THE MINUTES OF THE REGULAR COUNCIL MEETING OF NOVEMBER 3, 1969
Mayor Kirkham called the Regular Council Meeting of November 3, 1969 to
order at 7:43 P.M.
PLEDGE OF ALLEGIANCE:
Mayor Kirkham requested ihe audience to }oin the Council in saying the

INVOCATION:
Reverend Bergren, Redeemer Lutheran Church, offered the Invocation.

Mayor Kirkham presented Mr. Dona2d Batterson with a Certificate of Appre-
ciation for his service on tfie Plats and Subdivisions � Stree�s and Utilities
Subcommittee, with the Council�s "Thank You".
Miss Kristie Siverts, an excha�ge student back from Bangalore, India
presented Mayor Kirkham with a plaque from the Mayor of Bangalore which she
stated represented a typical example of the craftmanship of Bangalore. This
was an exchange present for the introductory certiiicate Miss Siverts took
to Bangalore from the Mayor of Fridley.
APPROVAL OF MINUTES OF THE REGULAR COUNCIL MEETING OF OCTOBER 20, 1969:
MOTION by Councilman Samuelson to adopt the Minutes of the Regular Council
Meeting of October 20, 1969. Seconded by Councilman Liebl. Upon a voice
vote, all voting aye, Mayor Kirkham declared the motion carried unanimously.
ADOPTION OF AGENDA:
Mayor Kirkham stated that there were some changes to be made in the Agenda
as follows:

Miss Holmquist explained that she was here tonight as she is part of the
Junior Achievement program. The Junior Achievement program is set up so the
high school students will learn about business by running corporations on a
small scale. In this way, they gain experience by actual participation,
In the fall stock is sold to get the capital to operate during the year, Then
the product is manufactured and sold and the money returned to the stock
holders with any profit there may be. She is part of the company called
Dayton's Party Company which will manufacture a type of party food. Mayor
Kirkham has already bought shares and there are only five left and she would
like to sell them to the remaining Cvuncilmen. She ielt that this would
be good publicity for her company, 5he thEn gave them an o�portunity to buy
the stock at $1.00 a share, and each Councilman baught a share along with
the Finance Director,
HERMAN K[JBOW, 6654 EAST RIVER ROAD
Mr. Kubow said that his well has gone dry and Iie investigated haoking up and
found that he would have to tunnel under East River Road as the water line
runs on the east side of East River Road. At this time he would also have
to pay a large sum for a sewer connection, although he has no lateral, hooks
directly into a main, and has been hooked up far about 12 years. He said
that it would cost him about $500 to tunnel under the East River Road, however,
if there was a line on the east side, it would only cost about $100.
The City Engineer said that Mr. Kubo►a quoted a price of approximately $350
to tunnel under East River Road to the east side for the wa�er connection.
There are about 4 existing homes on the east side which eventually need City
water. This man needs water immediately as his well is dry. He suggested
jetting under the road and hooking on himself as fie works for a plumber, He
has not been assessed for se�ex and water laterals before. He feels that
he should not have to pay this assessment. The Finance Director added that
the property does have a charge if there is no lateral, then the charge would
be the same as if there was a lateral. The sewer connection was made some
years ago without a sewer charge.
Mr. Kubow said that he understood that if he did the work himself, there would
be no lateral charge. He asked if the Ci;ty was exempt from the law that
states that after a debt is 7 yeaxs old, it cannot be claimed. He said that
the sewer is only 4' deep wliich is an illegal depth.
Councilman Sheridan said that there is a sewer there, he does have service
and the City is entitled to levy' an assessment. Mayor Kirkham read the
agreement aloud that Mr, Kubow had signed under protest. Mr, Kubow said
that his protest is with the approximately $900 since the sewer has been in
for some years, Councilman Samuelson said that he has been receiving, and
will receive benefits from the sewer line and from the pumps, reservoirs,
etc. The City Attorney said that he was not sure what the protest was, but
that Mr. Kubow would be assessed in the same manner as everyone else in a
similar circumstance. If the objection is tc the amount, this would have
to be settled in couxt, where it may be either upheld, abated, or taken off.

Mr. Kubow said that he has come into City Hall many times with this problem
and the City �ngineer told him that if he were to do the work himself, he
would still have to pay a lateral assessment. Mayor Kirkham told him that
the Finance Director has told him that some costs would be credited to him.
If the assessment is contested, the court will make the determination. He
asked if he wanted to wait until it is settled. Mr. Kubow said that he has
already started and has signed the agreement under protest. Mayor Kia°kham
said that he has done everything possible at this time then and he could go
ahead with the physical connection,
BRUCE HAY, VILLAGE OF HILLTOP
Mr. Bruce Hay, from the Village of Hilltop said that he was asked by the
Village Council to come before the Fr�dley Council and ask for fire pro-
tection at a rate of $3500 per year for a five year term.
MOTION by Councilman Samuelson to receive the communication requesting the
fire protection dated November 3, 1969. Seconded by Councilman Harris.
Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried
unanimously.
Mayor Kirkham told Mr. Hay that the Fridley Council will take this matter
under advisement.
ORDINANCE #439 - AN ORDINANCE UNDER SECTION 12.07 OF THE CITY CHARTER TO
VACATE STREETS AND ALLEYS AIVD TO AMEND APPENDIX C OF THE CITY CODE:
(Country Kitchen Restaurant)
MOTION by Councilman Harris to adopt Ordinance #439 on second reading,
waive the reading, and order publication held up until receipt of the ease-
ments necessary by the City. Seconded by Councilman Samuelson. Upon a
roll call vote, Liebl, Harris, Samuelson, Sheridan and Kirkham voting aye,
Mayor Kirkham declared the motion carried unanimously.
ORDINANCE #440 - AN ORDINANCE UNDER SECTION 12.07 OF THE CITY CHARTER TO
VACATE STREETS AND ALLEYS AND TO AMEND APPENDIX C OF THE CITY CODE:

MOTION by Councilman Sheridan to adopt Ordinance #440 on second reading,
waive the reading, and arder publication held until the easements are
received by the City. Seconded by Councilman Samuelson. Upon a roll call
vote, Samuelson, Sheridan, Kirkham, Liebl and Harris voting aye, Mayor
Kirkham declared the motion carried unanimously.
ORDINANCE #441 - AN ORDINANCE AMENDING AND RECODIFYING CHAPTER 45 OF THE
FRIALEY CITY CODE KNOWN AS THE ZONING ORDINANCE:
The City Engineer presented maps showing the areas of C-2 and other
commercial areas left undeveloped within the City. He said that there are
only a very few lots and open areas that are not the 25,000 square feet
called for in the amended zoning ordinance. The amended ordinance calls
for 200 feet of frontage and 25,000 squar� footage within the C-2 and other
commercial zoning districts. This ordinance presented tonight incorporates
these changes. The lot and setback requirements are found in Section 45.103.

