it would be a good idea
for the Council to stipulate construction of a fence along the West line of the
property of the school as required of tae Public Schools. The Mayor asked
whether or not Gardena Street which ru -.i along one side of the School property
was a State Aid Street. The City Engi!ee:r answered that it was. Motion by
Sheridan to approve the application f(r a Building Permit for Grace Catholic

attend the Civil. Defense Conference. The City Manager answered that he will
attend the Conference. Motion by Sheridan to receive the communication from
• the University of Minnesota - regarding the Civil Defense Conference and direct
the City 'Manager to authorize any staff members who the City Manager feels

ACRES, INC., INNSBRUCK 5TH ADDITION IMPROVEMENTS
Mr. Johnson, representative of Acres, Inc., was present at the Council Meeting.
Councilman Sheridan asked if it were possible to spread the assessments for
the construction of the Lift Station over a greater area and over the period
of time requested by Acres, Inc. Mr. Johnson stated that Acres, Inc. has
planned goad development which will be an asset to the City of Fridley and
the City of Columbia Heights. He stated that Acres Inc. felt that the spreading
of the assessment across all the lots of the homeowners in the area will make

Nee asked if the assessments for the Lift Station were assessed against this
area. Mr. Comstock stated that drainage of the lots southeast of the property
of Acres,; Inc, requires construction of the Lift Station to provide for pumping
of the sewage from the low elevations. He stated further that catch basins for
the storm sewer had been installed„ but that no outlets to the sump for this
drainage have been installed. The outlots are unplatted. The present plans
are to spread the assessments for the construction of the Lift Station over
27 lots. Mr. Johnson stated that Acres,; Inc. could enlarge the plat to spread
the , assessments further if it was possible to do so. The City Manager stated

stated further that granting such a request could set a precedent.
Councilman Thompson asked if platting of the land will be required in order
to spread the afssessmnt: over a larger area. The Mayor asked whether the
plat: of the land of Acres, Inc. had been recorded. The City Manager answered
that it had not been recorded, but that the Council had approved the plat. The
O�,:t.y Manager suggas4e:d that the Council hold over the petition to March 1st.
He stated that action on the petition would require Acres, Inc. to furnish money
in escrow to the. City.
Motion by Sheridan to receive the communication from Acres, Inc. as Petition
#2 -1965 and turn the petition over to the Administration for processing.

RRUFST FOR A PERMIT FOR THE CCVSTRUCTION OF A SIGN:
The property owners, Mr. and Mrs. Mark Hasten, were present at the Council
Meeting. Mr. Hasten told the Council that he wished to request permission
for the construction of a temporary sign, to be visible from T.H. #47
advertising apartments for rent: on 7th Street. Mr. Hasten stated that his
request for the construction of the sign to be visible from T.H. #47 was due
to the fact that 7th Street is not completed at this time. Mr. Hasten will
place the sign on the corner of the property at 5612 w 7th Street Northeast
on steel posts extending 14 feet above the ground and five feet into the ground.
• The. sign to be 4 feet high by 10 feet long, to be made of two by fours and
1/2 inch plywood. Mr, Hasten stated that his apartment buildings are not visible
from 'T.H, P47 and that he felt the sign was required to enable him to advertise
the location of the apartment buildings adequately. Councilman Sheridan
stated t;hat he assumed it was the intent of Mr. hasten to keep the sign in place
only until September or October. He stated further that construction of
T: >ll.> #47 underpass v ll be completed by November 1965. Councilman Thompson
asked MY% Hasten how far above the ground the sign taould extend. Mr. Hasten
answered that the s:i.ga would extend 14 feet above the ground, would be red and
write and', would be placed 3 feet inside the property line of the lot at 5612 m

to make and pmaeut: drawings of the sign to the Building Inspector. Mr. Hasten
answered that he would do so.

CONSTRUCTION OF 79TH AVENUE: NORTHEAST - EAST RIVER ROAD TO ASHTON (LINCOLN):
The City Manager explained that construction of a Storm Lever Line is necessary
to provide drainage needed for the construction of the pavement on 79th Avenue
from East River Road to Ashton Street,, The City dtrgineer perferred to complete
• construction of a Storm Sewer Line in area A at this time, also. A Storm
Sewer Line in area B is necessary if the rest of the Storm Sewer Line is
constructed or not. Construction of the Storm Sewer Line in area B would
make it possible for the City to receive State Aid Funds for the construction

and reduce the special assessments to the property owners accordingly. Mayor
Nee asked whethar it was possible to drain the water from the area into the
diJ:ch on the east side of East River Road, The City Engineer replied that
the HugineQring :staff had checked this possibility first and found that it
was not feasible to drain the water to the ditch on the East side of East
River Road since the ditch is of insufficieit_ depth that it would be necessary
to deepen the ditch, that this project would only work temporarily, and would
cost the City money The Mayor asked why the Storm Sewer Line as shown on
the map was not designed to run more directly to the Creek, The 'City Engineer
replied that the Storm Sewer Line followed the ditch, only because this had
been designed under a preliminary study, and could probably be changed before
final design„ Councilman Sheridan asked if it were possible to replace the
Storm Sewer Line in area B with an open ditch. The City Engineer replied
that there i..s an open ditch now in existence. The City Manager stated that
part of the open ditch in area A has been filled in by the property owners.
Councilman Sheridan asked if use of an open ditch would require installation
of a culvert under the street. The City Engineer ansusred, "yes." The City

