whether there will be a primary election whenever three candidates
have filed for office. If the Council desires to have a primary
for the office of Councilman at Large they should pass the attached
resolution.

WHEREAS, the City Clerk of the City of Fridley has repor��d ��a�t 3
�andidates havs fiied with his office for election to the office o� C��racilman
At Large.
NOW, THEREFORE, BE IT RESOLVED that, pursuant to the Charter of the City
of Fridley (Chapter 4, Section 4.03 as amended), the Council hereby provides
for and calls the Primary Election of the City of Fridley to be held in the
City of Fridley on 7uesday, the lOth day of September 1968, at which election,
etectors of the City shall vote and cast a ballot with respect to the office of
�runcilman At Large, and thereafter the two candidates receiving the highest
number of votes for such office at such election, shall be deemed the candidates
for the office to be voted upon at the Regular forthcoming General Election to
be h�ld on November 5, 1968.
That the City Clerk shall give at least 15 days notice of the time and
pl�ces of holding such election, the names of the candidates who have filed,
and pf the offices to be eleeted, by posting a notice thereof in at least one
paebl6c piace in each voting precinct, and by publishing a notice thereof at
ieast ance, privr to said Primary Election, in the official newspaper of the
City.

the past year. My neighbors and our family are convinced that the

The recently enacted surtax-appropriation cut act
(Revenue and Expenditure Control Act of 1968) contained
, a provision which says in effect that industrial revenue
bonds are no longer tax exempt .
The attached communication from the Municipal Finance
pfficers Association urges the support of a bill which
would clarify this legislation and protect some forms of
municipal bonds from being subject to income taxes.

provide a general redefinition of "industrial development bond" which accords

The quoted terms are defined i.n sec. 103 (c) (3) as proposed to be amended by
sec. 2 of the proposed bill.
"Industrial property" (proposed sec. 103 (c) �g ) would be lfmited
to its natural meaning of factory-type structures and equipment. It would not
include facilities, in factories, for the ebatement of air or water pollution,
waste disposal or other health or safety functions.
"Independent wholesal� or retail property" (proposed sec. 103 (c)
(3� (C}) includea structuras for shops ag well as retail departmenC stores
and similar mercantile establishments; but shops at public airports, offices,
bus terminals, museums, turnpike service areas, etc., are not included.
The definition of "exempt person" (proposed sec. 103 (c) (3) (A))
is retained from the Revenue and Control Act of 1968 (hereinafter called the
June Act). It includes governmental units and certa�.n oducational, charitable
and other tax exempt instituti.ons.
The requirement of a private, taxable '°beneficial obligor" is critical.
So long as the Congress does not propose to challenge the long-standing consti-
tutional rule of the States' and Tocal governments' immunity for thmir obliga-
tions, the only basis for taxin�; certair� bonds issued by States or local govern-
ments is that they are th� issuers' obligations in name only -- that the
issuer ie so disassociated from the ob2igation and from the facility financed.,
that the investor considers the private user as the "true" obligor and the
constiCutional lawyer may take the same approech without repudiating unreversed

The attriUutes of such a disassociation, as set forth in proposed
sec. 103 (c) (3) (D), are: (i) th� �utative� p�ivate abZigor wi11 be using the
property financed under lease or other contractual arrangement which requires
him to pay all or most of the funds needad ta w�et debt service on the
obligations, (ii) the putative private obligor and his contractual arrange-
ment are identified in the bond agreement or in the offering prospectus,
and his payments thereunder andJor the financed property are specifically
pledged or mortgaged to secure the bonds, and (i.ii) the governmental issuer
could not itself operate the industrial plant or shop to be financed. Evasion
of this third element is prevented by discounting certain sources of claimed
power. Thus, claimed power under a"residusry power" clause (granting all
powers not withheld) would not suff ice; nor'v�ould a grant of power made pri-
marily to seek exemption for otherwise taxable industrial development bonds.
The proposed new defiriitfon o� "industrial develop�nt bond" would
correct a grave assault on state a�d local gavernm�nt contained in the newly
enacted June Act. It is hard to believe ttzat tF�e Senators who first voted,
without hearings, for a Treasury-drafted rider tu define "industrial develop-
ment bonds," really int�nded to include bonds �ar prac�ically any state
' governmental purpose if the fixxanced facility would have private occupants
paying to use it, But tFiis is what was done by the lax�guage they Voted for

