06/28/1965 - 00022028� � � �� THE MINUTES OF THE SPECIAL COUNCIL MEETING OF JIINC 28, 1965 ----------------------------------------------------------------------------- A special meeting of the Council of the City of Fr�dley was called to order by Mayor Nee at 8:10 P.M. ROLL CALL: Members Present: Nee, Wright, Thompson Members Absent: Kirkham, Sheridan LAND ALTERATION PERMIT FOR CHIES: Mr, Chies was not present to discuss the land alteration permit. Mr. Ray Herrington, who lives at 1561 Ferndale Avenue, which is near the area where the propused land alteration would take place, asked what Mr. Chxes intended to do.. The City Engineer repoxted that Mr. Cha.es has not braught in any detailed plans or drawings showing just what he does intend to do. Mayor Nee stated that Mr. Chies is asking to do some excavaking in connection with platting the property, but he feels Mr. Chies is primarily concerned with getting some material out of the area, but he may bxing in an intelligenk plat and if he does, the Mayor stated he felt that it might be best to permrt the platting The City Manager stated that he fe1L- that Mr. Chies needed fill primarily, and platting the propeity was not his prime concern Mr. Herrington stated he was concerned that Mr. Chies might leave a high bank around the edge. The Mayor stated Mr. Chies had promiaed he would post a bond to guarantee that it would be platted properly. Councilman Wright stated that the Council had asked Mr. Chies to contact the ad�acent property owners, but he apparently does not want to do this. Mr. Wright asked Mr Herrington and Mr. Gillispie if they wished to have the property developed and built on. Mr. Herrington stated that he does not ob�ect to having it developed, but he does not want the edges left raw. There was no action taken on the land alteration permit. COMMUNICATION FROM TEIEN - REFERENCE TO BUILDING ON LOTS 23 THROUGH 26, BLOCIZ �, RIVERVIEW HEIGHTS: Mr. Teien stated that after a conversation with the Building Inspector in the early part of 1964 he purchased 1.ots 23 through �6 with the understanding that he could build two houses on the property. Mr. Wright asked what assurance did he get, and Mr. Peien stated that he was led to believe that he could build two houses on these four lots. The Manager asked if this request for a building had not been made by the Tred Company previously. Mr. Teien stated that he had sold the property with the contingency that Tred Company could build two houses on the property, and that he was the fee owner. Mr. Wright asked Mr, Teien if he knew a11 the setback and side yard requirements etc., and could he build without furYher waiver. Mr. Teien stateck"that he thought he could. Mayor Nee stated [hat if he could show an intelligent site plan the Council might grant the request to hu�ld, G1en Thompson stated that if Mr Teien could bring in a site plan, with a plan of the proposed houses, the Council could give consideration to the p1an. Mayor Nee told Mr. Teien to bring this in, including on the site location for a possible future garage. He could bring it in for the meeting of Ju1y 6, I,ETTER FROM THE US DEPARTMENT OF COMNNIERCE CP�RTIFYING THAT THE OFFICIAL CENSUS SHOWS THE POPULATION OF FRIDLEY TO BE 24,789 PEOPLE: Motion by John Wright to receive the letter and place it on file. AMERICAN LEGION WITH REFERENCE TO PENCING OF BASENICNTS ON TORNADO DESTROYCD HOMES; Mr. Ronald Kinkel, of the Amexican Legion, was present, There was considerable discussion on the method of fencing these houses, and the feasibility of it. The Mayor felt that this cost could be covered under the disaster program. After considerable discussion Councilman Thompson moved that a resolution of public policy concerning fencing of basements of tornado destroyed homes be drawn for the Counc2i consideration on July 6, 1965, and a contract with the Fridle_y American Legion Post ��303 for doing the fencing also be drawn for the Council's consideration at the July 6 mePting. Seconded by Wright. IIpon a voice vote, there being no nays, the motion carried unanimously. �� LET'I`LR FROM MR. & MRS. JEAN ENGELBRECHT - THANKING THE MAYOR AND THE COUNCIL POR THEIR PROMPT ACTION ON CLEANING UP THE CITY AFTER THE TORNADO: Motion by Wright to receive the letter and put this on file, Seconded by Thompson. Upon a voice vote, there being no nays, the motion carried unanimously. A LETTER FROM THE MINNESOTA HIGHWAY DEPARTMENT - REFERENCE STORM SEWER PROJECT �k12: The Mayor read the letter from the State Highway Department with reference to ' Fridley Storm Sewex Pro�ect -0k12 which covers the area fzom 38th Avenue to 53rd Avenue and from