THE MINUTES OF THE SPECIAL COUNCIL P1�ETING OP NLY 24, 1967
The Special Council Meeting of the City of Pridley was called to order by
Mayor Kirkham at 7:10 P,M.
OPENING CEREMONY;
Mayar Kirkham asked the audience to stand and �oin in saying the Pledge of
Allegiance to the Flag.

F'EDERAL LIIMBER COMPANY:
Mayor Kirkham stated that the people from the Federal I�umber Compaay had
called him to explain that they would not be attending the Council Meeting
as scheduled They had explained that they had a fire at their company and
were �ust not ready to meet with the Council. He said that they asked to
be put back on the agenda as soon as they have something ready for the
Council.
APARTMENT COMPLEX - FILISTER:
The Acting City Manager said that there were several questions the Council
wished to discuss with Mr. Filister. Incinerators, storage, garages, and
parking. He said that the Fixe Inspector and Health Inspector were present
to discuss the type of incinerator the City suggests and the type that
Mr. Filister wishes to put in his apartment buildings.
Mayor Kirkham asked the Health Inspector to give the Council a report
He said the Council was interested in why he disapproved of the incineratar
The Health Inspector said that the type of incinerator that Mr. Filister
wants is a single chamber incineraeor, and the Council would have to change
the ordinance to aLlow this. He said there wou13 be a distressing obnoxious
odor, and he could not conceive of a single chamber incinerator taking care
of a 462 unit apartment The Health Inspector went on to explain Che way a
multiple chamber functions. He said that the organic matter would be
reduced in the final stage to water and carbon dioxide. He said that the
multiple chamber is an air pollution device and many communities require
it. 'The Health Inspector said that he felt iC unwise to advocate a single
chamber incinerator as there is enough pollution, and Pridley should not
contribute to it.
The Fire Inspector drew the Council's attention to the report he had sub-
m�tted. He said that the Gity has not had much expexience with single
chamber incinerators as they are not permitted by code,
Mayor Kirkham said that he was proud Fridley has a modern forward thinking
ordl.nance as far as incinerators go, and he thought the City should stick
to it,

Mr. Filister asked if there is any type incinerator that is allowed, as
the City Code does a11ow incinerators. The Inspectors pointed out that
Ordinance No 335 allows multiple chamber incinerators approved by the
Health Inspector Mr. Filister said that they have literally put in
dozens of single chamber incinerators in their apartment buildings and
he invited the Council out to see that there was no pollution. He said
that they have yet to have problems with them.
The Inspectors pointed out the stringent ordinances of some of the surround-
ing communities. There was a discussion on the possibility of bugs in the
single flue incinerator; the reasons paper can be burned in this type of
incinerator but not garbage; different companies that make incinerators;
and the space required to install them
Councilman Liebl said that he had taken the ticae and effort to go to
Golden Valley and had spent 2z hours inspecting the apartment units.
He said that the room that housed the incinerator was very small but
he did not notice any odor. The Health Inspector said he was talking
about the odor in the atmosphere, not in the room. He said that he could
show the Council volumes of literature pertaining to pollution and to the
outcome of samplers put on stacks for testing. He said the Air Pollution
Commission wi11 be banning single flue incinerators and changing to
multiples. Mr. Filister pointed out that Mlnneapolis attd Golden Va11ey
allow them The Health Inspector said that they won't be fox long, and
that Minneapolis is contemplating stopping all burning.
Mayor Kzrkham stated that the City's Ordinance is very specific and would
have to be changed to a11ow a single flue incinerator. He asked if any of
the Council felt there should be a change. Councilman Samuelson said he
felt the City shou'Ld maintain the Ordinance they have and abide by it,
Mr, Filister as[ced if this meant he could, oz could not, incinerate.
Mayor Kirkham said that he would be able to incinerate but he must have
a multiple chamber as specified in the ordinance.
P4r. Cooperman, Architect, explained the changes they proposed in storage
units. The storage in the apartment buildings would be sufficient for
z the units and would be close to the 40 square feet required. The units
that do not have space in the building will have storage in the garages
Mr Filister said that z the tenants wi11 not be using the locker space,
and it can be switched back and forth between apartments. Mayor Kirkham
said that the proposed changes still do not meet the requirements for
space or location. He said the Council might be able to overlook whether
the space was on the first or second floor, but being short on space and
not being in the same building fa11s very short of the ordinance. Council-
man Harris asked the Architect why he did not, when he was dxawing the
plaas, take the ordinance into consideration and try to conform to it.
Mr. Cooperman said that he did not feel that the required storage was
necessary for this type of pro�ect, and that 25% of the storage space
in Golden Valley is not being used. He said that at no time have they
had any complaints on lack of storage. Mayor Kirkham said that another
point would be that the storage in the garage would invite pilfering and
burglaries Councilman Harris asked if the mechanical equipment filled
the space on the Eirst floor or would space be available in this area.
Mr. Filister said the space was pretty well filled.

