He said thac he had asked them to consider buiiding in Fridley, and told them that the City would be w�lling to wor7c with them in order to help them get started with their constructzo��. The City Engineer said that the petitioners had appeared before the Building Standards - Design Control Subcommittee on April 24, 1968, and the Committee had recommended approving the permit with certain stipulataons, which he read from their minutes. There was a discussion about L.M.J. Company's request to pave to the groperty line. The City Engineer fe1i: that it snould be at least 5 feet away from the properLy line. He saia that if iencing or other facilities were ever put in, there should be some room to work with. Nlr. Gibbs, who was present at the rn�eting in behalf of L.M.J. Company, said that they agreed to com�ly with all of the requests of the City, but would question the 5 feet required aff the 10� line easemenL-, He said they had also agreed to sprinkle the builaing. Councilinan Samuelson said that the only consideration oE this blac:t�opping co the property line he could see was that a grade should be established so that water does not wash oif onto the undevelopec� prol�erty. Mr. Gibbs said that they wi11 comply witn the request, but they wauld like to keep it open for negotiation or discussion in che =uture, so that the Czty will not say that they had agreect to do tnis. i'here was a discussion about getting the trucks through on the south side where there would be room, and about the possibilicy o� using temporary barrier blocks. MAINTENANCE AND PROVIDTNG FOR ABATEMENT ANB PENAL�iIES FOR VIOLATION THEREOF; rhe City Manager said that he had discussed this wa.th the Anoka County Extension Agent and he had said there a.s nothing in the State Statutes w�zich will a1Low the City to remove trees, except in the case of Dutcn elm disease. He said that the intention of this ordinance is to get rici oi dangerous trees laying around, which the Extention Agent says will harbor barx beetles. (COUNCILMAN LIEBL ARRIVED AT THE ME�TING i-ST 4:59 P.M.} and the Ordinance was explained to him. � MOTION by �ouncilman Harris to approve the ordinance upan first reading waiviny the reading. 5econded by Councilman Samuelson. NSSSD; The City Engineer said that if the Council wishes, ize can try and get t`tiis vacation published in tYie paper this week so that the Council can consider it at their May 13th Public Iiearing meeting. Councilman Harris said that this roadway is not servinJ any usePul purpose, and NSSSD wants to fence it in. z3e said he could see no reason for delay as the sooner it is tenced in the less problem there will be with people dumping there. Councilman Harris said that as a member of tlze Eoard, he nud in- dicated to them that the City would not consider abatinl this road- way without some consideration around the liquor store property. He said he did not know if it would be used ior parking or to enlarge tne liquor store buildiny, but he did not feel the City should grant the District's request without some transier. The Council discussed the amout of area the CiLy should request � be trans£erred in trade, and what benefic there would be to the Liquor Store. Councilman Aarris said that ize could take tl7e City's decision back to the NSSSD Boarcl for agreement, but he would like to have the figure decided on by the Council, ratizer than him trying to neyotiate a figure with the Board. The Council deciaed on increasing the area needed for expansion to 135" on the nc�rth, and with the 78' on the west, it would be not quite an acre ana a half. Councilman Harris askecl that a new shaded map be drawn up £or the District's consideration. MOTION by Councilman Harris ta set the public hearing on the vac- ation requested by NSSSD at tne earliest possible date. Seconded by Councilman Samuelson. Upon a voice vote, ihere being no nays, Mayor Y:irkham c�eclared the motion carried unanimously. LOCATION OF SSDEtidALK ON MISSISSIPPI STREEP BETGPE�N T.H. if6S AND CENTRFIL AVENUE - The Cxty Engineer said that some of t1�e property owners on Miss- issappi Street have been callzng him because they feel l.hat if the City rec�uires 5 more feet for the sldewalk, i�. wili be too close to their bedroom windows. He said that tnere were two choices, , either eliminate the sidewalk on one side or shift the road over for a smaller riyYit of way on the north side, ana a larger one on the south side.
