Page 1 t rW,ULAR COUNCIL MEETING MINUTES - MARCE 15, 1965 A regular meeting of the Council of the City of Fridley was called to order by Mayor Nee at 8-.08 P.M. OPENING CEREMONY- Councilman Kirkham introduced Troop 480 of the Fridley Boy Scouts who conducted an opening ceremony consisting of presentation of the Flag and the Pledge of Allegiance to the Flago Mayor Nee extended his thanks to the Troop for conducting the opening ceremony. PRESENTATION BY THE CAMP FIRS GIRLS: The Camp Fire Girls presented Mayor Nee with a cake to commemorate the 65th Anniversary of the founding of the Camp Fire Girls on March 17th. The Cabe was topped with a triangle and three candles in a center grouping, the three candles standing for Work, Health, and Love. Mayor Nee thanked the C,,mp Fire Girls for the cake. JUNIOR CHAMBER OF COMMERCE ANNUAL BALL: Junior Chamber of Commerce representatives sold tickets to the Mayor, the Councilmen, and the City Manager for the Annual Ball of the Junior Chamber of Commerce. The purpose of the ball is to provide funds for playground equipment for Fridley parks. The ball will be held on Friday, April 23rd. AWARD OF CONTRACT - POLICE CAR: The City Manager read the following bids for the police car, and a memo from Chief of Police McCarthy. Chief McCarthy recommended that the Council award the bid for one police car to • River Motors for the bid amount of $1,921.64 with the trade -in of the 1961 Plymouth. He also suggested that if the Council should decide to purchase an automobile for the use of the Civil Defense Director, that the Council provide the Civil Defense Director with the 1961 Plymouth and purchase the police car from River Motors for the amount of $2,271.64. The City Manager stated that the Civil Defense Office could not purchase the 1961 Plymouth from the City, but could lease it from the City at the rate of $30.00 per month, with the Federal Government paying 50% of the lease cost. This lease income would reimburse the City for the cost of the trade -in within two years. The City Manager then read a list of the trips normally made by the Civil Defense Director. The City Manager announced that the Police Department and the Civil Defense Office were considering an agreement concerning the policing of Locke Park. The Civil Defense Department will provide uniformed men to police Locke Park. This would relieve the Police Department of patroling the area, and provide more police patrol to the rest of the City. The 1961 Plymouth could be used by Civil Defense personnel as a patrol car to police Locke Park. Under the terms of the bid, however, the radio in the 161 Plymouth would be removed and placed in the new police car. Inorder to provide a radio for the Civil Defense Car or to leave the original radio in the 1961 Plymouth, the City would have to purchase another radio in the amount of $600.00 Councilman Kirkham asked who would maintain the 1961 Plymouth if it were leased to the Civil Defense Off ice. The City Manager stated that the Civil Defense . Office would maintain the Plymouth. Councilman Wright asked what the condition of the Plymouth was. The City Manager answered that the Plymouth had been maintained and repaired and used as an unmarked carp and that the Chief of Police Page 5. felt that the Plymouth was in better shape then any other police car since it • has not been used for ordinary patrol work,. The Mayor asked where the car will be garaged if it is provided for lease to the Civil Defense office. The City Manager answered that the car would be parked next to the Bennett building„ Councilman Kirkham asked what kind of transportation the Civil Defense Director was ?rovided with at the present time, The City Manager answered that the Civil Defense Director provides his own transportation and the City reimburses him for it;. Councilman Wright asked what the cos the reimbursement was. The City Manager answered that ttp- cost was S cents per exile. The Mayor asked if the car were loaned to the Civil Defense Uepartwnt: whether other City officials will be able to use it. Motion by Wright to purchase one police car, a Dodge, from River Motors of Anoka and to table consideration of awarding the, trade - -in of a 1961 Plymouth to the Regular Council 1,1eeting of April 5, 1965. Seconded by Kirkham. Upon a voice voter there being no nays, the motion carried unanimously,, REQUEST FOR WAIVER OF ESCROW t DON ANDERSON- The City Manager stated that the City Engineer advises him that the cost of inspecting the plans and inspecting the construction work to provide sewer and water services to the subdivision of Don Anderson would be $150.00. Waiving the escrow would require Don Anderson to furnish the City with a Performance Bond to guarantee completion of the work;. Councilman Wright stated that requests of this nature have come before the Council in the past and that he would like to have a discussion between the Council and the builders concerning the problem. The past experience of the City when the escrow has been waived has been that the work was not properly performed. The Mayor stated that the Engineer doing the design work and inspecting the