The City Manaqer explained ttutt along vith this problmi ia the considration of the off street parkinq by the apartaent houw. The Council. if the alley ware to be closed, would have to gsant waivers of the Ordinanca to alloa the front yard parki:rq. Mrs. Lucille B. Calguire, 6008 2nd Streat N.E., said that she had just bought this property and ie not aware of the backqround, but has already eean the probYem of the blowinq sarxi and jurilc, and would like to see the alley closed off. She said that as it is, it is very hard to maintain. She felt that gart of her land was beinq used as the alley. Mr. James Rudnitski, 6035 Main Street N.E., said that since tha storm sewer was put in on 61st Avenue, they have not had the water drainaqe problems. He said that in 1964 they qot flooded out, but no trouble since then. The City Engineer commented that there is, however, a low area that dces not have an outlet. A visitor to the Meeting froan the area felt, that by improving the alley, it would create greater drainage problems, since thera would be more blacktop. He asked if the alley were to be put in, would this eluainate the parking problems. The City Manaqer explained that the people living there have fencad off the alley and aze using unimproved parking lots in the front. He said that an in depth atudy was made to see about the front yard parkinq. He asked the City Engineer to show the diagonal parkinq plan on the screen and explained that this would put the cars within 11' of the curb and would not provide ample room to back up. The Council would then have to qive permiasion to back the cars out onto Main Street. . A visitor to the Meeting asked why adequate parkinq was not provided in the first place. Mayor Kizkham said he did not know, that this was before any of them vere on the Council. The visitor then aske8 if this would not meaa drivinq +►cross eomeone elsee property. A visitor to the Meeting snid he thought about 9 years. The City Manager aald that the correspoence datea back to 1%4 reqarding the fancinq. Gouncilsin Ltebl pointed out that there is a double garaqe built into the alley, and that he vould be for the vacation of the alley, but the Counbil must ahido by the laa and the law statea that there must be 100s aqreement, or it wuld mean same aondamnation proceedizaqs. The Aseistani REGUTAR COUNCIL MEETING QF MAY 14, 1964 PAGE 4 City Attorney, James Gibbs, said that for a vacation o! a dedicatad alley there must be 100s aqreement, or else it would mean enteri[g into condemnation procaedipqs, and if one pergon were to contest the caae, he miqht pzevail, as he could clai.m hi• right to access, whether he uses the accesa or not. The City Manager pointed out that one large pzoblsm thst:is being werlooked ia the front yard parkinq. They are presently parkinq illeqally in the front set back and for the Council to allow the vacation, thay poulfl alto haoe to qzant a waiver for the front yard parking, and all the aqreements fos this have not been received. Councilman Liebl asked for a show of hands on rho was in Eavor of the vacation of the alley. There were 10 hands raised, one for each property. It `ras ' pointed out that there ware 10 who signed the petition. It was alro pointd out that eome of the aiQners are not the fee holdera, and the City mwt Mve the fee holder's signature also. Conncilman xarris asked if A9r. Olsen, when circulating the petition, found anyone against the vacation. He replied no. Councilman Hasris said that the Council canaot conjecture on +hat the fee holders want to do, that the City needs the signatures, and suqgested sendinq a certified letter to each of the fee holders to try to qain their concurrence. Mra. Calguire saisi that she had not signed the petition and came forvazd and did so. 'Pbe condsanation could be coa- aidered an improvement to ttK alley, so then the question wuld be if it could be assessad. Couacilman xazris asked if certified letters aere aent ast, then could the City publish a condemnation notice. Ms'. MOTION by Councilman Liebl to table the final plat (P•5• #69-05) East Ranch Estates Second Addition requested by Robert A. Schroer to the next regular Meeting. Seconded by Councilman Samuelson. Upon a voice vote, all voting aye, Mayor xirkham declared the motion carried. RECESS: Mayor Kirkham declared a 15 minute recess at 8:55 P.M. CONSIDERATION OF APPROVAI, OF FINAL pLAT (P.S. #69-02) AMBER OAKS, BY DAVID R. HUBERS AND JUI.IAN JOHNSON: (Generally located south of 61st Avenue between Stinson Boulevard and Benjamin Street) The City Engineer said that the Public Hearing has been held and the plat basically meets the City standards, however, there is one point of conflict. There has been some disagreement between the owner of Lot 3 and the developers on how the street grade should be set. He said that he had requested that both the developers and the owner of Lot 3 be present at the Meeting tonight. Mrs. Zander said that she and her husband were the owners of Lot 3, and she hag been confused about the street grades. It appeared to her that her house would be sitting up too high in relatioa to the rest of the land. The City Engineer explained that by moving the street, it