DISCUSSION REGARDING IF AND WHEN 39TH AVENUE NORTHEAST FROM �AST
RIVER ROAD WAS VACATED AND IF SO, WHEN, AT WHOSE REQUEST: (ON
AGENDA AT REQUEST OF COUNCILMAN LIEBL)
The City Manager said that he had been asked the status of the
easement at the north end of the N.S.S.S.D, property. He said
he asked the City Attorney to check this out. The City Attorney
said he did not have all the Eacts yet on whether or not it has
been vacated. He said he did not find any evidence that it had
been vacated.
Councilman Liebl asked if it would, then would it be considered
a street. The City Attorney said yes, unless something else
comes to light, The City Manager said N.S.S,S.D, had stated
they could find no records on thi� at Anoka County. Councilman
Liebl said then it might be that the fence was put across public
right of way. The City Attorney said the City Engineer thought
it might be a question of whether there was a dedicated street
or a private easement. The City Engineer suggested this be laid
over to the next Regular Meeting.
MOTION by Councilman Samuelson to table this item to the next
Regular Council Meeting. Seconded by Councilman Harris, Upon a
voice vote, all voting aye, Mayor Kirkham declared the motion

DISCUSSION OF SEVJER AGREEMENT WITH MOUNDS VIEVl:
The City Manager said that representatives from the Village of
Mounds View came to discuss with the Finance Director and himseli,
the question of how the residents hooking onto the sanitary sewer
line would pay.
The Finance Directaz said that 3 residents are currently hoo]ced
onto this line naa. He said that the area is a 2 block area on
Sta.nson Boulevard south of Osborne Road. He said they would pay
N.S,S.S.D, directly and would pay the same use charqes and the
same connection permit fee as the City o£ Fridley. He explained
that this is �ust in preliminary stages and will have to come bacY,

in agreement with this.
Councilman Sheridan said that then we would be billing the Village
oi Mounds View directly, and the Village of Mounds View in turn
would bill the residents. Councilman Samuelson said he thought
that the billing sh ould be based on a sliding scale.
The Finance Director said that for the year 1969 it would be $6.88
pe�r foot. Councilman Samuelson said he thought a cut-off date for
any partacular figure shou�.d be established. Councilman Sheridan
agreed and commented that then in 1970 the rate would be re-
negotiated, probably at a higher rate. He said he felt �hat
Mounds View would like an established figure for 1969 and sug-
gested the figure o£-$6.88 per foot as the Finance Director
recommended .
Mayor Kirkham then suggested that the Council move on to th e
items the audience are interested in.
DISCUSSION OF ADDITIONAL ACTION COUNCIL DESIRES OF ADMINISTRATION
PRIOR TO CONSIDERATION OF RESOLU'PION ON STORM SE4VER PROJECT #80:
Councalman Harris said that this problem is still open and more
discussaon and research will be necessary be£ore making a deter-
mination. T3e said that he would suggest that the Ca.ty Engineer,
Consulting Engineer, City ManageY and the Council set a date far
discussing this and ironing out some of th e various problems.
Councilman Sheridan said that although he was not at the Public
Hearing Meeting, he did go over the Minutes carefulZy, and agreed
with Councilman Harris that a meeting should be arranged. He
suggested some kind of a ten year storm sewer program similar to
the ten year street improvement program that has been put into
effect, to include all those portions of the City not now in-
ciuded in a storm sewer district. He said that he felt thaf. the
ten year street improvement program was acceptable to the Citizens
after they understood it, and perhaps something like this could be
worked out for the storm sewer systems sta.11 to be installed.
Councilman Samuelson agreed and thought there would be less con-
fu�ion on the part of the Citizens if a long range storm sewer
proposal was presented. Councilman Harris agreed and felt that
after a staff and Council Member meeting, more concrete answers
could be given to the people. Councilman Lieb1 agreed, and com-
mented that there were streets petitioned for that cannot be done
because oP the necessary storm sewer. He said that it-just is not
possible to put in a street without sol.ving the storm sewer problems
first.

needing storm sewer be held in abeyance. Seconded by Councilman
Samuelson. Upon a voice vote, all voting aye, Mayor ICirkham

A Visitor to the Meeting saa.d that they were in £avor oi the
water line but not the street improvement on 66th Avenue. Another
Visitor agreed with him. Mr. R.D. Habel, 392 66th Avenue said
that he did speak in favor of the street impravement, and that
he was in favor of the package deal, as was the majority at the
last Meeting. Mayor Kirkham told x.he people in opposition that
this has already been voted upon, and their only recourse would
be a petition against the project, if chey so desired. Mr. Hab�l
said that he understood that the assessment would be higher, i�
they did not put in the street this year. The City �ngineer said
that that was correct as it would entail new studies �or the cost
as every service would have to be jacked under or trenched across
the street every 70' - 80'. They would also have to cross the
main at 67th Avenue to the south. This way of putting in the
line would be much more expensive. Iie added that keeping 66th
Avenue in adequate condition also cuts into the maintenance funds.
Mr. Habel said that many years ago, there was talk o£ putting in the
water main, and at that time the cost would have been about $200.
It seems that the residents are being penny wise and dollar foolish.
In 5 years time it will cost still more.
Mayor Kirkham told the objectors that L-he Council would be liappy to
consider any petition they would wisl� to circulate.
Mr, Habe1 asked if this wauld include sodding and blac]c dirt,
Mayor Ka.rkham said that that would depend on how the bYd was let,
It has been found to be cheaper for the people to put in their
own dirt and seed than to include it in the specifications.

