' THE MINUTES OF THE REGULAR COUNCIL MEETING OF OCTOBER 20, 1969
Mayor Kirkham called the Regular Council Meeting of October 20, 1969 to order
at 7:30 P.M.

The Council and audience joined in saying the Pledge of Allegiance to the Flag.

PRESENTATION OF AWARDS:
Mayor Kirkham presented Mr. Richard Donlin of the Parks and Recreation Conunission
his award for his service on the Commission.
Mr. James Keating was not present, so Mayor Kirkham requested the Administration
send his to him.

MOTION by Councilman Liebl to adopt the Minutes of the Statement of Canvass Meeting

Mr. Nils Nygards, 7435 Highway #65 N.E.

Mr. Nygards said that at the last Council Meeting there was a motion made authorizing
two hour parking on Fireside Drive, and asked that this action be explained.
Councilman Sheridan said that he had received a request �or this from a pro-
perty owner, Mr. Peter Brooks. Mr. Nygards asked if there was anyone else.
Councilman Sheridan said that theXe was also a request from a resident within
the trailer park on the east side of Central Avenue. Mr. Nygards said that he
would like to state right now that there is never a car parked there. He
said that he had lived in this City tor 10 years and has lived in the trailer
park and wondered why he did not get a call on this. He asked what the reason
for the action was. Councilman Sheridan said that there have been some problems
in the early mornings on this street. The Chief of Police added that the street
was posted by them on the orders of the City Council. It was felt that there
were people working at Onan's and Edison's that were parking here. He said
that when Mr. Nygards called him his reason for objecting is that he parks his
truck in front at night and runs a cord for a heater to the truck.: Councilman
Samuelson pointed out that the Council has recently adopted an Ordinance which
does not allow 24 hour parking on City streets, so he would be in violation
anyhow. If parked longer than 24 hours a tag may be issued. There had been
trouble with cars paring in the street at night which creates problems with snow
removal. Mr. Nygards asked if he could be tagged without notification. Council�
man Samuelson said that the Council.has the right to pass Ordinances and they are
published and no individual notifications are necessary. The Chief o�.Poliae
said that it was his understanding that more snow removal equipment will be
purchased and there will be snow removal at night. In that case vehicles will
be.removed.
Mayor Kirkham said that sufficient time has been allowed and if there is more
discussion needed, to see the City Manager about putting this item on the
Agenda.
Mr. William Meyer of Suburban Engineering representing Hirsch Brothers:
Mr. Meyer presented drawings to the Council and said that there are problems
with their parking lot at the intersection of Mississippi Way and Riverview
Terrace. The City has requested and wi11 receive an additional 10'. The
easement as laid out will restrict parking. The City Enqineer said that Hirsch
Brother s were ready to pave their parking lot and a slight change would not
create any severe problem. They only need about 2' - 3`. He suggested giving
them a triangle of about 5'. The City has not received the deed yet but will
receive it when the land survey is filed, Mayor Kirkham said that he could
forese e no major difficulties with the slight change.
MOTION by Councilman Samuelson to follow the recommendations of the Ci�y
Engineer for dedication of the westerly end oP Mississippi Way less 5' of a
triangular area to permit parking lot development. Seconded by Councilman
Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion
carried unanimously.
Councilman Liebl said that he noticed that the dirt is washing out on the`"south
side of the street. He wondered if a retaining wall is needed, The City
Engineer said that the boulevard work is not finished yet and there is still
sloping left to do.

CONTINUED PUBLIC HEARING ON THE 1970 BUDGET:

Mayor Kirkham said that this is the continuation of the Public Hearing on the
1970 budget. The City Manager went to the screen and gave a presentation on
the budget to the people with the help of visual aids.
Councilman Harris said that he would like to take this moment to say that he
felt that the City Manager has done an excellent job in preparing the 1970
budget. He has tried to keep pace with the growth and development of the
community. This budget is within the thinking of this Council in trying to
keep close to the same mill rate as last year, and it would have done so, had
not the Legislation ruled that the PERA, Firemens'Relief Association and
Police Pension Fund had to be brought up. It is important to try to keep the
good personnel the City has now. The Department Heads agreed with the City
Manager that some of the equipment could wait for purchase until next year to
keep within the mill rate set. Councilman Samuelson added that this budget
is an example of one of the best he has seen in recent years. In looking at
the budget each item of expenditure is justified by the needs of the co�unity.
The C ity Manager said that he had the fine help of the Finance Director.
Councilman Liebl asked if the Policemens' Pension plan would be sound. The
City Manager said that it is hoped so. It is not known what the full impact
will be yet, but the more that is budgetted this year, the less it will be
next year. Only the actuaries will tell us exactly. Councilman Samuelson
asked why the decrease in the Buildings and Grounds portion. The City Manager
said that this is because the Fire Station is now paid £or. Councilman
Samuelson said that this represents another asset to the City.

RESOLUTION #188-1969 - RESOLUTION CERTIFYING TAX LEVY REQUIREMENTS FOR 1970
TO COUNTY OF ANOKA FOR COLLECTIONS:

' CONSIDERATION OF UESTIONNAIRES, REZONING AND IMPROVEMENTS IN HYDE PARK AND CITY
VIEW ADDITION:
� Councilman Sheridan said that as this has been before the Council for some time,
he would be ready to act on the matter tonight, and could see no reason for
further delay. He felt that the Traffic Circle Flow pattern with the slip
' off should be installed• There has been some concern by the people concerning
the improvement of the interior streets and these could wait until the scheduled
date in 1974, unless they wanted them sooner.