Congress enacted. Thus the enacted definition includes bonds for airporta,
markets, nursing homes, piers, fairs, recreational facilities, ete. With�ut
hearings on the industrial development bond problem at any stage of the

to point out the impact of the ri�er.'Besidas, the attantion of the Nation

The June Act does noC at this time, �t is true, tax al.l of the bonds
it labels "ind��strial development bonds," but its technique o� limitation is
most offensive to the States and their place in the Federal system. It sets
up a list of approvQd purposes ].abeZed "Exceptions." (Sec. I03 (c) (4)).
Bonds for these purposes remain exempt and thase for all other State govern-
meneal purposes may be taxable. Thus the Congxess purported to class�fy as
"good" or "bad" all the legitim�te, constitutional functions of state or local
government, rewarding "good" purgoses with exemption and penalizing "bad"
purposes with taxation. Among the "bad" purpas�s are such fundamental govern-
menCal functions as education and he�lth caxe, w�iich are utterZy unrelated to
the davelopm�nr of new industrial pl�nts.
If such an appraach is retained, the Stat�s and cities must reckon
not only with the presant list but with the inevitable changes which will be
made by future Congresses which woul.d h�ve changing evaluations of the various
lawful State and local policies.
The present list of enmct�d "exce�tian�" is itself remaxkably irra-
tional. For example, as rhe Senate �assad the rider, there was an exception
for groperty "to provide entertainment (a.ncludin� spartin� events) or recrea�
tional faci].ities for the general gublic." As anacted, this was cut down to
"sports facilities." As a result, an exemption iE currently provided for bonds

to finance a stadium built for reatal to a prof�ess�onal baseball taam shapping
for a more lucraCive franchise, but no �xemption fs providad for a public

or educational drama. �
As snother example, Che �,xc�ption of th� June Act for terminal facilitics
covers airgorCs and piers for sir and m�rine vehici�s but not terminals for land
vehiclas such as buses, trucks or rai.lroads (unless they are limited to '�mass
commuting facilities,")
Facilities for education or health care are not among tha listed excep-
tions in sec. 103 (c) (4) as added bq the June Act.
The exception for utilities is limited to "local furnishing of electric
energy, gas, or water." The Conference Co�ittee report stated specifically
that these wurds "do not include facilitf�s'for regional or bxoader transpor-
tation of �as or water by pige line nr long Ii.ne transmi�aion of electric
energy." Yet ix� P�rt$ o� th� cou�.try, p�xta.�ularly th� w�st, regional or
broad�r transmiesion fa�ilities are essential p�rts of publiclyPowned utility
networks. The distinction between local a��. r�gional facilities �eems arbitrary.
This typa of con�ia�uing r�gul�tio� by seleceion of state and local func-
tians has no prc►per place in a I�ederal Sys�em and it wauld be abandoned in
Mr. Mills' bill by the repealer of sec. 103 (c) (4) as added by the June Act.
Zn the fie�d of true�industrial development fixtancing ot•factory facil-
itiea the proposed bill �eeks to draca the line between rec:ognized abuses and
usas which are in the N�tional as we11 as tha State interest to provide jobs in
areas of substantial a�nd chronic unemployment -- including the urban ghettos
and rural slums.