construction should be a person responsible to the City. The Mayor asked the City Engineer whether the City has specifications the Consulting Engineer may follow to make designs for poviding services to these properties? The City Engineer answered that the City does have specifications for the design of sewer and water services, but the City has no Way of checking on whether or not the Consulting Engineers comply with the specifications and it is necessary for the City to depend on the word and integrity of the Consulting Engineers. The Mayor asked what the result would be. if the City were to do the engineering and have the developer do the construction work The City Engineer answered that the City is 809 developed and plans for new construction will cover only small areas of the City. He explained to the Council that Phillips 66 had made a mistake in assuming that the crossover for an interchange on University would be close to the property which Phillips 66 had originally purchased for construction of a service station. Mr. Schlesinger stated that he had negotiated for the purchase of Mr. Schuur`s Property at 5669 University Avenue Northeast and had negotiated with Mr. Schuur to purchase the property at 5759 University Avenue Northeast which Phillips 66 had originally purchased. Mr. Schlesinger then read a letter of Mr. Schuur to the Council, Mr. Schuur requested the Council to grant permission for him to move his business to 5759 University Avenue Northeast, and stated that he would use the building for his own office to repair his own cars and will store all junk cars in back of the building. COMMUNICATIONS: MOUNDS VIEW: SEWAGE DISPOSAL: Mayor Nee stated that he believed it would be a good idea to cooperate with Mounds View in providing sewage disposal service to the Bel Rae Ballroom. The City Manager stated that furnishing sewage service to the Bel Rae Ballroom will • not provide any money for the City, will inconvenience City operations and in his view would not provide any immediate benefits to the City of Fridley. The City Manager stated further that sewage would be deposited in the interceptor of the City of Fridley at the rate of 10,000 gallons two or three times per week. The sewage would be passed on to mains in the City of Minneapolis where it would be metered and the City of Fridley would be required to pay for the service. Mayor Nee stated that he believed it was necessary to confirm the good relations of the Village of Mounds View with Fridley, and for this reason, he supported the request of the Village that Fridley provide sewer service to the Bel Rae Ballroom. Motion by Thompson to authorize the City Manager to prepare an agreement with the Village of Mounds View for the City of Fridley to provide for disposal of the sewage of the Bel Rae Ballroom. BOARD OF HEALTH; REPORT Councilman Kirkham stated that he would like to discuss the problem of Mr. Lyle Quam concerning connection to the City Sewer Main. Councilman Kirkham stated that the house of Mr. Quam was built before the City sewage mains were built and that he would like to be informed as to the reason why the City sewage main was not constructed in such a manner as to enable Mr. Quam to drain his basement into the sanitary sewer main. The City Manager stated that the City cannot require all the property owners along this interceptor to pay for construction of the main at a sufficiently low elevation to enable one home to drain the basement into the main. The sewage main is located at a sufficient depth that it can provide service to all of the house of Mr. Quam except the basement, and Mr. Page 10, Quam can receive sewage service for the basemant by installing a sump pump to provide drainage from the basement, • Mayor Nee inquired what the City had done for the property owner on Talmadge Way who had a similar problem. He asked whether the City had purchased a sump pump and installed it for the benefit of the property owner. The City Manager answered that he did not remember what the City had done in that case. Mayor Nee stated that he believed it might be reasonable to furnish a sump pump, connect it and install it to provide sewage service: to Mr, Quam, if Mr. Quam were to pay the full assessment for construction and connection to the sewage interceptor. Councilman Thompson stated that he wished to commend the Health Officer for his very vigilant concern for sanitation in the City of Fridley. The Mayor asked the City Manager if he would pass along Mr. Thompson °s commendation to the Health Officer. Motion by Kirkham to receive and file the report of the Health Officer. Seconded by Wright. WOODS a STREET EASE11INT: The City Manager explained that the property owners, Mr. and Mrs. Woods, would not sign the quit claim deed to provide an easement to the City for 25 feet of street which the City needs for construction of McKinley Street. He stated that the property was already heavily assessed and that he felt that the Council could do nothing now to defer assessments against the property in the future. MEMO - STRUCTURE ON LUTE 32 AND 331 BLOCK P L RIVERPIEW _HEIGHTS ADDITION: The City Manager