THE MINUTES OF THE REGULAR COUNCIL MEETING OF AUGIIST 21, 1967
The Regular Council Meeting of the City of Pridley was called to order by
Mayor Kirkham at 8:11 P.M.
OPENING CEREMONY:
Mayor Kirkham asked the audience to stand and �oin in saying the Pledge of
A1legiance to the Flag.

APPROVAL OF MINUTES, REGULAR COUNCIL MEETING, AUGUST 7, 1967;
MOTION by Councilman Liebl to adopt the Minutes of the Regular Council Meeting
of August 7, 1967 as presented. Seconded hy Councilman Samuelson Upon a
voice vote, there being no nays, Mayor Kirkham declared the motion carried.
APPROVAL OF MINUTES, SPECIAL PUBLIC HEARING MEETING, AUGUST 14, 1967:

Upon a voice vote, there being no nays, Mayor Kirkham declared the motion

ADOPTION OF AGENDA:
Mayor Kirkham said that Item 1 A under Old Business should be added to the
agenda, "Moving the Oman House".
MOTION by Councilman Liebl to adopt the agenda as amended. Seconded by Council-
man Samuelson. Upon a voice vote, there Ueing no nays, Mayor Kirkham declared
the motion carried.
PUBLIC HEARING ON IMPROVEMENT - UNIVERSITY AVGNiIE SERVICE ROAD ST. 1967-3:
The Acting CZty Manager read the Notice of Hearing. The City Engineer pointed
out on the map the way the sexvice road wi11 go from Satellite Lane to 67th
Avenue Northeast. He said that the State wi11 include a11 this in one pro�ect
and hopes to have it completed bef-ore winter.
The City Attorney said that he had discussed the purchase of right-of-way with
all the property owners. He said that he had �ust met with the attorney for
� the Ho11y Shopping CenCer, and they had agreed to give an easement to the City,
but they would like to receive a letter stating that they will get a slip-o�`f
ramp; that they will get the thzee exits from the service road into the parking
loC as appear on Che proposed plan before the Council; that they wi11 get a

third exit between the existing ones onto Mississipp�. Street, and that in �
the future the Council wi11 consider parking requirements as though Holly
Center still owned the land they are dedicating (which is about 6 parking
spaces), as they do not want to �eopardize the parking space/building
ratio. The City Attorney said he had told them that the slip-off ramp
depended upon the Highway Department, but the indication was they would be
as presently planned, and that the additional exit onto Mississippi Street
would probably require the concur�'ence of the County Commissioners. He
said he felt that these four requests were possible.
The City Attorney said that he had also had a discussion with Eric LaVine
who owns the 1ot between the Standard Station and the Dairy Queen, and the
north half of the vacated right-of-way south of this. Mr. LaVine advised
the City Attorney that if the City wished to purchase the property out of
court instead of go�ng through condemnation, his asking price for'the two
parcels would be $20,000.
Councilman Liebl asked if the road going around the service stations was a
two-way street or 7ust a one-way, and if there will be an island on Mississippi
Street. The City Engineer said that this will be a two-way s[reet and there
will be an island. Councilman Liebl asked if the City had concurrence from
the Highway Department on this. The City Engineer said that the Highway
Department is designing this part, and this whole pro�ect wi11 be a �oint
pro�ect between the Crty, County and State. Councilman Liebl asked if it
would be done soonet if the City did it or if the County did it. The City
Engineer said that zt is faster if the City condemns the land rather than �
the State. Councilman Liebl said he was concerned about this, and would like
to see the intersection completed as soon as possible.
Mayor Kirkham asked if there was any member of the audience present in regard
to this Public Hearing. There was no answer.
Councilman Sherid��n said that the Notice of Hearing stated that the proposed
area to be assessed is to be assessed proportxonately according to the benefits
received by such improvement, and he felt that there is no benefit to the
abutting properties. He said that, as an example, the northwest quadrant was
of no benefit to the service station and little, if any, to the shopping center.
Councilman Sheridan said thzs was being done for the traffic safety of the
community wrthin this general area, and he felt the pro�ect should be a City
pro�ect with the necessary Eunds taken out of the general revenue. Mayor
Kirkham said that the shopping center recognizes that they benefit, because ,
the traffic pattern wi11 help their traffic. She Cxty Engineer pointed out
that this was an improvement hearing, and in the case of highways and County
roads, the City has always assessed part of the cost of curbing. He said
that when the assessment hearing is held in a year or so, the Council will
have a1Z the costs an front of tlzem and can a�ake a determination at that time
whether they want to yay the entire City's cost from the general fund or assess
a partion of the curbing. IIe said that this was the way it had been done by
the National Tea store. He said that the City's cost will only be the acqui-
sition of the right-of-way. The State will pay all the improvement costs less �
some curbing the City will have to pay. The City Engineer said he questioned
how the City can prove any benefit, and how much benefit. He said this was a
a legal question the Council wi11 have to decide.

