RESOLUTION ORDERING CONDEMNATION ON MSAS NO. 27- 307 -020, MSAS
NO. 27- 311 -020, MSAS NO. 27- 312 -030 (Street Improvement Project St. 1965 -2)
Pursuant to due call and notice thereof, the meeting of the City
Council of Fridley was duly held at the City I'.all, said City, on the 18th
day of January 1965, at 8:00 o'clock P.M. The following members were
present: Nee, Kirkham, Sheridan, Wri -.ht, T"ripson
The following members were absent: None
Councilman Sheridan introduced the following resolution and moved
its adoption:
WHEREAS, by previous resolutions of the Council of the City of
Fridley, it was determined to construct and extend the utility and street
system as provided in Projects MSAS Nos. 27 -307 -020, 27- 311 -020, 27 -312-
030 (Street Improvement Project_ St. 1965 -2) of the City of Fridley and to
acquire easements for said street and utility purposes, and
WHEREAS, the City Engineer determined that the projects were
feasible, and
WHEREAS, public hearings were held on the matter at the City Hall,
and
WHEREAS, following said public hearings, the City Council did resolve
that the projects were feasible and necessary and did approve plans and
specifications for the construction and installation of said street and
utility improvements, and
WHEREAS, as a part of said improvements certain easements are
necessary for construction and cannot be acquired by negotiation. The
easement required is described as follows:
Streets and Utilities:
MSAS N0. 27- 307 -020 - 73rd Avenue: That part of Outlot 1, Block 1,
Fridley Industrial Park Plat 1 described as follows: beginning at the
Northwest corner of said Outlet 1, thence South 44 feet along the West line
of said Outlot 1, thence in a Northeasterly direction to a point in the
North line of said Outlot 1 located 460 feet East of the Forthwest corner of
said Outlot 1, thence West along the North line of said Outlot 1, 460 feet
to the point of beginning, thence terminating. All lying in Section 12,
T -30, R -24, City of Fridley, County of Anoka, State of Minnesota.
MSAS No. 27- 311 -020 : Main Street:
(1) Lot 1, Block 1, City View Addition.
(2) Lot 1, Block 8, City View Addition.
(3) The-East 33 feet of Lot 3, Auditor's Subdivision No. 78
All parcels lying in Sections 22 and 23, T -30, R -24, City of
Fridley, County of Anoka, State of Minnesota.
MSAS No. 27 -312 -030:
(1) The West 33 feet of Lot 3, Auditor's Subdivision No. 155,
all lying in Section 23, T -30, R -24, City of Fridley, County
of Anoka, State of Minnesota.
(2) That part of the East Half (Ell) of the Fast Half (El-2) of
the Southwest Quarter CSW`.) of Section 14 that lies between
the East 40 feet thereof and the following described line:
beginning at a point on the South right of way line of Mississippi
Street located 88.53 feet West of the East line of said parcel,
thence South parallel to the East line of said parcel a distance
of 51 feet, thence on a tangential curve to the left with a
delta angle of 16018' degree of curve of 10.380 and a radius of
551 feet for a distance of 157.03 feet, thence southerly in a
straight line tangent to last described curve a distance of 57
feet, thence on a tangetial curve to the right with a delta

angle of 16018` degree curve 11.060 and a radius of 490.25 feet
a distance of approximately 45 feet to a point of intersection
with a line drawn paralled to and 40 feet W -st of the East line
of said East Half (Ei4) of the Southwest Quarter (SW'I) of Section,
thence Terminating, all lying in the City of Fridley, County of
Anoka.
NOW, THERFFORE, BE IT RESOLVED, by the City Council of the City of
Fridley as follows:
1. It is necessary for the purpose of street and utility improvement
that the above stated easement be taken.
2. Said easement is to be used as a street and utility easement for
the improvement as shown on the plans and specifications of
Projects MSAS Nos. 27- 307 -020, 27- 311 -020. 27 -312 -030 (Street
Improvement Project St. 1965 -2).
3. The attorneys for the City are authorized and directed to acquire
such easements by condemnation in Anoka County District Court.
The motion for the adoption of the foregoing Resolution was duly
seconded by Councilman. Kirkham and upon vote being taken thereon, all
members presented voted in favor thereof.
Whereupon said Resolution was declared duly passed and adopted.
