The Regular Council Meeting of the City of Eridley was called to order by
Maqor Kirkham at 8 20 P.M.
OPENING CEREMONY:
Mayor Klrkham asked everyone to stand and �oin in saying the Pledge of Allegiance
to the Elag. Reverend Bergren from Redeemer Lutheian Church gave the Invocation

APPROVAL OF MINUTES. REGULAR COUNCTL MEETING. MARCH 18, 1968•
MOTION by Councilman Liebl to adopt the Minutes of the Regular Council Meeting
of March 18, 1968 as submitted Seconded by Councilman Samuelson. Upon a
voice vote, there being no nays, Mayor Kirkham declared the motion carried
ADOPTION OF AGENDA:
' The Council added ztem 4A-petition-"TRAFFIC CONTROL AT MADISON AND 57TH STREET",
added an additional license to the Licenses, and deleted Item 4, "AWARDING OE
SIDS - GROUP HOSPITALIZATION INSURANCE" because tfie Council has asked the
Insurance Consultant for additional information. The awarding of bids wi11
be put back on a future agenda when the inEormation is at hand
MOTION by Councilman Sheridan to adopt the agenda as amended Seconded by
CouncLlman Liebl Upon a voice vote, there being no nays, Mayor Kirkham declared
the motion carried unanimously.
DISCUSSION OF ELDON SCFIMEDEKE REZONING REQUEST (ZOA 4�68-01)�
Ma�or Kirkham asked the City Attorttey for his opinion on the standing of this
rezoning, because of somewhat conflicting motions at the last meeting The
City Attorttey said that his Lnterptetation would be that the vote was to deny
the rezoning request. He quoted Ordinance 358, Secrion VII of the City Code
which stated "In all cases where an appeal has been taken, and the relief sought
has been denied by the Board of Appeals, no petition for identical relief shall
be presented to or be considered by the zoning administrator, the Planning
Co�nission, or the City Council until a period of at least six months have elapsed "
Councilman Sheridan asked the City Attorney what action the Council could take
to reverse the denlal. The City Attorney said that the Council could rescind
their motion, or make a motion to reconsider the request
, MOTION by Councilman Sheridan to reconsider the action of the City Eouncil at

asked if the motion �ust made by Councilman Sheridan was a proper motion The
City Attorney said that the motion to reconsider the rezoning would have to be
made by one of the Councilmen on the prevailing side of the vote according to
Robert's Ru1es of Order Councilman Sheridan said that in that case, he wi11 �
have to withd�aw his motion Mayor Kirkham stated that the motion is withdrawn
Mr. Schmedeke said that he had a letter he would like to have read into the
record and he asked Councilman Lieb1 as Councilman of the 3rd Ward to read
it aloud for him. Councilman Liebl read the following letter and asked that
it be put into the minutes•
"YOUR HONOR THE MAYOR AND HONORASLE COUNCIL MEMBERS, as you have promised me
your honest answer tonight, I am here to remind you what my opinion is now,
and always has been.
if you believe you are be�ng fair and truly honest in your decis�on in
listening to an appointed group that is not interested in this area, and
never has been since Fridley was forroed, many people will be shocked. If
we are going to get more feeble pramises, I am sure few of us will be listening
This is your golden opportunity to show faith in a possible change in this part
of Fridley. Of course the people own this part of our town, so the realitors
may not get their hands on it first on short notice, but if we drag this
out it could be done so they can get involved. If this ever materializes, I
believe the small property owners should gaxn, not a total stranger as it
usually is the case
In my opinion, if some cammittee is dictating to you, then the mice are
chasing the elephant, and I am surprised to see this. If the people in this �
azea believe I am right, and what I as!z for is right, I w�ll abide by their
w�shes. I was informed that you represent the party of free enterprise and
self he1p, not federal handouts, only if it is the last resort. My trust
and hope is this is slowly crumbling. I am no longer interested'in
promises, and I ask for the truth. I am prepared to start my share of our
1oca1 urban renewal plan now, with the initiative of the people in this area
at stake, and aC no cost to the taxpayers of Fridley.
This group of interested citizens will probably stay in tact if you our elected
Council show enough trust to pass this first important step in the right
direction This step wi11 noC hinder the balance of the plan proposed if anyone
has any intention of following the peoples wishes.
I also want to emphasize that I did not pick G 2 zoning at random, I think it
should have been mentioned two weeks ago that item (G) under C-2 puts my
present business in this particular zoning group I do not want the people
of Fridley to believe I am doing something wrong in asking for G 2 zoning
as indicated by the Fridley Sun in an article two weeks ago.
At the last council meeting the Chairman of the planning Commission stated
that if these lots were zoned commercial that it would force the Council to
do the same a block or two away. I would like to remind Chis council this was
done on Che same side of IIniversity Avenue on the same street just two blocks
away when Holiday strip-zoned University and 57th Avenue N E two years ago.
Mr. Jensen stated if my lots were zoned C-2 the same would have to be done �

' across the street. I would like to remind this council, across Universrty
Avenue from me is zoned G2 and I am asking only for the same consideration
I have bought the lots where my building is on as commercial property, and I
— always used these lots as commercial I am a firm believer in doing what
is right and this happens to be so and not only in my opinion.
In following the recomendations of Mr Virgil Herrick, the City Attorney, I
have asked for this request and a correction in zoning of my property at this
t1me, so you are not making any ma�or decisions
Mr. Mayor, Gentlemen of this Council, I ask you for a final answer, to eiTher
grant or deny my request based on its merits."

Councrlman Liebl said that when Mayor Kirkham had been elected two years ago,
he had said that the initiative of the people could do what Urban Renewal
was supposed to do. He said that if the Council would have granted this
partial rezoning, the people would have worked wzth the Council to make a
nice area in the 3rd Ward He said he regretted to say that the Council
has not helped him in any way.
Mayor Kirkham said that his philosophy kas not changed, and he is stx11
for free enterprise and in favor of the people contr�lling their property,
He said that his interest in asking Mr. Schmedeke to wait was solely to
� protect Mr Schmedeke as well as the rest of the community, because
granting a partial rezoning can create some problems. He said that all he
asked for was a delay long enough for the City staff to work out some of
— the problems and to prevent any errors from being perpetrated, if not to
Mr. Sctunedeke, then to someene else.

CITY MANAGER'S REpORT REGARDING FUNDING OF LOOPBACKS:
MOTION by Councilman Samuelson to adopt Resolution ��45-1968 Seconded by
Councilman Harris, Upon a doice vote, there being no nays, Mayor Kirkham
declared the motion carried.
Councilman Harris said he had read the memo from the City Manager and said
that he may have misinterpreted Lt, but he believed there would be some
cases which would not be covered by the memo, and he would lxke to see it
broken down further to apply directly to the existing intersections
currently under pxoject study,
MOTION by Councilman Harris to rece�ve the memorandum from the City
Manager regarding funding of loopbacks, but not set it as Council policy
at this time. Seconded by Councilman Sheridan Upon a voice vote, there
being no nays, Maqor Kirkham declared the motion declared unanimously.

