OPENING CEREMONY: Mayor Kirkham asked the audience to stand and �oin in saying the Pledge of Allegiance to the Flag. ROLL CALL MEMSEAS PRESENT: Kirkham, Liebl, Harris, Samuelson, Sheridan MEMBERS ABSENT: None APPROVAL OF MINUTES, REGULAR COIINCIL MEETING, NNL 5, 1967: Councllman Samuelson said that on Page 3, Line 3, under the heading, "PLANNCR SPECIFICATIONS", the minutes should be corrected to read, 63z% of the commanity feels that the present planning and rezoning is fair to poor, rather than sayiag fair to good. � MOTION by Councilman Samuelson to adopt the Minutes of the Regular Council Meeting of .Tune 5, 1967 as corrected. Seconded by Councilman Sheridan. Upon a voice vote, there being no nays, Mayor Kirkham declared the motion carried. APPROVAL OF MINUTES. SPECIAL PUBLIC HEAAING MEETING. JUNE 12, 1967: MOTION by Councilman Liebl to adopt the Minutes of the Special Public Hearing Meeting of ,Tune 12, 1967 as presented. Seconded 6y Councilman Harris. Upon a voice vote, there being no nays, Mayor Kirkham declared the motion carried. ADOPTION OF AGENDA: Mayor Kirkham suggested that Item 11, "REPORT ON OPEN SPAC� REQLiEST" and Item 13, "CONSIDERATION OF SALARIES" be deleted from the Agenda, and that the Council add Item 12-A, "APPOINTMENT OF TEMPORARY MANAGL�R AND PRELIMINARY SCREENING COMMITTEES". Mayor Kirkham said that there was also an additional license to be considered, and two additional communications, (E) LITTLE LEAGUE and (F) PAINTING FIRE HYDRANTS AND SIGNS. MOTION by Councilman Harris to adopt the agenda as amended. Seconded by Councilman Samuelson. Upon a voice vote, there being no nays, Mayor Kirkham declared the motion carried. PUBLIC HEARLNG - FINAL ASSESSMENT ROLL, STREP�T PROJECT 1966-3, SIDEWALK CURB � AND GUTTER ON MISSISSIPPI STREET: The Crty Manager read the Notice of Hearing. Mayor Kirkham asked the Finance Director to explain the assessment roll. She Finance Director said that this was for sidewalk, concrete curb and gutter on Mississippi Street from University AP�GULAR COUNCIL MEETING, JUNE 19, 1967 PAGE 2 Avenue to T.H. -0�65. He said that the cost of the curb and gutter is $1.34 � per front foot as set up, and the cost of the sidewalks is $2.12 per foot for commercial and schools and $1.06 per foot for residential as the Citq will be paying 1/2 of the residential cost. He said that if the ro11 is adopted, the property owner will have 30 days to pay the assessment with no interest, otherwise the interest wi11 be retroactive to this evening if the ro11 is adopted. Mayor Kirkham asked if any member of the audience wished to be heard. There was no answer. Mayor Kirkham asked if any member of the Council had any c�esfions. Councilman Harris said that it could be pointed out to people in areas that may be considering sidewalks, that at the last Council Meeting the Council established a policy to pay 50% of the cost of the sidewalk improvement if tkte people in an area decide they want sidewalks. A visitor to the Council Meeting read from the Notice of Hearing that all land is to be assessed proportionately according to the benefits received by such improvements, and asked how anyone can say what benefrts are xeceived. It was explained that this is assessed on a front foot basis. Mayor Kirkham said that usually the entire cost of a pro�ect is assessed to the adjoining property, but as the sidewalks are bezng put only in areas that serve the walk�ng school children and the heavily travelled thoroughfares, the Council decxded it would be fair to assess the people only half. Another visrtor to the Meeting mentioned that this winter the sidewalk had been covered with snow, and the children had to use the streets anyway. � Mayor Kirkham said that the City had bought a snowplow, but last year the snow came so thick and fast, that it was impossxble to keep up wxth the County street p1ow, hut he was sure that this would not be the case every winter. A visitor asked if the assessment included storm sewer, or if this would come later. The Finance Director said that this assessment does not include storm sewer, and there is none scheduled at present, but if there was to be a storm sewer in the future, hearings would be held. Mr. Thayer, President of the School Board, asked for the actual total assess- ment against the Hayes School site. The Finance Director said there were several different parcels, and figured them out approximately. He said that he was