THE MINUTES OF THE REGULAR COUNCIL MEETING OF I� VEMBER 20, 1967 '
The Regular Council Meeting of the City of Fridley was called to order by Mayor
Kirkham at 8:07 P.M.
OPENING CEREMONY AND INVOCATION:
Mayor Kirkham asked the audience to stand and join in saying the Pledge of
Allegiance to the Flag.
Mayor Kirkham introduced Reverend Brayshaw, representing the Fridley Ministerial
Association, who gave the Invocation.

APPROVAL OF MINUTES, REGULAR COUNCIL MEETING, NOVEMBER 6, 1967:
Councilman Liebl pointed out an error on Page 14 of the Minutes, under the
heading, "CHANGE ORDER �'iM-4°. The Minutes stated that Councilman Harris had
made the motion and had also seconded the motion. Mayor Kirkham said that
the name of the seconder need not be listed, so it wi11 suffice to strike �
Councilman Harris' name as the seconder of the motion.
MOTION by Councilman Liebl to adopt the Minutes of the Regular Council
Meet�ng of November 6, 1967 as corrected. Seconded by Councilman Sheridan.
Upon a voice vote, there being no nays, Mayor Kirkham declared the motion
carried.
APPROVAL OF MINUTES, SPECIAL COUNCIL MEETING OF NOVEMBER 8, 1967:
Mayor Kirkham pointed out that this was the meeting at which the Council had
canvassed the votes of the election.
MOTION by Councilman Samuelson to adopt the Minutes of November 8, 1967 as
presented. Seconded by Councilman Liebl. Upon a voice vote, there being
no nays, Mayor Kirkham declared the motion carried.
APPROVAL OF MINUTES, SPLCIAL COUNCIL MEETING, NOVEMBER 13, 1967;
MOTION by Councilman Liebl to adopt the Minutes of November 13, 1967 as
presented. Seconded by Councilman Sheridan. Upon a voice vote, there being
no nays, Mayor Kirkham declared the motion carried.
ADOPTION OF AGENDA:
Mayor Kirkham suggested that Item 3, "RESOLUTION SETTING SEWER SERVICE CHARGES '
FOR MULTIPLE DWELLINGS AND TRAILER COURTS", be deleted from the Agenda because
of the absence of Councilman Harris, and be brought back at the next Regular
Council Meeting.

ORDZNANCE -0�378 - AN ORDINANCE UNDER SECTION 12.07 OF THE CITY CHARTER TO VACATE
STREETS AND ALLEYS AND TO AMEND APPENDIX C OF THE CITY CODE - VACATING CHARLES
STREET•
MOTION by Councilman SamueLson to adopt Ordinance ��378 upon second reading,
waiving the reading, and publish. Seconded by Councilman Sheridan Councilman
Sheridan asked when this hearing had been held. The Fit�ance Director did not
have the exact date, but said it was a month or six weeks ago, Upon a ro11
call vote, Kirkham, Liebl, Samuelson, Sheridan voting aye, there being no nays,
Mayor Kirkham declared the motion carried,
CONSIDERATION OF HULLABAL00 TEENAGE DANCE CLUB:
The City Manager said that it would be the Administration's recommendation to
, the Council that the teenage club be allowed to operate in Fridiey. He said
that an off-duty Policeman should 6e on the premises, paid by the proprietor,
and if additional personnel is needed, as determined by the Police Chief and
proprietoz, they could be from a detective agency or from the Anoka County
Sheriff's Deputy List. He presented a Letter he had prepared for the Mayor's
signature to Mrs. R. K. Kratoska. Mayor Kirkham read the letter, granting
approval, to the Council.
MOTION by Councilman Samuelson�to concur with the contents of the letter to
Mrs. R. K. Kratoska granting approval for a teenage dance club in Fridley.
Seconded by Councilman Sheridan. Upon a voice vote, there being no nays,
Mayor Kirkham declared the motion carried. The letter was given to Mrs
Kratoska who was present at the Council Meeting, and she was wished well in
the endeavor.
POLICY FOR COMMUNITY ROOM:
Mayor Kirkham said that the policy as drawn up by the City Manager contained
everything as it had been discussed at the workshop discussion after the last
Council Meeting. For the benefit of the audience, Mayor Kirkham read the
fees that will be charged for the use of the Communrty Room, Kitchen and
Council Chambers.
Mr, Carl Paulson, a visitor to the Council Meeting, asked if there were
� restrictions making it possible to refuse the use of the rooms to any groups
that may c�'�:ate disturbances. Mayor Kirkham said that the City Manager had
drafted the policy after consulting with the Council, and a number of controls
had been built in. He pointed out also, that the applications for the use
of the Community Room will be coming in through the City Manager's office.