1425 Onondaga Street, Were present, and stated that they objected to putting
double bungalows in that area. Motion by Fitzpatrick, seconded by Saunders,
to continue this hearing to Wednesday, March 24, 1965 at 7:30 P.M., and
that Mr. Gunderson be notified that he must present a plot plan of the two
lots showing the locations of the proposed double bungalows, and also that
he must be present at the meeting. Upon a voice vote, there being no nays,
• Chairman Nawrocki delcared the motion carried.
ADJOURNMENT:
There being no further business, Chairman Nawrocki delcared the meeting

Original preliminary plans and studies'to
remodel the old building prepared for the
University and 64th site work continued
until December 1, 1960.
As per memo of 23 May 1961, University and
64th site was abandoned and new site at
Mississippi and 7th Street was selected. -
An entire new program was prepared and
totally new plans and studies completed
for this site.
As per memo of 23 July 1962; the plans for
the Mississippi and 7th Street site were
abandoned and architects were instructed to
start anew and plan a new Center on the
University and 64th site. Work also
started with the Citizens Committee.
Total fees for this work .....................$ 2,300.71
On 11 October 1963 separate work was
undertaken on the Fire Station building
and handled independently of the Civic
Center planning. A 1% credit for previous
preliminary work on the Center was given
toward the Station, amounting to $580.15..... (580.15)
Also, separate work at this time was done
on refacing of the old City Hall Building.

Present was Mr. Johnson from 6600 Brookview Drive, and representing
Mr. Miller was Loren Glitzmaier. The Board discussed this application
with Mr. Glitzmaier and it was pointed out that the location drawings
for the funeral hums on the certificates of survey were incorrect so
it was difficult to determine just exactly what Mr. Miller intended
to do with the property, and also, that the Building Inspector had
reported that it appeared that the required setbacks could not be
provided, although it had been difficult to make this determination
since the drawings appeared incorrect. Per. Glitzmaier advised that
he would cnntact SFr. miller as soon as he returns to the City, and
would provide the Building Inspection Department with proper certifi-
cates of survey, and that if the setback requirements can' not be met,
Mr. biller probably would apply for variances to said setback require-
ments. Notion by Gabrick, seconded by Goodrich, to continue the public
hearing on this matter to the meeting of October 21, 1964 at 7:30 o'

Mr. Miller was present, and also, Mr. LeRoy Talbot, the owner of the
property for the proposed funeral home, and Mr., Raymond Gerrety, owner
of the property immediately adjacent at 6679 Brookview Drive Northeast„

between this property and the Gerrety property. Mr.. Gerrety stated
that he was not opposed to a funeral home, but that it appeared in
this plan that the parking lot would be under his bedroom window and

The City Manager read the reconowadation of the Board of Appeals to
the City Council granting the off - street parking variance stipulating
that the structure be a new colonial style structure substantially
the same as the picture of such a structure. Mr. Wallace P. Miller,
petitioner, was present and explained the parking area and that they
had agreed with Mr. Gerrety, property adjacent,, they would work
according to the original plans submitted.
Motion by Sheridan to concur with the recommendation of the Board of
Appeals and grant the request for a variance from section 450216,
City Code of Fridley, Minnesota 1963, by waiver of parking require -
ment (rear yard only) to permit parking in side yard, and a variance
from Section 450254 City Code of Fridley, Minnesota 1963,, by waiver
of rear yard depth requirement from 30 feet to 12 feet 8 inches on
Lot 2, Block 1, Brookview Second Addition, Anoka County, Minnesota,
• same being 6671 Brookview Drive Northeast, Fridley,, Minnesota (request

• A RESOLUTION IMPOSING LOAD LIMITS ON PUBLIC STREETS AND
HIGHWAYS IN THE CITY OF FRIDLEY
BE IT RESOLVED by the Council of the City of Fridley, as follows:
1. That pursuant to Chapter 72, City Code of Fridley, Minnesota, 1963
that com mucing on the 15th day of March,1965, and continuing until
the 13th day of May, 1965, unless sooner terminated or thereafter
continued' no vehicle shall be driven or operated upon any street or
public highway in the City under jurisdiction of the City where the
weight of such vehicle exceeds:

A RESOLUTION RELATING TO ALLOCATICIN OF STATE GAS TAX FUNDS ON BASIS
OF SPECIAL PEDCRAL CENSUS
WBSRBAS, present state Statutes require the use of ten year
population census figures in determining the allocation of State Gas
Tax Funds for any municipality, and
WHEREAS, the City of Fridley has had an increase in population
of approximately 75% over the 1960 census figures, and
WHEREAS& the City of Fridley is having a 1965 Special Federal
Census and has paid the costs of same, and
WHEREAS, the naffed for construction of additional city streets
with State Gas Tax Funds is great and it is unreasonable and uneconomic
to postpone the construction of such streets,
NOW, THSREFORS, BE IT RRSOLVED, by the City Council Of the City
of Fridley meeting in regular session on the lst day of March, 1965
as follows:
• 1. That the present Minnesota State Legislature be urged to
awend the existing State Statutes to provide for the use
of the latest federal population census figures from either
a general census or special census in determining the allo-

PLANNING COMMISSION MEETING MINUTES - FEBRUARY 25, 1965
The meeting was called to order by Chairman Kravik at 7:40 P.M.
ROLL CALL: Members Present: Kravik, Bergman, Hughes, Johanson

SLIDE PRESENTATION:
The Planning Commission was shown a Slide Presentation entitled,
"New Concepts of Land Subdivision," whic"_: the Chairman had seen at a
meeting last year and thought might be of interest to the commission.
DISCUSSION OF BILLBORAD LEGISLATION:
Mrs. Schreiner and Mrs, Mullin from the League of Women Voters
were present and discussed with the commission the League's recommendation.
that the City provide sign and billboard regulations. The extent to
which this regulation should go was discussed. Mr. Hughes stated that
he felt the Legislation should permit local businessmen to have a sign
advertising their business, that was not necessarily on the site of
their business, but not more than one quarter of a mile away, and that
the Legislation should . not attempt to regulate the content or the type
of advertising material to be placed on the sign, and that a standard
billboard size sign be permitted. Mr Bergman stated that he was definitely
interested in seeing that some provisions to require proper maintenance of
the signs be in such an ordinance.
MOTION by Hughes, seconded by Bergman that the commission request
the City Attorney to draft a suggested billboard and sign ordinance, and
that the City Attorney also advise the commission relative to regulation
of signs and billboards, and that there be special reference in the
ordinance to maintenance and upkeep of the signs, and the prevention of
unsightliness. Upon a voice vote, there being no nays, Chairman Kravik
declared the motion carried.
Mr. Hughes stated that he would like to see a summary
by the City Attorney of the present regulations of signs as found in
the City Code and any other Codes applicable thereto, the summary to
indicate the extent to which these present regulations could be applied
to the sign and billboard' situation in Fridley.
SLIDE PRESENTATION:
The City Manager advised the Planning Commission that he had
invited Mayor Nee to the meeting to present the Mayor's Slide presentation
on the need for planning in Fridley and the why's and wherefore's of
the City's decision to engage a Planning Consultant, the Slide Presentation
the one that the Mayor had presented to the Chamber of Commerce last
week. Mayor Nee then showed the slides to the commission and the commission
then discussed not only the Slide Presentation but the work the Planning
Consultant would do and the value to the City of the result of the
Consultant's work.

the City of Fridley of Anoka County# Minnesota are engaged in the munici-
pal operation of On -sale and off -sale of intoxicating 13quors# and
WHBRBAS# the business counNnityt interested citizens, and the City
Council of Fridley after discussion and numerous informal surveys have
concluded that the public interest would be best served by having con-
tinued municipal operation of the off -sale of intoxicating liquors, but
the granting of licenses to private enterprise for the on -sale of intoxi-
cating liquors,, and
WHEREAS, the Minnesota State Legislature presently in session has
before it the consideration of some general legislation that would permit
a municipality to continue with municipal operation of off -sale intoxi-
cating liquor and permit the granting of private on -sale intoxicating
liquor licenses,,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fridley meeting in regular session on the 1st day of March, 1965, as
follows:
1. That the present Minnesota State Legislature be urged to amend
the existing state Statutes to provide for the retention by a
municipality of the right to operate a municipal off -sale in-
toxicating liquor store or stores and at the same time be enabled
to issue private on -sale intoxicating liquor licenses.
2. That support be given to general legislation applicable to all
municipalities in the State presently operating municipal stores
for such legislation.
3o That special legislation be introduced applicable to the munici-
pality of the City of Fridley so that a bill applicable on a
local basis may be adopted in the event the general legislation
is not adopted.
4. That copies of this resolution be forwarded forthwith to state
Representatives Connie Burdett and John Nordin, Senator Vernon
S. Hoium# and to the Honorable Karl Rolvaag.

