Mayor Nee suggested collecting a library of photos of Lhe disaster for
historical and possible 1ega1 use. The Mayor estimated that perhaps
$500.00 would defray the cost of purchasing prints, because many prints

the City Manager to acquire evidence of the tornado disaster damage, by
purchase of a variety of photographs from whatever source possible Upon

� The City Manager explained that the Building Board had approved the structure
on February 10, 1965 and the City Council had authorized granting the Bu�lding
Permit on February 15, 1965. Subsequently the school had been asked to dedi-
cate to the City a 30 foot -easement for the west half oF the right-of-way
of Arthur Street and that by doing so the convent building inanediately ad�acent
to the high school would be only approximately 23 feet fram the right-of-way
instead of the 35 foot setback required by the zoning ordinance.
Motion by Wright, seconded by Kirkham, that the Council reaffirm the granting
of the Building Permit for the Grace Catholic High School. Upon a wice vote,
there being no nays, Mayor Nee declared the motion carried.

CONSIDERATION OF CONTRACTORS LICENSE:
Mayor Nee advised the Council that he talked to Mr Giertsen, of Giertsen
Contracting Company, and had told Mr. Giertsen that he would ask for no
action by the Council tonight, but that he did want to have the Council
hear from Mr. Don Larson of 129 Horizon Circle at�out his experiences with
the contractor. Mr. Larson stated that his insurance company had sent an
ad�uster who didn't appear to be accomplishing anything so that he called
the company and had asked for a different ad�uster. The ad�uster then sent
was a Rod Tow, who told Mrs. Larson that the house could be xepaired and
that he would get Giertsen Compny, a contractor, to look at the house,
Mr. Tow told Larson by phone that the Giertsen Company said they could do a
repair easy for $8,000.00. The Giertsen Company finally got out�the house
yesterday (May 20, 1965) to look at the house, The Building Inspector had
posted the house for condemnation. Mr Tow wanted to settle but the
mortgage company, Farmers & Mechanics, had told Mr. Larson to go slow on a
settlement The bank gave him a list of contractors for estimates. Both
the contractors had told Mr Larson that repairs would not return the house
to its original condition. Mr. Larson presented a letter from Andy Gawel,
a contractor. Copy of the letter follows;

up.

Mr�. Jack Dickenson, a near neighbor, was told by a man identifying himself
as from Giertsen Company, who was at the site, that many of the citizens of
Feidley wanted "totals" on their houses, and then were sorry that this was
done. He also sald to Mrs. Dickenson that the condemnation notice on the
building had no meaning, Mr. Tow told Larson that the notice had no meaning
Mr. Ga11up, 5851 N.E. 4th St., appeared before the Council and stated that
he had been told that Giertsen Company would solve his problem. He had
gotten another contractor to bid, but the ad�uster has refused to came to
the property to determine what is tornado damage and what is not tornado
damage. The Contractor Mr. Ga11up has contacted could start immediately
but apparently Mr. Gallup will have to wait for an estimate by Giertsen Co

Monday, May 24, 1965, and direct the City Manager to inform Mr. Giertsen of

CONSI➢ERATION OF POSTING DEMOLITION NOTICE:
Mr. Dean Sohnson, an attorney, was present and said that he represented
Reupublic Insurance Company, Utah Home Fire Company, Universal Surety,
and Inland Insurance Company.
Mayor Nee stated that he is proposing something that has been on the horizon
for several days and had hoped that more of the insurance industry could be
present at this meeting to discuss the matter �aith the Council. He stated

