Dropps represented him at the meeti.ng. The Chairman brought the proceedings up to date no�i�ag the public hearing ' was cloped on July 9, �969 and the last meetit�g was Aug�ust 6, 1969. The unsolved problema were the North�South road and the East�West ro�d., whether or not access would be on East River Road or Riverview Terrace. Mr. Swanson had been called , regardi,ng tabling of his petition and he had x�ot ob�ected. Because of the number of people prese.nt, the Plan.ning Commissio.n had no objection� to re-opex�ing the discussio.n at this time. , i ' ' ' ' ' Mr. Dropps said that Mr. Nielsen. had agreed to dedicate his 25 feet on the East side of his lot, and Mr. Swanson had a verbal agreement with Mr. Novak to work out other easements. Mr. Nielse.n, owner of Lot 31, asked that if by dedicating 25 feet, this would leave him with a lot too small to be built on. Hi$ lot was approximately 80'x227' with the house being on the East side. He would be left with about 202', and taking 102' for the lot with the house, the secon� lot �rould be 100'. The solution would then be to go to the Board of Appeais a.nd a�k �o�c a waiver of the lot size from 9,000 square feet to closer to 8,000 squaxe feet. Evelyn Goldman, 3518 Madiso.n Place: Mr. Nielsen does not have a road, but �n easeme.nt for accesg, and the school takes caxe of it. It would permit trucks getting in and out of the area without going throuhh the residential. streets and this would be a safety factor. The school board i.nd.icated a willingriess to dedicate for a road going ' Ea.st�West, but they objected to a cul de sac as it would interfere with the playground„ ' Mr. Nielsen wondered if a less expensive blackto�ped road could be built, probably be a dead end, or go out to East River Road. He was told the City would object to a dead end because o£ the difiicult.y of plowing. ' It was felt that the schoolboard could control the truck a,nd bus traffic on the road if it went through to Riverview Terracee ' Mrs. Ho Dickinson, 7175 Riverview Terrace: We are against the road con- necting to Riverview Terrace. You would be bringing all these trucks in on the sharp turn on Riverview Terrace wizere all tYie children play around Logan Pask. ' We have been against it from the very beginning. The�e �hould be only a walk- way up the proposed street and fe.nce the walkway from Riverview Terrace to the schoolgrounds. Then the street should go out to Ea.st River Road. ' , ' � Mr. Benedict Novak said that he would just as soon see the street go out to East River Road. Jensen said that the City has been criticized by the County and by private individuals about safety on East River Road. It is a County road and not particularl.y safe one because of the volume of traffic. There are a great number of intersections. The City has had under consideration, without speci- fically adopting it, a plan for reducing the number of intersections along East River Road from end to end. This is not only one more intersection, but happens to be a dangerous one because of the curva on East River Road. Mr. Sangster said this is the same inconsistency as in Stevenson School. There are many single dwelling lots facin� Fast River Road. He did not feel they are making a problem to pass along if the road goes out to East River Road, Further, he did not think this is a dangerous intersection if it is properly signalized. The School purchased three lots to change the entrance to Riverwood School. Mr. Jensen said it was the traffic coming on East River Road which is the problem. Mr. Novak said he had not. agreed t� having his land divided into three II ' parcels. If Mr. Swanson wanted to buy it, all right, but otherwise he would keep it for himself. He was in favor of the road going East. r � A d II ' ' ' ' �J Planning Commissio.n Meeting - October 8,1969 PaFe ; Mr. Dropps asked that the Planning Commission make a decision this eve.ning either £or or against the petition. MOTION by Mittelstadt, seconded by Fitzpatrick, that the Planning Commis- sion re-study the secondary plan and return the request to the Plats & Subdivi- sions-Streets & Utilities Subcommittee with the possibility of gettin$ access on Ea,st River Road. ' The Commission decided there were no new factors as Mre Swanson does not own the property, and the request has been made to reach a decision this evening, Mr. Mittelstadt withdrew the motion and MrW Fitzpatrick the second. THE MOTION FAILID. MOTION by Jensen, seco.nded by Mitteletadt, that the Plannixbg Commission recommend approval of the platting requests, P.S. #69-019 and P.S. #69-�7, Brentwood Estates (Revised� be�,ng the rear 43106 feet of Lot 35 and rear 401.9 feet of Lot 33, Revised Auditor's Subdivi.sion #77 (P.S. #69-01� and that part of Lot 34, Revised Auditor's Subdivision #77 that lies Ea.st of East li.ne of Block 1, Mississippi View Addition (P.S. �69-07� with the recommendation that street access be provided to Riverview Terrace including t21e recommendation of the Subcommittee as followa: (Feb. 6. 