HUMAN RELATIONS COMMISSION MEETING - FEBRUARY 17, 1965
The meeting was called to order by Richard Herder, acting chairman.
Members Present: Richard Herder, Louise Nei, Linda Roseman, Tom Myrha,
Bill Milbrath, Catherine Moss, Helen Truenfels,
Rev. Kendall, Bill Stukas, Father Keefe, and Jordis
Mittelstadt.
Mr. Milbrath reported on a Human Relations meeting he, Helen Truenfels
and Richard Herder attended in Minneapolis. The speaker was Dr. Lyons,
chairman of the St. Louis Park Human Relations Commission.
Mr. Stukas presented and discussed the Commissions by -laws he had drawn
up. Mr. T._Myhra moved we accept the by -laws. Seconded. Approved,
upon approval by the City Council.
A committee's report was given by Mr. Milbrath. He had met with Mr.
Cal Walton, Director of the Minneapolis Human Relations Commission, who
suggested Fridley not formalise our Commission structure now but rather
study the needs of the community and determine what is needed here.
Ad Hoc committees were set up to study the needs in Fridley. The
committees will study the areas of Housing, Education and Youth, Intra-
Government and Welfare, Community and Area Human Relations Activities.
Members of the Human Relations Commission will be appointed to the
Ad Hoc committees. Acceptance of this basic approach moved by R. Truenfels.
Seconded.
Mr. Bill Stukas suggested the election of a Board of Directors - either
temporary or permanent. After some discussion it was moved by Mr. T.
Myrha that we elect a temporary slate. It was decided we will then
appoint a nominating committee to present a permanent slate at the text
meeting. Temporary slate as accepted:
Mr. Richard Herder - Chairman
Mr. William Stukas - Vice - chairman
Mrs. Catherine Moss - Vice - chairman
Mrs. Jordis Mittelstadt - Secretary
A meeting of the temporary officers will be decided upon by those
concerned.

The meeting was called to order by Chairman Larson at 8:00 P.Me
Members Present: Weiss, Larson, Rossing, Fritz, Szegda
Others Present: Mr. Woehrle, representing Phillips Petroleum Company
and Mr. Robert Schlesinger, realtor

Consensus of the Safety Committee was that the North and South driveways
should be located at least 10 feet further East from the proposed locations,
and that all driveways should be 30 feet wide instead of tha proposed
22 feet, and that the elevation and slope of the ground at the rear of the
property should be such as to insure proper drainage away from surrounding
property in case of gasoline spillage. Mr. Woehrle advised the Committee
that he felt that the Phillips 66 Company could comply,and would comply,
j with this request.
Motion by Fritz, seconded by Rossing, that the plans be recommended for
acceptance with the above noted changes. Upon a voice vote, there being
no nays, Chairman Larson declared the motion carried.
POSTAL STORAGE AND PICKUP BOXES:
The Committee decided that relocating postal storage and pickup boxes
to provide better visibility for drivers at intersections could wait
until more favorable weather.
LETTER FROM CITY COUNCIL:
Chairman Larson read a letter from the City Council commending the
Safety Committee for bringing the hazardous conditions at the East River
Road and T.H. #100 interchange to the attention of the City Council.
ADJOURNMENT:
There being no further business, Chairman Larson declared the meeting
adjourned at 9:25 P.M.

Here is the complete disposition of the three cases involving minors in the
Frontier Club on February 6,1965•
1. John Steve Ellis, 1550 2nd St S.W. Rochester Minn, plead guilty in our court on
February 19,1965 of showing a fraudulent 'selective service draft card to Sgt Hilbert
L. Voigt.. Mr Ellis was fined $100.00 for this. Birth date of defendant is 3 -27 -46.
2. Sandra Marie Rawn, date of birth- 2- 12 -45, plead guilty in our court on February
19,1965 of being in the Frontier Club on February 6,1965 while under age. Sentence
was stayed until February 26,1965. The defendant appeared back in court on 2 -26 -65
with her parents for sentencing. The defendant was fined $25.00 and the fine was
stayed for i year on condition of no more like violations for 1 year. The reason
for the suspended fine was, the defendant was very cooperative with the police and
the court. In court the defendant took a oath and said that at no time was she asked
for any identification to prove that she was of the age of 21 years.
3. Judith Amanda Knutson, date of birth_ 5- 16 -45, plead guilty in our court on
February 19,1965 of being in -the Frontier Club on February 691965 while under age.
Sentence was stayed until February 26,1965. The defendant appeared back in court on
2 -26 -65 with her parents for sentencing. The defendant was fined $25.00 and the fine
was stayed for 1 year on condition of no more like violations for 1 year. The reason
