THE MINUTES OF THE SPECIAI. PUBLIC HEARING MEETING OF NOVII�3SER 13, 1967
The Special Council Meeting of November 13, 1967 was called to order by
Mayor Kirkham at 8:OD P.M.
OPENING CEREMONY•
Mayor Kirkham asked the audience to stand and �oin in saying the Pledge of
Allegiance to the Flag.

ADOPTION OF AGENDA:
MOTION by Councilman Harris to adopt the agenda as presented. Seconded
by Councilman I,iebl. Upon a voice vote, there being no nays, Mayor Kirkham
declared the motion carried.
REZONING REQUEST - COMMERCE PARK - FEDERAL LUMSER COMPANY;
Mayor Kirkham said that this requested rezoning had been formally
wi�hdrawn by the Federal Lumber Company. Mayor Kirkham declared the
Public Hearing on Rezoning Request ZOA ��67-09 closed at 8:D3 P.M.
APPROVAL OF A PRELIMINARY DEVELOPMENT PLAN - BOURDEAUX'S SPRING BROOK
ADDITION•
Mr. Harold Schroeder and Mr. Howard J. Dumphy were present at the Council
Meeting to go over the Planned Development plans with the Council.
The City Engineer said he would outline some of the highlights for the
Council, and then the developer could go into more of the details. The
City Engineer explained that this area is already rezoned as a Planned
Development District, and the concept has changed from the one originally
planned, in that the developer has eliminated the town houses, and it wi1
be apartment houses and a shopping area. He outlined the area on the map.
He said that some streets would have to be vacated to fit the complex,
and the developer has agreed that the City take 24 feet additional right-
of-way from their property for right and left turning lanes on East River
Road on the condition that this property is included in the area requirements.
The City Engineer showed the parking plan and explained that it wi11 be
25 feet from the R-1 zone, separated by a planting strip, and the parking
area will be setback 35 feet from the road, so the garages will be 11 feet
from the right-of-way after the City has taken their 24 feet of right-of-
way. The City Engineer said that one question not resolved, is on the
access. He said that some studies have been made, and Mr. Schroeder feels

, they can maybe get by with one access. Mr, Schroeder said that when the
development gets some tenants, the requirements wi11 be better defined
and then they wi11 sit down with the engineers aad plan for a good
ingress and egress plan from East Rxver Road.
Mr. Schroeder said that in developing their plan, they have worked within
the zoning xequixements, and taken into account the ad�acent areas and
East River Road. He said they had worked with traffic experCs, who did
not feel this development would cause any problems on East River Road,
but if conditions change after this is constructed, they wi11 work with
sahomever the City names on the problem.
Mr. Schroeder stated that in developing their plan, they did not subscribe
to the typical kind of apartment complex in this area, but took into
account the topography and lay of the 1and,the wooded and and sloping
terrain and have the apartments stepping down the hi11 and away from the
residential property. He said that the garages wi11 be down below, so
that only the roofs wi11 show from ;the road and these roofs may be planted
He said that there will be a bridge across the creek to take care of traffic
from the apartment area to the center.
Mr. Schroeder said that the Planning Commission and the City �ngiaeer have
been most cooperative and helpful in helping to develop this plan, which
will be a development in excess of $2,SOO,OOD. Mr Schroeder showed a
rough_ sketch and pointed out the lighted paths and intierior access.
� Councilman Liebl asked Mr. Schroeder to show where the bridge would be,
and if it would be for cars. Mr. Schroeder said that it would be only a
pedestrian walkway. Councilman Liebl asked what kind of shopping stores
they were planning on. Mr Schroeder said that they had a grocery chain
store, drug store, dime store and possibly smaller miscellaneous stores
in mind, but this may or may not material�ze.
Councilman Liebl asked if Mr. Schroeder planned Co remove much ground.
Mr. Schroeder said they have tried to retain the natural terrain as much
as possible, and have made a concerted effort not to move more ground than
necessary. Councilman Samuelson asked if the landscaping zone, as a
barrier on the north property line, would include a fence Mr. Schroeder
said that they prefer landscaping, but if a fence is necessary they would
put one up, �
There was a discussion on sewer and watex utilities, and Mr. Schroeder
said they would not be disturbing the utilities, only the street pattern
The City Engineer said that two streets need to be vacated in Fairmont
Gircle to build Chis compLex, and double cast iron pipes may have to be
put over the utilities to proCect them.
Councilman Harris asked if there had been enp �heught of lining up LLberty
Street, Mr. Schroeder said that there has been no decision as to where
, the access would be, and East Aiver Road's conditions could change so that
anything decided now may not be valid when construction is finished. He
said it had been the engineer's recommendation to either line it up
directly or 100 to 150 feet off the access point to be sure there is a
controlled itltt.e�section.. He said that if tow accesses are necessary
and the City rec'ommends there be two, this is what they wi11 provide.