1969) approve with the siipulatio.n that a 20 foot utility easement be provided from the cul de sac to East River Road. IIpon a voice vote, all voting aye, except Mittelstadt who voted nay, the motion caxried. The Coffimission felt the Northwest corner of the North�South road ahould �e eurved (cu1 de sac, rather than a square corner for safety reasona. PUBLIC HEARING: PROPOSED PRELIMINARY PLAT: P.S. 4�69-11, ANDERSON DEVELOP- MENT BY ANDERSON TRUCKING SERVICE, INC.: Northerly 750 feet of Easterly 720 feet of the Northeast quarter of the Northeast quarter of Section 12. The notice of hearing was read by Chairman Erickson. Mr. Richard A. Rennie and Mr. Kenneth Elliason, representing Anderson Trucking Service, were present. The Engineering Assistant distributed maps of the. proposed preliminary plat to the Commission. � Mr. Elliason said the County Engineer wants to drop the grade some and use the storm drain going down Old Central to take the water away from the County right of way. Other than that, the plans remain the same as discussed at the Planning Commission meeting of October 22, 1969. Mr. Jensen said that the comments of the Subcommittee are generally in regard to the'apparent need for the sanitary sewer easement to be provided on the South line of Lots 1, 2 and 3 of the proposed plat to provide sewer service for these lots. He verified the fact that the dash lines on the proposed plat indicate the required setbacks. Inasmuch as a building is to be set far back, and the North portion abuts Spring Lake Park, it is to the developer's best_interest to provide sewer along this East/West line, otherwise they found no general fault with the ___ layout of this plan. It was noted there is no sanitary sewer on Osborne Road. Also, on Page 2 of the Plats & Subdivisions-Streets & Utilities Subcommittee minutes of October 1, 1969, the first sentence of the second paragraph, there was an omission which made the sentence ambiguous. The correct wording should be "---- it was pointed out that the structures on the South side of Osborne Road are serviced by water only". The Engineering Assistant reported that Mr. Astleford called him, and voiced no opinion about the platting. � MOTION by Mittelstadt, seconded by Jensen, that the Planning Commission close the public hearing of the proposed preliminary plat, P.S. ��69-11, Anderson Develop- ment by Anderson Trucking Service, Inc., of the Northerly 750 feet of the Easterly 720 feet of the Northeast Quarter of the Northeast Quarter of Section 12. Upon a voice vote, all voting aye, the motion carried unanimously. MOTION by Jensen, seconded by Mittelstadt, that the Planning Commission recom- mend approval of the proposed preliminary plat, P.S. 4�69-11, Anderson Development, by Anderson Trucking Service, Inc., of the Northerly 750 feet of the Easterly 720 feet of the Northeast Quarter of the Northeast Quarter of Section 12, concurring with the following comments of the Plats & Subdivisions-Streets & Utilities Subcom- mittee as shown on the drawing entitled "Anderson Development", revised edition of October l, 1969 with the further recommendation that the final plat show proper sanitary sewer easement along the East/West line of the plat, approximately 250 feet South of the Northern boundary, and include appropriate utility easements as determined by the Engineering Department. L 3. VACATION REQUEST: SAV ��69-09, CITY OF FRIDLEY: Vacate 33 foot Street between 57th Place and 57th Avenue lying East of Lot 15, Block 8, and West of Lot 1, Block 7, City View Addition. The explanation was given that there is an agreement between the City of Fridley and Erickson Fetroleum Company to substitute the 3xd Street for the 33 foot street asked for in the