Harris said he would like the people to know that if this is'delayed, f't�will '
not slow down the contracts that have been let The City Engineer said
that this will in no way slow down the loop at Mississippi Street and
Mississippi Place. Councilman Liebl asked the City Attorney if it can be
assessed to the property owner The City Attorney said it can be done if there
is additional value to the property, which is a decision the Council wi11
ultimately have to make The City Manager said that this would go to the
bonding attorney for review, and he would check this very thoroughly
He said that the recommendation would try to make the minimum impact on
the property owner.
Councilman Sheridan said it was his understanding that any policy set
would be the overall policy on loopbacks for the entire community. Mayor
Kirkham said that the policy would have to be uniform and keep the cost
to a bare minimum for the property owners
DISCUSSION OF LIQUOR STUDY:
Mayor Kirkham said that the members of the Liquor Study Committee had been
invited to attend the Council Meeting, but when they had been polled,
several of the members had other committments, and the Chairmaa had asked
that the Committee be excused from attending the meeting. Mayor Kirkham
said that the item is still on the agenda because Councilman Sheridan has
indicated he has something to say on this sub�ect.
Councilman Sheridan said he has received considerable coimnents regarding �
the Liquor Study and would like to make a statement befora handing out a
resolution he would like the Council to consider. He reviewed the dates
that the report was authorized, the date the Council received it, the date
the committee was appointed and the extended date at which the Committee
was to return their evaluation. He said that the calls he has been
receiving have been on 6oth sides of the issue, and from some that have
not made up theix minds, but they have been accusing him and the Council
of shelving something and not making it readily available to the public
He said he is proposing that the Council either accept the report, pay the
accounting firm and make it public record or re�ect the report and return
it and the balance due to the firm, and possibl�[ instruct the City Attorney-
to begin action to retrleve the $1200 already expended. Councilman
Sheridan handed out the resolutzon he wanted the Council to review and
read it out loud to the public.
MOTION by Councilman Sheridan to adopt Resolution ��46-1968. Seconded by_
Councilman Liebl.
Mayor Kixkham pointed out that no effart has beAn made to hide the report,
that copies of it are out, and the date for returning their evaluation was a �
suggested date to get them to appreciate some concern as to timing Councilman
Sheridan said that after talking Co one Committee member, the committee
had met only twLCe. Once with representatives_of the authors of the study
and a second meeting at which sub-committees �aere set up

"Mr Mayor, you said at the regular Council meeting of March 18th, that you
had given the chairman of the Evaluation Committee, Mr Langer no other
authority except to evaluate the Horwath & HorwaCh report with the help of
the *�hole committee On March Sth at one of the committee sessions, Mr Langer
decided to split the group in three subcommittee s and make his own Liquor
Study on his own initiative, he also stated that he had discussed iL with you
the Mayor and had your approval and if anyone of the committee members did
not wish to go along with him could resign anvtime
You never mentioned one word of this to the whole Council except Lhe last
Item of the March 18th Council session was a letter from Mr Langer dated
March 15th asking us the Council if we would not ob�ect to a Liquor Study
of his own initiative
Haw many Liquor studies does the Council private Liquor clique want done in
two years� Cons�der the employees who have had to live under this harrassment
for two years not knowing from one day to the next whether they have to conslder
other employenent Some of them after long years of faithful and conscientious
service to the City of F'ridley Our Liquor stores manager is a competent out-
standing man and the employees do an excellent �ob I strongly protest your
attitude and sudden urgency to give up this operation
These employees have to date, earned the people of Fridley $1,517,165 91
profit, and so have helped maintain this administration and previous ones
balanced budget. What would we have done without the liquor income?

are trying Mr Mayor your best to whitewash this expensive report whzch you
recommended and now are not man enough to admit
Private Liquor will breed corruption and pay-offs in our city in my opinion
and in the opinion of many of our citizens
I am asking for an EVALUATION of this committee in regard to the Horwath

Councilman Liebl read a letter written to him by Mr O.M. B�erkesett, a member
of the committee, regarding the format�on of the three subcommittees and his
ob�ection to rt

