THE MINUTES OF THE SPECTAL COiTNCIL MEETING OF NOV�MBER 8, 1965
A Special Council Meeting of the Council of the City of Fridley was called
to order by Mayor Nee at 8;01 P.M.
ROLL CALL
Members Present: Nee, Kirkham, Wright, Thompson, Sheridan

APPROV�IL OF MINUTES, REGULAR COUNCIL MEETING - NOVEMBER 1, 1965:
Motion by Kirkham to adopt the minutes of the Regular Council Meeting of
November 1, 1965 as submitted. Seconded by Sheridan, ilpon a voice vote,
there being no nays, the motion carried unanimously.
The City Manager stated that he has not received a reply from the Chamber of
Commerce, or any indication from the Chamber of Comnerce, concerning their
attitvde. towards the proposed ordinance. Councilman Sheridan stated that,
since the Chamber of Commerce has not replied as requested, he believes the
ordinance should be tabled until the Council has sufficient information
concerning the attitude of local groups towards the proposed ordinance.
Councilman Wright stated that he believes the Chamber of Commerce should be
informed that the Council has considered the ordinance but will not take
action until the City receives more information from private groups in the
City of Fridley.
Motion by Sheridan to table indefinitely consideration of the proposed amend-
ment to Chapter 56, regulation of signs, until the Council receives addrtional
information concerning the proposed ordinance. Seconded by Thompson. Upon a
voice vote, there being no nays, the motion carried unanimously.
SIGN PERMIT - BUAGER KING (TAI3LED 10/18/65):
The City Manager stated that he has received no additional information from
the Burger King Company concerning their application for a sign permit. He
stated that the Council previously asked Burger King to submit a design for
a smaller sign. Mayor Nee asked whether anyone was present at the Council
Meeting representing the Burger King Company, There was no reply. Mayor
Nee asked whether the present ordinance �rovides that the Council issue a
sign permit for the construction of signs, The City Manager answered that
this is correct.
Motion by Wright to table consideration of the sign permit application by
Surger King Company pending receipt of further information from the applicant.
Seconded by Sheridan. Upon a vory_ce vote, there being no nays, the motion
carried unanimously.
�NT - ARIDLEY - COLUMBIA HEIGHTS - S
The City �lanager stated that Columbia Heights has not yet completed hearings
on financing construction of SS�i�12. He stated that Columbia Heights will
hold a hearing the following evening. Councilman Sheridan asked whether
Columbia Heights will act the same night the hearings are closed. The City
Attorney answered that he did not know whether or not Columbia Heights would
do so.
The City Attorney informed the Council that the Minnesota Highway Department
has re�ected bids for the pro�ect, since Columbia Heights has not advanced
financing for the pro�ect to the Minnesota Highway Department, The City
Attorney stated that he prefers to delay consideration of the agreements until
Columbia Heights acts on them,
The City Attorney asked whether the contractors who presented the tWO-Zo�aest
b�as to the City of Fridley indicated whether they would grant an extension
of time to the City, Duane Olson was present at the Council Meeting repre-
senting the Consulting Engineering firm of Comstock and Davis and stated
that Lametti & Sons, who have the low bid on this �ob, also have a low bid on

a construction pro�ect in Coon Rapids and are considering bidding on other
�obs. He stated that Mr. Lametti informed him that he would call the City
Manager�s office the following Wednesday ta find out if the Crty of Fridley
wi11 award a bid on this work or whether he should seek additional work.
Councilman Sheridan stated that the Administration should ask the contractor
for a five day extension of time to a11ow the Council to cansider the matter
at the regular Council Meeting of November 15, 1965, and inform the contractor
that the City of Fridley is willing to award the contract to him
The Crty Attorney sCated that the City Attorney of Columbia Heights is
� advising the City of Columbia Heights not to sign the contract before the
public hearings on same are completed. He stated that he is rather reluctant
_ to advise Columbia Heights to sign any agreements for this pro�ect He
stated that he *_hi_nks Columbia Heights might be ready to act by Wednesday
Mayor Nee called a special Council Meeting of the Council oE the City of
Fridley for Wednesday, November lOth at 8;00 P.M., �rith the provision that
should Columbia Heights approve the agreements,or should the meeting be
unnecessaxy, the Gity Manager will inform the Council that the special meeting
has been called off.

RESOLUTION AUTHORIZING AGREEMENT if54797 WITH THE MINNCSOTA HIGHWAY DEPARTMENT:
� The City Manager stated that the Resolution authorizing this agreement concerned
the �oint construction project with Columbia Heights, fte stated that pending
- completion of the agreements, the Council should not adopt the resolution.