explained the request of the Alan Construction Company for a Building Permit to build upon the foundation of a basement and also a request for construction of a home upon Lots 32 and 33, Block P, Riverview Heights Addition. Councilman Kirkham stated that he had taken a look at the property and believed the foundation of the basement home to be sound. Councilman Kirkham stated, however,that he hated to approve the construction of two homes on such small lots, even though the City has done so before in order to get rid of basement homes, shacks and other unsightly construction,and that granting the request of the Alan Construction Company would at least cover the basement home with an improved structure, The City Engineer stated that the superstructure of the proposed new home to be built upon the existing foundation was 10 feet from the lot line, that the owner owned the next two lots and the grant for a Building Permit should stipulate that construction on the two adjacent lets be set back 15 feet from the lot line in order to comply with the zoning ordinances. The Mayor inquired whether Allen Jensen, the Building Inspector, was recommending that the City grant the Building Permit to Alan Construction Company. The City Manager answered that the City Building Inspector was not but that he was for- warding the request to the Council. The City Manager stated that the Council could ask the Alan Constriction Company to provide plans for construction on the two additional lots. • Mr. Alan Peterson, representative of the Alan Construction Company, was present at the Council meeting. Mr. Peterson stated that the Alan Construction Company Page 11, • was interested in purchasing the lot with the basement foundations but would not purchase it if the City Council would not be willing to grant a Building Permit for constructing a house on the foundation. Councilman Thompson asked whether it would be possible for the City Council to grant the request for a Building Permit to construct a house on the existing foundation with a stipulation that the house on the two adjoining lots have a setback of 15 feet from the lot line, The Mayor asked if this question should not have been submitted to the Board of Appeals for a ruling. The City Manager stated that it was not submitted to the Board of Appeals because there was nothing the Board of Appeals could waive except the request for a setback. Councilman Kirkham stated than the basement home was becoming a juvenile hangout. The Mayor asked whether the vacant home had been condemned in the past and if so, why the City was now proposing to grant a Building Permit to construct a home on a condemned foundation. The City Manager answered that the basement home had been condemned as unfit for occupancy, but the foundation was sound and it was feasible to build a home on the foundation. The Mayor asked Mrs Peterson whether a bank mortgage will be used to finance construction of the home upon the basement foundation; Mrt, Peterson answered, "Yes." Mayor Nee asked Mrs Peterson whether the bank has examined the basement foundation with the intent of granting the mortgage for the construction of the home. Mr. Peterson answered that there was no point in having the bank examine the basement home until the property was improved,, Councilman Kirkham asked if it is correct that the code stipulates than a house must be built within 18 months after the issue of a Building Permit. Mayor Nee wished to refer this suggestion to the City Plainer and would like to have the Doctors meet with the City Planner,, The Mayor stated that he believed the Hospital should have supporting services in the immediate neighborhood, such as laboratories, oral surgeons offices, dental clinics, medical clinics, drug stores. Motion by Kirkham to direct the Manager to arrange and conduct a meeting between the Doctors of the Fridley Medical Center, the City Planner and any others interested in rezoning the area surrounding that North Suburban Hospital. Seconded by Thompson. Upon a voice vote, there being no nays, the motion carried unanimously. Councilman Thompson stated that Mr. Hafner had agreed to hire a planner to help plan the development of his land next to the N.S.H.D. hospital and had agreed to pay for the services of the planner. Councilman Thompson asked whether Mr. Hafner had done so. MINUTES OF THE MEETING OF FEBRUARY 23, 1965: �v The minutes of the meeting of February 23, 1965 were approved as corrected. BILL FRANK, FRIDLEY LITTLE LEAGUE: The Little League program has been expanded and will utilize two fields, one on East River Road and the NW field at the Commons. Would like to include a program for boys 13 - 15 years old but might have difficulty raising the additional funds needed for this program. Would also need an additional field for this group to play on. Have four men who would be willing to coach such teams if the Recreation Commission would sponsor a baseball program for this age group. The Commission will consider such a program and notify Mr. Frank. REPORT FROM THE PARK COMMITTEE: • The Committee withdrew their request for a full time Park Maintenance