Mr Ole B�erkesett, Mr Dick Donlin, and Mr Wilbur Whitmore, each a member '
of the su6committees that had been appointed were present at the meeting
Mr. Donlin said that somewhexe along the line everyone was getting involved
in persona�ities and politics. He said he did not remember Mr, B�erkesett`s
strong opposition to forming the subcommittees He said 6hat some of the
Committee Members felt there were some figures in the report which were
incorrect although they had followed these figures, He said that the sub-
committee met two or three times.
Mr. B�erkesett said that Zn a telephone conversation with the Chairman,
Mr. Langer, he had refreshed Mr. Langer's memory, and he remembered that
Mr. B�erkesett had ob�ected to what the Chaixman was doing.
Councilman Sheridan said that his resolution was not directed at any
personalities, but was a case where he felt the report should be accepted
or re�ected by the Council within a certain time period. Councilman Harris
asked Councilman Sheridan if he had discussed this with any members of the
Committee, and if April 15th would give them enough time to finalize their
report, Councilman Sheridan said he felt there should be a definite date
named. Councilman Harris asked the three members of the committee present
if they thought their evaluation could be concluded by April 15th The
committee members felt they could be ready with an evaluation of the contents
of the Horwath & Horcvath report, but they did not feel they should answer
for the rest of the m�ubers on the committee.
Mayor Kirkham said he would like to answer some of the charges Councilman �
Liebl has made Mayor Kirkham said Yhey were something about whitewashing,
delaying action, and that sort of thing,and about Councilman Lieb1 '
representing the people of Fridley. Mayor Kirkham said that he represented i-
the same people, and a certain percentage of the people have come to him
frequently to suggest that Fridley reconsider the position on Municipal
Liquor, and in fairness to this segment of the population, he said in his
mind it was only proper that the Council agreed to go at this from a
business like standpoint and hire a study made. He said that he made the
suggestion to the committee that this pattern be followed. Mayor Kirkham
said that Councilman Liebl had made Che motion that the Horwath and Horwath
firm be hired. He said the firm did not make a promise when the study
would be back, but would try to have it back as soon as possible. He said they �
had never made a study exactly like this before, and they were not certain
what would be entailed, He said that it took longer then they and the'eouncil
had hoped for, but there was not much to gain by pushing them and asking them
to cut the study short, once it was started. Mayor Kirkham said Yhat after
the report had been received, it seemed only proper to add more heads, and
he formed a committee, and asked each Councilman to appoint someone on it.
He said that he was accused of appointing people who had made up their minds
and were pre�udiced, He asked which of the people he had appointed were
pre�udiced, the two ministers, or the �udge, or who. He said that the man
appointed by Councilman Liebl was an employee of the liquor store
Mayor Kirkham said he took offense at Councllman Lieh1's accusations about
someone lining their pockets He said he did not care if someone gets a ,
drink in Fridley. Mayor Kirkham said that these accusations are mean,
personal and political, and if Councilman Liebl wants to campaign he should
hire a hall or get a soap box He said it was not fair for him to take
advantage of a captive audience.

� Mayor Kirkham said there are two things to be decided, whether this commumty
wants private liquor and if they want it, how can it be done economically, and
if it costs more money, is it worth it7 He said that he wanted the people to
decide, and they have to decide on the facts and not on facts that are
slanted, and for this reason he wanted a composite oi some different viewpoints,
which was the reason for the different members he had appointed to the
committee. Two Ministers, a Sudge, Attorney, member of the Police Civil
Service Cottunission, and the President of the Chamber oi Cammerce
Mayor Kirkham said he did not feel the Council should dictate April 15th, Uut
should ask the Committee when the earliest date would be that they would be
ready. $e said that he thinks the City should accept the reporL It was
contracted for and should be paid for, whether it is liked or not, Councilman
Liehl said that if he sees the signature of the 2 ministers, Chamber of
Commerce president and of a11 the other committee members on the evaluation
regarding the contents of the Horwath & Horwath report, he will beiieve it
Councilman Harris said he had no ob�ection to the resolution and will vote for
it but he questioned the date and asked Councilman Sheridan if he would
ob�ect to asking the Coimnittee when they could be done, as long as they are
meeting on Tuesday evening.
Councilman Sheridan said that if the seconder of the motion agreed, he would
change the date in the Resolution from April 15, 1968 to May 1, 1968, which
will give the Committee 30 days from today Counc�lman Liebl as the seconder
� concurred.
The Vote on the Motion to adopt Resolution ��46-1968, with tfie amended date, was
a voice vote, there being no nays, Mayor Kirkham declared the motion carried
unanimously.
PETITION �k5-1968 TRAFFIC CONTROL AT MADISON AND 57TH STREET
Mr. Robert W, Erickson, a resident on 57th Avenue, was present at the Council
Meeting and presented a petition from the people on 57th between 7th Streee
and Quincy Avenue requesting a 3-way stop sign at 57th Avenue and Madison He
said that there was increased traffic in this area because of the drive�in and
the Holiday Store and there were 91 young children living within the neighbor-
hood. He read some of the comments of the neighbors that had signed the petition
MOTION by Councilman Sheridan to receive the petition and refer it to the
Administration for evaluation and recommendation Seconded by Councilman Harris
Upon a voice vote, there being no nays, Mayor Kirkham declared the motion
carried unanimously.