University to Main Street in the Clty of Fridley. The letter outlined the proposed cost sharing for the storm sewer pro�ect. The Minnesota Highway Department wi11 construct the portion of the storm sewer within the Highway right-of-way. Pridley is to construct the 45th Avenue outfall line and all laterals outside the Highway right-�f-way. The cost estimate tor the City of Fridley for the construction from 38th Avenue to 53rd Avenue would be $26,150.00 and Fridley's share of the outfall line would be $104,201.00 not including engineering and other fees and not including the easement costs. Motion by Thompson to receive the letter and place it on file and znstruct the City Manager to prepare the proper res�lution for appropriate action on this matter for the meeting qf July 6, 1965. Seconded by Wright. Upon a volce vote, there being no nays, the motion carried unanimously. BUILDING P�RMIT POR GIET HOUSE STAMP COMPANY, 6440 iINIVERSITY AVENUE NORTHEAST; Mr. Nymark, representing Gift House Stamps, was present. Mr. Nymark stated the purpose of the I3uilding Permit was to reconstxuct the stoxe, as it was previously, to house the National Tea Company. The reconstructxon would involve putting on a new front and a new roof. The City Council pointed out that this lies within the area for a possible Urban Renewal Program and suggested to Mr. Nymark that he contact Mr, Hodne, the City Planning Consultant with reference to tying in the plans of Gift House Stamps with the City overall plan. There was more discussion concerning the procedures under the Housing and Redeoelopment Program. Motion by Thompson to refer the application to the � Housing and Redevelopment Authority foz� a recommendation. Seconded by Wright. Upon a voice vote, there being no nays, the motion carried unanimously. BUILDING PERMIT - SCHIRO -5849 UNIVERSITY AVENUE NORTHEAST: This property also was within the area being considered by the Housing and Redevelopment Authority. Motion by Thompson to refer this �uilding Permit application to the Housing and Redevelopment Authority for a recommendation. Seconded by Wright. Upon a voice vote� there being no nays, the motion carried unanimously. BUILDING P�RMIT AND ZdAIVEF - 6831 OAKLEY STREET NORTHEPIST - MR. LUEDERS Motion by John Wright to grant the Building Permit with the waiver of side yard setback to 8 foot 6 inches inste�d of the required 10 foot side yaad. Seconded by Thompson. Upon a voice vote, there being no nays, the motion carried unanimously. APPLICATION TO PARK AND OCCUPY A TRAILER AT 5608 - 4TH STREET NORTHEAST: This is a request by Andy Veres to occupy a trailer 'While his home is being reconstructed. Motion by Wright to approve the trailer permit for a period of 8 months, from Suly 1, 1965. Seconded by Thompson. Upnn a voice vote, there being no nays, the motion carried unanimously. ' REqUEST TO PARI� AND OCCUPY A TRAILER AT 596 - 63RD AVENUE NORTHEAST; This is a request by Donald Lee to occupy a trailer while his home is being rebuilt, Motion by Thompson to grant the permit to occupy a trailer at 596 63rd Avenue for a period of 4 months beginning July 1, 1965. Seconded by Wright, Upon a voice vote, there being no nays, the motion carried unanimously, PROPOSAL OP WALTER FR�EMAN: Mr. Freeman had made a pxoposal to the City Council for cleaning up the dump at 48th and Main Street at a cost of $2,200.00 and a proposal to clean up the � 57 dump at 59Ch Avenue and 7th Street at a cost of $900.00. There was discussion on this. Tt was pointed out that there would be sti11 one more dump to clean up, the large one at Locke Park. The City Manager stated that several Councilmen and people had contacted him and were anxious to have these two dumps cleaned up. Motion by Wright to approve the proposal for clean up of the two dumps on the basis of items one and two in the letter of Sune 25, 1965, submitted by Mr. Freeman. Seconded by Thompson. Upon a voice vote, thexe being no nays, the motion carried unanimously. BUTLDZNG P�RMIT FOR 7331 SAKER STREET NORTHCAST: � This is a request to repair a building damaged by the storm at 7331 Eaker Street, which is an industrial building, Motion by Wright to approve the Building Perm�.t. Seconded by Thompson. Upon a voice vote, there being no nays, the motion carried unanimously. SUILDING PERMIT APPLICATION FOR 6396 JEFFERSON STRE�T NORTHEAST AND REQUEST FOR WAIVER OF SIDE YARD AND ERONT YARD SETSACK. OWNERS NAME WAS MR R. C. HENDRICK Mr. R. C. Hendrick requested a waiver from 35 to 30 feet on the front yard setback and a waiver of a side yard requirement from 10 feet to 8 feet. Also, submitted was aletter signed byLawrence