It has come to my attention that Fridley may request a direct
connection to the District interceptor in the area of 73rd Avenue. This
connection would apparently be f rom an industrial building in the Commerce
Park development. The Distric�C has recently received a request for a con-
nection to our line of the sewer lateral presently installed in this area
but has received no request for a separate connection for the southern part
of Commeree Park. The original plans, as submitted to the District, call for
a lateral running east and west in the Park which�apparently was to service
the area in question. However, we are not certain what laterals.were indeed
installed.
The contractor who has been hired to do the sewer work on this
project called the District office requesting information regarding the
procedure on how to make a connection to the District line. The District.
Board has set forth certain requirements of Fridley before connections to
our line can be allo�aed and these requirements have been previously commurii-
cated to your office. The City did submit plans of the sewers to service
this area together with the location at which you wish to connect to our
line. However, if there has been some alteration of tHe previous plan, theri �
in keeping with our requirements it will be necessary for ti�e District to .�-
know exactly what area would be served by this proposed new connection and•
plans submitted covering the sewers for this area. It would be well to note
that, if indeed there has been.a change in the lateral sewer plan within the
Coimnerce Park area, the District should be made aware of this fact.
The City of Fridley should bear in mind the cost factors for
additional metering equipment etc. that may be required for these connections
contemplated for the Commerce Park development. -

easements as far as the Ci,ty was concerned. T'here is a 15 foot private
easement across the West elnd and the watermain and sewer lines are on
Mr. Momchilovich's property without easement to the City. TE►e lot to the
North has deeded some propierty and the lot iron is on that corner.rather _
than Mr. Momchilovich's pr,operty. ,
Mr. Momchilovich wonder'ec� if the City planned to take the service lane
all the way through to Mis�sissippi Street, but Mr. Jensen said it would
not be in a straight line !and there has never been a eontinued service road
along the Highway up to Mi'ssissippi Street.
Mr. Myhra asked that, if the peti.fioner were to give a 30 foot easement,
what would be the size of ',the apartments he could build. The Engineering
Assistant replied in R-3, ,$ units and in R-3A, 7 units. Mr. Myhra asked
where the approach that goes onto the highway is located. Mr. Momchilovich
answered that if the approach were to continue straight East, it would•be
on his property. '
In 'answer to Mr. Jensen'''s question, Mr. Momchilovich said he would-objeet�
to dedi:cating a 30 foot easement, as it might push his setback line back
further than the buildings'South of him. The way the'sexvice lane is-now,
if he would dedicate 30 fe�t, there would be a 20 foot jog into his property.

Mr. Momchilovicti asked if there were any plans for a street ancl was told
that there were no specific plans for a street, but there is nothing to
prevent the Highway Department closing their right of way.
Another question Mr. Momchilovich asked was if it would be O.K. for him
to build in line with the apartments, or he would be willing to put the
building wherever the Planning Commission would suggest. Chairman Hughes
infonned him that if he should dispose of the property, the new o��mer would
not be bound by what he had agreed to. .
Mr. Jensen reminded Mr. Momchilovich that if this rezoning were granted,
the value of that property would increase the value of the square footage
of the land involved.
MOTION by Erickson,�seconded by Je�sen, that the Planning Commission
recommend approval of Z0A ��68-04, Louis Momchilovich, being the South 150
feet fxont and rear of Lot 9, Auditor's Subdivision ��88 to be rezoned
from R-1 to multiple dwelling, subject to the dedication of the West 30 feet
for service drive purposes and recommend that there be no waiver of land
area requirements as they relate to the number of units that can be built
on the property. Upon a voice vote, all voting aye, the motion carried
unanimously.
Mr. Momchilovich asked if he had a certain length of time and was told
this item will be before the Council two weeks from Monday (April 15th).
` He can go before the Council and present his arguments against the Planning
, Commission recommendation of densities.

Mr. Erickson reminded Mr. Momchilovich he was giving up, in one sense,
and gaining in another. He had until the public hearing before the Council
to plead his case. Council can uphold the Planning Commission recommenda-
tion or turn it doum flatly. T'he decision of the Planning Commission was to
recommend approval of the rezoning subject to dedication of the Westerly
30 feet of the tract for service road purposes to R-3A. The mai.n portion of
the recommendation was no waivex of land area requirements for the number of
units he is having.

City Manager concurred with the Building Inspector. Such permission could
not be given an he would be in violation of the UBC, Section 301, Paragraph A.
The unapproved walk-out would be in violation of Sec. 301, Paragraph C.
Darrel Clark checked the drainage with transit and found it inadequate and '
a violation of Section 45.2b, Paragraph B,of_the City Code.

Reinspection with Darrel Clark, the City Engineer, and the City
Manager concurred with above findings. Mr. Gnerre also stated in this