SECOND READING OF ORDINANCE �k315 REZONING C-25 AND M-1 TO R-3A - YORTTON OF
SYLVAN HILLS PLAT 8:
Councilman Wright asked whether it is correct that consideration oi this
ordinance depends upon the rapidity with which connections are made to the
sanitary sewer system of the N.S.S.S.D. The Mayor stated that is not correct,
that this part of the sanitary sewer system wi11 be connected to a different
sewer system, rather than to the N.S.S.S.D.
Motion by Wright to adopt, upon second reading, Ordinance ��315 rezoning C-2S
and M-1 to R-3A, a portion of Sylvan Hi11s Plat 8, and publish same.
Seconded by Sheridan. Upon a roll call vote, there being no nays, the motion
carried unanimously.
READING OF ORDINANCE ��316 REZONING A-1 TO CR-1 PORTION OF OUTLOT 1
MANOR 4TH ADDITION:
Motion by Thompson to adopt, upon second reading, Ordinance �F316 rezoning
, from R-1 to CR-1 the north 400.00 feet of the west 217.80 feet of Outlat 1,
Melody Manor 4th Addition and puhlish same. Seccnded by Kirkham Upon a
roll ca11 vote, there being no nays, the motion carried unanimously.
SAFETY COMMITTEE MEETING MINIITES - OCTOBER 20, 1965:
Councilman Wright asked the City Manager whether he has data concerning the
traffic count at the intersection of 7th Street Northeast with 61st Avenue
Northeast, especially a traffic count of the number of vehicles making turns
at this intersection. The City Manager stated that he has traffic count data,
taken from automatic counters, and that it is not feasiUle to use the auto-
matic counters to determine the number of vehicles making a turn at an
intersection. He stated that the only way this data can be gathered is to
have an observer at the intersection count the number of cars that make turns.

The City Manager provided copies of the traffic� count to the Council. Council-
man Wright stated that�he believes the School Bo��ard and P.T.A. are correct
and a four-way stop should be provided at the infersection. Councilman Kirkham
stated that he is also in agreement with this argument.
Motion by Wright to receive and file the minutels of the Safety Committee
Meeting of October 20, 1965. Seconded by Sheri'dan. Upon a voice vote, there
being no nays, the motion carried unanimously. �
BOARD OF APPEALS MEETING MINUTES - OCTOBER 27 �1965:

of Mike Hafner and others for construction of a nursing home on
Outlot 1 in Melody Manor 4th Addition. He stat�ed that the Board of Appeals
recommended that the Special Use Permit be granited. He suggested that the
Council set a date for hearing the request for �a Special IIse Permit, since
the Council must hold a hearing on this request' in any event, and the City
Manager suggested further that this date for th,e Council Hearing be held
after the hearing held by the Planning Commissi'on.
Motion by Thompson to recei�>e and file the minu�tes of the 6oard of Appeals
Meeting of October 27, 1965, to note the reques',t of Mike Hafrier and others
for a Special Use Permit for construction af a nursing home in Outlot 1 in
Melody Manor 4th Addition, and set the date of December 6, 1965 for a Public
Hearing upon this request. Seconded by Kirkham. Upon a voice vote, there
being no nays, the motion carried unanimously. -
BUILDING BOARD ME�TING MINIITES - OCTOBER 27, 1965:
The City Manager stated that the Fridley 7aycees secured the agreement of
the School Board to locate the proposed warming house upon school property.
Councilman Thompson stated that he wished to have the Administration advise
the Saycees that it wi11 be necessary for them to bring this building up to
standards of the Building Code of ehe City of Fridley. The City Manager
stated that the Saycees promised to remodel this building and bring it up to
the appropriate standards. Coundlman Wright stated that he discussed the
matter with the Park Board and the Park Board agreed not to ob�ect to con- �
struction of the reservoir �g they are allowed to locate the warming house
near the szte of the future reservoir. The City Manager stated that the
Park Board agreed to set the warming house on skids so it would be possible
to move the warming house to a different location at the end of the season
and avoid interfering with construction of the new reservoix.
Motion by Kirkham to concur with the recommendation of the Building Board
and grant a moving permit to the Fridley 7aycees to move the Bungalow
Drive-In structure from Columbia Heights to Fridley Coomons Park to be used
as a warming house. Seconded by Wright. Upon a voice vote, there being no
nays, the motion carried unanimously.
PLANNING COMMISSION MEETING MINUTES - OCTOBER 28, 1965:
Dr. T. H. Lester was present at the Council Meeting and showed plot plans
and elevatxon of the proposed clinic to the Council. Dr. Lester stated that
since the first plans were presented to the City, the owners increased the
width of the boulevard another 17 feet. Councilman Wright asked the City
�ngineer whether drainage from the parking lot will be satisfactory. The
City Engineer stated that the plans do not show the grades and elevations
for Unity Hospital and elevations for the clinic match those of Unity Hospital
to provide drainage from the parking lot into the street.
Motion by Wright to concur with the action oE the Planning Commission and
approve the site plan of the proposed medical clinic. Seconded by Kirkham. '