would be farther from her house, so the slope could be more gradual. The cul-de-sac;as originally planned wuld have taken more of her land; the present plan will take less. He aaid that he felt that the developers should be asked to grade back and fix hez' front yard, while workinq in the area. He said it may need a retaining wall. He suggested that'if they were to put irt a garage, that it ba a tuck-under type. Mrs. Zander said that she just could not visualize thie slope, and how great it would be. The City Enginear aaid that the house would be about 70' back fraan the road, so the slope would be gradual. Mayor Kirkham added for the benefit of Mrs. Zaxdrs that it vrould be ccxiparable to the base of one side of tha Council Chambers to the ceiling on the other side, looking east and west. The pitch of the driveway would be less. The City Engineer said that the yard could be sloped, or a retaining wall could be put in, ox sme terracing work done, dependinq on what Mrs. Zander eanted. COUNPCIII4AN SHERIDAN ARRI9ED AT 9:15 P.M. Councilnwn Sheridan asked if the additionsl riqht of way had been acquired. The City Segineer said yes, the only problem left, was the decision on the stseet grade. Councilman Samuelson suggested asY.inq the leqal departent to-daaw up an. agreement for the Zanders and the developers to sign, and returninq it to the City. This would clarify what tha.City Engimer is trying to exQlain in Mritinq and wou2d qive the Zandera a deqree of protection and would aleo spell out just what is expact of the developars. This would be prior to releasinq the plat to the developars. , , ' , ' RDGUTAR COUNCZL MEETING OF MAY 19, 1969 PAGE 9 Mr. Julian Johnson and David R. Hubers wanted to know how long it would take to expedite this. Councilman Samuelson said probsbly les• time than it would take to record the plat. 2'ha developers of the plat said that this might turn out that it would be too expensive to develop the land. The City Engineer said that this really would not be too expensive, once they got the bulldozers into the area, this could be accomplished easily. Councilman Liebl conmiented on the need for residential hanes in Fridley, and that he would like to see this plat expedited. He said that he hoped that they will atart building homes as soon as the plat is recorded. , MOTION by Councilman Samuelson to approve the final plat, Amber Oaks, P.S. #69-02) raquested by Julian Johnson and David Hubere, subject to getting an agreement signed by them and Mr. and Mrs. Zander for the completion of the slope improve- ' ment ae outlined by the City Engineer. Seconded by Councilman Sheridan. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. ' , C PROPOSED Y.M.C.A. FACILITY: Mr. John W. Kessler, General Director of the Younq Men's Christian Aesxiation of Metropolitan Minneapolis read a letter to the City Council dated May 16, 1969 which atated that the YMCA has selected the Siest Moore Lake site for a full faciiity YMCA. This site contains 6.97 acres owned by the City of Fridley, .98 of an acre owned by School District #14, and approximately another 23 acre could be obtained if 60th Avenue were to be vacated. Dr. H. Strait added that an ad hoc committee has been meeting for many monihs and has been broken dovm into a program committee and a site comnittee. This wou3d be a full facility to serve all the northern suburbs, and would be a femily centered "Y". The propoaed facility would cost about one and one half million dollars, and this wuld not include any cost of land acquisition. The preaent predictione are for about 900,000 cubic feet of useable building space. This facility includea rooms that could be used by other organizations. Dr. Rufus Putnam, Chairman of the General Board of the YMCA added that the , aite was eelected last week, if the land could be made available. Council- man Sheridan asked if this proposal has been made to School District k14. Dr. Strait said not as yet. He said they wanted to talk to the City Council firat. ' He ecplained that there was an alternate plan, in case the land could not be acquired from 5chool District #14 for gaininq the same amount of acreaqe through reclamation of some of the shoreline of Moore Lake. He said that they , have talked to the school unofficia:.'_I and they hava indicated that they have no plane for the land, but no off cial approach has been made. Councilman Samuelson said that it had been added to the School Bosrd's ]►qe+da. , ' ' ' CounciLnan Shezidan said that he was not aure the Council had a riqht to con- eider this propoeal, ae this pzoperty came into the City's hande in s different way. All the property froa 59th Avanu to 63r Avenue wa. all tax titla between the City and the School v!.strict. He eaid that thie was a very attractiva proposal, but the leqel stafr wwld have to look into t}r lagality oi Ehe sale. CounciLmn Samuelson said that this is one of the mot outaGinding things that hae happened to the Citp of Fridle+ poL qlAy Yeara. He eaid tAat he wuld vrelcome this facilit Cl qpr sm# ard ptl QYtinly wrk wi{) jp tc do everything poqple to brinq i`t about. ` REGULAR COUNCIL MEETING OF MAY 19, 1969 - PAGE 1Q Mr: Gibbs said that he and the City