MOTION by Councilman Samuelson to adopt the proposed draft as the Policy �
for the use of the Community Room and Council Chambers. He said that this
was the first time that there has been something written on the use of the
Ciey's facilities, and he wholeheartedly agreed with the usage as outlined.
The Motion was seconded by Councilman Sheridan. Councilman Sheridan asked
if a larger room would be available in the lower level of the City Hall for
larger groups to meet. The Council felt that by using both the Community
Room and Council Chambers together, large groups could be taken care of.
The vote upon the motion was a voice vote, there being no nays, Mayor
Kirkham declared the motion carried.
EMGRGENCY REPORTING SYSTEM - N.S.S.S.D•
The City Attorney said he had consulted with Chief Aldrich in regard to this
request, and after checking with Northwestern Be11 Telephone Company and
the Railroad and Warehouse Commission, their recommendation would be that the
lines be made available to NSSSD at no charge to the District from the City.
He said that one ob�ection to a charge was that the City could not collect
any money for the use of the Board, or they would have had to handle all the
billing. He said that on a pro-rated share, it would amount to about $13.00
a month, and the cost of handling the billing would amount to more than that.
He said that the llistrict would make arrangements directly with the Telephone
Company for the lines they would need. The City Attorney said that if the
additional capacity is needed by the Crty in the future, the NSSSD will be
given 30 days notice to make other arraagements. He said that he has such an
agreement prepared. ,
Councilman Sheridan said he had related the Council's view to the District
and they were fully in accord with the Council's thinking on this, He said
this arrangement would be temporary as far as the NSSSD was concerned, and
when they have personnel_ on 24 hours a day, they will put on their own
emergency board, or make some other arrangement with the City.
MOTION by Councilman Sheridan to authorize the City Manager to sign the
agreement for use of the Emergency Reporting System by the North Suburban,
Sanitary Sewer District on oehalf of the City of Fridley. Seconded by
Councilman Samuelson, ilpon a voice vote, there being no nays, Mayor Kirkham
declared the motion carried.
BUILDING PERMIT FOR WAREHOUSE AND OFFICE AT 3-77TH WAY

The City Engineer said that at the Last Council Meeting, Mr. Harris had been
requested to move the building back to the property line, but that Mr. Harris
would like to leave the same setback, and put the parking behind the building.
The City Engineer said he feels that this would be a better arrangement than
had been decided at the last meeting.
MOTION by Councilman Sheridan to concur with the recommendations of the City
Engineer and approve the Building Permit as requested. Seconded by Councilman ,
Lieb1. Upon a voice vote, Councilman Samuelson abstaining, Mayor Kirkham
declared the motion carried.