The Enoineering �ssistant said that cae have two cases
where special use permits tvere granted, tiaith no construction
and ti�e are �4altlIla for an opinion from t�e City Attorney
on this very nuestion.
The Chairman said ttiat the variance iaould not have to
be recommended i.mmecliately. In most cases, ��here there is
a time limit, the time limit can be extended by the petitioner
where �ie has been delayed. We are not sure in this case
if there is a time limit. .
D�r. Myhra said he would hesitate to go to R-3 in vie���
of the fact the people living around there might feel
entirely different to an apartment accor.ding to their.
expressions at the last Commission meeting. In speaking.to
Dr. Ingebrigtsen, P-1r, i�4yhra said if there is a time limit, and
this runs out before he is ready to move, it has been suggested
it can be extended -- is this the way you understand it?
Dr. Ingebrigtsen asked.if .then, the Planning Commission actic-
would be recommending a variance and he was told they
could recommend CR-1 and for the petitioner to ask for a
variance later on,
Chairman Eiughes asked Dr. Ingebrigtsen if it would be
satisfactory to him for the Plannino Commission to recommend
to the Council this request to CR-1 with�_the recommendation
for �the variance for professional offices other than medical

a varianceshould be considered so as to include the possibil.ity
of other pro£essional and office facilities other than that
specified in the CR-1 zoning. Upon a�voice vote, al1 voting
aye, except �1lember Erickson, the motion carried. �
Mr. Jensen added that he believed it was proper, in
keeping with the intent of the petitioner and.in line with
the proper protection of the neig.hbo,rh.00.d., to restrict ..
rezoning to a CR-1 rather than the desir.ed C-1 by �the
petitioner. The CR-1 zonin� allows the majority of uses
that �ti�ere described by thenetitionerin his presentation�
for the reason of_ his rezoning. I think it is unfortunate
that the CR-1 zoning is as restrictive as it is in this �
particular instance and therefore I would hope that Council,
in the future, and other Commissions examininG the variance
of the renuest, would favor the rec{uest in line with the
recommendatioiis of this motion. - �

Mr. Philip fiirsch and b1r. R. Wormsbecker �aere present,
The Chairman informed the audience the public hearing had
been closed on this petition and now the matter was before
the Planning Commission for consideration.
A slight change had been made in the plans for the
complex tiahich were explained by Mr. Hirsch including a
discussion of proximity of Mr. Plum's property. When
asked what would be going in the commercial area, 1�1r.
Wormsbecker said there would be a�combination type of
grocery store. It would be a commercial enterprise and
would architecturally blend in with Mr. Hirsch's plans.
Mr. Erickson said he thought he indicated at the last
meeting some concern over the possible setback. The City
� Attorney assured him it was highly possible for the City
to enter an agreement with the property owners for certain
set backs and be perfectly binding. It may be desirable
if R-3 zoning were granted as it restricts the side line
requirements. Once the rezoning is granted, this plan
does not mean anything.
Mr. Jensen said thai during the action of the Plats
and Subdivisions-Streets and Utilities, he noted that the
recommendation for approval of the street vacated (Olive
Street) included acceptance o� a 10 foot additional right of
way for the Nlississippi Street extension and he would like
to review the viewpoint of t�e petitioner. Is there any

Mr. Hirsch said he was not concerned about that, but
he was concerned about the side yard. He was willing to
give the additional 10 feet. .

study made on the apartment market in Fridley and found
that the uacancy factor .is very low. Compared with 11 �
�different complexes in the area, some in Fridley and soine
adjoining villages. They found that the majorityof bui�ldings_

rezoning request, ZOA #68-06 except for Parcel 1-A as
described in the public hearing notice dated Nlarch 27
and April 3, subject to the excution of an agreement
between the land o�rners and City of Fridley to .restrict any
construction to a minimum setback of 38 feet on the North
and 45 feet on the South, 100 feet from East River Road in
a11 R-3 or R-3A zoning and the dedica�ion of an additional
10 feet of the south end of Blocks 21 and 22 from East
' _ River Road to jaest boundary of Riverview Terrace. Upon a
voice vote, all. voting aye, the motion carried unanimously.

The Engineering Assistant called attention to a dj,screpancy
in the right of East Ri.ver Roacl. The Cotinty originally
took an additional 24 fee� for East River Road, Back �vhen
Lorrie Johnson was interested in the property, the City
asked for an additional 26 feet of right of way and described
it as being part of the Block 22. Since that time a survey ivas
made by the County and the new alignment ZJas.made on East
River Road creating an island of Iand 10 ta 15 feet �vide.
Mr. I-Iirsch said the drivetaay easement and the strip
between tlie driveway and East River Road belongs to the
present property owners and they tiJOUld like to see it
aligned to their property. �
The Engineering Assistant said Anoka County has seen the
discrepancy and may ask that it be cleared up because it. is
torrens property. The original intent ivas at one time for
a 50 foot wide servi.ce drive. Since that time, service
drives for East River Road have not been talked about, therefore,
perhaps the Right Of Way could be reduced to the amount
needed for turn lanes.
It was decided that NIr. tiVormsbecker should return
with more information. �

Chairman Hughes said the attention of the Planning.
Commission was�called�to the editorial which appeared iri the
Fridley Sun on April 24, 1968 in which the editor spoke
favorably of the action to delay zoning of the land in the
Hyde Fark Area.
hi.r. Myhra said that since the time of Council'�s final
action on 1�Ir. Schmedeke's petition, very little action has
been taken, and that it is time for the C.ommission to
consider the approach that we should be taking in this matter
as'to recommending a course to the council. He said the -�

� After further investigation, it has been found that funds are available to
finance the addition of the Park Departmen� quarters in the Lower Level of the
Civic Center, -
The City is holding in a S�ecial Escrow Account �he amount of $6,982.04, pay-
ment for granular material �urchased by the Highway Deparfiment from Locke Park.
Zn oxder to do an A-1 job on these quarters, it will take about $4,500.00. I
�eel that the quarters should be developed now and not later because of higher costs
'' of construction, The package woul.d tie in nicely with the police c�uarters installa-
tion. These auarters would affoxd much more additional space for our operation.
�Z xecommend to the City Council that they consider this•method of financing
the pxoject and gzve their approval to build the Parks and Recreation offices in the