RESOLUTION #194-1969 - RESOLUTION ORDERING IMPROVEMENT AND FINAL PLANS
AND SPECIFICATIONS AND ESTIMATES OF THE COSTS THEREOF: STREET IMPROVE-
MENT PROJECT ST. 1970-4:
MOTION by Councilman Harris to adopt Resolution #194-1969. Seconded by
Councilman Liebl. Upon a voice vote, Liebl, Harris, Sheridan�and Kirkham
voting aye, Samuelson voting nay, Mayor Kirkham declared the motion carried.
DISCUSSION REGARDING TWO HOUR PARKING LIMIT ON FIRESIDE DRIVE:
The City Engineer pointed out that the Chief of Police has reviewed this
and checked with the owner of the trailer court. The memorandum from him
on Page 33 of the Agenda indicates that the general feeling of the people is
that they want it as it is now.
MOTION by Councilman Harris to receive the commc�ni�ation from the people
on Fireside Drive dated October 17, 1969 and the memorandum frorn the Chief
of Police dated October 29, 1969 and concur with the City Enganeer and the
Chief of Police. Seconded by Councilman Samuelson. Upon a voice vote, a11
voting aye, Mayor Kirkham declared the motion carried unanimously.
CONSIDERATION OF HUMAN RELATIONS QUESTIONNAIRE:
' The Finance Director stated that there was about $100 in the budget tha�
could be used for the mailing out of the quesiionnaire. Councilman Samuelson
commented that going by the sample costs, this would leave them about $275
' short. Councilman Harris suggested that it be sen� aut with the meter reading
cards. The cards could be in an envelope along with the r�uestionnaire. The
Finance Director said that this would take some time as the water billing is
, done by districts, and there are about 5800 water users. Councilman Sheridan
said that it seemed to him that it would cost less to us� a separate mailing.
The letters would not have to be stuffed, just folded and a label attached,
and the bulk mailing rate used. Councilman Sheridan said that the cost of
' the wages could be eliminated by using organizations to do the work. The
League of Women Voters he thought would be willing to help with this cause.
A Representative of the Human Relations said that the committee would also
' be willing.to help with the mailing. Mayor Kirkham asked what would be done
with the replies. The Representative said that the findings would be inter-
preted and a determination would be made on what is the most needed in this
' community. Mayor Kirkham said that he would like to think that the City of
Fridley has the welcome mat out to anyone who wishes to move into the City,
regardless of race. He felt that it would be almost impossible to answer
some of the questions with a definite yes or no. He wondered if this would
' not stir up a lot of heated comments. The Representative said that their
committee is trying to estab2ish a program and without any specifics it is
hard to relate their work. He said granted the questionnaire could be
' interpreted many ways. Councilman Sheridan said that he would agree with
Mayor Kirkham, and that there is too much reference. to "Negro" and should be
changed to "minority". The Representative said that it is subject to revision.
' He pointed out that if a questionnaire is made too nebulous, you do not get
a clear cut answer. If a citizen cared to qualify an answer, they are wel-
come to do so. Councilmen Harris and Samuelson agreed that a definite
answer yes or no would be difficult. Mayor Kirkham said that he would like
' to see it reworked before sending it out. He said that he would like to
meet with the committee at their next meeting. As it is now he would have to

vote against it. He said that he could see this type of questionnaire
fostering racism and bigotry. He said that he has entertained other races
in his home and he had a feeling thai they would agxee with him. Council-
man Liebl agreed also that the questionnaire should include all minorities.
He said that he did not see that this type of questionnaire would stir up
any racism.
A Representative of the League of Women Voters said that as they looked at
the questionnaire, they had much the same feeling as the concensus of the
Council. They felt that there should be more ro;nm for comments, and that
there should be a cover letter go out with it telling what the Human
Relations intends doing with the information. She also felt that there
should not be any signatures requested.
Mrs. Richard Pratt, 811 Rice Creek Terrace, said that th� churches in Roseville
and New Brighton sent out this type of a questionnaire a;id she di� not think
it aroused any strong feelings. She said tha� she �aould agree that the word
"minority" should be used, and added that she under5tood thai the sch�ols
are also interested in this questionnaire.
MOTION by Councilman Harris�to table considexation of this ques�ionnaire
and bring it back after the Human Relations Committee has met again.
Seconded by Councilman Samuelson. Upon a voice vote, all voting ay-e, Mayor
Kirkham declared the motion carried unanimously.
CONSIDERATION OF REGISTERED LAND SURVEY, GEORGETOWN APARTMENT AREA, MR.
MAURICE FILISTER:
The City Attorney introducted Mx. Sam Caplan, Attorney for Mx. Filister
and said that Mr. Caplan, Mr. Filister, the City A9anager arid himself had had
a meeting some time ago regarding the registered l�nd survey and the traffic
pattern. Mr, Caplan would like to request that the registered larad survey
be considered as a separate item from the dedicati�n of the land for the
roadway.
Mr. Caplan said that Mr. Filister purchased the land as one integrated piece
of land. The financing of it made it necessary to develop and finance it
in three s�eparate phases. For the mortgage implementation it is necessary
that it be split up into three separate units. The registered land survey
was requested for this reason. The City Engineer then wanted Mr. Filister
to dedicate a street to this property. The registered land survey approval
was made contingent upon the street dedication. It is questionable whether
or not the Council's approval is necessary and it came about only because
the Attorney General has stated that a Council should act on every redes-
cription of land. A semaphore should be installed at this intersection
without any other cars coming into the intersection. He said that this is
their belief, but they are not sure, and neither is the City Engineer,
therefore his suggestion would be to have an independent study made and both
parties agree to accede to the determination of an impartial third party on
the determination of the traffic pattern. If it is found that the road is
needed and will not impair the Georgetown development in any way, they will
make the dedication. He pointed out that the City is always in a position
to condemn the land. The only question is whether they voluntarily dedicate
the land and if �he study shows that they shvuld, they are willing to do so.