� APPEAL OF RAILROAD CROSSINGS:
Mayor Kirkham said that it was the Council's prerogative Co decide not to
pursue any more action or to appeal for a11 or as many crossings as they
wish. He said he felt the Council should appeal for the crossing at 61st
Avenue. Councilman Samuelson said that the 61st crossing s[zould be
appealed because of the new school program. The City Attoxney said he
had discussed this with the School Superintendent and they wish to discuss
it with the CouncLl at their scheduled �oint meeting.
The City Attorney said that unless there is more evidence for the two
northerly crossings, he would recommend that an appeal not be taken on these,
but that the City wait until there is a more pressing need. Mayor Kirkham
said that it might strengthen the appeal to drop the others, and make a
strong appeal for the 61st crossing, The City Attorney said thNt if an appeal
�s mad� at 6Zst, the Counei3 shoula be cl�rted to th.: possib�lit� that the
City may hav=_ to pay a large share or a11 of the cost for a grade separation.
MayoY Kirkham asked if the City Attorney could determine what an appeal
would cost, and if �ust aa ob�ection is filed, or is there a chance to
present new evidence to strengthen our position. The City Attorney said he
would be prepared to dascuss thls at the �oint meeting with the School Board.
Councilman Liebl said that many of the people that live in the 61st Avenue
area have objected to this crossing, and if it is granted, they are interested
in the type of crossing, and safety measures will have to be taken. He said
� that some people have suggested the possibility of asking for a crossing at
57th Avenue also for better bargaining. Mayor Kirkham said that strategy
does not do much good with the railroad, and real facts are needed to back
up the City's position. Councilman Samuelson felt the City Attorney should
prepare an appeal for the 61st crossing right away because of the 20 day limit
Councilman Sheridan said that the appeal can be fxled, and the Council can
discuss it with the School Soard at their meeting next week.
MOTION by Councilman Samuelson to direct the City Attorney to pursue the 61st
Avenue railroad crossing on an appea�s basis prior to the determination date,
deleting the three crossings previously requested, and thaC the Administration
direct a letter to School District ��14 informing them oi the action taken.

Kirkham declared the motion carried.
REPORT FROM CITY ENGINEER ON THE PLANNED DEVELOPMGNT OF SPRINGBROOIL PARK:
The City Engineer said that Mr. Schroeder, the developer of Springbrook Park
had agreed to most of the items on the report as recommended by the Subcommittee
and the Planning Commission, and required by the Engineering Department. He
said he had discussed this with him again this afternoon, and he had further
agreed to comply with some additional xequests. He said he had agreed with
the landscaping items, except that he felt that a Landscaped area along the
north side of the propexty would be bettex than a redwood fence which would
� disturb the beauty of the area, and this item would be up to the Council.
It was the consensus of the Council that a fence would not be necessary
with the landscaped area. The City Engineer said that under the recreational

facilities, the developer planned a minimum area of one acre for children's �
facilities and play apparatus and wi11 have a_plan ready when it comes
before the Council again. He said that he has agzeed to an uncovered
swimming pool with a small covered recreational area for adult games and
a party room. He said he did not want to be specific, but would incorporate
something of this nature in the plans. The City Engineer said that under
the general plat plan, he felt a covered walkway from the garages to the
apartment buildings was unnecessary because of the terrain of the area.
The Council felt this Was a personal choice for the contractor to make.
The City Engineer said the cunCractor had agreed to having only one sign
designating the commercial area, and that the type and location of access
will be resolved at a later date.
Councilman Samuelson said he did not agree with the existing utilities
either being rerouted around the proposed buildings or encased, because
the street for the commercial center xs going to be a"U" shaped street,
and it would make no difference if one was cut. The City Engineer said
that they recommend encasing only for the Live utilities, and that the
contractor is agreeable.
MOTION by Councilman Samuelson to concur with the recommendations a[�d
suggested changes noted by the City Engineer on the Springbrook Park
Planned Development District. Seconded by Councilman Liebl. Upon a
voice vote, there being no nays, Mayor Kirkham declared the motion carried.
GREAT NORTHEAN RAILWAY REQUEST TO BUILD CONNECTING LINE BETWEEN THEIR LINE �
AND M,A & C. RAILWAY:
The City Attorney said that this had been discussed at the last Council
Meeting, and he had prepared a deed in the form of a Quit Claim Easement
granting the easement on the corner of a platted, but unbuilt, street.
MOTION by Councilman Sheridan to appxove the requested easement and
authorize the execution of the Deed. Seconded by Councilman Liebl. Upon
a voice vote, there being no nays, Mayor K�.rkham declared the motion carried.
MELODY MANOR BURGLARIES:
The City Manager handed out copies of the report on the Melody Manor burglaries
to the Council and the Press. He read the report aloud to the audience.
The Gity Manager said that this report wi11 be followed up. The City Manager
said that the Administration is going to continue the study on the street
light requirements in all areas, and if additional lights are warranted,
increased budget Eor lighting wi11 be requested in 1969.
Mrs. Kay Beaman, 7363 Memory Lane Northeast, thanked the City Manager, Chief
of Police, and City Council for the time and effort they 6ad put in on this
report, Mayor Kirkham said that this was the kind of cooperation the City
liked to get.
BIDS - SIDEWALK TRACTOA AND SNOW PLOW (OPENE➢ NOON, NOVEMBER 20, 1967); '