COMMUNICATIONS
N.S.S.S.D: APPOINTMENT OF REPRESENTATIVE:
The Mayor stated thats+hever is the appointed representative of the N.S.S S.D.
in the City of Fridley will cotmnit the City to an expenditure of funds whenever
authorizing a pexmit for connection to the N.S.S.S,D. The Mayor asked whether
the persons proposed by the City Manager for these positions are bonded. The
City Manager answered that these persons can be bonded. He stated that
administratively the permits could be checked through his office before being
issued. He stated that both of the persons, whom he recommended for these
positions, are processing sewer pexmits at the present time. The Mayor stated
that the pexs.ms cera.fying sewer connections to the N.S.S.S.D. have responsibility
for these connections. He stated that these persons will have a great deal of
responsibility, and he is concerned whether these pereans should actually sign
these certificates. Mayor Nee asked whether the persons who check these
applications for sewer connection pexmits will be able to ascertain that
property owners have paid or been assessed fees for construction of the
sanitary sewer services to their property. The Finance Director answered that
there is a place upon the present sewer permit application where the Finance
Department verifies whether these people have been assessed for the proper
share of the system to which they propose to connect. Mayor Nee stated that
in signing the application for connection to the N S.S.5.D. services, the
person doing so certifies that the City of Fridley has the money to make this
connecti�.rn, and he believes this person should be in the Finance Department
or have charge of all City functions.
Councilman Sheridan asked whether it is possible that connections could be
made to the N.S.5.5.➢. line without taking an application for a sewer permit
from the City. The City Manager stated that this might be gossible, but that
it is also possible for persons to make connection to the City sewer at the
present time without a permit. He stated that he does not believe a large
number of people are doing so.
The City Manager stated that if it is found upon reviewing an applicat�..n
that there is no money for making the connection, the City can void the
permit. The City Attorney suggested that the Finance Director be appointed
the certifying official, since it would be necessary to certify that there
is money available for making these connections. The Mayor asked the City
Manager if he would be willing to act as the certifying officer to the
N.S.S.S.D. The City Manager stated that he could do so. The City Manager
pointed out, however, that bothc the Plumbing Inspector and the Superintendent
of Public Works are responsible to him through the City Engineer The Finance
Director stated that the Finance Department presently varifies assessments to
these officials for issuance of sewer permits at the present time. He showed
the Council the application forms which the City is presently using The Mayor
stated that each application will be worth $250, and he feels that persons with
greater authority than the persons proposed by the Manager should be certifying
these applications. Mayor Nee stated that the details on the work sheet
provided by the N.S.S,S.D. show that the N.S.S.S.D. is afraid that persons will
make connections to the system withoutauthorization to do so, and the City
should do whatever is feasible to insure that a11 connections are properly made.
Motion by Wright that the City of Fridley certify to the N.S.S.S.D. as
certifying officers authorized to process applications and issue pexmits for
connection to the sanitary sewer system of the N.S.S.S.S., the City NIanager,
Earl Tdagner, and as his deputy the Finance Director, Marvin Brunsell. Seconded
by Thompson. Upon a voice vote, there being no nays, the motion carried unani-
mously.

CITY �NGINE�R: ACCEPTANCE OF STREETS (PEARSON'S CAAIGWAY 2ND ADDITION):
Motion by Kirkham to concur with the recommendations of the City Engineer and
accept the streets in Pearson's Craigway 2nd Addition plat sub�ect to a one
year maintenance bond. Seconded by Sheridan. -Upon a voice vote, there being
no nays, the motion carried unanimously