, underemployueent. The criteria set forth are der�ved generally from:the
Advisory Commission on Intergovernmc�ntal R�l�ti.ons report on industrial
developinent financing. This report waa joined in.by Federal cabinet officers,
including the Secretary of th� Tr�asury, and by the Congressfonal members of
the Commission as well as by the members representing atate and local governm�nt.
These criteria are: (A) that location of tho industrial plant be
restricted to a coumiunity or area with a condition of substantial and persistent
unemploym�nt or underemployment; (B) �hat otixer opportunities for employment are
lacking; (C) that the number of jobs to be created wf.11 not be much greater than
the number needed to correct th� conditian; (D) that the plant will not have a
high ratio of capital cost to jobs, as would generally be the ca�e with an
automated plant. (A specific upper limit is provided based on annual Bureau
of Labor Statistics reports-it approximates ten timc�s annuai payroll for direct
proauction workrars.)
The Governor of the State must certify tha�: these criteria are met b�fore
tho exemption of propnsed s�c. L04 (c) (4) waullcl apply to a particular issue to
finance industrial pxoperty. The �xemption would not apply to in�ependent whole-
sale or retail property.
Sec. 4 of Mr. Mills` bill wa�ald lesve undisLurbed the Juno Act's concept
of exeinpting also car.tain�sm�ll issues undQr sQC. 103 (c) (6)., However, the
exempt issue atnount would be raised from $1 million to $S miLlion, which ia
deemed a more r��li.s�ic dividing line bQtween the issues representing healthy
normalcy and th� jumb� issues which have attracted national condemnation. In

1967, over 85% of the dollar volume of all industrial davalopment bonds was
in issues over $5 million.
Under sec. 4 of the bill, however, the �mall issues exemption of
sec. 103 (c) (6) would not apply toissuos to finance indepandent wholesale
or retail property. In this respect, the bi11 would be more restrictive
than the June Act.
In ascartaining the issues covered by the sec. 103 (c) (6) exempCion,
the bill would make no changes in subparagraphs (B) ("Certain prior issues
taken into account") and (C} ("Related persons"), wltich the June Act added
to prevent circumvention of the stated dollar limit.
Nor would Mr. Mills' bill make any ch�nge in sec. 103 {c) (5), tha
exemption for induatrial park financing, or in sec. 103 (c) (7) (the so-ca2led
"doubla-dip" exception), as added by the June Act. Under ssc. 103 (c) (7),
as retained, the exemptions for certain issues tio alleviate unemployment
(proposed new par�graph (4}), for industra.al parks f�.nancing (reta�ined para-
graph (S)) and for cert�in small iasus�s (amended para�raph (6)), would not
apply ta �ny obiigatian for any p�rind duxin� which it is held by the person
who is the beneficiaZ obligor.
Sec. 5 of th@ bi11 would, ho�aever, add to sec. 103 (c}, as paragraph
(8), an additional basis for withholdin$ the e�eruption� of p�ra�raphs (4),
(5), (6). Por th�s� ex�mptiona to apply, the �overnar must certify that the
industrial pl�nt to be financad is not "pirated" or a"run ac�ay shop" or
otherwise being relocat�d from anothar stata. '�hi.e adde3 xequirament would
eliminate a possible abuse which was not prevanted by t1�Q 3un� Act.

Sec. 6 oi the bill sets forth the ef£ectiva date and transitional
provisions. They are almost identical with the corrssponding provisions of
the June Act. The date of April 30, 1968 is retained so that, in effect, the
bill, if enacted, would displ.ace the June Act. One change is to eliminate
the June Act's require�ent that bonds exempt under the transitional provisions
would have to be issued duri.ng 1968. There appears no �ood reason for requiring
accelerated issu�nce prior to the time such bonds would be issued under normal
construction schadules. On th� contrary, �uch accel.aration cnuld flood the
1968 municipal bond market and adversely aff�sct convantion�l municip�l isaues
for schools, hospit�ls, s�re�ts, s�wera, etc.

