TO WHOM IT MAY CONCERN:
Notice is hereby given that there will be a Public Hearing of
the City Council of the City of Fridley in the City Hall at 6431 University
Avenue Northeast on December 8, 1969 in the Council Chamber at 7:30 P.M.
for the purpose of;
For the vacation (SAV ��69-11) by Mike E. 0'Bannon
of streets and alleys described as follovs:
All of the streets and alleys within and/or
adjacent to Block 1, Irvington Addition except
the street right of way that lies North of the
Easterly and Westerly extensions of the North
line of Lot 1, Block 1, Irvington Addition,
All lying in the South half of Scction 13, T-30,
R-24, City of Fridley, County of Anoka, Minnesota.
Anyone desiring to be heard with reference to the above matter
will be heard at this meeting.

October 1, 1969 with the further recommendation that the final plat show proper
sanitary sewer easement along the East/West line of the plat, approximately 250
feet South of the Northern boundary, and include appropriate utility easements as
determined by the Engineering Department. Upon a voice vote, all voting aye, the
motion carried unanimously.
3. VACATION REQUEST: SAV #69-11, MIKE 0'BANNON: Vacate all streets and alleys
in Block 1, Irvington Addition.
Mr. 0'Bannon attended the meeting, but was unable to stay until his request
came up.
Darrel Clark explained that the request was for the vacation of some old
streets and alleys platted years ago as part of Irvington Addition and his plat,
Heather Hill, will take the place of that old plat.
The Chairman felt the vacation should not be granted unless all the people
involved signed a petition. Mr. Jensen said the description should read "all
streeCs in Irvington Addition with the exception of Rice Creek Road. The Eagineer-.
ing Assistant said there was another lot, Lot 30, Block 2, Irvington Addition plus
30 feet abutting the West line of Lot 30. Mr. 0'Bannon indicated earlier he
had the signature of Mr. Ed Chies, but it was understood he was not the fee owner.
MOTION by Fitzpatrick, seconded by Mittlestadt, that the Planning Con�isaion
recommend approval of the Vacation Request, SAV #69-11, Mike E. 0'Bannon, for the
vacation of the streets and alleys in Block 1; Irvington Addition with the exception
of Rice Creek Road, subject to receiving signatures of all owners in Block l, and
those adjacent property owners. Upon a voice vote, all voting aye, the motion e8rried
unanimously.
� 4. REZONING.REQUEST: ZOA �69-12, ROBERT V PRITCHARD: South 2/3 of Lot 4,
Auditor's Subdivi�ion. Rezone from R-1 to R-3A.

I�IDTION by Jensen, seconded by Mittelstadt, that the Planning Connnission set the
public hearing date of December 3, 1969 for the rezoning request, ZOA i69-12, by
Robert V. Pritchard for the South 2/3 pf Lot 4, Auditor's Subdivision /108, to be
rezoned from R-1 (single family dwelling areas) to R-3A (apartments only). Upon a
voice vote, all voting aye, the motion c.:rried unanimously.
5. MULTIPLE DWELLING STUDY IN CITY OF FRIDLEY:
The Chairman said that he had talked to the City Engineer and was informed the
study will be ready for the next meeting, as they are making more studies of the
commercial properties.

REGARDING STREET IMPROVEMENT OF 612 WAY
RE: Improvement of 612 Way from East River Road
to alley on the East
Dear Property Owners:
The Public Hearing for improvement of this section
of street was held on July 14, 1969 before the City Council.
The City Council had considered delaying the improvement
of this street beyond 1970.
There is a request from Orbit Investment Company, Inc.,
which is planning to build five homes on this street,to improve
61'� Way so that they can get approval on the financing by
FHt�. The City Council is planning to discuss this item at
their meeting of December 8, 1969, at 7:30 P.M. Your presence

Dear Property Owners:
The Public Hearing for improvement of these streets
was held on July 14, 1969 before the City Council.
Since that Public Hearing there has been a new
development. North Suburban Sanitary Sewer Distrist is
planning to put in sanitary sewer force mains to serve
Brooklyn Park and the surrouading area,under 69th Way
and Hickory Drive and Hickory Circle.
This work is proposed to be done in the area from
April to August, 1970. The street improvements work will
be doae after this time.
The City Council is planning to discuss this item
at their meeting of December 8, 1969, at 8:00 P.M. All
interested parties and property owners are requested to
appear at this meeting.

and also with Columbia Heights and Minneapolis.