not sure that lOD% of the property was listed and asked Mr. Thayer if he would have someone stop in the office for the actual figure. Mayor Kirkham said that if anyone in the audience wanted to receive thelr assessment figure, they could ca11 the Finance Director at City Hall. Mr. Warren Scribner, 715 Mississippi Street Northeast, asked if the cost quoted per foot was the homeowner's share or if this would be reduced by 1/2. Mayor Kirkham said that the $1.06 figure was the homeowners cost. Mr. Scribner said that the City is go�ng to pay 1/2 and the schools are going to pay 100%, but it is really putting it from one pocket into another as it is sti11 the taxpayer who will pay. He said that some people are getting curb and sidewalks that they do not want, and he said his taxes have risen $300 a year without provocation. � Another visitor to the Council Meeting said that the brick retaining wall that was put in on his property is falling apart already. Mayor Kirkham REGUTAR COUNCIL NLETING, JUNE 19, 1967 PAGE 3 ' said that this work had been done by the County, and they are the ones that should be told about it. The visitor said that he had told them, and they had said he should geC some cement and fix it, Mr. Don Melton, 980 Mississippi Street, asked if the CiCy is sharing in any way on the co�t of the curb and gutter. Councilman Sheridan said that the County has a policy to pay 50% on the curbing in developed communrties, and the cost had originally been approximately $2.70 per foot rather than the $1.34 they wi11 be assessed. Mr. Don Melton said that he thinks the sidewalks are needed and worthwhile, bec�se of the way the City is laid out. He said that a11 the traff-ic comes down Mississippi Street as there is no secondary way to get around. He said that he felt this was a reasonable settlement, and as a taxpayer on the street he was satisfied. Mayor Kirkham declared the Public Hearing on the Fina1 Assessment Ro11 for Street Pro�ect 1966-3 closed at 8;25 P.M. RESOLIITION ��111-1967 CONFIRMING ASSESSMENT FOR STRE�T IMPROVEMENT PROJECT N0. ST. 1966-3: MOTION by Councilman Harris'to adopt Resolution �k111-1967. Seconded by Councilman Samuelson. IIpon a voice vote, there being no nays, Mayor Kirkham declared the motion carried. � PUBLIC HEARING - ON IMPROVEMENT STREET PROJECT 1967-1 (ADDENDIIM 4k4): The City Manager read the Notice of Hearing. Mayor Kirkham explained that this was the street improvement for 7upiter Drive from Rainbow Drive to Sylvan Lane, and Comet Lane from Trinity Drive to Jupiter Drive, and that the total estimated cost is $16,300, which w111 $gure out to $7.63 per front foot. Councilman Liebl said that he would like to mention that this takes into consideration an allowance of $1,594 from Storm Sewer Pro�ect No. 5 for street restoration work that will be used for the ne�a construction, so the people wi11 have a permanent street. He said that over 60% of the people on Comet Lane, and over 90% of the people on Jupiter Drive had signed a petition for this improvement and he wanted to thank the people in the 3rd Ward for their support of the pro�ect. Mr. Dick Schillinger, 6201 Trinity Drive, said he thought that Trinity Drive was to be inclu�ed in this pro�ect. Councilman Lieb1 said that they wanted to get these two streets in with the Rainbow Drive pro�ect. He said that the City Engineer had advased him that Trinity Drive will be put in with another pro�ect as only a certain percentage can be added to the present pro�ect, The City Engineer said that at present both Comet and Supiter were torn up, and two or three months is needed to go through the whole bidding procedure so Trinity Drive wi11 be done next Spring when there will be another big pro�ect to add it to. Councilman Harris said they would � not have added Comet Lane and Jupiter Drive Lo the Rainbow Drive pro�ect, Uut they had gotten a good price on 61st Avenue and felt that it would be good for the property owners to be able to take advantage of the good price. Mayor Kirkham said that it is a State 1aw that no more than 25% can be added to an existing contract, Councilman Lieb1 said he could assure Mr. Schillinger that if a contract is 1et in the Spring, his street wi11 be included in it. He said that he had tried his best to get 2t included, but it would be against the 1aw to add it to this pro�ect. REGULSR COUNCIL MEETING, JiTNE 19, 1967 PAGE 4 There was a discussion between several property