Councilman Harris said that recognizing Councilman Sheridan's comQ►ents, he
would like to bring up an item of concern to him and some of the people in
the area. He questioned what if some kind of a development plan were to go in
that needed three or four lots at the south end of the block, then later, one
at the north end of the block. They may gradually come together in the middle
with the result that one 40' lot would be isolated and would then be valueless
as a residential home and may not be of any value to any comomercial enterprise
either as it would be too small. He wondered how �hie �yp� of development
could be controlled to keep this from happening. He pointed out that the �eople

are to be assessed and there must be a benefit, but if this situation should
happen, there would be no benefit and would be a detriment. He wonder�d if it
would be possible to set out a minimum square footage for development such
as 25,000 square feet. He suggested rewritting the zoning ordinance, or
drawing up a new one to prevent this occurrence. Councilman Sheridan agreed
that there should be some kind of protection and the development should be
uniform. Councilman Harris said that it could come about that a home owner would
be boxed in, has paid for his assessmen�s, then would be unable to sell his home.
Councilman Sheridan said that he did not feel that there would be any objection
by the people to some kind of protection, although ther¢ may be from a de�
veloper.
Mayor Kirkham asked the City Attorney if he had seen any Ordinances from
other communities such as this. The City Attorney said no, this would be under
the concept of a non-conforminq use. Even though the land may be rezoned to
a different zoning, the people would have a right to continue the use for
residential property. There is no way that an individual can be required to
sell unless he wants to. If a developer were to come in and-want to develop
6 or 8 lots, he did not feel that the Council would b� within;their right to
dis-allow the permit just because it would make adjacent land of,less value, or
would box it in, and the Council could not require him to try to purchase the
additional one or two lots. He said that there may be some cities that have
gone through this type of transition but he did not know of any off�hand. The
City could try to pursuade a developer to pick up an additional one or two
lots, or may try to pursuade a home owner to sell but they would not have the
authority to require it. The City Attorney said that if a minimum square
footage were to be placed on a developer, this still would not assure that a
lot would not be skipped over.
Councilman Samuelson pointed out that Mrs. M. O'Berg had suggested rezqning
to multiples at one time. This possibility was also studied by the Planning
Commission. Mr. Eldon Schmedeke said that they were not interested in rezoning
to multiples, but wanted a commercial zoning.
Councilman Harris said that he felt that this realm of thought should be
researched by the City Attorney and the Administration. The City Attorney said
that a minimum 1ot size could be written into a commercial ordinance just as it
can be into a residential. It would then apply to any remaining land within
the City, however. The City Engineer said that there is very littie C-2 left
undeveloped within the City. The City Attorney said that this could then be
another zoning classification. The City Engineer pointed out that then there
would have to be a hearing for the Ordinance, then the hearings for Hyde Park
rezoning would have to be held over again. Councilman Samuelson said that this
may be true, but may prove to be more workable in the years to come. The City
Engineer felt that it would be easier to work with each developer as they come
in. There is not much land, and there would have to be sideyard utilization
for parking as the lots are not very deep. The 35' setback is the minimum now
for the zoning classifications.
Councilman Sheridan suggested that the first reading of the Ordinance could be
held at this Meeting, and then amended at the second. Councilman Harris said
that he would rather not handle the problem this way. Councilman Sheridan felt
that as this has carried on for some time, the Council should give some show of
faitM to the people. They need some indication from the Council that there is
some progress being made. Councilman Harris felt that this may mean giving a
first reading, then a complete change before the s�c�r�� ��ad�nc�.

Councilman Liebl said that this has been studied for about 4 years and he too
would like some action taken. However, he did feel that Councilman Harris'
suggestion had merit. He said that he would like to see the area developed to
C-2, but that there should be some minimum requirements. He said that he would
Iike to have the first reading and ask the City Administration and Attorney to
lpok it over before the second reading. This area presents a special problem.
The City Attorney suggested the City Engineer check to see if there is any
commercial area that is under 25,000 square feet within the City. He said that
what the Council has been talking about is very close to replatting. This would
be no problem if the land was vacant, but it is with the many mortgage holders.
He wo�dered if the Redevelopment Authority could be of any help.
Councilman Samuelson asked that the City Engineer check out the minimum land
requirements to see if the drafting of another Ordinance would hurt any other
areas and report back at the next meeting.
MOTION by Councilman Samuelson to return this proposal back to the AdminisR
tration to study draft ordinances for the orderly development of commercial
areas, and have the report ready for the Mesting of November 3, 1969. Seconded
by Councilman Harris, Upon a voice vote, all voting aye, Mayor Kirkham declared
the motion carried unanimously.

The City Engineer said that he would bring back these Ordinances for second

Gity Attorney has repozted to him that the City can no longer retain easements,
but must vacate land, then get an easement for utilities.

CONSTDERATION OF A REQUEST FOR A DOUBLE BUNGALOW ON 57TH PLACE:
The City Engineex explained that the applicant owns Lots 3, 4 a�d 5, Block 5,
Ca.tX Va�ew Ac�dition. Lots 3& 4 are zoned for multiples and Lot S is zoned
for single family residence. H� had asked the applicant if he could acquire
part o� Lot 5 then sbift to the west. As his plans are now would leave Lot 5
u�buildable, although he is meeting the City Cc�de with his plans £or the
daub].e bun�alow. Councilman Samuelsan asked why not rezone Lot 5. The Cit,y
Enqineer said that he tri,ed but it was turned down. Councilman �iebl

Hearing. It would take a variance to build two residential homes. The
City Attorney suggested that he split Lots 3& 4 and build single homes. The
City Engineer pointed out that as he is meeting the Cxty Code, he did not
think the Council could stop him. It was pointed out that making Lot 5
unbuildable would perhaps mean that it would go tax forfeit. Mayor Kirkham
suggested including Lot 5 on the building permit. The City Attorney said that
to make this effective would probably Yiave to have a resolution by the Council
that Lot 5 is unbuildable, and it should then be filed with the Registrar of
Deeds. Councilman Sheridan suqgested granting a variance so that he could
build part of the structure on Lot 5, then it could not go back for taxes, or
the applicant would lose the structure. All three lots would then be on the
title.
MOTION by Councilman Harris to table consideration of this item to the Meeting
of November 3, 1969. Seconded by Councilman Samuelson. Upon a voice vote,
all voting aye, Mayor Kirkham declared the motion carried unanimously.