vacation request. Erickson Petroleum owns both sides of the 33 foot street. � The suggested exchange of proper�y i_s a� follows: the 33 foot vacated street could be used for a parking lot; they have received fxom the Highway Department a 57 £oot strip adjacent to University Avenue and, in return, � dedicated a 60 foot right of way for 3rd Streeto �'he street will be improved to City standaxds. The people in the area were notified by public hearing notices. , � ' , � , I MOTION by Mittelstadt, seconded by Myhra, that the Planning Commission approve the request, 5AV ��69-08, City of Fridley, for the vacation of the South 18 feet of 57th Place lying East of a line extended North that is 20 feet East of the West line of Lot 7, I31ock 7, City View Addition and West of the line that is 57.5 feet West of centerline of Southbound lane of T.H. ��47 and the request, SAV ��69-09, City of Fridley, for the vacation of a 33 foot stxeet between 57th Place and 57th Avenue lying East of Lot 15, Block 8, and West of Lot 1, Block 7, City View Addition with the stipulations as foll.ows: SAV ��69-08: 1)reduction of the 18 feet vacation right of way to 16 feet leaving the City with a 50 foot right of way; 2)consideration of the fact that we have a street without a turn axound; 3) that the remainder of the street not being used could present a maintenance problern; 4) unless properly graded, there could be a drainage problem; 5) that the,City retain the utility easements in the vacated portion: SAV ��69-09: Reconanend the City retain all the appropriate utility easements; according to the stipulations as passed by the Plats & Sub- divisions-Streets & Utilities Subcommittee in their minutes of October 15, 1969. CONTINUED VACATION REQUEST: SAV ��69-10, THOMAS ALBFRS: Vacate Johnson Street on the West line of Lot 1, Block 2, Swanstrom's Court. Mr. Albers was present. Also present were R. C. Staats, 5368 Matterhorn ' Drive, Raymond Prestemon, 1391 53rd Avenue N.E., Clarence Engebretson, 5376 Matterhorn Drive, and Robert Oulicky, 5332 Matterhorn Drive. �� � The Engineering Assistant explained that the Subcommittee decided, rather than consider just one lot, that the abutting property owners should be sent letters for the vacation of the full length 'of Johnson Street requesting their opinions at the October 22nd Planning Commission meeting. The original request was for alongside Lot l. The Subcommittee felt the street, inasmuch as it had never been traveled, was of no use and could foresee no reason for it to be opened in the future, but that the City should retain an utility easement. Mr. Engebretson was not opposed to the vacation of the street. The answer to another question was that a building could be put up right along the easement line. A fence could go right on the , lot line, If the whole street were vacated, and an owner did not wish to acquire the land, he could sell it to a neighbor. It was suggested to Mr. Prestemon that if he were not interested in acquiring the property for himself, he might talk to the two neighbors to the East to see if they would be interested in enlarging their backyards. REZONING REQUEST, ZOA ��69-11, NORTHERN PACIFIC RAILWAY COI�ANY: That portion between 40th and 41st Avenues N.E. and in the vicinity of Grand and California Streets - approximately 2,19 acxes -- to be rezoned from R-1 to M-2 (heavy industrial). Representing the Northern Pacific Railway Company were Douglas Shoemaker, James Anderson and Jexry Masters. The request is Co rezone R-1 property to M-2 for the construction of a portion of railroad classification yard (departure tracks and slope excavation in this area). The Ordinance requires 1500 feet between railroad switching yards and residential, and the Northern Pacific Railway Co. is going before the Board of Appeals for a variance of the 1500 feet. The Planning Commission were shown the.proposed plans for modernizing the railroad yard and explained in detail by Mr. Shoemaker, Anderson and Masters. MOTION by Myhra, seconded by Mittelstadt, that the Planning Commission set a public hearing date of November 19, 1969 for the rezoning request, ZOA � ��69-11, Northexn Pacific Railway Company, that portion between 40th and 41st Avenues Northeast and in the vicinity of Grand and California Streets, approxi- mately 2.19 acres from R-1, single family residence to M-2, heavy industrial.