Mr. King was present at the Council Meeting and stated that h�.µias owned
these four lots since 1950. He stated that the four lots have� dimensions of �
25 feet by 105 feet each. He stated that a house is huilt upon Lots 12 and
13e Lot -0kll is used as a driveway to provide access to this property, and
Lot ��10 wi11 be the srte of a future garage. He stated that he moved off the
property in 1958 and rented the same. In 1960 he connected the house to the
City sewer services and ran a water line into the house hut did not have a
meter installed or make inside connections to the water system. In 1961 he
sold the house on a contract for deed. However, the purchaser failed to make
payments upon the mortgage, and-the mortgagee ordered Mr, King to take back
the house from the purchaser and make the back payments. He stated that upon
searching through the unpaid assessments, he was informed by the City of
Fridley that these amounted to $21D0, but when he checked the assessments
with the Anoka County Assessor, he found the assessments amounted to only
$1500. He stated that he then checked these assessments again with the City
Assessor of the City of Fridley and was informed that the amount of the
assessments is $1300. He stated that there is an assessment of $685 on Lots
12 and 13 for water and sewer connection to these two lots, and he is willing
to pay this assessment since this connection has been made to his house. He
stated that there is an equal assessment against Lots 10 and 11, but as he
mertioned before, Lot 11 is used as a driveway to provide access to the house
attd Lot 10 is the location of a future garage. He stated that these two lots
will not be used as a building site and he sees no reason why he should be
assessed for the sewer and water services which apparently have been run into
this property.
Mayor Nee asked Mr. ICing who received the tax statements for this property. ,
Mr. King stated that the tax statements were given to Ttain City Federal
Savings and Loan, mortgagee to the property. Mayor Nee asked Mr. King who
was making the tax payments. Mr. King answered that he is paying the taxes
to the bank. He stated that he noticed that there was an increase of $4 per
month in the amount of the payment at the time this connection could have
been made, but he stated that he did not believe that this was a charge for
the connection, but rather an additional charge for an increase in taxes.
Councilman Sheridan stated that the assessments for.this construction were
made on the former basis where 75% of the cost was assessed against the building
site and 25% of the cost was assessed on a per front foot basis. Councilman
Sheridan asked what is the front foot charge for this construction. The City
Finance Director answered that the amount is in excess of $12 per front foot.
Councilman Sheridan stated that for the one hundred foot building site then
the cost would be in excess of $1200. The Finance Director answered, "Yes."
The Finance Director stated that the charge would amount to $342.28 for each
25 foot lot, Councilman Kirkham asked what amount of this charge against
two lots the property owner owes to the City. Mr. King stated that he believes
that one-half the taxes have not been paid.
Mayor Nee asked the Finance Director what is the condition of the pro�ect
accounts. The Finance Director answered that this construction pro�ect has
been combined with other pro�ects in one bond issue, and that an abatement of the
single assessment would not be a great amount as far as the total fundzng of '
these combined pro�ects is concerned. The Finance-Director stated, however,
that if the precedent were set that some of the assessments are abated, a
sufficiently large number of such abatements could result in a deficiency in
the funds. The Pinance Director stated that there are many such 50 front foot
building sites assessed. He stated that in some cases the extra charges were
paid and the sites were not used for buildings.
The Council examined an aerial map showing the location of Mr. King�s property
Councilman Wright asked Mr King if the City were to abate a portion of the
assessments, would Mr. King be willing to splrt the amount with the City.
Mr. Izing stated that he would not ask for a refund on taxes which he has

already paid, but that he would like to have an abatement of the remainder
of the assessment against Lots 10 and 11. Councilman Sheridan stated that he
would like to postpone, until the following Council Meeting, consideration
of the abatement in order to give the Council time to examine the building
sites.
Motion by Sheridan to table to the regular Council Meeting of November 15,
1965, consideration of abatement of sewer and water assessments against
Lots 10 and 11, Block A, Riverview Heights Addition to allow the Council
time to :eview the siCe. Seconded by Kirkham. Upon a voice vote, there
being no nays, the motion carried unanimously.
MEMO: REFUND OF CASH BOND;
Motion by Kirkham to concur with the recommendation of the Building Inspector
and release the $500 performance bond provided by Mr. Mistelske. Seconded
hy Sheridan. Upon a voice vote, there being no nays, the motion carried
unanimously
JAYCEES; LOCKE PARK CLEANUP:
The City Manager stated that this additional bill is apparently part of the
cleanup work included in the bid received by the Fridleq Jaycees He stated
he did not know why this bill was presented to the City. Mr, Tonco was
present at the Council Meeting and staeed that he is a member of the Fridley
Jaycees, but that he is not on the committee responsible for Locke Park
cleanup He stated that the Fridley Jaycees hired four items of inechanized
equipment which were brought into Locke Park to perfoxm some work which the
City wished to have completed. He stated that he belie ves this charge may Ue
the rental on these four items of equipment.
Motion by Thompson to defer consideration of the estimate of the Fridley
Jaycees for Locke park cleanup, and ask the P'ridley Saycees for a supporting
statement explaining their request for these additional funds. Seconded by
Tdright. Upon a voice vote, there being no nays, the motion carried unanimously
CIRCLE PINES: RESOLUTION:
Motion by Thompson to receive the resolution from the Village of Circle
Pines. Seconded by Kirkham. Upon a voice vote, there being no nays, the
motion carried unanimously.
PTA: 4-WAY STOP,7TH STREET AND 615T AVENUE NORTHEAST:
Motion by Sheridan to receive the communication from the PTA and forward same
to the Safety Committee along with data of the traffic count at the sntersec-
tion of 7th Street Northeast with 61st Avenue Northeast Seconded by Wright

