RES 1965-83 - 00011370115 RESOLUTION NO. 83 -1965 A RESOLUTION CONCERNING REMOVAL OF DEBRIS RESULTING FROM THE MAY 6, 1965 TORNADO WHEREAS, on the 6th day of May 1965, a series of tornadoes struck public and private property in the City of Fridley and caused great loss of life and property, and WHEREAS, there are vast amounts of wreckage and debris strewn over public and private property, the responsibility for which cannot be de- termined, and orders for removal of this debris cannot be given to the properly responsible parties and owners because they cannot be determined, and WHEREAS, this litter, debris and wreckage has proven to be a source of extreme hazard to the citizens of Fridley and an attractive nuisance to the children of Fridley in particular, and WHEREAS, the presence of such vast amounts of combustible litter presents a fire hazard of such proportions as to endanger other proper- ties and neighborhoods, and..,: WHEREAS, insanitary conditions exist in and because of this debris, litter and wreckage, and these conditions become more hazardous to public health as time passes, and WHEREAS, this debris presents excellent breeding areas for mosquitoes, flies, vermin rodents and other disease bearing insect and animal life, and WHEREAS, conditions exist which allow surface water to be introduced into sanitary sewers in violation of the disposal contract between the City of Fridley and the City of Minneapolis, and which could overload sanitary sewers and cause the flooding of homes throughout Fridley with ' raw sewage, and AEREAS, the presence of such litter and debris is detrimental to the property value of others in the City and impairs the credit rating of the City of Fridley, and WHEREAS, the City Council has been unable to properly and judiciously determine responsibility for removal and disposal of the wreckage, litter and debris, and that the scope of the problem is so broad, and involves so many private parties that it is impossible to solve the problem by bringing action against private parties, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley as follows: 1. That the City,Council finds that responsibility for clearance, re- moval and safe disposal of debris, litter and wreckage is a necessary and proper public responsibility. 2. That the City of Fridley will proceed with clearance and disposal of wreckage from private residential property on receipt of written request and authorization of private property owners. 3. That the City of Fridley will finance this function with public monies in the first instance, but that it must and will secure re- imbursement from other interested parties such as insurance companies, and Federal grants.