The City Engineer pointed out that as the Council knows East R.anch Estates
Second Additipn was approved by the Council. They are in the process of nego-
tiation with a developer to the north of Bob's Produce Ranch. If the award is
made, the contractor will have to be asked if he would mind holding up on the work
for about 2 weeks until the negotiations are complete, then there will be a
change order necessary.
Mr. Comstock, of Comstock and Davis, Inc., Consulting Engineers said that there
were three alternates given, but the low bidder, b.M. Noyes only bid on the
Alternate #3 which is for plastic pipe. The engineering estimaCe at the time
of th� Public Hearing was $233,100 and since that time there have been additions
to the project amou�ting to about $25,000. It appears the Iow bidder would be
within the estimate. It was �he feeling that there shouid be some alternates
where it is known that the excavation area is quite difficult. There i_s a high
water table in this area.
Councilman Harris asked if another kind of pipe rather than plastic should be
considered. Mr. Comstock answered that he felt that the pipe would be all right
although there is some disagreement from the Engineerinq Department, who feel
that the cast iron would be better. There wexe no soil tests made. Ccruncil-
man Samuelson said that he had some taken in this area and the soil was quite
sandy. He said that he would like to try the plastic piping. The City
Engineer pointed out that the major portion of this area will be developed
industrial and felt that the type of effluent should be considered. Councilman
Samuelson asked what if after the soil tests are taken, it is felt that there
should be cast iron. Mr. Comstock said that this would have to be a field
decision. Councilman Liebl felt that as it is an industrial area under con�
sideration, he felt that this would be a foolish place to try the plastic pipe,
when it is not known how it will last. Councilman Sheridan pointed ou� that if
the low bidder would put in cast iron at the price of the second lowest bidder,
it would still be within the estimate. Mr. Comstock pointed out �hat there are
problems with the cast iron too. When there is a service connection to be made,
it is more expensive to do. This is largely undeveloped land. The City
Manager asked how much it would cost to make a soil analysis. Mr. Comstock
guessed between $4,000 and $5,000, and pointed out that the soil within the
City changes about every 150'.
MOTION by Councilman Samuelson to award the Water and Sewer Project #93 to D.
M. Noyes Construction Company in the amount of $235,098 according to the
specifications. Seconded by Councilman Harris. Upon a voice vote, all voting
aye, Mayor Kirkham declared the motion carried unanimously.
The City Engineer asked if the Administration was to come back with a change
order if it is found that cast iron is necessary. Councilman Samuelson said
yes.

DISCUSSION REGARAING HAZARDOUS INTERSECTION OF EAST RIVER ROAD AND I. 694 AREA
AND RESOLUTION #189-1969:
The City Engineer explained that.the City Manager wrote the letter appearing on
Page 60 of the Agenda, the Chief of Poli�e the one on Page 61 and the Planning
Commission passed the Resolution on Page 62. He said that signals are planned
for this intersection by the middle of next year. The City Manager wondered
i£ the signals would help enough as the grade is such that approaching cars
still would not be able to see the signals until they are very close to it.
Thexe was some discussion on adding the xequest for signalization to the letter
and the Resolution and it was agreed that they should be amended.
MOTION by Councilman Liebl to authorize the City Manager to send the letter
to the District Engineer along with the Resolution, a�ter they have been amended
to include the request for signalization. Seconded by Councilman Samuelson.

CONSIpERATION OF ACQUISITION OF RIGHT OF WAY ON 61ST AVENUE: (Lenny Cochran)
The City Engineer reported that as the Council knows, the Amber Oaks developers
are havinq trouble in obtaining the necessary right of way for 61st Avenue for
the development of their plat. The City Attorney added that he had talked to
Mr. Cochran and he indicated to him that he will dedicate the land if the City
will obtain a11 the rest of the right of way to put the road through to Benjamin
Street. There is one individual that does not want to dedicate the land on
Benjamin as they feel that this would make their lot unbuildable. The City
Engineer suggested that this fact could be taken into consideration at the time
a buildzng permit is applied for. If Mr. Cochran does not make the dedication
it will probably cost about $600 to $700 for the condemnation. Councilman
Sheridan asked if it has not been the policy for the developer to obtain the
riqht of way necessary for the development of any plat. The City Engineer said
generally yes, but in this case Mr. Cochran does not want to give it. The
Ctiy Attorney said that he did not feel tha± Mr. Cochran was being entirely
unreasonable if he is willing to make the whole dedication providing the road
goes all the way through. It may be cheaper to condemn the piece of property on
Benjamin Street. Councilman Harris pointed out that even if the north-south
road is not put in, it would be the place to put the utility lines. He was in
favor of accepting Mr. Cochran's suggestion for the dedication and getting 61st
Avenue all the way through. The City Engineer pointed out that this is not part
of any project, but it will have to be made a part, if it is going to be assessed.
MOTIOIV by Councilman Harris to acquire the necessary right of way all the way from
� S�inson Boulevard to Benjamin Street through negotiations or condemnation.
The motion was seconded and upon a voice vote� all voting aye, Mayor Kirkham
declared the motion carried unanimously.
APPROVAL OF BRIDGE OVER RICE CREEK REQUESTED BY MEDTRONICS:
The City Engineer explained that Medtronics will have to get approval from the
State Conservation Department a£ter the approval of the City Council. They
own the land on both sides of the creek and would like to build the bridge to
utilize the other side of the creek for recreational purposes for their own
employees. He then presented plans for the bridge.
Councilman Harris pointed out that the creek is used for canoeing and there should
be about 5� feet of clearance at high water.
MOTION by Councilman Liebl to grant the permit with a 5� foot clearanee above the
water, at high water. Seconded by Councilman Harris. Upon a voice vote, a11
voting aye, Mayor Kirkham declared the motion carried unanimously.
RECEIVING REPORT ON STATUS OF DIFFERENT HOOKUPS TO N.S.S.S.D. LINES:
The City Er�gineer explained that this report showed the status of the temporary
and permanent hookups within the City. Councilman Harris said that he would Iike
the possibility looked into of adding some of the effluent goinq to the City
lines being transferred into N.S.S.S.D. lines. After some discussion it was
agreed that the City Engineer would have the report ready for the Meeting
November 3, 1969.