Councilman Harris said that somewhere along the line it must be in writing
that Mr, Filister will agree to dedicate the land if it is found to be in
the best interest of the City. Mr. Caplan said that the question s�iould be
if the intersection can reasonably take the influx of additional traffic.
, The City Engineer said that they feel that there shauld be two signals, one
at 592 A�enue and one at the Georgetown entrance. The question should be
whether there should be two signals, or only one and where it should be
located. If it is shown that there is a need for two, there would be no
' need of the dedication. Councilman Sheridan pointed out that the City and
County have been trying to eliminate left hand turns. If the signal went
in at 592 Avenue there would have to also be some type of service road. Mr.
' Caplan said that this is what they wanted in the first place, but it cannot
be done because of the apartment houses in the way. Counci2man Sheridan
pointed out that another consideration should be how far from I. 694 the
' signalization would be. He said that speaking fox himsel£, he has always
objected to registered land surveys. There i.s no provision for any dedi-
cation of land for public use as there is in a plat.

Councilman Liebl asked if there would be any diff.icul�y �ti having the separate
owners of the different blocks in the future in getting rig�i� of way. Each
block is owned by a different mortgage company. The City Attorney asked if
this would affect more than one parcel. Mr. Caplan sai;d two, but the fee
owner is the same. The City Attorney said that if the owners}iip �•�as to be
in the hands of someone other than Mr. Filister, an agreement was made, but
Mr. Filister was no longer the fee holder of all the parcels, then t}ie
agreement would not be binding.
The City Engineer said that the signalization at the T. 694 ramp and East
River Road should be ready to go in in the middle of the next year. The
intersection of the Georgetown apartments arould not be the ideal location
because of the proximity of I. 694. There is naw a study bein� made on
East River Road from I. 694 to Rice Creek on the tx�ffic patterns by a
traffic consultant firm for the County.
The City Attorney said that the concern of Mr. Filister is that the traffic
generated may be more than the signal would be able to handle. There may be
a concentration at certain times of the day. He said that the idea of the
third party determination is not a bad idea. The movement, concentration,
and number should be factors to be weighed.
Councilman Harris said that if the Council should see fit to approve the
registered land survey, then the Administration should set forth some sort
of criteria for Mr. Filister, and he should have to live up to it, depending
on the outcome of the studies.
The City.Engineer pointed out that the Minutes of the conversation are in
the Agenda, and since that time Mr. Filister has built the garages and they
were not built according to the plans submitted. Mr, Caplan said the reason
for this-was because at the time the comment was made that the City could
always condemn, and rather than lose an expensive building, the garages were
moved on his advice. °
The City Attorney said that as Mr. Caplan has promised to abide by the
decision of an independent third party, he did not feel that an agreement

would be necessary. He said tha.t perhaps the consultant the Co�nty is using
would be adequate. Mx. Caplan said in regard to the street, lte would be
willing to sit down with the City Manager and the City Attorney, and after the
traffic study is made, the options will be evident and they will abide by
the determination.
Councilman Sheridan asked the City Attorney if he ever• got any comments
from the Registrar of Deeds concerning registered land surveys. The City
Attorney said that he had talked to the Registrar of Titles and they take
the position that they will not act on a registered land survey until the
Council passes on them. He is satisfied with this registered land survey,
but will not act until the Council does. Councilinan Sheridan said that it
has been the policy of the Council to require platting and he considered
registered land surveys as a way around dedicating land for public use.
MOTION by Councilman Harris to approve the regist�red land survey and ask
the Administration and the Filister people to agr�e u�on the guidelines for
the independent study of the area and the det�rmination of the report will
be the basis for action. Seconded by Councilm�3n Samu�l�on. Upon a roll
call vote, Liebl, Harris, Samuelson and Kirkh�rn votir�g aye, Sheridan voting
nay, Mayor Kirkham declared the motion carried.
CONSIDERATION OF REQUEST FOR DWELLING ON LOTS s, 4, AIJD 5, BLOCK 5, CITY
VIEW ADDITION:
The City Engineer explained that this is the same land that was discussed
at the last meeting when a double bungalow was contemplated. Z'his is a
120' X 140' parcel, and they would like to put a house, along with a
large garage on the land. Mr. Leslie Tranby is a roofer by trade and would
liek to have the garage to store his truck and materials in, rather than
renting a garage somewhere else. They would like to know if they will have
any trouble getting a building permit before they purchase the lats. They
would be building a large home with an attached garage with the detached
garage in the rear.
Mr. Tranby said that he planned on putting in a concrete driveway. His
truck is 1z tons. The attached garage would be to the east, and the entrance
to the detached garage would be off 57th Avenue. It would be 12' to 2' higher
than a normal garage. Councilman Harris asked if there would be any de-
liveries by semi. Mr. Tranby said perhaps four times a year there would be
shingles delivered. Councilman Samuelson commented that this would be more
like a warehouse and in that case you are talking about M-1 zoning. Mr.
Tranby said that this would be for storage only and there would be no work
done from his home. The garage is planned to be about 30' X 40'.
Mr. Carl Paulson asked if this is permissible. The City Attorney said yes,
if there is no visible signs of home accupation; it must appear as a home.
There must not be any scraps visible. Mr, Paulson wondered if there would not
be objections from the people in the area if they knew what was being con-
templated. He said that he could not see where this would be compatible
with a residential neighborhood. The City Attorney asked if he felt that
this would be less desirable than a duplex. It is zoned R-2 now. Mr. Paulson
said that he felt that this would be a downgrading situation, and would not
be good for the neighborhood. He pointed out that there are garages available

for rent for the purpose of the storage of trucks. Mayor Kirkham commented
that this was not the question, but rather if it�is allowable under the
Code. The City Attorney said that under R-2 zoning, a private garage with
one accessory building per lot is permitted. With each additional accessory
building after the first, a special use permit is required. There is no
size requirement on the accessory building,
Mr. Tranby said that on the same block there is an apartment house with a
large garage. He assured the Council that there would be no visible sign of
running of the business from the home. The City Attorney asked if it was
necessary for the garage to be that large. Mr. Tranby said that it would
be more comfortable. The house would be about 40' X 50' with a 20' X 22'
attached garage. It will be a substantial home and the plans are for a
split level. Mrs. Tranby then showed the Council a picture af the house
they plan to build.
The City Attorney asked if there was any special hurry. Mr. Tranby said
that they should know by the 15th of N�vember. The City Attorney suggested
that they could put down their earnest money contingent upon their obtaining
a building permit. Councilman Harris felt that the plans should go to the
Building Standards - Design Control for conside�ation of the ae�thetics.
Councilman Lieb1 said that by oxdinance, they must face 57Lh Flace. Mrs.
Tranby said that they had been informed of this. Councilman Liebl said that
he felt that this plan is superior to the plan for i�ie double bungalow which
would leave Lot 5 to perhaps go tax forfeit.
The City Attorney suggested tabling this item to allova time tu discuss the
plans with the Tranbys, their attorney and some of the n�ighbors. It
may be that an alternate plan, such as a large attached garage could be
agreed upon.