owners and the Council about the way that side lots are assessed. The Finance Director explained that the assessment rate is figured by divxding the cost of the pro�ect by the front footage of the 1ots, and 1/3 of the side footage. Upon a voice vote, tttere being no nays, Mayor Kxrkham declared the motion carried, PUBLIC HCARING - STREET IMPROVEMENT PROJECT ST. 1966-fi - SRYWOOD COIIRT: The City Manager said that this Public Hearing has been ordered by motion at the Regular Council Meeting of June 5, 1967, but a resolution should be passed setting this date, June 19, 1967, as the official date of the hearing, RESOLUTION if113-1967 FECEIVING THE PRELIMINARY REPORT AND CALLING A- PUBLIC HEARING ON THE MATTER OF THE CONSTRUCTION OF CERTAIN IMPROVE- MENTS - STREET IMPROVEMENT PROJECT ST, 1966-6: MOTION by Councilman Sheridan to adopt Resolution �k113-1967. Seconded by Councilman Liebl, Upon a voice vote, there being no nays, Mayor hirkham declared the motion carried. The City Manager read the Notice of Hearing. Mayor Kirkham asked if there was anyone in the audience that wished to be heard on this improvement. Mr. Lee sr�i15, Mr. David Abrahamson, Mr, Myron Kidder, Mr, and Mrs. IC. Helfenstein, and Mr, and Mrs. Walter Walburg, all from Skywood Lane were present at the Council Meeting. Mr. Bri11s said that the Notice of Hearing states that the assessment is in proportion to the benefits received by such improvement, and he explained that his double garage faces the opposrte direction, and there is a sheer cliff behind him. He said he caanot see where he has any benefit whatsoever and did not feel he should be assessed. Mr. Abrahamson said that he has no benefit from the street either. Councilman Sheridan said that the first two lots have some benefits, as they do have drive-under garages, but the last three lots gain nothing. Mr. Brills and Mr. Abrahamson showed the Council pictures of their lots which stxowed the drop in elevation that they have. CouneYlman Samuelson said he could appreciate their belief that they were not getting any benefit. Councilman Sheridan pointed out that the original hearing on the street had not included anyone on Skywood Lane. Mr. Walburg said [hat it was too bad that the developer had not had to put in the street as they are required to do now, and he said it would be a shame to have a glorified alley be the best street in the neighborhood. He said this was in effect an a11ey because no houses front on it and it is only for access He said they would be satisfied if it was just tarred so they could have some help with snowplowing. Councilman Sheridan said that 7 lots would be the very maximum that would ever use the street. Councilman Harris said he could understand their concern as it seemed a lot of money for a street that �ust ' � , REGULAR COUNCIL MEETING, 7ITNE 19, 1967 PAGE 5 � 7 people would utilize, and as it is not built up, there wi11 be only 3 or 4 lots using it initially. Mayor Kirkham asked who had petitioned for this street. Council:nan Sheri�lan said that the Swanstrom Company who is developing the lots in back of Skywood Court petitioned for water, sewer and streets. Mayor Kirkham asked how wide this street is. The City Engineer said that a 30 foot street is proposed with a 50 foot right-of-way. MOTION by Councilman Samuelson that the three lots that actually face on Skywood Lane and do not receive any direct benefrts from the pro�ect be deleted from the assessment hearing if and when held. Seconded by Councilman Sheridan. Upon a voice vote, there being no nays, Mayor ICirkham declared the mo'tion carried. A visitor asked if this could be changed to a Cemporary oi1-type street. Councilman Sheridan said that the Court could possibly have a temporary mat, but the Lane would need a mat and concrete curb and gutters for proper dra$nage. There was a discussion about the possibility of deleting the concrete curb. The City Engineer said that the cost of the pro�ect is high because a storm sewer is needed for drainage into the highway ditch and this is included in the pro�ect, There was a general discussion on the assessment costs with the three lots deleted. Councilman Harris said that with the high cost he could not in clear conscience support this pro�ect at this time. � MOTION by Councilman Harris to delete this street improvement from the 1966-6 Street Improvement Pro�ect. Seconded by Councilman Sheridan. One of the visitors