PLBDG& OF ALLBGIANCS- Mayor Kizkham requested the audience to stand and join the Council in saying the Pledge of Allegiance to the Flag. ' Mayor Kirkham read the Certificate of Achievement, then preseaated it to Mr. Hans P. Meyerhoff for his work in the field of human relations, with the compliments of the Council. Mr. Meyerhoff , said Thank Xou, and said that he felt that the Certificate of Achievement was really going to the ideal, rather than to the man. ADOPTION OF AGBNDA- ' It was agreed by the Council to table Item #1 (Sign ordinance) to the next Regular Council Meeting. The Council decided to postpone the second reading of the Ordinance for the rezoninq requeated by Robert Schroer until later in the Meeting in case one of the other Council Msmbers should arrive, as REGULAR COUNCIL MSETING OF FEBRUARY 3, 1969 a rezoning ordinance requirea a 4/5 vote of the Conncil. Ralph BroChen came forward to the Council table and presented his preliminary plans. He said that the electrical and mechanical plans were not completed as yet, and that he would be going back to the Building Standards - Deaign Control rsquesting a full permit February 11, 1969. At thia time he is juat requesting a foundation permit. Councilman Harris asked if he had coutacted N,S.S.S.D. about connectiag to their linea. Mr. Brothen said not as yet. He said that their plans arn for a three phase building, with additione onto the side. He said that tY►e additions would be approxicoately the same as what he is presenting tonight. Councilman Samuslson asked if there would be any outside storage of refuse. Mr. Brothen said no, that the refuse would be kept refriqerated downsta,ira, and would be picked up eve=y day. Councilmaa Samuelson questioned the REGVLAR COiTNCIL MSBTING OF FE9RUARY 3, 1969 PAGE 4 overhead door in the front of tha building as the Council has preferred to have the loading docks located other than in the front of the building. Mr. Brothen said that they would be receiving only once, or occasionally twice during the day and that this would be in the early morning. He said that they have three trucks, the ovexall length is about 48'. Tha Enginaering Assistant said that there is a 60' setback. Mr. Brothen explained that the mansard roof would be over the receiving area. Mayor Kirkham asked what he would be processing. Mr. Brothen explained that they would be processing the �at and loading it into barrels, or plastic con- tainers, and grinding meat etc. Councilman Harris said that ha queationad the overall appearance of the building from the front, because of the loading dock and also the fact,that they do not show all brick in the front. He explained that the Council has been raquiring othar companies to put in all brick in the front of the building. Mr. Brothen said that he had no objection to this if this is what the Ordinance calla for. Se said that this would be incorporated into the ele- vations presented to the Building Standards - Design Control at their next meeting. 'I'he Council pointed out that they would also like to have architectural masonry on other sides of the building, axcept the expansion side. Mr. Brothen said that he had no objection to this. Councilman Samuelson asked about the possibility of putting a fence along the east line of the property. Mr. Brothen said that he felt that from the elevation of the land, it would take a very high fencs. Mayor Kirkham said that the Suildinq 3tandards - Deeign Control, when looking at tha fir�al plans,could keep this in mind. MOTION by Councilman Harris to grant the foundation permit to f�ir. Ralph Srothen, for a wholesale meat process3ng and packaging plant located at 7501 Commerce Lane, subject to the recommendations of the Building Standards - Aesign Control, and subject to thais considera- tion of a fence along the east property line. He said that he had attended a Metropolitan Urban Affaira ' , ' , ' ' ' ' ' ' , , Cl , �J�, , , REGULAR COUNCIL MBETING OF F&BRUARY 3, 1969 ' ' ' � , , ' � PAGE 5 y Meeting this morniag, and at this meeting the Metropolitan Council admittad that this bill is the old "buy out plan" only na.r they cail it a rental plan. Under this plan the raen on the Board would be appointive rather than elective officials. They would also have tha right to levy taxea. He said that this bill would result in a co�lete qive up of any self determination and would give an appoiative body much too much pawer. He aaid that the only recourse the paople would have would be a public heari.ng, but before an appointive body, they would not be obligated to act according to the people's wishes. He said that he felt that this bill is very ad- verae to all the seven county metropolitan area. He said that he realized that there were prablems to ba solved, but that this bill is too high a price to pay for 1ts resolution. Mayor Kirkham agraed and said that he felt that it was a bad bill from stazt to finiah. Mr. Moen said that he had written to the Mayare of Spring Lake park and Mounda View also to gain some support. He said that he would like to get thia bill amended, or if possible stopped entlrely. He`eaid that the fealing in the Legislature is that this has been unreaolved for too long already, and they want to take some action. He said that the bill has some paverPul authors, which makes it all the more important to rally support to fight this bill. Ha said that he felt that he had about 15 metropolitan representatives that did not like this bill, and th at he hoped to galn enough support to get it stopped. He added that in this bill there are no specific provisiona for chazges, but that they did qive a farmula which was the old "buy out plan". ' Councilman Harris coimnented that he had looked at the original bill, and felt that it was ironical that