Mayor Kirkham commented tYiat due to the circumstances, th�re was not much
Ghoice. The Representative said that the plan is for a ranch-type of
building to conform with Bob's Produce Ranch. They plan on usir�g used brick.
Councilman Harris said that he felt that as the rear wall is readily
visible, it should have some sort of treatment to make it more aesthetically
pleasing, such as making it appear as a front of a building. A possibility
would be to use opaque glass windows, or maybe a fake door with an awning.
The Representative said that this could be done.
MOTION by Councilman Harris to approve the permit subject to giving the back
of the building a treatment to make it look like a front of a building, and
subject to acquiring easements and a landscaping plan and other natations the
Engineering Department may have. Seconded by Councilman Sheridan for discussion.
Councilman Sheridan asked what was the distance between T.H. #47 and the �
service road. The City Engineer said about 210 feet to the pavement. �
Councilman Sheridan said that then in about 210' there will be three curb
cuts. The City Engineer said yes, but there will be a median in Osborne
Road for the control of traffic. When the median goes in, then one opening
for Shell Oil will be for entrance only and one for exit only. Councilman
Sheridan said that he did not feel that the westerly exit would be necessary.
The City Engineer said that the Shell Oil people strongly felt that this cut
is necessary for the development of the gas station. The Representative

felt that this would eliminate cross-over traffic and stacking. Councilman
Sheridan said that it seems that this will create a greater hazard, and will
be similar to Red Owl on Mississippi Street and University Avenue. Council-
man Samuelson commented that this will be similar to the Western Station
across the street from Shell Oil. Councilman Sheridan pointed out that by
Ordinance a curb cut can be no nearer than 75' fxom an intersection. The
Representative said that this will be more than 75'. There followed a
lengthy discussion of the direction of traffic flow and possibilities of
control.
THE VOTE upon the motion, being a voice vote, Kirkham, Liebl, Harxis and
Sheridan voting aye, Samuelson abstaining, Mayor Kirkham declared the motion

Councilman Harris said that he felt that the special use pe.rmit should not
' be self perpetuating, but should be renewed every year. Mr. Roger Jones said
that the determining factor will be the speed at which the land develops to
a higher use. As the surrounding land develops, t}ieir land will become more
' valuable, and eventually it will become too expensive to maintain a driving
range and will. have to be developed as something else. Cauncilman Harris said
that this special use permit should be an annual permit and they would have
' to come back for approval every year. Mr. Jones said that this is a 122 acre
tract of land and has been a swamp for many years and he felt that he deserved
more than a 12 month operation. He did not t�ink that anyone could say within
12 months whethex or not it will be a profitable business and whether or
' not it will be out of place. Councilman Harris said that it would be a
simple renewal unless there were things that needed attention such as ease-
ments or assessments. Mr. Jones said that he would agree to this, but he
' would hate to operate for 12 months, and then not have his permit renewed.
Councilman Sheridan said that he agreed with r4r. Jones. The City should not
be in a position whereby it can hold his permit renewal over his head just
because maybe the City will need something from him. As the land becomes
, more valuable he will not be able to afford to keep the development as a
driving range. This would be a substantial investment. Mr. Jones agreed that
as the land closes in, the area itself will demand a change. He then showed
' a sketch of his plans, and said that he did not want to spend the money on
final plans until he knew that it would be acted favorably upon.

The City Engineer explained that the letter in the Agenda was received by
Action News. It is actually private land and not a dedicated roadway,
however, the school buses use it. The City does plow it in the winter and
blades it in the summer. Even if the City were to acquire the land, it
could not be improved until the utilities are in. Councilman Sheridan
commented that this is about a 600' to 800' stretch of road. Councilman
Harris asked how much it would cost to put in a temporary mat. The City
Engineer said for a 24' road and considering that it is clay area, about

The Finance Director reported that there were still some funds left in the
Parks and Recreation budget and they would like to blacktop the Moore Lake
Beach parking lot.
MOTION by Councilman Samuelson to approve the blacktopping of the Moore
Lake Beach Parking Lot and add it to Street Improvement Project St. 1969-1 and
St. 1969-2, by Change Order. Seconded by Councilman Liebl. Upon a voice

A. DONALD WESCOM: REQUEST RETAINING WALL TO PREVENT DANIAGE
Councilman Liebl said that he would like to see a retaining wall installed,
otherwise, there will be flooding of the street. The City Eng%.neer said
that the water is contained on the street and goes to the storm sewer. The
property on the south has a gara�e built 3 feet into the drainage easement.
He felt that there would be no problem with washouts or drainage. Mrs.
Wescom insists that a retaining wall is necessary but he said that he did not
think so. It would cost aUout $200 to $250 for the wall. If there is a
problem, it is more serious on the north side, so if a retaining wall were to
be put in, there would have to be one on the north side also. The slope
will be graded and seeded and the curbs will be �oing in later. He added
that to put in the retaining walls would be abot�t $15�0 for both sides.
Councilman Liebl said that he would still like to see the retaining wall
put in to protect the street. The City Engineer said that it can be done
if the Council wishes, naturally it would make Mrs. Wescom's yard look
nicer.

The City Attorney reported that he has talked to Mr. Hagen on several
occasions and he agrees that the primary problem is with the contractor.
When the utilities were put in, perhaps some of the settling may have come
from this. The City Attorney said that before he would reach any agreement,
he would need some further testimony. He said that there is a question of
whether there was proper investigation of the soil conditions and whether
there were proper frost footings.