said that if this is to be deleted from the pro7ect, he would like to have some help with the snowplowing. Councilman Harris said that hefore the Council votes on this, rt may be in order to refer it to the Administration and Czty Engineer for some kind of suggestion that the people may be able eo work with. The City Engineer satd he would recommend they delete the concrete curb and gutter and put the improvement in, Councilman Harris said he would like to have Engineering come back with some figures fox the Council. The City Engineer said that the cost they are presently quoting would be reduced by $2.50 per foot. Councilman Sheridaa suggested they delete this from this year�s pro�ect and put it in next year's pro�ect for now. One of the =oisitors said that there has not been any washout problem since one hole was fixed, and he did not see how tar would wash out. The City Engineer said that when the street had traffic on it, it would wash away. Councilman l�arris said the best thing would be to wait for a report. Mayor Kirkham said that the motion for the Council's consideration was to delete this from the 1966-6 Street Pro�ect. Upon a voice vote, there being no nays, Mayor Kirkham declared the motion carried. � Mayor Kirkham asked if the Council wanted the Engineexing Department to bring back a report. Councilman Harris said that as long as it wi11 not be in this year's pro�ect, there is no immediate need for it to be on the next agenda, but it can be brought back at the earliest possible date for the Council's consideration. REGULAR COUNCIL MEETING, NNE 19, 1967 PAGE 6 TERRACING YARDS ON 61ST AVENUE SIDEWALK PROJECT: � Mr. John Weise sazd that he had been told that the terracing on 61st Avenue would be discussed at this meeting. Mayor Kirkham said that this item was not on the agenda. Councilman Liebl said that he and the City Engineer had talked to some of the people along 61st Avenue and some of them want a retaining wa11 and some of them want their lots sloped. He said this is a decision the Council must make and they wi11 be discussing it. Councilman Liebl said that he personally preferred a retaining wall, and the City Engineer suggested they be sloped back wherever they can so there will be no washout dirt on the sidewalks. He saidthey would 1ilce a uniform base, but iirst the street must go in, and then xt will be anothez month and a half before this will have to be done. Mr. Weise said he would like to have a retaining wa11 as his property has an awful drop. Councilman Liebl suggested he give his name and address to the City Engineer. ORDINANCE ik366 - AN ORDINANCE UNDER SECTTON 12.07 OF THE CITY CHARTER TO � VACATE STREETS AND ALLEYS AND TO AMEND APPENDIX C OF THE CTTY CODE - VACATING PORTION OF CUL-DE-SAC - MISSISSIPPI PLACE: CounciZman Harris said that there were some stipulations on removal and replacement on this vacation, and he asked if this was to be a separate agreement between the property owner and the City of Fridley. He said that this is not part of this ordinance and he wants to make sure that this ordinance is sub�ect to an agreement. MOTION by Councilman Harris to adopt Ordinance #366 upon Second Reading, waiving the reading, and ask the Administration to draw an agreement on the replacement of the curb, and hold the publication of this ordinance until the agreement is signed by the property owner and the City of Frxdley. Seconded by Councilman Sheridan. They explained to the property owner that if he removes part of the cul-de-sac he must have engineering approval, and if the street is borken up, it is to be repaired by him to City standards with City inspection. ORDINANCE 4�367 - AN ORDINk1NCE TO AMEND CHAPTER 46 OF THE CITY CODE OF THE CITY OF FRIDLEY - ADOPTING iiNIFORM BUILDING CODE: The City Manager explained that the section on Truss Systems has been deleted since the first reading because the Building Standards - Design Control Sub- � Committee is sti11 considering this problem. The Council discussed whether they should read the Ordinance over for the first time or pass it at second reading as amended. P�SOLUTION �k114-1967 ORDERING IMPROVEMENTS AND FINAL PLANS AND SPECIFICATIONS AND ESTIMATES OF COSTS THEREOF: STREET IMPROVEMENT PROSECT ST. 1967-1 (ADDENDUM ��3): The City Engineer said that he had given the property owners the price of valley gutters and concrete curb and gutter, and that he had received easements from the Lumber