man. Paul Brown has worked out a list of projects for the Boy Scouts and other groups interested in Park maintenance and conservation. Boy Scout Troop 319 has done some work in the Fridley Parks. Construction of the Beach House has been approved and the low bid of $14,160.00 has been accepted. Members of the American Legion discussed a speed skating program with the Committee. REPORT FROM THE SCHOOL BOARD: The School Board appointed Mrs. Joanne Johnson to the Recreation Commission to fill out the term of Mrs. Valerie Nelson ending December, 1965. District 14 will construct a swimming pool in the Jr. High School. Jr. High addition will be completed in the fall of 1966. REPORT FROM PAUL BROWN: The Playground Program will follow the 1965 schedule as budgeted. Program will utilize the SRA puppet program and the SRA Crafts program. The Day Camp will be run in conjunction with the Playground Program in order to develop enthusiasm for a full -time Day Camp, Baseball age ranges will be reclassified as follows:: T - ball - 7 & 8 years, Pee Wee - 9 & 10 years, Cubs - 11 & 12 years, Juniors - 13 - 15 years. You will recall that some months ago I met with you and Wyman Smith regarding a dispute over a utility hook -up charge assessed against Mr. Wedan. After a lengthy discussion, we arrived at a compromise figure. To the best of my recollectionvm agreed at that time, to resolve the dispute over the hook -up charge for a sum of $300.00, it being understood that this was to be the entire cost of the hook -up and that any money paid by Mr. Wedan previously for the assessment would apply towards this figure. Following the above described meeting, I discussed the matter with Mr. Wedan and he felt that he would rather proceed with the law suit inasmuch as he did not feel that the city ordinance was fair and equitable. Since that time, I have discussed the matter further and Mr. Wedan and I agree that as a practical matter it would be better to dispose of the disagreement on the above terms . While I still question the validity of the ordinance, I do not believe that it would be to the best interest of Mr. Wedan or the City of Fridley to expend the money necessary to have a court determination of the ordinance. My file indicates that the city has appointed Andrew G. Kohlan as special council in the above suit. I have discussed this matter with Mr. Kohlan and have indicated to both Mr. Smith and Mr. Kohlan that we will dismiss the suit on the above terms. Mr. Smith has suggested that I write this letter to the council so that it may be placed on the agenda for the next meeting. The only method by which I can avail myself of full city senor .facility is to use heavy equipment, trench the entire distance, use larer sewer pipe, tear up pavement on Talmadge t�qy, and connect directly to sewer lateral in street. 16. The original contract price for sewer and water installation as previously described was X720.00. 17. The contract price for 6 inch line to sewer lateral in street is X1380.00. 18. The difference in cost is X670.00. 19. In view of the, fact that depth of the Talmadge Lateral could have been increased up to 30 inches, I hold to the opinion that the engineering firm planning and installing this lateral erred, for it fails to serve my property by conventional hook up methods. 20. As a Layman I am willing to accept the recommendations of the Engineering Department of The City of Fridley in the construction and slope of this sewer line from residence to Lateral as being "Praotioal" as well as a "Theoretical Possibility ". Therefore I would expect the City of Fridley to indemnify me against mal function of this line. 21. In addition to the specific aforementioned costs in running this line, I ask the City of Fridley to promptly replace pavement, curbs, and whatever other city property is disturbed by this operation. That subject additional costs not be assessed against my property, or that of others along this lateral. I urgently request a prompt decision in this matter. That the city code of the City of Fridley be amended by adding thereto a chapter designated as Chapter 77, entitled "Motor Vehicle Rentals ". Section 77.01 Definition of motor vehicles. For the purpose of this ordinance, motor vehicle shall mean any i self - propelled vehicle not operated exclusively upon railroad tracks. Motorized bicycles, motor scooters, motorcycles and the like are included within the definition of motor vehicle. This definition shall not apply to vehicles designed to be operated exclusively over snow, motorized wheel chairs, farm tractors, or other farm',implements. Section 77.02 License Required. No person, firm or corporation shall engage in the business of renting motor vehicles to any person or persons for hire unless said person, firm or corporation is duly licensed as hereinafter provided. I Section 77.03 Application. All persons, firms or corporations engaging in the business of renting motor vehicles shall file a written application with the City Clerk for the city of Fridley.';- application shall contain the following: (1) The name and business address of licensee; (2) The year, make, model, serial