� The CounciL went over the site plan and parking proposal wrth Mr. Filister
and Mr. Cooperman. The Council discussed the way Yhe garages wi11 front,
that they did not want cars aloag the service road, and if the Council
would grant a waiver for the garages from the required 35 feet to 15 feet,
would there be enough room for snow plowing Councilman Haxris said he
would rather see Mr. Filister have a waiver on the setback of the garages
than have open space parking.
MOTION by Councilman Harris to granY the setback variance with the pro-
vision that the garages exist.
Mr. Filister said there would be approximately 250 garages, and in the
future Chey may find [hey want to fill in the blank space with more garages
Councilman Harris sald he would not want to see continuous garages
Councilman Samuelson pointed out that there would be 32D feet of garage
for each module Councilman Liebl said he felt that fi111ng in with
garages would destroy the effect. He asked Mr Filister if he intended
to have the same qualrty apartments as he has in Golden Va11ey Mr. Filister
said that the units are somewhat smallex and thexe is a lowex rent scale
He said they will be the same quality but the rooE line is not the same.
The Council discussed the brick and redwood siding the apartments wi11
have.
Mayor Kirkham repeated Councilman Harris' motion. There was no second,
and the motion failed for lack of a second
, Mr Filister asked if the Council was going L-o take any action on the
storage. Gouncilman Lie�1 said that before the CouncZl decides on Lhese
questions, Mr Filister should have permission to Uuild. He said that
he did not want a slum area in 10 to 15 years, and the Council has to
rely on the advice of the Health and FLre Inspectors for their inter-
pretaCion of the Code. Councilman Lxebl asked Mr Filister if they were
willing Co comply with the ordinances. Mayor Kirkham said that Mr Filister
is asking for these concessions before he decides whether or not he wants
to build in Fridley
The Council asked if the balconies would be required as secondary exits
for fire purposes. The Pire Inspectar said they would not be required
if the windows are a certain size and distance from the floor, He said
they would assume this to be the case, but cannot determine this for sure
unCil they have the working drawings.
Councilman LZebl said that he had understood that if the plan had not
6een submitted and approved, there was no reason to consider the other
Ltems at this t�me, but now if Gouncilman Haxris would make his motion,
he would second it.
MOTION by Councllman Harris to approve the setback waiver irom 35 feet to
15 feet provided that the garages are coqstrucCed, and Chat the garages

bxick or stucco? Mr. FiLister said that it will vary He said that
they will try to carry oixt the uniformity of the building Councilman
Harris said he would like to see a11 brick. The Council discussed the
aesthetics with Mr. Filister, and which material they felt would Ue best

MOTION by Councilman Liebl to amend the motion that 80% of the exterior
wa1ls oY the garages be brick. Seconded by Councilman Harris.
The vote upon the amendment fio the motion was a voice vote, there being
3 ayes, 2 nays, the amendment carried.

Mayor Kirkham asked if the Council could make any determination on the
storage question. Councilman Sheridan said that the City has a number
of apartment buildings and the present ordinance was in ef£ect at the
time most of them were built He said the ordinance was made rather
stringent when it was adopted, and he said he could see no reasan to
change the ordinance or grant exceptions to it,
NIOTION by Councilman Sheridan to deny the request for waiver of storage
area requirements. Seconded by Councilman Samuelson. Upon a vaice vote,
there being no nays, Mayor Kirkham declared the motion carried.
Mr Filisker said he appreciated the Council's time and effort, but he
did not believe they would be back
CIiANGE ORDERS d�G-2, �kG-3, AND �ikE-2, CIVIC CENTER:
Mr. Richards, representing S. C. Smiley & Associates, was present at
the Council Meeting. The Council discussed 5 proposed change orders
for the new Civic Center, Mr. Richards sazd that two of the Change
Orders are going to be sent ttirough the Administration zn the usual
manner, but he would like to receive approval of the other three this
evening.
MOTION by Councilman i�arris chat Change ,Orders ��G-2 (Room EB 35),

The Council discussed the service station site with the representatives.
They discussed the possibility of improving the site with some 2andscaping.
The City �ngineer explained that in the future, the curb will be improved
and the drive changed so that the approach wi11 be 75 feet 6ack from the
curb. The representative said that it would be very expensive for them
to take up concrete or blacktop to make a grass area. There was a dis-
cussion on the possibilzty of a corner being planted, but this was not
feasible until the curb caas improved to protect it. It was decided that
the only protected place for planting was along the southeast corner.
MDTIDN by Councilman Harrls to concur with the alteratioas and add�.tions
request for the service station with the provision that the owner agrees
to put plantings along the southeast corner of the property. Seconded by
CouncYlman Sheridan Upon a voice vote, there being no nays, Mayor Kirkham
declared the motion carried.