the reatal of interceptors, when within the corporate limita of ![inneapolis are called laterals, ' but when they get into the outlying comvaunities, they are called inteceptora. ' Mr. Moen thanked the Council for allvwing him this time on what he aonsidered a most important issue, and said that if there were any questions, to please feel free to call him. KISSISSIPPI TORNADO DISASTER: Mr. William Drigans, Presidant of the Fridley Jaycees, was preaent and said that he would like to extend a thank you to D{ayor Kirkham and the Council, and also to the City of Fridley employees who have helped in this effort. He said that they have collected 200 cartons of supplies which amount to about 2 tons, and $280 has been donated. He said tY►at the City of Fridley has had television and radio coverage, besides coverage in the Minneapolis and St. Paul and the local papers. He said that he felt that this will go far in helping to improve human relations. He said that there was a similar situation in the City of Fridley in 1965 when we had our tornado disaster, and that there ie still about $2800 held in a epecial fund at the Fridley Sta te Bank. He said that their problem now ia transportation, and that he has tried contactix�q the Congressmen to qet help to ily the supplies down, also the trucking companies, but has found that it would cost about $500 to truck tha supplias down to Missisaippi. He said that he would like to ask for a release of $300 to $400 from this fund to defray the cost of transporting the supplies. Then, if in the �antime, the service is volunteered, the money could be added to the donation. He said that their greateat need is for food and moaey. He explained that about 80 ho�s were dastroyed, and only about 25% to 3096 of the people had insurance. Ae said that the Council of Aazelhurat had appointed a committee of 10 paople, five white people, and five black people to handle the disburseraent of supplies and funds. They say that they have a sufficient supply of clothinq, tha real need is �ney. Councilmar► Liebl asked if the City would have the right to spend this money this way. He pointed out that there would be a need to acquire some additional right of way at the south end of Riverview Terrace for the walkway. FIe pointed out that Riverview Terrace would evantually go through to Robert Louis Stevenson School anyhow. He said that he felt that this would be a compatible, and a much safer solution. It will fit onto a W-7 Case which is a four wheel front loader. He said that it takes about 15 to 30 minutes to put it on and it has it's own motor. The Director of Public Works said the W-7 Case frontloader is used as�a dual machine. It is a front end loader and the blowet attachment can be attached for snow work. The City Manager said that the W-7 Case Frontloader is too,big for use on most sidewalks. The Director of Public Works said the snow blower could be used all over [he City, and in some cases it could be used to blow the snow from the sidewalks into the trucks. There is a lot of children uaing it, aad at the present time there ie a lot of traffic all the time to that area. He thought putting auch a complex in e residential area would be hazardous, ae far as traffic ie concerned. He was against the resoning. The Council is the ultimate authority on it. The Council would have to say whether or not it would be rezoned. Bill Finnerty, 5040 Oakland Ave., Mpls.: What right doea the prope=ty awner have in the event it is not usable for xesidential and could not be rezoned? The Chairman answered he did not think, for one thing, the particular cost for reaidential is prohibitive. He thought if the petitioner had aome facta that 1t would be a hardahip, they could bring it to the Council. M=. Finnerty then asked that, as far as the rezoning, how far can the objections come from. He was told that anyone had the right to voice their opinion and that the City notifiea owners within 30� feet. Mr. Mittelstadt said the reasons for his motion of denial were that there were 19 namea on the petition against rezoning and these people do not want to eee apartment camplexes. He found no hardehip in thia case. He would agree to the rezoning, but felt that in thia area, which ie right next to msjor industrial complex, it should remain as is. He felt the propoeed streets ahould be put in within the next few years. The access is needed aad should be put in. Mr. Myhra said he thought where there is an induetrial area, apartmen[s probably would serve a buffer purpose. We have that on 73rd Avenue now, and if we were to rezone the northern part of the lots, we are actually getting out of that category and are getting into something Like apot zoning. The Chairman added that the use of the area ia aubstantially aingle family residences. He could not see, at thia point, the need to rezone inasm�ch as the Planning Coaimias*on recently apprwed a lot aplit for aingle family residence. He felt it ahould remain on R-1. Mr. Fitzpatrick co�ented on the fact that many people at the meeting tanight are f=am McKinley and Lakeside which ie further away. He wondered if there was a zeason for thoae living cloaex not being preaent. Several membera of the audience volunteered the information that there were valid reaeons for four of the neighbors not being present. Mr. Locker said that he was new in the area in the past two months. His home was on Onondaga and Lakeaide. He did not knaw anyone other than those right near him. Mr. Swanson volunteered he was not able to contact both partiea for the easements as yet. Benedict Nwak, 115 71at Way N.E.: He said he owned Lot 34 which wae south and weat of the proposed preliminary plat. He has acceas to hie property over a small road maintained by the achool for deliveriee to their