Attorney looked into thie, and it is their understanding that the City can leqally sell this operty for $1.00 and other good and valuable considerations under the Charter. He suggested that the City keep a reverter clause on the land in the event the YMCA should build the facility, then abandon it for some reason. Then it rrould revert back to the City of Fridley. He asked iP their plans call ior the entixe site. He was told that they did, Councilman Harris felt that this was a wonderful proposal, and another step forward for Fridley in providinq recreational facilities, and that he would concur with Councilman Samuelson completely. Mr. Richard Harris, 6200 Riverview Terrace, asked if there were beach facilities there now. Mayor Kirkham told him no. Mr. Harris pointed out that to reclaim any of the shoreline, they would need permission fran the Conservation Depart- ment. Mr. Gibbs said that this is true, however, he felt that this would be just a matter of askinq for permiasion. Mayor Kirkham coented that he would certainly like to see this proposal moved forward. Councilman Sheridan added that this would be the City's opportunity to beautify the west side of Moore Lake. Councilman Harris asked how the YMCA would like the Council to ahow their acceptance. Dr. Putnam said that the Executive Committee has full power to take action, and it will came before them May 28, 1969. Councilman Samuelson asked if a letter of concurrence would help for the meeting of the 28th. Dr. Putnam said that it would be helpful. Mr. Gibbs pointed out that the transfer oE property would have to be done by ordinance. He asked if the reverter clause would pose any problems. Dr. Strait said it wou3d not. MOTION by Cwncilman Harris to direct the Administration to prepare a letter of consent to be sant to the YMCA, and also to di=ect the City Attorcuy to prepare an Ordinance for the transfez of property. Seconded by Councilman Samuelson. MOTZON AMENDID by Councilman Sheridan to split these two orders, if it vas agraeable with Councilman Harris. CounclLian Harris aaked what was his purpose. Mr. Gibba said that it would not be illegal to hold Public Hearings. but they would not be requird by Charter. Councilman Samuelson asked if the street vacation would have to be by Public Hearing. Mr. (iibbs said that he was only speaking of the 6.97 acres. If 60th Avenue were vacated, this would have to qo through the regular vacation procedure. Councilman Sheridan said that this might be a way to put some emphasis on the YMCA Eacility, by holdixg Public Heazixigs. Councilman Liebl said that he noticed that there was a member of the Parks and Recreat3on COmaiission present, and asked if they were aware of this. Mx. Ed Fitzpatrick said thst the Coanission just became aware of this last Friday. He said that the Com¢nission has not had a meeting yet to discuss this, but the firat impression gained from talking with the other members is that they were enthusiastic. Mr. Gibba said that if the Council desired, before the week is over, a memo- randt could be sent to the Administration relative to the leqality of sellinq the property, so the City would have something in c►riting. He added that he could sae Councilman Sheridan's point in holding Public Hearings to make the people aware and that this miqht qet thinqs movinq faster. Councilman Samuelson said that if a letter of intent ie satisfactory for the YMCA, the Ordinance would not be neceasary at this tfine, and could be prepared after the Public Hearings. Councilman Sheridan pointed out that the Parka and Recreation Comonission woUld want to meet and discuss this, and they may have sane questiona of the YMCA about the joint nse of the facilities. He would prefer to have no action on an Ordinance before the Commission has a chance to look at this proposai, since a letter of intent will aerve the eame purpose. Cancilman Samuelson coented that Chen in the mesnti.me the xMCA can get started with their fund drive c¢aittees etc., and ihe Administration can keep thinga moninq at this end. Councilmaz+ Harris asked if the garaqe rent mould be included with the apartent rent. Itr. Johnson said that he did not know. Councilman Hazris said that on occasion in the past there has been trouble 1f the zent was charged separate from the rent for the unit. 2he qaraqe would sit awpty and the car auld be using up the parking space that is provided for viaitors, or in the street. Mr. Johneon said that it ia aaticipated that they will draw people who have one or two cars or a boat, so they wuld need the garaqe. Councilman Harris said that with a project of this nature, ha vould like to eae the charge for the apartment linked vrith the charge for the garaqe, so that the rent would actually cover both. _ Mrs. E.L. Pett, 176 Longfellow Street N.E. said that if the access is closed off from East River itoad, this will mean that all the traffic will be on 79th Way and there is already a problem with speeders. Councilman Samuelson pointed out that there is a signal achedu7ed for 1970 for 79th Way and East River Rcad. Mrs. Pett said that theze are already so many peopie trying to get onto East River Road now, and with all these added paople the problem will be greatly compounded. Councilman Harris said that it wou2d be easier to get out with a siqnal. Mrc. Pett said that then maybe people will use Longfellow to qo around the liqht. Councilman Ha=ris said that it has been the City'e experience that peop] wotzld prefer to use a light than to try to get onto a highpay.without one. A member of the.audience asked how many acres were involved. Mr. Johnson said about 17 acree and that there would be 294 unita. Councilman Ifarris said that he felt that the development as propoeed rould be an improvement aver an M-1 ditriot, which could include manufacturing planta. This would mean heavy semi trucks vrould be using 79th 4Pay, which would be worse. 