PUBLIC HEARING FOR BRENTWOOD ESTATES, REVISED, F1'NAL PLAT P.S. #69-07 BY
THOMAS SWANSON:
Mayor Kirkham read the Public Hearing Notice aloud. Mro Gordon Sangster,
7169 Riverview Terrace, presented the Council with Petition #41�-1969 and read
it aloud.
PETITION #41-1969 - TO MODIFY FINAL PLAT BRENTWOOD ESTATES (P.S. #69-01) AND
FINAL PLAT BRENTWOOD ESTATES 2ND ADDITION (P.S. #69-07) TO BRING ACCESS
TO THE PROPERTY FROM EAST RIVER ROAD RATHER THAN FROM RIVERVIEW TERRACE:
MOTION by Councilman Samuelson to receive Petition #41-1969. Seconded by
Councilman Harris. Upon a voice vote, all voting aye, Mayor Kirkham declared
the motion carried. '
The City Engineer showed the area on the screen and explained that there is a
,' study of East River Road, and the px'oposal is to try to eliminate all left
hand turns except at signals. Hopefully there will be a signal at 71st Way
' for the school, which would serve the area to the north. All the property
' in this area is residential. The Planning Commission recommended approval of
the plat as shown subject to the dedication of the necessary easements. There
are eight lots in the plat core area. He explained that there are some homes
that are now being served with the private easement which have access onto
I� East River Road, and if the plat is approved, there would have to be some
kind of turn-around at the East River Road end, and they would then have
access to Riverview Terrace.

Councilman Sheridan asked how wide the existing ea.sement is. The City
Engineer said that there is 18' of private easement, but there has been some
right of way already acquired from the school and there would be about 39' of
right of way for access to the plat. Councilman Sheridan said that to honor
the petition, he would suggest that the east-west road be made one way going
east. This would help eliminate some of the traffic. The City Engineer said
that engineering--wise, this would not be the best solution, but may prove to
be an adequate compromise. If coming from the north, the cars would then
have to enter the area from the signals at 71st Way. Mayor Kirkham asked if
the school can be served from 71st Way. Mr. Sangster said not the way it is
now. It is an entrance to the school, but not to the service entrance. The
dirt road is used for service deliveries. tie said that he felt that a one
way street may be more objectionable. He did not really understand why the
objection to left hand turns as there are other parts of East River Road
which need left hand turns into private r.esic�ences. This si.tuation has
existed for many years and to improve the r�ad *.,�oul.d only make matters worse.
The City Engineer explained that the City an<1 t.:��. C���lnt1� has been trying to
eliminate all left hand turns except at signalized intersections. If the
traffic can be discouraged from using this ent-r�nce, it wauld be advisable.
East River Road has a high traffic acr.idei-�t c�unt.
Councilman Harris commented that he could not see �•�here eight residential
homes could create such a traffic hazard as Nl�•. Sazzgster tias been indicating.
Mr. Sangster pointed out that in bad weather the parents drive the cliildren
to school and the traffic gets quite heavy. Thf:re are also school ciiildren
walkinq to school. The cars use the cul�-de�->ac now as a turn•-arouncl, and he
felt sure that they would continue to do so after it is improved. Council-
man Harris said that this would seem to eliminate some of tlie traffzc if they
cannot get back onto East River Road, they would use the 71st Way signal.
Mr. Sangster said that he felt that the cul-de--sac would still be used as the
turn-around. He added that Mr. Jaznes Thuyer, D�.str�_r,t d�14 School Soard, had
wanted to come tonight, but was unable to do SG.
MOTION by Councilman Samuelson to close the Public Hearing on the plat,
Brentwood Estates Revised requested by Thomas Swanson. Seconded by Councilman
Harris. Upon a voice vote, all voting aye, Mayor Kirkham declared the
hearing closed at 7:50 P.M.
PUBLIC HEARING ON PRELIMINARY PLAT P.S. #69-11, ANDERSON DEVELOPMENT, BY
AND�RSON TRUCKING SERVICE, INC.:
Mayor Kirkham read the Public Hearing Notice aloud and the City Engineer
showed the area on the screen and explained that this is in the southwest
quadrant of Central Avenue and Osborne Road. There is light industrial
zoning, and there are five lots proposed. Anderson Development plan on using
one lot themselves. The plat meets all the requirements, and has 200' X
250' lots with the corner lot being 250' X 270'. Councilman Samuelson
asked about storm sewer. The City Engineer said that there is already a
storm sewer outlet available at Fireside Drive and when the area develops
the storm sewer would have to be extended to serve the plat. Mayor Kirkham
asked if there was any member of the audience that wished to speak, with no
response.

PUBLIC HEARING ON VACATION SAV #69-07 BY FIVE SANDS:
Mayor Kirkham read the Public Hearing Notice aloud and asked if any member
of the audience wished to be heard. A member of the audience asked what
streets there were. The City Eng�neer showed the area on the screen and pointed
out the streets to be vacated, and explained that these are stub streets and
are not necess<�ry to the plat as the development has their own internal traffic
pattern. He pointed out that the City will need some easements at the easterly
end for a turn-around until the City is successful in getting the crossing
over the railroad tracks.
MOTION by Councilman Harris to close the Public Hearing on the vacation
requested by Five Sands. Seconded by Councilman Samuelson. Upon a voice
vote, all voting aye, Mayor Kirkham declared the hearing closed at 7:59 P.M.
Mr. Dolan, representing Five Sands then arrive and Councilman Samuelson
explained the proceedings thus �ar.

Mr. Dolan formally withdrew his request for vacation of tti�� westerly street,
as they plan to include the street into their plans. This is the street
between Block 1 and Block 2 of Pearson�s lst Addition. The City Engineer
explained to Mr. Dolan that the easement is sti11 necessary for the easterly
turn-around, and Mr. Do1an agreed to make this dedication.

PUBLIC HEARING ON THE VACATION REQUES'P SAV #69-10 BY TFiOMAS AI.BERS:
Mayor Kirkham read the Public Hearinu Notice.
Mr. J.B. Pollard, 1376 Highway #100 N.E., said that he lives on Lot 1,
Subdivision of Lot 10 and is adjacent to Johnson Street. He said that
,7ohnson Street was abandoned by Rodney Billman during the development of the
area. The City has made no attempt to maintain the street. There was a
petition at one time for something to be done about it, and the City did put
down black dirt and cultured sod and he said that he has taken care of it
since. He also had his yard landscaped. Johnson Street is now used as a
play ground which helps keep the children out of his yard. He said that he
would like to go on record as not wanting the land back. He wondered why the
City is suddenly thinking of vacating the street when it has sat as it is for
so many years.
The City Engineer explained that this vacation was not initiated by the City
but by a petitioner. The owner of some land would like to build a garage and
he did not have enough room. The petitioner was Thomas Albers, Lot 1, �lock
2, Swanstrom's Court. He explained that if it was vacated, the City would have
to have an easement as ther� .�� a 14" water main running in �ohnson Street.