The recommendation from the Public Works Department was that the bid of Minnesota
Toro Inc., 850 Florida Avenue South, Minneapolls, Minnesota, for a Snowline P-48
be accepted. The Crty Engineer said he wanted to stre�s that they were going
into the program reluctantly. He explained that ALternate 9{1 is a snowblower
type attachment.
' Councilman Samuelson asked how the prlce corresponded to the 1968 Budget The
City Engineer said that there was $4,000 budgeted for the machine. Councilman
Samueison asked about the horsepowex and was told the machine was self powered
and was 35 horsepower, and the blower attachment was over 9 horsepower.
Councilman Samuelson said he felt there was no sense overspending the budget
before they even get there, and with the blower the price would be $6,090.
He felt the bids should be re�ected and new speciiications drawn. The City
Engineer said that they had investigated this thoroughly and had tried to
come up with a happy medium. He said that the machine would have a straight
plow and a"V" plow, and said that the blower could be put off £ox a year.
There was a long discussion on the necessity of getting the stow off the side-
walks, the additional sidewalks we have constructed sLnce Last year, and the
capabilities of the present equipment, Councilman Liebl said he concurred
with Councilman Samuelson on re�ecting the bids.
MOTION by Councilman Liebl to reject Che sidewalk tractor and snow plow bids
and request that the AdminisYration prepare new specifications for new Uids.
The Gity Engineer said that this machine would do a good �ob, and they felt
that if the City has the money, they could buy the blower, otherwise they
could let the blower go. He said they felt that if they had the blower, the
parks Department would�be abLe to use it also, but they do not feel it is
absolutely necessary. He saLd that they would like to get this tractor that
would do the job.

The City Engineer said he felt that for only $500 over the budget, they could
get a good piece of equipment which will do the �ob, rather than paying more
for labor with the present equipment. He said that if they call for bids
again, the snow season will be here long before the delivery date of the
equipment. Mayor ICirkham said he understood that the machine would not be
satisfactory without the blower. The City Engineer showed the Council
pictures of the tractor and plows, and said the attachment could be bought
later on CounciZman Liebl asked if the present snow plow could be traded xn.
The City Engineer said that there was still use for the sma11 p1ow. The
Superintendent of the Public Works Department said he felt this was the only
piece of equipment which would do the work his department wanted it to do.
He said that the V plow would be enough for the present time under normal
wnditions. He said t6at the City should not have as much trouble with snow
this year because the County has bought special equipment. Councilman Liebl
said he would like to see the equ�pment, if there is money available, because
the City needs rt.
The VOTE upon the motion to re�ect the bids and request new specifications
was a voice vote, Samuelson and Liebl voting aye, Kirkham and Sheridan voting
nay, Mayor Kirkham declared a stalemate and the motion failed.
MOTION by Councilman Sheridan to receive the bids as presented and upon the
recommendation of the City Engineer and Superintendent of Public Works award
the bid to Minnesota Toro Inc , for a Snowline F-48 in the amount of $4540.
Councilman Liebl asked what this would include. The City Engineer said it
would be for a tractor and two plows. Mayor Kirkham asked if they had the
money elsewhere. The CLty Engineer said that two plows had been budgeted for
the regular trucks, and they could probablq 1et one go this year and get by.
Councilman Samuelson asked if the Park Depaxtment would be able to use the
equipment in the summer. The City Engineer said they could 1f they gave
the money. Mr, paulson suggested the Park Department could possibly buy the
blower for the use of the equipment. The City Engineer said that something
could be worked out on the money problem.
The MOTION to receive the bids and award the contract was seconded by Council-
man Liebl. Upon a voice vote, there being no nays, Mayor Kirkham declared
the motion carried.