Yard and the property to the south ior sanitary sewer. The CityEngineer said that the owners do not want curbs, and his feelings were that if they were going to delete curbs at all, that they do it on both sides. Councilman Harris said he thought the property owners had agreed that curb should go on the east side, and it was the Council's concern that unless the water was channeled on the street, there would be an erosion problem, and so he felt they should have valley gutters. Councilman Samuelson asked if the gutter should run in front of the 5tandard Station also. Councilman Sheridan said he could not understand why they would need 500 feet of continuous access. Councilman Harris said that the whole edge oF the road would break up unless there was an edge of curb or gutter, and if they do not want curb they should have a valley gutter. MOTION by Councilman Samuelson to adopt Resolution �k114-1967 with a valley gutter on the west side for control of drainage. The Council discussed that there will be a standard section on the east side, and that curb cuts can be determined on the north and south, BIIILDING STANDABDS - DESIGN CONTROL SUBCOMMITTEE MEETING MINUTES, JUNE 6, 1967; L CONSTDF.RATION OF CONSTRiiCTTON �F STX - AND 4, HAYES RIVER LOTS ADDITION (5911-'L1-31-41-51-61 ANNA AVENUE NORTHEAST). REQUEST BY JAMES NELSON COMPANY, 7601 WAYZATA BOULEVARD, MINNEAPOLIS, MINNESOTA: The City Manager read the motion of the Subcommittee recommending approval of- the proposed apartment complex with certain stipulations, The City Engineer showed plans of the layout,as recommended by the Subcommittee, pointed out the easement and discussed the setback variance. The Council said it was a very nice looking complex. Councilman Liebl said that this will be quite an asset to the 3xd Ward, MOTION hy Councilman Harris to concur with the Building Standards - Design Control Subcommittee and approve the proposed apartment complex with the 1 following requirements as stiuplated by the Subcommittee� To approve with parking 1ot alternate t'�'1, sub�ect to the approval of the Board of Ap� als with respect to setback of garages, also sub�ect to dedication of Anna Avenue to south property line, and sub�ect to receipt of garage plans and screening in of rubbish disposal areas. CONSIDERASION OF CONSTR.UCTION OF A CONCRETE BUILDING ON LOTS 16, 17 AND � 18, BLOCK 4, HYDE PARK ADDITION. REQUEST BY M& I AUTO PARTS COMPANY, 6005 UNIVERSITY AVENUE NORTHEAST: Councilman Harris said that this construction had been discussed at the Regular Council Meeting of June 5, 1967 with Mr. Mi11er, representing the property owners. The property ownexs were present at the Council meeting" with their attorney. Councilman Harris explained that the Council did not want to put the owners in the position of spendin.g money they do want to spend, but they hoped they could find a common ground to enhance the front of the building. He said that the Council had discussed the possihility of a mansard roof or a brick planter to break up the straight block front, The attorney said that Mr. Mi11er had indicated to them that this had been discussed. He said that the suggested roof change would be a very costly item, and they t,n uld like an idea of the dollar value of a planter. It was estimated that a 32" or 36" planter along the sidewalk could cost about $600 or $700. The attorney explained that before any steps were taken to buy the building they had met with a11 the inspectors and had gone into every detail so they would know how many dollars they would have to spend on the improvements so they would have an idea of how much could be spent on the purchase. He said that this had all been figured out very carefully. Councilman Harris said he was sure they have met every requirement, and the Council's question was put on a friendly basis, not trying to push them in a corner. He said that in the City's interest they hoped to come up with something. Councilman Samuelson said that as University is one of the City's main thoroughfares, and to improve the general aesthetics of their building, � they had hoped for a better plan. The Attorney said that if they could leave this for the time being, and not have the permit contingent on this, and if it did not have to be done right away with the rest of the improve- ment, maybe they would come up with something even better. He said that right now may be the worse time for the owners to have