� Councilman Samuelson asked if there will be any signalization of the looped
intiersection. The City Engineer said that he did not think so. Councilman
Samuelson questioned whether sidewalks should be included with this improvement,
or if they should be put in later. The City �ngineer said there was a resolu-
tion Later in the agenda ordering preliminary plans and calling a puUlic hearing
foY the street pro�ect fxom University to 2nd Street on Mississippi Street which
is part of the package, and at the hearing sidewalks can be added. Councilman
Liehl asked if there wi11 eventually be sidewalks to East River �rad. The City
Engineer said that this would be up to the Council to decide. Councilman
Samuelson said that after the problem with the County at the raiLroad tracks
is resolved, then 2nd Street to East River Road could be improved
Councilman Sheridan said he had made his comments on assessing as he thought
the Council could put themselves in a more favorable position with some of
the other intersections they may be considering in the future. IIe said that
the City is starting the pro�ect and not t-he property owners. The City
Engineer said that it is difficult to prove the beneflts, and there would be
a question whether the Council eould assess everything. He felt some of the
cost wi11 have to be picked up from the general fund. Mayor Rirkham said he
did not intend to imply that the property owners should pay everything, but
to point out that they do have some henefits,
MOTION by Councilman Sheridan [o close the Puhlic Hearing on Street Improvement
1967-3 University Avenue Service Road. Seconded by Councilman Samuelson. Upon
a voice vote, there being no nays, Mayor Kirkham declared the PuUlic Hearing
� closed at 8:34 P.M.
MOVING THE OMAN HOUSE:
The City Engineer explained that the Robin Corporation was not licensed as
a house mover in the City of Fridley, He said that the Gouncil could approve
the license this ever.ing on the condition that the BuiLding Inspector check
that they are reputable and have the proper insurance, and then the license
could be issued the next day and they could start moving the building.
MOTION by Councilman Samuelson to approve the issuance of a Housemoving License
to the Robin Corporation, 5016 - 40th Avenue North, Minneapolis, Minnesota
55422, upon presentation of proper bonds and background material to the
Building Inspector. Seconded by Councilman She�ridan. Upon a voice vote,
there being no nays, Mayor Kirkham declared the motion carried.
BUDGET:
The Acting City Manager saZd that the budget was not ready at this time to
present to the Council, but that he hoped to have something at the next
Council Meeting.
RESOLUTION 3k149-1967 MAKING A TRANSFER FROM THE PUBLIC UTILITY FUND TO IMPROVE-
MENT BONDS OP 1960 FUND, IMPROVEMENT BONDS OF 1963 FIIND, Ld-75 WATERWORKS
IMPROVEMENT BOND FUND AND REFUNDING BOND FUND:
� The Acting City Manager explained that this resolution would authorize a
transfer of funds from the utility fund to various improvement funds instead
of levying taxes.

Councilman Liebl asked what the City was gaining by authorizing this transfer.
The Acting City NIanager said that the City is not gaining anything, but the
tax levies are already set up, and if the transfer to the improvement bonds
is made trom the Public IItility Operating Fund, this wi11 cancel the need for
the tax levy.
UPON a voice vote, there being no nays, Mayor Kirkham declared the motion
carried.