MINUTES OF THE FRIDLEY INDUSTRIAL DEVELOPMENT COMMISSION MEETING, MARCH 7, 1968
AND THETR RESOLUTION TO THE MAC:
MOTION by Councilman Harris to receive the Minutes of the Fridley Industrial
Development Commission Meeting of March 7, 1968.
Councilman Harris said he would like to draw the Council's attention to the
resolution sent to the MAC indicating th�.t this Co�nission supported the airport
development. He said that the Committee would strive to have a hearing held
in Anoka County, requesting a plan of the proposed air traffic lanes and the
consequences of such over FrLdley. Councilman Harris suggested that the
Administration have a representative attend the hearings to protect the
interests of Fridley
Councilman Samuelson seconded the motlon to receiVe the Minutes, and upon a
voice vote, there being no nays, Mayor Kirkham declared the motion. carried
unanimously,

Councilman Sheridan said that the hearing Apri1 22nd is scheduled to be held �
in Bloamington at 10:00 A,M., which would make it impossible for the ma�ority
of those interested to attend the hearing. He said that perhaps this
location cannot be changed on such short notice legally, but he felt certain c'
they could hold another hearing within our County.
MOTION by Councilman Sheridan that the Administration request that the
Metropolitan Airpost Commission hold a hearing on the proposed airport Ln
the County of Anoka, and that the Administration dixect communications to
ad�acent communities, and the communities across the river, and to the elected
representatives in the area and ask them to proceed with a request also.
Seconded by Councilman Harris. Upon a voice vote, there being no nays,
Mayor Kirkham declared the motion carried vnanimously.
Councilman Sheridan said that he would urge the Fridley Industrial
Development Commission to use some of the people within our own community
in preparing their Business Forecaster Newsletter. Councilman Harris said
that as a representative of the Board, he would pass on to the Board the name
of anyone suggested. He said that the present gentleman had been consulted
because of his experience in preparing a brochure for another community.

MINUTES OF THE SPECIAL MEETING OF THE PARKS AND RECREATION COAIMISSION, MARCH 25, 1968•
MOTION by Councilman Harris to receive the Minutes of the Special Meeting of
the Parks and Recreation Commission Meeting of March 25, 1968 Seconded by
Councilman Samuelson. Upon a vo-ice vote, there being no nays, Mayor Kirkham

BUILDING S�ANDARDS - DESIGN CONTROL SUBCOMMITTEE MEETING MINUTES. MARCH 27, 1968•
1.
The City Engineer explained that the Council has approved the plan already, but
now they would like to provide laundry area in onlq one apartment building and
provide an additional apartment in the second building He said that this
will meet road requirements and has been approved by the Fire Department,
MOTION by Councilman Samuelson to concur with the recommendation of the
Building Board and grant the request su6�ect to adequate support for the
concrete floor above the basement boiler and locker area. Seconded by
Councilman Liebl. Upon a voice vote, there being no nays, Mayor Kirkham
declared the motion carried unanimously.

