;, WHEREAS, by a resolution passed by the Council on June 5, 1967
the City Clerk caas directed to prepare a proposed assessment roll for
the cost of the 1966-3 Street Improvement.
' WHEREAS, the Clerk has notified the Council that such proposed
assessment roll has been completed and fiZed in his office for public
' inspeetion. . .
NOW, THEREFOP,E, BE IT RE SOLVED, by the C�.ty Counczl of the
City of Fridley, Anoka County, Minnesota, as follows:

Gentlemen: • _
About ten days ago I received "A Resolution Regarding the Report and
` Recommendation of the Fridley Police Civil Service Commission�', together
with some enclosed documents.
Prior to my receipt of the City's resolution and attached documents, three
citizens from the City of Fridley appeared in my office to make a
camplaint in regard to the same matter as covered by the resalution and
requested that our office conduct an investigation based on their complaint.
We have in fact made a fairly extensive investigatian into this matter,
including a very thorough examination of all of the documents that have
been presented to us by these individuals as we11 as by yourselves. An
interrogation was carried on of certain of the police afficers and finally
a statement was taken from Chief McCarthy in the presence of his attorney,
Mr. Joseph Wargo, relating to the matter complained of by the individuals,
namely: with reference to the TV set. '
If actian were to be taken in prosecution, it would have to be taken under
Sec. 609.47 Minnesota Statutes Annotated, which reads as follows:
"Whoever intentionally takes, damages or destroys any personal groperty
held in custody by an officer or other person under process of law may - •
be sentenced to imprisonment for not more than l year or payment of a fine �
of not more than $1,000 or both.rr -
The elements necessary to be proven under that law are in part as follows: _
1) That the property is held in custody,by an officer or other person
under process of law.
• 2) That an individual takes the property from the custody of the officer
or other person or damages or destroys the property while it is'in
custody of the officer or other person. _

3) That the taking, damaging, or destroying is intentional.
Our investigation has fai led to supply sufficient facts to support any
charge under this section.
The request of your particular resolution is as follows, and I quote
from the resolution: �
"NOW THEREFORE, be it resolved that the Fridley City Council
hereby instructs the City Administration to forward said report of
the Fridley Police Civil Service Commission together with aIl supporting
evidence thereto to the Anoka County Attorney for his review and
comment".
Aside from the responsibility that I carried out as expressed earlier in
this letter, I do not believe that it is appropriate for me as County
Attorney to make comment on local matters as contained in the Police
Civil Service Commission report and recommendations. This is in my.
judgment totally a local matter to be controlled and administered by
yourselves and your appropriate appointed boards and not one that I
should become involved in.
The County Attorney's office and myself personally stand ready at all
times to assist any local unit of government to meet their responsibility
of providing police service in this what has become a terribly
complicated field of law enforcement.
If you have any questions about tiiis or any other matter, please do not'
hesitate to contact me.