Mayor Kirkham saxd that the total o£ the 1ow bids, plus alternates, is $95,D56
zohich is substantially below the estimates. The City Engineer said that this
total would not include some items which would total another $10,000 which
would bring the total pretty close to the estimate. $e said that he felt the ,
building should be built with one extra bay which would be gravelled, in
addition to the three concrete bays.
MOTION by Councilman Samuelson to receive the bids for the Municipal Gar&ge
and refer them to the Administration for ta�ulation. Seconded by Councilman

PETITION 4k39-1967 OBJCCTION TO A VARIANCE IN EXTREMITY AS NOTED IN THE PLACING
OF TWO SEPARATE STRUCTURE� NUMBERED 360 - 57TH AVENiTE NORTHEAST:
Mr. Carl Paulson, 430 Northeast 57th Place, presented a petition, a letter
from a property owner on his street, and additional informatiott whlch he said
set forth the City regulations according to the Zoning Ordinance, City Charter
and Building Code on which they base thexr ob�ections to a double bungalow
being bu�lt between 57th Avenue and 57th P1ace. He said that Councilman-
Liebl's name was mentioned in this, and he would like to know what role he had
played.
The City Engineer showed the location of this building being built on Lot 10
and Lot 11 on the plat map, He said that it faces 57th Place, and there is
no requirement in the Ordinance requiring him to face 57th Avenue. Councilman
Liebl said that his name was mentioned because he had talked to the Suilding
Inspector about this in regard to a Building Permit, and had asked if every^
thing was up to code. He had concurred when he found that it was up to code,
and had not been aware that it fronted on the wrong side. He said that it
would be impossible to look into every detail.

' The City Manager said that he has discussed this with the Mayox and the
Crty Attorney, has investigated it, and has an answer on the City's stand,
He also said he has recommended a change in the Ordinance so this cannot
happen again.
Mr. Paulson asked about the contractor getting a permit when he was not
Licensed or bonded. Councilman Lieb1 said that the contractor said he
was faced with a problem of not being able to build this year if he could
not get started right away. He said that he had applied the first part
of September, and the bond had been ratified at the followLng meeting.
Mr. Paulson felt that in a situation like this, the Building Department
has a right to refuse the permit and notify the people of any problem that
may effect property values. He complained about the lack of inspection.
The City Manager said that when the permit was issued the Building
Inspection Department was shorthanded and if the failure to have a footing
or basement inspection were taken as a polnt of con�ecture, and he were
told to tear his home down again, the City would not be in the best position
He said that in the Code there are no rules for double frontage 1ots. The
City Manager read a part of the ordinance he is proposing on double frontage
lots so this will not happen agaln.
The owner of the home being buiTt, Mr Richard Simmons, 353-57th Place
Northeast, was present at the Council Meeting. He said that Mr. Paulson
has said that the owner across from tihe home he is building is pexturbed,
and if this is so, Mr. Simmons wondered why he did not say something in
' September, or three weeks ago when the garage slab was poured. He sa�d
that the garage can only be seen from across the street. A woman present
at the Council Meeting said that it could be seen from way down the street
Mr. Simmons said that the man next door had come over and, talking about
the petition, laughed and said he could care less. Mr. Paulson said that
this neighbor, Mr. Weigel, had told him differently. Mr. Paulson said that
politically the people wi11 see ehis problem and point at the Council, so
he wants it part of the record so that the people will know the Council
did not concur in this action.
Councilman Samuelson said that the Council sees R-7 �onstruction plans which
do have to come before the Council, and suggesCed that perhaps anything over
R-1 constxuction, which would include double bungalows, should come to the
Council for concurre,nce also, so that this does not happen again. In this
way, they couLd also be sure the developer provides landscaping, black-
topping and other items required. He said he agrees that Mr. Paulson has
a rightful complaint.