CITY ATTORNEY; SEWER LATSRAL ASSESSMENT:
Councilman Kirkham stated that in view of the fact that the assessment for
connection to the sewer lateral should have been made nine years ago, that
the property has changed hands several times, the last change being seven
years ago, and since the property was not assessed at this time, he favors
abating these assessments,
Motion by Kirkham to abate the assessment for sewer connection to Lot 1,
Block 4, Ostman's 3rd Addition. Councilman Sheridan stated that he would
second this motion for the purpose of discussion.
Councilman Sheridan asked Councilman Kirkham whether he 7�s proposing that
the entire assessment be abated. Councilman Kirkham answered, "Yes,"
Councilman Sheridan stated that he does not favor abating the entire assessment
Councilman Sheridan asked the Finance Director how the assessment was
computed. The Finance Director stated that the amount of the assessment was
computed using the curzent figures for the average cost oE a sewer lateral
connection. Councilman Sheridan asked what is the cost of the sewer lateral
assessment to the property at the time it should have been assessed. The
Finance Director stated that the 1ot ad�oining this one, which was connected
to sewer services at the same time and which lot is the same size as this
one, was assessed a cost of $346.69,

Councilman Sheridan stated that he does not believe that any property owner
has a right to free service of the sewer lateral and that a property owner
should pay the cost of the assessment as it should have been made in 1956
and not the cost of an assessment for connection in 1965.
Councilman Kirkham stated that this property has changed hands twice, and
that the present owner has really been caught in the middle as the owner of
the property when the assessment was found and is getting stuck for the amount,
whereas, a previous property owner should have paid this amount Councilman
Sheridan stated that if the City would accept such a policy, it would a11ow
any property owner who sold his property before an assessment was spread to �
get out of paying such an assessment.
Councilman Sheridan asked Mr. Schmedeke whether he would accept an assessment
based on the 1956 cost of sewer lateral connection instsad of the present
cost. Mr. Schmedeke stated that he had asked the City Finance Department
twice previously, at the time that he bought the property and at the time he
sold the property, what the amount of outstanding assessments were against
the property. Ae stated that he was not informed of any assessment for
sewer connection charges. Mr. Schmedeke stated that when the attorney for
the purchaser asked for an assessment search, he was informed there would be
a future assessment against the property for the amount of sewer connection
charges.
Mayor Nee asked Mr Schmedeke whether he paid tkie quarterly charges for sewer
services. Mr. Schmedeke answered, "Yes." Mayor Nee stated that it would
seem that the proposal of Councilman Sheridan to assess the property for the
cost of the sewer lateral connection in 1956 is a reasonable one.
The Pinance Director stated that the City records show that there was no
special assessment search made against the property until October 13, 1965.
He stated that when a request is not made for a written search of special
assessments, pending assessments are not necessarily given to the property
owner. He stated that the form of a written assessment search, includes a
space for l�sting any future assessments pending against the property. Council-
man Wright stated that since the record show that no written search was '
requested by Mr. Schmedeke, there would be no opportunity for the City to
point out to Mr. Schmedeke that this assessment had not been made. He
stated that there was no record of any request by Mr, Schmedeke for a
written search, and Mr. Schmedeke's verbal request for a listing of
assessments against the property was made in a casual manner, whereas, the
proper request for a written search would have provided Mr. Schmedelce with
the information that this laterai connection charge was not made. Councilman
Sheridan stated that the property benefits from the connection whether the
assessment was made or not.
Mr. Schmedeke stated that he called and asked for the assessments against
the property �ust before the or}�er property owner asked for a written
assessment search, and was informed that the tntalLcharges were•$385 and
this charge for a sewer later�l connection was not given_to,h�.m,.:_Councilman
Sheridan informed Mr. Schmedeke that when he called he was given present
assessments against the property, and the future property owner by asking
for a written search, asked for both the present and future assessments
against the property. Councilman Wright stated that it would not be possible
for the City to ascertain that a sewer lateral connection charge had not been
made against this property unless a request was received for a written
assessment search.
Motion by Sheridan to amend the motion and spread the sum of $346 for the
sewer connection charge against Lot 1, Block 4, Ostman's 3rd Addition. '
Seconded by Wright. Upon a voice vote, there being no nays, the motion
carried unanimously.

Motion by Wright to approve General and Public Utilities Claims 4k6894 through

PETITION ik30-1965 FOA 7S4PROVEMENT OF JEFFERSON STREET TO 58TH AVENUE NORTHEAST:
Councilman Sheridan stated that this petition is for the improvement of a street
which costs may be only assessed on the west side of the street since the easement
is 30 feet wide, and what would noxmally be the east half of the street has
building sites upon it. Mayor Nee asked the City Engineer whether the City
has done any work on this street The City Engineer stated that Mr. Ben�amin
wanted the City to remove the sand which could not be used in the street
construction from the street. The City Engineer stated that the City did so
and that in doing so, the street was offset around four trees located on the
street easement. He stated that he did this in order to comply with the
�aishes of the Council not to destroy any more trees than necessary. He
stated that now Mr. Ben�amin would like to have the trees removed from the
easement.
Councilman Sheridan asked the City Engineer whether the specifications for
street construction are four inches of sub-base material with a one and one-
half inch paving mat. The City Engineer answered, "Yes." Councilman
Sheridan asked the City Engineer what is the proportion of cost of each of
these materials. The City Engineer answered that the proportion is about
50%. Councilman Sheridan asked the City Engineer to compute the cost of
the sub material and the cost of the paving mat and inform the Council what
these costs are. Mayor Nee stated that after the costs are computed, the
City Engineer or the City Manager should refer these costs to Mr. Ben�amin
and find out whether Mr Ben�amin and the other property owner is willing to
pay the costs for improvement of the street.
Motion by Sheridan to receive Petition ik30-1965 and refer it to the

PETITION 4k31-1965 FOR IMPROVEMENTS ON ONONDAGA STREET NORTHEAST FROM STINSON
TO LAKESIDE:
The City Manager stated that this petition is signed by 50% of the property
owners owning 60% of the front footage along this street. He stated that
the property owners want construction of curb, gutter and street.

BUILDING P�RMIT - 339 - 57TH PLACE NORTHEAST - RICHARD MILLER:
The City Manager stated that this request for a building permit was made to
the City in the month of Suly and referred to the Fridley Housing and redevelop-
ment Authority since it was thought that there would be an IIrban Renewal Pro�ect
in this part of the City. He stated that the property owner indicated, when
he made the application, that he was willing to build upon this site a structure
to suit the Urban Renewal Authority�s plans, He stated that since it has been
determined that there wi11 proba6ly not be an Urban Renewal Pro�ect in the City
of Fridley, the owner wants to restore the condition of the present house to
the original. The City Manager stated that the Building Inspector finds that

this structure is not in very good shape and would like to see the structure
brought up to code, The Council examined an aerial map showing the location
of this structure.
Motion by Wright to grant the request of Richard Mi11er for a Bui� ing Permit
to repair a house at 339-57th Place Northeast, sub�ect to Mr. Mi11er bringing
the entire building up to standards of the City Code. Seconded by Kirkham.

CONSIDERATION OF PTR CHASE OF LOTS FOR TOT LOT:
� Mayor Nee asked whether the Park Board has considered the purchase of this
pm perty. The City Manager stated that the Park Board considered the purchase
of this property in the past, but the price the owner asked for the property
was too high. The City Manager stated that the Park Director examined the
property and feels that the lots could be used for recreational purposes.
Mayor Nee asked whether this item should be referred to the Park Board. The
City Manager stated that he believes it would be good to refer it to the Park
Board. The City Manager stated that there is no way the owner can build upon
this property without installing sewer and water services to the property and
constructing a cul-de-sac on Lot 3 to provide access to the property. He
stated that this would provide only one building site upon the two lots.
Councilman Thompson stated that he was a member of the Park Board when the
Park Board examined the site 3z years ago and found that the contour of the
lots made it acceptable for a recreation site. He stated that he would be
willing to vote on the project at this Council Meeting since the price which
the owner is asking for this lot is better than the original price, Council-
man Sheridan stated that the price the owner is asking for this lot amounts
to purchasing a good lot and getting an additional 1ot free. He asked whether
the City owns Lots 1 and 2. The City Engineer answered that the City owns Lots
1 and 2 with the water tower being on Lot 1 c�nd a booster station on Lot 2

B1ock 1, Horizon Heights Addition to the Park Board for consideration and
recommendation to the Council at the regular meeting on December 6, 1965.

STREET LIGHTS NOT INCLUDED IN THE 1965 PROGRAM:
The City Manager stated that he received a suggestion for installation of
one street T.ight in addition to the six given in the agenda to be located at
the beginning of the bulge of the cul-de-sac on the dead-end street going past
the Embers property, Councilman Wright stated that there would be no immediate
benefit from the installation of this street light He suggested that if the
owners wish to pay for it, the City could include it in the pro�ec�. Councilman
Kirkham stated that he would suggest that this light be omitted from the
project until there is a real need for it. The City Manager stated that there
is a possibility the County might pay for installation of street lights on
either end of the Main Street bridge since Main Street is a counhy road.
Councilman Sheridan stated that, since the diamonds and cloverleafs located
along the Interstate Highway ��694 will be lighted by the Minnesota Highway
Department, perhaps these would provide a sufficient amount oF light, that the
City could remove some street lights ad7acent to the freeway and not install
some of the lights ad�acent to the freeway. The City Manager stated that he
believes it is likely the Minnesota Highway Department will install a street
light at the intersection of 53rd Avenue Northeast with T.H. df65, and in that
event, the City could have the street light removed, or if the streetlight
were installed by the Minnesota Highway Department before that time, the
' City would simply omit the street light from the program,