Councilman Harris asked Mr. Schroeder if it was his plan to build the ,
apartment complex first. Mr. Schroeder said that this was correct, then
they will seek out tenants for the shopping area, and the plan could be
accelerated, if tenants are found. Councilman Harris said he felt the
street pattern should be decided before construction on the co¢mtercial
enterprise is started. Councilman Samuelson asked abou't a storm sewer
easement in the vicinity of the garage construction. Mr. Schroeder said
that there is an outlet here, which they will reroute, probably to the
Creek. The City Engineer said that they were in basic agreement on the
utilities and will work together on this. There was a discussion on
deceleration lanes and a future signal light. Mr. Dumphy said that they
have acquired the Hugo corner, and will be able to incorporate Hugo and
the street vacation and the access factor will be easier to work out.
Councilman Liebl asked about the electrical facilities. Mr. Schroeder
said they hoped to go underground from Auth Street to the complex for
distribution. He said he has not checked the main sources, but would
like to run the lines underground.
Mayor Kirkham said that it was a pleasure to see a development planned
from an overall aspect, and it gives the idea of what real planning can
do. Councilman Sheridan said that it has been a xeal benePit to the
Council and the City Departments to have such a complete brochu�-e laid
out for them. Councilman Samuelson said that this wi11 be a real asset
to our community.
MOTION by Councilman Harris to close the Public Hearing on Planned Devel- ,
opment District - Bourdeaux's Spring Brook Addition. Seconded by Council-
man Samuelson. Upon a voice vote, there t�eing no nays, Mayox Kirkham
declared the £ublic Hearing closed at 8;37 P.M.
The City Engineer pointed out that there were quite a few items that
should have definite decisions made on them. Mr. Schr'oeder said that
they would be pretty much the Planning Commission's recommendations.
The City Engineer said directions should be given to be sure that every-
thing is understood by both the Council and the developer before the
developer goes into the fictancing of the pro�ect. Councilman Harras
suggested the City Engineer make a list of changes and recommendations,
and approval could be given contingent on the listed items being met,
then the developers wi11 know which way they wi11 have to go. Mr. Schroeder
said that this would be fine with them. The City Engineer said that they
know the items pxetty much, and they will be listed in detail to be clear
SIDEWALK ORDINANCE:
Councilman Harris requested that the Sidewalk Ordinance be brought back
on the agenda at the next regular meeting for a Council decision regarding
width. He said that the Ordinance presently reads, "four or five feet",
and there is a case in Fridley where a 4 foot sidewalk runs into a 5 foot
sidewalk. ,
LETTERS REGARDIIVG INDUSTRIAL DAY:
Councilman Harris said that phone calls and several letters have been
received from the people that had been in attendance at the Fridley Industrial

' Day, thanking the City. He said he felt it was a real success, and these
letters indicate that the visitors had a chance to view the community
with much more interest than before. He said that 3 or 4 businesses
have prospects interested in Fridley.
MOTION by Councilman Harris to receive the letters regarding the Fridley
Industrial Day. Seconded by Councilman Sherid� . Upon a voice vote,
there being no nays, Mayor Kirkham declared the motion carried.