waiving the reading, and publish. Seconded by Councilman Liebl. Upon a

RESOLUTION ��150�1967 CONFIRMING ASSESSMENT ROLL - 1967 WATER AND SEWER MAINS,
L,4TERALS AND SERVICE CONNECTIONS:
The City Attorney suggested that if the Council wished to pass this resolution
this evening, they do so with the exception of the property owned by Clem
Coverston where the ob�ection was taken at the Public Hearing, and that they �
ask the City Manager and City Attorney to study the amount of the special
assessment in that particular case and report back to the Cuuncil. The City
Manager said he would rather see the resolution passed without this one item,
than not passed at a11. Councrlman Samuelson said he felt the City Manager
had been correct in assessing this portion and that he could not fu11y
accept the ob�ectLOn. IIe said he did not feel this should be carried on the
Uooks until it was utilized. Mayor Kirkham said that he did not agree with
the ob�ection. The City Attorney said he would agree with what they were
saying, but on the other hand, the assessment code is silent on this type of
procedure, and the City may run a certain risk in a court case. Councilman
Samuelson said he did not feel the City should engage in any deferred
assessments, and asked if the Code should be corrected. The City Attorney
said that this is part of the State code adopted by reference, and he did not
feel the answer would be to abaadon Chapter 429 and go to an ordinance of our
own. Mayor Kirkham asked if the City Attorney felt some agreement could be
reached. The City Attorney saYd he thought this might be a possibility.
Mayor Kirkham suggested they delete the South 90 feet of Lot 16, Cloverleaf
Addition from the resolution and the City Manager could have that portion
back on the agenda at a later date.
MOTION by CouncLlman Sheridan to adopt Resolution ik150-1967 deleting the
South 90 feet of Lot 17, Cloverleaf Addition, owned by Clem Coverston,
represented by I'Loyd S. Ordemann, from the assessment ro11. Seconded by
Councilman Lieb1. Upon a voice vote, there being no nays, Mayor ILixkham �
declared the motion carried.
BIDS - BENNETT BUILDING (RECP�IVED AND OPENED NOON, AUGUST 21, 1967};
The Acting Crty Manager stated that the City had not received any bids on
the Bennett Building. He said the only thing the City could do now was
readvertise, tear it down, or use the building ourselves, but none of the
departments wanted it. Councilman Samuelson said he did not think the Cxty
would receive any worthwhile bids by readvertising, The City Manager

suggested there may be the possibility of negotiating with someone for it,
now that it has been advertised. The City Attarney said that this would
be all right if the City could find someone who was interested in it.

Z'he City Manager read the ordinance. Councilman Liebl asked if the corner
that had been discussed at the last Regular Council Meeting had been included
in the description. The City Engineer said that it was included.
The City Engineer said that Mr. Joseph Zizak, 5791 - 2z StreeL Northeast,
requested that Chis �treet be vacated He said that Mr. Zizak has two
lots, but they are not both buildable lots, and if he can get this addi-
tional footage he wi11 have two buildable lots. The City Eagineer said
that 2z Street ends in a 1ow area and there is no storm sewer at this time,
so this area is acting as a drainage sump The City Engineer suggested
the Council let Mr. Zizak buy the property at a nnminal price, make an
a11ey, and retain a fu11 easement for drainage and utility. Councilman
Samuelson said he did not think a fu11 utility easement would be necessary,
as they could take the standard utility easement and require a drainage
plan from the developer of the two 1ots. The City Engineer pointed out
that there is no storm sewer to drain the area into, aad the water would
then be on private property.
The City Attorney said he would feel that the question of what happened to
the property after it was vacated would be between the two property owners,
and the City should not get involved in this. The Council discussed
changing the wording of the ordinance to retain a full utility easement
and then a portion could be vacated when a storm sewer is put in. The
wording of the ordinanCe was changed so that after the legal descripton
of the vacation it reads: ^be and ic hereby vacated, excepted that the
Gity of Fridley retain the easement from drainage and utility purposes."

ORDINANCE - REZONING OF LOTS 1-6, BLOCK 1, C[1RLSON`S SUMMIT MANOR ANNEX 2ND
ADDITION, (REQUEST BY S& 5 INVESTMENT COMPANY):
Mayor Kirkham asked if this company had come back with any proposal on the
type of building they planned on building. The City Engineer said that there
is no provision to xequire Lhem to do this when rezoning property. He said
that even if they came in with plans this would be no guarantee once it was
rezoned. Councilman Sheridan questioned the possibility of going to a
Special Use Permit. The Gity Engineer said that thexe was no Special Use
Permrt to give under this zoning classi�ication. Councilman Lieb1 said
that he was not opposed to three six-unit apartments, but was opposed to a
25-unit apartment, and oncc it was rezoned the City would have no control.