Mr. Thomas Albers, 1390 Skywood Lane, explatined that he made the request for
the vacation of that part of :7ohnson Street adjacent to his property. There
is not enough room to build a double car attached garage. If he put his garage
in the back yar3, then his children would not have much room for play. He
said that he only needed an additional 10 feet, so with the easement, he would
still have enough room if the vacation was granted. His request was only for
that portion adjacent to him, but the Planning Commission at their Public
Hearing decided to include all of ,Tohnson Street as it is not travelled. He
said that he found that the taxes on the additional footage is a nominal
amount. He commented that he had not meant to create any turmoil in trying
to upgrade his home, and that he hoped that the Council would honor his
request.
Mr. Raymond C. Prestemon, 1391 53rd Avenue N.E., said that he has Lot 18,
Block 2, Swanstrom's Court (south of Mr. Albers). He wushed,to go on record
as stating that he did not want the propexty back. He-wendered whether he
would have to pay taxes on only that. part he couTd tise�or;the entire amount
including the easement. Mayor Kirkham tol.d him tha�'the',taxes�would be on
whatever portion reverted to him. .

Councilman Sheridan said that he thoug'h�° �h�i�e m�y �be, a prciblem.' : As he recalled,
prior to the filing of the plat, Johnson Street was in'`existance`. If this is
the case, then the property will revert back ta Mr: Shields�as original owner
of the land, rather than to the plat. If the City chose to vacate ,7ohnson
Street, then Mr. Albers would have to negotiate with Mr.,Shields for the land.
Mr. Pollard read from a statement he had saying that``�Mr, Shields did dedicate
roads and streets as shown in the p1at,.and Johnson Street is one,of,them.
Mayor Kirkham asked Mr. Albers how much land thex'e is from the house to the
lot line. Mr. Albers said about 20' to 22�', Then he{would have to meet the
side yard requirements. Mayor Kirkham suggested'that perhaps a variance
could be obtained from the Board of Appeals, There would b2:no problem'with
any adjacent property owner as the easement-i�"next`to him. Mr. Albers
pointed out that he also planned a 6' to 8" br�ezeuiay between the house and
garage. He said that he had not had the land surveyed as yet, until he finds
out the results of the Public Hearing.
The City Attorney suggested as there is a question whether the land was ever
a part of the plat, that the City Engineer and himself check it out and report
on the findings. This will determine who the land reverts to. It was agreed
by the Council to move on to other items and come back to this when the
City Attorney and City Engineer have the information.
ORDINANCE #442 - AN ORDINANCE ADOPTING THE Bt7DGET FOR THE FISCAL YEAR 1970:
MOTION by Councilman Harris to adopt Ordinance #442, waive the reading and
order publication. Seconded by Councilman Samuelson. Upon a roll call vote,

VISITOR - THOMAS SWANSON, LOTS 3, 40 & 5, BLOCK S. CI�":r VIE'W ADDITTON:
Mr. Thomas Swanson reported that the people who appeared at the last Meeting
are no longer interested in building the�.r home with the larqe garage on this
property. He said that he would like to build a duplex, but was refused a
building permit because his survey only shows 80', although he said that he
does own Lot 5 which is a 40' lot also. Councilman Samuelson said that
granting this permit would mean that the City would have to refuse a permit for
the 40' lot, then it would go tax forfei�. A 40' lot does not meet the minimum
requirements. Mr. Swanson then showed the plans at the Council table.
Councilman Samuelson asked Mr. Swansor. if part of the buildings could not be
placed on Lot 5. Mr. Swanson said yes, but he preferred not to. Councilman
Sheridan pointed out that the Council's objection is not with the building,
but rather with the remaining 40' lot. He asked Mr. Swanson what his ob-
jection was to placinq it on Lot 5 also. Mr. Swanson �aid that he disagreed
that this is�an unbuildable lot as it was established when the subdivision was
made and recorded. The City Attorney said that this did not make any difference.
Mr. Swanson asked if this was ever tested in Court. The City Attorney said that
he did not know, but if this were true, then the Council would have to issue

DISCUSSION REGARDING SPECIAL USE AERMIT FOR GOLF DRIVING RANGE, RE UEST $Y
ROGER JONES:
The City Engineer explained that there was a need for some easements or. an�
agreement to dedicate the easements. This land is undeveloped at p�e�en� and
there are no road patterns established. He said that he would suggest a 33'
easement on the south, a 33' easement on the west and a 50' easement facing
University Avenue for the future loop. Councilman Sheridan asked who owns
the property north of the driving rancje. The City Engineer replied Mr.
Barbush. The City Attorney added that Roger Jones is buying the land on a
contract for deed. Councilman Sheridan said that rather than get an agreement
between Mr. Barbush, Mr. ,7ones, and the City of Fridley for the future
dedication cf the easements, why not just get the easements now. An agree-
ment would not be binding if the property changed hands, but the easement
would. It was agreed by the rest of the Council that easements should be
acquired.
Mr. Roger Jones then arrived at the Meetin� and was informed that the City
would like the easements now and Mr. Jones had no objection. He said that he
would like the permit to run for a longer time than one year. He said that
he understood that if a time was not specified that it would k�e for one year.
He felt that as he was investing a considerable amourit of money he would like
to have some assurance that he could continue operations after one year. As
the sewer, water, storm sewer and streets go in, the assessments will be so
high, that an operation of this sort will be uneconomical, and the driving
range will have to advance to a higher larid use.
Councilman Samuelson said that there was no motion made based on any one year
premise, only that the concept was approved. He said that a permit could not
be issued until the final plans are approved. The concept approval gives Mr.
Jones the riqht to go ahead and start grading etc. Nlr. ,7ones said that he did
not as yet have a permit for the actual driving range. Councilman Samuelson said
that the building permit and the spec.i.al use permit will be considered together
after the final plans have been approved. He told Mr. Jones that the next
step is for him to submit the final plans. The City Attorney pointed out that
a special use permit is for an indefinite time unless stated otherwise on the
permit. Councilman Samuelson pointed out that if the ownership is transferred,
then a special use permit is void. Councilman Sheridan said that the Council
would have the right to consider such facts such as, if he did not open for a
year, or allowed weeds to grow wild, at the time of renewal. The City Attorney
commented that as the Council has given concept approval and this means that
he has the right to go ahead and grade the land, then they are committed to some
extent to grant the permit.