Mayor Kirkham recessed the Special Council Meeting at 8:34 P M, to
interview architects for the proposed City Garage,

NAMING OF ARGHITECT FOR PUBLIC WORKS GARAGE:

MOTION by Ilarris to appoint the firm of Patch and Erickson as architects
for the City garage building. Seconded by Councilman Samuelson. Upon a
voice vote, there being no nays, the motion carried unanimously.
FEA5IBIZITY OF RETURNING MUNICIPAL LIQIIDR TO PRIVATE ENTERPRISE;
Mayor Kirkham announced he had contacted the firm of Horwath & Horwath
with reference to making a survey of the municipal liquor store to
study the £easibility of selling the municipal liquax operation, and
recommended that this firm be retained to make the study. There was
discussion on this maCter.
MOTION by Councilman Liebl to negotiate a contract with the firm of
Hoxwath & Horwath to make the study of the LLquor operation. Seconded
by Harris. Councilman Sheridan asked that the matter be tabled uatil
' Che next regular meeting. Councilman Harris stated that the firm of
Horwath & Horwath would meet with the Council before they proceeded
with the study. Councilman Samuelson said he felt an outside firm should
be contracted with, and �o�tsomeone from within the community, and if the
firm recommends private Liquor, Yhe matCer should be put on a referendum
ballot.

APPOINTMENT OF A HIGHWAY SAFETY COOR➢INATOR:
MOTION by Harxis, seconded by Samuelson, to appoLnt Nasim Qureshl,
City Engineer, as the Highway Safety Coordinator for Fridley.
Llpon a voice vote, there being no nays, the motion carried.
RUIL➢ING INSPECTOR'S POST:
T'he Mayor announced that Bud Jensen was interested in the position open
in the Building Inspection Department.
MEETING WITH BOND RATING SERVICES:
There was a discussion on the possibility of going to �ew York to meet
' with the bond rating firms to try to secure a more favorable bond raCing
for the City of Fridley It was pointed ouC that the firm of Ehlers &
Associates was financing a trip for the bond rating people to the Twin
City area. This was being coordinated through the Mun2cipal Finance
Officers Association. The rating services would be conducted on a tour
of Fridley as well as some other selected communities.

CONTRACTOR'S BOND FOR COMMERCIAL, INDIISTRIAL AND APARTMENT DEVELOPERS:
Councilman Samuelson presented a plan in effect in Richfield, whereby a
bond is required for developers of commercial, industrial and apartment
buildings.
MOTION tay Councilman Samuelson that the material be turned over to the
City Attorney for the drafting of appropriate ordinances and also that
the material be submitted to the PLanning Commission for their comments.
The motion was seconded, and there being no nays, the motion carried
unanimously.
ENGINEERING ESCROW P'OR TERRY'S ADDITION:
Councilman Harris asked if Mr Sulkowski, the developer of Terry's Addi-
tion, could submit a check to the City for the engineering escrow, but
the City hold tl�e check and not deposit it until such time as it was
assured the plot would be accepted by the County. The Council agreed
to this, �
COUNCIL TABLE AND RELATED EQUIPMCNT FOR NEW CITY HALL:
The Council discussed the matter of the arrangement and construction of
the Council table in the new City Ha11. It was decided that Smiley &
Associates be instructed to furnish detailed drawings of the proposed
table so that the Council could see �ust what is being pr,oposed
POLICE D�PARTMENT SPACE:
There was a discussion about the feasibilit� of the Police Department using
a portxon of the basement in the New City Ha11 or remaining in the present
building, and the cost estimates.
MOTION by Councilman Samuelson to instruct the architect and Police
Chief to come up with a preliminary drawing of the Po1ice Department
layout in the new City Ha1L. Seconded by Councilman Sheridan. Upon
a voice vote, there being no nays „the mot�on carried unanimously.
PLACING OF CONDIIIT FOR OUTSIDE LIGHTING - CIVIC CENTER PARKING LOT:
The Council discussed the matter of placing the conduit in the parking
lot before the lot was surfaced and the curb put i�. It was decided that
a Change Order should be prepared, authorizing the placing of this conduit
at this time.
I'LAG POLE AND PLAQUE I'OR CIVIC CENTER:
The Council viewed several proposals submitted by the City Engineer for
a plaque and flag pole for the Civic Center. The Council instructed
the City Engineer to proceed with the 50 foot steel flag pole design.
ACQUISITION OI' LAND FOR THE SOUTH HALF OF 73RD AVENUE, WEST OF UNIVERSITY
There was a discussion on condemnation or acquiring the land for street
right-of-way for the south half of 73rd Avenue, west of University.