number and license number if the motor vehicle is an automobile; 0 (3) The serial number, license number, trade name and description of the type of self - propelled vehicle if other than an automobile. Said application shall be duly sworn to by the person or by the proper officer of ,'the company or corporation applying for the license. Section 77.04 Lessee shall be licensed. No licensee shall let or furnish any such motor vehicle to any person not having his or her motor vehicle driver's license issued in accordance with the provisions of the laws of the State of Minnesota. It is unlawful for any person, whether he be the owner or lessee of a motor vehicle, to permit any person 'who is not licensed by the State of Minnesota to drive or operate 58 such vehicle. Befgre letting, leasing or furnishing any motor vehicle to any • person, the licensee shall make a permanent and legible record containing the name, address and age of the person to whom the motor vehicle is leased, rented or let and 'shall record thereon the number and date of issue and expiration of the driver! :s license, together with the description of the person as shown by the driver's license, and identify the vehicle leased or rented to the person by the motor vehicle license number issued byl-the State of Minnesota, together with the date or dates of such licensing. It is unlawful to let, rent or furnish any motor vehicle to any person under the age of 18 years unless such person shall furnish and leave with the licensee a statement in writing showing the consent of the parent or guardian to the leasing or letting of the motor vehicle to such person. All records required by this section shall be kept for a period of not less than one year and shall at all times be open to inspectim by the Police Department of the City of Fridley. Section 77.05 Insurance required. No such license shall be issued to any person, firm or corporation to 59 engage in said business in the City of Fridley until the applicant shall obtain and file with the City of Fridley a policy of liability insurance, in an insurance company authorized to do business under the laws of the State of Minnesota. !IThe liability or indemnity insurance for each motor vehicle as in this chapterI defined shall be in the amount of $10,000.00 for injury to person or persons;',and shall provide for and be made to cover all injuries to property that may be'Icaused by said motor vehicle, not to exceed $5,000.00. Said resolution was read in full as follows: RESOLUTION N0. 48 -1965 A RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OF $715,000 SPECIAL ASSESSMENT FUND BONDS WHEREAS, the City of Fridley maintains a Special Assessment Fund to finance local improvements that are to be paid for, in whole or in part, from special assessments against benefited property, pursuant to Section 7.12 (d) of the home rule charter, and WHEREAS, the council is empowered by majority vote to issue and sell bonds pledging the full faith and credit of the city in order to anticipate the collection of special assessments in such amounts and maturities as it • may determine, regardless of the provisions of Section 7.16, and WHEREAS, the city manager has presented to the council his certificate showing the ;financial requirements for the issuance of bonds and requesting that the cou$ it authorize the issuance of Special Assessment Fund Bonds in the amount of $715,000, NOW, THEREFORE, BE IT RESOLVED By the Council of the City of Fridley as follows: 1 1. It islhereby determined that it is necessary and expedient to issue and sell $x715,000 Special Assessment Fund Bonds as authorized by Section 7.12 (d) of !the home rule charter of the city. WHEREAS, it has been the policy of the City Council of Fridley to discourage the use of Comstock & Davis, Inc., the consulting engineers for the City, from performing private engineering work for property owners and subdivision developers in the City, and WHEREAS the property known as the Johnson- Gravel Pit has long been a source of difficulty to the City, and WHEREAS THIS tract of land presents unusual topographical problems, and WHEREAS the adjoining neighbors of said tract; over many years, have protested any further gravel sale operations, and WHEREAS the tract has now been sold to Mike O'Bannon who intend# to level off thie property and develop the tract as a housing subdivision, and WHEREAS the development of the tract for a housing subdivision presents special problems to provide facilities for public water, sewer, streets, and storm drainage to the tract that would be unduly duplicated if consulting engineers other than Comstock & Davis, Inc. were employed. NOW THEREFORE BE IT RESOLVED by the City Council of Fridley as follows: 1. That the practice of discouraging the use of Comstock & Davis, Inc. as consulting engineers for a private development in the City of Fridley be waived in this instance. 2. That the consulting engineers, Comstock & David, Inc. be authorized to accept an assignment to perform engineering services for Mike O'Bannon in the development of the Johnson Gravel Pit tract if .such assignment is offered.