FIRST READIIVG OP FDOD ORDINANCE:
The City Attorney said that he and the Health Inspector have worked out the
details of this ordinance, but it has not been retyped. He said that the
Council could pass the ordinance at first reading and he would submit the
amended version with the corrections and additions for the second reading, or
they could table it until the next meeting. Councilman Samuelson asked the
Health Inspector if he had gone over the ordinance. Mr. Hensely said that
he had, and that it was an excellent ordinance now. Councilman Lieb1 asked
Mr. Hensley if the ordinance included lavatoi}rfacilities for the public or
if it �ust covered employees. Mr. Hensley said that it has been corrected
to include public facilities.
MOTION by Councilman Samuelson to adopt the Food Ordinance upon first
reading, waiving the reading. Seconded by Councilman Lieb1. Upon a roll
call vote, Kirkham, Liebl, Samuelson and Sheridan voting aye, Mayor Kirkham
declared the motion carried.
�VCRETT COLLINS - RE: FENCE & TRAILER PERMIT:
The Acting City Manager said that Mr, Collins has the property at 37th and
East Aiver Road, and when he applied for a trailer permit he was turned down
until something was done about an old fence. He ?�ad asked to be on the
agenda to discuss this with the Council, but had since agreed to go wrth
the Building Inspector and try to reach an agreement on what could be done,
so there would be no Council action necessary on this item. Councilman
Sheridan said that this property belongs to the NSSSD, and their attorney
has advised Mr. Collins that he must get along with the City.
MOTION by Councilman Samuelson to teble the trailer permit for Mr. Everett
Collins. Seconded by Councilman Lieb L Upon a voice vote, there being no
nays, Mayor Kirkham declared the motion carried.
CONSIDERATION OF A REGIST�RED LAND SURVEY - RE; BERRY - OSTMAN'S THIRD ADDITION:
The Crty Engineer explained that these are two lots that Mr. Berry is trping
to split by a registeradland survey rather than platting them. He asked the
City Attorney to comment on whether this can be done. The City Attorney said
that he had checked the code and the State Statutes, and there is no specific
requirement that a Public Hearing be held, but before it can be approved by the
County, it must be approved by the City. He said that if the Council felt a
Public Hearing would be beneficial, it was his feeling that this would be
reasonable, or the Council could approve it without a Public Hearing.
Councilman Sheridan asked if Mr. Berry was making three lots out of two. The
City �ngineer answered that he was. Councilman Lieb1 asked if he had enough
land to do this. The Crty Engineer said that he did.
Mr. John Petersen from C. E. Coultor & Associates and Mr. Berry were present
at the Council Meeting. Mr. Berry pres�nted-the Council with letters from
the abutting property ozaners stating that they had no ob�ections.

he has checked over the plat and that it meets all the County requirements.

There was a discussion between the Council, T4r_ Petersen and Mr. Berry
regarding the facts that several homes are built around the cul-de-sac
alxeady, there was cn exchange of land to straighten the property lines,
that this was torrens property, that the utilities wc�re in Hickory Circle,
and there was access to tract B.
MOTION by Councilman Liebl, that since the City Attorney has advised the
Council they do not need to hold a Public Hearing, the Council approve Chis
plat as presented to the Council. Seconded by Councilman Sheridan Upon a
voice vote, there being no nays, Mayor Kirkham declared the motion carried.

Mayor Kirkham called a brief recess in the meeting while the recording machine

PLANNING COMMISSION MEETING MINUTES, AUGUST 10, 1967:

BUILDING STANDARDS - D�SIGN CONTROL SU�BCOMMITTEE MEETING MINUTES, AUGUST 15, 1967:

NORTHEAST. REQUEST SY MCDONALD'S SYSTEMS, INC:
The Acting City Manager explained that there would be two things for the Council's
consideration. One would be the lot split contingent on the approval of a permit
and the other would be the permit itself wrth any or a11 of the stipulations
listed in the Building Standazds-Design Control Subcommitee Minutes Mayor
Kirkham read aloud� the stipulations lvsted in the minutes, and asked the
representatives of the McDonald�s Corporation if they were willing to abide
by all the stipulations. The Representatives said that they would agree to
them. The City Engineer showed the�Council the p?ans for the proposed
restaurant and also a detailed planting p1an. There was a discussion of the
fence that is to be put up hehind the restaurant and that it should be similar
to the one Erickson Petroleum has agreed�to put up at their station. Council-
man Samuelson requested that they plant a lombardy type tree on the east
property line inside of the fence to hide the view of the high sign for the
double bungalows. The representative said that he would agree to do this.
� There was a discussion about garbage pick-up and the Health Inspector said
that the ordinance requires that garbage be picked up daily.
Councilman Lieb1 asked if the size of the McDonald's sign will be the same
as they have in Golden Valley, The representative sa�d that the illuminated
surface was 248 square feet, and at present it is designed to stand 9 feet

off the grade, but the ordinance requires the sign to be 14 feet off the
grade, so the total height of the sign will be 29 feet if they have to
maintain the 14 foot clearance. The Council discussed the possibility of
waiviag this requirement of the sign ordinance so that the sign would not
have to sit higher, and agreed they would prefer the bottom of the sign be
at 9 feet rather thaa 14 feet high.