to agree to this, but they have long range plans or they would not have purchased the property. He said they would like to by-pass this at present so they can get going. Councilman Harris asked if they could have some assurance, gentlemen to gentlemen, that they wi11 do something in front of the building. The Attorney said this was �ust a matter of first things first. The owners and attorney were thanked by the Council for their cooperation. MOTION by Councilman Harris to grant the Building Permit requested by M& I Auto Parts Company, 6005 University Avenue Northeast, with provisions as out- lined by the Planning Commission and Building Standards - Design Control Sub- committee, Seconded by Councilman Lieb1. Councilman Liebl said he was glad to second this motion, as he had been the one that had brought this to the attention of the Council, and he would like to get this building fixed up. ACCEPT CITY MANAGER`S RESIGNATION: MOTION by Councilman Harris to accept the resignation of the City Manager as per his letter received on January 3, 1967. Saconded by Councilman Samuelson. Councilman Sheridan said he thought the Council knew what his vote wouid be on the motion. He said he was concerned with the development of the budget for 1968, which should be in the Councal's hands no later than 5 weeks from this meeting, and he ca�uld move to amend the motion, that the Council ask the present City Manager to stay on and work on the budget until such time as there is a replacement for him or until he has relocated himself in anothez position, and during this period, he can pu11 together the budget figures from the different department heads to at least have a rough draft fox the Council on its due date. Upon a voice vote, there being no nays, Mayor Kirkham declared the motion carsied ORDINANCE DEFINING CERTAIN FIRE ALAP,M REPORTING SYSTEMS AND SET�TTNG FORTH RULES AND REGULATIONS FOR THEIR USE: The City Attorney said he has gone over this ordinance with Chief Hughes and Chief Aldrich, and Zt is like an ordinance that Minneapolis is using, tailored to the system Fridley will be using, the Chiefs were satisfied with it, and he said he was satisfied from the legal standpoint. Chief Hughes said that it wi11 cost about $3,000 rental which he will include in his budget for the coming year. He said that the line charges are paid by the people using them. Chief Aldrich said that the ordinance could be defined as the protecti�e covenants on the system. Councilman Samuelson asked if any street type alarm boxes, which we will have at a later date, are included in this ordinance. Chief Ald_ich said that those would be controlled by the contract wzth the Telphone Company. He said this was strictly an ordinance to protect the City from alarm systems that may exist in a plant that have been built up and added to, and �ere they ask the City to take over the supervision. FIe said he was interested because next yea7' the decision wi11 have to be made again. Councilman Samuelson asked about a storm sewer. The City Engineer said that th�r-e are a few�problems, but they can take care of it temporarily. (C) STATE FORESTRY: ELM TREES Councilman Harris said he was glad this has been looked into, and he said that he feels the City should fnllow it up. He said he would like to have the Administration devise some method to do some policing to get rid of the dead trees as suggested, because of the chance of breeding the disease. Councilman Samuelson had a model ordinance £or the Dutch Elm Disease that he had received from the League of Municipalities, and he said the City Manager had a model ordinance from Ohio. He suggested they be given to the City Attorney to outline a propo�edordinance, as he felt the City would need it. He said that this gives the right to go on pxivate property and outlines methods of dxsposal. Councilman Herris questioned whether, before this ordinance is on the books, it could be conveyed to the people that these dead trees do present a danger of Dutch E1m disease if they are allowed to remain on the property, He suggested the newspapers convey this to the public to get their cooperation in removal of dead trees. Mr, Paulson, a visitor to the Council Meeting, said he had called the Forestry Department about trees damaged in the storm, and they advised him on pruning and a healing chemical, and he felt that including some kind of education for the citizens would be a big help, Mayor