Councal he had gone over and spoken to Mr. Simmons' wife and asked why the
house was facing the other way. Mrs. Simmons had said that the City of
FrLdley had told them they could build it either way. He said it was not

true he had laughed, but felt it was built now, and something shaald have
been done befure it had gotten this far. Mayor T�irkham said that the
Council is taking action to prevent this from happening again and wi11
conduct a thorough investigation of this procedure to see what can be
done. Mr. Paulson said that he had brought Mr. Weigel to the meeting
because Mr. Simmons had lied and tried to give the Council a false
impression.

The City Engineer said that the amount of land is small for the type of
facility that is being planned, and there is no storm sewer. He said that
water wi11 be draining from the southeast corner onto City property, and
he feels that the County should acquire more property so they can coatain
their own water. The CityEngineer showed the Council a map of the park
and showed the way that it will expand. CounciLma❑ Samuelson asked how
the area complies with the Ordinance. The City Engineer said that it
would comply xf there was a complete storm sewer system, but as such, it
does not, and they should have more area so that a11 the water is con-
tained on their property. He said this should be impressed upon them.

The City Engineer said that there is still a problem with this 1ot, He
said that there is a garage which was built for the tri-plex, which
Mr. McClish will use for his land, which leaves the problem of parking
for the tri-plex, and the tri-plex cannot be forced to pro�ide parking.
The City Attorney said that he had received a letter fr;��m Mr. Wargo
that at one time all this 'and was owned by Mr, McClish. There was a
discussion between the City Attorney and Mr. McClish about the dates at
which he acquired the different lots and whom he acquired them from The
City Attorney`s figures showed that, although Mr, McClish acquired the
property at different tlmes, at one time he held title to a11 the different
parcels. The Crty Manager suggested that the City Attorney could be
directed to see if there was some procedure that couLd be enforced by the
County Authorrties, whereby a certi$cate from the Building Tnspector
would be required in the case of a 1ot split. Councilman Samuelson said
he agreed with this. Councilman Sheridan said that when the original
request came in, it showed three parcels, but the owner had not owned one
of these lots. Councilman Lieb1 asked Mr. McClish to come to the Council
table and show where these lots were situ�ted on the map. There was a
long discussion of the different possibilities at the Council table,

Mr. McClish was asked if he would be willing to deed 15 feet of land to the ,
tri-plex iE he were allowed to build on a 45 foot lot. Mr. McClish said
that he Tac�uld zf the owner were willing to pay the back taxes on it. Mayor
Kirkham suggested that if he would try and negotiate this with the owner of
the tri-p1ex, and give him 15 feet, and the Council allowed him to build
on the 45 foot lot, he could still maintain his 10 feet side yard require-
ments, and this may be a satisfactory compromise. Councilman Shexidan said
that they could also work out a driveway easement regarding the garage.
The City Engineer suggested that the problem of the required four paved
parking areas for off-street parking for the trx-plex could be solved at this
time a1so. Councilman Sheridan saxd this would be fine, but the agreement
should not be contingent on solving this problem, Mayor Kirkham suggested
they get together with the City Manager and try to work out an agreement
Mayor Kirkham said that the Council does not need to take action this
evening, but that it can be turned over to the Administration to come up
with a reasonable solution.

SUPPLEMENT TO PRELIMINARY REPORT ON WATER UTILITY;
Councilman Lieb1 said that the Council has received a supplementary to the
preliminary report from Comstock & Davis which is a report taking an honest
look at the Cities policy on supplying the City water. He said that the
well system was decided on in 1954 for economy aad the City must make the
best of it, and now look ahead and develop a program to provide the necessary
capacity for the future. He said that the quality of the water should be
looked at also.
The City Engineer reviewed the growth of the water system, and said that
, there is no capacity left for we11s at the present location, but that the
Locke Park area would be a possibiLity. He said that it will be a Couacil
decision on whether a complete iron removal treatment will be done, or if
the water will be mixed in the summertime and have a partial treatmeat.
He said th7.s was a matCer of economics as a complete treatment is very
expensive. He said there would also be the decision of providing one
well or isolated wells in different locations. He said they would need
guidelines, and then make test borings to test wtiere water is available,
He said they felt there was enough money from revenue bonds for exploratory
work.
Mayoz Kirkham said�that this item should be diswt.ssed very thoroughly, and
felt it was an iCem for a workshop discixssion. Councilman Sheridaa agreed
that it should be discussed thoroughly, and that they investigate the quality
of the water the City wants before they embar}c on a program. Couttcilma❑
Lieb1 suggested that this item be discussed more fully at the end of the
regular agenda for the evening, and the Council agreed.

Councilman Liebl asked if this ordinance �ust concerned snow plowing or if
it regulated parking for the whole year around. Mayor Kirkham pointed out
Section 76.05 on Prohibition of Parking. The City Attorney asked the Chief
of Police to comment on this.
Chief McCarthy said that the reason for this ordtnance was that it was
impossible to enforce our ordinance for snow removal. He explained that
it may not be snowing when people go to bed at nLght, but when they wake
up they find their car hauled away for snow removal. If these people knew
they could not park on the streets, there would not be this problem. He
said that the Council could decide on the policy of whether it is to be
enforced in the sixmmer. He said that this ordinance would also do away with
the semi-truck parking that the Police Department has been getting complaints
about. Councilman Samuelson said he agreed with this approach, as it would
give the City a tool to use if necessary. Councilman Sheridan said he did
not agree with it, because the people pay for concrete curb, gutter and
streets, and then are told they cannot use them. He said there are sane
3-car families that cannot park off the stxeet. He said he could agree if
they only enforced the problems, Ch�ef McCarthy said that other commun�ties
have this type of ordinance, and the enforcement of it is up to the Council.
Councilman Liebl said he would like to see it enforced in w�nter, but
otherwise he felt that people should be able to park in front of their
own ho�les. Mayor Kirkham said he would prefer t�o see it enforced as stated.

Councilman Liebl said that he had suggested at the last Council Meeting
that an agreement be reached that would do �ustice to both parties. He saxd
he would like to see the contractor that did the work get paid, but that the
�architect should probably be penalized. Councilman Sheridan asked if the
sub-contractor had been �azd for this revisiun. The Finance Director said
he had not. Councilman Sheridan asked the City Attorney if the architect
was acting as an agent for the City, so that the City is liable. The City
Attorney said he felt the City would be liable to the subcontractor, but it
would have a separate quarrel with the architect. The Council discussed
the moneq sti11 owed to Smiley & Associa;es, and withholding some of it until
this is settled. The City Engineer said he will have the fYgure sti11 owed
to Mr. Smiley at the next meeting.

DISCUSSION OP SPEED LIMITS AND ACCI➢ENTS ON T.H. 4k65 AND T.H, ik47: '
Mayor Izirkham drew the Council's attention to a copy of a letter prepared
by the City Manager, addressed to the State Highway Commissioner, requesting
reduced speed limits on T.H. �F65, and T.H. r'�47. The Council discussed
signal lights that will be placed at several locations. Mayor Kirkham said
that even with signal lights the speed limits should 6e reduced. The City
Manager outlined the reasons for the request as mentioned in the letter.
MOTION by Councilman Sheridan to concur with the requested speed limit
reduction, and authorize the Mayor to sign the letter to the State Highway