OF ADDITION TO KURT MFG. OF 10,988 SQ. FT. (78 67 X 139 67
EXTERIOR. (REQUEST BY ALLIED BUILDING PRODUCTS, INC.,
The City Engineer said that the Kurt Mfg. Co. was proposing to make an
addition to their building on the southwest side. He said they have adequate
parking, and the only recommendation made by the Building Board �s that they
paint the exterior to match the existing building.
MOTION by Councilman Harris to concur with the Building S�andards-Design
Control Sub-Committee and grant the request of the Kurt Mfg. Company
sub�ect to painting the exterior to match the existing building Seconded by
Councilman Lieb1, Upon a voice vote, there being no nays, Mayor Kirkham
declared the motion carried unanimously.
3. CONSIDERATION OF A NEW

Councilman Harris said he had no ob�ection to addational parking, as this
will keep cars off the service drive, but he did ob�ect to the delay in fencing

The City Engineer said that he had checked and the fencing is up. He said '
that they have trouble with the fence behind Erickson's because people 6ack ,__
into it and knock it down. He said they have requested that they put in dome-
type pipe poles, and have agreed with this.
MOTION by Councilman Harris to concur with the Building Standards Design
Control and accept the proposal sub�ect to the notations on the drawing.
Seconded by Councilman Samuelson, Upon a voice vote, there being no nays,
Mayor Kirkham declared the motion carried.
4. CONSIDERATION OF OFFICE BUILDING 72'4" x 72'4" IN C-2 DLSTRIC'.
6281 UNIVERSITY AVENUE. (REQUEST BY L.M.J. CO., INC., 1011 W
The City Engineer said that the Building Board had approved the general layout
of the plan and authorized the foundation permit after submission of adequate
plans. Councilman Lie61 asked who the owner of the property was. The City
Attorney said the owners were Weaver, Talle, Herrick who will-eonstruct
the building, and Mr. George Hayano, Cliff Spieker and Dave Harris. Council-
man Harris said that this wi11 be one of the nicest office buildings in the
Twin City Metropolitan area. He said there will be a centex court yazd, air
condrtioning, a11 brick, and meets, and in many cases, exceeds the code and
ordinances.
MOTION by Councilman Samuelson to concur with the Building Board and approve ,
the general layout of the plan and grant the foundation permit. Seconded by

The City Engineer said that this property was on the southeast corner ot
Mississippi Street and T.H, iF65. He said that the Planning Commission
recommended the rezoning sub�ect to getting a dedication of the west 30 feet
of property for a service drive and also that there should be no waiver of
land area requirements as relate to the number of units that can be built on the
property. The City Engineer said that there are apartment buildings to the
south of this property and to the north are single-family residents He said
there are road easements on the property to the north and to the south of
this property, anc� reqniring�a_dedication'would continue the two easements.
MOTION by Councilman Harris to set the date of May 13, 1968 for the Public
Hearing before the Council on this rezoning request. Seconded by Councilman

The City �Engineer said that this property abuts on Oshorne Road and is large
enough to be split into two 1ots, but water and sewer cannot be provided right
away. He suggested that if the Council approve the 1ot split, they do so on
the condition that the lot be red tagged until ei�her the property owner or
City can provide water and sewer, so they will not put in a cesspool. He
said�there is a water stub up to the easterly property line, but it would sti11
need an extention and would be quite expensive.
MOTION by Councilman Samuelson to concur with the Planning Coimnission's recom-
mendation and grant the �,ot-split as requested by Larry Dean Ferguson subject
to providing the City with a 10 foot drainage easement centered on the
North line of the south parcel and a 25 foot easement along the south line
for road purposes, and that it be red tagged until utility service is
available. The motion was seconded, and upon a voice vote, there being no
nays, Mayor Kirkham declared the motion carried unanimously.

Councilman Sheridan said that he has reviewed this site in the past years,
and the trailer is very neatly placed in the trees, and he would recommend
granting the permit.

CLAIMS:
The City Attorney said that one item in the claims is a request for payment
to George Norton for an easement for storm sewer and water in Norton Avenue
� He said that he has started negotiations on some of these parcels. He said
that Mr. Alorton has obtained an appraisal from the Schaeffer Company, and
the City Attorney said he was recommending the figure that appears in the
claims as it is within the area of the appraisal, and if the City had to go

through with the condemnation it may cost a larger amount.