CONSIDERATION OF AMENDMENT TO THE FRIDLEY FIREMEN RELIEF ASSOCIATION BY-LAWS:

Relief Association By-Laws which would set the same level of benefit to the level
of contribution of the paid firemen. Seconded by Councilman Samuelson. Upon a

RESOLUTION #190-1969 - RESOLUTION TO ADVERTISE FOR BIDS FOR SIX AIR WARNING
SIRENS:
The Director of Civil Defense explained that he had held the bids until June
30th which is the end of the fiscal year, at which time he returned the bid
bonds. He will have to go out for new bids, but he thought that the same .
specifications could be used. He said that he held the bids for about 6 months
waiting for the Federal grant to come through. Now it is approved.

MOTTON by Councilman Harris to receive the communication from Rudy Boschwitz of
Plywood Minnesota dated October 9, 1969. 5econded by Councilman Sheridan. Upon
a voice vote, �11 voting aye, Mayor Kirkham declared the motion carried unanimously.
B. NORTHERN PACIFIC RAILWAY COMPANY: CROSSOVERS ON 79TH & 83RD AVENUES:
�I , Th� City Engi.neer explained that he contacted the Northern Pacific Railway Co.
again as �khere is mor� anc� more develapznent going in at the north end of the
City. The City made the sam� request two years ago and were turned down. So

far the r�sponse is not favorable. It was agreed by the Council that the
Engineer was to continue trying to get the crossovers and the City Administ-
�ation should check i� the City cauld legally request the relocation of the
existing two crossovers to the new locations at 79th Avenue and 83rd Avenue.
RESOLUTION #193-1969 - RESOLUTION CERTIFYING CHARGES TO THE COUNTY AUDITOR TO
BE LEVIED AGAINST CERTAIN PROPERTIES FOR COLLECTION WITH THE TAXES PAYABLE IN
1970:
MOTION by Counczlman Harris to adopt Resolution #193-1969. Seconded by Council-
man Samuelson. Upon a voice vote, all voting aye, Mayor Kirkham declared the
motion carried unanimously.
LEAGUE OF MINNESOTA MUNICIPALITIES: COMMITTEE INFORMATION:
Mayor Kirkham cangratulated Marvin Brunsell, the Finance Director for his work
on the Gavernment Finance Committee, and went on to say that he had received
an information resume' asking if there were any volunteers for the committees
of GoVerzunental Finance, Government S�ructure, Utility Regula�ions, or Human
Rights. He asked that the Council Members think this over and let him know.

CHARTER TO VACATE STREETS AND ALLEYS AND TO
AMEND APPENDIX C OF THE CITY CODE
The Council of the City of Fridley do ordain as follows:
SECTION 1. For vacation of the street described as follows:
- The South sixteen feet (16') of 57th Place lying-
East of a line extended North that is twenty feet
(20') East and parallel to the West line of Lot 7,
----Block 7, City View Addition and West of,a line
that is parallel to and 57.5 feet West of cente-rline
of the Southbound lane of State Trunk Highway No. 47,
All lying in Section 23, T-30, R-24, City of Fridley,
County of Anoka, Minnesota.
Be and is hereby vacated.
SECTION 2. The said vacation has.been made in conformance
with Minnesota Statutes and pursuant to Section
12.07 of the City Charter and Appendix C of City
Code shall be so amended.

Ttiwo publi� hearings have been held on the rezoning of the areas bounded on
the West by Main Street, on the East by Highway 47, on the South by 57th Avenue
and on the North by 60th Avenue. The consideration of rezoni:ng was based on
petitions and verbal requests. The City Council has directed that propezty owners,
who would be assessed for the slip off and service road, be contacted to find out
whether they desire the improvements or oppose them. '

The secoud public hearing held August 11, 1469 was on a plan that would have
created the following zon�ng; (Sketch of area attached as enclosure)
C-2 Commercial Zoning; That area bouuded on the East by Highway 47, on the
West by 2'� Street, on the North by 60th Avenue and on the South by 57th --
Avenue. Also, the lots and blocks not already zoned contmercial would be
zoned commercial C-2, creating commercial zonin� in tE�e area from 57th Avenue
on the South, S72 Avenue on the North, 2'� Street on the East and Matn Street
on the West.
R-3A Multiple Dwellings: The area bounded on the North by 60th Avenue, on
the South by 572 Avenue, on the East by 22 Street and on the West by Main
Street.
In conjunction with the zoning consideration the Council reviewed traffic
,patterns £or the area, along with the Public Hearing. Meetings with Highway
Department resulted in discussions of the traffic all entering on 57th Avenue
on the South with the opinion resulting that this would overload the intersection
of Highway 47 and 57th Avenue N,E. The Highway Department agreed to a slip off
at 60th Avenue with no interference from Northbound�traffic on Thfrd Street. This
requirement brought about plan circle flow, which creates a service road in order
that Northbound traffic on Third Street can double back South along Highway 47, in
order not to cross traffic sZip off for Southbound traffic entering the area from
Highway 47.
In the first Public Hearing on improvements, property awners indicated they
did not want streets other than the slip off and the service road completed at
this time. At the second meeting a petition was received indicating the slip off
�tnd service road should be paid for by the entire City and that no other street
improvements be made. In the meeting it was also suggested that all entry to the
area be from the South. Objections were made by property owners fronting on 2'�
Street paying a portion of the slip off and service road costs. The Highway .
Department has said �4��y wiii not paY�icipate �,� any eosts as the access is of no
benefit to them and does not solve any existing�-traffic problem. _