Hdmgren, the neighbor, agreeing to the side yard waiver. Motion by Thompson to grant the Building Permit and grant the waiver as requested. Seconded by Wright, Upon a voice vote, there being no nays, the motion carried unanimously. AEQiTEST TO PARK A TRAILER AT 730 KENNASTON DRIVE: The Manager stated that this had been okayed by the Plumbing Inspector and they wanted to use the trailer until their home was repaired. Motion by Wright to grant the permit to park and occupy the trailer at 730 Kennaston Drive for a period of 6 months from July 1, 1965. Seconded by Thompson. Upon a voice vote, there being no nays, the motion carried unanimously. REQUEST FOR A BUILDING PERMIT AND WAIVER OF SIDE YARD REQUIREMENT BY C.E � NEUERBERG AT 6598 CLOVER PLACE: A1so pxesented was a letter from Howard A. Stohl, 6588 Clover Place agreeing to the side yard waiver from 5 feet to 3 feet. Motion by Thompson to grant the Building Permit and the side yard waiver to approximately 7 feet of the side 1ot line on the corner. Seconded by Wright. IIpon a voice vote, there being no nays, the motion carried unanimously. BUILDING PERMIT FOR THE SERVIGE STATION ON'THC PROPERTY OWNED EY RANKO SCHUUA; Mz. SLm Gibbs, representing Ranko Schuur, was present and inquired of the Council if the Building Permit previously granted to Phillips Station was still good for the property. Mr. Gibbs stated that this permit had been granted before the tornado and that they are set to close but have to provide Phillips with assurance that the licenses can be obtained Mr. Gibbs stated that the Safety Committee had also approved the second location. Mr, Wright stated that this would be within the area under consideration by the Housing and Redevelopment Authority and the plans should coincide with their plans. Mr Gibbs also stated that Phillips Company had purchased the property immediately to the south which has been occupied as a fruit stand, from Schmedeke's. Mr. GibUs stated that pttillips had exercised the option on Uoth the Schuur property and the Schmedeke property. The Mayor suggested that Mr. Gibbs talk to Mr. Hodne the Planning Consultant for the City. There was no action taken by the Council on tfiis. � SEWER CLEANING PROPOSAL - CLEANING AND INSP�CTION PROPOSAL BY AMERICAN PIPE CLEANING COMPANY• Mr. Gottstein from American Pipe Cleaning Company, was present and made a presentation to the City Council explaining what type of work his company did, what his company had done in other areas that had been affected by the flood disaster and how the costs had been recovered under the disaster act He stated the Eederal Government normally pays 100% of their costs Mr, Gottstein made a lenghtly presentation showing the type of information the City Council would get when the job was completed including showing the conditions of all the lines which were inspected and the work which would need to be done. He stated that they have not had one City that the pro�ect has not been approved by the office of P�mergency Planning. He also presented a letter +3ated June 28, 1965, �� � from the American Pipe Cleaning Company outlining their proposal. Motion by Thompson to authorize the Mayor and the Manager to sign this le�ter and entex into a contract with American Pipe Cleaning Company to conduct a survey of the condition of the sanitary and storm sewer system affected by the tornado and flood disasters, Seconded by Wright. PUBLIC AEARING• SP�CIAL USE PEAMIT - DOUBLE BUNGALOWS - WOLKE: The City Manager read the notice of hearing. The Mayor asked whether anyone was present who would like to be heard on this question. There was no one present. Councilman Wright stated that he heard several ob�ect�.ons from the local xesidents living in the neighborhood of the proposed double bungalow, but he stated that when the neighbors saw drawings of the proposed building, they had no ob�ection to its construction. Mayor Nee declared the hearing closed. Motion by Wright to grant the request of Bernar3 Wolke for a Special Use Permit for the construction of a Double Bungalow an Lot 1, Block 1, Juli-Ann Addition, Seconded by Thompson. Upon a roll call vote, there being no nays, the motion carried unanimously. PUBLIC HEARING• STREET VACATION - SEFFERSON STREET; The City Manager read the notice of the hearing. The Mayor explained that the proposed street vacation is of a street dedicated to the City by the developer. The length of the proposed street vacation is one lot deep and the width is 60 feet. Leroy Innmon, property owner, on the west side of the proposed street vacation, was present at Che Council Meeting. He stated that he wishes to see , �J �
