RESOLUTION NO. 127 -1967
A RESOLUTION REGARDING JOINT ACQUISITION OF PROPERTY FOR ICE
ARENA, PUBLIC WORKS GARAGE AND OTHER CITY PROPERTIES
BE IT RESOLVED, By the Council of the City of Fridley, Anoka
County, Minnesota, as follows:
WHEREAS, The Anoka County Commissioners have determined a need
for an Anoka County Ice Arena and,
WHEREAS, the Commissioners have determined that property bounded
by University Avenue on the West and 71st Avenue extended on the
North and Locke Park on the South and East would be an ideal
location within the City of Fridley, Anoka County, for said arena
and,
WHEREAS, the Anoka County Commissioners and the Fridley City
Council have attempted to negotiate the purchase of the above
described property consisting of approximately 25 acres and owned
by Minnesota Transfer Railway Company and,
WHEREAS, the Anoka County Commissioners and the Fridley Council
believe that the asking price for said land is exorbitant and does
not reflect the market value of said property and,
WHEREAS, the Anoka County Commissioners need approximately
122 acres for the construction of the Anoka County Ice Arena and
adjoining parking facilities and,
WHEREAS, the Anoka County Commissioners have agreed to start
condemnation of the above described premises and,
WHEREAS, the City of Fridley needs a location for public works
garage.
NOW, THEREFORE, Be it resolved, that the City of Fridley
agrees to purchase from the Anoka County Commissioners the East
One -Half (EZ) of the above described tract for a price equal to
one -half (12) of the condemnation award or one -half ( 2) of any
negotiated purchase price, which price shall be approved by both
the Anoka County Commissioners and the Fridley City Council.
BE IT FURTHER RESOLVED, That said agreement is made with the
understanding that the Anoka County Commissioners will provide at
their cost the construction of a service road to service said
property and will grant to the City of Fridley an easement over the
West one -half (WZ) of said property to serve as access to the East
one -half (E2) of said property.
BE IT FURTHER RESOLVED, That the City of Fridley agrees not to
assess the West one -half (W2) of said property for any additional
water, storm sewer or sanitary sewer assessments. It is mutually
agreed, however, that the cost of extending existing services to
this parcel shall not be considered as additional special assess
ments but rather connection charges which will be born by the
Anoka County Commissioners.