Section 4:815005o Declaration of Policye It is hereby determinted
and declared to be the public policy of the City to maiaxtain the highest
practicable standards of purity of the air in order to promote and further
the public enjoyment and use of t�e City°s natural scenic and outdoor
recreational resources, to im.prove public health, and to facilitate the
growth of human, agricultural, plant, and animal life, all consistent with
maximum employment and full industrial development of the City and its e,nvirons<
It is deemed and determined necessary and required to the health, morals,
comfort, safety, conven�ence, and welfare of the inhabitants of the City of
Fridley to provide means for r.eductfon, control, preeention, prohibition,
abatement and suppression of air pollution. It is further realized that
the,-problems of air pollution are not necessarily solely local, but usually
are somewhat regional in nature, and to that extent, the City shall
cooperate with other municipalities, districts and counties for the purpose
of effectuating the provisions of laws, ordi,nances, and regulations dealing
with control of air pollution�
Section 4:815e0?a Air Pollution and causes thereof declared to be
a Nuisance� Air pollution and its causes are hereb� declared to be a public
nuisancen For any person within the corporate limits of the City to cause,
permit or allow emmission of air contaminants, including hut not'limited to dust,
fumes, gas, mist, odor, vapor, smoke, particulate matter or combinations
thereof, from any process, process equipment, refuse-burning equipment,
fuel-burning equipment, control equipment, or from any opening of any building,
or from any other source whatsoever, within the limits of said City, in such
mannex or placa.as to be or tend to.be injurious to huatan heal.th or-�aelf.are,
or injurious to human, plant or animal life or property or the conduct of
business, or to cause damage to property or business is hereby declared to:be

Section 40815„090 Public Nu�.sance Prohibitedo Any person who
shall commit, cause, or create a public nuisance or permit any public nuisance
to be created, or to be placed upon, any ,premises owr.ed or occupied by him
or them, as declared, defined, and prohibited in this ordinance, shall be

that an analysis af. the emissi.ons from any sour.ce is necessary to determine
the extent an.d amount of air pollution or air contaminants emitted into the
atmosphere which can.not be determiaed by visual observation, he may order
the collection and the anal�sis of samples by the Fridley Health Department,
The Minnesota State Health Department, State Pollution Control Agency, or by
any competent laboratorye The feES for suc.h work sha11 be equal to the total
of the actual cost paid the personnel plus the actual cost of the analysis
work� The City Health Authority shall report cost of such work to the
Director of Finance who shall render statements for such wor.k to the licensee,
or other peraon respon�ible for the control equipment� The statement shall

(b) the location, (c) raw materfal to be processed, (d) flow chart of
operation, (e) existing air pollution controls, (f) proposed measuring
devices if any to be installed by applicant, (g) and such other informatioa�
as the Fire Prevention Ch.ief shall require� Such application for and
issuance of such licenses, their maintenance, termination, and administr.ation
sh.a11 be in accordance with and subject to all conditions of the Fridley
Or.dinance Code relative to general xequirements for issuance of licenses

Section �r:315. :-1. Removal and Correction of Violations. All persons.
operating air pollution control equipment or allowin� �r causing the emission
of air contaminants, havin� a report postecl in the establishment giving notification
of one or more vialations of this ordinance sliall correct or remove each such
violation within the len ;th of time se c by t�ie Health Authority. The len�th of
time for the correction or -rerr:oval of each such violation shall be stated on the
inspection report. The failure to remove or correct each such violation within
the time period noted on tize inspection re�ort �nall constitute a se�arate vio-
lation of this ordinance.
Section �'r:�15. S-3. Dense Smoke or Equivalent Emissions Prohi�ited.
No person shall cause, �uffer, or allow the err.ission of dense smoke or any
other equivalent emission into the atmosphere from any �rocess fuel-burning
�quipment, refuse-burnin� equi�nzent, ,�rocess equipment, open fire, or any
other source. Dense srr-,ol:e is smoke the shade or appearance of which is
clarker than No. 1 of the P.in�lemann �hart or of �uch opacity ae to obscure an
ol�server's view to a degree equal to or �r�ater than does smoke of the shade
of No. 1 of the Rin,n,leman:i Chart exceptin;;:
Subd. 1. Smoke, t.'�e shade or appearance -�f which is equal