that if the Council concurs in his proposal the notice will be published in
the St, paul Pioneer Press Sunday paper and the Minneapolis Tribune Sunday
paper, which notice Mayor Nee read. He stated that before the Council takes
action he would like to have comments about the proposal Dean Johnson
asked pertinent parts of ordinances applicable thereto. Sohnson stated polic�_es
were private contracts. Mayor Nee said that these buildings must come down
now, Mr. Johnson said that if the call is made asking for delay, can a
hearing be held Mayox Nee said, "Yes." The Council is meeting on Nlonday,
Wednesday and Friday during the next two weeks. The City Manager stated
that the City Hall wi11 be open specially on Saturaday May 22, 1965 from
� 8;00 A.M. to 4:00 P.M. to receive any calls requesting delay Mayor Nee
stated that the follow up on the demolition notices of clearing the sites
will take at least two weeks and that the condemnation notices have been on
all of these premises for at least 10 days. Councilman Wright stated that
there has been a notice posted on these premises by the Health Inspector
and by the Building Inspector and that there is a provision for appeal
from the demolition which he thought was satisfactory handling of the matter
Motion by Wright, seconded hy Kirkham for adoption of the program and
publication of the notice. Upon a voice vote, there being no nays, Mayor
Nee declared the motion carried.
MEMO FROM FINANCE DIRECTOA RELATIVE TO CHARGE FOR WATPA HOOIZUP:
Motion by Wright, seconded by Kirkham to table action on this matter to
Monday, May 24, 1965. Upon a voice vote, there being no nays, Mayor Nee
declared the motion carried
ENGINEERING INSPECTION REPORT:
Mayor Nee pointed out to the Council that this report was encouraging in
that the field men from the Corps of Engineers, and the Highway Department,
had recommended that the site clearance by the City of Fridley was eligible
for reimbursement by the Federal Government and had put an estimate of
over $180,000.00 for this work. Motion by Wright, seconded by Kirkham,
' to receive the Engineering Inspection report and authorize the City Manager
to apply for an advance in Federal Funds in the amount of 75% of estimated
cost, Upon a voice vote, there being no nays, Mayor Nee declared the motion
carried,
SAYCEES: PARK CLEAN-UP:
Mr. Dave Shubert advised the C�uncil that the annual Jaycees Festival cannot
be held this year because of the tornado and that the Saycees depend upon this
Festival for providing funds which are used in the parks and other civic
enterprises of the Jaycees and that the Jaycees therefore would like to Ue
considered by contracting for the clean-up of Locke Park Mr Shubert read
a proposal by the Jaycees as to the method by which they would clean-up the
Park, and the cost to the City for said clean up The Council suggested to
the ,Taycees that they bring the pnoposal back to the Council either on Monday
or Wednesday, and that they provide for a professional tree export and also
for a chzpper machine

MINNESOTA HIGHWAY DEPARTMENT APPROVAL OF TRAFFIC SIGNASL SP-0207-15:
RESOLUTION N0, 88-1965:
Mr Dick Braun, Deputy District Engineer for construction District 5, advised
the Council that the Council had not passed the Resolution approving the
plans for the traffic signals at the intersection of T.H. 4r`65 and West Moore
Lake Drive, because the service road to the Drive-In Theatre to be constructed
bythe Highway Department was not to be constructed from the Highway right-of-
way, but part of West Moore I,ake Drive of the City of Fridley was to be used
for this service road, Mr. Braun reported that although the contract did not
provide for improving West Moore Lake Drive to the service road, authorization
had now been obtained for the �naintenance funds of District 5 to be used to
widen West Moore Lake Drive where it intersected T.H. ��65 to 44 feet and to
resurface it from T. H. �k65 to where the service road would enter onto th e
Drive-In Theatre property.
Motion by Sheridan, seconded by Kirkham, to adopt Resolution No. 88-1965
approving plans for the traffic signals at T.H, �ii65 and West Moore Lake Drive.
Upon a voice vote, there being no nays, Mayor Nee declared the motion carried.
PROPOSAL - LOCKE PARIZ CLEAN-UP:
Dave Shubert appeared before the Council and stated that the Jaycees have
added to their original proposals the rental of a chipper machine and that they
have made an agreement with Mr. Kukachka to assist them in a11 ways possible
todeter�nine what trees should be taken down and trimmed etc., but that he would
not be available until Tuesday of next week. The Saycees fe1t, however, that
there was plenty of obvious work to be done that would not require a tree
expert so that if they did receive the bid they would begin work this week-
end. The State Forest�y Department also was agreeable to assisting the
Jaycees in the tree expert needs of the pro�ect, but they also were not avail-
able until mid-week. He stated that the proposal as submitted previously
had not been changed to any great degree but that their proposal was for
$5,800.D0 to restore area No. 1 and also the park ad�acent to Melody Manor
and at 75th Avenue Northeast.
Motion by Sheridan, seconded by Kirkham, to award the clean-up contract for
area No. 1 and Melody Manor Park and the one on 75th to the Fridley Jaycees
as per their proposal and as per Ordinance No, 3D1. Upon a voice vote,
there being no nays, Mayor Nee declared the motion carried.