There was a discussion about the fact that some people are giving the
easements to the City free, and some of them have to be acquired. The City
Engineer said that the area assessment will be excessively high, and he
wants the Council to be aware of this. The City Attorney said he agreed
that it did not seem fair, and he said he would explore the possibility of
having ti7o different assessment figures or of crediting previous dedicatxons.
The City Attorney said that this area is zoned industrial or multiple, and with
the value of property rising, especially in these two zonings, this situation
is not unique to this property.
LICENSES:
The Council added the following additional General Contractors License to
the List: McCa11 and Company, 1618 West Lake Street, Minneapolis, Minnesota
as requested by Barry Pa1m.
Councilman Liebl said he had received several complaints about poor garbage
pickup and asked the Administration to me�ntion this to the companies when
the licenses are renewed.

AUTHORIZATION TO APPROVE PAYMENT FOR EASEMENT - DAVID C. BELL COMPANY:
The City Attorney said that this property was previously owned by the Pole
Company on the west side of Central Avenue. He said that he has negotiated
this easement with David C. Bell Company and feels the sum of $1,000 is
reasonable.
MOTION by Councilman Samuelson to concur with the recommendation of the City
Attorney and approve the payment of $1,000 for a sanitary sewer, public
utility easement over the property owned by David C. Be11 Company. Seconded
by Councilman Sheridan. Upon a voice vote, there being no nays, Mayor
Kirkham declared the motion carried.
OF POSSIBLE USE OF PUNCHED CARDS FOR BALLOTS IN THE 1968 ELECTIONS•
Councilman Harris said he felt this new method of voting would be a real asset
to the Community, and he would like to see the Finance Director resesrch
the facts and £igures on the cost ot changing to this method of voting.
Mayor Kirkham said he thought it should be done in time to use it this year
if possible. There was a discussion about whether the Legislature has
authorized other Cities to use this method of voting. The Finance Director
said he would check this out.
MOTION by Councilman Harris to authorize the Finance Director to research the
legality and cost of the possible use of punched cards for ballots in the
1968 elections. Seconded by Councilman Samuelson. Upon a voice vote, there
being no nays, Mayor ICirkham declared the motion carried unanimously.
DISCUSSION DF MIITUAL AID LAW ENFORCEMENT PACT:
Mayor Kirkham said that at a recent meeting of the 4-Community Mayor's
Coordinating Coimnittee, meeting on the ways and means for better cooperation
between Police Departments, they were enlightened with the cooperation between
the depar�emts that already exists. He said the Committee went on record
commending the Chiefs-of the 4 communities and recoim¢ending to the Council's
that the pact be adopted.
The City Atrorney said that the agreement was drafted by the Anoka County
Attorney and was submitted to the City Attorney's of each co�unity, He
said a meeting was held and some changes were made, and now this final
agreement speaks for itself. He explained that the Council will authorize

�he or more employees or elected officers to make the determination when �
assistance should be requested, and other communities decide whether they wi11
give assistance for that particular situation.
MOTION by Councilman Samuelson to approve the Mutual Aid Law Enforcement
Pact and authorize the Mayor and City Manager to sign it.
Councilman Liebl asked Chief McCarthy �ust what advantages this pact wi11 be
to Fridley. Chief McCarthy said this will give the City authority to reqnire
their men to go to another community to help in a situation, and will give

CONSIDERATION OF SETTING A DATE FOR THE PARK BOND ELECTION;
Councilman Samuelson said he felt that .7une llth as suggested at the meeting
with the Parks and Recreation Commission was a good date. Mayor Kirkham said
that the Bonding Attorney had indicated that this date would be satisfactory '
for him. Councilman Liebl said he would like to receive the 1ega1 description
on what the monies can be used for to study as soon as possihle, ---
MOTION by Councilman Samuelson to set the date of June 11, 1968 as the date
of the park Bond Election. Seconded by Councilman Harxis. Upon a voice vote,
there being no nays, Mayor Kirkham declared the motion_carried unanimously.
Robert Hughes, Chairman of the Parks and Recreation Commission, said that the
Cotmnission has looked at the�first draft of a map prepared for the brochure
regarding the election, and he felt it should be ready to present to the
Council in about two weeks.
CONSIDERATION OF POLICE MANUAL•
Mayor Kirkham read a letter from the Chairman of the Police Civil_Service
Commission, Mr. Wilbur Whitmore, stating that they have received and reviewed
the Police Manual dated January 1, 1968, and are in eoncurrence with issuing
this manual as policy, and ask that the Council adopt the manual as the official
manual of the Police Department.
The City Manager said that the Chief of Police, City_Council, and City Attorney
have a11 had a chance to review the manual and suggest changes, which have
been incorporated in one place or another and_he=_feela that,this is a workable
type of policy. He said that sma11 copies will'be mgde which the Policemen ,
can carry.