Fire Protection Contract with Hilltop Village.
I checked with the Chief of the Spring Lake Park Fire Department, as to the
number of. runs they make to tlie Village of Hilltop per year. He stated that
they made 5 or 6 runs per year. ,
Our dep�rtment is in need of another 1250 Gallon Per Minute Pumper, and also
a 100 £oot aerial ladder. The cost of a new punper would be around $40,000.00
completely equipped, The new aerial ladder would be around $65,000.00 . These
are at �odays prices. I feel the department should be authorized to start
d.rawing up the specifications fox these two pieces of equipment. It takes from
1S months to 2 years from the time the bids are let, before you get delivery.
The subject of a contract with Hilltop was diseussed at the last fire meeting,
and the auestion was asked what �aould we benefit from this. I stated that
Fiilltop would be helping us to pay for new equipment, and thereby save the
taxpayc,rs money, Some of the men were opposed to protecting Hilltop.
We would also gain some money in our Pension Fund from the 2% rebate on the
insurance written in Hilltop.
I recommend entering into a contract with the Village of Hilltop, to £urnish
them fire protection, for a five year period, with a standby fee of Three
Thousand Five Hundred Dollars ($3,500.00), and a service charge of One Hundred
Fifty Dollar� ($150,00) Per Call.
I also recommend that the Council autherize the Fire Department to draw plans
and specifications for a new pumper, with the objective o£ having it delivered
in 1971.

The Council of the City of Fridley do ordain as fallows:
SECTION 1. For the vacation of a street described as follows:
All that part of Johnson Street described as follotas;
All that part of the street right of way that lies East
of and adjacent to Lot l, Block 2, Swanstrom's Court
Addition and between the Easterly extensions_o£ the
North and the South lines of Lot l, Block 2, Swanstrom's

On �'age 6, the first para�raph explair�s the use for whic}1 tliese lots can be put as
(Lots 32 tlarough 35, Block 10, Spring Broolc Park) for a driveway for entrance
and exit to the Planned Development property. The commerci.al area, zoned R-I,
may be used for parking. Darrel Clark said that when the new zoning ardinance
becomes law, the parking requirement will be 1.5 stalls per unit plus one half
sta11 for each addit:ional bedroom, or two parking stalls for two bedroom units.
Mr. Solveson supplied ttle following infor.mation relating.to the specifi�
details asked for by the Plaiining Commission at the last meeting: The fence on the
North side of the multiples will be a 5'0" chai_n linlc fence with redwood slats;
in the same area, evergreen shrubs (Yew and Juniper) 4' to 5' high will be used;
ttiere will be deciduous shrubs (barberry) 2' high for parkzng lots; the trees
around the complex will be 3" to 4" caliper,]_ocust, ash and Sargent (flower.ing)
crabapple 3" caliper; littl_e leat linden, 3" caliper. There wi_11 be a five foot
sidewalk the length of the Planned Development on East R.i.ver Road.
He continued that the parking lots will be dropped about 2 feet, .and the cars
probably will not been seen from the street. They will have 108 units and have
plans for 162 parking stalls, but they feel t�iey can add additional stalls to con--
form to the new zoning ordinance.
In repl.y to Mr. Potts' question, the Chairman said the Commission was approvin_
the basic concept and at some future date, ttie petitione'r will have to come back �
in with a specific plan for the shopping center. He felt the shopping center kouJ_c�
be some���hat in the future. Mr. Solveson said that cohen the shoppzng center is
developed, the traffic flow could be studied and a request for a traffic sign made
at that time.
The garbage prablein would be handled by a dumpster, as garbage cans were not
allo�ved for apartments, and incinerators would be objectionable, too. It is pos-
sible only in high rise apartments to have.inside garUage disposals.
There will be parking along East River Road and whatever else depends upon
what the City does with the 24 foot easement, The runoff of excess water will be
controlled with catch basins and outfall into the creek.
Regarding the construction of the undergraund garages, Mr. Solveson said they
would probabl.y be concret�, poured if done by a smaller contractor, stucco could
be used. The garages will take more study.
MOTION by Jensen, seconded by Mittelstadt, that the Planning Commission close
the public hearing for the approval of the Preliminary Plans for the Planned DeveloY-
ment District (ZOA ��68-10) by Fiocaard Dumphy. Upon a voice vote, all voting aye,

Service, were present.
The Engineering Assistant distributed maps of the proposed preliminary plat
to the Commission. , .
Mr. Elliason sai�1 the County Engineer wants to drop the grade some and use
the storm drain going do�an Old Central to take the water away fron� the County right
of way. Other than that, the plans remain the same as discussed at the Planning
� Commission meeting of October 22, 1.969.
Mr. Jensen said that the comments of the Subcommittee are generally in regard
to the apparent n��ed for the sanitary" sewer easement to be provided on the South
line of Lots l, 2 and 3 of the proposed plat to provide sewer service far these
lots. He verified the fact that the dash lines on the proposed plat indicate the
required setbacks. Inasmuch as a building is to be set far back, and the North
portion abuts Spring Lake Park, it is to the developer's best interest to provide
sewer along this East/West line; otherwise they found no general fault with the
layout of�this plan.
It was noted there is no sanitary sewer on Osborne Road. Also, on Page 2 of
the Plats & Subdivisions-Streets & Utilities Subcommittee minutes of October 1,
1969, the first sentence of the second paxagraph, there was an omission which made
the sentence ambiguous. The correct wordir.b should be "---- it was pointed out
that the structur.es on the South side of Osborne Road are serviced � water only".
The F.ngineering Assistant reported that Mr. Astleford called him, and voiced no
opinion about the platting.