Councilmaa Sherxdan said he felt the Council could grant the lot split as
the seller was the owner of the property to the north and south and the
property on the east is already developed. The City Attorney asked how much
land would be left. The Erickson Petroleum representatxve said that 'originally
there had been 800 feet of which 200 feet had been used, 210 feet will be used
for this McDonald's restaurant and there wi11 still be 390 feet left.
MOTION by Councilman Sheridan to grant the lot split as requested by the
Erickson Petroleum Corporation for the south 10 feet of Lot 14, Block 4,
bennett-Palmer Addition, upon the receipt of the Certificate of Survey,

MOTION by Councilman Samuelson to concur with the Building Standards-Design
Control Subcommittee recommendation granting approval with stipulations A
through H as listed in the Minutes of August 15, 1967, and direct the Admini°
stration to issue the requested permit upon the presentation of all necessary
items. Seconded by Councilman Sheridan. Upon a voice vote, there being no
nays, Mayor Kirkham declared the motion carried.
MOTION by Councilman Samuelson to waive the Sign Ordinance to allow the
McDonald's sign to be 9 feet off grade as presented instead of 14 feet off

� JAMES GIBSON - RE; OFFICE BUILDING:
Mr. Gibson showed the Council a presentation he had for an office building
at 63rd and T.H. ��65. He said this would be built to the north and east of
his pxesent building which would be completely removed after the new building
was completed. He said there were some considerations that would have to be
discussed before he was ready to spend $1,000 to $2,000 on plans and then
find out he would not be able to build it. There was a short discussion on
property to the rear of h1s site that he w ould like to rent or lease from
the City, and the possibility that he may have to buy property to the east
of his property. Parking, the setback, entrances, and how close eo the
pump house he could go were mentioned. He said he would like tenta�i�✓e
agreement fxom the Council before he went any fuxther. Mr. Gibson said
that the building might go to six stories and would be the tallest building
narth of the Minneapolis 1oop. He said he would build accor�iing to the
underwriters code, which he thought was more restrictive than the City Code,
and would be more expensive, but he would save on fire insurance over a ten
year period. He said the building would cost tentatively $900,000 and would
be an asset to the community. Councilman Samuelson said that the zoning was
proper for this use, so it would only be necessary to work out an agreement
on the pump station. Mr. Gibson said there would be no problem with the
parking as he would get the necessary land 6ecause he feels good parking is
essenCial for business. The City Engineer said that he could go over the
code requirements with Mr. Gibson and see what waivers would be required
� MOTION by Couacilman Sheridan that this proposed building be referred to
the Administration to study the code requirements with Mr. Gibson, and if
some waivers are required, they be brought back to the Council. If the

The City Manager explained that the Council had previously discussed this

Lieb1 asked if it was correcC that these people wi11 be assessed anyway, but
that the pipes are �ust not being put in. The City Manager said that deleting

CHANGE ORDER ��4, SW&SS��84 (TJATER LINE ON 72ND AVENUE NOREHEAST):
The City Engineer said that the Council has approved water and sewer on 72nd
Avenue and on 69th Avenue. He said that Mr. Determan has built a building
and is anxious to get water and sewer, but there is a problem with the sewer
and he cannot get it before this fa11, so he is only asking for water to
serve his building and this wi11 be attached to an existing contract. Mayor
Kirkham asked about an easement and the City Engineer said that Mr, Norton
is willing to give a 30 foot easement to the south, The Consulting Engineer
e�lained to the Council that Mr. Norton had been given several choices, and
runi�ing it through his 85 foot lot seemed a good solution. The Consulting
�ngineer said that this wi11 ma[ce the land unusalSle and as the value of the
land is being disturbed, this will be part of the negotiations at the titre