PROPOSED ORDINANCE DESIGNATING CHAPTER 51 OF THE CITY CODE OF FRIDLEY AND
PROVIDING FOR A HOUSING CODE:
Mayor Nee stated that he is presenting this proposed ordinance to the Council,
and that in his opinion, this ordinance is a necessity to provide means for
the City to accomplish by direct action what might also be accomplished in part
through Federal Urban Renewal pro�ects. He stated that he believes the most
valid criticism of the proposed IIrban Renewal Program was that the City had
not exhausted all means at its disposal, before attempting Urban Renewal,
Mayor Nee stated that he asked the City Attorney to survey Housing Codes in
other cities and draw an ordinance to adopt a model housing code which could
be presented to the Council for consideration; He stated that this proposed
ordinance would be coordinated with the uniform building code and provides
for adoption of a housing code by reference.
The City Attorney stated that he discussed various housing codes with Mr, Hodne,
and Mr. Hodne mentioned three codes for use in the City of Fridley, He
stated that these codes were the American Public Health Code, the Code of the
City of Minneapolis, and the Unifoxm Housing Code. The City Attorney stated
that the American Public Health Code is concerned mostly with public health
matters related to the construction and operation of tenements, He stated
he does not believe this code would be as applicable to construction in the
City of Fridley as the IIniform Housing Code. The City Attorney stated that
the same holds true for the City Housing Code of Minneapolis, The C�ty Attorney
stated that the Uniform Housing Code is a small one amounting to 20 pages and
that half the 20 pages provide definitions of terms used in the Uniform Housing
Code. The City Attorney explained that the ordinance which he drew provides
for several exceptions to the Uniform Housing Code: Section 51.04.a provides
that the Planning Commission constitute the Housing Advisory and Appeals
Board; Section 51.04.b provides that penalties for failure to conform to the
Uniform Housing Code be the same as set forth in Chapter 105 of the Fridley
City Code; Section 51.04.c provides that the City Manager be designated the
Building Official as provided for in said Uniform Housing Code and the City
Manager be authorized to designate one or more officials of the City as
deputies; Section 51.04.d provides that multiple dwellings registration for

the City of Fridley sha11 be continued and not repealed by the adoption of
the IIniform Housing Code; and Section 51,04 e provides that the Dangerous
Building Ordinance not be repealed by the adoption of this Uniform Housing Code
The City Attorney stated that he asked the Minnesota League of Municipalities
for information concerning housing codes used by other cities, and was informed
that'the City of Fergus Fa11s and the City of St Louis Park in addition to the
City of Fridley use the Unifoxm Housing Code He stated that information that
the City of Eridley uses the Uniform Housing code is incorrect
The City Attorney stated that he made an attempt to get a sufficient num6er of
copies of the Uniform Housing Code to present to the Council He stated,
� however, that he was unable to obtain these copies, 6ut he believed they could
be obtained for examination by the Council at a future meeting The City
Attorney stated that he provided that the Planning Commission be the IIousing
Advisory and Appeals Board since the Planning Commission is closer to the
Council, and the Planning Commission could refer to the Board of Appeals
whatever items might be appropriately considered by the Board of Appeals.
The City Attorney stated that the information and the codes might be useful
to the Fridley Housing and Redevelopment Authority. The City Attorney stated
that the Uniform Housing Code deals with houses only and not with commercial
properties. He suggested that the Council adopt the ordinance to designate
Chapter 51 and adopt a Housing Code upon first reading at this meeting, then
after studying copies of the Uniform Housing Code, the Council could suggest
any other amendments which might be needed.
Councilman Sheridan stated that he would like to see copies of the Uniform
Housing Code before acting upon this ordinance Mayor Nee asked if the
Council adopted this ordinance upon first reading at this Council Meeting,
when the second reading would be. The City Attorney answered that the
second reading could take place 7 days later. Mayor Nee asked whether it
would be possible for the Planning Commission to study the Uniform Housing
Code before the Regular Council Meeting of December 6th The City Manager
answered, "Yes." Mayor Nee stated that he is convinced that the City of
Fridley needs to adopt a housing code such as the IIniform Housing Code.
Councilman Wright stated that this matter could be passed upon first reading
and referred to the Planning Commission, and studied Uy the Planning Commission,
� before the Council adopts the ordinance upon second reading. Councilman
Sheridan stated that he would prefer to refer the matter to the Planning
Commission first and ask them to study it. He stated that he did not like to
vote on a sub�ect which he has not studied.
The City Attorney stated that he discussed the use of a building code with
the Building Inspector and was informed by the Building Inspector that he is
using the IIniform Building Code of 1961 rather than the T,ater Uniform
Building Code fo 1963. He stated that he believes the Building Inspector
should adopt the changes and conform to the Uniform Building Code of 1963.
Councilman Kirkham stated that he did not wish to vote on the ordinance this
evemng.
Motion by Thompson to authorize the City Manager to order 20 copies of the
IIniform Housing Code and refer consideration of the ordinance providing
for a Uniform Housing Code to the Planning Commission Seconded by Sheridan
Upon a voice vote, there being no nays, the motion carried unanimois ly,
PIIRCHASE OF HEATERS FOR THE WASHROOM BIIILDING OP THE MOORE T,AKE BEACHHOUSE:
The City Manager stated that this item is a cost of less than 51000 and could
be installed without advertising for bids, He stated, however, that he
wished to have the Council authorize the Administration to purchase and install
� these heaters, Mayor Nee asked whether it would be possible to use the wash-
room building in the wintertime if these heaters are not installed, The City
Manager answered that it would not be possible. The City Engineer stated
further that because of the high water table in this area, it is necessary to
heat the slab of the washroom huilding at a temperature above freezing to keep
the slab from being damaged by frost,
Motion by Thompson to authorZZe the Administration to purchase and install
heaters in the washroom building of the Moore Lake Beachhouse Seconded by
Sheridan. Upon a voice vote, there being no nays, the motion carried unanimously

