page 6 is the building permit app].ication. On Pages 7 and 8
are minutes from previous council meetings, and an Page 9 is a
drawing of the situation. Although the vacating of this easement
from 30 feet to l2 feet neve� was consummated, it would appear
that the Council, if you so desire, could germit this garage to
be built onto this easement with an agreement from the builder,
in writing, that tYie garage would be removed at su�h time as the
easement rnight be needed. It has been checked out, however, and .
would appear that the City would never need more than a 12 foot
easement.

Minnesota has deemed it necessary and expedient that the improvements
hereinafter described be made.

STORM SEWER IMPROVEMENT PROJECT N0, 5(SCHEDULE C)
Notice is hereby given that the Council of the City of Fridley will meet at the
City Hall in said City on this 8th day of May, 1967, at 8:00 P.Mo, to hear and
pass upon all objections, if any, to the proposed assessments in respect to the
following improvement to-wit:
STORM SEWER IMPROVEMENT PROJECT N0. 5(SGHEI3ULE C)
The proposed assessment roll for each of said improvements is now on file and
open to public inspection by all persons interested, in the office of the Clerk
of said City.
At said hearing, the Council will consider written or oral objections to the
proposed assessments for each of said improvements.
The general nature of the improvements and each of them ,is the construotion of
storm sewer mains and connecting lines in the lands and streets designated in
manner as follows:
Storm Sewer and appurtenances in and serving the area bounded as;
Commencing at the intersection at the westerly rightof-way of the Northern
Pacific Railway and the Great Northern Railway and the northerly right-of-
-way�of Trunk Highway 4�694 (Formerly Highway ��100); thence east along the
northerly right-of-way of Trunk Highway �694 to its intersection with the
westerly right-of-way of State Trunk Highway �47; thence northerly along
the westerly right-of-way of State Trunk Highway ��47 to its intersection
with the southerly right-of-way of Mississippi Street thence westerly
along said southerly right-of-way of Mississippi Street ot its intersec-
tion with the westerly right-of-wag of the Northern Pacific Railway and
the Great Northern Railway, thence southerly along said westerly right-
of-way of said railways to the point of beginning.
The area proposed to be assessed for said improvements and each of them is all
that land benefited by said improvements or each of them and abutting on or lying
adjacent to the above named area. Said improvements will be assessed against the
propPrties within the above noted areas in whole or in part proportionately to
each of the lands therein contained according to the benefits received. The total
cost of the improvement is estimated at $246,000.00

had been fited in his office on the 17th day of Aprit, 1967, and that notice of
a hearing on said assessment to be held at ih� regutar meeting of the Council on
the 8th day of May, 1967, had been given in ttie form and manner as provided by
law. The Clerk presented an affidavit shor�ing publication.of such notice in the
officiat newsp?per, which affidavit was examined and found satisfactory and
ordered placed on fi1e.

BE IT RESOLVED By the City Council of the City of Fridiey, Minnesota, as foltows:
1. The City Cterk has with the �ssistance of the engineers heretofore selected
by this Council for such pur�pose, calculated the proper amounts to be
specialty assessed for the
STORM SEWER IMPROVEMEN7 PROJECT N0. 81
in said City against every assessable lot, piece or parcel of land in
accordance with the provisions of law, and has prepared and fiied with the ,
City Clerk tabutated statements in duplicate showing the proper description
of each and every lot, piece, or parcet of land to be specially assessed and
the amount calculeted against the same.
2.� Notice has been duly pubtished as required by taw that this Council would

6. Such proposed assessment as altered, modified and corrected is affirmed,
adopted and confirmed, and the sums fixed and named in said proposed assess-
ment as altered, modified and corrected, with the changes and alterations
�herein above made, are affirmed, adopted and confirmed as the proper special
assessments for each of said tots, pieces or parcels of land respectivety.
7. Said assessment so affirmed, adopted, and co:�firmed shall be certified to
by the City Clerk and filed in his office and shatt thereupon be and con-
stitute the special assessment for

8. The amounts assessed against each lot, piece or parcel of land shalt bear
interest from the date hereof until the same have been paid at the rate of
six per cent (6/) per annum.
9. Such assessrnent shall be payable in ten annual installments payable on the ,
, lst day of January in each year, beginning in the year 1968, and continuing �
until atl of said instatlments shall have been paid, each instatlment to be
collected with taxes collectible during said year by the County Auditor.
10..The City Clerk is hereby directed to make up and file in the office of the

such unpaid assessments and the amount which witl be due thereon on the lst
day of January in each year.
