I concur that, based upon the facts as stated in the letter, the assessment policy for State Aid Streets should be set each time an improvement is made. Lyle Qum is the only one that apparently fools the need to drain his basement. The Ug ineosaring Depa- rtmeut will have at the meeting the estimated cost for any participation the City Council might feel you wilt, to have the City take in this matter of providing lift for the basement into the surer line. • 20. WATER, SANITARY S WU MM STORM SEAR ON FIRF►SILI$r Walls Mr. Brook wishes to place these utilities in Fireside Drive, which poses certain problems, namely, the manner in which the City would assess for this, and also# the manner of acquiring the proper right -of -way, some of which he has promised to deed, but has not donne so. 21. PAVING ON JACKSON STREET - XSA 317s The developers of Melody Manor wish to pave Jackson Street, between 73rd and Osborne Roam, and this is designated as a State Aid Street. The question arises# does the council wish to let them proceed to put in a 36 foot wide street, and the City them put in the State Aid Street width later, or does the Council wish to have the administration attmat to find a way to finance this at this time? The subdivider has offered to put the street in at the 36 foot width to the 9 ton State Aid specifications, and in such a way that it could be widened by the City to the State Aid specifications and the concrete curb and gutter put in at a later date. The best solution would seem to be for the City to put in a State acid street and charge their costs to theme and state Aid funds picas up the difference. 202. This truck would replace a-%f048 pickup truck in the Engineering Department that was bought for $700.00 in 1964. Repairs on it now would run $300.00 to $350.00, and the engineer advises that a printing machine and a two --zay radio were budgeted in 1965 far a total of $1,600.00, both of which were purchased out of the budget of 1964, and therefore, this money is available plus the tradein of the used truck, which should be enough money to purchase a n CM0 Z would record that the Council pass the resolution, so that the Rngineering Department can purchase this new truck. 29. Mayor Nee stated that correcting the error would require passing a .motion to amend the minutes of the Council Meeting of April 5, 1965. Nye stated that he needed a Building Permit in order to be able to sign the papers required by the Postal Department for the construction of the Pont Office. IM signing should take place at 9800 A.M. on the following day. He stated further that the plans for the Post Office were given to him by the Postal Department and he had revised the plans to make them fit in with the rest of the construction of Moon Plaza. Mr. Julkowski stated that the Postal Building would be located upon the existing foundation aorth of the bakery in Moen Plana. Councilman Wright asked if the plans included a proposal for drive -up bones for depositing mail. Mayor Nee stated that future construction of commercial property on Plat 8 of Sylvan Hills might make it preferable for the furniture store to have two main entrances, one facing the front of the present shopping center and one in the rear. Mr. Levy stated that such a construction was possible but that he preferred not to redesign the plans of the furniture store at this time. In the Skywood apartments there are lockers on each floor of the building located in the utility roams of the building. He stated further that the utility rooms were separate rotors in the building and as such satisfied the fire codes for storage of combustible materials in a separate fire gated room. Councilman Wright stated that he believed the Council ought to prohibit the storage of combustible materials in the apartments. Councilman Sheridan stated that one consideration is providing more living space in the apartments and locating the lockers for storage of materials not caumonly used for the convenience of the residents. He stated that if the apartments in this construction were larger than the usual size it might be more convenient for residents to store their propetty in lockers located in the apartments, Page 7. . JAYCEZSo CARNIVAL: The City Manager stated that the City Attorney probably should be asked whether or not it was possible for the Council to grant a license to the Fridley Junior Chamber of Commerce for the sale of beer at the Carnival. Councilman Wright asked whether the request for approval to hold the Carnival included approving any site for the Carnival. The City Manager stated that this depended upon whether or not the Council wished to stipulate a site. The City Attorney asked whether the Fridley Jaycees had been granted a license to sell beer at the Carnival before. The Mayor' answered, "No," and added that the Carnival would only last for three days. The City Attorney stated that he would need a few minutes to check whether or not it vas possible to grant the Fridley Jaycees a license to sell beer at the Carnival. A representative of the Fridley Jaycees was present at the Council Meeting and stated that the Fridley Jaycees wished to include in the list of probable sites for the Carnival the Franklin Manufacturing property. The City Attorney stated that the request for a permit to play Bingo at the Carnival would have to be made to the Council in writing in order to comply with state statutes, The Mayor • stated that the Council did not have any provisions for licensing Carnivals and Bingo games. The City Attorney stated that the state statute required that a permit be issued for playing Bingo, and that nothing in the charter prevented the City Council from giving the Fridley Jaycees a permit to play Bingo. The City Attorney stated later that nothing in the ordinance or in the charter prevented the Council from giving the Fridley Jaycees a permit to sell beer. as suggested that it, would be possible for the Council to waive the fees for a beer license and that than ordinance provides that the license to sell beer extends for a full year. Councilman Wright stated that he had talked to the secretary of the Police Commission and that receipt of the money is not a critical item to the secretary, but the secretary has spent a considerable amount of time working for the Committee. Councilman llCirkham asked whether other secretaries have received any compensation for their work on the Commissions. Mayor Nee stated that he had received a preliminary report from the Bureau of the Census regarding the 1965 Census completed in Fridley. The report contained the findings of the census which found the population of the City of Fridley to be 24,759 as of April 1, 1965. He stated that the letter requested City officials to notify the Bureau of the Census if they believe the preliminary report to be incorrect, or if any population had not been counted in the process of completing the census. The City Attorney stated that a question might be raised whether • the residents of the rest home in the City of Fridley had been enumerated. PST1TiON W 5 -1965 TO DE1JM PORTION Of STREET P'RO.i6CT 1965 -1s Councilman Sheridan stated that he received a petition fray one of the property owners which had beam circulated amoung other property owners. The petition requested the Council to delete 58th Avenue from Quincy Street to Madison Street, Madison Street from Helene Place to 58th Avenue and Monroe Street from 58th Avenue to 59th Avemue from Streat Project 1965 -1. He stated that the reason for this petition is that property owners feel they cannot afford both sewer and street construction at this time, and that be would turn over the petition to the administration for processing. Councilman Sheridan stated further that the special assessments for the cost of this project on some of these lots are as high as $1,000 to $1,200 dollars per lot. The City manager directed the City Engineer to write a Change Order to be presented for Council approval at a future mating deleting these portions from Street Project 1965-1. He stated that apparently activities of the Police Department are not sufficient to prevent all vandalism in the neighborhood of the Youth Center. Councilman Wright stated further that the Board of Directors of the Youth Center have adopted a policy of allowing youths to enter the Youth Center, but not alloying thews to return once they leave the Youth Center. Be stated further that he believed it would be unfair to the Mouths to control the behavior of every young person in the neighborhood on the basis of complaints against the behavior of a small minority of these people, and that whereas more police work is needed outside the Youth Center, the number of complaints and the amber of young people involved in complaints is a small minority of the total number of younG people attending the Youth Center. Mayor Nee stated that the Council is sympathetic to the request of Mr. Christenson and aware that his report is not exaggerated. Sheldon Mortenson was present at the Council Meeting. He presented plans to the Council shoving the layout of the restaurant in the Skywood Mall Shopping *enter. The Plans showed a setback of 50 feet for the restaurant. Sheldon Mortenson stated that the ordinance required a setback of 80 feet. He said that as a result of the reduced setback, there will be a driveway in front of the building with parking in the back of the building. Councilman Wright asked how • close the nearest building would be to the proposed restaurant. Mr. Mortenson answered that the building would be in line with the grey house presently located on the property and that plans are not to build on the adjoining lot. Councilman Wright asked if the owners plan to build a motel in conjunction with the restaurant, eventually. Sheldon Mortenson answered, "No, not here." The City Attorney stated that be believed construction of the restaurant will bo a real credit to the cooaauaity. Councilman Thompson stated that it was conceivable the Minnesota Highway Department might object to the reduced setback of the restaurant since the Highway Department wants good road visibility. Sheldon Mortenson stated that he believed there would be more congestion of traffic in the area with parking in front of the restaurant and an 80 foot setback for the restaurant, than there woviltl be with the prevent plans for a 50 foot setback and parking behind the restaurant. The City Manager suggested that the Council could approve the request for a reduced setback with reluctance, and suggest no parking be allowed in front of the restaurant, Mrs Nortenaon asked the Council whether they mould merely pass a not -ion etat-_ag that they were receptive to the idea of changing the setback for the restaurant. He stated that the North Suburban Sanitary Sewer District was not obliged to provide sewers immediately for these communities but only to plan for them, and that the bill does not provide to the additional communities anything which the District did not originally plan to provide to totem The Mayor stated that the capacity in the sewage lines of the District is paid for out of user charges and that the only detriment that he could foresee In the addition of moro members to the District would be *hAt the majority on the board might change, 'the Mayor stated further that the bill allows the District to perform planning west of the river, if the District wishes to do so.. The bill provides that effluent may be discharged into the Sty. Anthony Pool. Mayor Nee stated that the present Board of the North Suburban Sanitary Sewer District is limited to 11 members, that with the addition of more communities to the District a reapportionment of the representation of the District will have to be made based on the population of the District, The bill provides for a means by which communities may be dissociated from the District, however, the proceeding is difficult. An amendment to the bill provides that the N,S,S_S,D. have access to the river for the discharge of treated effluent. This amendment was added to the bill apparently, to induce the District to add more communities to its membership. 34yor Nee stated that Senator Sosenmeier wished to kill the metropolitan area bill and provide the District with access to the river for the discharge of treated effluent, and provide for the establishment of a Southwest Sanitary Sewer District. He stated that he believed the solution to be a correct one and a sensible one to the problems of tba. area, Mayor Nee ,stated further that Senator HOiucp had advised his that if the amendment providing access to the river for the discharge of treated effluent does not pass or is detached frm the bill, that Senator Ho um will have the bill, killed. Mayor Net stated that it had been the policy of the District at the present time not to grant the request of the Village of Lexington and the Village of Circle Pines for membership in the N „S 6 S J S „D, In order that support for the bill might be increased by these communities. Councilman Sheridan, asked whys are terms in the bill given as limiting the discharge of effluent The City Manager answered that the provisions of the bill limited the discharged effluent to the standards of the Water Pollution Control Coamission and did not limit the quantity of the effluent which could be discharged into the river, Cou.aacilman Sheridan asked what action the N.S�S,S-D, could take in the future if the State or Federal Govern ant were to raise the standards of acceptable • effluent discharged into the river, The Mayor answered that the standard as Page 22. • presented by the Water Pollution Control Commission provided that, effluent . dischargoJ into the river have almost the same quality as that of drinking water and that he could foresee no change in the otandards since the standards provided that J© to 95% of the solids be reduced from the sewage an3 that equipment could remove 95% of solIJa depending on the flan of sewage through the plants The plant furtheroore could provide heavy chlorination to the effluent during the periods of lou river flaw. Councilman't7right stated that the standards for the discharge of the effluent depended upon the low level of the river, that the dilution capacity of the effluent was a factor in determining the character of the discharged effluent, and that there is no arbitrary ceiling on the number of cubic feet per second which could be discharged into the river. The Mayor stated that the effluent dill be of higher quality than the present water in the river* Councilman Wright asked whether it were possible for the District to grow as such as it aeoded or wanted to in the future. Mayor Nee stated that he bad called the Governer's office to try to find out if the Governerva office was of the opinion that the bill would not be passed. Be stated the Governer's office did not wish to render an opinion since there is a question of whether or not the Governer would veto the bill, The City Manager stated that there were two bills of this nature in the legislature this session: • one bill, proposed by the Minnesota League of Municipalities, is not likely to be passed this session; the other bill is being supported by Senator Rosenmeier. The league bill provides that the majority of the communities in a District that wish to adopt a project may do so by a majority vote„ Mayor lien stated that Senator Rosenmeier has been very co®perative and has helped the City of Fridley to a number of ways during the session and that he did not like to oppose the Senator on this bill. The City Attorney stated that it was generally to the interest of the City to oppose the bill in order to retain all the authority that a home rule City noxmalky has. The Mayor stated that there are no limitations in the bill specifying how far the legislature may go in determining the actions of a immicipality in conjunction with other municipalities. He stated that the legislature could discriminate arbitrarily without any recourse to the local community. He stated that he believed this to be a violation of the sense of home rule which is given to Cities having home rule chatters. The City Attorney stated that on a particular problem provisions of this bill weight be all right, but that he believed the bM violated the principle of home rule, The Mayor stated that he thought this bill would provide an opportunity for the legislature to interfere in the affairs of the local community and to resolve the problems of local comuuai,ties without the consent or action of local officials elected by the cowmfflities� Councilman Wright stated that he believed it would be necessary for the Council to indicate what they believe is in the best interest of the City of Fridley. Councilman Sheridan stated the Council would never know whether or not the application for Federal Funds for Urban Renewal in this area would be available unless they were to ask for the grant. This Council finds that each of the lotse pieces or parcels of land enumerated in said proposed assessment as altered and modified was and is specially benefited by the STREET IMPROVMENT PROJECT 110. 1963 -2 in the amount in said proposed assessment as altered and modified by the corrective roll in the amount set opposite the description of each such lot, piece or parcel of land, and that said amount so set out is hereby levied against each of the respective lots, pieces or parcels of land therein described. 6. Suaa proposed.assessment as altered, modified and corrected is affirmed. adopted and confirmed, and the sums fixed and named in said proposed assessment as latered, modified and corrected, with the changes and alterations herein above made, are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 7. The City Council received the petition and directed this office to advise all of the property owners on the streets that the Council at its regular meeting on May 3, 1965 at 8 :00 P.M. would take under consideration said petition, and decide whether or not these three streets would be removed from the Street Paving Project. This will not,be a formal public hearing, but the Council has asked that you attend this meeting if at all possible, so that the Council might discuss it with all of the property owners involved to assist the Council in making a decision. The Council also asked that I point out to you that the estimated cost to the property own- ers for this improvement which were given to you at the public hear- ing on the improvement has now been reduced by approximately 20% because the bids received were approximately 20% lower than the original estimated cost of the improvement. A review was made of the stand that the. Planning Commission had taken at the `last' meeting. The conclusion reached was to consider a specific plan for resoning''in this area, that part of the stipulation would be the presentation by Mr. Graham of how they plan to use this piece of property, the purpose being that this information, along with other studies conducted at this time would be used in arriving at a recommendation to the Council. Mr. Graham explained the property was purchased in 1948 and although it is in a soning'category.which permits apartments, he did not feel that an apartmoat building would he the proper structure on this property because of the traffic hazard. Mr. Graham stated there were several types of businesses he would like to get in, but until the property was zoned for such, he felt his hands were tied. The Commission asked Mr. Graham if he had considered ,applying for a Special Use Permit in order to get the type of business that he had in mind. Mr. Graham replied that he realised he could got a Special Use Permit but if, after the initial permit were i.s *ued, the business was not successful. then. in cyder to try something tlse, there could be several months delay getting a new Special V'se Permit.., qtr. These streets are State Aid Streets. It has been the'Council °s policy to assess property abutting an State Aid Streets for the benefits received. The work done under Project No. 69 consists of installing Sanitary Sewer, Water and Storm Sever in the plat of Meadommoor Terrace and Meadowsoor Terrace 2nd Addition. At the time of the petition for the improvements all of the property was owned by one person. Unless instructed otherwise by the Council the assessment roil will be prepared on the basis of past Council policy, that is the water and sever laterals will be assessed on a front foot basis, the service lines will be assessed on a per service basis, and the storm saver will be assessed on a square foot basis. The assessments would be due in one lump sum in the year 1966, unless the Council wishes to spread the assessments over a period of years.