I'RIDLEY - BI,AINE AGREEMENT FOR IMPROVEMENT OF COIINTY DITCH �k17:
The City Manager stated that the Council previously discussed improvement of
County ditch -0f17 with the City Council of Blaine in a �oint meeting. He
stated that the Council agreed to the principles of the agreement at that
time, and this agreement would formalize the action of the City Council. The
City Manager stated that Anoka County needs this agreement before they can
begin work to improve County ditch �F17.
The City Attorney stated that this evening is the first time he has seen a
copy of this agreement. He stated that he discussed it with the City Engineer
and the City Engineer info�ed him that the agreement provides for
construction of an open ditch and the cost is not significant. The City
Engineer stated that he would like to point out that if at any time Fridley
should decide to enclose the open ditch and pipe the storm sewer, the cost
would be tremendous. He stated that as long as the ditch remains an open
ditch with no more pipeing than the culverts needed under roads and rail-
r oad, the cost to the City of Fridley would not be great Councilman Wright
asked the City Engineer whether it was the purpose of the agreement that
there would be only improvement of an open ditch with the installation of
culverts where necessary to cross roads. The City Engineet answered, "Yes."
Mayor Nee stated that the Village of Blaine made agreements for a contract
on the basis of the Joint Council Meeting with the City of Fridley, and would
need this resolution in order to act on those contracts. The City Manager
stated that if the Council sees fit to adopt this agreement, it would be
necessary for the Council to pass a resolution to do so. The City Attorney
suggested that the Council adopt a motion authorizing the Mayor and the City
Manager to execute the agreement, and ordering the City Attorney to prepare
a resolution and place the same on the agenda of the following Council
Meeting.
Motion by Sheridan to authorize the City Manager and the Mayor to execute an
agreement between the City of Fridley and the City of Blaine for improvement
of County ditch -0�17, and direct the Administration to prepare the appropriate
resolution for consideration by the Council at the regular Council Meeting of
November 15, 1965. Seconded by Wright. Upon a voice vote, there being no
nays, the motion carried unanimously.
AUTHORIZATION OF THE CITY PLANNING CONSIILTANT TO REVIEW THE LAYOUT OF 61ST
AVENUE NORTHEAST:
Councilman Sheridan stated that he wished to have the Council authorize the
City Manager to ask Hodne Associates to review the plans for construction of
61st Avenue Northeast on the property of Mr. Saliterman east of T.H. ��65.
Councilman Sheridan stated that businessmen in the area questioned whether
the present plans are the best possible layout for this road. He stated that
lie believes Mr. Hodne should be able to answer the questions of the business-
men concerning layout of the road.
Motion by Sheridan to authorize the City Manager to request Hodne Associates
to review the layout of 61st Avenue Northeast, east of T.H. �'k65, on the
property of Mr. Saliterman. Seconded by Wright. Upon a voice vote, there
6eing no nays, the motion carried unanimously.