2his plan vronld reduce the area to residential, and he felt that the developer has tried to come up o+ith a gooti plan. He explained that obviously this land will not lay vacant, and that samethinq eventually would be built there. with the present zoning, there could be apartment units along 79th Way and an induetrial building juat south of there. The City Engineer said no, because there is access in the back of this lot. There is a 16' dedicated alley along the back of the lot so the City vill need some additional right of way for a future road. He explained that the split is betoreen the two zoning categories. ' CONSIDERATZON OP' PAVING OF MISSISSIPPI WHY WEST OF EAST RIVER ROAD: The City Engineer explained that the County still claims that an underpass for , the railroad tracks on Missisaippi Street is not warranted. If it is felt that there ahould be further negotiations, then the question arises whether or not to pave xississippi Way. If the City should get the underpass the storm ' serer would have to be changed, and some of Mississippi Way would have to be torn up. The busi, nesaes on Missiesippi Way need their street, however. ' ' ❑ , ' ' , , 1 ' Councilman Harris felt that there were still areas for future negot.iation with the railroad to try to get the underpass. Councilman Sheridan asked if the storm sewer could not go to Locke Lake. The City Engineer said no, there ig not sufficient depth. The only place far:the storm sewer to go would be west of the dam, or to the river. Councilman Sheridan asked the distance of Misaissippi Way. The City Enqinear said about 600' to 650'. Councilman Sheridan caented that the replacement of the blacktop would not be too ezpensive then anyhoa+. Counci].aian Harris asked how this lines up with the intersection configuration plan, arid mhat is the atatus of moving the gas station that is in the vray. The City Engineer said it is at an impasse with the County. Councilman Harris said that he could not see any reason for spending money, if it would have to be torn up later. As long as there is going to be some work done at thie intersection, perhaps now is the time to go shead and acquire the gaa station land, and get the work done all at once. Mayos Kirkham Pointed out that the businesses need the street now. The City Enqineer said that the County ie plannirnJ to improve the rest of Missiecippi from 2nd Street to East River Road next yesr acd they ►ill expect the City to acquire the aecesaary riqht oi way. Councilman Sheridan aeked how much the east-west portion of Misaissippi Way wou18 coaL.. The Citp Lhqirteer said about $12,000. The Fire Undervriters have instruoted the Fridley 'iremen that tAey are.not to enter the building if it is on fire under any circimtstances. He pointed out that he might find hiatself in a very difficult situation if there was a fire and one of his empioyees was }urt. The Cify Manaqer pointed out that they did install a sprinkler system. Council- man Harris said that thia did reduce their fire insurance somewhat, but the Fire Department does not feel the protection adequate. Hr. Ankrum, City Manager Paul Brown, Director of Parks and Recreation OFFER TO SELL LAND Mrs. Florence Swanson described to the Commission a parcel of land which she owns located in the Ruth Circle area which she has of£ered to sell to the City. She feels that this land would be beneficial to the City for future development as a park, There is no park at all in this area and the neighbors feel there is a real need for such a park. Part of the property is zoned R1 and part of it is zoned Light Industry. The area is rapidly being developed and soon there will be no open land available for a park. She would like to sell the land as soon as pos- sible and has offered it to the City at a sale price of ten thousand dollars but would be willing to agree to an appraiser's evaluation figure. hbTION by Cochran, seconded by Stimmler, that the Commission receive the communication dated May 26, 1969 from Mrs. Florence Swanson regarding the decribed parcel of land. Tlie Motion Carried. PROPOSED Y.M.C.A. BUILDING A letter has been received by the City Council from the Y.M.C.A. of Metropolitan Minneapolis regarding the building of a full facility, Y.M.C.A. Center. They have considered many possible sites and have selected the West Moore Lake site in Fridley. They request the donation of this land to them from the City of Fridley. A citizens committee from the area surrounding the site was present