REQUEST FOR APPROVAL OF BUILDING PERMIT APPLICATION WITH SEVERAL CHANGES
FROM ORIGINAL - MOON CORPORATION:
The City �,ngineer explained that the contractors had run into a complex
problem when they started digging for the basement. He said that evidently
the topography map was not correct, and the building is too close to the
bank which goes down almost 30 feet. He said their request is to move
the 6uilding ahead about 10 feet and in addition they want to put 16 garages
in the rear instead of a parking strip in front of the building. He said
the setback wi11 sti11 be within the requirements. He felt this was a
good improvement and wi11 get the building onto solid ground.
MOTION by Councilman Ltebl to concur with the recommendation of the City ,
Engineer and approve the requested changes and the Building Permit for a
building at the corner of Anna Street and Charles Street as requested by

(A) MINNESOTA HIGHWAY DEPARTML�NT: TRAFFIC SIGNALS AND LIGIITING FOR T.H. -0F47�
The City Engineer said that there is a disagreement with Columbia Heights
on the signal lights at 53rd and T.H. ��47. He said that if the City had
received approval from Columbia Heights, we would have had the signal by
now. He said he understood that Columbia Heights feels that as long as
the whole facilitp is in Fridley, they do not want to particzpate, hut
the Highway Department feels that since one signal drains onto their
cornex, they should pay. Mayor Kixkham said that he would be speaking
to the Mayor of Columbia Heights, and would poiat out that the signals
would be serving Yheir citizens also. There was a discussion of signals
at other intersections, and when they will be operating.
MOTION by Councilman Samuelson to receive the communication from the
Minnesota Highway Department. The moCion was seconded, and upon a voice
vote, there being no nays, Mayor Kirkham declared the motion carried.
(S) MINNESOTA HIGHWAX DEPARTMENT: CSAH 1- TRAFFIC VOLUME:
MOTION by Councilman Samuelson to receive the communication from the
Minnesota Highway Aepartment dated August 17, 1967 Seconded by Couaczlman
Sheridan, ilpon a voice vote, there being no nays, Mayor T:ixkham declared
the motion carried.
� FURTHER DISCUSSION OF SUPPLEMENT TO PRELIMINARY REPORT ON WATER UTILITY:
The C1.ty Engineer explained that there will be three questioas for the
Council to decide: Whether they want complete iron removal treatment
which is extremely expensive, or mixing the water for a partial treatment
for a 7 month period. He said that only 2 wells are used in the winter and
9 in summer, and if a complete treatment is used this would mean that the
facility would be standing by doing nothing 7 or 8 months of the year
The other �uestion would be whether to put we11s in the Locke Park area
or have isolated we11s in different locations.
He explaiaed the three orlginal proposals that had been presented to the
Council in 1959 for their decision; buying all the water from Minneapolis,
taking it from the river, ox digging wells He said that the well system
had been decided upon as the cheapest investment He said that if ehe
concept for the future is a complete treatment, we11s must be found in one
well field similar to waht we have in Commons Park, and if they do not use
a complete txeatment, isolated areas can be found for the high peak time.
There was a long discussion between the Council, City Engineer, Consulting
Engineer and his assistant about the present system in use, otier possible
systems, the cheapest sysCem which would be mixing the water and building
wells when needed, or the most expensive system of going to the river and
, building a treatment plant to augment Che present supply and using the
present system as a standby for spr7�nkling. Mr Comstock said that it
would be a Council dec.Lsion on what they want to service the people with
Zt was suggested that a study he authoYized. The CouncLl felt this needed
a lot of discussion until the matter is resolved,

COMMUNICATION TO COIINCILMAN SHERIDAN FROM LIEUTENANT GOVERNOR GOET,',:
Councilman Liebl called the Council's attention to a letter Councilman
Sheridan had received from Lieutenant Governor Goetz congratulating him
on his re-election, and said the Council should be honored by this
letter. Mayor Kirkham read the letter out loud.
THANKSGIVING DAY MESSAGE;
Mayor Kirkham read a message he had prepared addressed to the City
Council, people of Fridley, and the Administration expressing best
wishes for an en�oyable Thanksgiving Day.