Kirkhan said the County Agent may have some information ready for use. The City Manager said that it was ordered 1a:t week. Councilman Samuelson said he would like to point out what the Fridley Little League has done to this area. He said that they have taken eax delinquent, derelict land and made a recreational area everyone can be proud of. He sa�d that the Council should commend them on what they have done to improve the City, (F) PAINTING FIRE HYDRANTS AND SEMAPHORES Gouncilman Samuelson said that he has talked previously to the City Engineer and Chie£ Aldrich, and notices that the fire hydrants are being painted. He asked the Cxty Engineer the situation on paintzng the semaphores and stop signs. The City Engineer said that they are on the schedule and all signals that the City La�intains will be painted. VISITORS NIIt, WILBUR WHITMORE, INSURANCE FOR FIREMGN AND POLICEMEN: ' Mr. Whitmore said that there had been a meeting a week ago which the Policemen attended, and they concurred partly with the letter from the Insurance Committee, which had been on the agenda at the last meeting, He said that a year ago it was recommended there be $10,OD0 life insurance on the policemen, and the present proposal is for $7,000 additional. I-Ie said the policemen were asked, and they woald prefer to have $7,D00 double indemnity than $10,000 straight life. Mr, WhLtmore said that a year ago, one proposal had a rider to Lnsure dependents for $1,000 and the policemen indicated they would be willing to pay this portion o£ Che cost to add the rider to the insurance. He recommended to the Council that they take action on a$7,0�0 double indemnity policy, Councilman Harris asked if Mr. Whitmore had any figures on this. Mr. Whitmore said that he did not. Councilman Harris suggested that he get the figures and bring this back at the next Council Meeting. Covncilman Sheridan suggested that Mr, Whitmore make a report to the Administration, and they will put together the figures to have back on the agenda for the July 5, 1967 meeting. Councilman Sheridan said that the C�ty has no insurance committee as such, so if Mr. Whitmore wi11 give the Administration his findings and recommendation, the AdministraCAon wi11 gee the figures. Mr. Whitmore said he would do this, BATTERSON: PROPOSED LOT SPLIT � Mr. Batterson said that he had requested a proposed lot split be brought before the Council. The City Manager said that this has been turned over to the Plats and Sub-Divisions Committee, and he was not sure when they would be meeting, but possibly this could come before the Council ae the Ju1y Sth meeting. The Council discussed reviewing this, and making it sub�ect to the Committees approval to save time, but they did nbt have a survey so they c ould not act before the ,Tuly Sth meeting. REGULAR COUNCIL MEETING, JUNP� 19, 1967 PAULSON: STATIIS OP TRAFFIC SIGNALS PAGE 20 Mr. Paulson asked the status of the traffic lights to be installed at 57th and IIniversity. Mayor Kirkham infoimed him that the City has been notified they will be in and operational by October 1, 1967. Mr. Paulson commented on the difficulty of crossing Universitp Avenue because of the traffic, and the problem of entering University Avenue from I-694. Mayor Rirkham said that eventually this interchange will be signalized. Mx. Paulson said he hopes they dzd not caait untiZ someone lost their 1ife. ATTORNEY: NSSSD The City Attorney said he had talked to Dick Meyers, attorney for NSSSD, about a hookup for Commerce Park, and Mr. Meyers had suggested that the City make a formal application for the hookup. Mr. Meyers agreed that he did not feel that the Board had any authority to deny the hookup and he would so advise them. The City Attorney suggested that a formal letter or petition from the Consulting Engineer be presented to the Board. Councilman Sheridan said he and the Consulting Engineer would get a request to them, to be on the agenda at their next meeting. Councilman Harris said he had talked to the contractor, and he is anxious to get this hookup in so he can complete the closing on this property. CITY ATTORNEY; HAZARDOUS BUILDING ACTIONS The City Attorney said that one of the hazardous building actions that he has been working on is completed, and the other will be soon, and if there are any other buildings of this type that the Council wants him to act on, he suggested they turn a list into the Building Inspector or himself.