at the meeting to make known their views of such a building. They presented to the Commission a letter summarizing their questions which briefly are: Is it possible to give or sell property designated as park property to a private group? Would our last natural site be lost? Is it desirable to build another swimming pool righi across the street from the Junior High pool? Would it present heavy traffic and parking problems? Is it feasible to develope the lake into a swim- ming teach? They feel that this building would be very beneficial to the City and surmunding communities but feel that a different location would be better. Chairman Fitzpatrick told the group that if the land was donated to the Y.M.C.A., an agreement would be made where by the land would revert to the City if nothing is done within three years or if the Y'.M.C.A. abandons their plan. The Commission and the Y.M.C.A. are to meet to discuss the feasibility of combined use of such a buiiding. I am enclosing it for your information. 2 am certainly sorry that the report is not more encouraging. I am hoeful that your proposal will receive consideration early in new fiscal year. With best wishes, Sincerely, Walter F. Monda e 94 DEPARTMENT OF THE ARMY OFFICE OI THE SECRETARY OP TNE MMY ORFI OP GVIL OEP1lE WA3MINCiTON, D.G. tOS10 Honorable Walter F. Mondale 7 United Statea Senate ' Washington, D. C. 20510 'y Deaz Senator Mondale: Thank you for your inquiry of April 25, 1969, concerning Federal aesistance for Fridley, Minnesota. The Office of Civil Defanse in authorized to provide financial con- tributions for tke purchaee of equipment to be used for civil defense purpoaes to the Statea, and through the States to their political eubdiviaions oa a matchingfunds basis. Civil defenae purposes are those directed at minimizing and relieving the effects of an attack upon the United Statee, The normal public safety activitiee of a community, such as a warning system to alert the local popu- lation to a threat of a tornado or other natural disaeters, do not fall within the atatutory definition of civil defense, However, if the warning ayetem is inetalled for civil defenae purpoees it may be used during aud in preparation for natural disaeter, , All of the FY 69 funda available for financial contributiona to the 3tates for purchase of equipment for civil defenae purpoees have been obligated. We have a remaining hacklog of applications for financial aaeiatance, which coupled with applications we anticipate ' receiviag before the end of the fiacal year, will exceed funda expected to be available in FY 1970, Approval of projecte in FY 1970 will, ae in FY 1969, be based on the priority of the program for wrhich ' aseitsnce is requeeted and the date the application was raceived. Warning projecta are among those given firet priority of fund allocation. Within that priority, the applicatioa from the City of. , Fridley will be coneidered in terma of its relative time of eubmission to the OCD Regional Office. l , , , We regret that maay eeeential State and local civil defense programs have been temporarily deferred for lack of Federal financial eupport, Since rely, Joseph Romm Dinotor ot CiYli phnit 95 , ' k ' ' ' ' , — DEPAqTM[NT pF THE ARMY iT. I trust that your comnunity will respond with the same high degree of cooperation during any future flood emergency requiring either structural or non- structural meaaures of protection. I realize that your caomunity has another big job before you in cleaning up the debris and trust that you will receive the same high degree of cooperation in this task as was demonstrated in the fight to hold the waters back. I am confideat that ae can solve the major flood problems of this region if we can continue to work together to get long-range solu- tions. Fridley, Minn. 55421 Gentlemen: On behalf of my father, Stanley C. Dahlberg, I would like to comment on the requested lot split M69-14. The Plats Subs Committee approved this request for the following reasons: 1) The precedent had been established on the Easterly end of the plat. 2) It would be impractical to split the line only; leaving a very large lot lot on the East-west remaining. (125' x 131.78') , The Planning Commission denied the North-South split because it would not meet the 75 foot frontage requirement, (line "B") At the Planning Commission meeting it was suggested that my , father purchase the land to the East to meet the 75 foot frontage requirement. Chairman Erickson's copany of Bronson-Erickson is the fee owner of the abutting property ±o the East. I believe that ' his decision not to approve the NorthSuth split could have been nfluenced by this fact. ' I am at this time requesting the Council to approve the lot split 69-14 as apgroved by the Plats $ Subs Committee and to waive the required certificate of survey until the time that the building permits are acquired. 1 ' ' A' The main purpose of the certificate of survey is to prove that no permanent structures encroach upon the proposed new property line. The attached drawing shows the distance from the garage (the most 5outherly permanent structure) to b 73 feet *. This leaves little doubt that any encroachment could exist.