� �e Council has expressed the fact that a slip off is needed to prevent
j' traffic stack up at 57th Avenue and Iiighway 47 on the South and easy accessibility
is needed to the area if it is zoned commercial.
Special assessments for the slip off and service road have been spread over
the entire area from 57� Avenue on the South to 60th Avenue on the North and from
Highway 47 on the East to 2� Street on the�West, based on the fact these areas
are all being considered for commercial zoning and as such it was felt their
property would receive any benefits from the slip off and service road which are
deemed necessary by the Highway Department and Council in any.consideration of
zoning the area commercial.
The meeting of September 2, 1969 on the improvement involved the receipt of
a petition by the Council against the special assessments for installation of the
slip off and service road being spread over the area being zoned commercial North
of 57� Avenue. The-'Council discussed the fact that improvements necessitated by .
change in zoning to commexc�al would be at the expense of property owners as City
funds would�not be available for�a benefitted area.
Based on the petition and expressions by some property owners, the City
Council has directed that a letter be forV�arded to all those who would be a£fected
by the slip off, askfng the�r response as to whether they do or do not wish to
have the slip off and se�vice road installed, as is uow being considered by the
City Council, with assessments spread over the area North of 57� Avenue currently
being considered for commercial zoning.
A form has been enclosed for your convenience in oxder that you may make your
desires known to the City Council. If an answer is not received from you, by
September 30, 1969, the Council has indicated they will consider the property
owner or contract purchaser approves of th� installation of the slip off and
service road on the assessment basis proposed.
Attached.hereto are enclosures, including a sketch of t�affic pattern and
zoaing uuder consideration and the proposed improvements and information on the
, special assessment cost estimates applicable to the properties involved.

CONSIDERATION OF THE STUDY OF EAST RIVER ROAD 5AF�TY IMPROVEMENTS AND RECEIVING
THE MINUTES OF THE ANOKA COUNTY TRANSPORTATION LAND USE COMMITTEE MEETING OF
MAY 23. 1969:
MOTION by Couneilman Liebl to receive the Minutes of the Transportatian and
Land Use Committee Meeting of Aiay 23, 1969. Seconded by Councilman Harris
for discussion.
Councilman Harris asked if the City would�be preparing anything as far as
Engineering studies go. The City Engineer answered that the county is going
to make a study from I. 694 to Rice Creek with the use of consultants to get an
overall plan for any additional right of way and any other improvemenCs needed.
When the plans are completed, they will be coming to the City of Fridley with
their x'equests and the City will have to do some improvements with the
side roads mentioned. Councilman Liebl pointed out Item #3 and #5 and felt that
when some decision is reached, the people should be informecl through an in-
formal Public Hearing of the anticipated action of the Council. Councilman
Harris agreed with this idea. Councilman Liebl said that some people have
objected rather strenuously to the condemnations. Councilman Harris said
that these people could be assured that they will be asked to come in when
there is a plan ready for their participation i:n any discussions held.
1 Councilman Liebl said that he would liJ�e to see a semaphore at 61st Way. He
said that since the speed limit was reduced to 40 MPH on East River Road, there
has been no appreciab3.e difference in the speed drivers drive at, they still
sp�ed. The only thing that slows them down is the semaphore at Mississippi
� P�ay. He suggested that the Police Department patrol East River Road more
closely.

Councilman Sheridan said that as the minutes indicate, they are studying East
River P.oad between I. 694 and Rice Creek and this �rould`be perhaps step one
of mAny phases of the overall plan. He said that he felt that it was a step in
the right direction. The City Engineer agreed, and commented that as money
becomes available, the job will be done in sections. The job has to be
started somewhere. A portion of East River Road south of I. 694 is just now being
completed, and the portion discussed in the minutes would be the second phase.

county has recommended three signals, one of which is to be at the entrance of
the Geoxgetown Apartments. He has discussed getting the traffic pattern in
north of the complex with rix-. Filister, and he did place his garages as
requested by the City Council. Mr. Fili,stez is in sa�ewhat of a hurry because
of the financing and would lik� to bypass some of ±he lec�al requirements of
goinq to the Plats and Subdivisions - Streets and Utilities Subcommittee and
the Planning Commission and ge� approval fzom the Council.
Councilman Lieb1 said th�t the semaphore has to be lined up to accommodate
the industries on'the east side of East River Ro�d al.so. The City Engineer
agreed that they will serve the industries on the east also. He said that the
City would need a dedication from Mr. Filister for the road to the north of
his complex to tie into Anna Avenue. The road y*ill not go through the George-
town complex. ,
MOTION by Councilman Harris to approve the Registered Land Survey requested by
Mr. Fil.ister subject to acquiring a dedication foz a road to the north of his
complex to tfe into Anna Avenue. Seconded by Coun�ilman Samuel.son.
Counci�an Sher�dan asked �•rhat could be done about eZiminating tY�ese types of
reques�s. For the last 10 - 15 years platting has been required. He said
that he did not agren with registe�^ed land surveys. The City Engineer comznented
that Great N�rthern Railc�ay Company, wi�o had i.nsistsd that they wanted a
registered land survey, has no�� decided that they wi11 pl�t instead. The City
Attorney sugqes�ed that if the Council desires, an Ordinance could be drawn �
up whereby pl�tting is required and registared la:�d surveys are not acceptable.
He asked if bir. Filister i� requ�sting a regis�ered land survey rather than
platting because of the ti.me elem�nt. The City bi�na�er said yes, and that the
Finance Directox's office h�s said that they would h�ve da.fficulty in breaking
down assessr.�ents on the p1aL-ting. Councilman Sa_muelso.z agreed that land should
be platted, so that a block can be broken down into la4s easily. This makes
doing btisiness with the mortgage companies go more smoothly. Councilman
Sheridan said that as the Council has h�d a policy, that maybe this should be
put into an Ordinance form. Perhaps it aould be t.hat one split is allowed,
but if there ia anothex split requested, that then the land would have to be
platted. This would make things easier for the City, County and the State.
The City Attorney said that he would check with the �:egistrar of Deeds and •
will try to get a mamorandum to the Council as to sthat xequire.�nents the County
is put�ing on registered land 5urveys and what latituda the Council can put
on them. Councilman Harris agreed with Councilman Shez'idan on his suggestion.
Councilman Sheridan said that Mr. Filister has never �����ared before the Council
when h� was not in a hurry, and wanted to bypass �c�:�e legal requirement to
speeil things up.
Councilman Samuelson asked if all the parcEls will havQ �ublic access. The
City Engineer said yes, when the street goes through. ,

mission waive the reading of the public hearing notice for the Preliminaxy
Development Plan (PD #68-10). Upon a voice vote, all voti.ng aye, the

Mr. Dumphy and Mr. Solveson were present. Copies of "Submission
' of Preliminary Development Plan" were distributed to the Commission.
Drawings of the plans, Scheme 1 and Scheme 2 were exhibited for the Com-

Mr. Solveson eacplained that since the last meeting with the people
in the sudience, they have redesigned the building, two parcels in the
corner are now included in the project, and made two complete studies.