REPORS FROM PARK DEPARTMENS ON MOVING GAR[tGE BUILDING:
The City Manager said that the Park Director had recieved another bid in the
amount of $1600 to move the garage building in addition to the $180d bid he
already had. The City Engineer said he had met with NSP and had asked them
about access to Locke park on the east side and they had indicated that
they would give the access if the City wished to put the building there.
The City Attorney said that he had had a discussion with the Mayor of East
Bethel and he had indicated that they might be interested in purchasing it,
as they are interested in bu�lding a storage facil�.ty for the Street Department.
Councilman Sheridan said that if they took what they could get for sell�ng it
and add the cost they would have had to pay to move it, they Fs obably could
build a new one. The Acting City Manager suggested that if the City Attorney
got an offer from East Bethel, he could talk to the Councilmen individually
instead of waiting for the next CounciZ Meeting.
MOTION by Councilman Lieb1 to direct the City Attorney to contact the Mayor
of East Bethel to try and negotiate a price for the Eutler building. Seconded

Councilman Samuelson asked the City Attorney if any of the multiple dwellings
listed requesting licenses were on the list he had been given by the Bullding
Inspector. The City Attorney said there were only three buildings in the
City that did not purchase licenses Last year, and in at least two cases,
the property had changed hands and Che license did not have the name of the
new owners.
Councilman Liebl said that four of the 12-unit apartments on 59i Way were
the ones that he had requested a letter be written asking them to do some-
thing about their driveways. The City Engineer questioned whether the City
had any authority to enforce the requirements of the code. He asked if the
City can hold back the licenses. The City Attorney said that if the multiple
dwellings do not meet the code, they can hold the Lzcense, but he was not
sure they had any authority over the driveways under the code. The City
Engineer said that there are three apartments on Ma�n Street where their
parking £acilities are not in compliance.
MOTION by Councilman Samuelson to approve the contractor's licenses and the
multiple dwelling licenses with the exception of the multiple dwellings at
6019 Main Street Northeast, 6021 Main Street Northeast, 6035 Main Street
Northeast, 190 - 592 Way Northeast, 191 - 59z Way Northeast, 151 - 592 Way
Northeast, 150 - 59z Way Northeast, and these seven multiple dwellings are
to be hrought back to the next Regular Council Meeting with a report from

MOTION by Councilman Sheridan to receive Petition �'k30-1967 and that ehe
Administration advise the circulator of the peti�i.anthat the City Council
has set a policy on assessing sidewalks whzch cannot be changed, so he can
recirculate the petition. Seconded by Councilman Lieb1. IIpon a voice vote,

TO AND FROM SCHOOL:
MOTION by Councilman Sheridan to receive Petition �k31-1967. Seconded by
Councilman Samuelson.
The City Engineer said that a school signal would be out of the question at
this time because neither Columbia Heights nor Fridley has money for signals.
He said that possibly after a study of this intersection, a four-way stop
could be put up. Mayor Kirkham said he would agree with a four-way stop,
Councilman Sheridan said he had discussed this with some of the people, and
they thought there could be a stop sign wiCh a school drop for CI7e crossing
hours at 53rd Avenue, and a sign could be put up further down the street
that there was a school crossing ahead. Mayor Kirkham said there was some
question about the legality of a dropped sign, The City Engineer said he
would check on the Legality of the sign, and proceed accordingly.
UPON a voice vote, there being no nays, Mayor Kirkham declared the motion
carrie d.
RESOLUTION -0�164-1967 RELATIVE TO CITY OF FRIDLEY - NORTH SiTP�URBAN SANITARY
SEWER DISTRICT SEWER IISE AGREEMENT•
The City Manager pointed out that this was the same resolution as was sent
to the District before, but that the location named was different. The City
Attorney said that this does not include the language that had been added to
the last resolution about the City's positLOn. He asked what the District had
done about the last resolution. Councilman Sherldan said that their Attorney
had taken it under advisement, as there was the additional wording, and had
indicated that if it in no way �eopardized the District he would authorize
the C1erk to accept the resolution and grant the hookup. The City Attorney
advised that the same language be used on this resolution for continuity.
Councilman Samuelson said that he thought Item C(lateral serving Designware
Industries) should be deleted from this resoluL-ion and a separate resolution
submitted in case this present resolution was delayed for any reason. He
said that there have haen a number of complaints recently about the effi.uent
going into Locke Lake. Councilman Sheridan agreed that a separate resolution
would be a good idea, as this would be the first property below 69th Avenue�
and he thought it should be on a permanent basis rather than a temporary
bas�s. There was a discussion about the number of RECS that Designware sinuld
use and whether the District would be meter�ng the PH factor.