� Mayor Kirkham said he thought the City Manager should be coramended for this
Police Manual, and that it shon]d have been a part of the City's ogeration
for a long time.
MOTION by Councilman Samuelson to adopt the Police Manual dated January 1, 1968
as presented to the Council. The motion was seconded, and upon a voice vote,
there being no nays, Mayor Kirkham declared the mot�on carried unanimously
STATE DEPT. OF HIGHWAYS RE: PROPOSED PEDESTRIAN STRUCTURE AT 51
AVENUE N.E,;
Mayor Kirkham read the letter from the State Department of Highways to
the people that were present in the audience, Councilman Harris said he
was glad to receive this much awaited reply, and knowing the feelings of
the people in the area, he would like to see this proceed with fu11 haste
He suggested that a meeting be set up with the other governmental units
and the Columbla Heights School District. Mayor Kirkham said that the
Highway Department should be instructed to start work on the plans.
MOTION by Councilman Harris that the Administration get all interested
government units, and the Columbia Heights School District together to
discuss this proposed pedestrian bridge, and that a letter be written
to the State Highway Department requesting that they start the preparation
� of the plans for the bridge. Seconded by Councilman Samuelson. IIpon a
voice vote, there being no nays, Mayor Kirkham declared the motion carried
_ unammously.
(B) STATE DEPT. OF ECONOMIC DEVELOPMENT RE: INDUSTRIAL REVENUE BONDING:
MOTION by Councilman Harris to receive and file the cammunication from
the State Department of Economic Development dated March 26, 1968 Seconded
by Councilman Samuelson. Upon a voice vote, there being no nays, Mayor
Kirkham declared the motion carried unanimously.
(C) DOREMAN, RUDQUIST & IZARALIS: RE - PERMIS FOR WAIVER OF TRIICT WEIGHT
RESTRICTION:
MOTION by �"duncilman Harris to receive and flle the communication dated
March 28, 1968. Seconded by Councilman Liebl. Upon a voice vote, there
being no nays, Mayor Kirkham declared the motion carried unanimously.
The City Engineer said that in regard to the load limits placed on the
streets, because the weather is exceptionally good, they feel that if
the Council wishes, the Administration could go back to issuing load
limit permits and increase the restriction from 4 tons to 5 tons and reduce
the speed limit to 10 miles per hour to compensate fox ehe extra 1oad. He
recommended that $20 be cha.rged for a permit to cover the cost of processing
� the permits, There was a long discussi.on regarding whom the permit should
be issued to, if the Cruck driver should be required to carry a weight slip
for the load he is carrying, weighing the truck to check on the load, and
who would be responsible if the delay caused damage to the load (cement for

instance), The Council felt that this could be covered in the permit, and
if a company wanted a permit they would have to 11ve up to it, and the
liability would be on them. If they were found to be overweight, the permit
would be withdrawn, and if they were found going over the speed limit they
would be violating the permit.
MOTION by Councilman Samuelson to concur with the recommendation of the City
Engineer and issue load limit permits at a cost of $20. The permits to be
issued to vendors for one particular location on1y, and that non-compiiance
is cause for revocat�on and no further permits will be issued. The load
limit restrictions are to be increased from 4 tons to 5 tons and the speed
limited to 10 miles per hour and that vendors agree to submit to weight check.
Seconded by Councilman Harris, Upon a voice vote, there 6eiqg no nays, Mayor
Kirkham declared the moti_on carried unanimously.