For both Scheme 1 and 2, the buildings basically are the sa�e shape. 1'�ey still
have the same number of units and parking stal�s. The house on Lots 32 and 33
will remain as it is. There will be an evergreen planting along the West and
1Vorth, and possibly an underground parking ramp. There will be a twelve unit
module interconnected with a staiYway breaking up the complex, and a swi.�ing
pool. The City has been given a 24 foot easement along East River Road. Z'here
�.:� d 35 foot setbaCk on the East and 60 feet on the North and 85 feet un the
South .
Scheme 1 is for a 12 unit building, interior pool area, fixewalls separting
tta� modules, 24 two bedroom units and 84 one bedroom unit.
Under Scheme 2, the buildings are much the same shape, but they are further
away from the house situated on Lots 32 and 33. Some of the parking is to be
underground if possible, the xecreation area is outside and includes a patio
area. The setbacks are 35 feet on the E.�s� and 70 fe�t from„the creek. These
buildings would have 36 two bedroom uni.ts and 72,ane b�droom unit. �'he�elevation
is basically the same.
Mr. Myhra said he recalled there was something in thr�. ord��►�i��,�u^^e��rri,ng
to a change of plar4s, and he wondered if the firs�t p7.� h�d, any, bea�� �e►n Lhe
one presented this evening. Th:e consensus was the �irst plan had �ra �re��ng on
the new one.
Chairnian Erickson asked if the Engineering Assistant had checked into the
use of the axea en the Northeast corner. Darrel Clark said that it ctuld ba
used for parking, but he wasn't sure about the area occupied b�y the l�o�se.
Under the PD ordinance, thexe is no specific are� xequire�ments.
� The follawing people fram the area, Jerry Po�t�s, 8066 Ruth Street, William
Forster, 298 Ely Street and William Young, 8121 aZuth Circle we•re present and
expressed concern about the buffer of trees slong Ruth Street suggesting goplar
and evergreens, and questioned the garbage disposal, traffic patterns, paxking,
' cammercial area and proposed bridge on East side of shopping center. They also
wanted to know of the controls the City had aver the plans. Chairman Erfckson
read that part of the PD Ordinance which referred to the controls the City had
' over the details of the final plan, and what was required at the preliminary
stage.

It was e�cplained to the audience that at the previous hearings, there was
a traffic study by Bather � Associates. Their opinion was the traffic on East
River Road was not heavy enough to warrant signals at this location until a
later date when a traffic pattern could be studied. The Planning Couunission did
take same action in that they asked East River Road be widened to provide for
right and left turn lanes at the entrance of the conmiercial area. This was the
principle reason why an additional right of way had to be pravided by the
developer. Chairman Frickson said the Planning Coa�ission would be very much
opposed having another exit on East River Road, mainly because of the problem
of elevation. There is a difference in elevation between the road and the com-
plex of about 15 feet -- a drop from the complex to the creek.
Regarding parking, Mr. Solveson said the parking was figured at 1.$ stalls,
or lla2 parking stalls. The Coumission felt underground parking would be the�
answer fox either Plan and asked Mr. Solveson to try to incorporate this in �the

building by the creek. The Planning Commission asked MY. Solveson to try for
two stalls per unit.
In regaxd to the exit on Ruth Street, Mr. Solveson said it was a require:ment
to have two exits from the area.
The suggestion was made to use evergreens, poplars, aad a redwood fence for
buffer between the house on Lots 32 and 33 and the camplex. Mr. Dumphy said they
may sell the house because, at the present time, it is rented, b�t it would be
better to have the owner live in it.
Mr. Dumphy said the conmiercial area was the same as before. The building
will have two floors. The entrance to the East would be pri.marily used by the
people from that area. A bridge could be built across the creek, a�d a foot-
path leading to the residential area. This path wauld be adjacent fia the lot
of Mr. Potts who eaid the people cross his backyard now.
Regarding the procedure for the preli.minaay developmet�t plaria, th+a a�t�ti�ce
were told that, at this time, a11 the Planning Co�nission had ta cansider was
the averall plan. Upon the approval of the Planning Cvsr�n3.ssion, the plan would
go to the Counciland another public hearing would be held. When the`pzeliminary
plan goes before the Council, it becomes a final p1a� upon its approval. The
small details pertaining to the buildings, landscaping, sid�walk and traffic
problems will be handled by the Building Standards-Design Control Subcarmittee
and if a variance �rould be needed,�-the Board of Appeals. A1Z work wi�l be aone
in accordance to the PD Ordinance under the directions of the departments
affected. Whatever permits are given by the Building Standards-Design Control
Subcoum�ittee will be after a public hearing is h�ld. The public hearinga of the
Subcono�ittees will be the final public hearings for the project.
Chairman Erickson added that, as far as he was concerned, he was about ready
to vote with a couple of additional suggestions. 1) Ztore specific detail on
screening and planting of trees giving species and size.2)Statement of intent and
guarantee to protect present foli�ge along creek route. 3) Provision made for
future parking either at the time of the approval of the preli,minary plan or a
guarsntee they would add additional parking. 4) He liked Scheme 1 with Scheme 2
parking incorporating underground parking. This would necessitate soil tests
and grade plans with specific proposed elevations throughout.
The parking lot facing Ruth Street could be depressed with a raised exit as
you drive out. Mx. Solveson asked if the exterior of the buildings, being stucco
and brick, met with their approval, and was told it appears to be what was asked
for.
MOTION by Myhra, seconded by Mittelstadt, that the Plaiming Comaission
continue the public hearing to November 5, 1969 of the approval of the Preliminary
Development Plan for the Planned Development District by Howard Dumphy and the
reason for doing so was to give the petitioner a chance to move forward on sug-
gestions as outlined by the Chairman listed abave. Upon a voice vote, all voting
aye, the motion carried unaaimously.