MOTION by Councilman Samuelson to adopt Resolution ik164-1967 deleting
Item C(lateral serving Designware Industries at 6536 Main Street North-
east) and amending the Resolution with the original language used �n the
original resolution to the NSSSD and filling in the words ^temporary
basis". Seconded by Councilman Sheridan. Upon a voice vote, thexe being
no nays, Mayor Kirkham declared the motion carried.
RESOLUTION 4k165-1967 RELATIVE TO CITY OF FATDtEY - NORTH SUBURBAN SANITARY
SEWER ➢ISTRICT SEWER USE AGREEMENT:
MOTION by Councilman Sheridan to adopt Resolution �k165-1967 requesting the
connection of the sanitary sewer lateral serving Designware Industries at
6536 Main Street Northeast on a permanent basis, using the same language
used in the original resolution. Seconded by Councilman Sheridan. Upon a
voice vote, there being no nays, Mayor Izirkham declared the motion carried.
PURCHASE OF RIGHT-OF-WAY - TH 4�47 SERVTCE ROAD, LAVINE:

The Crty Attorney said he t.o uld like some direction on whether to offer
Mr. LaVine his asking price of $20,000 or pxoceed with the condemnation.
Councilman Sheridan asked if an appraisal would be necessary for the
coredemnation. The City Attorney said that it would, Councilman Sherzdan
suggested the City get an appraisal so they would know how to negotiate
this. The City Attorney said that Mr. LaVine had informed him that this
property had been sold previously on a zoning contingency and the sale price
at that time had been $25,000, which did not include the north 1/2 of the
vacated piece. He said that if they authorized him to get an appraisal, he
may have to contact the Council individually, because if this is to go to
condemnation it should be filed before September Sth. The Council agreed
with this.
APPOINTMENTS:
MOTION by Councilman Samuelson to table the appointment for the 7nspector
inr the Building Inspectlon Department until the next regular Council Meeting

The City Engineer said that he and Councilman Harris had met with the District
Manager from NSP and their xight-of-way man and they had requested that
Fridley wait until NSP has completed their settlement with Roseville. The
City Attorney said he had talked to the Roseville Attorney and he felt they
had a fairly good chance that their oxdinance requiring a Special Use Permit
for high voltage lines would be sustained in District Court as long as the
conditions placed on the Special Use Permit were reasonable. He said that
Northern States Power does not waat to make any decisions until they get the
results of this case.
The City Engineer pointed out on the map the route the line will be going.
Councilman Liebl saxd he did not feel the CiCy had a good argument against
this route, but NSP wi11 have to work it out with the railroad so that
they w111 not interfere with their signals. The CLty Engineer said that,
if the lines are constructed, an arrangement would have to be worked out
for roadways when this property is platted.
COMMUNICATIONS:
iA) PAOGRESS REPORT - CIVIC CENTER - ARCHITECT:
The City Manager showed the Council an estimate he had �ust received from
Smiley & Associates. Councilman Samuelson read the estimate aic+ur_7. Mayor
Kirkham said Che Administration should ask for an itemization of ehis estiRate
The Gity Engineex said he had one quoCation on the sign fox the new City Hal1,
and Smiley Associates is asking for a quoCation from D. M, Noyes Construction
Company. He itemized the approximate cost as follows; $600 - masonry and
concreCe, $1700 - brick, $200 - electrical wiring, $400 - letters, $400 -
flag pole and installation, for an approximate total of $3400. He asked the
Council if they wanted to go ahead with this pro�ect, and if the Noyes
quotation comes in cheaper, should he accept it� The Council felt that
this sign was important to the whoLe new City Hall pro�ect,
MOTION by Councilman Samuelson to authorize the City Engineer Co proceed with
the sign for the new City Hal1. Seconded by Councilman Lieb1. Upon a
voice vote, there being no nays� Mayor Kirkham declared the moCion carried.
Councilman Liebl said that the Council has discussed the wording for the
plaque for the new City I{all, and rather than having something about the
tornado he suggested one of the following:
"Liberty is to the collective body, whaL- health is to every
individual body. Without health no pleasure can be tasted by
man, without liberty, no happiness can be en�oyed by society,"

Mayox Kxrkham said that these were good suggestions, and asked the City
Engineer if there was a hurry on thzs. The City �ngineer said no, but it
would help the completion. Mayor Kirkham said that Yhis could wait until