The 'Loning Ordinance states that t:tie requirements for parking stalls are 1 1/2 �
- plus 1/2 for each additional bedroom. The Chairman said, when he drove around, he
found in some locations the space, off the street, was about one half full. People
were not making use of the parking space provided. He noticed in driving through
residential areas, that there were about just as many cars parked on the street in
front of single homes. Mr. Fitzpatrick,felt that�the reason for this in front of the
pxivate residences was that the people did not have enough room. The Chairman won-
dered if the City is not just as responsible for requiring single family owners to
refrai.n from on street parking as the apartments. The problem is with the larger �
complex, there is parking on�the street and not all the sralls are used in the parkin�
lots. The smal�.er apartment units do not seem to have this problem in most cases.
The trend seems definitely to point in the direction of two cars per family, and
sometimes more, as the children reach college age. An apartment with three bedrooms
would have thr.ee cars. The large complexes in Fridley were nat built until two
years ago indicating this is a relatively new problem. Also, sometimes a boat is
added to the parki.ng lot. The Commissian felt "No Parking" signs might help keep
the peop].e parking in the lots provided for that purpose.
MOTION by Jensen, seconded by Fitzpatrick, that the Planning Commissiori
recommend to Council that the Zoning Ordiriance be changed or modified to include a
provision for two parking stalls per unit for all multiple dwellings. Upon a voice
„ vote, all voting aye, the motion carried unanimously.

Mr. Duane Grande presented the request to the board.
Mr. Grande explained the changes in the proposed addition to the warehouse.
The exterior addition would amount to nothing more than an enclosed entry
or vestibule with the exterior finish being of painted scored concrete block
and rib face concrete block. The parking lot was designed for a total of
235 parked cars with the blacktop area to be surrounded by a blackCop
burm in order to direct the drainage toward the area directly North of the
building addition. This parking area to be seperated from the building
by a landscaped area. He explained also that in order to provide a means
of egress to the entry located on the West wall of the building, the City
obtained an easement on a strip of land directly West of the building which
the Target Company would blacktop. This access would be used mainly for
small vans delivering papers used for the data processing equipment.
MOTION by Bierman to recommend approval of the proposed modifications of
the building subject to the original stipulations and conditions.
Seconded by Tonco. Upon,a voice vote,there being no nays, the motion carried
unanimously.

As yau are awar�, we were in negoti�tion with Minnesota Transfer
Railway Company for about a year to get access to Locke Park. I am
happy to report that we have received the attached 50 foot wide easement
fram 73rd Avenue to Locke Park on the West side of Target Warehouse.
This will provide a good an.d safe access to Locke Park instead of the
access we have from Highway ��65.
We are working �,�ith the Target people to see if they will black-
top the road at least up to their delivery entrance, which is on the
West side of their building.
It looks �1ike ws might be able to get the Target people to do
this work early next spring.

Dear Dick:
Following are some of the items that I have discussed
with you, at a meeting earlier. I am writing these few lines
just as a reminder to you.
1) INTERSTATE 694 INIPROVEMGNTS
East River Road: You indi_cated that your office
is working on the plans for installing traffic
signals at the ramps and the project will be let
in February, 1970, with the work to be completed
by the middle of the year.
" 2) TRUNK HIGHWAY ��47 IMPROVEMENTS
a) Traffic signals at 73rd Avenue: You will be
� supplying us with an agreement covering the
signal at this location in the n,ear future
so that the monies the City has budgetted in
1969 could be encumbered and the installation
of a signal at this locati_on will be done
early next year.
b) Proper coordination c+f signals: You are working
on getting all the signals.on ToH. ��47 tied
in and working on a coor.dinated basis so that
traffic could move e�ithout excessive stoppage
on the highway. As I have mentioned to you,
some of the people have complained that they
can make better time on side streets than
travelling on the highway.

making studies to see that at signalized
locations, where it is.safe and advisable,
to install signs allowing right turn after
stop .

e) Fi:nal costs for signals at 53rd and Osborne Rd.:
You are sending us the final costs so that we
can supply you with the City�s share of the
costs which is budgetted in the 1969 budget.
3) TRUI�TK. HIGHWAY ��65 IMPROVEMENI5
a) Central Avenue: You are working on the plans
for improvement af signals at the intersection
of Central Avenue.
Please send us your preliminary plans so that
we can coordinate tYie construction with you
as we are improving West Moore Lake Driye on
the West of this intersection.
b) Mississippi Street; As I indicated to you
that the signals`�standards have to be moved
to get them out of the traffic flow and also
we would like to coordinate with you the
extension of the sidewalks in this intersection.
Please supply us with the preliminary plans so
that we can work with you in the beginning
stages.
c) 73rd Avenue: As you know we have improved
the section of 73rd Avenue between Highway
��65 and Central Avenue. This makes 73rd
Avenue to be a through street from ToH, ��47
to Highway �10 and it is carrying a large
amount of industrial traff_ic. We are anxious
to get a signal at this location.

to check the warrants for signals at this

damages by Mr. Bruce Hoch, 7815 Apex �ane, Fridley,
Minnesota.
Previous claim submitted by Mr. Hoch was an estimate
of the damages caused by tt�e malfunction of the lift

of furnace.

Transmitted herein please find the Final Estimate Voucher for work on
the above referenced project by Marvin Rehbein Contracting, Inc. Field
staking and general inspection of the work was performed by this firm. The
work was completed in conformance with plans and specifications on file in
the City Engineer's office and authorized by contract dated May 12, 1969.
On Wednesday, October 29, 1969, the completed project was inspected
by Mr. Duane Brown and Mr. Dennis Wildemuth of the Minnesota Highway De-
partment, District 5 office in Golden Valley. Based on their observations,
the project will be recommended for acceptance by the Minnesota Highway
Department for perpetual maintenance. A letter confirming their findings
and recommendations will be forthcoming within the very near future.
It is hereby recommended that the final payment for the project be
made upon acceptance of the work by your Honorable Body and subject to the
receipt of confirming correspon�ieace from the Min:�esota Highway D�nart*.nenr
accepting the work for perpetual maintenance. It is further recommended
that the one year guarantee period stipulated in Section 49 of the General�
Conditions of Contract commence from the date of acceptance by the Minne-
sota Highway Department.

Commu�ications concerning speed limit on Osborne
Road from Spring Lake Park and Woodcrest �TA in
the November �, 1969 Council Agenda
The Chief of Police contacted the Anoka County
Highway Department and received background on change of
speed limit from 3D MPH to 40 yIPIi on Osborne Road. He
also had the Fr.idley Police conduct radar checks on
NovemSer 6th and 7tE� on eastbround traffic. An extract
from the Council memo, to includ� the Minnesota Hi.ghway
Department survey and Fridley City Police radar check foll.o�ws.
The Chief of Police feels that the 40 :IPH spee3 limit
estaUlished is reaso.zable and prudent and that there has
been no appreciable increase in the speed habits of
motori_sts using the street. The City Engineer concurs with
speeds established, however, recommemds expediting of side-
walks as approved in 5 i'ear Program,