building. He was worried about the assessmenta because of the south aad east frontage. Darrel Clark said Che achool had sewer and water along the eouth line for the echool which ie not uaed by the residente in that area. If they used the lines, they would be asaesaed. He had talked with Jim Hedren who atated this idea was brought before them in 1961 of dedicating more right of way. The school board now would like to aee a topog map before final approval. Chaixman Erickson asked the Novak's if they plan to divide their lot and would the proposed preliminary plat fit in with their future plana. Mr. Novak said he did not lmw how �ch would be taken off for a road. If the proposal was for 25 feet, the south side of his lot is the front yaxd and would not leave him enough land. Mrc. Navak said they come i.n off East River Road on what used to be 71st, but naw it ia not exactly a street but an easement. Mr. Jensen said the school board plowa thie easement to get supplies into the achool. Mr. Novak asked if he could have the cost of etreet, curb, aewer and water. Darrel Clark told him if his property were divided into two Lots facing 72nd and the present houae facing the proposed north-south street, aewer and water would be asaesaed on frontage only. The street would be assessed along the frontage and one third on the aide yard. His lot may be large enough to divide into three parcels. Mr. Novak said the street is 100 feet from the house and if you took anything more off for the etreet, there would not be enough left. Mr. Jenaen told him that, depending what the action of the school board is, it might not be necessary to ask for any additional right of way on the south side of his lot. There was a short discusaion regarding the present coat of assessments. The people living north of the propoaed plat said they bought their property because they did not want to live in aomebody's backyard. They coulda't afford mo=e taxea either. Mr. Jeneen said it is importsnt from the standpoint of Rice Creek that the creek bottom be maintained in its preeent form. It ahould not be filled and no atructure ahould be allowed to be built on that creek bottom where it would impede the flow of water. This cha�el ie required to carry the water. It is really a trench because it hae been eroded from time to time. There follwed a diacuesion of the elevatione of the creek. Clark said that lookiag at the topog, Central Avenue ie 863 feet above sea level. The Co�ieaion diecuseed allowing the rezoaing of the land North of the creek and keeping the creek bottom and bluffa in their exieting condition. At this point, Mr. Nordatrom wae asked to bring up his plana for dis- cu�sion and study. The Commisaioa took an infoxmal poll of the m�bers to determine what the feeling was ae to the rezaning itself being proper. Mr. Myhra said he wat not really pleaeed c+ith the lsyout of the euggeeted apar�ent complex. He added it doee seem we have an area about as ideal for miltiplea as we are going to find what with Onan's an the north. Chaixman Erickeon agreed. Mr. Jeneen wondered about the road along the New Brighton side. Darrel Clark said a road would not aerve any more lots, but would carsy traffic fxom ane aide of the creek to anather. Ha had not heard of any plans to exeend Stineon Boulevard. A discusaion of the waterehed area of Rice Creek wae aaked by Mr. Jeasen. A dam could be put in to hold the water up and a pond near Central Avenue. The seport of the flood plain info�ation survey, which will be done by the Corpa of Sngineers, will be ready by the firat of July. In the opinion of the Chairman, the City should acquire bottom land, but not necessarily for park purposes. In answer to the question of the constzuction schedule, Mr. Nordstrom said he had been to CiCy Hall a number of times and is ready to go ahead -- financial cormnittments have been made. Chairman Ericl�son said that in order to get something maving, he would snggest that the property south of the 860 contour line be deeded to the City and that no construction of residential buildings be allowed below the 880 line. The dity would be provided with access easements needed from the P=�Pe=tY- One of the objections by Mr. Myhra was the use of automobile parking all the way around the complex for a buffer. Mr. Nordstrom said he would work an that. It was felt tfiat a slope easement should be requested so that the 20 fcot vertical bank of the creek would not be disturbed and that the area north of the 860 be the zoning boundary. This would amount to ahout 10% of the whole area. Danel Clark wondered if this could be handled by agreement rather than easement. MOTION by Jensen, seconded by Fitzpatrick, that the Planning Co�ission recommend anproval of the rezoning request, ZOA 4�`68-13, Han¢nerlund Enter- prises, Inc., Clarence Nordstrom, Applicant, of the North 903 feet of the East 3/4 of the NE� of the NE'� of Section 13 (Parcel 10 and 200) to rezone from R-1 to R-3A subiect to the followinQ conditions: That the petitioner agrees to sell to the_City of Fridley the remainder of the total parcel South of the North 813 feet for the sum of one dollar and other considerations as previously offered and that an easement be provided�over the South 160 feet of the North 813 feet for purposes of maintaining slope and that a suitable access easement be provided to the previously mentioned parcel which the City is to acquire, locatian to be negotiated between the owner and the City. The Planning Commiss;on does not feel that the plan as presented is necessarily a part of this action. BE IT FURTHER RESOLVED that the Mayor and Clerk be and they hereby are authorized to execute such agreement, and thereby assume for and on behalf of the City of the contrac- tual obligations contained therein.