1�10 person shall cause, condutt, use, operate, or maintain any machine, equip-
1nn8rtt jaro�ess or process equipment not otherwise regulated in this ordinance,
o� 8uch equipnnent to which the process weight rate table, elsewhere mentioned
hexeix�, cannot be applied, which emits air contaminants to the atmoephere in
qua�titi�s or frequencies which cause air pollution as herein defined.
Section 4. 815.53. Sulfur Di�Qacide Requirements. No person ehall
allow, permit or cauae the emission into the atmosphere of sul�ur dioxide from
aay souzce in such manner and amount that the concentrations and frequencies
c� st�ch emissions exceed those shown in the following Table No. 2 in the ambieat
a�x at any place at or beyond the property lines of the premises upon which the

Section �4:815. 7;�. Hand Fired Fuel Burnin�Equi�ment �rohibited.
No peraon ahall insta.11, construct or use hand fired fuel burning equi�ment 8uch
as but not limited to furnaces, boilers and stoves. This requirement shall not
8pply t0 �ixeplacea, recreational fires and construction fires aa �rovided else-
where i,n thim ordinance.
' Section 4:315. �1. Gdors, Emission �rohibited. No �erson shall
cau��, �ernnit or allow emission into the atmosphere of air contaminants having
odors which are noxious, nauseating, obno�cio�c, offencive, annoyin�, iajurioua or dsaQet•
au� tp l�ealth, comfort, welfare, or property.
Section 4:315. 32, Odors, Emissions, Fanel. No person sha►II cause
Ox parmit the emisaion into the arrioient air of irritating obnoxious odors whichare ot �uck
intensity as to cause air pollution on any adjacent residential, recreational, in-
stitutional, commercial or �ducational �remises. An irritatin; odor will be
deemed to be of such intensity as to cause air pollution when 30 percent or rr.ore
of ��ample of the people norinally exposed to it believe it to be objectionable
in their u�ual places of occupancy. The sam.�;le size shall be at least 20 �eople
or 75 percent of those ex�osed if fewer than 20 �eo�le are exposed.
Section 4:�15. �3. Equipment Breakdown. No pereon shall operate
any �rocesa, process equi�ment, fuel-burnin� equipment or refuse-burnin� �quip-
ment when such �rocess or equi�ment is out of repair, causing or �ermitting a.ir
contaminants to be emitted into the at�rios�here. Emissions exceeding any of the
lizxiits establiahed in this ordinance as a�irec� result of u�set conditions in or
bxea►lcdown of any process equi�rr.ent, fuel-'uur:zing equipment, refuse-burning
equi�ment or control equipment or related o;�zrating equipment beyond the control
of the person owninti or o�erating such equi�ment, shall not be deemed to be in
violation of this ordinance, provided that the owner or operator advises the Health
A�thority of the circumstances and outlines a corrective �rogram. The Heslth
Authoz�ity shall permit o�eration on a temporary basis during the �eriod of auch
ar� emergency shut down if such operation will not create an immediate serious
public health hazard.
Section 4:315. �5. F'rovision of Test r^acilities. Any person reepoa-
sibl� fpr any process, process equi�ment, control equipment, fuel-burning equip-
ment, xafuse-burning equipment, or other equipment which may emit air contam-
inanta, u�on the request of the Health Authority, shall provide openings,
meax�,� pf access to sam�ling points, lightin;, and power source, and any similar
sa�pl��}g facilities necessary to provide accurate inspection and testin� thereof
undear this ordi�nance. Such facilities may be perrr:anent or temporary at the dis-
cr4t�on oi the person responsible for providing the :z. Such facilities shsll be
safe zad shall conforrn to all applicable Laws, Rules, and Regulations covering
safe practice.
Section 4:815. 87. Equivaleat lv ethods of Air Pollutioa Control. Any
proeedure. process, or equipment which shall provide sir pollution control �eeting
the sbndarda of this ordinance may be validated. The licensee or other �roper
per�QQ �hall submit to the Health Authority evidence showing in detail the procedure,
procps• pr equipment and tbe effectiveness thereof. If such methods are determiaed
by the Haalth Authority to be an equivalent, the Health Authority shsll vslidste Lhe