3. VACATION REQUEST: SAV �69-09, CITY OF FRIDLEY: Vacate 33 foot Street
between 57th Place and 57th Avenue lying East of Lot 15, Block 8, and
West of Lot 1, Block 7, City View Addition.
The explanation was given that there is an agreement between the City of
Fridley and Erickson Petroleum Company to substitute the 3rd Street for the 33
foot stteet asked for in the vacation request. Erickson Petroleum owns both
sides of the 33 foot street.
The suggeated exchange of property is as follows: the 33 foot vacated
street could be used for a parking lot; they have received fxom the Sighway
Department a 57 foot strip adjacent to University Avenue and, in return,
dedic$ted a 60 foot right of way for 3rd Street. The street will be fmproved
to City standards. ,
The people in the area were notified by public hearixtg notices.

Drive, Raymond Prestemon, 1391 53rd Avenue N.E., Clarence Engebretson, 5376

The Engineering As$istant explained that the Subcomnittee decided, rather
C�an consider just one lot, that the abutting property owners should be sent
letters fpr the vacation of the full length of Johnson Street requesting their
opinions at the October 22nd Planning Co�nission meeting. The original request
wA+� for alongside Lot 1. The Subcomrnittee felt the street, inasmouch as it had
never been traveled, was of no use and could foresee no reason for it to be
opened in the future, but that the City should retain an utility easement. The

Tt1,e property owners wanted to know how much the tax would be, but that
coulda't be asiswered at this time. Mr. Engebretson was not opposed to the
vacation of the street. The answer to another question was that a building
could be put up right along the easement line. A fence could go right on the
lot line. If the whole street were vacated, and an owner did not wish to acquire
the land, he could se11 it to a neighbor.
It was suggested to Mx. Prestemon that if he were not interested in
acquiring the property for himself, he might talk to the two neighbors to the
East to see if they would be interested in enlarging their backyards.

Representing the Northern Pacific Rsilway Company were Doualas Shoemaker,
James Anderson and Jerry Masters. The request is to rezone R-1 property to M-2
for the conatruction of a portion of railroad classificatioa yard (departure
tracks aad slope excavation in this areaj.
The Ordi.mance requires 1500 feet between railroad switching yards and
residenti�l, and the Northern Pacific Railway Co. is going before the Board of
Appeals for a variance of the 1500 feet.
The Planning Camnission were shown the proposed plans for modenzizing the
railroad yard and explained in detail by Mr. Shoemaker, Anderson and Masters.

, ' The Chairman xeceived a letter from the Metropolitan Planning Coffinission
regarding a meeting to discuss public ownership of the �ain City Lines. He
felt he was not in a position to answer because he did not use the bus. A
� sugg4stion might be made to cut some of the stops, as �hey need something that
gets downtown quicker. It seems relatively few people depend upon the bus.

ZANING ORDINANCE: REVIEW OF PARKING STALI.S FOR APAR1'MENTS:
The discussion centered around the original zoning and the areas yet
to be developed. The Coue�nission felt that the present zoning ordinance require-
ment of 1.5 stalls was inadequate at this time. There was no action, but the
members were individually to do their own checking and report at the next meeting.
10. MULTIPLE IX�IELLING STUDY IN THE CITY OF FRIDLEY:
The Engineering Department compiled a booklet on Apartment Study in
Fridley in relation to the tax structure and school tax. The fact was discussed
that some of the income tax money is returned to Fridley as State Aid, and the
Commission felt this should be explained s�znd ��� �.n tt►� report as this would
more accurately reflect the tax load. No action, as the study was not completed.

Mr. Harris felt that although the applicant has the concurrance of his

Mr. Minish felt that that a hardship had not been shown as a single garage
could be built in the same location without asking for a variance, and a
double garage could be built in the back yard as there was no difficult
terrain to deal with. He also stated he knew that a single garage was not
as desirable as a double garage but since the applicant could stay within
the limits of the City Code b.y building a single garage that a hardship was
not shown.
Mr. 0'Bannon was in favor of the variance as the applicant prefers a
double garage and the abuttir�g neighbor does not object and there were no
other people present that objected. He also felt that a single garage
was just about useless and that a double garage would increase the value
of this house and also increase the valu� of the neighborhood.
Chairman Mittelstadt was in favor of the variance i.f the applicant would
agree to sheetrocking the far end wall along witYi the ceiling and the
common wall.

Mr. K1ein explained he could not build the garage in the backyard because
of the slope of the land.
Chairman Mittelstadt asked the Building Official if the Building
Inspection Department had gone out and measured the distance between the
present structures. The Building Official stated that they had measured
29 feet between structures. He also said that Mr. Klein had started
building the garag�e.
Mr. Klein told the Board that he was under the impression he could st�,rt
building as he felt he had, in a way, applied for a building permit by
applyx�g for a variance. He also said the Building Inspector had inspected
the footings, -

MINUTES OF THE REGULAR MEETING OF SEPTEMBER 22, 1969
MOTION to accept the Minutes of the Regular Meeting of September 22, 1969.

HOCKEY ASSOCIATION AGREEI�ENT
The revised Hockey Association Agreement was signed by Member Blair,
President, Hockey A'ssociation of Fridley; Chairman Fitzpatrick; and
Paul Brown, Director.
MOTION by Stimmler, seconded by Cochran, to accept the signing of
the Agreement. The Motion Carried.
ORDINANCE ON PROHIBITING VEHICLES ON PARK LAND
The Commission discussed the memorandum sent to the City Attorney from
the Director in which the Commission requests an Ordinance prohibiting
the use of motorized vehicles within the boundaries of the City park
areas. �
CONCESSION STAND POLICY
The Commission reviewed the policy on concession stands within the City
that are located on park property. The Commission members requested
that the Director write a letter to the concessionaire at the Moore Lake
Beach House and ask what his schedule will be this coming winter. The
Director noted the license for the concession stand would terminate in
April, 1970.
1970 BUDGET ADOPTED BY CITY COUNCIL
The adopted budget will not be ready for two weeks. Chairman Fitzpatrick
suggested a special meeting be set up on November 10, 1969, specifically
to discuss the 1970 budget. This was agreed upon, providing the budget
comes through by that date.
PUBLIC RELATIONS AUTHORITY
The Commission discussed and reviewed the need for better Public Relations
coverage of our Parks and Recreation Department and to better inform
the general public of our many programs and accomplishments during the
year. Vice-chairman Cochran stated that we owe it to the public to let
them know what is available in our City parks. It was noted that our
Director's weekly column in the Fridley Sun Newspaper;did cover our
Department, in genaral, but there should be special coverage on what
our parks can specifically offer the public. .

improvements o� public utilities and streets.
BE IT FURTHER RESOLVED, that if the Administration is not
able to acquire said easements and right ot ways upon terms agreeable
to the City Council, that the City Attorney is hereby authorized to
commence condemnation action in the anoka District Court for the
above described easement.

� NOW, THEREFORE, BE IT RESOI,VED, by the City Council of the City
of Fridley, Anoka County, Minnesota, as follows:
Z. That the streets marked black on tt2e attached map be seal
coated, and the wo�k involved in said Improvement shall here-
after be designated as:

2. The plans and spec�fications prepared by the City Engineer for
such improvement and each of them, pursuant to the Councfl
action heretofore, a copy of which plans and specifications
are hereto attached and made a part hereof, are hereby approved
and shall be filed ��ith the City Clerk.
3. The work to be perf.ormed un3er STREET II�?FROVEriENT. °ROJECT
ST. 1969-10 shall be periormed under one contract. '
Th� City Manager shall accordingly prepare and cause to be inserted
in the official newspaper advertisements for bids z�pon the making of such
improveMents under such approved pl�.ns and specifications. The advertise=
ment shall. be published for two (2) weeks (at least 10 days), and shall
specify the work to be done and will state that rids wi:.l be opened
at 11•30 A.M. on Wednesday, the 26th day of November, 1969 in the
Council Chambers of the City Hall, and that na bids wil.l be considered
unless sealed and filed with the City Clerk, and acco:t�.panied by a cash
deposir, bid bond, or certified check payable to the �i.ty for five per '
cent (5%) of the amount of such bid. That the advertisement for bids Por
STREET IMPROVEMENT PROJECT ST. 1969-10 shall be substantially in form as
that noted in Exhibit "B" attached hereto for refererice and made a part
hereof .

WHEREAS, Osborne Road (County Road �8} borders the
southern boundary of Spring Lake Park; and

WHEREA�, the Woodcrest Elementary School and the Prince
of Peace Parochial Scho�l a•re located on Osborne Road; and
WiiE�tF.AS, Unity Hos�ital and Fridley Medical Center are
also located along Osborne Road; ,
hTOW, THERFFORE, �3E IT RESOLVED:
1. That the Village Council go on record as being �
ogpo�ed to the action of the Anoka County �3oard of Comr�zssioners
in incr�asing the speed limit on Osborne Road from 30 miles
per hour to �+0 miles per hour
2. That the Spring Lalte Park Counci.l requested
th�.t immediate action be taken to reset the speed limit
to 30 miles per hour �
3. That yellow pedestrian flashers be placed on
�sborne Road at or near the Able Street (entrtt.nce of
Woodcrest School) and at i��onroe (near the Prince of Peace
School).
Be i.t further resolved that the Spri.ng Lake Park
Vi2lage Counci2 go on record as being opposed to any
changes of speed regulations on Spring Lake Park streets
without the Council being consulted.
The fore�oing resolution was mr�ved by Mayor Holz, and seconded
by Councilman McCarron. .

Fridley City Council on September 8, 1969, we have
arranqed far the preparation of a final plat.
Attached are two hard shell copies and three tracings
of the plat comprising Pages 1 and 2.
You will note that Page 1 of the glat has no�a been
signed by the Surveyor, Great Narthern Railway Company,
ancl First National City Bank.
As the plat nlust be signed by th� City, will you please
arrange for �Ir. 33runsell's signature and also place
your sa.gnature in the space provicled. As the plat ��as
approved by the City Council on September_ 8, 1969, that

By separate instrument the Railway Company �vill dedicate
Outl�ot "A° to the City for street purposes.
As �h�-City Council approved the plat on the basis that
Lot 1, �loc}: 3, ��aould be �dedicated to the City arid an
easement for water line purposes be grantec� to it over
Outlot "I", v�e are plcased to advise that the proposal
has the approval of the Railway Company.
Lot l, I31ock 3, wi11 be dedicated to the City for ex-
clusively public purposes. It is understood that the
City will permit the Railway Company to construct, main-
tain and reconstruct a sign on saz.d Lot in a manner as
it sees fi� in cooperation with the City. The City is
to maa.ntain th� property at its expense.
A water main easement will be granted to the City for
' exclusively public purposes over Outlot "I" from the
southerl.y boundary of Outlot "A" to the northerly bound-
ary of Lot I. , BI.ock 3.

' Through a recent action oP the Minnesota State Highway Department� the
speed limit on Osborne Road was 3ncf°eased from thirty miles an hour to forty
miles. Because Osborne Road rnust be used by our children as they xalk to the
' Woodcrest Elementary Sehool, we must indicate ov.r de�p�es� disapproval of this
increase in the speed limit.
May w�e most sincerely urge ihe Fridley City Council to join in a cooperative
effort xith the Spring Lake P�rk Village Council and Anvka County to impress
upon the State Highw�y Department their folltp in increasing the speed lizait i.n
an area which we still consider to be primarily residential, contrary to opinion.
Whatever influer�ce you can use to cause the speed limit to be lowered, to
have pedestrian crossways painted on all streets leading to Osborne Road near
the Woodcrest School, and to have a caution light in�tallecl near the school.