The City Engineer showed the plans £or the garden center. He
said that they are requesting approval on only the garden center
now, as their plans are not completed for the produce section
yet. He said that there is also a gas station shavn in the
corner, but this is not included in the request. He said that he
has made a request to the St. Paul Waterworks, to see what can
be done about crossing their easement. He said that there are
5 entrances shown on the plan and he feels that this should be
reduced to three onto the service road. He said that it is going
to be bricY. and wood, with shingles on the roof, and the north
side is going to be block. Councilman Samuelson said that his
entrance should, iE possible, line up with the service road to
the south. He said that there is a N.S.S.S.D, line running through
there, and they will hook up to this line for sewer service.

to utility and drainage plans to be submitted to the Engineer,
and eliminating two driveways, and dedication of the roadway

Mr. Schroer said that the next portion they will. start working on
is the produce section.
The City Engineer said that the southwest corner of the hill which
is on the St, Pau1 Waterworks easement needs to be cut down Eor
visibility, or removed. They have agreed to cut it dawn verbally.
Councilman Sheridan asked how many parcels this rezoning request
will be split into. Mr. Schroer said two phases. He said this
garden center will take about 40�'. His second phase (the pro-
duce portion) wa.11 take about 300' making a total of 700'. This
is the portxon that he is required to have all the plans done on
in 6 months time. He said that he would like to get the garden
center under way within 2 weeks, then he could proceed with the
plans for the produce portion.
Councilman Samuelson saa.d that the dedication of the roadway will
be no probZem, and this will be dedicated by the developer when the

� The City Engineer said that he would sugqest putting in the
streets that are possible now and agreed with Councilman Sheridan's
proposal for a long range plan whereby the districts would be large
enough to keep the costs down.
MOTION by Councilman Harris to ask the ?�clministration to set a
meeting with the Council as soon as possible for consideration of
this starm sewer problem, so that it can get back on the Agenda
as soon as possible and still possibly be included in the 1969
imnrovement pro�ect.
Mayor Kirkham said possibly the storm sewer could be put in, in
the future at 68th Avenue and 7th Streei: if enough easement width
cauld be acquired. Councilman Liebl said that this was one of
the things that would have to be consic7ered.
Mr. Thayer said that this proposal was brought before the people
about 3 years ago and it was turned down. Nothing has been done
to change the original plan. Iie said that when the developers
of Christie Addition put in their storm sewers, they realized that
� they would have to run north to Riae Cree]s, and it was not devel-
oped to drain the Riedel property. He asked that the ramifications
be considered carefully beiore any decision i� made. Councilman
Samuelson said that they Pelt that the cost a� a new study would
be an unnecessary expenditure until the ieeling o£ the people
was determined. Mr. Thayer said that he felt that it would be
hard to prove any benefit to the people. A Visitor to the
Meetiny asked why it cannot run south. Mayor Kirkham told him
that this will be looked into at the staff ineeting. Mr. Thayer
brought up the point that a dollar held in abatement in 1954, is
not the same as the dollar in 1969; there is no equalization.

Enganeer commented that this would complete the utilities in this
street. He added that iF the street is not put in with the water
Iine, it will cost more ior the water improvement. Councilman
Harris added that the cost oi the water la.ne would include patching
of the street etc „ but ii the street would be put in later, the
people wauld actually be paying on the street twice.
A Vis?.tor asked if there was any time limit as to when a person
would have to hook up. Mayor Kirkham said that the residents
could hook up at any time they wished, as a residential hookup
would not disturb the street. Councilman Sheridan added that in
the event that a weZl became inoperable, however, they would not
issue any new well permits and the residents would have to hook
up. The City Manager said, as was pointed out befose that a
resident could hook up to the water line, but retain the well for
use in sprinkling, so long as the well system is separated trom
the City system.
A Vasitor asked how long it would be between the time the street
is torn up to put in the water line and the completion of the street. �
The City Engineer said that a contractor cannot always schedule his
work exactly, but that the street would ]ae completed by the end
of September. As it is required to let the contract on a com-
petitive bid basis, xt will be 2 or 3 months before the contractor
can dig. He also pointed out that we like to see�the trenches
settle for a month before L-urther work is done. He added that the
watar line would be about 7' deep. A Visitor said that it was
his undexstandiny that a street assessment is spread over 10
years with 6/ interest. He was told that was correct.

done. Councilman Harris said that he would rather see these
two streets held in abeyance, rather than deleted, until the
Council can see what develops with Project �80.

School District ##14 dated January 16, 1969. Seconded by Council-
man Liebl.
Councilman Liebl said that he would like to have the Administration
find out the costs of puttiny in a sidewalk on the east side of
East 12iver Road. The City Engineer said that there was not
enough right of way on East River Road £or 5idewalks and it
would make it extremely dangerous for children to walk along
this street. He showed an alternate propasal that he said that
he would like to propose to the School I�istrict #14 showing the
walk-way down Riverview Terrace. Councilman suggested condemning
some l�nd on 61st Avenue 100' further south, L-hen signali�e the
intersection. The City Engineer said that the signals will have
to be complete 5emephores, rather tlzan flashing signals. The
Ca.ty Engineer pointed ou� that along Riverview Terrace the City
already has most of the necessary right of way, the south portion
would be just a walk-way. The City Engineer said that this will
have to be discussed with the School Board, and that he did not
think that enough right of way could be obtained without condemning
some homes on East River Road.
Mr. Richard Harris asked ii there would be sidewalks put in in
the sou�.h portion of Riverview Terrace. The City Engineer said
no, that easements would have ta be obtaaned, then it would be
�ust a walk-way. He said that he felt that this is the most
reasonable and safest way. The Council was in agreement with
the City Engineer's propasal.

Councilman Sheridan said that he felt that the City Engineer
should be awarded for the outstanding contr�utions Yxe has made
in the many facets oP the industrial development of the City:

to get assistance and he would like to suyyesc that the Adminis-