• 4. The Railroad should control any excess of dust (by watering if necessary),
blasting and noise to minimize the adverse effect on the surrounding
neighborhood.
S. Sound deadening on the retarders be resolved before starting construction.
The Board also suggested that the Railroad and their contractor evaluate the
structures in the area prior to construction so any charges of damage because
of blasting will be easier to detect.
The Buildfng Inspector suggested a seismograph be used at all times to check
vibrations from the blasting.

Mr. Don Nelson, owner and Mr. John Polym�ros, representing Sussel Company were
present to present the request.
Mr. Polymeros explained the existing house is facing Bacon Drive and the garage
will be 20 feet by 26 feet, attached onto the North side of the dwelling.
Mr. Nelson said there are other houses on the street with the same type of .
garage. He explained he couldn't build a single garage and stay within the
code requirements, and [o build the garage in the back yard would�make the exit
on Osborne Road.
rir. 1Jelson brought with him a letter signed by ten (10) families within 200
feet of his property. The letter.stated that there were no objections to the
garage being setback 8 feet instead of 17 feet, 6 inches from the side street.

MOTION by Ahonen to approve the request for the following reasons:
1. There were no objections from neighbors within 200 feet.
2. There is a hardship caused by the particular tayout of the building on the
lot and the alternate plans would most necessarily mean exitiag onto Osborne
Road which would create a traffic hazard.

Mr. Bud Berry was present to present the request to the Board.
He informed the Board that he had applied for, and was granted, the same requests
in 1965. He did not realize that when this was granted in 1965 that it Would
expire if he did not start construction.
Chairman Mittelstadt went over the City Council Minutes of April 1965, that
�oncerned this property. He explained to Mr. Berry that the City Codes have
changed since 1965 and some of the stipulations the Council stated then were
no longer correct. This would concern the enclosed parking stalls and�also off
street parking. Also, it would be necessary to dedicate more land at the
Northeast corner of the intersection of Hickory Drive and East River Road.
_ Mr. Berry answered Chat this would be worked out with the Engineeriag aiud Inspection
Departmsnts. iie stated the lot is 210 feet by 75 feet with 15,750 aquare feet
which is more than the minimum lot area requirement. Tliere was no current survey
available to check these figures. �
, Mr. Harris asked Mr. Berry if he could get a plot plan of the corner, ahowing the
land to be dedicated for the corner, which will be decided by the Engineering •
- Department. .

MOTION by Harris to table the two requests until the December 10, 1969 meeting,
and in the meantime, the applicant.should: •
1. Get a plot plan showing finished corner. '
2. See the CiCy Attorney and get [he papers drawn up for the dedication of
1$nd at the intersection of Hi kory and East River Road.
3. Bring in an elevation of the proposed dwelling so the Board can see what
will be constructed.
4 Consult with the Building Inspection Department to work out any problems
that may arise at to drainage, parking required, etc.

the issuance of s�ne on-sale liquor licenses by the City of Fridtey
under legislation passed in the 1969 session.
As your records wiil indicate, we have had a restau�ant oQeration
at our establishment for many years, and appropriate licenses therefo�.
It is our belief that we w�uld qualify for the issuartce of such a lice�se.
The purpose of this letter is to advise the Counct) of our
foregoing understanding and to indicate that we may be interested in
making application for such a license at such time as the Council may
decide to proceed with the issuance of o�-sale liquor licenses.
